associated with the Flood of '93 end its effect upon Iowa City, Coralville and Johnson

The inflow Into the reservoir Is now 31 ,000, some of the highest flows to date du~ng this flooding
c~sis. The outflow Is 18,700 with the conduit wide open. As the Inflow continues to rise, outflow
will Increase. This is one of the clear examples where the reservoir management has protected
those downstream as best they can.

Staff attended the State-sponsored meeting at the County Fairgrounds concerning the possible
dam breachRnundation/evacuation planning process. A number of scenarios were developed.
The study work to date shows the extent of flooding damage that could occur without the
reservoir/dam facilities. This and the potential for continued wet weather provided a rather chilling
view of what might actually be the extent of flood damage under extreme scenario/catastrophic
events. A map In the Conference Room shows the extent of flooding that could occur with dam
fallure. Some extreme examples show that water could be as high as 35 feet deep In the
Normandy area and approaching the back door of the western buildings on the Pentacrest.
Another note was that we would be provided with little notice, likely less than an hour, If such
flows would hit Iowa City.

We had two cave-Ins on Pepper Drive, off of Sandusky during the evening hours. We have
dispatched crews and are providing the pumping and other work necessary to help alleviate any
. further damage. At our morning meeting we were still in the process of trying to relieve the early

damage problems and begin to prepare for restoration. The sewer line appears to have caused
the cave-In/sink holes.
In our conversations with the University, they are noting subgrade problems In those roads that
have been under water. The water Is coming through the Joints at several of the roads throughout
the city.
We are concerned about the weekend of September 4 and football traffic. It Is unlikely that our
road system will be In a condition to accommodate the additional traffic that accompanies a home
football game. We wlil be lookIng for extensive media coverage of the roads that are blocked In
the Iowa City/Coralville area, as well as the construction along Interstate 80 which will simply
complicate matters. A forfeit was suggested; however, we felt the University would not look klndly
upon such thoughts.
We are also now beginning to receive complaints about the University's project at Burlington and
Riverside and the traffic congestion occurring. This appears to be Just simply part of the public
frustration with the traffic circumstances In our community.
We receive requests for claims on damage and we often advise our citizens to also claim with
FEMA. Many of our citizens do not realize that It Is not an Income/needs-based assessment, that
If you experience damage you are entitled to apply for FEMA ald. We encourage them to call the
FEMA number - 1-800.462-9029 . to secure FEMA claim forms. If you receive similar requests,
please encourage people to talk to FEMA.

Re: Flood Update
The pool level at the Coralville Reservoir is now at 708.6 and Increasing. The Inflow Is at 23,000
and Increasing. The outflow Is to Increase later today to 18,000. The Corps Is working to control
the flow and not have the level go beyond 709. If It were to rise much beyond that they feel they
will be losing some control and as you will recall at 712 the spillway be reached.
Early this morning, Iowa County received 2.5 Inches of rain and the Impact of that rainfall should
be In the Iowa City area at about 5 PM, primarily affecting Clear Creek. It Is expected that the
river level will Increase and If we have an aftemoon thunderstorm It can only exacerbate our
problems. The national weather service has' a 2-3 Inch rain center located In western Iowa. The
. Corps of Engineers continues to take a pessimistic view of these weather forecasts and are
planning accordingly.
The telemelly system Is now activated and we will hopefully be provided with quicker Information
and thereby can respond accordingly when flood waters begin to rise rapidly.
The chlorine delivery at our water treatment plant wenl satisfactorily. The chlorine supply Is good
for approximately one month and our crews will restore sandbags Immediately.
During the day, City staff and others will be attending a meeting at the Johnson County
Fairgrounds, sponsored by the Slate Disaster Preparedness Agency. The purpose of this
meeting Is to discuss Issues associated with potential for a dam collapse, Inundation and an
evacuation plan. Evldenlly this has been planned for some time by the Slate, which Is
unfortunately Incredibly bad timing in that the rumors will likely be rampant. This Is merely an
Informallonal meellng to discuss the 'What II' scenarios that might occur.
We have dropped sandbags off In various neighborhoods although we have not been asked to
deliver sand. We will continue the process we have used In the past and with water levels rising
It may be necessary for some to re-sandbag their properties. .

In distributing the press release and other Information concerning the water level Increase to
affected areas, we did receive some complaints from the South Gilbert area. Specifically, they
want to be able to call out fire equipment to assist In the pumping. I am resisting the placement
of fire equipment for pumping purposes only. There are a number of public safety Issues and
thereby we onlv provide fire equipment for pumping purposes after cautious consideration of other
public safety Issues. This will not keep the South Gilbert Street area folks particularly happy.
Another circumstance Is that for fire equipment pumpers to work satisfactorily we need several
feet of water. The moment the waler begins to rise on South Gilbert, there Is an expectation that
fire equipment will be dispatched.
We have received a number 6f complaints about the placement of pumps. Last evening a
gentleman came to Council after the meeting and discussed pump placement with me and some
Council members. The primary concern appears to be how we utilize and place p~mps. The
example given was the location of a pump near Plum Street/Laurel area. Ith!nk It is important
to note that this area has not in recent memory bean affected by the recent back-ups. Sandusky
area Is another neighborhood that Is now experiencing backups that they had not previously
experienced. The pump is placed at Plum on the side of the road and must be manually moved
to the manhole when conditions warrant. This placement Is done as a safety precaution. In the
judgment of our wastewater treatment crews that are required to respond to these types of calls,
placing the pump permanently In the middle of the road, particularly on a busy street, simply
endangers motorists and could damage a very precious commodity, that Is the pump.
We will monitor each and every circumstance carefully as we measure flows Into and out of the
wastewater treatment plant which triggers our response to the areas experiencing sewer backup.
I believe we must rely on the judgment of our crews. They must be able to respond to the
request for selvlce as best they can wllh the equipment that we have available. As you know, we
have ordered and are receiving additional pumps.
In the PlumlLaurel area the storm sewers are full, which Is a circumstance experienced by all of
the residential areas close to the Iowa River. When we receive rain there is just simply no place
for the water to go. We do have certain electric pumps that are sump activated at certain
locations and we also have those that are manually activated. Our crews are encouraged to
respond In their best Judgment to those that may be risking the greatest potential for damage.
Hopefully you can appreciate our crews are doing the best they can. There are circumstances
In heavy rains when the pumps cannot keep up with the Inflow of water.

Mr. Bean of Dunaggan Court has declined an offer for the Installation of a gate valve In his home.
He would be required to valve off the sewer Into his property which would affect his use of toilets
and other facilities requiring water, but could significantly reduce the damage to his property.
Additionally, I have received a letter from an attorney representing Mr. Bean and they appear to
be Interested In selling the property to the City. This circumstance grows a little more complex.
As of today we have had approximately 55 people request claim forms for sewer back-ups.
Unfortunately we are not getting the paperwork In on these claims as rapidly as we would like.
Only 17 have flied complete claim forms. While folks may call and complain to you and wish us
to respond to their particular claim, each and every one must be Investigated and without proper
documentation of the claim, It Is difficult for us to know our responsibility. Simply calling and
complaining about the water level Is beyond our control and we are encouraging people If they
feel they have a legitimate claim to file the paperwork. Each of the circumstances can result In
an additional claim and residents can file amended claims. We will continue to work with our
residents, but we cannot force them to file paperwork which would allow us to process the claim.
We are also having trouble with our Insurance company, which we believe will not honor our
claims. Furthermore, some citizen claims verge on the ridiculous, In that sewer back-up would
not affect what they claim.
We provided a roll-off bin to the Taft Speedway area In order for that portion of our community
to be able to dispose of flood damaged materials.
A longer term Issue we discussed Is the potential for winter time damage to our streets and
utilities. With the ground saturated, and If we go Into cold weather with this problem, which
appears more and more likely, a deep frost could cause significant damage. Water main breaks
, and street heaving are all likely. Not much we can do but be aware.

Re: Flood Financial Update
We have completed most work associated with our damage estimates and the cost on the part
of the City to respond to the flood. These estimates were through July 30. Estimates will
continue to be updated. While our estimates can be staggering, that Is the $2.03 million, I do not
expect our financial assistance from the federal government to be anywhere close to that number.
Many of our damage estimates Involve work In City Park and, therefore, It Is not covered under
current FEMA guidelines. It Is difficult to project, but from experience the monies we received
from FEMA will be substantially less than our damage estimates. There may be some community
expectation that we will have our expenses covered, but I doubt whether we will receive monies
anywhere close to what actually went Into our work effort.

Re: Affordable Housing Polley Proposals
At present, while affordable housing seems to be the main Impetus of State and Federal housing
programs, one of the difficulties Is the definition of affordable housing for the community. I agree
with Mr. Richard Nelson, President of the National Association of Housing Rehabilitation Officlals
(NAHRO), that affordable housing Is not a term that can be defined In Washington and Imposed
upon local communities or neighborhoods. Affordable housing should be based on a local
strategy, such as the CHAS, to provide housing for a range of people who cannot afford to pay
market renls or own homes In their own communities. The successful outcome of an effective
affordable housing strategy Is vital neighborhoods thaI are diverse, and socially and economically
viable. This link between affordable housing and community development Is one of the keys to
success. The provision of housing for citizens In all Income ranges Is In the public Interest and
Is extremely Important to the vitality of Iowa City, creating stable, vibrant neighborhoods and
encouraging other residential or economic development.
In conjunction with the development of Iowa City's new five-year Comprehensive Housing
Affordablllty Strategy (CHAS), the Community Development Division of the Departmont of
Planning and Community Development will focus the attention on the affordable housing priorities
for the City's five-year strategy.
The basic priorities have not changed much since the completion of the 1992 five-year CHAS,
but they are being organized a bit differently for reasons of clarity. This year the priorities
continue to be to expand the stock of affordable housing, maintain existing affordable
housing units, and to assist people In staying In housing. Planning activities will be focused
on the numerous barriers to affordable housing In our community.

Based on our experience, the 1990 Census data, as well as public comments received at the
June 23, 1993, public meeting held by the Housing Commission and CCN, what follows are
proposed to be the basic priorities of the 1994-1998 CHAS.
1. EXDanslon of the affordable houslna stock
expansion of the affordable housing stock Is crucial - the basic laws of supply and
demand seem to work against us at every turn. Problems such as discrimination against
families with Section 8 vouchers and certificates, and a shortage of nursing home space
for the frail elderly can hopefully be minimized with the creation of more housing
opportunity. At present, landlords, nursing homes, and other housing providers can afford
to be selective. Those who are most In need, the homeless and those needing support
services, for example, are most likely to face discrimination, eviction, or simply be unable
to find a suitable housing unit.
To help correct the problem, the City should continue to work with providers of new
affordable housing such as the Greater Iowa City Housing Fellowship and for-profit
developers, as well as the local lenders and others who have expressed Interest In this
community Issue. A subsidy Is likely to be needed for new construction, so It Is In our
Interest to pursue as many options as possible to ensure cost-effective new development
The options discussed below under 'Feasibility Studies and Planning' will be Important
to explore If we are to expand the affordable housing stock when little available land and
shrinking financial resources exist.
2. Rehabilitation of the exlstlna affordable houslna stock
Given the housing situation In Iowa City, the maintenance of our existing affordable
housing stock Is as Important as new construction. The Housing Rehabilitation Program
continues It's busy schedule, but Is also exploring ways to reach homeowners occupying
the structures most In need of rehabilitation. For example, recently awarded HOME
Program funds will be used for a program to assist homeowners with Ilttie or no equity In
their homes. Many times, families with Incomes under 80 percent of the area median
Income can only afford houses that are In need of major rehab, but cannot qualify for
loans, even through the City's programs, because they have no equity. The Community
Development Division Is also working with lenders and realtors on a homebuyer education

Although expanding the stock of affordable housing Is crucial In our tight real estate
market, there are Individuals and families that would be likely to continue to be without
housing even If hundreds of new unlL~ were to be constructed. These people need some
type of supportive service to help them stay In housing. Needed services range from
basic household skills training, to those for persons with severe mental Illness. The many
social service agencies In Iowa City do an excellent Job with few resources, and they
provide a vital contribution to the provision of housing for all people.
In addition to assisting agencies providing supportive services, efforts to coordinate
services for people with multiple problems should also be supported. Just a few of the
current efforts Include the Family Self-Sufficiency Committee and the Local Homeless
Coordinating Board. Some of the goals of these groups are to overcome barriers to
finding and staying In housing, working with families to build basic life skills, and to
coordinate services for clients.
4. Feasibility studies and plannlna
Our greatest emphasis needs to be placed on the expansion of the affordable housing
stock and the provision of supportive services to help keep people In housing. The
planning and research to be conducted by the Community Development Division must be
more focused and as appropriate, public boards and commissions will need to be Involved
In these planning activities.
The most Important step Is to address the barriers to affordable hOUSing for all Iowa City
residents. The barriers range from a lack of financial and land resources to community
attitudes. There may be no way to remove some of these barriers. Options that staff will
focus on will Include land acquisition, planned development, the feasibility of modifications
to development standards and zoning, and enhancing the public/private partnerships thai
have begun Informally, through several projects, with the local financial Institutions.

The County Board of Supervisors at their regular meeting discussed a policy concerning tho
possible reduction in property taxes for those properties directly affected and/or damaged by
the floodwaters. This is evidently similar to what the Scott County Board of Supervisors is
considering. The Johnson County Board has taken this issue under advisement and we will
learn more as they provide us information. At this time it appears that their interest is to
reduce the property taxes to real property by a certain amount or as a percentage of the
assessed valuation for property which might qualify as flood damaged. We'll let you know
more when we find out.

Solid Waste Management Policy
The City currently has in place residential refuse collection policies that substantially satisfy
our health and sanitation code requirements, provide a public waste removal service, and fulfill
legal requirements of the state and federal governments. It is interesting to note that these
governments regulate the provision of our municipal public service and yet rarely provide such
services themselves. They regulate but have little to no experience in the delivery of the
service the'l choose to regulate.
We have chosen as a community to have a municipal refuse collection program for our
residential customers, while business and industry ere more or less left to their own devices
as long as health and sanitation codes are satisfied. For the purposes of your discussion, I
would suggest that we assume that these residential services as we know them would remain
substantially unchanged. You can amend the services as you see fit; however, as you will
see from the following discussion, I believe there are far more critical issues that need
immediate attention and thereby your policy decisions could have significant influence on
what amendments you might offer in the future. Specifically, following a lengthy discussion
among your staff, we have concluded that the single most important issue is our mandated
obligation as the owner of a landfill to reduce landfill volumes by 50% by the year 2000. This
50% reduction is a federal mandate administared by the State and is more readily identified
as the "Waste Minimization and Control Act." We have currently satisfied our 1994
requirement of a 25% reduction; however, our volumes did move up last year and therefore
we will need to be more diligent in maintaining and increasing our reduction efforts. We

believe that the substantial portion of our ability to reduce by 25% was due to the yard waste
program, imposed upon all users of the landfill and fulfilled primarily by residential users.
Large industry waste reduction was also notable. In order to meet the 50% reduction
requirement, we will need to focus our policy on other than the residential user.
This 50% reduction I believe should be the foundation of your policy discussion, It is far more
critical due to the legal obligations and likely sanctions that could occur. The means by which
you decide how the Iowa City business or resident will be responsible for disposal of and
collection of their refuse becomes secondary to the overall obligation you have as landfill
owner and operator. The City's residential refuse program amounts to less than 15% of total
landfill weight and even if our city residential service were to never create even one more
ounce of garbage we are still substantially short of our mandated obligation under federal law
as owner/operator of the landfill. In our discussions, we do not wish to diminish the efforts
to date; however, far more stringent regulations by the City on those who use the landfill are
necessary in that as the landfill owner we are responsible for 2!I waste that enters the landfill,
not just what is generated by our residential refuse program.
We need to decide how we would intend to fulfill the 50% reduction requirement and as the
City Council shapes its policy discussions and debate, they should center around that
obligation. All landfill users, not just Iowa City residents and businesses, need consideration
in your discussions, and following your policy decisions local collection systems can be
designed toward fulfilling the 50% reduction requirement. This would include rate structures
you might choose and services provided. The Federal government does not seem to care how
landfill operators meet the mandatory 50% reduction as it affects the provision of a local
waste collection service. The State government has chosen to ben certain materials and
requires alternatives for disposal. The landfill and its waste volumes will be used as the
measure of whethar a community is successful in their waste reduction efforts.
In your discussions I believa you must be willing to impose a policy position on 2!I other
jurisdictions, businesses, and industries as well as on our own residential refuse program. If
wa are to remain the single owner/operator of the landfill and responsible for its management,
all of those who choose to usa the landfill must come under your landfill regulations. If at
some point joint ownership is considered I the 50% reduction requirement does not change.

To date we have not seen any interest on the part of other jurisdictions to form any type of
authority or joint ownership, although an authority can be designed to force participation in
the liabilities of landfill operation. From my experience in another community where I
participatad in discussions of joint ownership and the policy debate associatad with a landfill,
it involved well over two years of negotiation and litigation before the joint ownership issue
was resolved. This occurred at a time when there was no federal pressures to reduce
volumes and, therefore, you do not enjoy the same time availability, I would suggest that you
not davote time at this point to a discussion of joint ownership and devote your energies to
the 50% reduction requirement.
Ultimately the question you will need to answer is how to meet the 50% requirement. You
must recognize, as a City Council and owner/operator of the landfill, you are responsible for
100% of the volume at the landfill, even though that volume is not generated by your-
community. However, while the City only provides a public service that directly affects 15%
of the total volume, I think you can sss that in order to address the remaining 85% volume
factor at the landfill, any change in our residential refuse collection policy is likely to be of little
immediate consequence. Also less than seven years remain to implement and fulfill policies
to meet a 50% reduction requirement.
We believe that in order to satisfy the 50% requirement some type of allocation system of
landfill volumes by jurisdiction will be required. This means that all political jurisdictions within
Johnson County as well as the two cities from Washington County using our landfill will be
advised of a limited amount of landfill volume they will be parmitted to utilize during a specific
period of time. Those volumes will be reduced gradually over a six year period until the
mandated reduction obligation is met.
The allocation system appears to be the fairest and the only practical means by which we will
ever have a direct, immediate affect upon landfill volumes. Selected local programs are
helpful for public participation and raising people's awareness; however, they do not
substantially reduce volume. Following the identification of some type of allocation system,
you may then be in a position to consider selected bans on various materials at the landfill.
This is not unlike what the State of Iowa has already chosen to do by banning yard waste,
tires, waste oil, etc.

There are other means by which the City could allemptto reduce volume, which could include
developing systems at significant capital expense to sort materials arriving at the landfill. This
is an expensive process and would require new capital expenses and does not get at the root
cause; that is, we must be able to reduce landfill volumes, By sorting materials we simply
confront further marketing problems as a landfill operator for the sorted materials/goods that
are created and, given our current experience, requiring cash subsidies,
Alternatives for materials that ultimately will be banned would also need to be identified,
whether it be by the landfill operator or those jurisdictions/businesses that can do so on their
own. This could include regional composting now being considered. Regardless of the
circumstances, local government (landfill operators) has been identified by law as being
responsible for reduction of waste, whether they create it or not.
We believe the allocation system should be undertaken in a reasonably short period of time,
with the understanding that we have until the year 2000 to reduce our annual tonnage by
approximately 5% per year to meet that goal. We suggest that the system be voluntary and
then move to mandatory. The voluntary program, however, if the allocation system is
selected, would require some type of extra charge or premium if jurisdictions exceed their
allocation in the early stages of implementation, Alternative disposal options will continue to
be researched and others may choose to pursue their own options. If a landfill user chooses
to satisfy their allocation requirement by some means beyond the control of the Iowa City
landfill and/or our policy, that should be their responsibility and their choice.
Ultimately, as the landfill owner/operator, you are going to be obligated to regulate other users
of the landfill by identifying for them what landfill volume is available. This is not unlike what
the State has done to the City as a landfill operator in that they have capped our usage of the
landfill at a number which is 50% reduction (51,000 tons) from our 102,000 base tons.
Landfill use for fiscal years '92 and '93 was 75,200 tons and 77,500 tons, respectively.
With a fully established volume allocation, I believe we can move far more effectively because
we now have a target goal and can design local programs to meet the volume reduction limits
that have been imposed upon the landfill. This should focus Iowa City IS waste management
efforts as well as those of all landfill users. The debate concerning how to pay for it, what
items to be picked up, level of subsidiesl then appear to have greater relevance in future plans.

There will no doubt be complaints about this system of landfill management. It is likely that
waste collection districts may be designed and related policies as we seek some type of
jurisdictione I boundary to be utilized for volume measurement. It is further likely that more
formalized policies and ordinances will need to be enacted on behalf of the County and other
smaller communities that do not provide government sponsored pickup of solid waste.
This issue has been discussed and debeted amongst members of your staff. and after listening
to the debate and reviewing the extensive files and memoranda prepared. it is my conclusion
that until we decide a formal policy which identifies how to meet the 50% mandatory
reduction requirement at the landfill. all other collection systems. rate decisions and debates
appear to be secondary. The underlying motivation for our policies needs to be reduction of
volume. The only means by which to seriously address and reduce volume as required is a
significant policy statement and ultimata direction established by. the City Council as the
landfill owner/operator.

Attached you will find Johnson County waste stream estimates, residential waste stream
estimates, and IndustriaVcommerclal waste stream estimates. These percentages are based on
waste stream studies done by Brice, Petrides-Donohue Co. for the ECICOG Regional
Comprehensive Solid Waste Management Plan (1989). I believe the percentages are stili
t accurate enough for us to use.
Also attached Is a complete list of Items and tonnages of material recycled by Iowa City In FY93
and an estimated tonnage of recycled material county wide.
I havg also attached a table showing where the Iowa City landfill needs to be, as tonnage Is

The City of Iowa City is in the process of developing a community focus group to assist the City
Council In their decision making associated with the reconstruction of the Melrose Avenue Bridge and
Melrose Avenue from a point east of the bridge to South Grand Avenue, A map is attached, In order
to Involve our citizenry and other Interested parties, as well as perform a required environmental
assessment, this focus group is being created to bring together what we believe to be the various

The specific task of the group will be to review a draft scope of work. We believe that you represent
one of those Interest groups. A list of groups contacted is attached. Our plans call for hiring a
facilitator, securing a representative from each of the Interest groups, and convening this group in a
formal focus group setting In order to review the draft environmental assessment scope of work under
the guidance of the facilitator. We recognize the divergence of Interest and the fact that certain
interest groups are from out of the Iowa City area. Therefore, sufficient lead time must be
Incorporated into the process. This should provide not only a timely review to meet requirements of
various agencies, but also to secure sufficient participation prior to the formal decision by the City
Council to proceed on the scope of work.
We would like for your organization to provide a representative to participate in this community focus
group discussion. Our plans call for the meeting to be held in October. Your participation or that of
a representative would be helpful. We believe such a focus group session could Involve an all day
commitment. We will do our best to accommodate schedules. However, It may require a commitment
of a Saturday In order to assure maximum participation.
Please contact me as soon as possible about your participation in this group effort and, if at all
possible, the name of the Individual who would participate, Follow-up Information such as
correspondence and background material associated with the Melrose Avenue project will be provided
to participants prior to the meeting In October.

The City Council has decided to fill the vacated seat of William Ambrisco by special election.
That election will be held on the regular election date of November 2, 1993.
Each candidate filing for an at-large seat must clearly indicate on their petitions and the affidavit
their intention to seek the unexpired term (26 months) or the full four (4) year term. The
petitions must be filled out with the term indicated prior to any signatures being obtained.
Failure to indicate the term could result in petitions being challenged. For proper identification
on the ballot an indication is needed on both the affidavit and the petitions. We suggest, that
whatever wording is selected, it be consistent on both the affidavit and the petitions. Samples
are included for illustration purposes.

Over the summer, the Executive Committee of the Chamber of Commerce Arts Subcommittee
has met several times to work with Camlros and Golden Associates In arriving at an optimal use
configuration for a downtown conference and cullural center. The resulting project Is down-scaled
In the space devoted exclusively to arts uses, Incorporates a number of shared spaces, and
provides revenue-generating retail spaces as well as a sizable conference center.
Representatives of the arts have worked very hard to modify the project to retain the essential
concept this project began with and at the same time be cognizant of what the community could
conceivably support.
In mid-September the consultants will be In Iowa City to present a preliminary construction and
operations budget to the Executive Committee and to discuss management models with the
Administration and Operations co-chairs. Our expectations are that the feasibility study will be
ready for presentation to the City Council In mid-November. The Executive Committee Is planning
on a public forum on the project shortly after the presentation to the Council.

Re: Neuzil Tract
Dear Ms. Gentry:
I am sure that you will recall the litigation involving the
Neuzil land which finally terminated in a Supreme Court decision.
The Iowa Court of Appeals entered a judgment in favor of my client
which was reversed by the Iowa Supreme Court. However, all of the
decisions are interesting in setting the factual situation
concerning this real estate since it was acquired by my client
during the 1930's.
To refresh your memory the Neuzil tract has been regarded as
part of Iowa City for many years and in fact a dispute arose
between Iowa City and University Heights concerning the property.
Iowa City went to great lengths to retain jurisdiction over the
Neuzil tract.
A short time ago a group of neighbors residing in Iowa City
brought an application to have the property down-zoned. This was
resolved by the Supreme Court of Iowa as indicated above.
I am sure that you can understand the surprise and chagrin of,
my clients when they received a copy of the story in the IOWA CITY
PRESS CITIZEN of June 18, 1993, and other media reports pertaining

GENERAL COMMENTS/REACTIONS/QUESTIONS ON SA'S MEMO ON SOLID WASTE
Where did this strategy come from? Are other communities who hold
landfill permits allocating volumes to other jurisdictions who
utilize their landfill?
According to the info provided by Brad Neumann, Hills, Lone Tree,
North Liberty, Solon, Tiffin, U Heights, and Coralville all have
pay as you throw programs. Iowa City, Oxford, Sheuyville, and UI
do not. The unincorporated areas of the County are not served
(officially) by any program. The City Managers' argument seems
based on that other jurisdictions will have to be regulated via an
allocation of space in the landfill. They already seem to be
taking positive steps towards reducing volume, up to 27.6% in North
Liberty.
I asked Brad for specific figures on rate reduction for
jUrisdictions which are not provided in the packet. The figures on
the second page outline county-wide residential reduction rates.
Without tonnages/volumes from each community, how can we determine
who has been doing a good jOb, therefore helping us make decisions
as to where policy decisions should focus? What is incorporated in
to the figure of 5% for IC?
What about commercial/industrial reduction rates? How do we know
where to focus our rate reduction policies. Our approach should be
mUlti-tiered. Lots of consistent information.

Have we talked to any of these communities to see what they are
planning for the future, to communicate what our goals and needs
are, and gotten any feedback? It would be difficult for me to make
a policy decision before this communication takes place.
If there is a majority to implement such a pOlicy, would we make
annual adjustments to accommodate Changing population and natural
disaster circumstances?
It makes sense to me that we clean up our own backyard first,
before going out to the smaller towns who have been reducing volume
via a fee-based system.
We have the most ability to effect changes in volume in our
municipal system, secondly in mUlti-unit apartments and
commercial/industrial sectors (all of whom essentially pay by
volume via size and frequency of pick-up of dumpsters).
We need an ongoing commitment to education. If we were to ban a
material from our landfill, there are some steps that need to be
taken first. Having an effective curbside program, business and
multi-family, and an ongoing pUblic awareness/educational program
are steps to be taken before banning of any materials should take
place. Banning should be a last result. Need to show commitment
doing these other things before we ban materials.

If we decide to ban any materials from the landfill, we should
focus on paper. It is the largest part of the waste stream on all
sectors, there are markets out there, and we can purchase new paper
products with post-consumer content fibers. We should time this
with the opening of Cedar Valley Paper who will take everything but
newsprint and magazines.
Many people have requested that we add cardboard and chipboard to
our curbside and drop-off programs.
The public is interested and much effected by decisions we make
about solid waste. Let's form a commission to advise us and help
do some research on issues, trends, innovations, and successes.
This is going to be an ongoing issue which will do nothing but get
more complex and expensive.
Is IC trying to go up versus out with the landfill? What is the
process with DNR? Where is the process with DNR? What are the
issues and policy decisions associated with going up?
Environmental? Aesthetic? Economic?
Enforcement questions, what if a city reaches their allocation
three quarters of the way through the year? Incentive pricing
after this allocation has been reached.

Markets are not a problem locally. There are enough vendors out
there dealing with a variety a materials. We are not Seattle. We

CLARIFICATION TO POLITICAL SIGN REGULATIONS, Page 4, of the Council Candidate
Handbook:
In residential zones:
All political signs shall be placed no earlier than 30 days prior to the election and shall
be removed not later than seven days following the date of the election. (If a primary is
required the earliest date to post signs would be September 5, 1993, BUT ONLY FOR THE
SEATS THATREQUlRE A PRIMARY ELECTION. All other seats would not be able to post
political signs until October 3, 1993.)

Regarding requests for information:
Individuals requesting copies of public documents may be required to pay a fee as established
by that department to cover the retrieval and/or copying costs.
Once an individual tiles candidate papers, and those papers are verified by the City Clerk,
requests are furnished to all candidates automatically. A copy of all information furnished to
candidates shall be kept on tile in the City Clerks office.
After the general election, and before taking office, newly elected candidates will receive
Council agenda and information packets.
