Notice Is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:30 p.m, on the 17th day of August,
1993, In the Civic Center Council Chambers,
Iowa City, Iowa; at which hearing the Council
will consider the fOllowing item:
1. A public hearing on the use of $40,000
of Communitv Development Block
Grant funds (CDBGI to assist

ORDINANCE AMENDING SECTION 2.100 OF
THE CODE OF ORDINANCES OF IOWA CITY
BY REVISING THE MEMBERSHIP
REQUIREMENTS FOR BOARDS AND
COMMISSIONS
SECTION I. PURPOSE, The purpose of this
ordinance is to revise the eligibility
requirements for members of citv boards and
commissions by allowing Individuals who are
not eligible electors of the city to serve as
members.
SECTION II. AMENDMENT. Chapter 2, entitled
'Administration,' Article IV, entitled 'Boards
and Commissions,' Section 2,100, entitled,
'Membership, compensation, and tenure,' of
the Code of Ordinances' of the Citv of Iowa
City, Iowa, be and the same is herebv amended
by repealing Section 2-1 00 ~nd adding thereto
a new Section 2-100 to read as follows:
Section 2.100. Membership, compensation
and tenure.
All members of boards and commissions shall
serve without compensation and, except as
specifically authorized by the by-laws of the
particular board or commission, shall be eligible
electors of the city. However, In all cases the
cltv council must first approve the by.laws
exempting members from the eligible elector
requirement.
A commission or board member's
consecutive unexplained/unexcused absences
from regular meetings may be cause for
removal of said member. The chairperson of
the board or commission shall Inform the city
council of any such occurrence, In addition,
the appOinting authority may remove any
member for cause, except In the case of ex
officio members and except as otherwise
provided by state law,
SECTION III. REPEALER, All ordinances and
parts of ordinances In conflict with the
provisions of this Ordinance are hereby
repealed,
SECTION IV. SEVERABILITY, If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjUdication shall not affect the validity of the
Ordinance as a whole or anv section, provision
or part thereof not adjudged Invalid or
unconstitutional,

NOTICE TO PROPERTY OWNERS
Notice is hereby given that there is now on file
for public inspection in the office of the Clerk
of the City of Iowa City, Iowa, a proposed
Resolution of Necessity, an estimate of costs
and plat and schedule showing the amounts
proposed to be assessed against each lot and
the valuation thereof within the District as
approved bV the Council of Iowa City, Iowa, for
a street improvement, designated as the 1993
Paving Assessment Project, of the types and in
the location as follows:
Portland cement concrete paving,
seven inches thick, with necessary
grading and miscellaneous related work
as shown on the plans, on the allev
south of Bowery Street between
Johnson Street and Dodge Street from
Bowery Street to a point 198 feet to
the south,
That the proposed District to be benefited and
subject to assessment for the cost of such
improvements is described as follows:
All properties abutting along the line of
the allev Improvements,
The Council will meet at 7:30 o'clock p.m" on
the 17th day of August, 1993, at the Council
Chambers, Civic Center, 410 E. Washington
Street, Iowa City, Iowa, at which time the
owners of property subject to assessment for
the proposed improvements, or any other
person having an Interest in the matter may
appear and be heard for or against the making
of the improvement, the boundaries of the
District, the cost, the assessment against any
lot, tract or parcel of land, or the final adoption
of a Resolution of Necessity, A property owner
will be deemed to have waived all objections
unless at the time of hearing he has filed
objections with the Clerk,

OUr specific objections are as follows: First, your notice states that
irrpriwement costs are to be assessed to II (al 11 Properties abuttirg along the
line of the alley irrprovements, II Because the Miller property does not abut
the area which is to be irrproved, the tenns of your CMll notice preclude you
from assessirg the Millers with any portion of the cost.
Secondly, we feel that because of the considerable distance between the
Miller property and the area to be irrproved, those property CMllers whose
land actually borders the area to be iIrproved should be ~"SeSsed the cost of
improvements ,
'lhirdly, we are col1CeIl1ed that any regrading of the alley will
aggravate an existirg drainage problem in the area, A large portion of the
alley drains directly onto the Miller property. 'Ibis drainage has caused
claJrage in the past, and we are col1CeIl1ed that any alley irrprovement will act
to furmel additional drainage over the Miller property,

A repaving of the whole alley Is unnecessary and extremely
expensive.
The alley runs into Bowery Street and it has been paved to
within a very few feet of the junction with Bowery Street. We
estimate that to complete the paving will cost less than $2,000
which should be born by the property owners on either side of the
small section that needs paving.
We have already paid a portion of the cost of the pavIng of
the alley up to the point Where the small unpaved section lies.
The paved portion of the alley is adequate for the needs of
the people who live there. The paving of the small remnant
unpaved section should be completed by the City.

As affected property owners, we cannot stress strongly enough the
necessity of having this alley paved. We are pleased to see that
the assessment has been attached to all property owners along the
alley--both those along the northern, unpaved part of the alley, as
well as the owners of the apartment buildings on the south part of
the alley, which was paved last year at those owners' cost. The
only reason the alley requires paving is due to the increased
traffic caused by those mUlti-unit apartment buildings, and though
they may object to being included, it is only fair that those
owners be assessed their portion of the total cost.
In short, we are very much in favor of this project, willing to pay
our portion of the assessment, and urge you to approve the
proposal.
As we will not be able to attend the City Council meeting of August
17 due to prior commitments, we are sending this letter to express
our support and approval for the proposed paving project of our
