WHEREAS, on July 31, 1990, the property owners of 900 Clark Street, Iowa City, Iowa executed e Promissory Note in the amount of $1,197.00 in exchange for a no-interest loan; and WHEREAS, said Promissory Note created a lien egainst subject property; and WHEREAS, on June 25, 1993, the balance due under the Promissory Note was paid in full. "~ -.-.:-.-'-~ RELEASE OF LIEN The City of Iowa City does hereby release the property located at 900 Clark Street, Iowa City, legally described as follows: Commencing at the Northwest Corner of Lot One (1) in Hill Crest, Price's Addition to Iowa City, Iowa, according to the recorded plat thereof, thence South 99.6; thence East 125 feet; thence South 65 faet; thence East 48 leet; thence North to the South line of the right.ol-way of the Chicago, Rock Island and Pacific Railroad Company; thence Northwesterly along the south line of said right-of-way to tha place of beginning. Excepting therefrom land described in Book 1008, Page 437, from an obligation of the property owners to the City of Iowa City in the principal amount of $1,197 represented by a Rehabilitation Agreement and a Promissory Note recorded in the Office of the Johnson County Recorder on August 29, 1990, in Book 1163, Pages 99.103. This obligation hes been satisfied and the property is hereby released, in full, Irom any liens or clouds upon titla to the above property by reason of said prior recorded documents. The weather during the last nine months has created a condition in which it is not economical to bid sewer projects. Not only are contractors months behind on their work, but the wet soils .make what little construction that is taking place slow and expensive. This condition is expected to continue throughout the 1993 construction season. In our judgement it is best to rebid the project during the . winter for construction in 1994. Prices may still be slightly elevated because of the backlog of work but the weather - we hope - will be better. In the interim, we will need to install quality backflow preventers on the Bean and Kelly residences. "- SIXTEENTH RENEWAL OF A 28E AGREEMENT FOR TRANSIT SERVICES This sixteenth Renewal Agreement is entered into by and between Johnson County, Iowa, and the City of Iowa city, Iowa, both municipal corporations. WHEREAS, the parties hereto wish to renew their Agreement for Transit Services which is recorded in Book 501, Page 303 in the Office of the Johnson county Recorder. BE IT AGREED by and between Johnson County, Iowa, hereinafter referred to as the County, and the city of Iowa City, Iowa, hereinafter referred to as the city, as follows: 1. The sixteenth renewal term of the 28E Agreement referred to above, as amended, shall commence July 1, 1993, and continue for one year through and including June 30, 1994, 2. The county shall operate the service within the corporate limits of Iowa city from 6:00 a.m. until 10:30 p.m., Monday through FridaY1 6:00 a.m. to 7:30 p.m. on Saturday; and 8:00 a.m. to 2:00 p.m. on Sunday,. including the holidays of Martin Luther King's birthday, Presidents' Day, Veteran's Day, and the day after Thanksgiving. All specific operational decisions shall be made by the Board of Super- visors and the SEATS Manager to maximize responsiveness to demand and productivity. 3. The County shall continue to request a donation from city residents using the SEATS system. All such donations will be retained by the County to help defray operating expenses. The average donation per passenger in FY94 will be used to establish a basis for payment by the city to the County in FY95. During FY94 the county shall provide the city with daily data sheets which include the origin, destination, and time for each city trip, and a total of city donations for each day. 4. To the degree required by the Federal Transit Administra- tion, SEATS will comply with applicable regulations regarding drug and alcohol testing. 5. For service operated during FY94, the city agrees to pay the county $291,000, Payment by the city to the County shall be made in twelve'equal payments of $24,250. Total funding by the City for service during FY94 shall no~ exceed $291,000. 6. In the event that a contract is executed in FY94 between Johnson county SEATS and the Iowa city community School District which diminishes service provided to the city, the county agrees to reduce the city's expense for SEATS service by a similar amount. The County shall indemnify, defend, keep and save harmless the City, its agents, officials and employees, against all claims, suits, liabilities, judgments, costs or expenses, which may in any way be made or claimed against the city in consequence of this agreement. The County shall, at its own expense, provide insurance protection with respect to this indemnification agreement. 8. The original Agreement, as amended, between the parties shall, to the extent not inconsistent herewith, remain in full force and effect. 9. This renewal agreement shall be filed with the Secretary of the state of Iowa and the County Recprder of Johnson county, Iowa. Proposals were mailed to fourteen locattowing service providers. The City received one proposal from Holiday Wrecker Service, Inc. the current towing service provider. Staff is recommending an award to Holiday; a resolution is on the agenda for approval. A few notes regarding the RFP: . City receives no direct revenue from this contract. . 3 year contract will continue. . 2,719 tows in the past year. At a conservative $50/tow = $136,000 contract. Approx. 1500 tows during the busiest 4 months of Sept./OctlNov.lDec. of which 200 billed at a $20 show up fee = $4,000 and 150 trucks were called back(canceled before half way) = $0. The show up fee appears to be a fair way to cover contractors expense, without passing onto all tows in conjunction with payment of parking fines. . Insurance coverage remains the same; adequate but not excessive. . City will continue to pay for it's own auto/smalltruck tows; 14 in the past year. . Storage fee upon Police request- following 7 days this fee can be negotiated to a lesser amount do to type of vehicle, length of stay and circumstances. Randy Larson had directed a letter to the Police Chief in May 1991 regarding a client having to pay storage fees due to a police investigation which resulted in what he felt was unfair charges.
