The applicants, Michael and Vicki Lensing, have requested the amendment of their rezoning
application for 617 Kirkwood Avenue. As discussed In the July 15, 1993, staff report, the
applicants had originally requested that 617 Kirkwood Avenue be rezoned from RS,5, Low
Density Single,Famlly Residential, to CC.2, Community Commercial, to allow expansion of an
existing funeral home business onto the property. The applicants are now requesting that the
rezoning request be expanded to Include the existing funeral home located at 605 Kirkwood
Avenue, and that the request be amended to rezone the two properties to CO,1, Commercial
Office. The property at 605 Kirkwood Avenue Is currently zoned CC.2.
Staff views the requested CO.1 zoning as being more appropriate for617 Kirkwood Avenue than
the previously proposed CC,2 zoning. However, the amended proposal continues to raise
concerns thai the establishment of commercial zoning on the subject property might erode the
clear demarcation that currently exists between residential and commercial uses In this area, and
result In further requests fOf commercial zoning along Kirkwood Avenue.
If commercial zoning Is to be appfoved, the requested CO,1 zone Is perhaps the least Intensive
commercial zoning classification that allows funeral homes. In the event thai the subject property
and the existing funeral home are ever redeveloped, the uses allowed In the CO.1 zone would
be more compatible with the surrounding residential neighborhood than the uses permitted In the
'previously proposed CC,2 zone and the existing CC.2 zone, which currently applies to the
existing funeral home.
If the requested rezoning Is approved, staff recommends that the existing curb cut for 617
Kirkwood Avenue be closed at the applicant's expense, and that an access easement be
established across 605 Kirkwood Avenue to provide access to 617 Kirkwood Avenue. Restricting
access for 617 Kirkwood Avenue will help assure that It Is developed In conjunction with 605
Kirkwood Avenue, and may make It less likely that a strip pattern of commercial uses develops
along Kirkwood Avenue.
The CO.1 Zone allows funeral homes subJect to the approval of a Special Exception by the Board
of Adjustment. If the requested rezoning Is approved, the applicant would be required to receive
approval of a Special Exception If the funeral home business Is to be expanded onto the lot at
617 Kirkwood Avenue.

STAFF RECOMMENDATION:
Staff recommends that the proposed rezoning of 605 and 617 Kirkwood Avenue from CC.2 and
RS.5 to CO-I be denied, but that II It Is approved It be condltloned upon the closure of the curb
cut at 617 Kirkwood Avenue at the applicant's expense prior to Issuance of any permit to
redevelop the pfoperty, and the establishment of an access easement over 605 Kirkwood Avenue

BACKGROUND INFORMATION:
The applicants, Michael and Vicki Lensing, are proposing that the property located at 617
Kirkwood Avenue be rezoned from Low Density Singla.Family Residential (RS-5) to
Community Commercial (CC-2). The subject property currently contains a single-family
residence. The applicants own the funeral home located in the adjacent CC-2 zone to the
west. They have indicated that, if the rezoning Is approved, a garage for storage of
limousines and hearses would be built to the rear of the existing house on the subject

property. The second floor of the existing house would be used as a residence and the first
floor would be used for meetings of a support group. Access to the proposed garage would
be via a driveway connecting to the existing parking lot of the funeral home located to the
west.
ANAL YSIS:
The Comprehensive Plan indicates that the subject property and the area to the east and south
should continue to be developed for residential purposes at a density of 2-8 dwelling units per
acre. The current RS,5 zoning complies with this Comprehensive Plan designation. The Plan
also designates the area to the north for residential development at a density of 8.16 units per
acre, and the area to the west for commercial development.
The current boundary between the RS.5 zoning end the CC-2 zoning in this vicinity, provides
for a clear demarcation between commercial and residential land uses. The existing
landscaping along the boundary of the CC-2 zoned property, which is required by the Zoning
Ordinance, provides a buffer between residential and commercial development. The applicant
is proposing that the boundary be adjusted to include an existing residential lot within the CC.
2 zoned area. Although the applicant's Intention to use the property for the adjacent funeral
home business may result in development which would appear more compatible with the
surrounding residential neighborhood than other potential commercial uses, the proposed CC-2
zoning would allow the reuse of the property in the future for more intense commercial uses
which may not be as compatible.
If commercial development occurs on the subject property, a new landscape buffer between
the proposed commercial zone and the adjacent residential properties would have to be
established. Establishment of mature landscaping may take time and result in some
inconvenience for the inhabitants of tha adjacent residential properties. Given the relatively
small size of the lot proposed for commercial zoning, it may be difficult to establish an
effective landscape buffer while leaving sufficient room for commercial development.
The establishment of commercial zoning on the subject property might also erode the clear
demarcation that currently exists between residential and commercial uses in this area, and
result in further requests for commercial zoning along Kirkwood Avenue. The other residential
properties on Kirkwood Avenue in this vicinity are similar In character to the subject property.
Approval of this request would raise the question as to whether these properties should also
be zoned commercial. Since the adoption of the Comprehensive Plan and the designation of
the RS.5 zoning district In this area, there does not appear to have been a change in
circumstances that would werrant a rezoning and redevelopment for commercial uses for the
subject or adjacent properties.
STAFF RECOMMENDATION:
Staff recommends that tha proposed zone change of 617 Kirkwood Avenue from RS-5 to CC-
2 be denied.

THIS AGREEMENT Is made by and between the City of Iowa City, Iowa, a Municipal Corporation

WHEREAS, the applicants, Michael and
Victoria Lensing, have requested tha City to
rezone approximately 1.2 Acres of Land locatad

WHEREAS, the Planning and Zoning
Commission recommended approval of the

WHEREAS, the applicant, Braverman

ANAL VSIS:
The requested rezoning from ID.RM, Interim Development Multi-Family Residential, to RM-12,
Low Density Multl.Famlly Residential, Is consistent with the Comprehensive Plan recommendation
for this area of residential at 8.16 dwelling units per acre. This remnant property Is a natural
addition to Block 3 of Braverman Center, a 6.296 parcel north of this pfoperty, given the existing
pattern of development.
The Public Works Department has raised concerns about sanitary sewer capacity In this area of
Iowa City. If sewer capacity Is not available, development of this entire approximately 6.4 acre
site could be delayed. However, staff feels that It is appropriate to rezone the 0.139 acre at this
time.
STAFF RECOMMENDATION:
Staff recommends that REZ93-0011, a request by Braverman Development, Inc. to rezone 0.139
acre of land from ID.RM to RM.12 be approved.
