In that you are epparently a resident of the City of Coralville, you mey wish to make a similar request for information to that community. To my knowledge, they heve not planned on the development of such an ice skating rink; however I you may wish to c~ntact their City Council or Parks & Recreation Commission. I , To: October 15, 1993 City Council From: City Manager Re: Federal Crime Bill It Is expected that a Clinton Administration crime bill will appear before Congress within the next week or so. The House and Senate Judiciary Committees have begun the process of review. Both the House and Senate versions have provisions that would provide $3.45 billion in federal aid over six years to local governments to hire additional pollee officers. The House version also Includes the Brady Bill, which would establish a five-day waiting period for handgun purchases, The Senate version does not. ; I ,I Ii i " , " I 'I l I, !: !i - , " ii 1:1 I': r " I ': . H Ii :1 The intent Is to provide federal funding to hire pollee officers for local governments under 150,000 population. The Slates will be required to rank all proposals In accordance with criteria established by the U,S. Attorney General. We will review this leglslaUon and attempt to deteonlne how It might fulfill our local needs. A primary concern Is the Issue of what happens after the federal funding expires, particularly due to the likely requirement of a commitment on the part of the local government to maintain the staffing or, at the very least, keep officers hired under the federal legislation, Here In Iowa, that can be most difficult with the property tax freeze which directly affects our general fund. If any further restrictive tax polley Is put forth by the state legislature and/or the Governor our long-teon financial planning Is further compromised. We heard of the Inlerest on the part of the Governor In extending the freeze for two more years. Such revenue constraints could have significant bearing on our ability to fulllll a commitment In the long.teon, Programs such as these often gather significant public support; however, the long-term implications are often forgotten or Ignored in future budgets, We will monitor the leglslallon and whether we think we can saUsfy the goals as ouUlned. The measure does require final ection by both houses of the Congress and apparently would be administered by the states. Additionally, the EPA indicates that this revolving fund concept must ewait re-authorization of the Safe Drinking Water Act. As you know, we have relied on the current legislation to guide our water project planning and, therefore, we ere somewhat anxious as to what changes may occur in the re-authorization, Congressmen Leach Indicated he would monitor the legislative process for us. If these monies are available, it may be a source of funds to assist us in project construction. Pittman Family r - """f"""'"-' As some of you may be aware, the Von Pittman family at 840 Normandy had significant structural damage to their home, to a point that the home can no longer be reconstructed in accordance with FEMA guidelines, We have had conversations with tha family concerning how to assist in their eligibility for various federal programs. They have been very cooperative and helpful, even though they have experienced difficult circumstances, At this point we are holding back on the application for monies to purchase their home, demolish. and have the property revert to public ownership. This delay is at the request of the Pittman family, They are exploring other options and are aware that such an application process may take many months and there is no guarantee of eligibility/acceptance by the federal government. They appear more anxious to make a decision than await faderal purchase. City of Iowa City MEMORANDUM Date: October 13, 1993 To: City Council From: City Manager Re: South Gilbert Street Business Area We have received a request from some of the businesses in the South Gilbert Street araa to consider participation in construction of some type of levee in order to provide flood protection, The decision is complex in that there are many property owners involved and aach would require granting of easements and some share financially. Additionally, the cost of engineering and finally approval of DNR could be not only expensive, but also involve complex decisions. We will be arranging meetings with the area businesses to discuss this issue. We have made no commitment to pursue this project. Additional work needs to be undertaken to determine whether the cost is not only beneficial to the properties in question, but whether the City would actually even be involved. , ! Life Cycle Costing (LCC) is a common evaluation tool used by Purchasing in the analysis of products and services used by the City, Spacifications are written including LCC cost factors so an informed evaluation can precede the award. The goal of Life Cycle Costing is to procure the most cost-effective product or service which best fils the City's needs. not always the lowest initial price. It is estimated that the rollback could be in the neighborhood of 68% or less, it is currently at about 73% . This will have an effect on our budget planning for next year. This factor alone reduces approximately $44 million dollars in taxable value. Our new construction will be the primary emphasis for budget planning, specifically due to the implications of the rollback ml!l. the proparty tax freeze. We will need to refigure the second year of the two year plan but I am not sure at this time about projections. We were anticipating returning to our thraa year operational plan with the understanding that the fraeze would be removed. The State Department of Natural Resources desires to resolve this conflict between state and federal law by January 1994, Since the Cityls permit to discharge treated wastewater is a federal permit, the State is in a weak position to honor the moratorium, and tha City in effect will have to nagotiate a schedule with EPA for compliance with the ammonia requirament. With this in mindl Public Works staff has initiated the selection of an' engineering consultant to provide dasign services to construct improvamants to the City's wastewater facilities. The firms interviewed were: Shive-Hattery Enginears, Strand Assoclates/MMS Consultants, and Stanley Consultants. Stanley Consultants was the selected firm, In addition to the ammonia removal requiremont, the City is faced with treatmant capacit'l limits as tha North Plant Is currantly operating at its design capacity. The sanitary sewer connection between the north and south treatment plants must be' constructed before I' further development In not only this west portion of the South Area of Iowa City, but also In the I. west, north and northeast portions of Iowa City, can occur. It Is a logical consequence that If an area cannot be sewered, then developers cannot build In that area. The Commission's recommendation to deny REZ92-0012 was made on the basis of the sewer situation only. The , Commission has not considered the rezoning request on Its own merits. The Commission understands that Council will be evaluating sanitary sewer Improvements during the upcoming Capltallmproverpents Program discussions. During the Commission's meeting with the City Public Works Department staff on October 29, 1992, It was determined that a comment ' of encouragement should be forwarded to Council to consider commlttfng funds for the expansion of the sewer system, particularly fot the north-south sanitary sewer connection, to accommodate growth within undeveloped areas of Iowa City, as well as to meet the federally mandated ammonia standards for wastewater treatment. The optimal location of a regional facility is immediately north of Breese Road on the Gatens Tract. The cost of the facility plus the cost of a conveyance system to insure access to the facility from the various tracts under separate ownership is $805,000 or $2320 per acre. As an idea for discussion, Public Works would like to propose the City construct, own, and maintain the facility and recover project construction costs through the implementation of a tap-on fee or facility user fee. Project construction costs include: engineering and planning, legal, land, and construction. It is not recommended that the City recover interest charges, as is the case with sanitary trunk sewer tap-on fees, since these additional charges would render the project too costly for land developers. There are several advantages in providing a City owned storm water detention facility for this area: ' 1) With public ownership maintenance is assured. continual and reliable 2) Storm water detention can be provided for 106 acres of property developed prior to passage of the storm water detention ordinance. 3) Public use can be provided within the approximate 28 acre storage area. 4) The storm sewer and drainage way easements can be used as a public trail from Sycamore to the Natural Wetland Area. RE: Emergency Sewer Repairs We have been working to repair nine sanitary sewer collapses as well as numerous storm sewer collapses caused by this yearls record rainfall,' Our difficulty has been in securing a contractor capable of doing these difficult repairs. We are competing with private sector clients who already have the contractors under contract and with other communities who also have emergency work. Cedar Rapids for instance has over 70 sewer collapses. The frustration of residents reached a peak iast week when Maxwell Construction unexpectedly pulled his equipment off the Pepper Drive repair. Jeff Maxwell reports that this was necessary because he was being assessed financial penalties on one of his existing contractual obligations. This is understandable considel'ing the time he and his staff have spent assisting the city on other emergency repairs. i i i \ III I r i 'Ii,)' I \ ' < I.: !; i 'I " ! r After checking around eastern Iowa, we were able to secure the services of Tschiggfrie Excavating of Dubuque to complete the remaining repairs. Year End FY93 The Iowa City Energy Conservation Program continues to accumulate savings. Since 1960 the City has saved an estimated two million nine hundred and six thousand eight hundred seventy five dollars ($2,906,875) In energy costs. This fiscal year alone the City has saved approximately two hundred elghty.two thousand five hundred twenty one dollars ($282,521). Contributing, In no small measure, to this savings Is a dedicated City staff which maintains and operates City buildings efficiently, Overall, energy efficiency In City buildings has Increased 41% since 1980. In order that you may more fully understand the energy conservation program, allached is my "FY93 Energy Use" report to staff regarding Iowa City energy use, Two graphs have been plotted which show the trend toward greater energy efficiency In the City, The first graph, "IOWA CITY ENERGY USE PROFILE," depicts the total amount of natural gas and electricity used by the City for each fiscal year as measured in millions of BTU's per degree day (DO), standard year. The top line, consisting of connected diamonds, represents what the energy use would have been in each fiscal year had there been no energy conservation programs and had each year had exactly 7563 degree days or a standard year, This line Is generated by assuming that starting In FY78 the City's energy use growth would have kept pace with the average growth rate of energy consumption by the entire metropolitan area as calculated from utility company data (3.7% per year). The sudden jump In usage for FY90 Is caused by the construction 01 the large wastewater treatment facility which came on.llne In FY,90, The lower line represented by connected rectangles shows the actual energy consumed each year by the City as adjusted to correspond to the standard year of 7563 degree days, Since each line represents energy use for a standard year (same temperatures), the energy savings may be calculated each year by subtracting the lower line from the upper line, For example, In FY62 the energy saved would be 10 million BTUlDD minus 9 million BTUlDD or 1 million BTUlDD saved, I , ' The second graph,(also shown In tabular form) shows the trend toward greater energy efficiency In the average Building Energy Index (BEl). The smaller the BEl, the more efficlenlthe building. The BEl is the measure of energy used In a building (BTU) divided by the heated and cooled floor area (square feet) of the building and further divided by the number of degree days (DOlin the fiscal year. Dividing by the area of the building removes the size as a variable and dividing by the degree days removes outside temperature differences as a variable. A descending line shows a trend toward greater energy efficiency, The short.term increase (loss of efficiency) indicated In FY85 corresponds to a period when there was no Energy Coordinator employed by the City and a probable lapse In conservation effort. AS POINTED OUT IN MY MEMO OF 9.11.86, THIS MOMENTARY LAPSE IN CONSERVATION EFFORT COST THE CITY AN ESTIMATED $76,875.00 IN EXTRA ENERGY CONSUMPTION. The award.winning Energy Conservation Program Is self.funded out of energy savings, requiring no new allocation of lax dollars, In fact, even as the program spends money for new Energy Conservation Measures, energy bUdgets are reduced, Total energy savings have surpassed total expendilures from the fund. I 'i We have entered into an agreement with a local contractor to disc/rototill much of Lower city Park. Weather permitting, they will begin the week of October 18. Our Parks Division employees have been performing some of this work in order to keep contracting costs down. This' is the first step in preparing the soil for seeding/sodding next spring. For the time being, the large amount of sand along the river bank north of the Park Road bridge, will not be removed. We are currently investigating the possibility of leaving it there, and creating a "natural area", perhaps establishing a sand prairie. Also the week of October 18, we will have a crew of six individuals working for us, specifically assigned to flood- related tasks. Finance Director Ow- City of Iowa City Disaster Recovery ~rogram. 1993 Official Intent From: Re: I have compiled the costs related to the flood of 1993, Total actual and future estimated costs are estimated at $2.083.801, Actual expenses incurred to date are $577.587. Future estimeted expenses totaling approximately $1,5 million are either in the works to be repaired or the total cost estimates have not been ectually determined because of the floodwater level. Approximately $1 million of the $1,5 million of future estimated expenses are park.related and it has only been recently that City staff could datermine what the actual repairs will be. The other $500.000 is related to sewer collapses and repairs to various locations throughout the city. Of the'total $2.083.801 estimated expenses. the following funds have or will incur direct charges: General Fund - $1.183,920; Refuse - $3,842; Wastewater Treatment Fund _ $756,810: Landfill - $49,494; Transit - $16.374: Equipment Division. $8,146: Water- $40,151; and Airport - $25,063, All of the $2.083.801 of estimated expenses, except for $1,800, are projected to be eligible expenses and. therefore, reimbursable from FEMA and/or FHWA, The Federal reimbursement percentage is 90% and once the project is complete and the proper forms are submitted to the state, the state will pick up the 10% balance, If, for some reason, the federal government does not reimburse the City 90% of actual costs, we may be forced to issue debt or reise wastewater rates in order to pay for the cleenup costs. FEMA claims totaling $240,000 are cleared and ready to be processed for reimbursement to the City at the 90% level, The City should ba expecting a check in the next 2-4 weeks for approximately $216.386. This equates to approximately 45% of the actual costs incurred by the City as of the end of August. FHWA'related expenses will be submitted in the next couple weeks totaling approximately $142,000 and I am confident that the City will be reimbursad for approximately 90% of those costs, The City will be requesting additional follow-up inspactions from the FEMA staff in order to determine what the actual costs will be for future expenses in the parks, airport and sewer- related repairs to determine if they would qualify for faderal reimbursement, I have attached a detailed schadule showing the 1993 official intent by site number. the damage costs, the fund and departmant where the costs were Incurred, and the impact to the specific fund without federal reimbursement, Additionally, I have taken that same report showing total actual future estimated expenses by site and projected the sources of funds, which in most cases is 90% federally funded and 10% state fundad. Even though the Cedar Rapids bid has come in at a IOller rate per ton than the IOlla City bid, I have some concerns about taking the Cedar Rapids bid, All aspects of the cost of the sand have to be taken into accolmt - not Just the proposed cost per ton. By the time lie factor in the cost of the travel time to the cost of the sand, the cost lIill be ~ equal from either bidder, The larger problem lIith taking the Cedar Rapids bid is the weather. ~te to the cold lIinter temperatures, by the time lie travel to Cedar Rapids to pick up our sand and drive back to IOlla City, the sand lIi11 be frozen in our truck box and lIill be unusable. Moen stated that given the Planning and Zoning Commission's present attitude, they are Interested In the conservation easement route; however, It Is not their sentiment to Include or preserve the right to use that land for tertiary treatment for the future, 7. The buses meet some of the guidelines required by the Americans With Disabilities Act - Public Law 101:336 (signed July 26, 1990). The Iowa City Transit Director has not yet set up an ADA training for the bus drivers and he put the two ADA "accessible" buses out on the road'to carry non-disabled passengers in March. Persons who use wheelchairs and motorized scooters are not allowed to board. If a driver sees a disabled person in a chair, the driver must stop the bus, get off the bus, apologize to the person and explain to the person in the chair that they cannot board the bus because the drivers haven't been trained to use the lifts or the securement devices. The transit director indicated that there were problems with securement devices in April when I phoned him. He refused to say when drivers would be trained and when those with disabilitiee could use the buses. Were the "accessible" buses ordered to serve non-disabled persons? What is the purpose for the "accessible buses? When will the buses serve the persons the ADA intended to serve? When will persons who use wheelchairs and motorized scooters fulfill their dream 1:0 ride on a "fixed route" bus like regular folks? The buses meet some of the guidelines required by the Americans With Disabilities Act - Public Law 101:336 (signed July 26, 1990). The Iowa City Transit Director has not yet set up an ADA training for the bus drivers and he put the two ADA "accessible" buses out on the road'to carry non-disabled passengers in March. Persons who use wheelchairs and motorized scooters are not allowed to board. If a driver sees a disabled person in a chair, the driver must stop the bus, get off the bus, apologize to the person and explain to the person in the chair that they cannot board the bus because the drivers haven't been trained to use the lifts or the securement devices. The transit director indicated that there were problems with securement devices in April when I phoned him. Be refused to say when drivers would be trained and when those with disabilities could use the buses. Were the "accessible" buses ordered to serve non-disabled persons? What is the purpose for the "accessible buses? When will the buses serve the persons the ADA intended to serve? When will persons who use wheelchairs and motorized scooters fulfill their dream to ride on a "fixed route" bus like regular folks? We are inviting you to work on a community service project with us. We invite people to help on a Transit Study Group. We invite persons who are non-disabled to work with us to help the local transit systems. The Americans With DiSabilities Act was created and signed into law July 26, 1990 (Public Law 1011336). The goal is to help make transit systems accessible to persons with disabilities.
