ORDINANCE AMENDING THE ZONING
ORDINANCE BY CONDITIONALLY CHANGING
THE USE REGULATIONS OF AN
APPROXIMATE 65.14 ACRE TRACT OF LAND
LOCATED WEST OF SCOTT BOULEVARD AND
NORTH OF THE IOWA INTERSTATE RAILWAY
FROM RS.5. LOW DENSITY SINGLE.FAMIL Y
RESIDENTIAL, TO OPDH.6, A PRELIMINARY
PLANNED DEVELOPED HOUSING (PO H) PLAN
FOR VILLAGE GREEN SOUTH. PARTS THREE.
EIGHT, IOWA CITY, IOWA.
WHEREAS, Village Green, South, L,C.
(hereinafter 'Village Green"l. has requested the
City to rezone an appropriate 65.14 acre tract
of land located west of Scott 80ulevard and
North of the Iowa Interstate Railway from RS-
6. Low Density Single-Family Residential to
~PDH-6, a Preliminary Planned Development
Housing Plan IPDH); and
WHEREAS. the requested zoning change
'would permit Village Green to construct a
planned housing development of 84 zero lot
line dwellings and 83 detached single.family
residential dwellings while providing a 12.18
acre parkway including pedestrian trails. usable
neighborhood open space and the required
storm water detention facilities; and
WHEREAS, the Village Green South, Parts
Three-Eight development clusters the proposed
zero lot line dwellings in the south central
portion of the parcel with the conventional
single-family lots oriented towards major
streets within the develapment and located
adjacent to existing RS-5 zones to the north
and west to minimize the Impact of tho
proposed use modification on naiuhborlng
conventionally developed iand; and
WHEREAS, the density of the proposed
development Is consistent with the density
designated for this area In the Comprehensive
Plan; and
WHEREAS, Iowa law provides that the City
of Iowa City may impose reasonable conditions
on granting an applicant's rezoning request,
over and above existing regulations, to satisfy
public needs directly caused by the requested
change; and
WHEREAS, the City wants to ensure the
appropriate allocation and suitability of
neighborhood open space and protection of
environmentally sensitive areas; and

WHEREAS, Village Green has agreed to
develop this property In accordance with the
terms and conditions of a Conditional Zoning
Agreement to ensure appropriate urban
development on the eastern edge of Iowa City,
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. APPROVAL. Subject to the terms
and conditions of the Conditional Zoning
Agreement as authorized by Iowa Code ~414,5
(1993), a copy of which is attached hereto and
Incorporated by reference herein, and subject
to the approval of the final plat of Village Green
South, Parts Three-Eight, the property legally ,
described below Is hereby reclassified from its
present classification of RS.5 to OPDH-5, and
the preliminary PDH plan submitted by Vii/age
Green South, L.C, for Village Green South,
Parts Three-Eight is hereby approved:
That portion of the Northeast Quarter of
Section 24, Township 79 North, Range 6
West of the 5th Principal Meridian lying
East of Village Green South Part 2 as
recorded In Plat Book 18 at Page 67 of the
Records of the Johnson County Recorder's
Office; and North of the Northeasterly
Right-of-Way line of the former Chicago,
Rock Island and Pacific Railroad and West
of the Westerly Right-of-Way line of Scott
Boulevard, Said tract of land contains
55.14 acres, more or less, and is subject to
easements and restrictions of record.
SECTION II, VARIATIONS. The following
variations from the requirements of the RS.5
zone have been approved as part of this
preliminary PDH plan:
a, Zero lot line dwellings will be a permitted
use.
a, Modification of the minimum dimensional
requirements of the underlying zone will be
allowed to permit zero lot line development
on lots having less width and area than
required of conventional detached single-
family residential development In the RS-5
zone. The lots used for zero lot lines will
be clustered away from adjacent detached
slngle'famlly residential development, and
12.18 acres of open space will be provided
to offset the slightly Increased density of
the areas of the tract designated for zero
lot line development.

b. Due to the single-family residential nature
of the structures that will be constructed
on this tract, the preliminary PDH plan,
requirement concerning submission of
general building design sketches has been
waived,
SECTION III, ZONING MAP. The Building
Inspector Is hereby authorized and directed to
, change the Zoning Map of the City of Iowa
City, Iowa, to conform to this amendment upon
final passage, approval and publication of this
ordinance as provided by law,
SECTION IV, CERTIFICATION AND
RECORDING, The City Clerk is hereby
authorized and directed to certify a copy of this
Ordinance which shall be recorded at the Office
of the County Recorder of Johnson County,
Iowa.
SECTION V, CONDITIONAL AGREEMENT. The
Mayor is hereby authorized and directed to
sign, and the City Clerk to attest, the
,Conditional Zoning Agreement between the
owner of the property and the City, and to
certify the Conditional Zoning Agreement for
recordation 'in the Johnson County Recorder's
Office, following passage and approval of this
Ordinance.
SECTION VI. REPEALER. All ordinances and
parts of ordinances in conflict with the
provisions of this Ordinance are hereby
repealed,
SECTION VII. SEVERABILITY, If any section,
provision or part of the Ordinance shall be
adjudged to be Invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged Invalid or
unconstitutional,
SECTION VIII. EFFECTIVE DATE, This
Ordinance shall be In effect after its final
passage, approval and publication, as provided
by law,

CONDITIONAL ZONING AGREEMENT
THIS AGREEMENT Is made by and between the City of Iowa City, a municipal corporation
(hereinafter "City") and Village Green South, L.C" an Iowa Umlted Uability Company (hereinafter
Village Green) and George and Marcia Nagel, husband and wife, Richard L. and Mary Lou
McCreedy, husband and wife, and Jerry J, and JoAnn E, Hilgenberg, husband and wife
(hereinafter "Owners").
WHEREAS, Owners are legal titleholders of a portion of the property legally described below; and
WHEREAS, Village Green has contracted to purchase Owners property and Is the legal titleholder
to the balance of the property described below; and

WHEREAS, Village Green has requested the City to rezone approximately 55.14 acres of land
from RS-5, Low Density Single-Family Residential, to OPDH-5, Planned Development Housing
Overlay, and approve a Planned Development Housing (PDH) plan for property located west of
Scott Boulevard and north of the Iowa Interstate Railway; and
WHEREAS, Village Green has applied to rezone the parcel from RS-5 to OPDH-5 to permit a
planned housing development containing zero lot line dwellings, which are not permitted In the
RS.5 zone; and
WHEREAS, Iowa Code ~414,5 (1993) provides that the City of Iowa City may Impose reasonable
conditions on granting a rezoning request, over and above existing regulations, to satisfy public
needs directly caused by the requested change; and
WHEREAS, the City wants to ensure the appropriate allocation and suitability of neighborhood
open space and protection of environmentally sensllive areas; and
WHEREAS, the parties acknowledges that certain conditions and restrictions are reasonable to
ensure appropriate urban development on the eastern edge of Iowa City.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES CONTAINED HEREIN,
THE PARTIES AGREE AS FOLLOWS:
1. George and Marcia Nagel, husband and wife, Richard L. and Mary Lou McCreedy,
husband and wife and Jerry J. and JoAnn Hilgenberg, husband and wile, are the owners
and legal tllleholder of a portion of an approximately 55,14 acre tract of land located west
of Scott Boulevard and north of the Iowa Interstate Railway, which property Is more
particularly described as follows:
That portion of the Northeast Quarter of Section 24, Township 79 Nortb,
Range 6 West of the 5th Principal Meridian lying East of Village Green
South Part 2 as recorded In Plat Book 1 B at Page 67 of the Records of the
Johnson County Recorder's Office; and North of the Northeasterly Rlght-of-
Way line of the former Chicago, Rock Island and Pacific Railroad and West
of the Westerly Right-of-Way line of Scoll Boulevard. Said tract of land
contains 55,14 acres, more or less, and Is subject to easements and
restrictions of record,
2, Village Green Is the contract purchaser of the property owned by George and Marcia
Nagel, Richard L. and Mary Lou McCreedy and Jerry J. and JoAnn Hilgenberg and Is the
owner and legal title holder of the balance of the property legally described above.

3. The parties acknowledge that the City desires to ensure appropriate allocation of open I
space and to protect environmentally sensitive areas.
4. In consideration of the City's rezoning of the subject property from RS-S to OPDH-S, I

Village Green and Owners agree that development and use of the sublect property will I
conform to the requirements of the OPDH-S zone and the conditions of the PDH plan, as I
well as the following additional conditions:
a) Prior to approval of the final plat and PDH plan, Village Green shall document the
existence of state or federal jurisdictional wetlands on the site. If protected
wetlandf exist within the proposed development, Village Green must demonstrate ,
that the development, as designed, will not negatively impact the wetlands. ,
b) Village Green must construct the proposed walkways (trail) to conform with the
Americans with Disabilities Act (ADA) requirements, At a minimum, the trail must
be constructed at least eight feet in width. The trail must consist of a minimum
base of four inches of 3/4-lnch roadstone and a minimum topping of three Inches !:!
of 3/8-inch base material (said materials to be compacted). Ii .

c) Village Green must provide appropriate ground cover and landscape the parkway

Installation and cost sharing of the proposed 12.lnch water main on Scott
Boulevard.
Q A Grading and Erosion Control Plan must be approved by the Public Works
Department prior to Council consideration of the preliminary plat and PDH plan.
g) The connection of Wintergreen Drive to Sterling Drive Is prohibited until the
connection of Wintergreen Drive to the future Village Road extension Is completed.
5, Village Green and Owners acknowledge that the additional conditions herein are
reasonable co~ditlons to impose on the land pursuant to Iowa Code ~414,5 and that said
conditions are appropriate, and satisfy public needs which are directly caused by the
requested change,
6, Village Green and Owners acknowledge that in ths event the subject property is
transferred, sold, redeveloped, subdivided, divided or split, all redevelopment will conform
with the terms of this Agreement.
7. The parties acknowledge that this Conditional Zoning Agreement shall be deemed to be
a covenant running with the land and with the title to the land, and shall remain In full
force and effect as a covenant running with the title to the land unless or until released
of record by the City. The Parties further acknowledge that this Agreement shall Inure to
the benefit of and bind all successors, representatives and assigns of the Parties.
8. Village Green and Owners acknowledge that nothing In this Conditional Zoning
Agreement shall be construed to relieve them from complying with all applicable local,
state and federal regulations.
9. The Parties agree that this Conditional Zoning Agreement shall be Incorporated by
reference Into the Ordinance rezoning the subject property; and that upon adoption and
publication of the Ordinance, this Agreement shall be recorded In the Johnson County
Recorder's Office,

WHEREAS, the 'subJeJt property Is presently
located outside the Iowa City corporate limits;
and
WHEREAS, the owner of said property,
Robert R. Mitchell, has petitioned the City of
Iowa City for voluntary annexation and the City
is proceeding with same; and
WHEREAS, pursuant to Iowa Code ~368.7,
annexation of the property must be approved
by both the City and the City Development
80ard; and
WHEREAS, pursuant to the annexation policy
of the Comprehensive Plan of the City of Iowa
City, the proposed rezoning is subject to the
developer agreeing to pay all of the costs
associated with providing infrastructure for
development of the subject tract; and
WHEREAS, Iowa law provides that the City
of Iowa City may impose reasonable conditions
on granting the applicant's rezoning request,
over and above existing regulations, to satisfy
public needs directly caused by the requested
change; and
WHEREAS, the Applicant has agreed to
develop this property in accordance with the
terms and conditions of a Conditional Zoning
Agreement to ensure appropriate urban
development on the eastern edge of Iowa City,
NOW, THEREFORE, 8E IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I, APPROVAL. Subject to the City

Agreement for recordation in the Johnson
County Recorder's Office, following passage
and approval, am. subject to notification from
the City Development Board that the

SECTION IV. REPEALER. All ordinances and
parts of ordinances In conflict with the
provisions of this Ordinance are hereby
repealed.
SECTION V. SEVERABILITY, If any section,
provision or part of the Ordinance shall be
adjudged to be Invalid or unconstitutional, such
adjUdication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged Invalid or
unconstitutional.
SECTION VI. EFFECTIVE DATE, This
Ordinance shall be In effect after Its final
passage, approval and publication, as provided
bV law.

CONDITIONAL ZONING AGREEMENT
THIS AGREEMENT Is made by and between the City of Iowa City, a Municipal Corporation
(hereinafter "City") and Robert R. Mitchell (hereinafter "Owner').
WHEREAS, Owner has requested the City to annex and rezone approximately 6,92 acres of land
, located south of Scott Park and north of Falrvlew Golf Course, legally described below, from the
County designation of RS, Suburban Residential to ID-RS, Interim Development Single-Family
Residential; and
WHEREAS, Iowa Code s 414,5 (1993) provides that the City of Iowa City may Impose r,easonable
conditions on granting Owner's rezoning request, over and above existing regulations, to satisfy
public needs dlrectiy caused by the requested change; and
WHEREAS, pursuant to the annexation policy of the City's Comprehensive Plan, the proposed
rezoning Is subJect to the developer agreeing to pay all of the costs associated with providing
Infrastructure for development of the subject tract; and
WHEREAS, Owner acknowledges that certain conditions and restrictions are reasonable to
ensure appropriate urban development on the eastern edge of Iowa City.
NOW, THEREFORE, In donslderation of the mutual promises contained herein, the Parties agree
as follows:
1. Robert R. Mitchell Is the owner and legallltie holder of the property located south of Scott
Park and north of Falrvlew Golf Course, which property Is more particularly described as
follows:

16, Township 79 North, Range 5 West of the 5th P,M.; Thence

2, The Parties acknowledge that, pursuant to the annexation policy contained In the City's
Comprehensive Plan, the proposed rezoning Is subject to the developer agreeing to pay
all of the costs associated with providing Infrastructure for development of the subject

3. In consideration of tho City's rezoning of tho subject property from County RS, the Owner
agrees that development and use of the subject property will conform to the requirements
of the ID-RS, Interim Development Slngle.Famlly Residential Zone and further agrees that,
as an additional condition, Owner shall pay all costs associated with providing Infra-
structure for development of the subjecltract.

4, Owner acknowledges that the conditions contained herein are reasonable conditions to
Impose on the land under Iowa Code 9 414,5 (1993) and that said conditions are
appropriate to satisfy public needs directly caused by the requested zoning change.
5. Owner acknowledges that In the event the subject property Is transferred, sold,
redeveloped, or subdivided, all redevelopment will conform with the terms of this
Agreement.
6. The Parties acknowledge that this Agreement shall be deemed to be a covenant running
with the land and with the title to the land, and shall remain In full force and effect as a
covenant runnlpg with the title to the land unless or until released of record by the City,
The Parties further acknowledge that this Agreement shall Inure to the benefit of and bind
all successors, representatives and assigns of the Parties,
7. Owner acknowledges that nothing In this Agreement shall be construed to relieve the
Applicant from complying with all applicable local, state and federal regulations.
e, The Parties agree that this Conditional Zoning Agreement shall be Incorporated by
reference Into the Ordinance rezoning the subject property; and that upon adoption and
publication of the Ordinance, this Agreement shall be recorded in the Johnson County
Recorder's Olllce.

Solid Waste
At your last City Council meeting, you deferred the proposed solid waste ordinance to your
next meeting as well as requested edditionellnformatlon for your review. You will recell from
the discussion, there were many opinions and questions concerning the proposed ordinance,
not only ebout the specifics of the ordinance, but also the future direction of our refuse
collection and landfill policies. With so many available alternatives, let alone numerous
opinions, it Is difficult as a staff to prepare a memorandum that we believe would outline eech
and every possible refuse collection option. It is at this point that our staff work appears to
break down.
As a staff, when we engage in our preparation of reports for you, we often include in that
,process an attempt to develop a consensus of what we believe to be the Council's general
policy direction. In doing so, we attempt to debate a position which we believe to be
representative of the position of individual Council members. This allows us to look for
potential areas of agreement end single out conflicts. With respect to this report on solid
waste, we were unable to reach any type of consensus on your policy direction and,
therefore, found It difficult to shape options. The options ere so numerous, each town
appears to do It a little bit differently, to prepare such a report would be voluminous and, I
believe, unproductive. I believe we need to set upon some sort of polley direction discussion
to provide staff with more detailed guidance. We have an obligation to provide you
Information In order to fecllitate policy debate; however, more specific Information from you
Is necessary In order to fulfill that responsibility.
I would' propose that before we prepare any final list of options, some type of formal
discussion be planned where each and every element of our refuse collection policy Is

analyzed. Hopefully, dealing with refuse collection as one policy debate, Independent of our
landfill policy, we would be able to settle in on a refuse collection policy that we could live
with for some time. Thereby, we can prepare education and other public Information to
support the policy and avoid dramatic annual changes. If we continue an annual reo
view/debate end start chenglng piecemeal, we believe It creates hardship in not only the
administration of refuse collection, but also the public reliance on a quality public service mey
be compromised.
As you know, our refuse collection policy amounts to only 15% of total landfill volumes and,
therefore, even with dramatic policy chenges, we would likely not have a significant Influence
on landfill volumes, and yet we must preserve our leadership position. From your discussion,
there appears to be interest not only In our residential refuse collection policies, but also those
that might affect business, Industry, multi-family, and commercial, and other jurisdictions.
We must have some type of position that allows our work effort to guide theirs and not haVe
them work independently of our policy. Some communities may simply choose to pay the bill
and never be motivated to address this Issue, which simply burdens others with the
responsibility to reduce volumes.
Attached Is a brief summary of our refuse collection policies. I believe If we can reach
agreement on the Items Identified, we can then shepe a list of options more clearly directed
to your collective interests. I would expect that the Council, with a formel scheduled
discussion, could step through them by Item and meke any adjustments as you see fit. This
would then be the framework of our policy options.

ordlnence, dealing primarily with definitions, deferred to this meeting. Item #25 Is the original
fee ordinance, also deferred. If Council wishes to defeat Items #24 and #25, we believe it
Is Important to Initiate the new landfill fees as soon as practical while we do have some,
although little, time on refuse collection revenues. Item #26 will Initiate the new landfill fees.
Our refuse collection fund Is running very close and new, increased rates are necessary. You
could choose to Increese as proposed which will provide for some financlel comfort, but also
if there evolves 9. change In polley direction and thereby rate structure, you will again need
to amend.

Please appreciate that we are attempting to maintain the fiscal health, as well as our health
and sanitation obligations of our residential refuse collection system, and yet we need to
establish new directions to this system to satisfy state and federal law. The Changes
forthcoming with respect to landfill volume reduction are inevitable and our area businesses,
Industries, and other political jurisdictions will be affected. I believe a more focused policy
discussion is needed in order to fulfill all of our obligations.

City staff has developed a payment for service scheme for solid
waste collection and disposal services provided by the City. The
purpose of thls change is to more effectively and fairly charge
for solid waste collection and disposal services that do not
involve residential refuse. Also, additional separation of waste
(untreated wood waste) is required to further reduce landfill
use'. It is our desire that these changes will also reduce future
rate increases for residential refuse collection. In addition,
rate increases and changes to reflect increased cost and non-
uniform landfill charges have been included.
Attached are the proposed changes to Chapter 15, Solid Waste and
Chapter 32, Taxation and Revenues. Changes have been
highlightea.
City staff will be available to discuss these changes with the
City Council at the June 7, 1993 informal council meeting or at
your convenience.

ARTICLE I. IN GENERAL
Sec. 15-1. Purpose.
The purpose of this chapter is to provide for the health, safety, and welfare of the citizens
of the city by providing for the collection and dispose I of solid waste; by regulating the
storage, collection, trensportatlon, processing, disposal, recycling, reuse and littering of solid
waste; and by providing for the collection and disposal of solid weste.
Sec. 15-2. Definitions.
The follOWing definitions shall be applicable to this chapter unless a contrary meaning is
indicated by the text. The word "shall" is mandetory; the word "may" is permissive. Terms
not defined shall have the meanings customarily esslgned to them in Webster's New
Collegiate Dictionary. Uses not defined or listed shell have the meanings as defined In or
categorized according to the Standard Industriel Classification (SIC) Manual, Superintendent
of Documents, U.S. Government Printing Office.
Appliances means machines common to residential household use, end shell Include
refrigerators, stoves, microwave ovens, dishwashers, clothes washers, clothes dryers, water
heaters, furneces, air conditioners, dehumidifiers, console television sets, stereo systems,
lawn mowers; and any device containing a gasoline engine, an electric motor or an electric
capacitor.
Bulky rubbish means nonputrescible refuse consisting of combustible andlor non-
combustible waste materials which are either too large or too heavy to be .'2 and
conveniently loaded into solid waste trensportatlon vehicles by solid waste collectors.
Commercial solid waste means solid waste resulting from the operation of any
commercial, Industrial, institutional, agricultural or other establishment, end shall elso include
solid waste resulting from multiple dwelling facilities having more than four (4) dwelling units.

Director means the city manager or hislher authorized designee.
Disposable solid waste container means 9l-m disposable plastic sacks specifically
designed for storage of solid waste having a capacity of five (5) to thirty-five (35) gallons.
Dwelling means a building which Is wholly or partially used or Intended to be used for
residential occupancy.
Dwelling unit means any habitable room or group of edjolnlng habitable rooms located
within a dwelling and forming a single unit possessing facilities which are used, or are
Intended to be used, for living, sleeping, cooking and eating of meels.
Garbage means putresclble animal or vegetable wastes resulting from the handling,
preparation, cooking, serving or consumption of food.
Hazardous wastes includes but is not limited to pethologlcal wastes, explosive wastes,
pesticides, pesticide containers, toxic redloactlve materials, and those wastes Included by
definition In Section 455B.411(4a) Code of Iowa (1989) end Rules of the Iowa Depertment
of Natural Resources.
Landfill shall mean the Iowa City Landfill located In Johnson County, Iowa.
Landfill service area means Johnson County Including both Incorporated and
unincorporated cities loceted therein, together with the cities of Riverside and Kalona, for
which Iowa City provides lendflll services herein.

Occupant means any person who alone, or jointly or severally with others, shall be In
actual possession of any dwelling unit or eny other Improved or unimproved real property,
either as owner, landlord, tenant, resident or operator.
Offending party Is any person, operator, responsible party, resident, entity or occupant
who has been given notice of a violation of this chapter and who has not yet cured or
remedied the offense.
Offending property Is that property which is In violation of this chapter and which offense
has not been cured or remedied.
Operatormeens any user, responsible party, occupant, entity, business, firm, corporation,
governmental entity, association, partnership, venture, or any combination thereof, or any
agent, fiduciary or representative thereof, who occupies, possesses, uses or owns property
within the Iowa City Landfill Service Area and lor who stores or generates solid weste within
the Iowa City Landfill Service Area.
Owner shall mean eny recognized Interest of ownership in real or personal property,
Including legal and equitable property Interests.
Person shall Include individual persons, user, responsible party, entity, business, firm,
corporation, association, partnership, venture or eny combination thereof or any agent,
representative or fiduciary thereof.
Premises Includes any Interest in real property, Including but not limited to buildings and
Improvements, whether Intended for or used for residentlel, commercial or Industrial use.
Processing means bailing, compacting, compostlng, Incinerating, recycling, separating,
shredding, together with all other processes whereby solid waste characteristics are either
modified or solid waste quantity Is reduced.
Recycling means any process by which solid waste is collected, separated, processed or
returned to use In the form of raw materials or products. Recycling shall Include the
composting of yard waste, but does not include any form of energy recovery.
Refuse means solid waste not required to be recycled or reused.
Residence meens any dwelling either Intended for andlor being used for residential use.
Resident means any person or group of persons who QCCUPY a residenllel dwelling,
dwelling unit, or rooming unit.

Residential solid waste means solid waste resulting from the maintenance and operation
of single-family, duplex, triplex, and four.plex dwellings, including solid waste from operation
of a home occupation which complies with the requirements of the applicable zoning
ordinance.
Responsible party meens any person, persons or governmental entity who epplies for,
who obtains or who Is Issued an account for sewer, water andlor solid waste service, and
Includes any person who pays an Individual account for anyone or a combination of the
following services: Water; sewer and solid waste collection. Responsible party shall also
mean an account holder of the above accounts. If more then one person Is listed on an
account, both persons shall be deemed a responsible party for purposes of collection, storege
and disposal of solid waste and compliance with this chapter.
Revocation means withdrawal of privileges, termination of landfill permits and withholding
of access to the landfill site. Revocation may be cerried out by the director upon deter-
mination by the director thet sufficient ceuse exists to revoke, after notice and an opportunity
to cure the defect or to rebut the existence of the offending cause.
Rooming unit means any habitable room or group of adJoining hebitable rooms located
within a dwelling and forming a single unit possessing facilities which are used, or Intended
to be used, primerlly for living and sleeping. A rooming unit shall have bath and toilet facilities

available for exclusive use by the occupants or for communal use. In addition, a rooming unit
may have kitchen and dining facilities avellable for usa by the occupants therein. For
purposes of this chapter, two (2) rooming units shall be deemed the equivalent of one
dwelling unit.
Solid waste means unwanted or discarded waste materials In a solid or semi-solid state,
inclUding but not limited to garbage, ashes, refuse, sludge, m11muJi'im11 yard waste,

Solid waste container meens a receptacle used by any person or operator to store solid
waste during the Interval betwesn solid waste collections.
Solid waste disposal means the process of discarding or getting rid of unwented material;
in particular, the final disposition of solid waste.
Solid waste management means the entire solid waste system of planning and
administering storage, collection, removal, transportation, processing and disposal of solid
waste.
Special waste means solid waste that must be handled or processed In a special manner
prior to disposal at the landfill.
Storage means keeping, maintaining, or storing solid waste from the time of Its production
until the time of Its collection and removal.
Transportation means the transporting of solid waste from the place of collection or
processing to the lowe City Landfill.

Sac. 15-3. County ordinances.
Provisions of this Chepter together with eny provision of any ordinance administered
by the Johnson County Board of Heelth which Is not In conflict with this Chapter, shall govern
the City's management of solid waste.
Sec. 15-4. Enforcement.
In order to ensure compliance with this Chapter and the rules promulgated [pursuant)
thereto, together with all applicable county, state and federallews and regulations" the
Director Is authorized to Inspect all phases of solid waste management within the jurisdiction
of Iowa City. In all cases where such inspections reveal that the storage, collection, transpor-
tation, processing, disposel, recycling or reuse of solid waste are In violation of this Chapter
or rules promulgated [pursuant) thereto andlor are in violation of state or federal law, such
violation shall constitute a nuisance andlor an environmentel infraction under both state and
local law. In such event, the City may, at Its option, elect to carry out anyone or all of the
following remedies: prosecute environmental Infractions under Section 1 -20(d) of this Code;
withhold solid waste management services from that person, dwelling, commercial or
Industrial, business, institution or government entity; deny or revoke any permit under this
Chapter; terminate a service account; dispose of any nonconforming solid waste container;
or abate the nuisance In accordance with Chapter 24, Article VI of the Iowa City Code of
Ordlnences; abate the nuisance under stete law, Chapter 657, Iowa Code (1989). Election
of anyone of these remedies by the city shall not preclude the city from pursuing any other
remedy, and such remedies are deemed cumulative and not exclusive.
Notice of any such City determination that e prohibited nuisance exists shell be given to
the offending party as follows:

(1) Be given in writing to the person, responsible party, resident, operator, business or
entity at their last known address;
(2) State that the City has determined that a violation of this Chapter exists;
(3) Describe the violation, with reference to the epplicable provisions of this Chapter,
rules, or other applicable county, state, or federal law;
(4) Advise what actions are required to be taken by the offending perty to remedy the
violation.
The notice shall be deemed to be properly served if It is personelly served; if It is
posted In a conspicuous place on the offending property or building; or If a copy thereof Is
sent by ordinary mall, with sufficient postage effixed, to the last known address of the
person, responsible party, occupant, operator, entity, business or governmental entity.
Sec. 15.5. Director's rule.maklng authority.
The Director may make, amend, revoke and enforce reasonable and necessary rules
and regulations governing, but not limited to:
(1) Specifications for solid waste storage containers, including the type, composition,
equipment, size, weight and shepe thereof.
(2) Weight and size limitations on bundles of solid waste too large for solid waste storage
conteiners.
(3) Sanitation, maintenance and replacement of solid waste contelners.
(4) Schedules and routes for collection and transportation of solid waste by City
personnel.
(5) Collection points of solid waste containers.
(6) Special identification requirements for use of solid waste contelners.
(7) Collection, transportation, processing and disposal of solid waste.
(8) Storage of solid waste.
(9) Records of quantity end types of solid waste received at disposal fecilltles.
(10) Hendllng of hazardous wastes, special wastes, toxic wastes, sludges, ashes,
agricultural waste, construction weste, bulky items, tires, automobiles, oils, greases,
yard waste, batteries, appliances, and recyclables.
(11) Special carryout service for the elderly and handicepped.
(121 Collection of residential solid waste resulting from the operation and maintenance of

Sec. 15-6. Prohibited practices.
It shell be prohibited for any person, responsible party, operator, resident, occupant or
entity, or any agent or representative thereof, to:
(1) Deposit solid waste In any solid waste container othar then In e solid waste container
either owned by the depositor, or properly and lawfully leased by the depositor.
(21 Interfere In any manner with the collection, storage, or trensportatlon of solid waste;
Interfere with the equipment for the use of such collection, storage or transportation;
or Interfere with solid waste collectors in the lawful performance of their duties.

(3) Throw, cast, piece, lay or permit placement of any refuse into or on any receptacle
specifically designated by the City or private entity as a receptacle to be used only for
deposit of recyclable or reuseble waste.
(4) Deposit recyclables or reusable waste in containers or at locations not specifically
designated for such waste.
(5) Litter.

ARTICLE f1- COMMERCIAL SOLID WASTE HAULERS
Sec. 16-10. Permltrequlred,
No person, business, responsible party, occupant, operetor, or entity shall engage In
the business of receiving, collecting, transporting, processing, recycling, or disposing of solid
waste within the Iowa City Landfill Service Area without first obtaining an ennuel permit from
the City; provided, however, that this section shall not be deemed to apply to employees of
the holder of any such permit. No permit shall be required for episodic or irregular collection
and transportation of building demolition material or brick or foundation materials, or of dirt
or rock materials from grading or excavation activities, However, a permit shall be required
for persons who provide building demolition services or who collect and dispose of building
demolition materials on a regular basis.
Sec. 15.11. Application.
Each appllcent for any permit required by Section 15.10 shall state In its application:
(1) The cheracterlstlcs of solid weste to be collected, transported, processed, disposed oi
or recycled.
(2) The number of solid waste transportation vehicles to be opereted.
(3) The precise area served, and the name of any person, operator, business, entity or
governmental entity served, if any.
(4) That its employees have an understanding of eppllcable local, state, and federal laws
and practices governing the collection and disposal of solid waste.
(6) Such other Information as may be required by the Director.
Sec. 16.12. Issuance of permit and fee.
If the application for the permit required by Section 15-11 and City Inspection shows
that the applicant will collect, transport, process or dispose of solid wastes without hazard
to the public health or damage to the environment, and that such collection, transportation
process or disposal will conform with all applicable state, federal and local laws and this
Chapter, then the Director shell Issue the permit authorized by this Article II. A permit sticker
shall be applied to the upper right-hand corner of the right door of all solid waste transpor-
tation vehicles. The permit shall be issued for a period of one year, and each applicant shall
pay an annual fee as provided In the Schedule of Fees, Section 32,1-66,
Nothing In this Section shall prejudice the right of the eppllcant to reepply after the
denial of Its application, provided that ell aspects of the reapplication shall comply with the
provisions of this Chapter.
Sec. 16.13. Trensferablllty.
Permits authorized under this Chapter shell be deemed personel to the appllcent, and
shall not be transferable or assignable In any manner unless specifically approved by the
Director.

solid waste shall provide containers of sufficient number and adequate quality for the storage
of all solid waste, sufficient to properly serve each such dwelling unit andlor establishment:
and shall mainteln such solid waste containers in reasonable repair. This provision shall not
apply to bulky rubbish, appliances, ~mm;IlB[WLml demolition or construction waste.
Sec. 15.21. Required use and maintenance of containers and surrounding areas.
The occupent, resident, operator or owner of every dwelling unit, residence, and of
every institutional, commercial, industrial, agricultural or business establishment shall place
ell solid waste to be collected in proper solid waste containers, except as otherwise provided
In this article: and shall maintein such solid waste containers and the areas surrounding said
containers In a reasonably clean, neat and sanitery condition at ell times.
Sec. 15-22. Specifications for containers.
(a) Residential Refuse. Residential refuse shall be stored in containers of not more than
thirty-five (35) gallons In capacity, nor less than twenty (20) gallons In capacity.
Containers shell be leakproof, waterproof, and fitted with a fly-tight lid, and shall be
properly covered at all times except when depositing waste therein or removing the
contents thereof. The containers shall have handles, bails or other suitable lifting
devices or features. Contelners shall be of a type originally manufactured for
residential solid waste, with tapered sides for easy emptying. The conteiners shall be
of light weight, sturdy construction. The weight of eny individual container, including
contents, shall not exceed IDIY319:Q! pounds. Galvanized metal containers, or rubber,
fiberglass, or plastic containers which do not become brittle In cold weather are
deemed appropriate. mm disposable solid waste contelners, as approved by the
Director, may also be used for storage of residential solid waste.
(b) Residential Yard Waste. Residential yard waste collected by the City shall be stored

fee for said stamp shall be established in the schedule of fees Section 32.1-55.
(c) Recycling waste. Residentiel solid waste designated by the City for recycling shall be
stored In containers, which may be an epproved compartmentellzed container, of not

ill Commercial. Commercial solid weste shall be stored In solid waste conteiners as
approved by the Director. The containers shall be waterproof, leakproof and shall be
covered at all times, except when depositing waste tharein or removing the contents
thereof. Commercial solid waste containers stored on City property shell be
waterproof and leakproof, end shall be covered at all times with a water.tlghtlld locked
in position, except when depositing waste therein or removing the contents thereof.
Commercial solid waste conteiners shall be steam cleened at least twice each year:
once during the month of May and once during the month of August.
m Non-conforming containers. Any container that does not conform to itrll1l!t(gr[m~ori
of thi:; section must be promptly replaced by an approved solid waete container upon
receipt of written notice from the City. If not replaced within seven (7) calendar days
after delivery of such notice, the contelner and Its contents mey be disposed of by the
City as waste.
Sec. 15-21. Location of solid waste containers.
Residential solid waste containers shell be stored upon private property. Commerciel
solid waste containers shall be stored upon private property unless both the owner of the
container and the owner or operator of the premises shall have been granted written
permission from the City Council, by way of written agreement, to use public property for
such purposes. The storage site for both residential and commerclel solid waste containers
shall be well drained, whether stored on public or private property. Further, the storage site
for said container shall be fully accessible to collection equipment, to public health personnel
and to fire Inspection personnel. Regardless of whether permission has been granted by the
City for storage on public property, commercial solid waste containers shell not be placed In
the area between any building and the street rlght-of'way,lncludlng areas commonly referred
to as "parking" between the curb and the private property line. In cases where a conteiner
oannot physically be located enywhere but between the building and street right-of-way, mJ
Director may epprove LIJ! location If properly screened. Containers located within fifty (50)
feet of a street right-of-way must be screened from view from seld right-of-way. In the event
a solid waste container becomes a nuisance by reason of litter, the City mey require the entire
container storage erea to be enclosed by a fence or structure sufficient to prevent litter.
However, nothing herein shell be construed to create any duty on the City to collect
commercial solid waste, which Is specifically prohibited under Section 15-38.

ARTICLE IV . COLLECTION AND TRANSPORTATION
Sec. 16-30, Collection from residential dwellings.
The City shall collect all residential refuse resulting from the operation and maintenance
of single-family, duplex, trl-plex, and four-plex dwellings, as defined In the zoning ordlnence,
when each dwelling or dwelling unit Is located on Its own lot with frontage on a public street.
The City shall make such collections once per week whenever reasonably possible. The
Director Is authorized to adopt reguletlons end to enter Into written agreements to provide

residential solid waste collection to other dwellings. Residential refuse collection shall be
mendatory. Private collection of residential refuse, es defined in Section 15-2, is prohibited.
Those dwellings receiving City refuse collection service on the effective date of this
Ordinance, which would not be entitled to receive such service under the terms of this
subsection, may continue to receive City refuse collection service. In the event such service
is voluntarily discontinued by the owner of any such dwelling for any period of time, the City
may terminete refuse collection service to such dwelling.
The Director may exempt quellfying dwellings from the City's mandatory collection
herein If the Director determines that the dwelling and an adjacent establishment which
generetes commercial solid waste Is part of one complex of buildings, which together serve
a unified purpose.
Sec. 15-31. Collection of tires, appliances and bulky rubbish.
Appllences and tires discarded from use et premises to which collection services ..fe
provided by the City will be collected by the City at such residential premises, but only upon
prior request and arrangement with the City. The owner, responsible party, occupant or
operator of such premises will be billed for collection and disposal of each such appliance and
tire In the amount provided in the S~hedule of Fees, Section 32.1-55 of the City Code.
Bulky rubbish from premises to which collection services ere provided by the City will
be collected, but only upon prior request and arrangement with the City, provided that the
bulky rubbish does not exceed reasonable limitations of weight and bulk, as determined by

thoroughly rinsed prior to dlsposel. The residential recycling of waste Itemized In this section
Is not mandatory. Only properly stored recycling waste shall be collected.
Sec. 15-3~. Certain wastes not subject to collectIon.
The City will not collect any of tho following materiels from any dwelling, residence
or residential premises served by City solid waste collection service: lead acid batteries;
waste 011; or any substance or material determined by the Director to be hazardous or
unacceptable for collection. The Director may edopt and enforce regulations, based on health
and safety concerns, specifying additional substances and materials not subject to collection,
as provided under Section 15-5.
Lead acid batteries and waste 011 are subject to disposel at City solid waste disposal
facilities as provided In Article V of this Chapter.
No person, occupant, responsible party, resident, operator or entity shall obtain or
attempt to obtain City collection of solid waste or other substances or materials herein
declared not subject to collection. Any such separate attempt end/or action by such offending
party shall constitute a separate offense of this provision and Section 15.4. The City's costs
for retrieving such substances or materials from the collection vehicle or from the City's
disposal site, and/or for cleaning up the collection vehicle or disposal site, shall be chargeable
to the responsible perty for the solid waste collection account for the residence, dwelling or
premises where such substances or meterlals were placed for collection. or where ectually
collected. If no account has been established, notice of a violation of this provision shall be
given to the offending party, as provided In Sections 15-4 and 15.6 herein.
Sec. 15-31, TlmesQ";tlf91f!tQtI6}Fand location of collection contaIners.
Refuse, !rOl(~;gmt1rlttiioJJJI9r~J}lJIIY.9lrri9.~Jit9 yard waste, as
described In Sections 15-22, together with other solid waste permitted to be placed at the
curb, shall be placed for collection at the curb of the street upon which the residence,
dwelling or premises fronts. ~pmlJr.wa~~ltl must be physically separated
In order to enable the solid waste collector to easily identify differing contents as well as
differing containers. Yard waste containers and recycling containers must be clearly marked
as such. Placement of solid waste at the curb for collection shall occur prior to 7:00 a.m. on
the regulerly scheduled collection day, but shall not occur before 3:00 p.m. on the day before
the regulerly scheduled collection day. Containers shall be removed from the curb on the
same day collection is made, and returned to a location reasonably near the side or back of
any permanent building on the premises.
Sec. 15-3li. Responsibility for compliance.
It shall be the responsibility of the owner, operator or responsible party for any
residence or dwelling containing two (2), three (3) or four (4) dwelling units to effectuate
compliance with the provisions of Section 15-31l. For single-family dwellings, the owner,
occupant, operator, or the person who Is the responsible party for the solid waste collection
account or tha person who pays the solid weste collection fee shall be responsible for
compliance with the provisions of Section 15-SZ. In the event the fee Is unpeid, the owner,
occupant, or operator of the premises or the responsible party for the premises, shall be
responsible for compliance with this Chapter, and shall be deemed the responsible party for
purposes of securing compliance.

generates commercial, industrial, institutional, or agricultural waste or any combination
thereof, or which operation generates other than residential solid waste.
Sec. 15~. Responsibility of collectors.
(~) Solid waste collectors shall be responsible for the collection of solid waste from the
point of collection to the trensportetlon vehicles, but only If the solid waste was stored
In compliance with Sections 15-20, 15-21, 15-22 and 15-23 of this Chapter.
Any spillage or blowing litter caused or resulting from the collection activities
of the solid waste collector shall forthwith be retrieved by the offending party, and
placed In the transportation vehicles by the solid waste collector.
(b) All solid waste transportation vehicles shall be maintained In a safe, clean and sanitary
condition, and shall be constructed, maintained and operated to prevent spillage of
solid waste. All vehlclas used for transportation of solid waste shall be constructed
with watertight bodies, and with covers which sheil either be an Integral pert of the
vehicle with only loading hoppers exposed, or shall be a separate cover of suitable
material with fasteners designed to secure all sides of the cover to the vehicle. If the
cover of the solid waste transportation vehicle is separate, it shall be secured
whenever the vehicle is transporting solid waste. No solid waste shall be transported
In the loading hoppers.
(c) Permits shall not be required for the removal, hauling or dlsposel of dirt and rock
material from grading or excavation activities; however, all such material shall be
conveyed In tight vehicles, trucks or receptacles, constructed and maintained In such
a menner thet none of the material being transported can spill upon the public rlght-of-
way.
(d) Storage of transportation vehicles used or intendad to be used for collection and trans-
portation of garbege is prohibited in all residential zones.
Sec. 154~i. Residential collection fees.
m The fees for the collection of residential solid weste from residentlel premises, es
defined In Section 15-2, shall be as provided in the Schedule of Fees, Section 32.1-55.

Section 32.1-56. The deposltmt shall be held either until three (3) yeers after establishment
of the account!Jj or until service Is terminated and the account closed, whichever Is earlier.
At such time of termination or three year's duration, the amount of the deposit shall be

Sec. 15-4~. Deposit upon delinquency of account.
A delinquency deposit may be cherged upon repeated delinquency of any water service
account, sewer service account, and/or residential solid waste collection eccount. Upon the
occurrence of two delinquency charges for anyone of these eccounts during anyone calendar
year, the responsible party for the account(s) shall be required to make a combined account
deposit which Is equal to the average two.month billing for the entire account. The average
two-month billing shall be based upon the actual billings during the prior twelve.month period.
If the responsible party already hes a combined deposit being held, that deposit amount
shall be increesed to the proper emount for a delinquency deposit.
Delinquency deposits shall be held either one year efter the estebllshment date or one
year after the last delinquency cherge for a delinquent eccount, whichever Is later. The
deposit shall be released to the responsible party when service Is terminated or when the
account Is closed, at which time the deposit shell be credited to the account.
Section 1544. Lien.
In addition to the above, the City shall have a lien upon the property of any user or
property owner who has failed to pay for solid weste service. After written notice and public
hearing, the City shall adopt by resolution said Iienls), and the city clerk shall certify the
amount of the lien and file the same with the county. Such lien shall attach to the property
receiving solid waste service upon certification by the city council and filing of the lien with
the county. Liens perfected in this manner shall be assessed against the property to the
extent of the balence due to the City for solid waste service supplied and costs incurred In
perfecting such lien. Such lien shall be enforced until peyment in full, at which time the lien
shall be deemed setisfied, and the City shell acknowledge satisfaction thereof and file a
releese with the county. However, any rental property owner or manager who furnishes to
the City, In writing, the name and forwarding address end telephone number (if known) of
former tenants who have vacated the premises where solid waste bills are past due,
delinquent and unpaid, then in thet event the City shall forebear filing the lien provided In this
section.

ARTICLE V . DISPOSAL
Sec. 15.50. Disposal facilities.
Solid wastes shall be deposited at a processing facility or disposal area consistent with
all requirements of local, stete, and federal law. Only persons, firms, businesses, operators
or entities residing, loceted or operating within the landfill service area may dispose of solid
waste at the lendfill, and only provided that such solid waste was generated by activities or
operations occurring within the lendfill service aree.
Sec. 15.51. Hazardous or special waste.
The Director may adopt regulations classifying certain wastes as hazardous or speclel
wastes and mey, pursuant to such regulations, prohibit the disposal of such wastes at the
Iowa City Landfill or require special handling thereof, as provided in Section 15-5.
Sec. 15.52. Disposal of lead acid batteries and waste 011.
Persons, businesses, operators or entitles residing, loceted or operating within the
Lendflll Service Area may dispose of lead acid batteries and weste oil from their private or
commercial vehicles by delivering same to locations approved by the Director, provided thet
such wastes were generated by ectivities or operations located and operating, In whole or In
part, within the Landfill Service Area.
Sec. 16-53. Disposal of appliances at the Landfill.
Persons, firms, businesses, operators or entitles residing, located or operating within
the Landfill Service Area mey dispose of appllences at the Landfill, provided that such westes

Appliances deposited et the Landfill In a crushed condition, or so damaged as to prevent
removal of capacitors or ballasts, shall be subject to a surcherge fee, to be established in the
Schedule of Fees, Section 32.1-55.
Sec. 15-54. Disposal of tires at the Landfill.
Persons, firms, businesses, operators or entitles residing, loceted or operating within
the Lendfill Service Area may dispose of tires at the Lendfill, provided that such wastes were
generated by activities or operations occurring within the Landfill Service Area.

Sec. 15-51. Disposal of yard waste at the Landfill.
Persons, firms, businesses, operetors or entitles residing, located or operating within
the Landfill Service Area may dispose of yard waste at the Landfill, provided that such wastes
were generated by activities or operations occurring in whole or in pert within the Landfill
Service Area.
Sec. 15.5~. Appliances, Mil, yard waste, and llTif{qmlIOO!&i1W~m to be separated
from other solid waste for disposal.
Appliances, m:;, yard waste, and Yo1(1f~elk1JQM{!if.m may not be mixed with other
solid waste delivered to the Landfill for dlsposel. Persons, firms, businesses, operators or
entities disposing of appliances, Iltm yard waste, or ymrs"a,ttiflWiJID1i at the Landfill
shall separate those items from other solid waste materials, and shall deliver and unload them
at the sites designated by the City for disposal of such items.
Sec. 15.5~. Penalties for Improper disposal or disposal of prohibited or hazardous
waste.
It Is prohibited for any person, firm, business, operator or entity to deposit solid waste
at the Landfill in a location other than thet provided by the Director or as directed by Landfill
personnel. It is further prohibited for eny person, firm, business, operator, or entity to dispose
or attempt to dispose of hazardous or prohibited waste at the Landfill In a manner or In a
location other than thet provided by the Director pursuent to Section 15.51 of this Ordinance.
It Is also prohibited for any person, firm, business, operator or entity to dispose or attempt to
dispose of eppliences, Ylm yard waste, or prt!\l1WRE~QBP>>V~~ti at the Lendflllln a manner
or at a location other than that provided pursuant to Sections 15-53, 15-54, 15-55, 15-56
mtJ.I9J of this Ordinance. Violations of either this provision or of any regulations adopted
by the Director pursuent to Section 15.51 shall constitute either a misdemeanor or a municipal
Infrection, and eech vlolotlon shall constitute a seperate offense. The City's costs for
retrieving such substances or materials from the Landfill disposal site, and/or for any costs
Incurred by the City for cleaning up the disposal site shall be chergeable to the offending party
or perties. Repeated vloletions of this provision or of regulations adopted by the Director
pursuant to Section 16-61 shall be sufficient cause for the City's revocation of the Landfill
disposal privileges of an offending party, after written notice of the City's Intention to revoke.
Sec. 15.5~. Disposal fees.
The fees for disposal of solid weste shell be as provided in Schedule of Fees, Section
32.1.55.

ARTICLE VI . LITTERING
Sec. 15-70. Short title.
This article shall be known and may be cited as the Iowa City Antl.Lltter Ordinance.
Sec. 15.71. Definitions.
In addition to the definitions set forth In Article I of this Chapter, for purposes of this
article the following terms, phrases, words and their derivations shall mean the following:
Aircraft Is any contrivance now known or hereafter Invented, used or designed for
navigation or for flight In the air. The word "aircraft" shall include helicopters and lighter-than.
air dirigibles and balloons.
Receptacle Is a litter storage and collection container as required and authorized In
Article 11/ of this Chapter.
Litter is "gerbage," "refuse" and "rubbish" as defined In this Chapter, together with
all other solid waste material which, If thrown or deposited as herein prohibited, unreasonably
endangers public health, safety and welfare.
Newspaper is any newspaper of general circulation as defined by general law , any
newspaper duly entered with the post office department of the United Stetes, In accordance
with federal statute or regulation, and any newspaper flied and recorded with any recording
officer as provided by generellaw; end, In addition thereto, shall mean and Include any
periodical or current magazine regularly published with not less than four (4) issues per year
and sold to the public.
Park Is a park, reservation, playground, beach, recreation center or any other public
area In the city, owned or used by the city end devoted to active or passive recreation.
Private property or premises is any dwelling, house, building or other structure
designed or used either wholly or In part for private residential, business, commercial or
Industrial purposes, whether inhabited or temporarily or continuously uninhabited or vacant,
and shell Include any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox
belonging to or appurtenant to such dwelling, house, building or other structure.
Public place is any and all streets, sidewalks, boulevards, elleys or other public ways,
together with any and all public parks, squares, spaces, grounds and bUildings.
Vehicle Is every device in, upon or by which eny person or property Is or may be
transported or drawn upon a highway, inClUding devices used exclusively upon stationary rails
or tracks.
Sec. 15-72. Prohibited In public places generally.
No person shell throw or deposit litter on or upon any public place within the city
except In public receptacles, or In authorized private receptacles for collection and disposal.
Any person who drops, or permits to be dropped or thrown upon any public piece any of the
above-described materials upon eny county road or stete highwey shall immedletely remove
the same or cause It to be removed, and failure to do so shall constitute a violation of this
chapter.
Sec. 15.73. Placement of litter In receptacles so as to prevent scattering required.
Persons placing litter in public receptacles or In authorized private receptacles shell do
so In such a manner as to prevent the litter from being carried or deposited by the natural
elements upon any public place or upon private property.
Sec. 15.74. Sweeping litter Into gutters, streets or other public places prohibited.
No person shall sweep into or deposit In any gutter, alley, street or other public place
within the city litter or eny accumulation of litter from any bUilding or lot, or from any public
or private sidewalk or driveway. Persons owning, operating or occupying property shall keep
the sidewalk In front of their premises free of litter.

Sec. 15.75. Throwing litter from vehicles.
No person, while e driver or passenger In a vehicle, shall throw or deposit litter upon
eny street or other public place within the city, or upon private property.
Sec. 15.76. Operation of trucks causing litter prohibited.
No vehicle carrying a load of materials shall be driven or moved on any state highway,
county road or city street unless such vehicle Is so constructed or loaded as to prevent any
of its load from dropping, sifting, leaking or otherwise escaping therefrom, except that sand
or other materials may be dropped for the purpose of securing traction, and water or other
substance may be sprinkled on a street or roadway In order to clean or maintain such street
or roadway.
It shall be prohibited for vehicles to deposit from their wheels or track substantial and
unreasonable quantities of mud, gravel or other meterials onto paved public streets or
roadways.
Sec. 15-77. Throwing litter In parks prohibited.
No person shall throw or deposit litter in any park owned by the City, whether within
or without the City, except In public receptacles and In such manner that the litter will remain
in the receptacle until collection, and will not be scattered by the netural elements onto any
park, street, roadway or public place. Where public receptecles are not provided, all such
litter shall be carried away from the park by the person responsible for the litter's presence
on the public property, and shall be properly disposed of elsewhere, as provided herein.
Sec. 15.78. Throwing litter In lakes and fountains prohibited.
No person shall throw, deposit or permit litter In any fountain, pond, lake, stream, or
any other body of water In a park or elsewhere within the city.
Sec. 15.79. Dropping litter from aircraft.
No person in any aircraft shall scetter, drop or deposit any litter, handbill or any other
object within the city or the confines of the munlclpel airport.
Sect. 15-80. Depositing litter on occupied prIvate property.
No person shall throw or deposit litter on any occupied private property within the city,
whether owned by such persons or not; except that the owner, operator or person in control
of private property may maintain euthorized private receptacles for collection in such a manner
that litter will be prevented from being cerried or deposited by the natural elements upon any
street, sidewalk or other public place, or upon private property.
Sec. 15.81. Owners to maintain premises free of litter.
, The owner or person either operating or in control of any private property or premises
shall at all times malntein the property or premises free of litter; provided, however, that this
section shall not prohibit the storage of litter In authorized private receptacles for collection,
or prohibit the compostlng of yard waste.
Sec. 15.82. Throwing or depositing litter on vacent lots prohibited.
No person shall throw or deposit litter on any open or vacent prlvete property within
the city whether owned, occupied or operated by such person or not.
Sec. 15.83. Clearing by City of open or vacant private property upon owner's fellure.
(a) Notice to remove.When,ln the determination of the Dlrector,lItter poses an unreason.
able or dangerous threat to public health, safety or welfare, the Director or hlslher
designee Is horeby authorized and empowered to notify the owner, occupant or
operator of any open or vacant property within the city, or the agent or representetlve
thereof, to properly dispose of litter located on the offending property. Such notice
shall be In accordance with Section 24, Article VI of the Iowa City Code of Ordinances.
(b) Action upon noncompliance. Upon the failure, neglect or refusal of any owner,
occupant, operator or agent so notified to properly dispose of said unhealthful or

dengerous litter within seven (7) calendar days efter receipt of written notice, or within
fifteen (15) calendar days after the date such notice Is returned to the City because
of inability to make delivery to the lest known address of the offending party. the
Director or hls/her designee Is authorized and empowered to abete or cause the
abatement of litter on private property. Abetement of litter on private property may
be accomplished In accordance with Section 24. Article VI of the Iowa City Code of
Ordinances.
(c) Charge for action upon noncompliance. Alter the City has effected the removal of
such offending litter or has paid for its removal. the actual cost thereof. plus accrued
Interest at the. maximum rate designated by law per ennum from the date of
completion of the work, shall remain an obligation of the offending owner, person,
party, occupent or operator. If said costs ere not paid by said offending perty prior
thereto, the costs shall be cherged to the ow~a( of such property andlor levied as an
assessment against the property In th~ same manner as a property tex, all In
accordance with Section 24, Article VI of the Iowa City Code of Ordinances.
Sec. 15-84. Depositing litter at City Landfill sites.
No person shell throw or deposit litter on or upon any City owned Lendfill site. except
In those areas designated for dumping or by the direction of City Landfill personnel.
SECTION 2. REPEALER. All ordinences or parts of ordinances In conflict with the provisions
of this Ordinance are hereby repealed.
SECTION 3. SEVERABILITY. If any of section, provision or part of this Ordinance shall be
adjudged to be invalid or unconstitutional. such adjudication shell not affect the validity of the
ordinance as a whole or any section. provision or part thereof not adjudged Invalid or
unconstitutional.
SECTION 4. EFFECTIVE DATE. This Ordinance shell be In full force and effect from and after
Its final passage and publicetion as iE9Ylitm by law YH11ii9fJ!i!fPL__ml.

ARTICLE I. IN GENERAL
Sec. 15-1. Purpose.
The purpose of this chapter is to provide for the health, safety, end welfare of the citizens
of the city by providing for the collection and disposal of solid waste; by regulating the
storag collection, transportation, processing, dispose I, recycling, reuse and littering of solid
waste; d by providing for the collection and disposal of solid waste.
Sec, 15- Definitions.
The fol wing definitions shall be applicable to this apter unless a contrary meaning Is
Indicated by t e text. The word "shall" is mendatory; t e word "may" is permissive. Terms
not defined s II have the meanings customarily signed to them in Webster's New
COllegiate Dlctlo ry. Uses not defined or listed sh II have the meanings as defined In or
categorized accor ' g to the Standard Industrial Cia slfication (SIC) Manual, Superintendent
of Documents, U.S. overnment Printing Office.
Appliances mean machines common to res' entia I household use, and shall include
refrigerators, stoves, mi owave ovens, dishwas rs, clothes washers, clothes dryers, water
heaters, furnaces, air co Itloners, dehumidlfle s, console television sets, stereo systems,
lawn mowers; and any dev e conteining a ga oline engine, an electric motor or an electric
capacitor.
Bulky rubbish means non trescible r fuse consisting of combustible andlor non.
combustible waste materials wli' h are ~ ther too large or too heavy to be ~Arlry and
conveniently loeded Into solid wast tran~portation vehicles by solid waste collectors.
Commercial solid waste mean s lid waste resulting from the operation of any
commercial, Industrial, institutional. agr ultural or other establishment, and shall also include
solid waste resulting from multiple dw I i facilities having more than four (4) dwelling units.

Dwelling means a buildi g which is wholly or partlall used or Intended to be used for
residential occupancy.
Dwelling unit mean~ y habitable room or group of adjo'Qing habitable rooms located
within a dwelling and f ming a single unit possessing facill~~s which are used, or are
intended to be used, for iving. sleeping. cooking and eating of me~ls.
Garbage means p rescible animal or vegeteble wastes resu~~'g from the handling.
preparetlon, cooking, erving or consumption of food.
Hazardous waste Includes but is not limited to pathological waste explosive wastes,
pesticides, pesticide containers, toxic radioactive materiels, and those ~stes included by
definition in Sectlo 455B.411(4aJ Code of Iowa (1989) and Rules of the Ih~a Department

Landfill shell ean the Iowa City Landfill located in Johnson County, Iowa.
Landfill se ice area means Johnson County Including both Incorporated and
unincorporated ities located therein, together with the cities of Riverside and Kalona, for
which Iowa Clt provides landfill services herein.

Occupant means any person who alone, or jointly or everelly with others, shall be in
actual possession of eny dwelling unit or any other impr ved or unimproved real property,
either as owner, landlord, tenant, resident or operator.
Offending party Is any person, operator, responsi e party, resident, entity or occupant
who has been given notice of a violation of this c apter and who hes not yet cured or
remedied the offense.
Offending property is that property which is In v'olation of this chapter and which offense
hes not been cured-.er remedied.
Operator means ilQY user, responsible party~ cupant, entity, business, firm, corporation,
governmental entity, a sociatlon, partnership, enture, or any combination thereof, or any
agent, fiduciery or repr entative thereof, wh occupies, possesses, uses or owns property
within the Iowa City Lan fill Service Area~ a/or who stores or generates solid waste within
the Iowa City Landfill Ser ice Area.
Owner shall mean an recognized Int rest of ownership in real or personal property,
Including legal and equitable roperty Intq ests.
Person shall include indiv uel pers9.hs, user, responsible party, entity, business, firm,
corporation, association, part rshlp, enture or any combination thereof or any agent,
representetlve or fiduclery there f.
Premises includes eny Interes 'n eal property, including but not limited to buildings and
improvements, whether Intended f or used for residential, commercial or industrlel use.
Processing means bailing, com tlng, composting, Incinerating, recycling, separating,
shredding, together with all oth~r/pro sses whereby solid waste characteristics are either
modified or solid waste quantlty!~ red ed.
Recycling means eny procer.s by whi solid waste Is collected, separated, processed or
returned to use in the form [if raw ma rials or products. Recycling shall include the
compostlng of yard waste, ~t does not in ude eny form of energy recovery.
Refuse meens solid was e not required t be recycled or reused.
Residence means any elling either intan ed for and lor being used for residential use.
Resident means any erson or group of p rsons who occupy a residential dwelling,
dwelling unit, or rooming nit.

Residential solid wa te means solid waste result g from the maintenence and operation
of single-family, duple ,triplex, and four-plax dwelling ,Including solid waste from operation
of a home occupati which complies with the re Irements of the applicable zoning
ordinance.
Responsible par Y means any person, persons or go rnmental entity who applies for,
who obtains or w Is issued an eccount for sewer, wate andlor solid waste service, end
includes any pers n who peys an individual account for a one or a combination of the
following service : Water; sewer and solid weste collection. Responsible party shall also
mean an accou t holder of the above accounts. If more tha one person is listed on an
eccount, both ersons shall be deemed a responsible party for pu oses of collection, storage
and dlsposel f solid waste and compliance with this chapter.
Revocat' n means withdrawal of privileges, termination of lendfil ermlts and withholding
of access the landfill site. Revocation may be carried out by th director upon deter-
mination b the director that sufficient cause exists to revoke, after notlc and an opportunity
to cure t defect or to rebut the existence of the offending cause.
Roo ing unit meens any habitable room or group of adjoining habitable rooms located
within a welling and forming a single unit possessing facilities which ere used, or intended
to be used, primarily for living and sleeping. A rooming unit shall have beth and toilet facilities

Solid waste container eans e receptacle used by a y person or operator to store solid

Solid waste disposal me ns the process of dlscerdi g or getting rid of unwanted material;
in particular, the final disposi 'on of solid waste.
Solid waste managemen means the entire solid waste system of planning and
administering storege, collectio , removal, transp rtation, processing and disposal of solid
waste.
Special waste means solid wa te that must e handled or processed in a special manner
prior to disposal at the landfill.
Storage means keeping, maintain' g, or st ring solid waste from the time of its production
until the time of Its collection and re val.
Transportation means the transpo Ing of solid waste from the place of collection or
processing to the Iowa City Landfill.

Sec. 15-3. County ordinances.
Provisions of this Chapter t gether with a y provision of any ordinance administered
by the Johnson County Board of Haith which Is no In conflict with this Chapter, shell govern
the City's management of solid aste.
Sec. 15-4. Enforcement.
In order to ensure compli ce with this Chapter nd the rules promulgated [pursuant)
thereto, together with all ap IIcable county, state an federellaws and regulations" the
Director Is authorized to insp ct ell phases of solid weste anagement within the juriSdiction
of Iowa City. In all cases were such Inspections reveal th the storege, collection, transpor-
tation, processing, dISP~O , recycling or reuse of solid was e are In violation of this Chapter
or rules promulgated [pur uentl thereto andlor are In vlolatl n of state or federal law , such
violation shall constitute a nuisance andlor an environmental, fraction under both state and
local law. In such eve ,the City may, at Its option, elect to rry out eny one or all of the
following remedies: pI secute environmental Infractions under ction 1.20(d) of this Code;
withhold solid wast menagement services from that person, dwelling, commercial or
Industrial, business, nstltutlon or government entity; deny or rev ~anY permit under this
Chapter: tormlnate service account; dispose of eny nonconformin solid weste container:
or abate the nuisa ce In acqordance with Chapter 24, Article VI of e Iowa City Code of
Ordinances: abet the nuisance under state lew, Chapter 657, lowe C qe (1989). Election
of anyone of th e remedies by the city shell not preclude the city from p~rSulng any other
remedy, and SUf remedies are deemed cumulative and not exclusive.

Sec. 15-5. Director' rule.maklng authority.

(1) Specifications for solid aste storage c~tainers, Including the type, composition,
equipment, size, weight a shape there f.
(2) Weight and size limitations bundle~ solid waste too large for solid waste storage
containers.
(3) Sanitation, maintenance and re lace ent of solid waste containers.
(4) Schedules end routes for coli f 11 and transportation of solid waste by City
personnel.
(5) Collection points of solid waste on alners.
(6) Special identification requirem~nts fo use of solid waste containers.
(7) Collection, transportation, pr96esslng d disposal of solid waste.
(8) Storage of solid waste. /
(9) Records of quantity and types of solid wa te recaived at disposal facilities.
(10) Handling of hazardous pastes, special astes, toxic wastes, sludges, ashes,
agricultural weste, const,ruction waste, bulky 'tems, tires, automobiles, oils, greases,
yard waste, batteries, appliances, and recycla es.
(11) Special carryout servi9~ for the elderly and han ~'capped.
(12) Collection of reslden~al solid waste resulting fro the operstlon and maintenance of
more than four (4) ~welling units.
(13) Billing and collecti9n of disposal service charges at e Landfill.
(14) Hours of operatiio for the Landfill.

ARTICLE II _ COMMERCIAL SOLID WASTE HAUL
Sec. 15.10. Permit required.
No person, b iness, responsible party, occ~p t, operator, or entity shall engage in
the business of receiv g, collecting, trensporting, pr essing, recycling, or disposing of solid
waste within the Iowa ity Landfill Service Area wit out first obtaining an annual permit from
the City; provided, how ver, that this section she not be deemed to apply to employees of
the holder of any such p mlt. No permit shall b required for episodic or Irregular collection
end transportetion of buil Ing demolition mater'al or brick or foundation materials, or of dirt
or rock mete rials from gra 'g or excavafzon tlvitles. However, a permit shell be required
for persons who provide bUI ing demolition ervices or who collect and dispose of building
demolition materials on a reg lar basis.
Sec. 15-11. Appllcatlo .
Each applicant for eny p mit req red by Section 15.10 shall state in its application:
(1) The characteristics of soli wast to be collected, transported, processed, disposed of
or recycled.
(2) The number of solid waste t sportation vehicles to be operated.
(3) The precise area served, and he name of any person, operator, business, entity or
governmentel entity served, f ny.
(4) Thet its employees have an nd rstanding of applicable local, state, and federal laws
end practices governing t colle tion and disposal of solid waste.
(5) Such other information a may be equlred by the Director.
Sac. 15-12. Issuance 0 permit an fee.
If the applicetion for th permit reqUl ed by Section 15.11 end City inspection shows
thet the applicant will collect transport, pro ess or dispose of solid wastes without hazard
to the public health or dama e to the environ ent, and that such collection, transportation
process or disposal will co form with all app 'cable state, federal and local laws and this
Chapter, then the Director h'all issue the permit uthorized by this Article II. A permit sticker
shell be applied to the up el right.hend corner 0 the right door of all solid waste transpor-
tation vehicles. The per it shall be issued for a p riod of one year, end eech applicant shall
pay an annuel fee as pr vided in the Schedule of ees, Section 32.1-55.
Nothing In this ection shell prejudice the r ht of the epplicant to reapply after the
denial of Its applicatlo , provided thet all aspects 0 the reapplicaticn shall comply with the
provisions of this Ch pter.
Sec. 15-13. ransferablllty.
Permits auth rlzed under this Chapter shall be emed personal to the applicant, and
shall not be transf reble or asslgneble in any manner unless specifically approved by the
Director.

Sec. 15-21. Requlr use and maintenance of container and surrounding areas.
The occupant, reside t, operator or owner of every dw ling unit. residence, and of
every Institutional, commerci ,Industrial, agricultural or busi ess establishment shall place
ell solid waste to be collected I proper solid waste container ,except as otherwise provided
In this article; and shall maintal such solid waste containe and the areas surrounding said
containers In a reasonably clean, eat and sanitary condl on et all times.
Sec. 15-22. Specification for containers.
(a) Residential Refuse. Reslden ial refuse shall be ored In containers of not more th~n
thirty-five (361 gellons in cep city, nor less th n twenty (20) gallons in cap~city.
Containers shall be leakproof, aterproof, a fitted with a fly-tight lid. and shall be
properly covered at all times ex ept when eposltlng waste therein or removing the
contents thereof. The containe shall h ve hendles. beils or other suitable lifting
devices or feetures. Conteiners shall e of a type originally manufactured for
residential solid waste, with lapere sid for easy emptying. The containers shall be
of light weight, sturdy construction. weight of any Individual container, Including
contents, shall not exceed Utiy2{R';Ol p unds. Gelvanlzed metal containers, or rubber,
fiberglass, or plastic containers who do not become brittle In cold weather are
deemed approprlete. P-lw dlspos Ie olid waste containers, as approved by the
Director, may also be used for sto ge of esldentlal solid waste.
(b) Residential Yard Waste. Residen al yard aste collected by the City shall be stored

approved by the Direc or. The containers shall be waterproof eakproof and shall be
covered at all times, e ept when depositing waste therein r removing the contents
thereof. Commercial olld waste containers stored n City property shall be
waterproof and leakproo and shall be covered at all t~'m with a water-tight lid locked
in position, except when positing waste therein or moving the contents thereof.
Commercial solid waste co talners shall be steam eaned et least twice each year:
once during the month of M and once during th month of August.
:(llt Non-conforming containers. A y container that es not conform to I1i9tfEq'iflilitl
of this section must be promptl eplaced by a approved solid waste container upon
receipt of written notice from the ity. If not eplaced within seven (7) calendar days
after delivery of such notice, the CQ alner a d its contents may be disposed of by the
City as waste.
Sec. 15-23. Location of solid waste c
Residential solid waste containers shall stored upon private property, Commercial
solid waste conteiners shall be stored upon riv te property unless both the owner of the
container and the owner or operator of e pr ises shall have been granted written
permission from the City Council, by wa~ of writte agreement, to use public property for
such purposes. The storage site for bot residential d commercial solid waste containers
shall be well drained, whether stored 0 public or priv e property. Further, the storage site
for said container shall be fully access' Ie to collection e ipment, to public health personnel
and to fire inspection personnel. Re ardless of whether p rmisslon has been grented by the
City for storage on public property, ommerclal solid waste containers shall not be placed In
the area between any building and he street right-of-way, In uding areas commonly referred
to as "parking" between the cur end the private property IIn . In cases where a container
cannot physicelly be located a where but between the bulldln and street rlght-of.way, ilil
Director may approve L~ loc Ion If properly screened. Contain rs located within fifty (50)
feet of a street right-of-way ust be screened from view from sal right-of-way. In the event
a solid waste container bec mes 6 nuisance by reason of litter, the Ity may require the entire

Sec. 15.30. Collection from residential dwellings.
The City sh I collect all residential refuse resulting from the operatlo and malntenence

residential solid waste collection to other dwellings. Residential refuse c lection shall be
mandatory, Private collection of residential refuse, as defined In Section 1 -2, is prohibited.
Those dw gs receiving City refuse collection service on the ef ective date of this
Ordinance, which would not be entitled to receive such service un r the terms of this
subsection, may c tinue to receive City refuse collection service. In e event such service
is voluntarily disc on inued by the owner of any such dwelling for an~ period of time, the City
may terminate refus collection service to such dwelling.
The Director ay exempt qualifying dwellings from the . y's mandatory collection
herein If the Director etermlnes that the dwelling and an ad' cent establishment which
generates commercial s lid waste is part of one complex of b dings, which together serve
a unified purpose.
Sec. 15.31. Colle tlon of tires, appliances and bulk rubbish.
Appliances and tire discarded from use at premise to which collection services are
provided by the City will be ollected by the City at such sidentlal premises, but only upon
prior request and arrangeme t with the City. The ower, responsible party, occupant or
operator of such premises will e billed for collection an disposal of each such appliance and
tire in the amount provided in t e Schedule of Feas, ectlon 32.1-55 of the City Code.
Bulky rubbish from premi s to which collecti n services are provided by the City will
be collected, but only upon prior quest and arra ement with the City, provided that the
bulky rubbish does not exceed ree on able IImitati ns of weight and bulk, as determined by

Sec. 15.3g. Certain wastes not subject to collection.
The City will ot collect any of the following materi s from any dwelling, residence
or residential premls s served by City solid waste collec on service: lead acid batteries;
waste oil; or any su stence or material determined b the Director to be hazardous or
unacceptable for collec . on. The Director may adopt an enforce regulations, based on health
and safety concerns, sp Ifylng additional substance and materials not subject to collection,
as provided under Sectlo 15-5.
Lead acid batteries nd waste oil are subje t to disposal at City solid waste disposal
facilities as provided In Arti Ie V of this Chapter
No person, occupant, responsible party. resident, operator or entity shall obtain or
ettempt to obtain City collec 'on of solid w ste or other substances or mete rials herein
declared not subject to collectio Any such s parate attempt and/or action by such offending
party shall constitute a separate fense of Is provision and Section 15-4. The City's costs
for retrieving such substances or ate ria from the collection vehicle or from the City's
disposal site, and/or for cleaning up e c ectlon vehicle or disposal site, shall be chargeable
to the responsible party for the solid a te collection account for the residence, dwelling or
premises where such substances or m terials were placed for collection, or where actually
collected. If no account has been est hed, notice of a violation of this provision shall be
given to the offending party, as prov' ed Sections 15-4 and 15-6 herein.

differing containers. Yard wa te containers and rec ling containers must be clearly marked
as such. Placement of solid aste at the curb for coli ction shall occur prior to 7:00 a.m. on
the regularly scheduled coli ction day, but shall not occ r before 3:00 p.m. on the day before
the regularly scheduled c ection day. Containers sha be removed from the curb on the
seme day collection is m e, and returned to a location r asonably near the side or back of
any permanent building n the premises.
Sec. 15.3tt Re ponslblllty for compliance.
It shall bo'the esponsiblllty of the owner, operetor or responsible party for any
residence or dwelling containing two (2), three (3) or four (4) welling units to effectlJate
compliance with the provisions of Section 15.32. For slngle-f i1y dwellings, the owner,
occupant, operator, or the person who Is the responsible party for he solid waste collection
account or the p son who pays the solid waste collection fee hall be responsible for
compliance with e provisions of Section 15-3Z. In the event the f Is unpaid, the owner,
occupant, or op rator of the premises or the responsible party for t e premises, shall be
responsible for ompllence with this Chepter, end shall be deemed the sponsible party for
purposes of s curing compliance.
Sec. -3g. Collection from certain premises by the City Prohlblte .

thereof, or which operation generates othar than residential solid waste.
Sec. 15~. Responsibility of collactors.
(al Solid waste ollectors shall be responsible for the collection of id waste from the
point of colle ion to the transportation vehicles, but only if the lid waste was stored
in compliance ith Sections 15-20,15-21. 15-22 and 15-2 of this Chapter.
Any spll ge or blowing litter caused or resulting fro the collection activities
of the solid was e collector shall forthwith be retrieved b the offending party, and
placed in the tra portation vehicles by the solid waste ollector.
(b) All solid waste tra portation vehicles shall be maintain d in a safe, clean and sanitary
condition, and shal be constructed, maintained and operated to prevent spillage of
solid waste. All vehl les used for trensportation of solid waste shall be constructed
with watertight bodle and with covers which s II either be an integral part of the
vehicle with only loadi hoppers exposed, or all be a separate cover of suitable
material with fasteners signed to secure all s' es of the cover to the vehicle. If the
covar of the solid wast transportation ve ide Is separate, It shall be secured
whenever the vehicle is Ira porting solid w ste. No solid waste shall be transported
in the loading hoppers.
(c) Permits shall not be required for the re oval, hauling or disposal of dirt and rock
material from grading or exca atlon ac Ivltles; however, all such material shall be
conveyed In tight vehicles, truck or re eptaclas, constructed and maintained in such
a menner that none of the materia bel g transported can spill upon the public rlght-of-
way.
(d) Storage of transportation vehicles u d or Intended to be used for collection and trans-
portation of garbage Is prohibited' I residential zones.
Sec. 15-4W. Residential collect! fee.

Sec. 154~. Deposit upon delinquency of account.
A delinquency deposit may be charged upon repeated delinquency any water service
account, sewer serv e account, and/or residential solid waste collecti account. Upon the
occurrence of two de inquency charges for anyone of these account urlng anyone calendar
year, the responsible arty for the eccount(s) shall be required to ake a combined account
deposit which Is equa to the average two.month billing for the tire eccount. The average
two-month billing shall e based upon the actual billings during e prior twelve-month period.
If the responsible party already has a combined deposl elng held, that deposit emount
shall be increased to the proper amount for a delinquency eposit.
Delinquency depo 'ts shell be held either one year Iter the establishment date or one
year after the last dellnq ncy charge for a dellnquen account, whichever is later. The
deposit shall be released t the responsible party wh n service Is terminated or when the
account is closed, at which Ime the deposit shall b credited to the account.
Section 15-44. Lien.
In addition to thG abov the City shall ha a lien upon the property of any user or
property own~r WtlO has failed t pey for solid w te service. After written notice and public
hearing, Ins City shall adopt by esolution sai lIen(s), and the city clerk shall cartlfy the
amount of the lien and file the sa with the ounty. Such lien shall attach to the property
receiving solid waste service upon rtlficatl n by the city council and filing of the lien with
the county. Liens perfected in this ann shall be assessed against the property to the
extent of the balance due to the City or olld waste service suppllad and costs incurred In
perfecting such lien. Such lien shall be forced until payment in full, at which time the lien
shall be deemed satisfied, and the Clt shall acknowledge satisfaction thereof and file a
release with the county. However. an r tal property owner or manager who furnishes to
the City, In writing, the name end fo war g address and telephone number (if known) of
former tenants who have ~acated the pr mlses where solid waste bills are past due,
delinquent and unpaid, then in that vent the ity shall forebear filing the lien provided in this
section.

Sec. 15-50. Disposal f cllltles.
Solid wastes shall be d posited at a processl g facility or disposal area consistent with
all requirements of local, sta e, and federal law. On y persons, firms, businesses, operators
or entitles residing, located r operating within the la dfill service area may dispose of solid
waste at the landfill, and Iy provided that such soli waste was generated by activities or
operations occurring wit n the landfill service area.
Sec. 15.51. Haz rdous or special waste.
The Director ma adopt regulations clessifylng cert in wastes as hazerdous or special
wastes and may, purs ant to such regulations, prohibit t disposal of such wastes at the
Iowa City Landfill or r quire speclel handling thereof, es pr Ided in Section 15.5.
Sec. 15.52. Isposal of lead acid batteries and wast 011.
Persons, bus' esses, operators or entities residing, 10 ated or operating within the
Lendflll Service Ar may dispose of lead acid batteries and w ste 011 from their private or
commercial vahle I s by delivering same to locetions epproved by the Director, provided that
such wastes wer generated by activities or operations located an operating, In whole or In

shall separate those Items from other. solid was e materials, and shall deliver and unload them
at the sites designated by the City or disposal of such Items.
Sec. 15-5B. Penalties for mproper dls sal or disposal of prohibited or hazardous
waste.
It is prohibited for any per on, firm, buslne ,operator or entity to deposit solid waste
at the Landfill In a location othe than that provide by the Director or es directed by Landfill
personnel. It is further prohibitq for any person, fir ,business, opere tor, or entity to dispose
or attempt to dispose of haz ,rdous or prohibited ste at the Landfill In a manner or in a
location other than that provi ed by the Director purs nt to Section 15-51 of this Ordinance.
It is also prohibited for any p rson, firm, business, ope ator or entity to dispose or attempt to
dispose of appliances, Ir!~ yard waste, or Plii1Jl!illlq[dkm~ at the Landfill in a manner
or at a location other than hat provided pursuant to S ctions 15-53, 15-54, 15-55, 15-56
Em of this Ordinan ei Violations of either this pr vision or of eny regulations edopted
by the Director pursuant t Section 15.51 shall constitute Ither a misdemeanor or a municipal
infraction, and each vio ation shall constitute a separa e offense. The City's costs for
retrieving such substan es or materiels from the Landfill isposal site, and/or for any costs
Incurred by the City for leenlng up the disposal site shall be hargeable to the Offending party
or parties. Repeated iolatlons of this provision or of reg lations adopted by the Director
pursuant to Section 1 .51 shall be sufficient cause for the Ity's revocation of the Landfill
disposal privileges of n Offending party, after written notice 0 the City's Intention to revoke.

Sec. 15-70. Sh rt 'tle.
This article shall e known and may be cited as the 10 City Anti-Litter Ordinance.
Sec. 15-71. Deflltlons.
In addition to the eflnltlons set forth in Article I of t IS Chapter, for purposes of this
article the following terms phrases, words and their deriv. tions shell mean the following:
Aircraft Is any cont 'vance now known or harea er Invented, used or designed for
navigation or for flight in the ir. The word "aircraft" sha Include helicopters and Ilghter-than-
air dirigibles and balloons.
Raceptacle is a litter s orage and collection ontain'.; as required and authorized In
Article III of this Chapter.
Litter is "garbage," "ref e" and "rubbish" es defined In this Chapter, together with
all other solid waste material whi h, If thrown or eposited as herein prohibited, unreasonably
endangers public health, safety a d welfare.
Newspaper Is any newspa r of gene al circulation as defined by general law , any
newspaper duly entered with the po t office epartment of the United States, In accordance
with federel statute or regulation, an any ewspaper filed and recorded with any recording
officer as provided by general law; a d, n addition thereto, shall mean and Include any
periodical or current magazine regularly blished with not less than four (4) issues per year
and sold to the public.
Park Is a park, reservation, play, ro nd, beach, recreation center or any other public
area In the city, owned or used by th city nd devoted to active or passive recreation.
Private property or premise Is any dwelling, house, building or other structure
designed or used either wholly or n part fo private residential, business, commercial or
industrial purposes, whether Inhab' ed or temp arlly or continuously uninhabited or vacant,
and shall include any yard, grou ds, walk, dri eway, porch, steps, vestibule or mailbox
belonging to or appurtenant to s ch dwelling, ho se, building or other structure.
Public place is any and a streets, sidewalk boulevards, alleys or other public ways,
together with any and ell publi parks, squares, sp es, grounds and buildings.
Vehicle is every devlc in, upon or by whlc any person or property is or may be
transported or drawn upon a Ighway, Including device used exclusively upon stationary rails
or tracks.
Sec. 15.72. Prohlb ed In public ploces generally
No person shall th ow or deposit litter on or upo any public place within the city
except In public receptac s, or in authorized private recep ecles for collection and dlsposel.
Any person who drops, r permits to be dropped or thrown pon eny public place eny of the

the same or ceuse it t be removed, end failure to do so sha constitute a violation of this

No person, while a driver or passenger In a vehicle, shall throw or deposit II
any street or other public place within the city, or upon private property.
Sec. 15-76. Operation of trucks causing litter prohibited.
No vehicle carrying a load 01 materials shall be driven or moved on any ate highway,
county road or city street unless such vehicle Is so constructed or loaded a to prevent any
of its load from dropping, sifting leaking or otherwise escaping therefrom except that sand
or other materials may be dropp d for the purpose 01 securing traction and water or other
substance may be sprinkled on a treet or roadway In order to clean 0 maintain such street
or roadway.

unreasonable quantities 01 mud, gr vel or other materials 0 paved public streets or

Sec. 15-77. Throwing litter In arks prohlbltad.
No person shall throw or deposit itter In any par owned by the City, whether within
or without the City, except in public rece tacles and I such manner that the litter will remain
In the receptacle until collection, and will ot be sc ttered by the natural elements onto any
park, street, roadway or public place. WIi re p lie receptacles ere not provided, all such
litter shall be carried away from the park by t person responsible for the litter's presence
on the public property, and shall be properl isposed of elsewhere, as provided herein.

any other body of water in a park or e ewhere ithin the city.
Sec. 15-79. Dropping litter fr m aircraft.

object within the city or the confl es of the munici I airport.

No person shall throw or d posit litter on any occ pied private property within the city,
whether owned by such person or not; except that the wner, operator or person in control
of private property may melntai authorized private recept c1es for collection In such e manner
that litter will be prevented fro being carried or deposlte y the natural elements upon any
street, sidewalk or other pub c placa, or upon private prop rty.
Sec. 15-81. Owners to maintain premises free of II r.
The owner or perso either operating or In control of a y private property or premises
shall at all times maintain t e property or premises free of IItte provided, however, that this
section shall not prohibit e storage of litter in authorized prlva e receptacles for coll6ctlon,
or prohibit the compostl of yard waste.
Sec. 15-82. Thr wln'g or depositing litter on vacant lots rohlblted.
No person shall row or deposit litter on any open or vaca t private property within
the city whether owne ,occupied or operated by such person or t.
Sec. 15-83. CI arlng by City of open or vacant private prope y upon owner's failure.
(a) Notice to rem ve.When, In the determination of the Director, II er poses an unreason.
able or dange ous threat to public health, safety or welfare, t e Director or hlsiher
designee Is ereby authorized and empowered to notify the wner, occupant or
operator of y open or vecent property within the city, or the age t or representative
thereof, to roperly dispose of litter located on the offending pro rty. Such notice
shall be In accordance with Section 24, Article VI of the Iowa City Co ~f Ordinances.
(b) Action uPq~ noncompliance. Upon the failure, neglect or refuse I f eny owner,

dangerous litter within seven (7) calendar days after receipt of written notice, (within
fifteen (15) calendar days after the date such notice Is returned to the Ci because
of inability to make delivery to the last known address of the offend I party, the
Director or his/her desl nee Is authorized and empowered to abat or cause the
abatement of litter on prl ate property. Abatement of litter on priv e property may
be accomplished in accor nce with Section 24, Article VI of the owa City Code of
Ordinances.
(c) Charge for action upon non omp/iance. After the City has e ected the removal of
such offending litter or hes p id for Its removal, the actual c t thereof, plus accrued
interest at the mexlmum ra e designated by law per num from the date of
completion of the work, shall emain an obligation of th offending owner, person,
party, occupant or operator. I said costs ere not paid y said offending party prior
thereto, the costs shall be char d to the owner of su property and/or levied as an
assessment egainst the proper Y in the same m ner as a property tax, all in
accordance with Section 24, Artl Ie VI of the low City Code of Ordinences.
Sec. 15-84. Depositing litter at ty Landfill site .

In those areas designated for dumping or y the dire ion of City Landfill personnel.
SECTION 2. REPEALER. All ordinences or arts of rdinances In conflict with the provisions
of this Ordinance are hereby repealed.
SECTION 3. SEVERABILITY. If any of secti n, provision or part of this Ordinance shall be
adjudged to be invalid or unconstitutional, sue djudication shall not affect the validity of the
ordinance as a whole or any section, prov' n or part thereof not adjudged invalid or
unconstitutlonel.

working hours, a $30.00 altar-hour fee shall be
cherged In addition to the normal working hour
fee. In addition, whan service time alter hours
excaads 2 hours, an additional charge will be
added to cover aqulpment expense and actual
amployee wages, including ovanlme. The
watar service division's normal werking hours
are 8:00 a,m. to 4:00 p,m. daily.
SECTION III, EFFECTIVE DATE. This
Ordinance shall be In full force and effect from
and alter Its final passage and publication, as
provided by law, but not before August 1,
1993.
SECTION IV. SEVERABILITY. If any of the
provisions of this Ordinance are fer any raason
daclared Illegal or void, then tha lawful
provisions of this Ordinance are deemad
sevarable from said unlawful provisions, and
shall remain In full force and effect, the same
as If the Ordlnanca contalnad no lIIagal or void
provisions.
SECTION V. REPEALER. All ordinances or
pans of ordinances In conflict with the
provisions of this Ordinance are hereby
rapealad.
