AN ORDINANCE AMENDING THE ZONING ORDINANCE BY CHANGING THE USE REGULATIONS OF AN APPROXIMATE 1.65 ACRE TRACT OF LAND LOCATED AT 702 SOUTH GILBERT STREET, IOWA CITY, IOWA, FROM CI.l, INTENSIVE COMMERCIAL, TO CC.2, COMMUNITY COMMERCIAL I , , ! WHEREAS, Kennedy Plaza Inc. and Capitol Implement Co., the applicant and owner, have requested the City to rezone an approximate 1.65 acre tract of land located at 702 South Gilbert Street, Iowa City, Iowa, from CI.l, Intensive Commercial, to CC.2, Community Commercial; and WHEREAS, the subject properly Is located In an area of general commercial development; and WHEREAS, the land uses allowed In the proposed CC.2 zone are compatible with the existing land uses In the surrounding area and the land uses permitted by the zoning on adjacent properties; and WHEREAS, the Planning and Zoning Commission and City staff recommended approval of the proposed rezoning, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: SECTION I. APPROVAL. The properly legally described In Attachment "A', attached hereto and Incorporated by reference, Is hereby feclasslfied from its present classification of CI.l, Intensive Commercial to CC.2, Community Commercial, SECTION II. ZONING MAP. The Building Inspector Is hereby authorized and directed to change the zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval and publication of this Ordinance as provided by law. SECTION III, CERTIFICATION AND BECORDI~. The City Clerk Is hereby authorized and directed to certify a copy of this Ordinance which shall be recorded by the owner at the Office of the County Recorder of Johnson County, Iowa, upon final passage and publication as provided by law. If any section, provision or part of this Ordinance shall be adjudged to be Invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged Invalid or unconstitutional.
