City of Iowa City MEMORANDUM Date: July 12, 1993 To: Robert Miklo, Associate Planner Mary Lee Dixon, Property Consultant w.P Value of Vacated Alley (as per attached map) From: Re: I am responding to your request In regard to determining the market value of the vacated alley as shown on the attached location map. Sales of similar parcels provide parameters in establishing a value for the subject property. The attached Exhibit A shows several comparable sales that have occurred In this area. These sales should be adjusted since they date as far back as 1987. A 3% adjustment per year for Inflation would be reasonable. Because It involved land in the Immediate area, the sale between the City and Iowa City Law Building Partnership Is a good comparison. In that case the City sold the vacated alley to the north of the property now being requested (see Exhibit B) for $2.73 per square foot. That sale occurred In 1987. Adjusting for Inflation at 3% per year, the square foot value today would be $3.22. It should be noted that this property was subject to utility easements and could not be built upon, whereas the portion of the alley now being requested could potentially be built upon, and therefore would have greater value per square foot. The higher visibility and access to an arterial street would also result In a greater value for the subject alley. In addition to determining value by using the method of comparable sales, you may also want to look at the assessed value of the adjacent land as a valuation method for the subject parcel. According to the location map (Exhibit B) and the figures from the Assessor's records, the assessed values of the adjacent parcels are as follows: A: $4.00 per square foot B: $5.61 per square foot C: $2.45 per square foot. If you average the square foot values of parcel Band C since the majority of the alley abuts these two parcels, the value Is $4.03 per square foot. As I have mentioned In previous memos, the value of such parcels may be minimal If sold on the 'open markel'. Typically, the size and shape of such parcels affect the value In a negative way. On the other hand, these parcels can be very valuable to adjacent property owners since they can be added to exlsllng parcels and therefore provide a larger parcel for building, etc. The sales listed on the attached chart are all sales of land to adjacent property owners. In summary, the value of the subject vacated alley according to the two methods of valuation described would be between $3.22 and $4.03 per square foot. If the applicant does not agree with this price, I would suggest that the City hire an appraiser to establish the fair market value for this parcel with the cost of the appraisal being paid by the applicant. Currently, the zoning ordinance Is silent on the regulation of such establishments. Staff has conducted a survey which Indicates that there are three existing bed and breakfast establishments In Iowa City. One Is located In the Central Business Service zone (CB'2) and Is regulated as a hoteVmotel. One Is located on N. Linn Street In an area zoned Medium Density Slngle.Famlly (RS-e). One Is located In an area zoned Low Density Single- Family (RS-5) on Buena Vista Drive. There has been some discussion by staff as to whether or not these existing establishments In residential zones can be permitted as home occupations or whether their guests can be considered boarders under our current regulations. In order to resolve any question regarding the leglUmacy of these establishments and other Issues such as parking and length of stay of guests, staff has drafted the attached zoning amendments. Proposed Reoulatlons: The proposed amendments would divide bed and breakfast establishments Into two categories. Bed and breakfast homeslays, which would be limited to owner-occupied slngle.famlly homes or duplexes with a maximum of three bedrooms available for guests, would be allowed as accessory uses In all residential zones except the Factory Built Housing Residential zone (RFBH). The length of a guest's stay In these facUlties would be limited to 30 consecutive days. This would discourage the misuse of bed and breakfast establishments as rooming houses where boarders would stay for extended periods of time. Such establishments would also be required to provide at least one off-street parking space In addition to the spaces required for the principal dwelling. The proprietor of such an establishment would be required to apply to the Building Inspector for a permit at the time of the establishment of the bed and breakfast homestay. The permit would need to be reissued every two years. This would allow the Building Official to perform a general Inspection of the property with the Intent of assuring that the bed and breakfast homestay had sufficient parking and complied with City codes. In the event that such an establish- ment did not adhere to the regulations and created problems for surrounding residential properties, the City could seek resolution of these Issues or revoke the required permit " a satisfactory solution could not be found. Staff believes that limiting the number of guest rooms to no more than three would help assure that the Intensity of these bed and breakfast homes/ay establishments would be compatible wllh surrounding residential land uses. The second classification of bed and breakfast establishments would be bed and breakfast Inns. Bed and breakfast Inns would potentially be more Intense than bed and breakfast homestays, In that they could contain up to five guest rooms. The requirements for bed and breakfast Inns would be similar to those for homestays; however, they would only be allowed by special excaptlon In all residential zones except the RFBH zone. This would allow more oversight by the City, and because special exceptions require a hearing, neighboring property owners would have notll/catlon of the proposed use prior to Its establishment. The Board of Adjustment could Impose additional conditions on a case.by.case basis as determined necessary. Staff has sent a draft of these proposed regulations to the existing operators of bed and breakfast establishments. It appears that all of the current establishments would conform with the proposed regulations. If these amendments are adopted, however, these establishments (with the exception of the bed and breakfast Inn located In a commercial zone) would be required to seek a permit from the Building Official. Staff Recommendation: Staff recommends that the attached proposed amendments to allow bed and breakfast homestays and bed and breakfast Inns as accessory uses, subject to certain conditions, In all residential zones except the RFBH zone be approved.
