I Thank you very much. In the past year we have tried to get
all of our paper work done and proceeding to get our affiliation
taken care of with the National Board For Habitat for Humanity,
We have had had many many open doors and many friendly
faces and lots of help from various offices throughout the Iowa
City government. There are lots of people who have given us
lots of help and a lot of Information. This proclamation this
evening, I think, reflects once again that spirit of helpfulness
on the part of the community of Iowa City. The council has
Indicated their Interest and their support for our organization.
In the spring as we start to build our flrst home we wlll hope
to come back to council and once again Invite all of you to Join
us and strap on that carpenters belt and get a paint brush and
help us put that first house together. I thank you again very
much.

('l) CONSIDER SETTING A PUBLIC HEARING FOR OCTOBER 26,
1993, ON THE CITY'S PROPOSED COMPREHENSIVE HOUSING
AFFORDABILlTY STRATEGY (CHAS).
. Comment: Iowa City is required to prepare a CHAS in order to
be eligible for certain federal funds. The document also provides
an opportunity for the City to review and address its affordable'
housing needs. Public input is required and any comments
received must be addressed in the final CHAS document.
Comment: The owners of the property located at 512 South
Summit Street participated in the City Housing Rehabilitation on
June 4, 1990. The financing received was in the form of a two.
year interim lien for $17,500.00. The lien was raplaced by a
payback mortgage on March 15, 1993, because the applicant's
income had increased. The mortgage and lien were paid off on
October 1, 1993, and can now be released.

Comment: The Large Scale Residential Development Plan and
Stormwater Manegement Easement Agreement for Idyll wild
Condominiums obligate the Developer to construct two storm-
water management facilities. This obligation constitutes a lien
and a cloud on the title to the condominiums. The Developer has
substantially completed the storm water facilities but a general
release of the facilities is not yet appropriate. Th,is Partial Release
Agreement removes the cloud on the title to Idyll wild Condomini.

a. Public hearing on an ordinance amending the Zoning Ordinance by
conditionally changing the use regulations of an approximate 1.2 acre
tract of land located at 605 and 617 Kirkwood Avenue from CC-2,
Community Commercial, and RS.5, Low Density Si~!e-FamilY ~slden-
tial, to CO-I, Commercial Office. (REZ93-0008) ~/
Comment: At its September 16, 1993, meeting, by a vote of 5-0, the
Planning and Zoning Commission recommended approval of an
amendment to the Zoning Ordinance by changing the use regulations for
property located at 605 and617 Kirkwood Avenue from CC-2 and RS-5
to CO-I. subject to: 1) the existing curb cut at 617 Kirkwood ~venue
being closed at the applicant's expense; and 2), an access easement
being established across 605 Kirkwood Avenue to provide access to
617 Kirkwood Avenue. The Commission's recommendation is inconsis-
tent with the staff recommendation included in a staff report dated July
15, 1993, and a memorand~m dated September 2, 1993.

Michael Lensing! I, along with my wife Vicki, own the properties and
60S and 617 Kirkwood. I think the only thing that I would
want to assure the councll is after this long long process which
I have learned a lot we-out goal is really to keep the integrity
of that neighborhood together because we plan to be there
many many years. Our biggest focus Is really wanting to house
the support group in the property at 617 and also to put
garages In the back. Earlier when Susan had mentioned about
plantlngs and everything-the only think I guess I would say tot
hat when that property at 60S was developed we did put two
plantlngs of arbor vita and they were large ten years ago. But
there Is a row of walnut trees that consistently drop sap on
those trees and they have not been well maintained. So when
doing hedglngs and different things to border those properties
we would be happy to work with the city forester to help us
find something to do that. We appreciate your help and we
really have to go on living there too and we want to have a
good rapport with neighbors. Thank you.

an approximate 240 acre tract, known as Windsor Ridge, located east
of Scott Park, south of Lower West Branch Road and north of American

Comment: At its August 19, 1993, meeting, the Planning and Zoning
Commission, by a vote of 4-0, recommended approval of an amendment
of the conditional zoning agreement that accompanied the March 30,
1993, rezoning of Windsor Ridge from County RS to City RS-5. The
purpose of the amendment is to clarify the procedures for conveyance
of approximately 13 acres of land for a school site to the Iowa City
Community School District. The recommended amendment differs
slightly from what staff originally proposed, but is consistent with the
intended clarification staff felt was warranted. Comments were
received at the September 14, 1993. public hearing on this item. The
public hearing had been continued from the September 14, 1993,
meeting of the City Council. No comments were received at the
Council's September 2B, 1993, hearing on this item.

public walkway right-of-way located adjacent to the southwest lot line
of Lot 21, Windsor Heights, Fifth Addition, be vacated, subject to
retaining the 20-foot wide sanitary sewer and utility easement located
along the N. Seventh Avenue frontage. This recommendation is
consistent with the staff recommendation included in the staff report

Commission, by a vote of 5.0, recommended approval of the preliminary
and final plat of Windsor Ridge, Part One, a four lot, 5.57 acre subdivi-
sion located north of American Legion Road and west of Taft Avenue in
Fringe Area 5, subject to: 1) City Attorney approval of legal papers prior
to Council consideration; 2) approval of a Grading and Erosion Control
Plan by the Public Works Department prior to Council consideration; and
31 approval of construction plans and design calculations by the Public
Works Department prior to Council consideration. This recommendation
is consistent with the staff recommendation included in a report dated
July 29, 1993. The Grading and Erosion Control Plan has been
approved by the Public Works Department.
On September 30, 1993, the applicant submitted a separate final plat
of Windsor Ridge, Part One, to be considered simultaneously with the
final plats of Parts Two, Three and Four of Windsor Ridge. On October
1, 1993, a separate preliminary plat of Part One was submitted for
immediate Council consideration. No legal papers are required as part
of a preliminary plat approval, and in accordance with standard
procedures, the construction plans and design calculations need not be,
approved at this time, but should be approved prior to final plat approval
of Windsor Ridge, Part One. The preliminary plat for Windsor Ridge,
Part One, is ready for Council consideration.

Pigott/l would like to just address It for a moment. I will vote for it.
I just understand that we are collapsing the readings In order
to allow small businesses to occupy these spaces shortiy and
that they need to move in soon, very soon. Whlle I support
that, we are support of collapsing this in part because of
someone else's mistake I think and because of that it gives me
pause to think we are doing someone else a favor when they
made a mistake initially in the need to come before counell.
Whlle I'll vote for this I just wanted to say that It Is Important,
too-I think that I do it with hesitation.
Horow/l agree with you Bruno. It think It sends a message to
people that this is something that they can do whimsically
whenever they want to.
Pigott! While I'll vote for this because by requiring a third
consideration we would only be punishing the small businesses
that seek to move into there and that is not the intent of this
councll and so I don't think that that would really resolve a
problem.
NovlWe did address this problem for the first meeting. We did ask
that when someone applies for a bullding permit that they get
the designation of the zone so that we know which zone they
are in and the kinds of developments, the kinds of businesses,
residential are allowed In the particular zone that they
requested a permit for. When the person requesting this
permit did not know this-it Is not as if they weren't doing it in
a timely fashion. They just did not understand what was
allowed in the current zoning ordinance and they made an
assumption that was really not correct so we have to do
something that prevents assumptions in the future.

Harold Engen! You appointed me to the Senior Center Commission.
When you did that I was a little reluctant. I was not really
very knowledgeable about the Senior Center. Although f was
eligible I was stlll not very knowledgeable about it. And f
have just been amazed by the numbers and the volunteers that
we use. There Is a mistake In the Post and f want to make
public announcement of that. We do not have 1,117 classes
taught last year. That is the number of sessions we had. We
did have, however, 253 different classes that were taught.
Now that Is amazing to me. We had 814 part-time services
provided. Listen to thls- 84,000 visits to the old post office
which Is now a beautiful Senior Center and we have two
persons handling 500 and some volunteers to do that. Last
night we honored them and I think 4 or 5 of you were there
last night. We had abut 200 of the volunteers. We need to
think now about how the future is going to be conducted at the
Senior Center. We have had a 5 year plan that Is up this year.
We are going to do something that f think is kind of exciting,
really. We are going to Invite-we have made the Invitation and
we haven't received all of the acceptances yet, some of the best
and brightest In fowa City and Johnson County. We are going
to form, well we think so, we are going to form a visionary
committee and this visionary committee will sit down on the
second Tuesday In November and Jude West and David Day
from the School of Business who are very very talented In this
area have volunteered their services. We are going to lock
these 35 people up for a day and have them brainstorm. David
Day will then take the brainstorming Ideas, put them together
and we will bring this committee back on the second Tuesday
In December and work on strategies. These strategies will be
for a half of a day. We are getting these people for a day and a
half of very Intensive brainstorming. We will then take the
Information that they provide and the members of the Senior
Center Commission and other persons In the Senior Center and
then will propose a new mission statement and strategies for
completing them. We will be back to you, as you well know,
later on to present the findings to you. But we think this is a
very very conscientious and reasonable way to go about
handling the senior citizens of fowa City and Johnson County.
fowa City will always be a community for the youth. We have

the University here, we have a young community. And I think
that is what attracts retired persons to this community. And
retired persons are looking at Iowa City as a very very
favorable place to retire and I think that is a consideration
when we look at the Senior Center as being one of the
outstanding ones in the United States. Thank you.
KUbby! Later on in a minute the mayor is going to read all of the
openings but there are two Senior Center Commission openings
and the two people whose terms are up cannot run again
because the by-laws say only two terms in a row. So anyone
hearing Harold's description of this next phase of the Senior
Center who is interested should apply for the Senior Center

faces in the audience tonight. I am told we have a poli sci class

Theresa Mclaughlin! I am here tonight to thank you and also to
introduce myself as the director of the Johnson County United
Way. I am oniy six weeks on the job and I have a lot left to
learn. I did want to let you know I have become very famlllar
with some of the funding basis of the agencies in which we are
involved which there are 40 agencies supporting 240
programs. I have come to realize how much Iowa City proVides
these agencies as well as your own participation in the UW
Campaign and the fact that Iowa City employees in the
Campaign rank #9 when you compare the number of
employees in this area. So I do want to thank you for those
significant contributions and let you know we have kicked off
the Campaign and so far towards our $950,000 goal tonight we
reported at our board meeting that we are up to $130,000.
This time last year we were up to $117,000 so we are off to a
real good start. As part of my orientation to UW I pretty much
stepped into the frying pan in that I started and four days later
the Campaign started. So it has been a little bit hectic but one
of the priorities that I have made is visiting the agencies and
becoming familiar with the directors and their programs and

services that they offer. They have been quite overwhelming
and quite compeIllng. I think you can see all of the needs. But
one thing that keeps coming out Is how effective the human
services agencies are In Iowa City. I belleve that Is one of the
things that we hope to promote In the future and that when
people start selling Iowa City one of the things they can say Is
the quality of llfe her Is so good because of the human service
agencies that we have In Iowa City. As far as my own goals
with OW I was hired with many Ideas In mind Including
starting some planned gift areas and endowments for UW.
Currently we spend all of our money In operations and I think
there Is a lot to be done there and there are some things In fine
tuning our campaign. For Instance we are going to start
acknowledgments for the first time this year. We have never
thanked people for their Individual gifts and I think that Is an
Important component that we start up. In a couple of years It
wllI probably become much more organized but we are trying
this year to get that going. Currently my biggest charge Is
when I was hired the campaign has just been around $940,000,
This year It Is $950,000. They want to bring that closer to $2
mllIlon next three to five years. I really do think that we can
do that. I think that Is something that Is out there and the
money Is there and I just think we need to ask for It a little
more clearly and articulate out needs a little better. As far as
my own experience I have moved back to Iowa City after
taking a short hiatus and I came back In 1986 as a fund raiser
for Regina Catholic School system. I was out there for about
three and a half years and during that time we went from
$20,000 to about $450,000 In an event called the Gala, an
annual fund raising and an endowment giving. I was lured to
the U. of I. and there I worked as a fund raiser for Hancher
Auditorium and the Museum of Art. The budgets between
Hancher and UWare quite different but I really do Ilke the
mission of OW. In the three and half years I was there we
went-we raised about two and half mllllon dollars In several
campaigns and I say that someone modesty because I see my
roll as kind of setting the table for the people who are the
contributors, who are the campaigns chairs and who are the
people who are Involved In those fine organizations and I hope
that I can do the same for UW. From what I can tell with the
support I have seen and commitment, we should be able to be

there hopefully before that five years Is up. I say that because
I see Johnson County, Iowa City and Coralville all contributing
to some of these agencies but I know that budgets are tight and
tax dollars aren't ovelWhelmlngly going to continue to come in
at the rate that everybody says the needs are there. I do see
UW perhaps picking up some of those areas and I do hope that
we can fill those. I welcome any suggestions and comments
you have In helping me and UW's board and all of it's
committees become more organized and I encourage you to
attend our planning and allocations meetings as well as taking
some of these tours that have been very helpful for myself.
We are going to be setting another schedule of tours this month
and next month and If you would like you can give me a call.
They are Just setting up the tour schedule now so you can plug
Into them quite easily. If you have any questions, again, lease

Courtney/ City Council Appointments. Earlier council nominated Jane
Jacobsen, 1204 E. Washington Street.

Kubby/ I had asked the council at informal session if they would be
Interested in postponing this appointment, not because of the
applicant but because the person who we are appointing will
be making recommendations to the new council and thought It
would be an act of courtesy. Although I understand it would
be two and half months and a lot of Issues without a fuil
commission. So I understand the reasoning and will be voting
for the applicant. It will also help with gender balance on P/Z
and the applicant worked a lot in '85 with the ad hoc
committee on environmental concerns that Naomi was apart of.
So I think she has some sensitivity to some of those issues that
we are dealing more and more frequently with development
and trade off between allowing growth and protecting
environmentally sensitive areas and it is going to be very
challenging next five to tens years and we will need someone
with this person's qualifications. Even with my hesitancy with
the timing of the appointment I will be voting for Jane.

Kubby/ She is very well qualified. We welcome her participation. It
was just kind of a principle I wanted to bring up.
Courtney/ I am not sure I agree with the prinCiple you are trying to
bring across here. With have had an extreme problem with
attendance at P/Z meetings. If you watch as I read these
things we are 4-0, 5-0 and one of the ones that tended to be
there was Casey. I hate to take this down to a problem where
they don't have quorums. We need to put someone on there
now.

Courtney! City Council Information.
Kubby!1 wanted to continue a discussion we had earlier about a
letter we got from someone who was distressed about bicycles
being In Hickory Hlll Park and there are signs. For people's
Information you are not suppose to ride your bikes on the trails
or In the park at all In Hickory Hill Park. even though it Is fun,
it Is a walking trail and not a biking recreation trail. And one
of the things I was thinking of Is If there are peak times when
this is a problem that maybe we could pin point the time that
the bike patrol Is In that neighborhood to be around weekends
or If there are certain times of the day that it Is more filled
with people on bikes.
Courtney! The bike patrol does patrol the park.
Kubby/ I don't know If there are targeted times or random times. I
don't know that. So If there Isn't targeted times maybe we
could figure out what the best target times would be., Can the
bike patrol give tickets or do they just give warning tickets.
They are not sworn officer, right.
Courtney! Warnings.
Kubby!lt would be Interesting to find a way to have more umph to
what they do. I think they do a good job. I have seen them
stop people on the pedestrian mall and talk with them. They
seem to have a good manner as well as bike skills. We have
some biking officers already. I wouldn't mind people getting
some tickets actually for some of these because It Is also
tearing the trails up down there. And I think the point about
maybe needing a place for bikers to bike around the area Is a
good one. It Is a fun thing. It Is a sport people are Interested
In.

Kubby/ They are trying to keep this a natural area and the more
bikes In there tearing up the trails the more disturbance there
Is to the park.

people who go down that hill with the water detention area.
The other thing I wanted to just mention to people this letter
we got from somebody who wrote to the Airport Commission
suggesting that we don't try to sell the 48 acres at this time.
And that to find a more practical way to keep the present
airport functioning for many more years. I just wanted-l have
a few questions about-because I just found out through the
paper when the Airport Commission was discussing this and
have they made any decisions about what they are going to do.
Atkins!l understand their next meeting I think is the 14th.
Courtney! October 14 they intend to take a vote of some kind.

Atkins! And the story in the Press was the resuit of comments from
a commission meeting and then I was called by a reporter and
asked some general questions and I discussed it with her.
Nov! One of the members of the Airport Commission told me that
this particular option made the newspaper and they had
discussed other options which did not make the newspaper.
Kubby! I wouldn't mind then getting a little low down on all of those
additional options besides what the consultant gave the Airport
Commission.

nice to have those soon.
Lastly I assume Darrel you are going to give us a report about
your trip. Which you-I was in Des Moines and someone from
Iowa City came up and asked me what is going to happen to
the money raised from Operation Payback. I didn't have any
idea and then read in the paper that you are going to be part of
a committee. If you would, during your report, maybe talk
about that committee and who is on it and how you are going
to make those decisions if you would later on.

discussed last week when Larry Quigley came before councH
and asked us what we could do regarding ADA and I wondered
whether or not we could schedule a time to talk about perhaps
some sort of monetary incentive programs for busInesses
downtown to comply by putting ramps Inside their businesses

so that they become accessible for the disabled in the
community. And, for instance, I know that some CDBG money
has been used in the past-has gone to landlords to fix up their
apartments that they rent out to tenants so that the intent is
that the place Is habitable for tenants and perhaps something
like this could be thought up or staff could be encouraged to
put forth some sort of program that encourages businesses to
comply with ADA by giving them some sort of small incentive
monetarily to put in these ramps if they do. I know there are
all sorts of pros and cons but I just wanted to put it out as
perhaps one way to be pro active on this ADA issue instead of
waiting for the feds.
Horowl That is an interesting point. We don't even know whether
there are federal guidelines that preclude businesses getting
CDBG money. I don't know that, do you.
Kubbyl In terms of block grant moneys their clientele would have to
be-their customers would have to be at least 50-more than
50% low-mod income. But we do have the residential
accesslblllty program. Maybe interested-if the owners were of
lower income that the owners, because of that criteria, they
could get In on some of these. The other options besides block
grant money. Some other kind of federal program or grant.
PIgott/ It doesn't have to be restricted. I was just thinking that
maybe we could provide an incentive instead of a regulatory-
Horow/ We certainly have to deal with other federal legislation of a
more urgent nature for health and safety reason and it seems
to me that this is definitely a safety Issue for someone who Is-
Plgottl And It Is urgent for those who are disabled. For those who
can't get Into restaurants or places of businesses.
Horow/ I really would like to get the d.t. or the Chamber of
Commerce Involved In this somehow.
Nov. I would have to think about all the other businesses who had
already put In their own money to make their business
accessibly for the handicapped and now their competitors
would be given government funding. I just don't see this as

thoughts about how we can act.

Nov/ I have to tell everybody the reason I am wearing black and
gold. For those of you who know me know that black and gold
Is not my favorite color scheme but I went to the presentation
yesterday of the Homecoming Queen and King and I was very
Impressed. The Homecoming Committee worked hard on their
selection criteria. They had an excellent group of candidates.
They were judged very carefully by a panel of judges. This
was not a popularity contest and the winners were Deborh Hole
as queen and Scot Dumpsmer as king. And I think that these
are worthwhile people. We should commend them. Also the
parade Is this Friday, October 15 and everybody should see the
Homecoming Parade. It Is always worth seeing. And
yesterday, after that, some of us went to the Senior Center
Dinner to acknowledge their volunteers and we found that the
Pan Hellenic Association had sent us the waiters and waitresses
and there was another group of talented young people devoting
themselves to the community. And last week I brought up the
question of someone who was getting a parking ticket within
two minutes of ten o'clock and It was clarlfled that there Is a
five minute leeway, so I have to say this out loud today.
Somebody Is not suppose to get a ticket at 9:55 or after and I
thought that was quite fair. There Is also a five minute leeway
allowed on exiting the ramp If you have to walt In line to get
out. Thank you.
Horow/ I would like to follow up on Naomi's comment about the
Senior Center Volunteer Dinner. It was and It always Is a joy to
go to these dinners. You see the number of people who
actually volunteer and participate at the Senior Center and to
listen tot he staff In terms of their analysis of volunteerlsm and

the joy they get out of giving. Usually they are very very
thought provoking speeches. This time though it was
Interesting because the director of the Senior Center thanked
various members of city government for their creative ways of
helping to support the Senior Center. Everyone form someone
In our acquisition department, the Director of Finance, Bob
Hardy on Cable Television to our city manager and I really
appreciated that because I think so often the normal citizen of
Iowa City does not see the whole tapestry. They really do not
get to see all the threads that are Inner woven and create this
city of Iowa City and volunteerlsm In whatever form Is
definitely a part of that tapestry. It was an excellent dinner.
Going from the dinner, however, I would llke to remind people
that on October 20 there Is the Human Rights Commission
Breakfast at the IMU. If any of you are Interested In attending
that and seeing the progress that Iowa City has made In terms
of human rights, the award that will be made to someone who
has been an outstanding person In that area, get In touch with
Allee Harris here at the Civic Center.
Then on October 24 and I am sure that John has really been
working hard In getting ready for this Is the Hospice Road Race.
Now John gets ready for this by pressing the finger because he
has In previous years has helped set off the gun. But I am
assuming that you are going to do It this year. Those of you,
get your bods out there and start working on walking-running.
Get ready for the Hospice Road Race on the 24th on Sunday.

weekend justice but I know that I really can't convey to you
the enthusiasm and the sincerity of the group of people that
are heading up this effort out there that they are callIng
Operation Payback. For anyone who hasn't updated themselves
on this. In 1906 there was an earthq uake In California. San
Francisco got the majority of the publicity but Santa Rosa was a
community hat was completely leveled and I saw some
pictures of it while I was there and it was not a building left In
the town standing. The midwest came to their rescue by some
extent by sending 30,000

money depending on what sort of Interest rates you want to
use on so on. But it was a lot of money. And so there was a
group of people who just kind of popped Into their heads really
that they ought to try to do something for the mldwest. There
are some other cities out there who have adopted other
mldwestern cities but Santa Rosa chose to adopt Iowa City and
Johnson County as a whole. It Is not all just Iowa City as a
community that they would like to help out In anyway that
they can. The-I actually I think council a little bit astray on
this because I was under the impression that they had been
working a little longer than they had and that this last
weekend was really going to be the culmination of their efforts.
It was really more of a kick off than it was a culmination
because they have been planning for this particular weekend
for most of the time. They only started Into this effort on
about August 8 or 9 and It was a very short time ago. The
Intention Is to continue on through the winter months and Into
the spring. So far the total number of dollars that are raised
are a little bit hard to pin point. We know that there Is at least
$14,500-600 but they have other things that really haven't
been counted yet because there are milk cartons sitting allover
the city beside cash registers where people can drop money in.
And they haven't even collected those yet. They have some
other projects that are really just getting started. They
presented a few Ideas to me while I was there. So I really
don't know what to expect totally. The collection this weekend
resulted In about $5,000. There was a silent auction and a live
auction and what you have to call a very large garage sale.

People were Invited to come In and bring all of their items to a
table that was provided free and they could donate whatever
percentage of their sales that they wanted to for the Operation
Payback cause. I saw most of the signs on the tables that said
100% was what what they had picked. I few of them were
80/20 and that sort of thing. Most of them were 100% the
items that they brought in. Friday we spent on really what I
like to call a dog and pony show. We toured the community.
We being Mayor Maurine Casey and myself and she picked me
up at 7:15 after a long day of traveling and we started through
the radio stations in town. The sounds awfully easy here but
Santa Rosa has a lot of radio stations. The first one that we hit
at 7:15 we got upstaged and this Is a story I have to tell. We
pulled in and somebody got their wires crossed and Kenney
Loggins was there at the same time. I found out I wasn't quite
as Important as Kenney loggins was in Santa Rosa. Instead of a
live Interview they did put us on a newscast and replayed It all
day so it actually worked out pretty well. I like to tell the
story because as we pulled In the station owner had picked up
Kenney and brought him and he parked in a handicap spot and
Mayor Casey has a real thing about handicap spots and as he
got out of the car she says two things-#1 I am the mayor of
this town and #2 you are in a handicap spot and that is a $275
fine. We thought we were being hard when we hit $50. In
Santa Rosa, folks, it is a $275 fine and she says that they write
several every week and it all goes to the city. So anytime you
want to think about raising it there is a precedent out there. So
we proceeded on and we had a t.v. crew following us part of
the time. I understand that tape made it back to Channel 7
news last night in Waterloo and I was glad to see that. We
visited three different schools. Neuman High School which Is
the equivalent of Regina here. It is a catholic parochial school.
That one we talked to a government class there that wasn't
quite as elaborate as the other Mr. Hibb's class here. I gave
them suggestions on how he could shame politicians Into
coming Into class like Dale Hlbb's does and he couldn't believe
that. So he is going to be calling Mr. Hlbb's to get suggestions
on that. We then went to Lincoln Elementary School which Is a
publIc school In a low to moderate income neighborhood. They
have a video tape that t.v. 50 put on that Is just an absolute
first class job. They put together news clippings form several

t.v. stations here that they compiled and some that I took when
Mayor Casey was here on her tour of the city and some footage
of the Santa Rosa earthquake and I have a copy of that tape
and I couidn't bring all the stuff back. It is being all shipped
back. And that t.v. station donated all of their time to put that
together and certainly appreciate that. They are using that in
all of their fund raising out there. They went to Lincoln
Elementary Schooi with us. These klds-J am sorry the t.v. crew
didn't go there. The tape we played for the full elementary
school and those kids had some great questions. And some of
them showed up the next day at the auction and brought some
toys and so on to put on the table to auction off. It was in
particular, one little guy I wish I could remember his name.
You w11l see this tape before it is over but he brought up a
whole sack of toys that he didn't sell and said to take them
back and give them to someone that needed them. It is all age
groups that are participating in this thing. The other school
that we went school is probably the one that touched me the
most because it is a Sierra Youth Center and it is a medium
security youth center for youth that-I don't know how else to
say it. They have had a little bit of history of some legal
problems and they are on their way back. They progress
through this center. Some of them get to the point where they
get to go home on weekends. Others don't. And eventually
they are able to leave the center. And the banner that J have
behind me is a banner that was drawn by these young people
at the youth center. And I don't know how well the cameras
can pick it up but the wording across the bottom says "sun,
keep on shining." And they have some raIn clouds but the
emphasis is on the sun and if anyone can pick up on the
camera the drawing on the far right shows an extreme amount
of talent from the artists that did that particular one. I had a
chance to talk to that young man and he is going to work his
way back through and put his talents to use when he gets out.
This particular center, I didn't get a age grouping but it
appeared to be somewhere In the 114-16 or 17 year olds.
There are other youth centers there that are a little maximum
security and so on but they made progress through the Sierra
Youth Center. And I would just encourage those kids who are
going to see this also to keep working and get out of there and
get your life back together. You are a great group. On

Saturday we did the live auction and the silent auction and the
garage sale. Then we had something pretty unique, one of
radio stations in particular. The D.J.s name was Steve Jackson
and he does a live radio show from a restaurant/bar on
Saturday nights and they have the t.v. cameras there that show
it ail over the bar. It Is almost like a sports bar except this Is
an old nostalgic one. The 50's and 60's. The greatest '53
Cadillac Convertible sitting Inside the bar that you have ever
seen in your life. And they broadcast the t.v. show. I haven't
taken this much time on council time for eight years. I m
leaving and I am going to do It. They broadcast this at the
same time. They have a live slmul-cast over the radio and the
two mayors were the featured guest over that and we went
from nine to twelve hyping this cause over that radio station.
Absolutely thousands of dollars worth of free publicity on It.
We had two particular thing that took place. They were selling
roasting ears for $1 an ear. And each one of those dollars were
donated to the Operation Payback. We left without knowing
how many ears of corn they sold. They had a contest between
Mayor Casey and myself. She was shucking ears of corn and I
had to take the foil off of the top of wine bottles. That Is wine
country out there for those of you. Sonoma County Is next to
Napa Valley and It Is all wine country. She won 9-6. That foil
Is hard to get off. The other one-
Kubby/ You have got to drink more wine, Darrel.
Courtney/ I am usually not opening It myself. The other one which
Is of note Is a actual big check that I got but It Is In a form of a
real check from the Santa Rosa fire fighters, Local 1401, and
they have so far raised $500. That Is put Into the fund.
Kubby / Darrel, was my theory true that things that sald Iowa City
went for an okay amount of money.
Courtney/ Yeah shopping bags went for $5 and I understand we sell
them for $4 out here so we came out ahead on that. And I don't
know what the final price on your Item that was there. I know
what it was when I left. It was up to $20 when I left and I had
bid on another set of ear rings that I had $20 and got outbid
seriously. I can buy yours anytime. This was someone out
there. There was a lot of silent auction Items and some very
expensive ones and some falr amount of art work and so that Is
how the weekend went. We finished up Monday morning with
sort of a little planning session. Mayor Casey who will by them

be councll woman Casey because her term as mayor ends at the
end of the year will be back the first week In April. They have
a very special gift to present to the city which I am going to
keep secret untlllt gets here. And It Is not an Item really
designed for the Operation Payback but something to enhance
our relationship a little bit. I see this as a long term
relationship between California and Iowa and I hope that
councils In the future continue. I have letters form the kids at
Lincoln Elementary, the 4th grade class, that I am going to pass
along to a couple of 4th grade classes In Iowa City to establish a
pen pall relationships. I have some other-

Courtney/ Maybe. I have some other thoughts about some penpallng
relationships with the kids at Sierra. They are very anxious
for that so we have kind of set up a couple of things on that. So
far the planning committee, there are seven people that are
really Involved In this whole effort out there. They are doing
virtually all of the planning, the leg work on It. They have
actually a separate office set up that they are renting to work
out of. They have so far only designated a couple of thousand
dollars that they had a specific request form the Mennonite
Relief Society the spent a lot of town In cleaning up. They sent
out a specific requests for a family that needed to get their
foundation done In a hurry so they could bit the winter on
rebuilding the house and they have voted to sent about $2000
back for that particular effort. When It gets past that I would
have to say that the percentages that they are talking about
are still under discussion. They are seven people and as you
know seven people can have a lot of different Ideas about
where they want to go. I can tell you that the Salvation Army
Is being mentioned quite frequently and I suspect that they
will get their share of It. The American Red Cross-those were
the two that had the most visible presence when the visitors
from Santa Rosa were here and so the American Red Cross will
be Included In there and then I think they are still looking for
specific projects, specific people to help that aren't going to be
able to get help otherwise. I put In a very serious plug for
another Item I am going to talk about here In a second. Our
city park restoration fund and our little League ball diamonds.
I wouldn't go out there without bringing that up and that will
be taken under consideration also.

deciding how to pin point It and send it.
Courtney/ I think that you are going to see that the seven people on
that committee are primarily going to make the decisions. I am
not sure that-the item In the paper may have been a tad
misleading. I am not actually on the committee. They are
looking to me for suggestions and they are-
Kubby/ So the committee or Santa Rosalans-
Courtney/ Currently those are the people that are Involved with the
heavy emphasis placed upon any suggestions that I would give
them through the council and so I really can't give you a total
breakdown of It. I think that some of that will come depending
on how much they raise In total but right now they are
Interested In some specific projects if anyone has specltlc
people In mind that are-that there Is an urgency for. They
would like to hear about that.

Kubby/ Was there a discussion about people who wouldn't fail under
the guidelines that we have for using the federal block grant
moneys like Bacillus and Thatcher Trailer Courts.
Courtney/ The Bacillus and Thatcher Trailer Courts is really one of
their pet projects on this. They had two local people I should
mention, Bob Crawford and Steve KolI, two local real estate
agents who accompanied me along with my wife out there and
they really did some nice work on some peace making efforts
to those trailer courts down there and have them to make a
come back and to do some work. They have some other
suggestions they would like to go with. I did take our
resolution along and the first CDBG moneys, the $175,000, and
they were certainly glad to see that. They have a crew of 20
young people that would have raised enough money to actually
get on the train and come out there and do a project from one
of the churches and so they are looking for a project for them
to come and donate some labor to.
Kubby/ It might be good. The Board of Supervisors have been doing
a lot of clean up and contact with people In the unincorporated
areas of the county to see If they might have suggestions.
Horow/ In the Senior's Involvement, the newspaper, there was a
IIttie advertisement by Heritage Agency also that If anyone

needed specific items such as washers, dryers, stoves or
whatever to let Heritage Agency know that. I thought they
really plug Into this. At least for Johnson County.
Courtneyl Along with the Red Cross and the Salvation Army they
were very Impressed with the efforts that were being put out
by the Mennonite Relief people. They have put out a huge
amount and so when they called it was met with a lot of
success.
Okay. A couple of other just little tidbits about Santa Rosa
getting off the fund raising efforts. The $275 handicap ticket I
thought was great. They also have their own ice skating rink.
We have a letter from someone, I don't think it is in the packet
yet, asking about an ice skating rink.
Horowl It wasn't me but I could have.
Courtneyl it just so happens that they have an Individual that lives
out there who is a great hockey fan. His name is Charles
Schultz who writes Peanuts. That is why you see Snoopy and
the little bird. Charles Schultz lives in Santa Rosa and he build
an ice skating indoor arena for them and he maintains it for
them and it is going to be donated to them at the end of the
year. We need somebody like that to build us an ice skating
rink. We do have a cartoonist living in town but he hasn't
quite got to the level of Charles Schultz yet. They are also
building a skate board park which is another item that has
been discussed many times here and I-in the box that is being
shipped back here is an RFP that they put out for a skate board
park. You are welcome to look that over too. Okay, enough on
Santa Rosa.
We had a meeting last week on the parks fund raising
committee, for what it is being called now. We have set an
initial goal for the fund raising effort for City Park restoration
at $150,000. The P/R Commission and Foundation are both
meeting tomorrow night to discuss this and decide whether
they want to proceed and take some votes on it. If so we are
going to meet again next week, Tuesday, October 19. If anyone
has any suggestions or would like to sit in on the meeting. You
are certainly welcome. There are four or five entities that are
involved in the community so far. I would like to point out
that the Iowa Sports Program was highlighted tonight on ABC
News, the Women's Program. ABC News did a whole issue on
the equity issue in women's sports and really took a stiff jab at

Auburn who got sued by some of their women athletes and lost
big time and they picked Iowa as the prime example In the
whole country as having come the farthest to meet that and
will come to full equity before any university In the country. I
thought It was a great piece that they did. Hunter Rawlings
was featured and Christine Grant and wish them all the luck to
finish that up quickly. It meets a lot of the goals that we are
trying to do all over town. I think that Is It.

Atkins/ I have two items for you. I wlll hold the good news for a
moment. I want to report to you briefly just some general
concerns we have. Obviously we all know the water has
receded. With the water going down and I don't want to call
them complaints but the publlc complaints about the
maintenance activity are beginning to Increase. We have not
flnlshed and we wUl not finish the street damage that occurred
from last winter. There Is just simply no way to get it done.
Secondly, we are stUl working toward resolving the many fiood
related maintenance and damage that occurred. You need to
know as well as the public needs to know that we are
somewhat at the same mercy as they are and that Is trying to
secure contractors to do some work of some consequence. And
then the third point Is that we have many Ideas for new
construction on how to protect properties In the future. We
wlll be deallng with those. Hopefully we wlll be meeting with a
number of businesses on South Gilbert before too long. But
those are going to have to be just a little further down on the
Ilst. The bottom line problem Is we don't have enough time or
people or money to get everything done and there are certain
things that have to be done In preparing ourselves for winter.
We wlll do our best to correct particularly the major Issues like
sewer collapses. But it does require contracted work. Right
now many of our crews are sort of up to their elbows In leaves
and that Is an expectation level on the part of the publlc that
we have to satisfy for the next couple of months. I simply ask
you and I ask the public please be patient with us. If FEMA
money comes through come next spring we wlll be able to get
ourselves back In some normal routine of maintenance and
have the city looking spiffy again. But bottom line problem Is
going to be the next month or so and it just takes time to get ail
of this work done and I beg your Indulgence In that of the
publlc.
Kubby/ We are doing three sweeps of the city for the leaf vacuum
program. What would happen If we went down to two a kind
of a trade off for these repairs from last winter that wlll get
exponentially worse two winters In the row without the repair
and maybe it Is Inconvenient but that would be the trade off
for getting a little more work done.

Atkins/ That Is a thought. The only concern that I would have Is the
asphalt plant will close sometime In early November anyway.
Just about the time we would be doing the third sweep and we
wouldn't have the materials available to us to do a lot of the
work that we would like to get done.
Kubby/ Do normal sweep one and three Instead of two.
Atkins/ We can do that. I suspect you are going to see It go off the
chart with respect to complaints.
Kubby/ We can't do everything so we need to make some priorities
and try to balance everyone's needs.
Nov/ The discussion Is too late. We should have eliminated the first
one that came along yesterday and there was really nothing off
the trees yet.
Atkins/ We were getting calls. They start calling right away.
Nov / If you are going to do -
Courtney/ People have an expectation when they get them out to the
curb at the time when they are suppose to be there. They
don't want them blowing back Into the yard.
Atkins/ That Is an Important part of the time we have tied up on our
streets crews. The biggest problem Is getting the contractors
that our folks are simply not equipped to do the major sewer
repairs which we normally contract out for construction as well
as the maintenance activities.
Horow/ [remember asking the question and [think the answer
needs to be repeated. The question was Is there no way that
we can elicit contractors from metropolitan areas, Minneapolis
or Chicago. The answer at the time I think Rick told us that by
the time they got here- [ still keep wondering If there Isn't
some way that this couldn't be worked out.
Atklns/ [ suspect there could be but [ think you will have to be
prepared to get scalded on the prices too.
Kubby / [ know some of the utlllty companies have done that.
['Iorow/ The utlllty people use the tree trimmers and they bring
them In from all around.
Atkins/ Our problem appears to be more on the sewer related
collapses that we have and that there Is really only one
contractor of any size that can afford to buy all of the
equipment that Is now necessary to get Into the sewer
construction business and that just simply makes it difficult.

throughout the area. They have generally been pretty good to
us.
Horow! It isn't necessarily that our crews could be taken off of what
they are doing and put into this construction.
Atkins! My concern about the leaves circumstances Is that there Is so
much street work that didn't get finished. They can do a lot of
that type of work. And what we are going to do Is just
postpone it until spring time. We really don't have much
choice In the matter.
Nov! I am afraid we are going to have another flood in the spring
and postpone It again.
Atkins! We don't want to talk about that. That Is an element that we
have buIlt Into our thinking that there is a very real possibIlIty
that that could occur and If we have another tough winter lIke
we had last year. We didn't get a lot of snow. It Is the darn
freezing rain that tears the streets up. Snow acts, quite
frankiy, as a blanket and Insulator. I am not suggesting we
want tons and tons of snow either. It Is easier to push that
around! I just wanted to alert you because I suspect you may
be gearing about It.,
Courtney! Now the good news.
Atkins! The good news. We received notification from HUD that we
wlll receive a grant of a lIttle over $3 mIllion for the
construction of 13 new affordable housing units, scattered site
housing. And another 20 units of housing to replace the stock
that was sold In the program that we Initially approved a
couple of weeks ago. In addition to that we are going to
receive another 50 certificates and vouchers which wIll bring
us to almost 800 famIlIes now that we wlll be assisting and wlll
bring our total publIc housing stock up to about 95 units. The
vouchers and certificates are five year contracts Is how we
measured them and have a value of about $1.3 mIllion. That
plus $3 mIllion In new construction money, we did pretty good.
We got more than Des Moines. We put a dent In that Issue.

northern California. I am a graduate of Berkeiey- University of
California at Berkeiey. But I couldn't talk you into needing

Horow! This particular resolution I feel should have happened a long
time ago. Just this councll did we finally use the word parking
and transit In the same sentence. And that to me Is a quantum
leap forward In planning and looking at the variables that go
Into moving the city around. And so, because the councll has
taken that step it seems to me the next natural step Is to
create-not creating new departments. It Is a new department
but It Is essentially merging two existing departments and
when you do merge them the position that Is created as
director supplants the two previous directors from the old
departments If you are following me. There wlll be a merging
of some of the tasks. We will be certainly helping In terms of
planning because someone has to overlook those two Issues and
be aware of all of the other issues that go Into those. I applaud
this whole resolution. I think it Is about time.

when you do have two departments moving it kind of stirs up

positions. I don't want to burden the new director to not to be
able to make recommendations In the future. But that Is the
Intent not to Increase the total compliment of employees.

Kubby/ Although It Is Interesting because last time we talked about
this when I had raised thIs question we had some concerns
about moving one of our people who Is now the head person In
their own section to this position because the transit person
will have bias In one direction and the parking person bias In
their own. But now you are thinking about It differently.
Atklns/ I think that I can count on the two IndivIduals that are going
to compete for the position. I think they are both are
imminently qualified. They both have graduate levels of
degrees. They both have sufficient depth of experIence that
they recognize what we are trying to accomplish in doing this
and I think they can offer the leadership. I would be less than
candid with you. We could go through the interview and they
could bomb miserably and we have to move on to something
else. But I have to come back to you and talk to you about
that.
Nov/ It sounds fair to offer the currently employees first chance.
Atklns/ I have confidence in both of them and I think It will be a
very difficult choice to make. But I think having that
involvement and that experience in the two candidates is a
plus for us. Again, I would like to say that If It didn't work we
have that option available to them. My Inclination is we have a
total compliment of personnel that is what we are going to try

Kubby/ For me this is Important because for years there has been
this two ways of thinking of council that transit and parking
policies don't have anything to do with each other. One does
not affect the other and some of us were thinking that It does.

McDI I do think that this is a move in the right direction and I can
see a lot of benefit in this. I have to take exception to a couple
of comments my colleagues have made. This is not the first
time this has been taiked about. And there have been other
councils that have talked in terms of or talked about the
transportation system which we all know consists of basically
cars and out bus system as being alike in many ways. Because
of the fact that it Is a transportation system that we need to
continually address. But at the same time I think that we do
have to remember that they are both different and maybe-I
mean one is subsidized and the other is not. The other is paid
for by the users. So I d think though-I mean it makes sense to
view it as a transportation system and to maybe bring
everything under one umbrella and the possibility of maybe
becoming more efficient and managing it a little better. But
they are different I think and I think at times the council, as
different issues are laid on the table, wiIl have to viewed that
way also. But it is not the first time guys.

those people that have been talking about combining these

this crew. I would just repeat my warning from last time if
you have any illusions about raiding too much of the money
out of the parking system be very careful. The bond covenants
that you have there we have already got in trouble once and

carton Just opens up those options. We haven't really talked
about how we would really go about with curbside collection of

prices. If the market prices Is high enough then we don't have

Kubby/ Last year or the 1st contract It was $25 a ton, wasn't It
Instead of $30. Was It $30.

John Ockenfels/ There Is a little bit of confusion on that. What we
are operating on Is a spread on a market sheet. So there Is an
actual published price every month that we get for paper and
what we have done Is tie our contract to that number. For the
number that we get for the drop off bins Is $30 a ton less than
the high point of the selling market price and we take the high
side. They have a high and the low and we use the high side
for the benefit of the city. The curbside collection material,
that comes In substantially cleaner and because that Is cleaner
we don't have to put as much processing Into It. We give you a
$10 per ton break on that and only use a $20 margin. So that
the rate that we payor that you pay Is based on those markets
and It varies up and down throughout the year. For the last
three years this contract has been severely down.
Kubby/ If we should go to a staffed drop off site we might want to re
negotiate this because I would assume that the products taken
to that staffed drop off site would be

Kubby/ On page 2, under city's responslblllty It talks about

there were some really neat signs that had good graphics that
had easy explanations. I will get those pictures to you. I know
that has been a problem of vandalism and keeping the
Instructions there. When I was talking about the 011 thing
before that I know when I have gone to the bins at Econofoods

they are real junky because they get used so much which Is a
good thing. But If we can do continued good maintenance on
them and emptying them frequently enough then people will
take more Initiative to keep them neat. If they see stuff all
around and then they just-I have seen people just be really
messy. So I hope we will continue to take those responsibilities
seriously.

Horow/ #17, page 3, City Responsibilities. It says the city will not
sort the deposited recycling materials either for the city's
convenience or the convenience of the contractor. Maybe I
misunderstood this because my question Is why are we not just
co-mingling and why bother with the separated source at the
curbsIde.
Schmadeke/ We have to separate In order to get these prices that are
In the agreement. If we co-mingle then City Carton would
have to separate and the price would go up.
Kubby/ You mean if we had mixed paper that we wouldn't separate
the paper out. This Isn't about taking-
Schmadeke/ This about taking white paper out of newsprint for our
benefit rather than the benefit for City Carton. That we would
not do.
Horow/ You are talking about paper. When I looked at this I
automatically thought gee I can co-mingle my tin, plastic, and
glass.

Kubby/ I need some explanation because when I read through this It
sounds like we are tightening things up. The language Is more
concise which makes It also more clear. And there are more
responslbJlJtles on the people doing pre-treatment. It Is
actually a stronger ordinance.
Gentry/ yes. We are doing Is as requested by the DNR.
Kubby/ There Is a couple places where It did say shall and not It says
may and it Is In terms of If someone Is convicted of
environmental Infractions. I want them to pay the $1,000.
Gentry/ No. We had qUite a debate, the DNR person and I, over that.
And it Is very clear that the DNR and the EPA require that
when a permit holder violates their permit or If they violate
the Indirect discharge ordinance we have to malntaln some
flexibility In terms of the severity of the violation and to say
shall means that that takes away all discretion from us to deal
with severity, repeated acts, good faith, bad faith, ete.
Kubby/ So we might be able to fine someone $100 If It were a small
thing that was an honest mistake that didn't have great
consequences. I mean If someone Is convlcted of an
environmental Infraction can we fine them less than $1000. I
thought environmental Infraction meant $1000 per blank.
Gentry/ It does but the option Is stili to use municipal Infraction
which are not $1000.
Schmadeke/ The state, too, looked at that as a maximum amount that
we would charge.
gentry/ Which Is by law anyway.
Kubby/ But It says In here upon conviction of an environmental
Infraction. So If they are convicted under environmental
Infraction do we have any choice.
Gentry/ We prosecute. It goes through the legal procedures In
magistrate court. In other words you would not assess a fine.
Dave Alias, Chuck SChmadeke, or Steve Atkins would not assess
an administrative fine. You would site them with a violation
and It would go through court and then upon finding of a
conviction then they would owe up to $1000 for each
environmental offense and If you prosecute It as a straight
municipal Infraction $100 for the first offense, $200 for the
second offense. We stili have three options of penalty: simple
misdemeanor, environmental Infraction, and municipal
Infraction.

Kubby/ Okay. So I am hearing a couple different things. I am
hearing at the beginning of the conservation you said that if
someone is convicted of environmental infraction it is $1000
but then you said up to $1000. So it is up to $1000.
Gentry/ It Js no more than $1000 by law.
Kubby/ And once you are convicted of environmental infraction do
we have a choice of saying there is no fine associated or there
Is a discretion as to how much.
Gentry/ There is discretion. The judge wouid not have to impose the
$1000 and that is what I think the DNR was after is some form
of discretion. And we would not impose it anyway. It would
be the judge.
