Ridge Subdivision. This covenant shall remain In effect until released of record
by the City as set forth herein.

If lhe Iowa City Community School District decides to use the qlte and applies for
i Building Permit to build a school on the designated pare r within twelve (12)
years from the date the parties execute this Amende Conditional Zoning
Agreement, Owner shall convey the site to the School Istrlct. If the School
Istrlct has not applied for a Building Permit within thlrt en (13) years and six (6)
mbpths from the date the parties execute the A nded Conditional Zoning
Agre@ment, the covenant will expire and the use 0 he parcel shall revert to the
Owmlr. At that time, the City will execute a r~le e of the covenant so that the
coven~nt will not constitute a lien and cloud on the title to the parcel. That
release III be recorded In the Johnson C nty Recorder's Office at Owner's
expense.

NOTICE TO PROPERTY OWNERS
Notice is hereby given that there is now on
file for public inspection in the office of the
Clerk of the City of Iowa City, Iowa, a
proposed Resolution of Necessity, an estimate
of costs and plat and schedule showing the
amounts proposed to be assessed against each
lot and the valuation thereof within the District
as approved by the Council of Iowa City, Iowa,
for a street improvement, designated as the
1993 Paving Assessment Project, of the types
and in the location as follows:
Ponland cement concrete paving, seven
inches thick, with necessary grading and
miscellaneous related work as shown on
the pians, on the alley south of Bowery
Street between Johnson Street and DOdge
Street from Bowery Street to a point 19B
feet to the south.
That the proposed District to be benefited and
subject to assessment for the cost of such
improvements is described as follows:
All properties abutting along the line of the
above-described alley.
The Council will meet at 7:30 o'clock p.m., on
the 28th day of September, 1993, at the
Council Chambers, Civic Center, 410 E.
Washington Street, Iowa City, Iowa, at which
time the owners of property subject to
assessment for the proposed improvements, or
any other person having an interest in the
matter may appear and be heard for or against
the making of the improvement, the boundaries
of the District, the cost, the assessment
against any lot, tract or parcel of land, or the
final adoption of a Resolution of Necessity. A
property owner will be deemed to have waived
all objections unless at the time of hearing he
has filed objections with the Clerk.
This Notice is given by authority of the

RE: 1993 Paving Assessment Project
This project will pave the northerly 198 feet of the alley south of Bowery Street
between Johnson and Dodge Streets, The total estimated assessment cost is
$25,911.00 which consists of the following elements: $19,467 engineer's estimate of
cost of construction; $1,947, engineering and legal fees; $2,141 contingency fee
associated with construction costs; and $2,356 default fee to cover costs in the
event that some assessments are not paid. These additional fees are established
by the State Code, and often do not re'present actu<1l costs,
Because the bid price exceeds the engineer's estimated cost of construction, it will
be necessary for the City to finance about $4,630 toward the cost of construction
if Council chooses to award' this contract. This is necessary because the actual
assessment can not exceed the estimated assessment. It should be noted that the
City is already subsidizing this project by about $13,000 in engineering and iegal
fees that will not be recovered by the assessment process,
If Council chooses not to award the contract, this bid can be rejected and
rebidding postponed to a later date. This action serves to hold the project in
abeyance until it is timely to readvertise, We estimate that it will cost about $1,500
to maintain this portion of alley through the winter,
In summary, the City could pay $1,500 to maintain the alley this winter and
postpone the project until next construction season with the hope of obtaining a
lowel' bid, or pay the additional $4,630 and proceed with the project. The
engineering and legal fees, which include preparation of plans, specifications and
plats, surveying and construction staking, will remain unchanged. This assessment
project was Initially combined with the Malden Lane Paving Assessment project and
If postponed at this time, the two could be rejoined.

Practical ObJection'
A repaving of the whole alley Is unnecessary and extremely
expenSive.
The alley runs into Bowery Street Clnd It has been paved to
within a very few feet of the junctfon with Bowery Street. We
estimate that to complete the paving wlll cost less than $2,000
which should be born by the property owners on either side of the
small section that needs paving.
We have already paid a portion of the cost of the paving of
the alley up to the point where the small unpaved section lies.
The paved portion of the alley Is adequate for the needs of '
the people who live there. The paving of the small remnant
unpaved section should be completed by the CIty.

Dear Council Members,
We understand that due to a technical error in the drafting of the
paving proposal voted on last month, the proposal will once again
be coming before the Council for consideration at the September 28
meeting. Prior commitments prevent us from being able to attend
that meeting, but we wish to submit this letter to indicate our
strong support for the proposal's passage.
We own one of only two owner-occupied dwellings on the alley in
question; we have discussed the proposal at length with the other
owner-occupants, Tom and Chris Mentz, who will be present to speak
at Tuesday's meeting and with whom we are in full accord. However,
we also understand that there is apt to be some opposition to the
proposal, specifically from the apartment owners at the south end
of the alley, and it is to that anticipated opposition that we wish
to address ourselves.
Beyond question, the alley needs to be paved; even the most cursory
examination of its condition leads inevitably to that conclusion.
It seems that the only issue in contention is how the cost is to be
divided among the property owners along the alley; we understand
that some of the southern rental property owners feel that they
should not be included in the assessment. However, the great
majority of automobile traffic on the alley is generated by those
same apartment buildings, and since it is this increased traffic
that accounts for the rapid deterioration of the alley, it is only
fair that those rental property owners be assessed along with those
of us at the north (and currently unpaved) end of the alley,
Within the past year, Mr.' Mentz arranged for a traffic counter to
be placed in the alley to determine just what proportion of traffic
originated from tenants of the southern end of the alley; while you
would need to check with Tom for an exact figure, as we recall it
was over 80%. We hope and trust that the Council will not buy into
the ludicrous proposition that owners whose properties generate 80%
of the wear-and-tear on the alley should somehow be exempt from
Sharing in the assessment for its paving.

As people who actually live here and must negotiate the alley every
single day, it is infuriating to think that absentee owners of
large, high density, income-generating properties might be able to
thwart such a patently necessary improvement. We understand that
Mr. Mentz recently had a discussion with one of those apartment
building owners, in which Mr, Mentz professed his support of the
paving project and his dissatisfaction with the alley's current
condition; apparently the absentee owner responded "If you don't
like it Tom, I suggest you move." We pray that the council takes
a more egalitarian and just view of the situation, and approves the

Dear Ms Karr, HE: Notice He Proposed Paving
of198 feet of Alley South of Bowery
We strongly object to the proposed paving project on two
grounds: the proposed hIghly unusual manner of paying for It and
the high cost.
We believe that your attempt to b11l property owners other
than those adjoining the portion, of the alley to be paved Is
unusual and 11legal.
If the City of Iowa CIty wishes to pave the 198 foot section,
the adjacent property owners shoul.d foot the b11J. This Is normal
practice.
The City of Iowa city Is attempting to force us, the
undersigned non-adjoining property owners (and others) by a
procedure concocted to lull all Into paying for something which Is
none of their concern.
It Is common practice that If an access route Is to be paved,
only adjolng property owners pay the cost. Other users who
benefit from same do so cost free. We have shared the cost of
paving the alley adjoining our property. We do not Intend to
participate In the proposed unusual procedure In order to
subsidIze a cost which Is the responslblllty of others.
The estimated cost of the paving project at almost $30,000
Is too high, perhaps by an order of magnitude.
Iowa City should rethink this wrongful proposal.

Dear Clerk:
On behalf of Neal am Ruth Miller, I am writi.ng to forwally object to
certain aspects of the 1993 pavi.ng assessment project conceming the alley
located between Dxlge am Johnson streets south of Bowery street am north
of the railroad.
Mr. am Mrs. Miller CIYIl a parcel of property located on the south end
of the above-described alley. Accordi.ng to the notice we have receiVe:l, the
city proposes to iJrprove the northerly 198 feet of the above-described alley
aIXl to assess a portion of this iJrprovement cost to my clients. Mr. am
Mrs. Miller's property, hCMever, is not adjacent to the area of the alley to
be iJrprove:l, aIXl in fact is located approxilrately 200 feet south of the
proposed iJrprovement area.
OUr specific objections are as follcus: First, your notice states that
iJrprovement costs are to be assessed to "(a) 11 properties abutti.ng along the
line of the alley iJrprovements." Because the Miller property does not abut
the area which is to be iJrprove:l, the tenns of your CIYIl notice preclude you
from assessi.ng the Millers with any portion of the cost.
Secondly, we feel that because of the considerable distance between the
Miller property am the area to be iJrprove:l, those property CIYIlers whose
laIXl actually borders the area to be iJrprove:l should be assessed the cost of
iJrprovements. .
'lhirdly, we are concerned that any regradi.ng of the alley will
aggravate an existi.ng drainage problem in the area. A large portion of the
alley drains directly onto the Miller property. 'Ibis drainage has caused
daJrage in the past, aIXl we are concerned that any alley iJrprovement will act
to funnel additional drainage aver the Miller property.

Proposal for paving alley south of Bowery Street between Dodge
and Johnson streets
Dear Council Members,
As we will not be able to attend the City Council meeting of August
17 due to prior commitments, we are sending this letter to express
our support and approval for the proposed paving project of our
back alley.
As affected property owners, we cannot stress strongly enough the
necessity of having this alley paved. We are pleased to see that
the assessment has been attached to all property owners along the
alley--both those along the northern, unpaved part of the alley, as
well as the owners of the apartment buildings on the south part of
the alley, which was paved last year at those owners' cost. The
only reason the alley requires paving is due to the increased
traffic caused by those mUlti-unit apartment buildings, and though
they may object to being included, it is only fair that those
owners be assessed their portion of the total cost.
In short, we are very much in favor of this project, willing to pay
our portion of the assessment, and urge you to approve the
proposal.
