Iowa City, IA 52245 Dear Mlnnette: The purpose of my letter Is to express my concerns wnh respect to H.F, 672, an act which ,would greatly reduce the effectiveness of the urban renewal law and the use of tax Increment financing, Though the Inlenl of the bill, which Is apparently designed to limit the abuses of tax Increment financing, may have some mern, H,F, 672 has the potential of crippling cities' abilities to effectively use tax Increment financing, Our two major concems are 1) the requirement of forming a fiscal review commntee and the potential delays this could create and 2) undermining the effectiveness of a TIF district by changing the dale at which the base assessment occurs, Requiring a municipality to notify affected taxing districts of a proposed TIF project Is not an unreasonable requirement. However, the proposed process In H,F, 672 co~ld cause untimely delays for sne specific economic development TIF projects thus potentially requclng a communny's ability to compete with other states for Industrial projects, Rather than requiring the formation 01 a fiscal review committee to Identny fiscal Impacts I n would seem more appropriate that an affected taxing district be given the opportunity to demonstrate how the TIFs use would negatively Impact the fiscal operations of that district or jurisdiction, . From: City Manager Re: Airport As the debate continues with respect to the Iowa City Municipal Airport and our requirement to fulfill FAA compliance standards, I have a number of concerns that I feel must be brought to your atlentlon, most of which are of a political and financial nature, I am concerned you may be trapped Into a decision that not .only you will not like, but also the public's acceptance of your decision will be less than understanding, I wish to avoid passing judgment on proposed airport alternatives; however, there seems to be an assumption that a 'do nothing' option Is acceptable, The definition of a 'do nothing' option also has been debated with many Individual opinions and expectations. Of the Information I have avallable~ and I recognize It may not be In the same detail as members of the Airport Commission, It reaffirms we will be required to meet FAA compliance standardS regardless of whether we 'construct a new relocated airport or reconstruct on the existing site, Doing nothing simply does not appear to be a realistic option, If we choose to stay at our existing site, I believe there are many fiscal and polltlcal'lssues which will need your atlentlon, Remaining on our existing site does not relieve the City of FAA compliance standards, These are not new, and have been on the FAA books since approximately 1988. To date, the FAA has apparently been satisfied with our efforts to work toward fulfillment of compliance standards, I have always understood the goal of tlie Airport Commission was to build an airport which will meel our needs well Into the future with respect to providing a facility for current and future aircraft, This leads to several questions, Can we fulfill compliance standards at the existing airport site and meel current and future aircraft needs? This appears to be, at best, a remote posslblllly which will Incur substantial cost to the City and the FAA, The next question to arise will be whether the FAA Is willing to undertake such an Investment when they could build a new 159~ ; i . ; ~ I 1\ :1 i1. The Initial and likely most difficult element of your decision with respect to compliance standards Is a sIgnIficant capital program Investment, particularly the purchase of private property. The bowling alley, parts of the 4.H farm, a trailer court, etc, all appear to need to be purchased and structures demolished within runway protection zones In order to comply with design standards, Regardless of relocation or renovation at the existing site, private property will be purchased, Additionally, the airport Is approaching 50 years old and the runways, taxiways, hangars, and terminal building will need significant repair or replacement. The recent study did not discuss the terminal bulfdlng, however, some factor for compliance with ADA must be considered In addition to whether the existing building Is even acceptable, If the prevailing political Interest were to remain for doing this work at the existing site, It would appear we would be Investing heavily In an airport which will not meet aviation needs either present or future, A significant capital expense will likely cause a community debate over the Investment In an airport, At the very least, I suspect the debate will occur with respect to the community's willingness to Invest In an airport recognizing there will be little return, that Is, the resulting airport when renovated will have resulted In newer, but not Improved facilities with respect to aircraft capabilities. As Indicated In Option 1 (current site) from the airport study, the major drawback to this altematlve Is the Inability of the current site to provide a facility necessary to accommodate the range of aircraft that oresentlv use the airport, As the deterioration of the capital assets at the airport continues, as well as our obligation to fulfill FAA compliance standards, It may hit at precisely the wrong financial point In time In our community's history. As you know, we are planning expenses In the neighborhood of $40.to $70 million for renovated water and sewer system, as well as many other projects, Significant capital expense, whether It be with FAA funds and limited City, or a substantial City share with limited FAA money, I am sure you can appreciate the political and financial consequences and the likely debale that will occur. There are many capital projects which will compete with the airport for available monies, Additionally, once you h!ive made the Investment assuming a decision to remain at the existing site, It would appear difficult to move the airport to another location at some time In the future due to ail of the resources sunk Into the project. If at any time the Issue of compliance standards Is questioned by the FAA, It could result In a material change In our liability exposure and our Insurance representatives Indicate It could result In grounds for removing the airport from our Insurance program. They also Indicate Ills vlrtually'lmposslble to secure such Insurance from other markets, The FAA, as you can see, has a significant controlling Influence over the airport, Its location, our future capital Investment, as welf as the community's risk In owning and operating an airport, This Is a knotty political problem and I believe we need to set aside time for discussion to review these Issues, Regardless of circumstances, the ultimate disposition of the airport rests with the City Council, I want you to be fully aware of the significant tlnanclal exposure that may occur, and the fact that the FAA, while they appear to 'be willing to support our policy discussion process, will be the key factor In any decision, The community's critique of the decision will also be complex, particularly when no shortage of opinions exist. I. am sure the critique will be without benefit of all available Information and therefore only cause further consternation, partlculariy If the expectation Is that we can remain at the current site and handle current aircraft needs. In summary, I believe the following represents the basic Issues: 1. The airport as a capital project will be In direct competition with other capital projects, These other projects are more expensive, higher community profile, mandated by federal . or state orders, and therefore community expectation Is far different. In preparing the capital plan you will need to consider whether to set aside some fulure debt for the airport, . calling further atlentlon to your commitment. 2. In order to satisfy compliance slandards, we will need to make further acqulslllons of private property, many of which are high profile properties, Regardless of opllon, further properly acqulsll/on appears Inevitable. I do have a concern whether the consultant Indication of approximately $5 million (existing site) cost Is a realistic number. For example, the purchase of a bowling alley Involves more than merely compensating for bulfdlngs and land, You must consider the value of the business, 3. " 4 4, I believe the community debate will end up In a simple straightforward decision as to whether or not the Investment Is worthwhile In the existing site, and whether the airport Is as Important as other capital needs, water, sewer, open space, streets. 5, The Issue of moving the airport and the rural complaints have not diminished and your 'neighborliness' as a City Council will be called Into question, Just as It will when you look to purchase property In runway protection zones, Whether you purchase an outlying farm for a relocated airport, or the bowling alley, etc. for a renovaled existing site, such property acquisition seems to always cause substantial criticism, 6. If you move the airport to a new site, It will require a referendum for any capital borrowing, Can you assess the likelihood of passage of such a bond referendum? If a bond Issue does not pass, It brings us right back to the option of using the existing site, and ultimately an undesirable capital asset that does not meet current or future needs. 7, The airport Issue Is complex with many opinions, yet how do you generale a meaningful decision about the airport, which Is part of our community's history, without raising the Issue of what could happen If we were to close It. That question was apparently not considered within the realm of options by the Commission, Such a debate would certainly not satisfy the Interests of the Airport Commission, I recognize this results In a difficult political decision for you, but we have the possibility of a community debate over the political popularity of a public service (airport), the weight of the FAA's money to see that It continues, and many other community Interests, I I i; . I believe the airport, Its future, our Investment exposure and I,s relationship with other public services we provide needs to be brought Inlo focus as soon as possible, or the momentum of a negative debate will continue to work against you In this decision, I do not know the outcome of your debate, but the longer you walt your options appear to grow fewer, and definitely more complex. The FAA can walt as long as they like because they control the finances, the standards, and the timing, We controlliltle but will end up on the receiving end of the outcome of a. polley we have not guided to conclusion, but have been steered through by others with circumstances they created for you, It would appear If we are to remain at the existing site, It needs to be stated so a plan can be formulated to accomplish that goal, Identify the financial consequences, and confirm FAA support. City c)f Iowa City MEMORANDUM Date: July 23, 1993 To: City Council From: City Managar Re: Flood Damage Estimate to Public Property In order to provide our Congressional delegation with some idea of the cost todate, as well as projected costs associated with the City's involvement in flood recovery and general cleanup, we have assembled an estimate of costs, This information represents our cost estimates through July 21 and therefore any costs that are incurred after that date must be added to this estimate. Keep in mind that the longer the flood water remains, the greater potential for cost associated with cleanup, as well' as damage to public property. , : i i i; ~ I. : Iii II " 'i il. I: .1 I. I 1\ :: Ii i' , ,. f' I; I'; " , I I I II I " 'I I Our immediate City response in the form of personnel and equipment has resulted in a cost of $205,000. Generally speaking, you can estimate that our response costs approximately $100,000 Ii week beyond our routine public service responsibilities. When estimating the cost of cleanup, we include such major projects as bridge maintenance, riverbank erosion, street repair and reconstruction, park facility reconstruction such as tennis courts, baseball fields, etc. and specifically the repair to Benton Street. The biggest single project in the estimate is a reconstruction of Dubuque Street which is estimated to be $2 million. This is a very general estimate and whether we could even construct the street to a height sufficient to protect it from future flood waters Is problematical, These are, again, very rough estimetes but will give you some idea of our costs to date and potential exposure. We will be using the number of $4.033 million. Please keep In mind that es I have indicated, the costs will continue to grow the longer the water remains. Our Congressional delegation has bean Informed. I I Aa: Construction of Additional Levees ; 1 , . , , We are beginning to receive requests from what ara certainly distraught residents and business owners about the possibility of constructing additional sandbag levees to further protect their pro parties and pump water so that businesses may reopen, As I am sure you can appreciate, this is a very complex engineering and political decision as well as significant undertaking. I have requested that Aick talk with representatives of the Corps of Engineers to determine whether the circumstances in our flooded areas are aven practical from a technical standpoint to consider such work, We as a city government do not have the resources, that Is in the form of City crews and the type of equipment that might be necessary to construct some of these levees. Additionally, we have the problem of deter- mining which area would receive the levee construction, Certainly, it will be difficult to make such a choice; however, we will discuss with the Corps the possibilities. I would assume if we receive any indication that this work can be done, it will require coordinating our work effort with the Corps, National Guard, and likely private contractors, if they are available, II: I I: ,i ;, If .1 r; L I ~ I II i" {o , , , i' i ., I I I ! We hava re'ceived particular intarest from the South Gilbert Street businasses. This area has received a quick engineering analysis by our staff and It would prove to be a most difficult situation. In order to construct the sandbag wall to protact those properties, it would require our going into the water, searching for and plugging manholes as well as determining a location to provide for e secure foundation for such a levee, This is a problem we believe could result in dangerous circumstances for workers involved for little gain, The river's edge . Is sand and rubble and, tharefora, the construction of a wall may simply be a futile effort in that the river water pressure may find its way through the rubble and sand, in other words under the levee structure. '1 , , - '- " -~--" '-.-. 2 pump the area dry, which could take many days, I do not wish to give these businesses a false sense of security in thet if we were able to build such a levee, pump the area dry, that they are forever protected, If the river were to breach the levee they could be closed a second time following their cleanup effort. We will continue to pursue these construction options; however, they are very expensive and we are not fully sure of whether they can provide the benefit that individuals expect. Also, we are not aware of federal financial support and the levee would need to be removed, at City expense. I assume City liability could increase dramatically if we are directly involved in such construction, If a levee wall were to collapse, the water pressure, force of flow, could cause significant damage. There has been some comparison to the work being undertaken in Coralville to reopen First Avenue by the sandbag levee they recently constructed, Our circumstances are far different in thet Coralville attempting to reopen First Avenue and a few businesses will enjoy the benefit of that work. The levee is also built on a stable, paved surface,. Protecting these businesses from Clear Creek is a far different set of circumstances than attempting to protect businesses from the flow of the Iowa River, We will continue to pursue all. options in order to accommodate all of our business and citizen requests. nIUIV... Re: Service Shedding By the subject matter of this memorandum, I suspect you were curious as to what 'service shedding" means, I am not sure whether I learned of the term as one of the recent buzzwords being bantered about among municipal, county, and school district officials or inadvertently invented the term, What it simply means is ,that due to revenue shortfalls or other restrictions on one particular government, they do their best to unload, pass off costs, or in any other way possible have a public service provided by another governmental unit.. At the very least, substantially reduce the cost to one government by transfer of costs (not necessarily responsibility) to another, Upon reflecting about this Issue, it appears that we may have some local examples and issues developing that could have a long-term, and possibly profound, financial effect upon the City government. These circumstances may occur incrementally and thereby can often go unnoticed, While I do not see a deliberate pattern developing, clearly other Iowa City area governments are looking to other governments to either amend an existing public service program reletionship, assume costs not traditionally the responsibility of another, or seek financial support diractly or indirectly for a program/project initiative. The school district, for example, constructed a new school in a policy atmosphere conducive to their needs and now requires the City through City financial resources to build capital facilities to satisfy a school district project need. Another recent example is a traffic study undertaken by the school district whereby they are advised what types of traffic improvements their consultant feels are necessary and therefore it will certainly become City responsibility to finance these Improvements, A very subtle but recent change was the school policy, which Is now ,.~.' This simply means that the parents will look to others, notebly other governments, to satisfy their children's street crossing safety requirements, such as the corner of Third and Court near Hoover School as mentioned in the recent school sponsored traffic study. I assume this Jocation is thought to be out of sight of the school. Adult crossing guards become the obvious answer at City expense, The debate concerning SEATS, not only from the school district perspective but also the county, is a further example of passing costs along to other jurisdictions. The library negotiations involved a difference of opinion as to who should pay and how much. A new issue about to arise is the contractual relationship between the Senior Center and the nutrition program--Congregate Meals.-and how we do business with the County in the provision of this public service at a City-owned facility. This will likely create additional debate among the elected boards governing the various public services provided. I do not know the answer to this issue but I suspect it is a pattern of behavior that will likely continue and the City, as a general purpose local government and the most high profile . government in our area, I expect we will receive the most requests, The financial obligations will likely fall on the City Council more so than they have in the past, There is certainly a need for area governments to cooperate and serve our community, but we also must be awaie of the consequences. The inflow is 15,100 cfs and dropping and outflow remains at 24,500 cfs. The weather forecast for Tuesday was approximately 1/2 to 1 inch of rain and then clearing, Weather Service indicated that a change in the weather pattern is likely to occur due to circumstances associated with the jet stream. The following represents what we believe to be, and in consultation with the Corps of Engineers, a good weather schedule, 1. Thursday, July 29 - the Reservoir level should be at 714 and 1.380 and 965 can be reopened. 2, Gunday, August 1 - the Reservoir level should be at 712. the outflow from the emergency spillway will cease and discharge levels from the Reservoir will decline to 20,000 cfs, This could result In an approximately one foot decline in the water level in Iowa City. 3. Friday August 6 - the Reservoir level should drop to 707 and the emergency procedures implemented by the Corps of Engineers would discontinue, 4. Monday, August 30 - public school starts, 8, Saturday, September 4 - first home football game, Other initiatives that have been undertaken in the last few days included hiring a safety consultant. We had this individual walk through our safety procedures and do risk assessment for us at our water treatment plant and wastewater treatment plant. We were provided some additional information, but all in all, we were very satisfied with our review and the actions had been taken to date. Hopefully, later today we will also be able to stop the wastewater bypass caused by the Benton Street sewer collapse. This is still somewhat speculative, but our goal is to have that circumstance under control. Over the weakend of July 24-25, sandbag levees were built along South Gilbert, We provided the sand and sandbags. An assessment of these levees was undertaken late Monday evening, There is still substantial seepage and, therefore, the pumping that we will be doing on behalf of the property owners may not be to any significant advantage. Last night's rain did slow down the pool level decline and the inflow into the reservoir increased slightly. Outflow remains at 24,500 cfs, The National Weather Service forecast was clear for several days. , Generally speaking, the schedule I provided you in the previous memorandum will continue, We have also experienced our first efforts at clean up, The South Gilbert Street area has cleared substantially and our pumping efforts appear to have worked. We have done some initial efforts in clean up, specifically from the public right-of-way, This involves removal of a several.inch-thick muck/mess, We then flush the street area and perform street sweeping, We will attempt to work with the property owners in order to assist them, Our general policy will be that we will do our best to avoid going onto private property wherever practical, I have discussed this matter with the City Attorney's Office and we will do our best to not only provide for a thorough and responsible clean up, but protect the City from future liabilities, Many of the private parking areas are asphalt that may have been undermined by the water and thereby any of our heavy equipment could severely damage the paved area, Many of these decisions will need to be made in the field by our personnel to determine whether equipment can be used, Generally speaking, we are going to do our best to encourage property owners to get the mess to the curb and we will assume responsibility for removal. With the use of the sand bags, we were able to build a dike to gain entry to our service bays and resume parts and service operations, thus limiting the days we were totally closed to four out of the last fifteen. Unfortunately, after a valiant effort for many days to keep the water out of the bUilding; the heavy rains received early Saturday morning caused flooding in the both buildings except the showroom of at least four inches. We appreciate the efforts in the last few days to build a dike close to the river and to pump out the water surrounding our lot. It was great to come to work today and actually see the cement of Stevens Drive. It appears that now, for us, the crisis is over and all that is left to do is the clean up. "'1""" " !. - ""\;&., CITY OF IOWA CITY July 27, 1993 Dear Flood victim Assistance provider: Indications by the Army Corp of Engineers suggest that a significant amount of the flood waters will have receded from the Johnson County area by August 9, 1993. Once this happens, many resident, businesses and other property owners will be able to enter their properties and assess damages. The city of Iowa city recognizes that there will be a need for information regarding flood cleanup. In order provide information about various services that are available and how particular city (and other) services are going to help meet this need, the city of Iowa city is developing a "Flood Cleanup Resource WorkshOp". Flood victims can receive all of this information in one location in as simple and efficient manner as possible. The city has a number of concerns that will need to be addressed at this workshop (sand bag removal, special garbage removal programs, process and time schedule for street cleaning, etc.) but also feels it would be the ideal opportunity for other agencies to provide information about their services. There are two workshops scheduled: TUESD~Y, ~UGUST 3 - 7:00 PM - LINCOLN SCHOOL GYMN~SIUM 300 TEETERS CT. WEDNESD~Y, ~UGUST 4 - 7:00 PM - TRANSIT BARN 1200 S. RIVERSIDE DR. The schedule for the workshop will include presentations by various city staff about flood cleanup programs and discussions by Red Cross, salvation Army and Federal Emergency Management Agency (FEMA) representatives about programs that they coordinate. We have continued to meet with them by way of conference call every morning and now anticipate going to every Qther morning beginning the weak of August 2. Our energies are now turned toward trying to secure federal disaster aid for our disaster response and recovary work effort. As the federal policy now stands it is a 75/25 grant program. While the state hes asked for a waiver of the 25% match, which we believe will not happen, we are planning on what our financial responsibilities will be. I do not expect much assistance from the state, and therefore the full match requirement may fall to the City. In,our review of the items thet are eligible for disaster aid, there are many that are of some concern to us. SpeCifically, traes are not eligible for any disaster assistance. The Parks and Recreation Departmant Is most concerned about whether the trees at City Park will survive. We will need to begin thinking about alternate plans if a significant tree removal and replanting program Is to be initiated et City expense. The Corps of Engineers has advised us that tha reservoir level is now 713.3 and the inflow into the reservoir is 13,800 cfs and dropping. You will recall we mentioned that at 712 the spillway will no longer be taking water. The oUtflow is 23,500 cfs and dropping with the conduit wide open. Evidently many foreign students will be leaving the area soon and need to ramove their belongings from the Mayflower Apartments. They are coordinating their efforts with our public safety personnel. J I i II I! , ' I' , The South Gilbert Street pumping continues. We now hava a large pump that Is operating 24 hours a day to keep tha water leval down. As an example of what can occur, during the night before one of our crews could arriva. the pump ran out of gas and wa noticed an immediate rise in water In the street. We have personnel who are monitoring pumps throughout the city 24 hours a day. Wa have received some complaints from the Fosterrraft Road area about traffic. Further .Road Closed Ahead. signs will also ba postad so, at the very least, anyone exiting on Dubuque Street will be notified immediately by signing and can return to I.SO without wandering through the flooded area. This is an issue that we can address; however, the Department of Transportation has the responsibility and authority to proceed with any type of signing changes. I mentioned in the previous mamorandum of a water break at Senton Street. We have chosen to valve off the water and divert water flow to other pipes; therefore, no one in the area should be without fresh weter. The water line is et a location that cannot be Immediately accessed without some danger to our employees and therefore we are going to wait for the river level to drop before attempting further repairs. The wastewater treatment plant continues to function satisfactorily and with the water levels dropping, we should ba able to have direct access to the plant by Monday or Tuesday. As a note of thanks, the Aero Rental Company allowed us to park most of our equipment on their site. We will thank them more formally later on. The most significant work effort will now be our attempt to secure funding from FEMA end the FHWA. We have prepared a site map Indicating the 34 sites ~hroughout the city that have experienced some sort of flooding, sewer backup, or any other problems directly associated with the flood conditions. It Is located in our Public Works Conference Room; I plan to bring it with me on Monday evenIng to give you a better feel for the exten! of flood damage throughout the community. We have received calls from citizens requesting what they need to do to file claims for what they may believe to be City responsibility for damages to their property. We edvise them that they may fila a claim with the City. At the same time we distribute to them a FEMA claim form. I have estimated that we heve approximetely 16 people working practically full-time in filing various applications with the Federal government for public financial assistance. This is a complex undertaking and we feel we have. to.date, established our accounting systems In a form that will be acceptable to FEMA. We will not know that officially until they begin the process of review of our estimates. It is our intention that we do not plan to remova any substantial number of sandbags in and around the watar treatment plant at this time. Unpaid Parking Tickets We've been exploring the possibility of increasing parking ticket fees on outstanding tickets. This was dalayed as any changes in our procedures needad to coincide with the reorder of billing forms and parking tickets. We currently need to order both of these forms and feel the issue should be addressed at this time. At the present time there is no incentive to pay a City of Iowa City parking ticket until the total tickets issued to a vehicle accumulate to $15.00. Once $15 or more in tickets has been accumulated, they get onto our impound/towlist. In addition, any ticket that is uncollected for twelve months is dropped from the system. This system ellows users of the parking system to maintein a balance of less than $15.00 and wait for the time limit to eliminate the' remainder of their tickets through attrition. As en exemple, you received five $3.00 parking tickets in July and August of 1992, total due is $15.00. Depending on the time frame of the tickets you would receive up to 5 billings. You pay one ticket, total outstanding Is $12.00. The four other tickets received in August 1992 are erased from the system. Balance due, $0.00. City does not collect for the tickets but incurs the expens~ of billings. At the present time there is an average of 1880 notices of unpaid parking tickets mailed each . Yi.Ws. If we consider the cost of postage, billing form and envelope, computer time, and personnel it is not a profitable activity. We believe that by establishing a tiered fae schedule offenders will be encouraged to pay their tickets before the fine escalates, This would save the City the cost involved with the expense of mailing notices. At the present time only 6% to 7% of the tickets are paid before billing, Any Increase in this percentege results in cost savings to the City. Section 321.236 of the State Code of Iowa sets the fee limits for parking tickets. It also allows for the fee to be increesed to $10.00 if not paid within thirty days of occurrence. At the end of 8 calendar days $3.00 expired meter and overtime ticket fees Increase to $5.00. Other violation fees remain the same. Thirty calendar days after the original entry date all $3.00 and $5.00 tickets increase to $10.00. If these fees are increased we should also increase the minimum amount to place a vehicle on the impound list. At the present time the limit is $15.00. City Attorney Re: Update on Reseerch for Deniel of Alcoholic Beverage Permits and Licenses; Legal Opinion Request This is to updat~ you on two additional questions raised, in part. by my earlier memo of July 16,1993, together with discussions atthe City Council meeting of July 20. 1993. concerning denial of a 'renewal parmit.' 1. Local authority limited to control serving to 19 and 20 year olds. You have asked whether the City Council can enact local ordinances, so that the City could impose more stringent penalties on rastaurants and bars who serve beer, wine and alcohol to 19 years olds and to 20 year olds. Unfortunately. the answer is 'no." As you can see from the elaborate scheme which the Iowa legislature has set up for penalizing license holders who serve to 19 year olds and to 20 year olds. there is little room laft for local municipalitias to impose graatar penalties than thosa which are set out in state law, see my earlier mamo dated July 16. 1993. and the attach ad explanations. Thus. as a practical matter, our local ordinances merely 'track" state law. This is bacausa. applying a homa rule analysis. tha state legislative schema is so pervasive that it Is what we. in the law. describe as 'filling the field." This means that the City is preempted by this elaborate state schame from imposing more string ant penalties, since the City cannot proscriba or ban behavior which the state law would permit. However, , as I stated in my earlier memo. the City Council probably has the authority to keep undarage drinkers out of restaurants and bars, if that ordinance is based on a legitimate safety, haalth. and welfare concern. 2. I concur with Anne's conclusions, and point out a number of things to you, prior to your proceeding to take action: a. First, you as the City Council have considerable authority to closely reviaw all liquor Iicanses and beer permits. if you so choose - realizing, of course, that the state has reviawauthority. However. if you choose to usa this authority set out in state law, you must do it fairly and even.handedly across-the-board. Rather, your dacisions should be based on facts, and made after a close review of records and after closa scrutiny. c. Third, even if the state liquor control reverses the City Council's decision to deny or revoke, the City can still appeal that decision to district court here in Johnson County. At that point, whatever political .pulls and tugs. you might feel would be minimized, and the legal process would continue to .work itself out. in front of the judge. In sum, you have considerable authority to act upon liquor and baer licenses and permits at both the renewal stage, as well as the original approval stage, with the applicant still having an appeal process to the state. Nonetheless, the City still has appeal rights to the district court, if the City so chooses. In a word, it is all a matter of the level of energy and time which the City wishes to bring to bear on the issues before you, and how much energy and time you wish the various City offices and departments to focus on in pursuing the issues of license and permit holders in this city. It also depends on how patient you want to be to let the elaborate legal scheme .work itself out. even to the district court level. (2) Upon what grounds may the city council deny the Fieldhouse's application to renew their Chapter 123 license/permit? CONCLUSION: (1) The city council should use the same criteria to review an application for renewal of a permit/license that It uses to consider an Initial application. The Council's action Is subject to review for being arbitrary, capricious or without reasonable cause, An applicant must meet the statutory definition of "good moral characle~'. (2) The Fieldhouse or Its owner was convicted in District Court for violation of ~123.49(2)(b), selling or dispensing after hours, and the license/permit Is presently subject to suspension/revocation proceedings before the alcoholic beverage control division of the State. The city council may deny the application for renewal for the underlying Chapter 123 offense. However, If the City Council has not treated other establishments similarly, or if the administrative hearing process ultimately exonerates the Fieldhouse and Imposes no suspension or revocation, the action of the City Council to deny renewal may be open to a finding that the decision was arbitrary, capricious or without reasonable cause. DISCUSSION: I examined the statutes, cases and Attorney General opinions relevant to the questions, There are very few cases which shed light on the construction or application of Chapter 123. All authorities which bear upon the question are summarized below. All statutory citations are to the Code of Iowa (1993). ~123, 1 Public policy declared. The chapter shall be deemed an exercise of the police power of the state, for the protection of the people of the state, and all provisions shall be liberally construed to accomplish that purpose. Traffic In alcoholic liquors shall be so regulated as to prohibit all traffic except as provided In Chapter 123. ~123.3(26) Deflnftlons. Any applicant for a license/permit may appeal the administrator's disapproval of an application. The appeal Is to the division hearing board. II the hearing board determines' the city council acted arbitrarily, capriciously or without reasonable cause In disapproving the application, or that the administrator's disapproval should be reversed, the board shall order Issuance of the license/permit. this Is the same right of appeal available to a licensee/permittee whose license/permit has been suspended or revoked, Judicial review of the board's decision Is available according to Chapter 17A. The city council may appeal a finding by the board that the city acted arbitrarily, capriciously or without reasonable cause. ~123.35 Simplified renewal procedure. When a licensee/permittee seeks renewal, a "short form" may be used provided the qualifications for Issuance of a license/permit have not changed since the original document was Issued, The applicant for renewal must verify under oath that the Information contained In the original application remains current and no reason exists for the division to refuse to renew the license or permit as originally Issued, The application for renewal Is filed In the same manner as an Initial application Is filed. ~123.39 Suspension or revocation of license or permit. Ucenses and permits may be suspended or revoked upon any of these grounds: Misrepresentation of any material fact In the application; violation of any of the provisions of this chapter; any event which would have resulted In disqualification from receiving the license or permit originally Issued. The city council should deny the Initial or renewal application of any person who does not meet the definition, above, of "good moral characte(', The city council should carefully consider whether to Issue an Initial or renewal license/permit to a person who does not clearly satisfy the requirements of ~~123,31 and 123,35, II the city council can articulate a rational, nondiscriminatory reason to deny the application, the council may do so, AgaIn, the legislative exclusions ~123,39(4) and ~123.47A apply (no suspension or revocation for sale to 19-20 year aids). It Is not reasonable to deny renewal on grounds which will not support suspension. I found three cases which deal with the grounds and procedures for denying a license/permit. One, Smith v.lowa L1auor Control Commission, 169 N,W,2d 803 (Iowa 1969), Is an "old law" case decided prior to the substantial code revisions of Chapter 123 In 1972. The court does make clear that a conviction, rather than a charge, of violating Chapter 123 or a comparable local ordinance Is required to trigger the revocation and suspension provisions, I think It must alao be clear that a conviction would be required to deny an Initial or renewal ,application. Randall's International, Inc, v. Hearlna Board of Iowa, 429 N.W,2d 163 (Iowa 1988) considered whether the vicarious liability aspect of Chapter 123, by which the conviction of a licensee/permittee's employee Is Imputed to the licensee/permittee, and supports the suspension or revocation of privileges. The Court upheld the provisions of ~ 123.39 (suspension and revocation; penalties) and of ~123.50(3) (vicarious liability for employees). In Dell 011, Ltd" v. Beer and L1auor Control Deot., 406 N.W.2d 462 (la, App. 1987), the Court of Appeals affirmed a department suspension of a license where there was only one alleged violation of ~123.49(2)(b), selling or dispensing after hours. While the court was divided In Its decision, no Justice argued that a suspension for only one violation was unreasonable. An Attorney General opinion from January 21, 1976 considered the same question you posed, and concluded that the city council can approve or disapprove the Issuance of an Initial application or an application for renewal of a license or permit. The opinion points out that the applicant must meet the definition of "good moral characte(', and the city cannot act arbitrarily or capriciously or without reasonable cause. There have been no statutory changes or cases which would change the validity of this opinion, except the restrictions of ~~123,39 and 123.47A. Regarding the Fieldhouse application for renewal, I understand that the business has been convicted of one or more violations of ~123.49(2)(b). The city council could suspend a license/permit for this conviction, subject to administrative review. Dell 011, at 463-464. The applicant for renewal must be of "good moral character', and one test Is whether the person will comply with all laws, ordinances and regulations applicable to Chapter 123, It Is quite possible that a decision to deny renewal because of the ~123.49(2)(b) conviction Is lawful, Other factors should be considered, however. The existing license Is presently subject to administrative suspension/revocation proceedings at the state level. II those proceedings terminate In a finding that no suspension or revocation Is warranted, the city decision to deny renewal-an act tantamount to revocation-will certainly appear excessive and unreasonable. Saturday's rainfall, which was measured at 2' to 4' In places throughout the City, has slowed some of the progress, The conduit Is to remain wide open until the Reservoir pool level Is below 707, which Is projected to occur on or about August 9. While the rain was a temporary setback, we sUII remain close to the earlier schedule we provided. As the flows drop, the water recedes. The resulting rain did cause localized flooding throughout the City, and we experienced noodlng In areas tha,t had not normally retained water. As far away as Melrose near Westwlnds we were experiencing flooded streets. The Isolated noodlng also attributed to sewer surcharging In the Riverside Drive area as well as along Kirkwood. We do not know whether this was directly attributed to the rain and saturated groun~ or the older sewer In the area. This Is being Investigated. Following the Saturday rain, Baculls Trailer Park also appeared to be taking more water. It appears that some of the trailers were sinking Into the soli. The Baculls.Thatcher mobile home parks have presented a unique problem for us. The two trailer parks are pumping water; we want to be sure It Is away from each other. We will provide pumping support wherever practical. A lightning strike at a water pump station 'fried' some of the electrical work and repairs were underlaken Immediately. '-,,,. '," .......-- ,. . This line Is underground and under water and, therefore, not pracllcal to repair at this time. An alternate line above ground has been constructed. We are also planning the construction of some type of pedestrian corridor In and around the waler treatment plant; as the number of students and other University acllvltles begin to Increase, we expect pedestrian traffic to likewise Increase. The pumping In the S. Gilbert area conllnued; however, with the heavy rain the pumps were not able to keep up. Water actually did begin to fill the streets late Saturday night and It was necessary to call In our reserve fire pumper. It spent the evening serving as a backup to the large pump we currently have In place. Evldenlly It was successful, and the water was removed before It went over the sidewalk. We stili encourage people not to remove the sandbags until the river Is substanllally back to Its normal course. We are receiving requests for the removal of . sandbags and we are discouraging the removal until such time that we have greater confidence In the volumes of water coming out of the Reservoir. One of the Issues that we will need to prepare our citizens for Is what Is left behind. While we have a number of programs that will address the needs of our flood victims, In my conversallons with other communities It Is clear that the community will not be prepared for what Is left behind. The smell, the muck and mire, and the slalns are almost as bad as the flood waters. We will do our best to prepare folks for the outcome. Our cleanup schedule remains on course. More Informallon will be available Wednesday to see the Impact of'Saturday's rain on Reservoir levels. As we work through the flood recovery and response, we are learning many new Issues that will need our atlenllon In the future. Our Public Works crews and engineers may design some type of a bolt down manhole to help protect the surcharging of stormwater. We believe if the water continuas to declina and we have noticed some movement of parking off of Park Road and back into the Normandy area, we will be able to accommodate the circumstances, A particular problem has arisen at the water treatmant plant, that being security, We hava done our best to keep folks out of tha area and we will be stressing publicly to stay away from the water treatment plant area. We have found folks within the snow fencing that surrounds the water treatment plant as well as actually in the plant. We will not ba stressing it publicly, but the chlorine line is something of concern and, therefore, we will do our best to discourage people from going to the water treatment plant area. Our sewer/wastewater treatment plant is beginning to return to some degree of normalcy and we are assessing the damage to the equipment. We are continuing to process at about 20 million gallons; however, no bypass is occurring, The August 3 meeting at Lincoln School appears to have been very well attended, and we received many questions.and concerns from residents, The overwhelming majority of the audience appears to have been Normandy residents, The staff estimated that following a show of hands approximately 1/3 to 1/2 of the people are still out of their homes, Marcia was able to arrange many of the social service agencies' attendance, such as Red Cross, Legal Services, Salvation Army, Department of Health, Iowa-Illinois Gas & Electric, etc, At 10:00 a.m. on Wednesday, John Sobaski, our Assistant Street Superintendent, Floyde Pelkey, our Solid Waste Superintendent, end Marcia Klingaman will have appaared on a radio program to discuss Issues of cleanup.
