TION PLAN FOR A PROPOSED URBAN REVITALIZATION AREA IN THE CITY OF IOWA CITY, IOWA. WHEREAS, pursuant to Iowa Code Chapter 404, the City Council may, by ordinance, designate an area of the city as an urban revitalization area for the purpose of granting property tax exemptions for Improvements to properties; and WHEREAS, on May 11, 1993, the City Council adopted Resolution No. 93-106, supporting the concept of using tax exemption for Improvements Involved In the Block 62 Project and directing City staff to begin the necessary steps to establish property tax exemption for the Project as set forth In Iowa Code Chapter 404; and WHEREAS, this proposed Urban Revitalization Area Includes and consists of the area described as: Block sixty-two (62), Original Town, Iowa City, Iowa. WHEREAS, the City Council must follow the statutory criteria set forth In Iowa Code Chapter 404 when designating an area as an urban revitalization area. This procedure Includes adoption of a resolution finding that the rehabilitation, conservation, redevelopment, or a combination thereof of the area Is necessary In the Interest of the public health, safety, or welfare of the residents of the City and the area meets the criteria of 9404.1; and WHEREAS, Iowa Code 9404.1 provides that the City Council may designate an area of the City as a revitalization area, If that area Is any of the following: "3. An area In which there Is a predominance of buildings or Improvements which by reason of age, history, architecture or significance should be preserved or restored to productive use. 4. An area which Is appropriate as an economic development area as defined In Section 403.17," WHEREAS, Section 403.17 defines an economic development area as the following: "An area of a municipality designated by the local governing body as appropriate for commercial and Industrial enterprises or housing and residential development for low and moderate Income families, Including single or mulflfamlly housing." Washington), the Iowa Building (southeast corner of Linn and Washington), and the Masonic Temple (312 E. College) as key buildings In terms of architectural and historical significance and recommends the preservation and Improvement of these buildings and other key downtown buildings as a means of promoting the economic vitality of the City's center. The Commerce Building (325 E. Washington) Is also historically significant In terms of Its place In Iowa City history as once being the home of the Elks Club. In addition, Trinity Church (320 E. College) Is listed on the National Register of Historic Places; and WHEREAS, the Incentives created by said Chapter 404 are necessary to preserve buildings In the revitalization area and provide low and moderate-Income housing; and WHEREAS, this Council has reasonable cause to believe that the area described above satisfies the eligibility criteria for designation as an urban revitalization area und6r Iowa law; and WHEREAS, Iowa Code ~404.2 (1993) requires the City to prepare a revilallzation plan for the proposed revitalization area; and WHEREAS, Iowa Code Chapter 404 requires the City Council to hold a public hearing on an urban revitalization plan for an urban revitalization project following notice to all owners of record of real property located In the proposed area and all tenants living In the proposed area, In accordance with Iowa Code ~362.3; and WHEREAS, Iowa Code Chapter 404 further requires that, In addition to notice by publication, notification shall be given by ordinary mall to the last known address of the owners of record and to the "occupants" of city addresses located within the proposed area. These notice shall be given by the thirtieth day prior to the public hearing; and WHEREAS, the only reasonably current and complete list for City addresses located within the proposed area Is contained In R.L. Polk Company's City Directory. NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. The facts stated above In the preamble are a true and correct statement of the conditions In the proposed Block 62 Urban Revitalization Area and of the necessity for Its designation as an urban revitalization area. 2. The proposed Block 62 Urban Revitalization area legally described above Is an eligible urban revitalization area under the criteria of Iowa Code ~404.1 (1993). 3. " Ilf ~ I ,I II I !I l ;1 '. ~ I " ,I , .i: " ;-' Ii h: : I; , The Citizen Building Limited Partnership is moving full.steam ahead with plans to acquire the 'old Iowa City Press.Citizen Building and convert it to 18 one.bedroom units affordable to low income persons who are elderly or disabled. Federal. state and private funding is now in place with the exception of formalizing the tax exemption to be granted by the City after the approval of the Urban Revitalization Plan. Public monies for this project include: Direct grants: CDBG HOME Investment Partnership Iowa Finance Authority $30,000 $400,000 $15,000 Other public subsidies, in the form of taxes that are forgiven over a period of years, are the property tax exemption from the City of approximately $150,000 over ten years, and the federal Low Income Housing Tax Credit (L1HTC) worth about $165,000 over ten years. The L1HTC is the incentive to get private investors for the project. The total funds for the project, from various sources including private monies, are $2.16 million. , ,I The project is preserving the facade of the building, as well as ali of the exterior features of the original structure. (The 1968 addition to the building is being demolished,) The only change to the exterior will be the insertion of windows which can be opened. These windows will maintain the overali "block" appearance and will be approved by the State Historic Preservation Office in a Memorandum of Agreement. Mr. Burns still hopes to build 48 additional units on the south side of the building in the future. ,\ :', i r Prooertv Tax Exemotion The Resolution on the Council's agenda is the first step in establishing property tax exemption for the Citizen Building Project. Attachment 1 lists a proposed schedule for the steps in establishing property tax exemption for the site. The steps in the process are basically tha following, The City designates an area as an urban revitalization area by ordinenca; the City then adopts, by resolution, en urban revitalization plan for the area. Once the City Council grants the exemption, the application is sent to the City Assessor to determine if the added value of improvements meet all of the requirements. The proposed revitalization area includes the entire block on which the Press-Citizen Building is located, Block 62. The wording of State Code implies that an urban revitalization area cannot consist of only one building. Designating the entire block will provide an opportunity to encourage the preservation of historic and architecturally significant buildings on the block through adaptive reuse of the these buildings, when appropriate, for housing for low and moderate income households. According to the proposed plan, proposed projects within the revitalization area must meet all of the following criteria to qualify for property tax exemption: Provide housing for low and moderate income households through the adaptive reuse of historic or architecturally significant buildings. Be qualified real estate which includes real estate assessed as residential property or asse,ssed as commercial property, if the commercial property consists of three or more separate living quarters with at least seventy-five percent of the space used for residential purposes. (The remaining twenty-five percent of the space could be used for other commercial uses such as oUice space). Be eligible construction which includes rehabilitations and additions to qualified real estate which increase the actual value of the property as of the first year for which an exemption is received by at least fifteen (151 percent in the case of real property assessed as commercial property, or at least ten (10) percent in the case of real property assessed as residential property. The proposed plan includes four tax exemption schedules from which an eligible property owner can select. As discussed this past May, Schedule 4 is the schedule that will be used for the Citizen Building Project. These four tax exemption schedules are provided by State Code, State Code does allow the City to adopt different schedules than these four. However, a different schedule shall not provide for a larger tax axemption in a particular year than is provided for that year in a corresponding schedule specified in the State Code. In addition, the tex exemption schedules provided in one revitelization erea must also apply to every revitalization area within the City. So if the City in the future designates another area of the community as an urban revitalization area, the plan for that area must include the same tax exemption schedules included in the Block 62 Urban Revitalization Area. In order to provide consistency in the future, staff has included the four schedules provided by State Code, The Block 62 Urban Revitalization Area shall remain a designated revitalization area for a period of ten years. During this ten year period, e qualified property owner in the area may apply for property tax exemption, The tax exemption schedule the property owner selects will be in effect from the date of City Council approval of tax exemption for the specific project. The Plan also conteins relocation provisions in the event qualified tenants are displaced. . SECTION 1: SELECTION CRITERIA FOR THE BLOCK 62 URBAN REVI. TALlZATION AREA CODe OF IOWA CRITERIA Under the Urban Revitalization Act of the State of Iowa, the City is granted the authority to designate portions of the City which meet the specified criteria as revitalization areas. Accordingly, on September 2B, 1993 the City Council adopted a resolution finding that the proposed Block 62 Urban Revitalization Area meets the criteria of Sections 404.1 (3) and (4), 1993 Code of Iowa, and that the rehabilitation, conservation, redevelopment, economic development, or a combination thereof is necessary in the interests of the public health, safety or welfare of the residents of the City. Sections 404.1 (3) and (4) specifically state that the City may designate an area of the City a revitalization area if that area is "an area in which there is a predominance of bUildings or ,improvements which by reason of age, history, architecture or significance should be preserved or restored to productive use," or "an aree which is appropriate as en economic development erea as defined in section 403.17." Section 403.17 defines an economic development erea as "an area of a municipality designated by the local governing body as appropriate for commercial and industrial enterprises or housing and residential development for low and moderate income families, including single or multifamily housing. Such designated area shall not include land which is part of a century farm." CITY OF IOWA CITY POLICY CRITERIA The City Council has adopted the Comprehensive Housing Affordability Strategy (CHAS) which outlines City policy regarding the provision of affordable housing. The first priority of the CHAS is to expand and maintain the affordeble rental housing stock and expand rental assistance. The CHAS also emphasizes the need for housing opportunities for persons with special needs, including the elderly and persons with disabilities, The City Council has also adopted the Iowa City Historic Preservation Plan which outlines City policy regarding the preservation of historic and architecturally significant bUildings. The Iowa City Historic Preservation Plan identifies the Press.Citizen Building (319 E. Washington), the Iowa Building (southeast corner of Linn and Washington). and the Masonic Temple (312 E, College) as key buildings in terms of architectural and historic significance and recommends the preservation and improvement of these bUildings and other key downtown buildings as a means of promoting the economic vitality of the city's center. The Commerce Building (325 E, Washington) is also historically significant in terms of its place in Iowa City history as once being the home of the Elks Club. In addition, Trinity Church (320 E. Both of these categories of qualified real estate must provide low and/or moderate income housing in order to qualify. All additions shall be developed in such a manner as to be architecturally compatible with existing development. Plans and specifica- tions for proposed exterior renovation will be submitted to the Iowa City Historic Preservation Commission for review and approval. All qualified real estate assessed as residential property is eligible to receive an exemption from taxation based on the actual value added by the improvements. The exemption is for a period of ten years. The amount of the exemption is equal to a percent of the actual valued added by improvements, determined as follows: one hundred fifteen percent of the value added by the improvements. However, the amount of the actual value added by the improvements which shall be used to compute the exemption shall not exceed twenty thousand dollars and the granting of the exemption shall not result in the actual value, of the qualified real estate being reduced below the actual value on which the homestead credit is computed under section 425.1 of the Code of Iowa. 2. All qualified real estate is eligible to receive a partial exemption from taxation on the actual value added by the improvements. The exemption is for a period of ten years. The amount of the partial exemption is equal to a percent of the actual value added by the improvements, determined as follows: a. For the first year, eighty percent. b. RELOCATION PROVISIONS The City has considered provisions for the relocation of persons, including families, business concerns and others, who could be displaced as a result of improvements to be made in the designated area. Benefits Upon application for and verification of eligibility for tax exemption to e property owner by the City, qualified tenants in designated areas, whose displacement was due to action on the part of a property owner to qualify for said tax exemption under this plan, shall be compensated by the property owner for one month's rent and for actual reasonable moving and related , expenses. Eligibility "Qualified tenant" as used in this Plan shall mean the legal occupant of a residential dwelling unit which is located within a designated revitalization area and who has occupied the same dwelling unit continuously since one year prior to the City's adoption of this plan. Under this plan there are no relocation provisions made for commercial units. Actual Reasonable Moving and Related Expenses A qualified tenant of a dwelling is entitled to actual reasonable expenses for: a, Transportation of the displaced person and personal property from the displacement site to the replacement site. An application shall be filed for each new exemption claimed and approved by the City Council pursuant to Section 404.4 of the Code of Iowa. The City Assessor shall physically review each first-year application pursuant to Section 404.5 of the Code of Iowa. SECTION 5: AMENDMENTS TO PLAN Once the City has adopted the Pian, the City may amend the Plan after a hearing. Notice of the hearing shall be published as provided in section 362.3 of the Code of Iowa, except that ,at least seven days' notice must be given and the public hearing shall not be held earlier than the next regularly scheduled City Council meeting following the published notice. SECTION 6: REPEAL OF ORDINANCE When in the opinion of the City Council the desired level of revitalization has been attained or economic conditions are such that the continuation of the exemption granted by this Plan would cease to be of benefit to the City, the City Council may repeal the ordinance establishing the revitalization area. WHEREAS, pursuant to Resolution No. 84-130, Mercy Hospital and the City of Iowa City, Iowa entered into an "Indemnity Agreement" whereby the City gave Mercy permission to use public right-of-way for placement of certain informational traffic signs, which agreement was signed June 5, 1984; and WHEREAS, Mercy Hospital now desires to install an additional information sign on public right- of-way, in order to facilitate traffic to Mercy Hospital's emergency facilities; and WHEREAS, the City Traffic Engineer has reviewed the proposed additional emergency sign, and finds that Mercy's request to install this additional sign will not adversely affect the City's interest therein; and WHEREAS, since the prior Indemnity Agreement was not previously recorded as a document affecting property and public right-of-way, said Agreement should now be recorded with this resolution and amendment to indemnity agreement, since the traffic signs herein touch and concern public property and public right-of'way; and WHEREAS, Mercy Hospital has agreed to enter into an amendment to the indemnity agreement for use of public right-of~way. AMENDMENT TO INDEMNITY AGREEMENT THIS amendment to indemnity agreement is made between Mercy Hospital, Iowa City. Iowa and the City of Iowa City. Iowa. a municipal corporation ("City"). WHEREAS. pursuant to Resolution No. 84-130 Mercy Hospital and the City of Iowa City. Iowa entered into an "Indemnity Agreement" whereby the City gave Mercy permission to use public right-of-way for placement of certain informational traffic signs, which agreement was signed June 5, 1984; and WHEREAS. Mercy Hospital now desires to instail an additional information sign on public right- of-way. in order to facilitate traffic to Mercy Hospital's emergency facilities; and WHEREAS, the City Traffic Engineer has reviewed the proposed additional emergency sign. and finds that Mercy's request to instail this additional sign will not adversely affect the City's interest therein; and WHEREAS. since the prior Indemnity Agreement was not previously recorded as a document affecting property and public right-of-way, said Agreement should now be recorded with this resolution and amendment to indemnity agreement. since the traffic signs herein touch and concern public property and public right-of-way; and WHEREAS. Mercy Hospital has agreed to enter into an amendment to the indemnify agreement for use of public right-of-way. NOW. THEREFORE, in consideration of their mutual promises. Mercy Hospital and the City of Iowa City. Iowa agree as foilows: 1. The original Indemnity Agreement. attached hereto as Exhibit A and incorporated by reference herein, is hereby amended as set forth in this "Amendment to Indemnity Agreement." in order to facilitate Mercy Hospital's need to instail an additional information sign on City right.of.way, namely on the east side of Johnson Street south of 8100mington Street, in order to facilitate traffic to Mercy Hospital's emergency facilities. 2. In consideration of the City's permission for Mercy Hospital to instail an additional informational traffic sign, Mercy agrees to provide. keep in place and maintain said sign in good working condition, to the complete satisfaction of the City Traffic Engineer and the City Engineer and at the sole expense of Mercy Hospital. 3. Mercy Hospital further agrees to instail said sign according to the application and permit attached hereto as Exhibit 8 and in the location shown on Exhibit C, both of which Exhibits are attached hereto and incorporated by reference herein. ail in compliance with City sign regulations and City traffic control provisions. 4. Parties hereby aCknowledge that the original Indemnity Agreement, which is attached hereto as Exhibit A and incorporated by reference herein, should be and is hereby incorporated into this amendment, for recordation of the entire agreement in the Johnson County Recorder's Office, as a covenant running with the land. In the event ot breach ot this Amendment to Indemnity Agreement, or in the event of breach of the original Indemnity Agreement, the City may, at its discretion, elect to give notice to Mercy Hospital to remove all signage and/or obstructions trom the City's right-of-way, all as provided in Section 364.12, Code of Iowa (1993); and in the event Mercy Hospital does not comply within the time period designated in the Notice to Remove, City may elect to remove, or direct removal of, said signage and/or any or all obstructions from the right-ot-way, and to charge the cost of such removal to Mercy Hospital, and Mercy Hospital agrees to pay said charge in a timely manner. 6. Mercy Hospital, together with its successors and assigns, agrees to indemnify, defend and hold the City harmless in connection with any liability whatsoever arising in regard to the installation, maintenance, use. location or repair of said signage along the City right-of-ways described in Exhibits A, Band C attached hereto, including any liability which the City may incur as a result of its decision to allow placement of said signage along City ot Iowa City public right-ot-way. Mercy Hospital may later be required to carry liability insurance coverage, but such coverage is now waived by the City. If any required insurance is not maintained, the City shall have the right to remove the signage pursuant to Section 364.12, Code of Iowa (19931. I I I ! 7. Mercy Hospital acknowledges and agrees that no property right is conferred by this grant ot permission to use the City's right-ot-way tor placement of the signage; the City is not empowered to grant a permanent use of its street right.ot-way for private purposes; and that the City may order said signage removed at any time if, for any reason, the City Council determines that the property or public right-of-way upon which the signage is located is needed tor a public use and/or should be cleared of any or all obstructions, as provided by state law. 8. This Amendment to Indemnity Agreement, together with the original Indemnity Agreement and Exhibits Band C shall constitute a covenant running with the land, shall be binding upon and enure to the benetit of the respective heirs, successors in inteiest and assigns of both parties, and shall be recorded in the Johnson County Recorder's Office, at Mercy Hospital's expense. , , I i Dated this 1'T11 ,1993. oc:ro BE. Such funds are awarded to meet an 'Urgent Need" (one of the National Objecilves under the CDBG program), and can be used anywhere In the City to repair ilood damage, Including public facilities such as streets, sewers, etc. The funds do not havB to be targeted to low Income residents; however, HUD strongly urges cities io use the CDBG monies to help residents (particularly low and moderate Income households) to repair their damaged homes. We are, therefore recommending using this Initial CDBG allocation ior such housing assistance. ThB attached Interim Guidelines for the Flood Repair Program Indicate that priority will be given to lower Income households. We expect to provide considerable ass,lstance to homeowners In the Baculls and Thatcher Mobile Home Parks. Assistance will Include elevation of the homes and placement on a permanent foundation as required by the Floodplain Ordinance. We are also looking Into the possibility of elevating as many homes as possible to one ioot above the 100-year flood level (even those homes where the damage Is less than 50% of the value of the structure) or assisting In relocating homes out of the floodplain If a suitable site can be iound. If relocation Is to be an option, the Council may need to consider rezoning land to permit a mobile home park. The guidelines are preliminary at this point and do not Include a maximum dollar amount for assistance since we dQ not have enough Information on what repairs will cost, or how many homes may have to be replaced completely. HOME funds through the Iowa Department of Economic Development will also shortly be available for flood damaged housing repairs or replacement. We will have a better Idea of our needs once the homes of owners requesting assistance have been Inspected and we have some Idea of the costs of elevating homes ior Instance, . 'Urgent Need' Is defined by HUD as 'existing conditions which pose a serious and Immediate threat to the health and welfare of the community which are of recent origin or which recently became urgent'. The City has chosen to use most of these funds to assist property owners with repairs to their flood damaged homes. This program will be administered by the City's Housing Rehabilitation OHlce. We will be offering both grant and no Interest loan funds to assist In repairing damage to your structure and to any essential systems that make your home unsafe and unsanitary; however, these funds can not be used to replace any personal property. For Instance, we can replace or repair your plumbing, heating, electrical, flooring and walls. We cannot replace your Washer, dryer, air conditioner, or personal belongings damaged In the flood. We will only be assisting in paying for Items that are not eligible for assistance through FEMA or HACAP, or that were only partially covered by these agencies. InterIm Guidelines for the Flood Damage Repair Program. 1. All repairs will comply with the City's Floodplain Management ordinance which requires that any structure that has been 'substantially damaged' by flooding (I.e. to the extent that Ihe cost of repairs equals or exceeds 50% of the fair market value of the structure before the damage occurred) must be elevated" the structure Is In the 1 OO-year floodplaIn. 2. COORDINATION OF 1993 FLOOD RELIEF AND RECOVERY ACTIVITIES IN IOWA CITY Background I ! I ! I, I I I The operation of the Coralville Reservoir flood gates by the U.S, Army Corps of Engineers controls the level of the Iowa River In Iowa City. Although the reservoir helped to reduce the magnitude of the flood, it also extended its duration considerably, Flooding in Iowa City remained almost constant from July 5 through September 17, 1993, with some intermittent increases due to ilash floods from local tributaries. As a result, it has been extremely diiflcult to determine the extent of flood damage, and we are only now getting into homes to inspect the damage, and getting some'ldea of repairs needed for public facilities. The high water table and length of flooding is resulting In the almost constant coliapse of sewer or water mains, which is likely to continue ior some timo. , Coordination of Flood Relief Activities I , ! , I " " ! Ii II 'I' , I'~,,' ! \ I' Ii The City has made every effort to coordinate the Emergency Disaster Relief activities of the , Salvation Army, the Red Cross, FEMA and many private citizens. We are now starting to coordinate activities to repair damages. ' 1. Public Facilities The City has been working with FEMA on estimates for the repair, replacement and in some cases, elevation of public facilities including streets, sewers, bridges, park improvements, etc. For these public facilities the City is also working with the Federal Highway Administration (FHWA) for repairs to collector and arterial streets, and the Soil Conservation Service (SCSI for pier scouring and erosion control. The estimated cost of these repairs is approximately $4.5 million. /: 1\ 2. Houslno r , I, i " ! I :l j, A very rough estimate of the total cost to repair housing damage in Iowa City is $2 million. As we start to inspect individual homes, we will have a more realistic estimate of damages and households needing assistance. Initialiy, priority Is being given to low income homeowners and those whose homes are unsafe or virtually uninhabitable. This includes homes with non-functioning furnaces. A program is being coordinated with the Hawkeye Area Community Action Program (HACAPI for water heatars, iurnaces and Insulation needs. We are also attempting to get Information on FEMA payments to residents, but understand that this Is likely to take time. However, some residents are already able to supply this iniormation, Once we have Inspected the majority of homes, we will determine what funds we will request irom the Iowa Department of Economic Development under the HOME program, We will also be evaluating the ieasibility of relocating homes out of the floodplain. , tloa.{ ,( ...._._............~ ".,...,.....;."'~,..~....-.- I, . " / 1 , " COMMUNITY DEVELOPMENT BLOCK GRANT GRANTEE CERTIFICATIONS I , In accordance with the Housing and Community Development Act of 1974, as amended, and with 24 CFR 570.303 of the Community Development Block Grant regulations, the grantee certifies that: (a) It possesses legal authority to make a grant submission and to execute a community development and housing program; (b) Its governing body has duly adopted or passed as an official act a resolution, motion or similar action authorizing the person identified as the official representative of the grantee to submit the final statement and amendments thereto and all understandings and assurances contained therein, and directing and authorizing the person identified as the official representative of the grantee to act in connection with the submission of the final statement and to provide such additional information as may be required; (c) Prior to submission of its final statement to HUD, the grantee has prepared its final statement of community' development objectives and projected use of funds in accordance with ~570.301(c), as modified by statutory and regulatory waivers for this grant, and made the final statement available to the public; (d) The grant will be conducted and administered in compliance with: 1. Pi~n~~ NAYS: None Whereupon, follows: the Mayor declared said Resolution duly adopted as Resolution No. 93-267 RESOLUTION WITH RESPECT TO INTENT TO FINANCE DISASTER COSTS WHEREAS, the City and its citizens and property owners have suffered economic loss from a series of floods and related events occurring in the month of July, 1993; and WHEREAS, the City has incurred obligations in the exercise of its emergency powers, has sustained losses protected by insurance and its program of self-insurance, has incurred and will incur significant capital costs as a part of its response to and recovery from the effects of the above disaster; and WHEREAS, because such losses and expenditures have been incurred and payments advanced from a number of City funds, the accounting for same is a complex process. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, AS FOLLOWS: 1. The Finance Director is designated to assemble a record of costs and losses incurred as a results of the 1993 floods, and to determine the sources of funding potentially available to defray the same, inclUding proceeds of standard policies of insurance, self-insurance reserves, private payments, federal and state grants and loans, and the issuance of bonds or other obligations of the City under the Disaster Response Program of 1993. 2.
