We feel unsure as to what future the city planners may have in store for us. The council has approved the buying of the sand pit on South Gilbert St. which lies adjacent to Napoleon Lane and our neighborhood. We wait with foreboding as to what the city has in store for us. We feel it is ollly a matter of time before we will be displaced and forced to move to a different location. But to where will we find such economic dwellings surrounded by the wonders of nature? Living in the Showers addition is extremely economical as well as a beautiful place to live. With the woods on one side and the river on the other, one does not have to walk too far to enjoy wildlife and fauna of all kinds. And yet we feel little or no consideration will be taken by a city whose only plans are for fast and glutinous growth. Knowing right from wrong seems to be not in the nature of developers as they court the city planners who are of the same manner. It is simply wrong for anyone person to even think of displacing another person for any reason. It is especially wrong when it is done by those who suffer from a lust and greed in obtaining power and wealth. They wrongfully buy up land and force people out so that they might line their pockets. This is of course covered by the blanket statement "Good for the whole community". We fear that our neighborhood will be purchased by the city and rendered into a city park so that all may come and enjoy the wonders of nature. This is not right. We elected to live here and not in the city. It is not our fault that city dwellers elected to live in the city. It is wrong that our neighborhood should be disturbed under the guise of "Good for the whole community" as we are pushed out to find dwellings that we can ill afford and forced to watch the growth of manufactured housing, instead of trees. During our negotiations with the owner of the quarry for acquisition of the property that will be the Sand Lake Recreation Area, the staff did investigate the option of also purchasing the property owned by the Hagens, known as the Showers Estate. However due to the complexity of the ownership/lease arrangement on this property and the inability to acquire good information as to how this arrangement functions now, we are no longer pursuing this acquisition. Plans are proceeding for the design, property acquisition and construction of McCollister Boulevard which includes a bridge over the Iowa River to connect this road between Old Hwy 218 on the west side of the river and Gilbert Street on the east side of the river. This project will impact the Napolean Lane area to some extent; until design plans are completed we do not know exactly the scope of the impact. It is likely one residence will be affected and we have already had conversations with the owner and resident. When the design plans are completed, our attorney's office and the Dept. of Public Works will begin property acquisition processes. Anyone directly impacted will be notified and a pre-construction meeting will be held with residents of the area. I live on the south side of town, and look forward to seeing this project come to fruition-but not until after we do a better job of providing for the basic human needs of our residents. I feel that this $1 million expenditure by the City ofIowa City represents a priority problem among council members. If the city council feels that the city budget can accommodate spending a million bucks to set aside land for a future park, surely there should be no problem with providing $90,000 in funding for the homeless shelter-a modest sum that has been repeatedly requested (even in writing) by the Affordable Housing Coalition of Iowa City on behalf of the Shelter House. In addition, Iowa City needs to work harder to make sure that there are enough units of affordable housing available so that all of our residents have the ability to provide shelter for themselves and their families-and to avoid becoming homeless in the first place. Council members are already aware that there is a pressing need for affordable housing-and I commend you for considering inc1usionary zoning as a way to address that problem. Your own city plan called for 1336 units of affordable housing to be built between 1998 and 2005. Sadly, only 8% of those units ever materialized, so we are far behind in our progress addressing the needs of our low- to middle-income residents. In 2007, we should begin to correct that shortfall by constructing 150 units or more in affordable housing in this town. Emergency shelter facilities (churches) provided shelter last winter for 1,200 homeless people. We have the smallest number of shelter beds available per capita than any comparable city in Iowa. Winter is coming, and we need to address the problem of providing safe shelter to struggling low-income people in this town before we spend any more money on creating new recreational spaces. Thank you for keeping the issues of affordable housing and homelessness in Iowa City at the top of your list of priorities. Council members do not receive their email directly and your message will be forwarded to them and received as official correspondence as part of an upcoming regular meeting agenda. As always, you are welcome to contact them individually if you prefer. Perhaps I can help clarify what the building is currently used for. The building would require extensive work to be brought up to conformity with the building code, a measure that would be necessary were it to be regularly occupied for any commercial or institutional purpose. Given that it will likely be demolished in the next few years, such an investment would not be cost effective. Currently we store snow removal equipment there during the winter for use in the downtown area, thus saving time and energy by not having to transport that equipment to and from that area from a remote location. During the past summer, the Bicycle Library was allowed to use it for overflow storage of donated and refurbished bicycles, which enabled them to better meet the demands for bikes during the high use summer months. Use of the building for storage can be accommodated without doing the renovations necessary for code compliance as mentioned above. Thus, we feel we are putting the building to its best use given its condition and the use limitations that exist. I hope this information is helpful. That building was probably built with a very good foundation, plumbing, electrical wiring and probably needs only some cosmetic repair. It needs a mural, and some kids would probably like to help. The activity you mentioned having occurred on Friday was a function of the Department having the ability to allocate time for officers to conduct those operations. This was quite unlike Saturday, where we experienced significantly higher concentrations of people and activity which occupied the officer's time and attention. Additionally, some of the fight calls you referred to actually happened outside the named bars, which were simply used as landmarks for assisting units. In those specific instances, having officers inside the bars would have no effect in deterring the fights from occurring and would have actually hampered their ability to respond, given that they would have needed to make their way outside to deal with those calls. While it would be ideal to be able to direct personnel to both sets of issues, we are often called on to prioritize our presence and response to areas we deem having the greatest need. Saturday was a good example of one of those occasions. My question is according to the police log there were 30 bar checks by the police on Friday September 29th occurring between the hours of 7-9 pm. On Saturday September 30th into the hours of October 1st there was not one bar check logged. Yet there is reported 17 fights occurring in various bars as well as a few assaults requiring medical attention. I know it was a big game day, but the amount of bar fights reported on a weekend basis should indicate more attention given. Why was there no bar checks on a day when the bars would be so heavily occupied? The City Council, as a policy making body, typically does not become directly involved in matters such as this. Police officers are given discretion in the enforcement of City ordinances and violations are prosecuted by the office of the City Attorney based on the facts as presented. "No-Right-Turn-On- Red" prohibitions are primarily posted for purposes of pedestrian safety and such violations are especially hazardous in the area near campus where there is a very high volume of pedestrian traffic. Council and the City administration continue to support enforcement by the police of pedestrian protection laws and do not intervene in the judiciai process once a citation is legally issued. I'm sure you are aware that the State Department of Transportation (DOT) is the agency that suspends or revokes Iowa operator's licenses. It is my understanding that they do have an appeal process whereby they can review a particular case and perhaps exercise some discretion. While I am uncertain whether or not an appeal by Scott would merit a review, this is the only suggestion I can offer. I hope this information helps clarify the City Council's role in matters such as this. My husband was on the City Council for 15 years in Laurens, lA, and he tells me that you aren't in a position to help us. But I'm hoping it's worth a try. Our son, Scott Hunter, moved to Iowa City on Sept. 1. He was raised in Laurens, lA, a small town with 3 stop lights. He went to Buena Vista University in Spirit Lake, lA, where there are no NO RIGHT TURN ON RED signs. 1 Y, years ago, Scott was arrested for OWl. We didn't fight it at all, he took all of his punishment without argument, as it should be. He lost his license for 6 months, and is currently serving a 1 year probation period. Scott got his degree, and decided to move to Iowa City to search for his first big job. He moved there on Sept. 1. 10/3/2006 Page 2 of2 A little over a week ago he was driving in the college area of town for the first time, where, I understand, there are many 1-way streets and many NO RIGHT TURN ON RED signs. Well, Scott came to one of those corners, stopped, saw no traffic, and turned. A policeman stopped him and gave him a ticket. We know he shouldn't have done it, we know he should have been more observant and spotted the sign. But, he was on campus of Iowa City and gawking around, and never having had to worry about such signs, he simply didn't see it. He went to the City Attorney to plead his case, and was told that had he been speeding, they could have reduced his speed and he wouldn't have lost his license for another 6 months. We feel that speeding is much more dangerous than stopping at a red light, looking to see no traffic, and then turning the corner. Please, do any of you know if there's anything that we can do to minimize Scott's punishment? It just seems too severe for the crime. He needs to get to interviews, and then he will need to ask a new employer to please sign a form so he can get a work permit. Not a wonderful way to start out your first big job! If there is anything we can do to minimize this for Scott, we would be so grateful. Thank you for your consideration. "PRIME COMMERCIAL LOTS LOCATED AT THE 1-380 & HWY I EXIT. THESE HIGHLY VISIBLE LOTS HAVE THE INFRASTRUCTURE IN PLACE & ARE READY FOR BLDG IMPROVEMENTS. PRICED BETWEEN $3.25 & $6.50PSF " If this area is worth $3.25-$6.50/ sq ft. then I think the city could offer 2 acres ofland to the shelter for $2.00/ sq foot. that would equal $174,240, which if I am not mistaken is aprox. the offer they received for the land now tied up in litigation. Sounds like a heck of a deal to me... The city makes money, looks good, and does a good social thing. The red dots are areas of open land that is not in a flight pattern. Think about it ..... Save tax payer money. . . Withdraw the appeal. Sell 2 measly acres ofland to look like the bigger social sole. Hello City Councilmernber, The article in today's Daily Iowan brought to my attention City Councilor Connie Champion's feelings about cyclists in Iowa City. "Champion encourages students to ride their bikes to school - just not downtown." Then, when asked about cyclists using streets instead of sidewalks, the reply was, "I'm not sure how safe that is." This is a terrible vision of our downtown. I am aware of the city ordinance to keep the downtown area sidewalks clear of bicycles, and I believe it is a necessary law. What bothers me about this is the blatant disregard of bicycling as a viable transportation alternative. The streets aren't safe enough? Well, what is the city council willing to do to make cyclists safe? Check your statistics, and you will find that deaths and injuries from motor vehicle accidents grossly outweigh those of bicycles. Iowa City was once considered a Bicycle Friendly Community by the League of American Bicyclists. We have that status no longer. Perhaps it is time to regain the safe streets that we have lost, so cyclists will choose the streets over sidewalks of their own will. I appreciate your time. The comments attributed to City Councilor Champion do not make Iowa City sound like an attractive place to bicycle at all, which is well off the mark. I do not take issue with the sidewalk law, bicycles do not belong on sidewalks or in the pedestrian mall any more than cars do and enforcement of existing laws is neccessary to ensure the safety of everyone. I do take issue with Councilor Champions encouraging students to ride their bikes to school - just not downtown. This statement is simply not to be believed as anyone who is familiar with Iowa City knows that the campus is downtown. Bike lanes are not an issue and no buildings will have to be moved as the roads serve as perfectly good bike lanes already. As for the statement that riding bicycles in the streets of Iowa City may not be safe, I almost fell out of my chair! This is the vision of Iowa City? The laws of Iowa City regarding bicycles will ensure that riding them in the streets is safe, maybe the police could spend a day ticketing motorists that pass to close to cyclists or fail to yield the right of way to cyclists or maybe the city could more aggresively prosecute Girls Gone Wild buses when they run over cyclists (assault with a deadly weapon?) here in OUR town. I could go on all morning and I welcome the opportunity to meet with each of you in person in your office or over coffee downtown to discuss bicycle related issues in Iowa City. I would urge you, in light of the recent article in the 01, to write an editorial to both the Daily Iowan and the Press Citizen clarifying the City Council's views of bicycles as part of Iowa City's transportation system. My name is Rachel Bender and I am a sophomore at the University ofIowa. Fellow students and I have some growing concerns about student safety, and would be very grateful if they were addressed in any manner. There have been increasing reported sexual assaults around Campus, and I feel that nearly every student I have spoken with either has experienced it directly, or knows someone closely who has. I understand that this is unpreventable to some measures, but the fact that the majority of these go unreported, and that the majority of them are happening within student residential areas is very frightening. I feel that this issue needs to be addressed, and simple measures can be taken. I find something very wrong with the extremely high concentration of police officials on the 2 block radius of the downtown bars, which are regulated by bouncers and door workers. The large sums of monet coming from the pockets of college students is quite appealing to the city police I am sure, but I feel that their job of serving and protecting should be focused on areas that are not regulated and that need attention to safety. The house party scene has been growing increasingly out of control due to the expense of PAULA's and other tickets. House parties can not be monitored, and the people and substances coming and leaving are frighteningly out of control. Perhaps a more equal distribuition of officers is needed, or more street lights, or safety alarms on blocks, or a safe walk program of some sort. Something needs to be done, students should not be put at risks like this. If the parents of daughters and sons walking home at night knew ofthe odds that their child could be scarred for life, they would not so readily send their child to such a campus. I have always loved this town as one of the most progressive in the Midwest, and I think we should be very proud of that fact. However, in my opinion and that of many others, it has fallen behind in one main category: smoking. I have recently been very impressed with the hospital's smoke free campus policy, and the ban of smoking outside of 25 feet of all campus buildings. Unfortunately, it is not enough. One of the main social attractions of Iowa City is the downtown. Not just the bars and alcohol, but the restaurants, the boutiques and the diversity. By now everyone knows of the health risks that smoking and second hand smoke cause, but think of the damage to property, the litter, and the population of people that will not come downtown to see one of their favorite musicians because their eyes will puff up and their entire body will reek of smoke the next morning. The 2001 ban on smoking was met with a lot of grief from restaurant owners, but that is because of the stratification. It is unfair to allow some restaurants to have smoking and some to not based on and easily tweaked alcohol revenue. What needs to happen is to have a full ban of smoking for our city. We need to join the ranks of other progressive cities like New York and Seattle. It was said in 2001 that "the public would not support a total ban" but I would like to challenge that statement. Please let me know how I can help make this a true possibility-can we put the city to a vote? Do you need signatures? Not only would this help the economic status of our city, but make it more attractive to incoming professionals, especially young professionals. Very little has been done to replace shrubbery damaged by vandals and weather conditions. Only select beds are planted with flowers resulting in a very sad iooking downtown. Protective fencing around these beds was deleted from the project which might have prevented much of the vandalism. I hope that you can encourage staff to replace damaged shrubbery and expand the planting of flowers next spring. It seems the only color we get downtown is the Ped Rats hair, which does add interest to the area. Additionally, the untreated wood benches look pretty sad. Iowa City, IA 52240 RE: Deer population Dear Council Members: For the past several years, our neighborhood has experienced severe destruction wrought by the local deer residing in lands bordering Walnut Ridge. Besides the constant and substantial property damage, we grow increasingly concerned about the potential traffic safety issues within our subdivision, as well as on nearby roads from nighttime road crossing by individual and small groups of deer. We understand that the City engages outside professional herd management teams, such as White Buffalo, to control the deer population in other areas of the City. Unfortunately, due to a variety of circumstances including the restrictions from neighboring landowners, such teams have not, to date, been permitted to freely and regularly work in our bordering areas and as a result, the nearby herd continues to grow. We strongly desire to have these deer population control services consistently rendered in our neighborhood as part of the overall City deer population control efforts, and we wish to work collaboratively with the City council to see this occur. As a starting point, we desire to pursue two potential solutions. First, we believe it is essential to negotiate an acceptable hunting date with the University ofIowa. We are aware that the university has refused to allow White Buffalo sharpshooters to hunt on their land while school is in session. A very large part of the neighboring woods and fields next to Walnut Ridge belong to the university. We would request that the city reschedule, or add an additional date to, White Buffalo's population- thinning shoot to the winter break period of the university so that hunting might be allowed on this land, including the area surrounding the cross country course. The Walnut Ridge Homeowners Association would be happy to contact the university in support of the council's efforts, if desired. The second is to allow a citizens' or professional bow hunt within the city limits. Based on a small poll of residents, the Board believes that most Walnut Ridge residents would allow limited (time, date, method) bow hunting to be conducted on our individual lots, as well as in the common areas. Such hunts have reportedly been successful in neighboring cities and could do much to aid in reducing the herd. We urge the city to renew your efforts at thinning the deer population on the west side to both reduce unnecessary property damage and prevent potentially serious bodily injury from a car vs. animal accident. Please be advised the City of Iowa City recently finalized the 2006-2007 Wildlife Management Service Agreement with Dr. Tony DeNicola of White Buffalo, Inc. The University of Iowa has granted access to their property in support of our effort to reduce the number of deer on the west side of town. Dr. DeNicola is currently in communication with the University to determine the exact dates and location for deer removal which will coincide with the University's winter break. Every year the City Council reviews recommendations for deer management as provided by the Iowa City Deer Task Force. These recommendations have included both sharp shooting and bow hunting. Iowa 52240-1826 (319) 356'5000 (319) 356-5009 FAX www.icgov.org Re: Cable TV Division budget Dear Council Members, At this important budget time the Iowa City Telecommunications Commission (JCTe) would like to emphasize the importance and the value of the many services the Cable TV Division offers the community and the importance of reconsidering what had been a long-standing budget principle of user-fee funding for the Cable Division. The JCTC is aware the City Council always has many important matters to consider when budget time comes. There are always many choices to make. The Cable TV Division represents one of the very important ways this community informs and educates itself about its many activities, events and facets. Through this Division and the funding it receives and distributes, valuable insights are provided into our many institutions including the City, the schools, the Library, the Senior Center, nonprofit organizations, as well as the community members through our local cable TV channels. What these channels offer also exhibits to visitors and new community members the importance the City places on telecommunications in moving into the digital age. The ICTC has worked with all ofthese institutions and entities to improve the quality and programming they offer, and will continue to do so. These channels, and what they offer, are becoming more and more valuable as the spectrum space they occupy on the basic tier becomes scarce. Their use and value to the City and community is measured by its direct financial support. The JCTC read in the newspapers recently that the City no longer faces the financial crisis that prompted it to look for other sources of revenues such as the ICTC budget. Therefore the ICTC would again like to request the Cable TV Division budget be restored to its original amount and the budgeting principle to which the Council adhered for 25 years be re-instated. We understand the City was compelled to review this policy and change it, given the unique fmancial crisis it faced three years ago. In addition, we're sure the Council is aware of the Kragness vs. Des Moines as well as the Curtis vs. Bettendorf legal cases. Each of these cases indicates the importance of cities maintaining a direct connection between the sources of funding they receive and the uses of these funds. Page 2 To: Iowa City City Council The Curtis vs. Bettendorf case in particular implies that in order to best protect and justify the collection ofthese fees, the use of franchise fee funds should be linked to the source of these funds - the cable subscribers. Just as the Water Dept. revenues of the City of Iowa City go to support only the water system and services, so would the cable TV revenues go to support the services offered to cable subscribers, as the pending legal cased imply, and as cable subscribers appear to believe. The state legislature and Congress are attempting to centralize authority in cable TV related matters to the State or Federal government rather than the local communities. This may render consumer protection almost nonexistent, provide less franchise fee revenue to the cities, and eliminate accountability of cable and telecommunications companies. We hope the Council will indicate its support for the way cable funding and services are now provided to their citizens and consumers, both in its funding decisions and its lobbying efforts, as the Council had indicated in their previous letters to the Senate and the FCC. The ICTC hopes the Council will review the Cable Division funding matter, and retum to its original policy adopted over 25 years ago - that the cable TV funds collected go to cable TV related expenses to benefit the cable consumers, including the cable channels which benefit the whole community, and consumer protection. This is a policy and a user-fee principle in which you still believe as you indicated last year during the budget process. We understand the exception occurred during a unique tight budgeting experience. We hope you will return to the principles you established in the past. I also visited the site. It;.. my belief the damage to the homes is ~al,l"Ad by thA street shifting. The damage was also increased by the lack of expansion material between the street and the driveway and the driveway and the sidewalk. The Iowa City Streets Division will be on site this week to cut expansion joints into the driveways and to re-cut the expansion joints in the street.
