First individuall As Mayor Courtney said more than half of the people diagosed with cancer
today will be alive in five years and today there are 6 million cancer survivors with that
in mind we would like to issue an invitation to all cancer survivors, their families and
thier friends to attend a cancer survivors day on Saturday.
Second individual/ Cancer Survivors Day is a celebration that is sponsored by Mercy Hospital
of Iowa City, Iowa City Cancer Treatment Center, and the American Cancer Society.
It will be held this Saturday from I to 3 in the afternoon at the Mercy Medical Plaza at
540 East Jefferson. Thank you.

,improvements for Part 3 have been accepted, and paving,
water and sanitary sewar hava been Installed for adJacant
Lot 24, Part 4. The City has not finally accepted Part 4,
so a cloud remains on the title to Lot 24, and the house
cannot be sold.
This Limited Release would transfer tha lIan to the
$10,000 escrow for 2.3 months, the escrow will protect
the City, and will permit sale of the house to be complet-
ed. Staff recommends approval.

(1) CONSIDER SETTING A PUBLIC HEARING FOR JULY 6,
1993, ON AN ORDINANCE AMENDING CHAPTER 18,
ENTITLED .HUMAN RIGHTS,. OF THE CODE OF ORDI.
NANCES OF THE CITY OF IOWA CITY, IOWA, TO EX.
PAND THE EXEMPTION FROM THE ORDINANCE FOR THE
RENTAL, LEASE, OR SALE OF HOUSING BY NON-PROFIT
CORPORATIONS.
Comment: The "Human Rights. currently permits non-
profit corporations to leasa or rent housing accommoda-
tions preferentially to persons based on their sex or the
presance or absence of dependents. This provision is ona
of seven exemptions to the section which prohibits
discrimination in the area of housing. This amendment
would expand the exemption to elso permit non-profit
corporetlons to sell, as well as lease or rent, a housing
accommodation praferentially to persons based on their
sex or tha presence or absence of dependents. This
amendmant was requestad by representatives of "Habitat
for Humanity, . an organization which attempts to provide
housing primarily for femilies in naed and wishes to begin
providing services in Iowa City.

OF CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE 1993 ASPHALT RESURFACING
PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE
OF SAID HEARING, AND DIRECTING THE CITY ENGINEER

Comment: This project involves the asphalt resurfacing of
various streets throughout Iowa City and one streot in
Coralvilla. Tho Engineer's estimate is $814,500.00. Of
this amount, it is anticipeted thet $40,000.00 will be
reimbursed from the State and Coralville's share will be
approximately $64,460.00.

Kubby! I had a question about f(l) and I am really Ann is here
tonight because she might be abie to answer it It is about the
amendment to the Human Rights ordinance. And I had thought
at one time we were also going to explore the issue of source of
income. That definition to be broadened to possibly include
vouchers and certificates to our Section 8 program. I know
that these are separate issues. But is the Human Rights
Commission looking at other amendments in the future to the
Human Rights ordinance as well a~ this.
Burnside! Yes. There is a subcommittee of the commission that for
many months has been working diligently on a very significant
amendment and revision of the entire Chapter 18 I.Iuman
Rights and this particular one before the council now is a very
limited one as your comment indicated to you. It is specifically
addressing this issue which was brought to the attention of the
commission by John Watson in the Habitat for Humanity
context. There is a much larger process that is on going.
Kubby/ Is there a specific project that is coming on line that is
having us to this separately and not waiting until we do the
. major amendment.
Burnside! yes the local Habitat for Humanity group is very close in
being ready to make it's first offer for to solicit requests for a
first offer. They hope to be actually working with a family by
the middle or end of this summer and they wanted to make
sure that they wouldn't be at crossed purposes with the Human
Rights ordinance.
Horow! In our packet we also have the guidelines for the HOME
program and I wondered whether the amendment of our
Chapter is in sync with those that are coming out of federal
guidelines for the HOME program.

Comment: At its April 15, 1993, meeting, by a vote of 6.0. the
Planning and Zoning Commission recommended approval of the
requested rezoning and OPDH plan for Village Green South, Parts
Threa-Eight, subject to certain conditions. Although the recom-
mendation is inconsistent with the staff recommendation on this
item, the conditions specified by the Commission heve generally
eddressed staff concerns about the density, design, open space,
and environmental considerations of the proposed OPDH plan.
The Fire Marshal has expressed his concern regarding additional
development in the area due to the temporarily limited number of
access points. No comments were received at the May 11, 1993,
public hearing on this matter. In a letter dated June 14, 1993, the

Horow! I have reservations about this. I have voted for it once and I
will continue to vote for it but the way it is designed and the
lack of finll knowledge as to when the future design will
complete this subdivision and others with the Fire Marshall's
concern about this makes me vel}' nelVous. And so I know
this isn't going to get anywhere but I just want you all to know
that I have a lot of reservations about this.
Nov! I think we all have some reselvations about this. Monica, I
have a question on the potential of street alignment and the
neighborhood concern about through traffic. I noticed on the
south point plat they did a little offset to prevent through
traffic from going too qUickly. Is it Possible that when the area
north of this development comes in we can do a little offset on
tha t also.
Moen! There is a direct connection. Are you referring to Sterling
Drive and it's future connection to Winter Green Drive. That is a
direct connection and I am not sure it is off set and would
achieve what you have in mind. There is a circuitous kind of
route between Scott Blvd. and Sterling Drive that may deter the
interest of people to go through tins neighborhood to get fonn
the eats to the west.
Nov! So you are saying I1mt if we ask for an off set in the next
development it wouldn't necessarily do any good as far as
slowing traffic down.
Moen! The way that Village Road is designed to date and that the
pattern that we expect to take in the future is sort of in an
elliptical shape. So that shape alone will detract fmm the
incentive to cut through 111is particular neighborhood. It is no
guarantee but it will be some form of detraction.
Horow! I can understand the neighbors concerns. I can understand
the neighbors concerns on Sterling Drive and r can understand
the neighbors concerns throughout Village Green. There are
going to be ways of people going from Scott Blvd. up to First
Avenue. r know this is not germane to this particular issue.
But it is of concern the traffic pattern through that general
area.

Kubby/ When we-I think it was two weeks ago when we voted on
the rezoning or two weeks before that. I can't remember. I
Illust apologize because I must have been asleep. I was
thinking this plot of land was contiguous to current
development because [ traditionally don't like us allowing
there to be empty space in between development because it
costs us more to provide city services through that new area.
And transit service will not be available to this area. So I am a
little concerned about that. There is going to be requests I
think. In the near future we are going to be asked and need to
put transit down. This isn't the rezoning. I guess I am
apologizing for past behavior and I really like the plat. Even
with those comments, the way that the subdivision is laid out
maybe rather traditional and not be exciting but it is compact.
It is a really efficient use of land. Often times we see
subdivisions with-they may be beautiful streets and nice and
curvy and lots of cul-de-sacs. But it makes it really difficult to
get around in a neighborhood and it is not necessarily the most
efficient use of land and it helps the subdivision be a tiny bit
more dense while still giving people enough space and if a lot
of people did this we may not need to annex more land as
quickly, etc. So I like the plat and I will be voting for it.

Mary Geaslandl S3 Regal Lane, Iowa City. I am here representing
the Senior Center Commission. And officially it is summer,
thank goodness. Hopefully some of this rain has ceased and
desisted. To kick off summer in Iowa City the Senior Center is
announcing it's one day at a time summer series. We have
developed a variety of very short term programs out of
consideration of summer time being a vel)' varied time and
people have a lot of different things going on. So retired people
are no different. So that they can have the time to spend with
family, vacations or reunions or be out on the golf course or in
their garden, we've developed through the entire summer a
variety of short tenn sessions, whether it's an hour long or a
day long. Vel)' varied. I'll just highlight a few. There's arts,
crafts, literature, nature, even if you've never been to summer
camp they've worked on a summer camp for seniors including
Sherlock Hohnes to car maintenance. One of the very first
things we did with the session was address lawn mower
maintenance. One of our very own Senior Center participants
who I happen to personally know and worked with when he
was employed at the VA, Monty Monsanto, did that little
program. Also another vel)' interesting program that even the
community might be interested in attending, it's coming up in
July. A social worker from the V A had the honor of being one
of nine people in the world going to the Netherlands and
spending four weeks there. She's going to be presenting a
program of the highlights of that. She worked directly with
Senior Center program and care of the elderly in the
Netherlands. I think it'd be a vel)' good comparison because
they do have socialized medicine there. For those of you in the
community who are of fifty-five years of age or older, we
invite you to come down even if it's just for a short period of
time. For those of you in the community who might have
relatives who are fifty-five or older, invite them down to the
Senior Center, they are welcome even though they are not
actually citizens of Iowa Clly or Johnson County. I belleve each
one of you city council members already did receive this
program. If nqt, I've given to the city clerk additional copies.
She'll also hqve those available here at the civic center.
Othelwlse people may call the Senior Center's number itself.

and I'm amazed at the number of Seniors who already know
about this program and are velY excited about it They say
they've been waiting for this for a velY long time. It makes so
much sense.

days at a time.
Geasland/ This is one of the things that we had gotten feedback on
previously. Out of consideration to all those comments, we're
tlying this summer and we'll assess it. Also I almost forgot to
sing the praises of our Senior Center 1V group. This is a group
of volunteers who spend an e.xorbitant amount of hours
developing video and cable skills. And also for your purview
and the community's for throughout the course of the summer
will be a short clip. I think about ten minutes, that this group
has developed highlighting One Day At A Time summer series.
Please check it out. I think their work is great and it's high
quality with a little bit of humor incorporated into it.

case scenario. We can only really hope until you get into the
thing.

Kubby! That would be great. My fear is somehow those tiny little
fibers some how filtering through the soil and getting into
ground water and I have no idea what kind of problems that
could cause way down the road.
Teny Sin~ I work for Shive Hattery Engineers and Architects
and for the consultant for the city for this particular project. In
regard to the asbestos issue, the existing roof assembly was
tested. Samples were taken of the products, submitted to the
hygienics laboratOlY at the University of Iowa. We do have
results. Those results are available in the specifications manual.
We located asbestos at the base flashings which are located at
the walls of the building, so the membrane itself in the ___ of
the roof does not contain asbestos materials. There's a quantity
approximately 600 lineal feet of material. The material will be
removed according to the OSHA and EPA regulations which
require that a licensed abatement contractor within the state of
IOIVa perform that IVork. The materials once they're removed
can be bagged and disposed of at the city landfill or a landfill
acceptable for those type materials depending on the removal
contractor who actually gets the work. The concern of the
materials being friable and getting i11l0 the ground water, the
parlicular materials In the roofing are already encapsulated in
the asphalt so they're not friable. They're not open to air as
they set today,'so there's not a potential for that type of
contamination.

the driver's education teacher to be a Christian martyr. I really
do. But he has got a good crew and they seem to be dOing well.
I just want to give people credit. Our business community does
actively take part in this city and with the school. I think
evel)' once In a while we should say thank you. That is all.
Ambr/ I think each one of the councilors is aware that time to time
we are asked to go out into the collllllunity and give various
speeches and talk and visit with groups. I know one of the
tracks that I run on is to give a bit of local government 101.
And I usually start by saying that the city council is charged
with hiring just three city employees. The city manager, the
city attorney and the city clerk. Now those of us who work
with these fine people on a day to day basis know the One and
competent manner in which they discharge the day to day
duties. Once in a while one of them has a chance to pop up and
be especially recognized for outstanding achievement. Not only
locally, state or national. But we have one that just recently
came back from a national institute which was the
International [nstitute of Municipal Clerks. Marian Karl' was
one of just a very few 3-4 people throughout the whole nation
that received that institute's highest award which was

Nov/ This has been lots of fun but I have a serious concern here. I
read in the newspaper and I assume it is correct because I also
talked to Linda Gently that our state board of liquor control
does not have any sanction for a liquor license-not renewing or
suspending liquor license for an establishment that sells to
underage customers Imless those customers are under 18. So
we are citing them between 18 and 21 and we have no local
law and no state law that gives us any sanctions for them. I
would like the rest of the council to go along with this because
Linda Gentry said that if we all wanted her to do this she
would look up some memos she had in the files and she was
pretty sure she could do something in the way of local
sanctions on this.
Horow/ I definitely would support that I think we have been
declared a safe substance free educational program community
and I think we need to-
McO/ Ifwe are going to pursue this, Naomi, [would not mind having
a little discussion about it with Linda. It has been my
understanding for a number of years and I have had [ don't
know how many conversatiOl~s with Marian, for example who
is involved in this. And to her city attorneys as to just how
much control we actually can exercise in this area. And in the
past I have been told on more than one occasion that because
of the way that the: system is set up. Because it is a state
license that is issued by the state that we are rather limited if
we have any power at all in this area. So, [ mean if Linda has
some new ideas on this I think we should hear them because I
think if we get into this area before- I guess I would like to
have a discussion first because [ think to get into this area and
to send her in a direction like that which is fine if the end
result will be something that is going to give us authority in
this area. But it is probably also going to take a tremendous
amount of work. With the workload that that office already has

would be interested in hearing that.
Nov/ I also felt the way you do. That this office has a lot to do
already and I did call her and she says that there is something
that she hasn't done before. She had looked up something. She
has a memo in the file and she can easily generate some
information on what we can and cannot do with this. And she
will give us a discussion on this if we all want it.
Horow/ I think that would be useful. Considering the cooperation
the chiefs of police have in this city, Ames, and up at UNI. I
think we need to look into this whole area a little bit more.

and for the city and in a certain way I want the p.h.s combined.
I think ideally what I would like is some kind of presentation
from staff as to-I knolV there is a map that is drawn into one
square mile pieces and they are colored meaning certain things
and I guess I would like to make sure I understand the map
through a presentation. Maybe with the county and the city
people there so that the staff don't have to do it twice and
questions from the county folks may be different than ours
which will help me understand the whole plan. I'd like to
request one meeting where we have a presentation about the
fringe area agreement as proposed and then a joint p.h. if that's

council election. That is a Tuesday. There is probably going to
be early voting, satellite voting at the library again as there
was for the primmy. So if you need an absentee ballot make

My last item was-I guess I want to ask Steve to do this. To
repeat what we decided about parking on College Street last
night.
Atkins/ I am not sure exactly so I willlty to repeat. It is a test. I
talked to Jim Bractel this morning and I understood that what
you wanted us to do was that we would sign it and not put in
meters and that we would probably have one hour signing and
that we would enforce that one hour signing and I1mt it would
be on the south side of the bridge which was 10-12 spaces and
that there would be three or four spaces up near Wilson' and
cab- bus area and that was it. That is what I understood.

answered and we got lots of information about the company,

application, to talk about some of our process questions. About
how we go about reviewing these kinds of applications and it is
unfortunate that we haven't had that discussion before and

again. Frankly, I need some guidance on this. ['i1ch time we
rehabilitate homes throughout the city and we talk about the
fact tl1atthey must be available for affordable homes. When
they are turned over we are hoping that they are going to go to
those people who need affordable homes n the future. Maybe
not the rehabilitation of homes but certainly the purchase of
homes under affordable housing program. I am going at this
the wrong way. What I am trying to say is that each time IVe
upgrade a home for someone who is purchasing it as an
affordable home, what happens to the assessment value of that
home. In that future, doesn't that increase the price of it. Do
we take that into consideration when we are projecting how
much that home has to cost in the future if it turns over.
Atkins/ If you will recall and Marianne can come to the microphone
or Pam. Either one of them. Remember one the programs we
had and we had to write the letter asking for a waiver because
of the value of the properties and they use a certain percentage
of it. We recently did that. The value of the property is an
element in the consideration of how much money is ultimately
can be put into the property.
Horow/ Is this going to mean that the city in the future will have to
put more money into these properties when they turn over.
Atkins/ Oh no. I think it is quite the contrm}'. I think the fact that
you take an old home and you arc able to get a family in them
that might not normally be able to get into ownership and
housing. We tl1en have tl1ese programs to get the homes
rehabilitated and up graded on their behalf at low cost. When
it is t11rned over it increases the value. It sort of a win win for
everybody. That summarize it.
Milkman/ Yeah, I think so. [think the resale Issue is a problem if
incomes don't rise at the same rate as the value of hou~ing. I
think that Is the point at which an additional subsidy might be
needed.
Horow/ So that each home will have to be a case by case situation for
council to determine whether or not we wl1l have to subsidize
its future turn over.
Atkins/ I don't know each home. That Is not a fall' way to do it.

Kubby / Once we rehab the house we have no other intervention in
that family life. They are not obligated to us in any way once
that loan is repaid. That is the way it is working.
Milkman! There is a big difference between the owner occupied
rehab programs that we have which we are doing partly
obviously to assist the low income home owners. But partly to
maintain our housing stock and to maintain our neighborhoods
and in fact maintain the tm; base. You know that is a very
different issue form the ones like the ones we move.
Horow/ What happens then \\1th the low income homeowner whose
home has been rehabbed and the assessed value goes up. They
have been counting on a certain-
Atkins/ What you are concerned about is that their ta.xes go up. The
value is going to go up. There is no doubt about that. The
taxes then accordingly will go up and as Marianne pointed out,
the concern is if the value and thereby taxes increase at a more
rabid rate then the individual. Then you have a problem. That
is case by case.
Horow/ I guess I am asking you what are we going to do about it if
we nm into this situation with more than one home. Is it our
responsibility.
Atkins/ I don't suspect that it is our responsibility that-that is the
homeowner. The owner of the property ultimately has to make
the financial decisions that is in his or her best interest with
respect to the value of the property and their particular income
and it Is almost case by case. am not sure what might happen
is an Individual maybe In the home, have It rehabbed, the
value goes go, taxes go up accordingly and [or some economic
problem occurs in their famIly and they may have to move to
another program. That doesn't change the value of the house.
Remember we an: a property tax base system.
Kubby / And some o[ the rehabs, even [or owner occupied, are
getting things up to code. I remember Pam telling us a stOlY
about an old woman having her bathroom in the kitchen and
that is just not appropriate and that that won't necessarily up
the assessment of her house tremendously but it is like a real
Important thing that we get involved. Gettlng up the code
Issue. But lIke with rental rehab If they can't jack the rents up.
The landlord can't get Involved In the program and have a
lower Income tenant If they do they can never get money
from us again becuuse-

Nov/ So many of these rehabs are just normal repairs. The roof wore
up and you replace the roof. It doesn't change the value.
Horow/ But there is a psychology. I have watched this with some
people. If they have lived in that home for a long time and
they are getting older. Do they really want to get it upgraded
or rehabilitated because they knoll' that they would have to
pay more taxes on it. It is a delicate balance.
Kubby/ Is it ever discussed, Pam, when you are looking at their
Pam ffinnm:eSl'he thing that triggers the taxes to go up is a building
. ,/ permit. Any exterior painting, plumbing permits, electrical
~ permits, the assessors don't receive those. It is the building
permit that triggers them to review that. And they necessarily
will not increase in value. We also have a after rehab appraisal
done. There is one project that we will be starting in about
three weeks. And the before value is like at $48,000. Not
quite $48,000 and the after value is only $65,000. So under
the HOME program I think our limit we cannot provide
assistance or we cannot have an after rehab value over
$75,900 or has that increased. It is about to be increased. So
those houses are 111e older affordable housing. That is the after
value and the people that we have on our waiting list have
houses 11mt are only assessed at-We have some at $20,000;
30,000; and 40,000 and youlcnow 1110se are 111e old houses that
are deficit.

Barnes/ There is one that is just a tiny little house.
Horow/ I just needed this because I have been asked the question
about 111e assessment and what our program does to these
homes and I honestly didn't know how to answer it. Thank

RESOLUTION AMENDING THE HOUSING REHABILITATION PROGRAM
MANUAL FOR OWNER OCCUPIED PROPERTIES IN IOWA CITY.
Comment: The Rehab staff periodically reviews the Housing Rehab
programs and proposes changes to meet the changing conditions under
which these programs operate. The lest time major changes were made
was in 1987. Changes are now needed because of a drastic increese
in material and labor costs, elimination of one federal progrem (Rental
Rehabiliteticn), and creation of a new funding source, the HOME
Investment Partnership Program (HOME). A memo explaining the major
changes is Included in the packet. The Housing Commission
recommended approval of the revised manual at its meeting on May 11.

Kubby! I have a question about rental rehab. In the memo it says if
in the future there appears to be a need or council wished to
have a such a program, meaning the rental rehab program, you
can apply for funds to the HOME program. And \\'e have some
money left in the rental rehab program. Is it that landlords are
not choosing to participate right now. Or do we still have a
waiting list for rental rehab. We don't, okay. Because it seems
to me that we have a lot of housing stock out there that needs
some rehab and that it is a pretty good guess that there are
lower income people living in those places. Do you know why
people are choosing to use- I think the need for the housing
stock is there. It is just the landlords aren't using it.
lvIilkman! I think part of it is that money is cheap right now and
there are interest rates on these. There is on one of the rental
rehab programs and on the other one they still have to come
up with half of the fl1l1d. We make them do a lot more than
they would otherwise would want to do. I think the other
factor is that the code enforcement progmm has been going
now for 15 years or more. I think it has really had an affect on
the rental housing stock so that things are in reasonable shape.
We don't see these properties where we get a list of violations
that are 10 pages long and they really have to have some help.
I think that is a part of it.
Kubby/ Maybe when interest rates should rise again we should think
about this. I kind of hate to stop the program completely
because you have to get momentum up again and that [
wouldn't mind always having a little bit of money and always
advertising for those few people who might use it to the
benefit of the people living in those places.
Milkman! We also have the option of using CDBG moneys for it if we
want to or making an application of the HOME funds.
Kubby! I would always like to have just a little pot of money. Even
if it is enough for a couple of units sitting there specifically for
rental rehab. It makes me uncomfortable to completely
eliminate the program. If we would apply for HOME funds for
rental rehab and we would get them, would that make it
harder lor us for other kinds of loans.
Milkman! yes and no. I think that every application is evaluated
and has to meet a certain threshold. That is the way that the
state does it and provided the application meets that threshold

we will get some money. How much we get will depend a little
bit on how they are doing sort of geographically. They don't
have a rule about X number of dollars to each part of the stale.
But none tile less, when you have $9 million or something, you
can't give $3 million to one city.

Comment: A Storm Watar Management Agreement and the City.
Subdivider's Agreement for Village Green, Part XII obligetes the
Subdivider to construct a storm water control facility. This obligation
constitutes a lien and a cloud on the title of each lot in the Subdivision.
The Subdivider has substantially completed the storm water facility but
a general release of the facility is not yet appropriate. This Limited
Release Agreement removes the cloud on the title to the lots in Village
Green, Part XII Subdivision while protecting the City by establishing an
escrow fund which will be retained until the facility is completed.

Comment: This agreement includes the terms and conditions of the
tentative agreement reached by the City and IAFF Local 610 on
December 17,1992. Wage and benefit adjustments under the terms of
this agreement include a 4% across.the-board wage increase, an annual
payment of $150.00 ($15.00 per holiday) to each bargaining unit
member in lieu of overtime pay for hOlidays worked, and a $20.00 per
month co-payment by each employee who elects for family coverage
under the health cere insurance benefit program of the City. This item
was deferrad from the June 8, 1993, Council meeting.

recommendation would be to go ahead and adopt this
resolution and enter into this agreement as per the tentative
agreement that you approved in Janumy. We will continue to
pursue this with the fire fighters. As of this point we have not
gotten that confirmation. Just in case you should get some

Helling! If there is a problem in the sense that we missed something
we would probably have to go back and correct it. That is why
we like them to go through it. !vlaybe they just haven't taken
the time or proof read the document or whatever. I don't
know and I haven't been able to get a response. So, I think we
need to go. But I wanted you to be aware of that because it
could come up in the future that this is different than any
other contract that I have been involved with in that we have
always had the concurrence of the union before we brought it
to you. That is why I asked you to defer it and we don't have
that concurrence yet. It may not be a problem but I don't
know.
Kubby! Could this put us in any kind of compromise position later.

Kubby! I am going to be voting no on this item and the next item
because of the $20 per month co-payment for the family
coverage for each employee. I feel very strongly about this.
That If we rally want to help facilitate people with families
making sure they have heallh care that it Is not the $20 so
much, it is the fact of the co-payment and it opens the door for
us bargaining for larger and larger amounts. When we haven't,
I don't believe, done as much as we can in working with our
employees on health care cost containment. Until we have kind
of exhausted those possibilities I don't feel comfortable putting
my name on the yes vote when there is a co-payment.

payments for family coverage. The school district has a much
higher co-payment. The state University has a much higher co-
payment. certainly in private industries it is much higher. I
think it puts a IiUle bit of the onus on the employee to help
contain the cost too if they have some vested interest in it of
money that they are putting into the program. We haven't had
exactly good cooperation from the unions on tIying out
programs that would contain the health care cost. It is two
different view points and there no sense of us arguing because
we won't convince each other.
Kubby/ I guess what I am saying is that we hold the same value. The
value of working with employees. The rationale behind the co-
payment is to reduce health care costs to the city. Instead of
ha\1ng tile same costs but having them say it, cost containment
with some positive incentives form the city to behave
differently around health care issues would be amore positive
thing for the family and for the actual costs going down vs. us
just sharing the costs among different parties. And I am asking
that we do the latter thing before we do the co-payment.
Courtney/The city has done may things. Co-insurance. Raising
deductibles which we cover. There are many things where the
city council and the staff have done to reduce the cost to the
taxpayers and I think it is time for evelybody to share in this
thing. The increases that we have had in the cost of covering
are monumental.
Kubby/ I know that and maybe since this discussion is going on. But
I know that ASFME had some specific ideas for cost
containment. Working witll several pharmacies. They had
some specific ideas and that we had talked at an earlier time
about the city initiating further discussions about that same.
Repeat those ideas. Let's brainstorm some other ones. And we
had kind of said well, yes, we can do that. And I guess I would
like to encourage us to do that with or without the co-pymetn.
To still go fonvard with working with our employees with some
positive, kind of financial incentives. If you don't use your
health insumnce for six months in a row, you get a day off. Or
whatever the incentives are that other communities have used.
There are communities who use positive incentives like that
that actmlly cost less than that day off if they haven't used-
haven't gotten into the health care system which Is also velY
expensive even for something small. Anyway. This is going to

. Courtney! I would like to point out through binding arbitration that
the fact finder both agreed with the position on this.
Kubby! And the union is abiding by that arbitration. I do have a
question I think for dale about the reclassification procedures.
There is something here that is just worded funny that I end
up interpreting funny. It is AppendL\: D under the section 5
rules, #3. It says the personnel administrator may vote in place
of any absent management committee members and the union
officers may vote for any absent union member. Does that
mean these people get tileir votes and the votes of other people
who aren't present. Or are they there and they are not usually
voting anyway.
Helling! It means that they would get that person's vote as well.
Kubby! They get a double vote.
Helling! They might but still the votes are going to be even. There
are going to be the same amount for votes.
Kubby! One person gets to vote more than one time if someone is
absent. Either a union official, union officer.
Helling! Keep in mind. This has been in place for about ten years.
This is from the old classification study and the reclassification
committee that came about as the result. We have not
negotiated the implementation of the new classification study.
Kubby! So this mayor may not be gel111ane.
Helling! This is only germane to this particular contract. We will
negotiate the implementation of the new classification study to
be effective next July 1.
Kubby! Okay. So no committee will meet between now and then and
use these rules.
Helling/ The could because they are still in effect but probably not.
Kubby! lliesn't hat seem weird. If someone is not there someone
else gets to vote twice.
Nov! No. Not if they have the proxy.
Atkins! A proxy is what it is.
Nov! It is done all of the time.
Kubby! It means that they have to represent the other person the
way they want to. It's not that they get to do their own thing.

increase in fees even though we are not doing anything
different with our collection program. So if I miss anything
Steve will you be my safety net.
Pa'rt of it is the state tax is rising. Every year the state ta;.; on
landfill fees rise. And the other part is that we need financial
assurance. We need to start putting together a pot of money
for closure and post closure for 30 years. We need to start
building that now. That is what part of the increase is about
also.
Novl And we are talking now about increasing the fees per ton. Not
the home collection fees.
