Chair Paul called the meeting to order. She asked for approval 01 the minutes 01 September
27. Shires made a motion to approve and Dautremont seconded. Unanimous approval. Next
meeting Is scheduled for November 22 in tha Civic Center Lobby Meeting Room at 7:00 p.m.
CASES PENDING:
Team A: Paul made a recommendation to take housing case to public hearing. Vote 5.0,
unanimous, conciliation taam abstaining. The' case is discrimination based on race and
presanca or absence of depandents.
Team B: Lu recommended housing discrimination case based on presance or absenca of
dependents go to public haaring. Vote 5-0, unanimous, conciliation team ebstaining. Galstad
postponad recommendation on employment case until next meeting.
Team C: Galstad recommended retaliation case in employmant go to public hearing. Vote 5-

Gatlin and Harvey are planning to do a presentation on preventing sexual harassment and ADA
training at the Iowa, State Bank. Gatlin expressed the need for more outreach by the
Commission in the area of housing discrimination. He would like to see preventative measures
taken. He wants to get personally involved in this endeavor. He asked for further discussion
of outreach et the next meoting. Chen recommended a book by Stephen Carter called ~
of Disbelief. The author will be speaking on campus in the future.

Harris asked for specifics on when to arrange the state ADA training for Commissioners.
Tentative dates are January 22 or January 15,9.12 in the Iibrery. She sought recommenda-
tions for next year's breakfast. She reported 75 attendees. Agreement was reached to hold
the event at IMU next year. !lurnside brought up the letter from the Council about what the
Commission might want to do concerning inaccessibility of facilities such as restaurants and
stores to the disabled community. Paul will invite Ethel Madison, Director of Independent
Living, to speak ebout it at the next meeting.

1. Recommend approval. bya 5-0 vote. of amendments to Zoning Ordinance Sections 36-
5B. Off-Street Parking Requirements. and 36-4. Delinitions. changing the requirements
for hard-surfaced driveways that are eccessed via an unpaved alley, as proposed by
staff.

There was none.
Bovbjerg welcomed Jane Jakobsen to the Commission. noting she had previously served on
the Commission from 1975 to 1985, She said the Commissionars were pleased to have a
person with her axperlence on the Commission and she would be a great help to the City In
resolving some of the current complicated zoning issues.
ZONING AND COMPREHENSIVE PLAN ITEMS:
1. REZ93-0010. Public discussion of an application submitted by First Muscatlne
Properties, Inc. to rezone a 7.86 acre parcel located north of Muscatlne Avenue and
east of First Avenue from RFBH. Factory Built Housing Residential. to CC-2.
Community Commercial. (45.day limitation period waivad to October 21.1993)
Miklo said the proposed rezoning Is of an area currently zoned RFBH, Factory Built
Housing Residential. and Is the site of the Towncrest Mobile Home Court; if the
rezoning to CC-2. Community Commercial. Is approved. the epplicants have indicated
that the mobile home court and the edjacent properties already zoned commercial
would radevelop as a grocerv store with retail shops attached. In their examination
of the proposed rezoning. staff found there Is some support for redevelopment of thIs
area In the Comprehensive Plan in that it encourages commercial development to occur
In existing cores rather than creating new commercial areas. However. this must be
balanced with other concerns Identified In the Comprehensive Plan. includIng the
arterial street plan. which Identifies an existing capacity constraint at the Intersection

of Muscatine Avenue and First Avanue, and also the section of tha plan that addresses
alfordable housing, which designates the RFBH portion 01 this property as appropriate
for residantial development at 16-24 dwelling units per acre,
Miklo said, in terms of the traffic issues, a traffic analysis was prepared by the City's
Transportation Planner, which the Commission has examined in detail, The applicant
has indicated a willingness to contribute towards the cost of improving the
intersection; however, the exact amount has not been agreed upon and thera is
ongoing discussion on how that ligure should be calculated. Stalf recommends the
rezoning be approved only if the City Council makes a commitment to move the
improvement of the intersection up in the City's Capital Improvements Plan.
Miklo said, because of the poor condition of much of the existing housing in the area,
staff sees that there may be some benelits to the proposed redevelopment; at the
same time, the housing in this area is affordable and there is currently a lack of
affordable housing alternatives elsewhere in the City to accommodate the tenents that
would be displaced if the rezoning and redevelopment occurs, Staff recommends that
the City, in a spirit of partnership with the developer, try to address those concerns.
and has identified a number of potential means to do so, Including 1) contracting with
an organization such as Life Skills. Inc. to provide relocation counseling for the existing
tenants; 2) providing linancial benefits, such as the first month's rent and deposit, to
the existing tenants to assist them in securing alternative housing; and 3) providing for
disposal or relocation of the existing mobile home units. There are also some
strategies that the City could approach on a larger scale, such as applying for federal
and state funds to establish new manufactured hOUSing and rezoning other areas of
the City for manufactured housing. Staff sees those as more long-term strategies that
would not address the needs of the particular tenants of this court necessarily,
Miklo said there are also issues regarding site design and bUffering of the proposed
development from adjacent development; staff believes those can be adequately
addressed and the applicant has been quite cooperative with staff in addressing those
concerns.
Miklo said that staff recommends that the proposed rezoning be approved only If the
concarns regarding traffic and housing can be addressed adequately by tha City and
the applicant. Miklo noted a lelter he had distributed from Life Skills, Inc.; staff had
contacted the agency to determine if they could be of assistance in the event the
rezoning and redevelopment does occur. Bovbjerg also noted a lelter staff had
distributed at the October 18, 1993, informal meeting from Eagle Food Stores that
responds to concerns outlined In the staff report. Miklo noted the lelter proposes a
payment to the City for transportation related Issues; as discussed at the Informal
meeting, there Is some disagreement on the amount that the developer should
contribute to the cost of the Improvement to the Intersection. The letter also proposes
a payment of $25,000 to the City to address the housing concerns.

that these issues should be resolved prior to that meeting If a vote is to be made bV
the Commission, Bormann noted the City legal staff will have a report outlining the
Clty's options in requiring relocation assistance from the developer at the October 27,
1993, meeting.

In response to questions from Dierks, Miklo said. because of trailer size rastrictions,
only one mobile home court within the City limits will accept trailers of the siza located
In Towncrest Mobile Home Court; Forestview Mobile Home Court does accept trailers
01 that size but rarely has vacancies. He said he Is unsure If some the trailers In
Towncrest Mobile Home Court are structuraliy capable of being moved to another
court.

Greo Nelsen, 2312 Muscatine Avenue, 5C, said he has lived in Towncrest Mobile
Home Court for about 5 years and Is a student. He said this mobile home court
provides the only affordable housing In Iowa City for his purposes; he cannot afford
to mova his trailer nor could ha find a court that would accapt It because of its size
and age. Nalsen said he was unaware of the proposed rezoning until yesterday whan
a person came to his door; the landlord has posted tha requirad notice away from any
public access area of the mobile home court. He said if he Is required to move with
60 days notica. it will force him to ra-situate his Iile and add a yaar and a half onto his
schooling. Ha said ha lives well below the poverty level now but asks for and receives
no public assistance, Nelsen said he wished to express his outrage at the proposed
rezoning of the property that currently houses the Towncrest Mobile Homa Court.
Ed Murohv, 2312 Muscatlne Avenue, presented the results of a survey he conducted;
01 the 69 units in Towncrest Mobile Home Court, 40 ware included in the survey. The
survey showed 72.5% of those surveyed were aware 01 the proposed rezoning;
Murphy noted this Is miSleading because many 01 those tenants had only heard rumors
and had never actualiy seen the posted rezoning notice. He said the notice Is posted
In the window of a vacant restaurant also owned by the owner 01 Towncrest Mobile
Home Court and Is visibla only Irom Muscatine Avenue. Murphy revlewad the results
01 the survay, InclUding the number 01 vaars tha tenants have lived In the mobile
home court, the age and siza 01 the trailers, the number who own and rent trailers, the
numbar 01 adults and children living In the trailers, the percent that are students, and
the annual Income 01 the tenants. He noted 45% of the residents earn less than
$10,00 a year and cannot allord to relocate their mobile homes.
Murphy said he Is planning to move his trailer out of Towncrest Mobile Home Court
soon. He said that he was abla to rent one 01 the lew vacant lots that will accept
older, smaller trailer. It Is going to cost him between $600 and $800 to move his
trailar lour miles. He said he is not asking for linanclal assistance bacause he has
managed to save some monev but thare are a lot 01 tanants who will need assistance
II the rezoning Is approved. Murphy said he does not feel he should have to spend his
own money to move his tra~ler II the property Is rezoned but there are others who need

the essistence more than he does. He asked the Commission to not forget about those
people,
Vickv Jordan. 2312 Muscatlne Avenue, 8E. identified hersell a 29 year old, single
mother of 4 children who has lived in Towncrest Mobile Home Court for about 6
months; the two bedroom unit she rents costs her $375 per month. She asked if the
tenants will also be eliglbla for financial assistance if tha proposed rezoning is
approved. She said she would like to be more informed as to what is happening with
the proposed rezoning.
Miklo said staff has received several inquiries from tenants of Towncrest Mobile Home
Court end a letter is being sent to all tenants notilying them of the special meeting
scheduled for October 27. In response to a question from Dierks, Mlklo said staff may
be able to provida referrals to the City's Housing Assistance program. Bormann said
various City departments are working togather to coordinate efforts to provide
assistance to the tenants of the mobila home court. Starr stressed no ection has yet
been taken on the proposed rezoning; the purpose of the public meetings is to allow
concerned persons an opportunity to voice their concerns, and referrals may be
premature at this point. In response to a question from Dierks, Bormann explained 60
days is the legal requirement for termination of a lease in a mobile home court; the
applicant has indicated that a longer period of time would be allowed for relocation of
the current tenants.
Jordan expressed concerns regarding the time Irame necessary to arrange for
assistance from the various agencies that may be able to help her with relocation. She
urged the Commission to keep the tenants of Towncrest Mobile Home Court more
informed. Dierks noted for anyone unable to attend any of the meetings, minutes are
available.
Gillian Fox, Executive Director of Life Skills. Inc" said the residents who had spoken
at the meeting expressed much better than she could some of the concerns that her
agency has identified with. the relocation of the tenants. She said her agency has
concerns f.or those who own as well as those who rent because moving is an
expensive process and is not easily done. She said the survey conducted by Mr.
Murphy makes it very clear that most of the tenants are from very low Income
households.
Fox said Life Skills, Inc. Is a private, non-profit, social service delivery agency that has
bean in business since 1989; the agency provides a variety of in-home and community
basad educational services and skill development services. Their program serves
Individuals, children, and families who are In need of assistance; the agency Is
currently In their second year of a housing support curriculum project that is lunded
by Community Developmant Block Grant lunds in cooperation with the Greater Iowa
City Housing Fellowship. She said the agency's housing program helps persons who
are homeless find new housing or Individuals who must leave their current housing Ilnd
new housing. She said, because persons often have difficulty finding alfordable
housing. they settle for housing that does not meet their budgetary needs and must

development for Individuals who are at risk of eviction due to a lack of housing skills.

Fox said her agency has long been concerned with the lack of affordable housing
because they help persons find housing daily. Very few of the tenants 01 Towncrest
Mobile Homa Court receive faderal housing esslstancethrough the Iowa City Housing
Authority; one of the agency's concerns is the 6.9 month waiting list to receive lederal
housing assistance for 3.4 bedroom units. It eppears most of tha tenants would be
looking for smaller apartments, based on Mr. Murphy's survey; this Is fortunate
because there is a smaller waiting list for smeller units. Fox said Life Skills does have
a housing support program with no waiting list, but It relies on grants, so she is unsure
what the status of the program will be next spring.

Fox said her agency is prepared to provide programming and assistance In locating
units and assistance with referring individuals onto other community resources, but
one 01 the biggest difficulties that individuals face in Iowa City is a lack of linances to
pay deposits on apartments. A revolving loan lund is availeble; however, many 01 the
persons needing to borrow the money may have a poor credit rating and are ineligible.
Many Individuals also have a poor rental history which makes it even more difficult to
place tham in an affordable rental unit.
In response to a question from Starr, Fox said she feels direct financial assistance is
more important than transitional programming support lor these tenants, which Is the
reason why the agency scaled back their proposal for programming described in the
letter distributed earlier. She stressed the Importance of establishing that the tenants
have a financial basis to pay the ongoing rent In the units that they move to through
budgeting assistance or income verilication.
In response to a question from Bovbjerg, Miklo said staff has raised concerns regarding
the needs of the tenants that should be resolved before the rezoning request is
approved. He said the City's Community Development Block Grant Office is currently
doing research to determine If the City can provide assistance in addition to what has
been of Ie red by the developer.
Lawrence Ellie, 2312 Muscatlne Avenue. 28E and 20W,Identifled himself as a 2.year
Vietnam veteran who owns 2 units in Towncrest Mobile Home Court. He said he rides
his bicycle around the trailer court every day and the notice of rezoning is not posted
to his knowledge. Ellie said he leels It is absurd to expect him to walk away from his
property beceuse he cannot alford to move ,the trailers. He seid it is a disgrace that
this could happen in America.
Dennis Sloan. 2312 Muscatine Avenue. 35E. said he bought his trailer because It was
chaaper than paying rent. He said he has not been able to find a place to mova his
trailer because of Its ege and he does not have the lunds to pay for a move. He said
If the proposed rezoning Is approved, there will be many other tenants in the same
predicament.

In response to a question from Bovbjerg, Miklo said the various mobile home courts In
Iowa City have set limits on the size and age of trailers they will accept: most of the
units at Towncrest Mobile Home Court are smaller than those limits.

Jill Bolton, 2312 Muscat/ne Avenue. BC. said she purchased her trailer three years ago
for $2,500 because it was an inexpensive housing alternative. Sha said It would be
vary difficult to move her trailer and she is unsure it would withstand the move
structurally. She expressed concern for the residents of the mobile home court who

waiver of the 45-day limitation period to October 27, 1993. Dierks requested staff
ensure the notice of rezoning Is posted in a conspicuous location. Miklo verified the
notice was posted in a window of a vacant building; based on public Input, staff will

Public discussion 01 amendments to Zoning Ordinance Saction 36-58 regarding off-
street parking raqulremants lor multi.family residential uses.
Miklo said Jossph Hollsnd had sent a letter requesting that the City consider a proposal
to amend the Zoning Ordinance to require an Increased amount of parking for multi-
family developments. Steff researched other communities and found their
requirements are very similar to the City's cllrrent requirements, which ere 1.5.2
spaces for multl.lamily units regardless of the number of bedrooms. Staff beileves the
requirements 01 other communities are based on the assumption that apartments with
more than two bedrooms will ba occupied by households with 1 or 2 adults and a
number of children who do not drive. However, with the large student population In
Iowa City, this does not tend to be the case. Staff also found that several
communities with college campuses regulate the parking based on the number of
bedrooms rather than apartment size.
Mlklo said steff proposed a new schedule for parking requirements; for efllclencles and
one bedroom apertments, one rather than the current 1.5. Staff had proposed 1.5

spacas for two bedroom units; the Commission requested that be increased to 2
spaces. For 3 bedrooms. staff Is proposing 2 spacas: for 4 bedrooms. staff is
proposing 3 spaces; and for 6 bedrooms. stefl is proposing 4 spaces. Under the
current regulations, regardless of the numbar of bedrooms, only 2 spaces would be
required for these units.
Miklo said staff is also proposing some additional provisions in the Zonin9 Ordinance
to address staff concerns about the dasign of buildings that place the parking on the
ground Iloor with the apartmant units on stilts above with exterior stairwells. These
buildings tends to ba unfriendly for pedestrians and ganerally are not aesthetically
pleasing. Staff would also like to includa provisions regarding exterior stairwells in the
commercial zones, where apartments are allowed by special exception. Staff is also
proposing that the area coverad by the Near Southside Redevelopment Plan, which is
zoned CB-6 and PRM, not be amended other than striking the reference to 800 square
feet as requested by the Commission and that eldarly housing also not be amended.

Joe Holland, 123 North Linn Street. said there is an obvious trend in Iowa City to build
4-6 bad room apertmants, particularly in the near south side of Iowa City. This trend
is principally basad on tha land cost and tha landlord's ability to get a return out of a
small lot. When the current Zoning Ordinance was originally dralted in 1983, the
concept revolved largely around the type 01 construction going on at that time, which
was 2-3 badroom apartments: the Zoning Ordinance was structured around a square
footege requirement as opposed to the number 01 bedrooms. Since 1983. there has
been a trend to downsize the badrooms to push more bedrooms into the same physical
space.
Holland said the staff raport regarding this item was wall written but he takes issue
with the assertion in the report that 4.6 bedroom apartmants are the extreme; he feels
it is bacomlng tha norm. He noted a building with lour 6-bedroom apartments requires
only 8 parking spaces according to the currant regulations: functionally, only 7 spaces
are available because of the requirement to provide a handicap space: 7 or 8 students
olten live in the 6 bedroom units to reduce their individual costs. He said the ratio of
parking spaces par bedroom has decreased to the point where it is currently about 1/3
space par bedroom. Holland distributed copies of a recent Cedar Rapids Gazetle article
outlining the frustrations of tenants 01 apartment complexes regarding parking and a
letter ha wrote to the City last September.
Holland noted the City's Zoning Ordinence requires a certain number of parking spaces
for multi-family residential housing but does not regulate how the spaces are assigned:
many tenants are left to their own devices to find parking and often park In adjacent
lots. yards, fire lanes, aisles, and even move dumpsters into the alley to free up a
space. The parking problems create hostility on the part of tanants and causes access
problems In emergencies; it also creates hostility towards the public officials
responsible for enforcing the parking regulations. Holland distributed photos of

examples of illegal parking. He said he has a genuine concern lor the quality of Iile for
persons living in apartments.
Holland said he is pleased with staff's recommendations for amending the
requirements because it strikes a balance between providing a reasonable rate of return
and providing more parking. He suggested the required handicap spaces should be in
addition to the minimums proposed by staff. He said he also agrees with staff's
comments on below-building parking because It is an efficient use of the lend, and
staff's comments regarding screening requirements. He urged the Commission to send
staff's recommendations on to Council with tha addition of his proposal regerding
handicap spaces.
In response to a question from Dierks, Holland said the police normally do not patrol
for misuse of handicap spaces unless they receive a specilic complaint.

complaints from landlords or developers regerding the proposed amendments. He
added some of the developers who have been building apartments such as those
described by Holland were informed of tonight's meeting. Jakobsen noted the reason
. the Commission went to square footage as opposed to number of bedrooms in 19B3

EMERGENCY HOUSING PROJECT VISIT REPORT:

Cooper reported that on July 28, 1993 five members of the Committee: Unda Murray, Rusty
Martin, Sue Feeney, Bruno Pigott and Grace Cooper met at the Emergency Housing Project and
served the evening meal. They served over 50 people and performed all the tasks related to the
set-up, serving, and clean-up. The Committee members brought dessert and coffee. Afterwards,
they talked with the new director, Patricia Jordan. Murray added that Jordan expressed Interest
In meeting with the entire committee In the future. Nasby volunteered to Invite Jordan to a
meeting at the end of September. Discussion lollowed about the members' Impressions of the
evening.
FLOOD RELIEF EFFORTS:
Milkman stated the City departments have met regularly to coordinate flood rellel. Milkman said
that In addition to flood relief meetings organized by Hale, the Planning and Community
Development Department has been examining methods of assisting In terms of rehabilitation of
f1ood-damaged dwellings.

Barnes reported that recentiy there have been two large loan 'pay.olls' where money has been
returned to the Rehabilitation Program. The program Income retumed to the system amounts to
$40,000. The Rehabilitation Program recommends use this money, which would normally b~
turned back Into next year's budget for rehabilitation grants, for flood damaged homes. Bames
stated the application process would be stream-lined yet stili Include low-Income certification.
Barnes reported that FEMA's grants average about $2000 for major repairs and are limited to
Individuals whose Income Is 50 percent of the median Income level. The Rehabilitation Program
works with Individuals whose Incomes are up to 80 percent of median Income. Barnes said FEMA
grants may also be given to people with a heavy debt burden.
Barnes stated that rehabilitation work has been done In the past at both Baculls and Thatcher
Mobile Home Parks. She suspects that at least the skirting of the trailers would be damaged, that
there may be mold Inside, and some trailers are sinking In the mud and standing water. Bames
proposed a grant program using the returned money with a stream-lined application process and
a possible limit of $1,500 to 2,500. Bames said that according to the manager of Baculls, 108
trailers were vacated and 15 had water inside. Bames said in Thatcher, 57 homes were vacated
since water was unavailable because of the danger of. contaminating the 11ft station.
Milkman explained this proposal to use CDBG program Income would require an amendment to
the 1993 CDBG budget Milkman said the necessary public hearing could be held at the August
1 B, 1993 meeting of the City Council. She also added there may be additional flood reliel money
Irom the federal government
Martin moved that the Committee on Community Needs recommends the Iowa City City Council
amend the 1993 CDBG Budget to Include $40,000 of recent program Income for flood relief
through the City's Housing Rehabilitation Program. Ruff seconded the motion. The motion
carried 9.0.

Dennis called the meeting to order at 6:30 p.m. Dennis welcomed the new committee member,
Marc Ubants. The entire committee Intr9duced themselves.
REVIEW AND APPROVAL OF CCN MINUTES OF THE AUGUST 4. 1993 MEETING:
Murray moved and Martin seconded to approve the minutes of the August 4, 1993, meeting. The
motion carried 8-0.
PUBLIC/MEMBER DISCUSSION:
Dennis announced that there will be a public lorum sponsored by Hawkeye Advocates and the
National Federation of the Blind on 'Accesslble Buses. on October 5, 1993. Ruff added that two
city buses are now equipped with adequate tie-downs that accommodate a variety 01 wheel
chairs. He said the operators still need to be trained before the buses can,be used by disabled
riders. Dennis also notified the Committee about the upcoming United Way hearings. Martin Is
the designated CCN representative lor those meetings. Nasby reviewed the October CDBG
monitoring report schedule: Murray' Down Payment Assistance Program, Feeney. Mayor's
Youth Employment Program, EglI . Systems Unlimited, MECCA, and EHP Rehabilitation.

QITY COUNCIL UPDATE:
Dennis Inlonned the Committee of the various openings on other City committees and
commissions.
HOUSING COMMISSION UPDATE:
EglI reported that Milkman Infonned the Commission that modifications to the CHAS will Include
Ilood relief actlvlUes and mobile/manufactured housing. These modifications will be reviewed by
the Commission.
EglI summarized Ron Henderson's Public Housing Report to the Housing Commission. The
Commission discussed the relatively high vacancy rate and the newly proposed utility allowance
Increase for Section B. The Commission voted down the Increase as presented and the PHA will
have to re-evaluate rates.

EMERGENCY HOUSING PROJECT PRESENTATION:

Pat Jordan, the new director of the Emergency Housing Project, Introduced herself and explained
her goals for EHP. She distributed a EHP newsletter and the latest EHP statistics, Jordan
discussed the stallstics with the Committee. She stated the biggest challenge Is the lack of staff
and decreasing lundlng. She said that local churches remain the most lucrative source of funds.
In order to increase funding sources and make the local homeless situation more real to the
community, Jordan Is making presentatlo~s to many groups.
Jordan stated that she has to be flexible about EHP house rules. She said there Is need for
transitional housing in Iowa City. Jordan explained that support for clients should not end when
the client has secured housing; people need on-going support In accessing the human services
system.
To this end, she has devised a volunteer program called 'Early Bird' to provide Infonnal case
management to help clients coordinate plans lor improving their Job,' health and housing
situations.

Next Jordan fielded questions Irom the Committee regarding among other things, the statistics,
women's safety at EHP, house rules, meals and staff hours.
In response to a question about the changeover to having evening meals served at the Salvation
Anny's center on Highland Ave., Jordan said that there was some reluctance by EHP clients to
going out their lor meal, but she felt that In time this would work out The Salvation Anny has
been serving since Sept. 13 and averaging approximately 50 persons nlghUy.

Milkman emphasized the main point of the CHAS Is the Increasing need for affordable housing
In Iowa City. Despite new construction, the vacancy rates are sUII very low. Milkman said the
flood accentuated the need to address the location and viability of mobile homes as affordable
housing. Milkman added that this Issue Is also under consideration because 01 a request to
rezone Towncrest Mobile Home Court to accommodate a grocery store. Milkman explained the
, details of the situation. Milkman stated the two most difficult aspects are (1) limited land available
for affordable housing In Iowa City, and (2) the community's negative attitude or perception
towards affordable housing. Milkman explained that although drug and gang activity are real
problems, there Is no evidence that building low Income housing affects property values. She
asked the Committee to consider ways to change the 'Not In My Backyard'(NIMBY) attitude.

The Committee discussed rezoning criteria, relocation processes and opportunities lor low income
housing In Iowa City. Murray asked If the City could require low Income units In new subdivisions.
Milkman explained It Is possible to do so II the City proves the pubilc purpose 01 such as

In response to Dennis' question, Milkman explalned the content 01 the unexpended balance was '
primarily funds that have been committed to projects and were obligated but not expended at the
time of the report. Several comprehensive rehabilitation projects Involving CDBG and HOME
funds were walUng for HOME approval. Milkman emphasized that 99,8% of the funds were used
lor low- and moderate income Individuals and administrative costs were kept at 15%, well below
the allowable level of 20%.

CDBG FLOOD RELIEF ALLOCATION: '

Milkman reported that the City was awarded $175,000 of first.round CDBG Supplemental Funds
designated ONLY for flood relief. HUD has yet to allocate the remaining $125 million authorized
by Congress In the Midwest Disaster Relief Bill. Milkman stated the City will distribute the money
as grants and loans, using an abbreviated application process. The City's Flood P.laln Ordinance,
In accordance with FEMA regulations, requires that If homes are damaged more than 50% of the
pre-flood value, the home needs to be raised to one foot above the 100 year flood plaln. In order
to do this, the flood plaln needs to be surveyed. Some 01 the CDBG money will be used to
accomplish Bils task. Milkman said that an estimated 120 mobile homes were damaged as were
about 20 homes located on Normandy Drive, Taft Speedway and In the Shower's Addition.
Murray stated much of the damage came from sitting water. Milkman said that the CDBG money
will be used In conjunction with FEMA and HACAP funding. Milkman added Ihatthe CDBG rehab
program Income recommended lor flood relief by CCN at the last meeting will be held in reserve.

Dennis reported that the City has held several meetings with the GICHF, developers and
architects concerning the Land Acquisition grant. They'dlscussed land availability, possible
designs and project feasibility.
Nasby, reporting for Oxley, stated the Press.Clllzen project is moving along. The developer, Bob
Bums presented the Historic Preservation Commission with plans for minor alterations to the
building's facade. Mlklo Is drafting a Memorandum 01 Agreement between all parties regarding
the alterations.
Ruff reported that In the past quarter the ESA Small Repalrs Program made 43 repalrs. The
number Is down this quarter because the volunteer contractors are deluged with requests since
the flood.

$1.055 million which has been awarded and designated lor any flood-related repairs or
activities. Milkman said there has not been as manv applicants as expected to date. She said
that Steve Long and others will begin a door-to-door inlormatlon campaign In the Baculls and
Thatcher moblla home courts. In response to questions. Milkmen said the monay can be used
lor ell forms of esslstence, including the repair of furnaces and water heaters. Also, structural
damage can be repaired, and assistance is provided for moving expenses and replacement of
units as necessary. She said the criteria is that the applicant lives within the city limits and

approval of the CHAS to City Council. The Housing Commission also discussed public
housing preferences and the number of times an applicant can refuse an available unit of
public housing. Kubby explained thet an applicant will have three chances before they are
moved to the bottom of the waiting list.

Committee. Pigott said that CCN was a great committee and he was pleased to have been
a member.
ACCESSIBILITY GUIDE TO IOWA CITY:
Dennis directed the Committee's attention to a memo from Karen Kubby in the agenda packet.
Dennis asked If the Committee lelt it was appropriate for them to pursue the topic. Snider
said that previously a map showing curb cuts was drawn up. Milkman presanted a copy of
"The Curb Ramp Survey" done in 1989. Milkman explained that the City had moved away
Irom prioritizing curb cuts and currently constructs them upon request if funding is available.
The Committee discussed the current situation and the target date for compliance with the
Americans with Disabilities Act (ADA). Snider stated the older curb cuts wera bumpy and
poorly angled.
Kubby Indicated Interest in making Information about the location of curb cuts widely
available. Martin suggested making a map to put in the public information section of the
telephone book. The Committee discussed a hotline or informing service agancles about the
map as possible options. Murray said she felt the topic was within the Committae's purview
since accessibility Is covered by CDBG. Martin noted there were several questions: are curb
cuts being made? who has a map or engineer's plan? how much work would it take to make
a map If one does not exist? Milkman said she would pursue the topic and then the
Committee could make a recommendation to City Council about the topic If it wished.
Kubby suggested that CCN or "friends of ramps" survey the City and give the Inlormatlon to
the staff to map out. Martin suggested school children be involved in a survay. Murray
envisioned an accessibility guide project that would Include a map, a guide to public facilities
and businesses, and handicapped parking spaces. Milkman suggested that this project could
be a potential funding request for next year.

REASSIGNMENT OF YOUTH HOMES, INC, LOANS:
Bill McCerty expleined the request for authorizetion to transfer the two existing mortgages on
the Ronalds and South Linn Street lacilities to a new building that Youth Homes wants to
purchase located on Waterfront Driva. McCarty noted the programs at the other locations
would be consolidated with their offices at the new location. He said the proceeds from the
sale of the current facilities would be reinvested in the Waterfront building. This building was
formerly the Hope House and Is already designed as a residential lacility.
Milkman explained that In 19B7-BB, Youth Homes received CDBG funds and under the
agreement Youth Homes would continue to provide services lor ten years at these locations.
The portion of the mortgage which is a no.interest loan is being paid off regularly, Milkman
said the request is complicated on paper since Youth Homes would have to return all the
money to the CDBG program to comply with the original contract, then CCN would have to
reallocate the lunds to Youth Homes. Inc. for the new building,

shelter programs located on Jefferson and Johnson Streets.
Martin motioned to racommend that the City Council approve the transfer of Youth Homes,
Inc.'s mortgages. Feeney seconded the motion. The motion carried 10.0.
CDBG BUDGET REVISION AND RECOMMENDATION:
Milkman referred the Committea to the memo in the agenda packet that explained the budget
changes. After sevaral questions about the revisions, Milkman directed the Commlttae's
attention to the contingency lund. The City is considering contributing funding lor the
relocation of rasldents Irom the Towncrest Mobile Home Park who may be displaced il the
land Is rezonad to allow lor the construction 01 an Eagle supermarket. Milkmen esked the
Committee to consider using $30,000 Irom the contingency lund to assist Towncrest
residents. Milkmen explelned that the Planning and Zoning Commission at the present time
was considering the rezoning Issue. Milkmen noted thet although the issue was unresolved,
the Committee could possibly vote on their recommendation at this meeting so that the
budget would not have to be revised a second time.
Murrav expressed concern about where the Towncrest residents would relocate since land
zoned for manufacturad housing Is scarce in Iowa City. Murray noted that some trailer
owners may be forced to rent housing. She stated she was not opposed to using the
contingency lund but that she favorad the developer taking more responsibility.

Milkmen said that the neither the developer nor the land-owner have any legal obligation to
those renting units or spaces in Towncrest. She emphasized that the use 01 the contingency
fund depends upon the outcome of the rezoning issue.
The Committee discussed the number of individuals who might need assistance and their lack
of affordable housing options, Martin moved that CCN ask the City Council to encourage the
developer and the land-owner to come up with a signilicant portion of tha relocation lunds
should the rezoning go through, Murray seconded the motion.
Milkman explained that the issue is very tricky, legally, and that the developer has already
offered $25,000 to assist in relocation. The City is still negotiating with the developer.
Kubby noted that a condition on the rezoning would have to be agreed upon by the developer.
Murray pointed out the many variables involved with this, including the need to consider
where the Towncrest residents want to live and if they can afford it. Milkman stated that the
City Council has yet to address the topic,

Martin moved to recommend approval 01 the amended 1993 CDSG Budget Revision to City
Council. Murray seconded the motion, The motion carried 10-0.
AFFORDABLE HOUSING COMMUNITY OUTREACH:
Milkman suggested postponing this discussion in light of the City Council's decision which
resulted in a request for Staff to come up with strategies to address this issue. Martin
inquired about other communities' response to the problem of locating affordable housing.
Dennis encouraged everyone to read the linal draft of the CHAS. Further discussion of this
topic was postponed until the November meeting.
COMMUNITY DEVELOPMENT WEEK:
Milkman stated that our annual Community Development Week will be coming up in April,
1994. Dennis asked for volunteers for the subcommittee. Dennis, Murray and Llbants said
they would volunteer to take the lead. '
MONITORING REPORTS:
Murray reported that although there have been many inquiries about the Downpayment
Assistance Program, there were no applicants. The problem seems to be misinformation
about the program among loan olficers. Nasby stated that a citizen inquired about the
program that alternoon because the bank told the applicant the program wad not funded.
Martin suggested putting the Information about the Downpayment Asslstence Progrem in the
newsletter thet accompanies the water bill. It was pointed out that primarily homaowners
receive water bills, but the newsletter should be made available to everyone. Milkman said
there would be another push to inform lenders about the program. '
Feenev reported on the Mayor's Youth Employment Program. She stated that MYEP has
started training youth in business development lor the "We Deliver" program. CDSG lunds

SPECIAL EXCEPTION ITEMS:
1. EXC93-0023. Public hearing continued from the October 13, 1993, Board meeting on
a request submitted by Lesle Greb to amend a special exception approved on June 9,
1993, permitting a residential use on a nonconlormlng lot of record for property
located in the RS-5 zone at 1334 E. Davenport Street. '
Rockwell distributed revised elevations and a site plan that she had received from the
applicant Just prior tll the special meeting,
PUBLIC DISCUSSION:
Lesle Greb, 528 N. Dubuoue Street, exhibited the new site plan and elevations. Greb
described a discussion with a neighboring property owner, Mr. Millar, who expressed
a preference for the two car garage option. Greb felt It was important for everyone
to get together and figure out e solution that evaryone could live in accord with. On
Saturday, October 23, Greb met with Mr. and Mrs. Miller, Mr. and Mrs. Rittenmeyer,
and Mr. and Mrs. Rogers. The Millers, Rlttenmeyers and Rogers submitted a letter that
stated their agreement with the plan for the recessed, two door gerage located
underneath the Reno-Berg house.
Following the October 13, 1993, Board meeting, Greb contacted Dick Kruse, who Is
listed In the WHO Book for Historic Preservation and Restoration. Greb said Kruse
advised her on how to Change the two car plan and creete a one car plan. In response
to Eckhardt's comments etthe October 13, 1993, Board meeting, she stetad they tried
to achieve the goal of having the garage doors In alignment with the upper, historic
portion of the house. In addition, Greb stated the garage In the revised elevations Is
recessed on the left-hand (west) side ebout four leet, which foliows the original porch-
line. Greb noted she had worked with a lot of people on this to come to a position of
agreement. She hoped that the plan would be approved.

Dick Kruse, 150 East Court Street, said that the previous Friday, Greb had called him '
with some concerns about the project. Alter visiting the proposed site and the house
at its present location, Kruse stated he and Greb met and worked on some solutions.
Kruse noted that the Reno-Berg structure was historic and has some interesting
features. He stated thet it was nice to see this type of structure being preserved.

Kruse emphasized that the structure happens to be a fairly narrow house: the widest
part of the house Is 28 feet wide which leaves about 32 feet of available side yard
space. For most of the house there Is about 36 feet of total side yard area, which
would give the house a very wide-open setting. Kruse felt that was a lairly favorable
advantage for the Reno-Berg house and this particular site coming together.

Kruse noted the issue of the one or two car gerage seemed to be the main point of
discussion. Kruse said that he understood that Greb desired a two car garage. Kruse
noted that this was basicelly updating the house so that it would be usable in today's
world. Kruse said Greb Is living In the house now and Intends to reuse some of the
original foundation stones for retaining walls. Kruse stated this could be not only an
exciting project, but a very nice looking project as well. Kruse said it could be very
positive to the overall neighborhood.

Kruse said he and Greb had tried to look at the details and resolve some of the Board's
concerns. Kruse stated the lirst thing done was to center the east garage door below
the two windows on the gable end that comes forward; the other door, thay tried to
recess back a few feet. Kruse noted that the recessed portion would actually be only
a foot behind the line of the original front porch. Kruse pointed out the "man door"
behind the stairway on the basement level of the one car garage elevation.

Kruse said they tried to minimize the Impact of a big driveway by Including tha
sidewalk that runs along the west edge to run flush with the surlace of the driveway
so that It can be driven on; to aid backing out of the garage. Kruse said, without
making too much of an Issue out it, the driveway was fairly difficult to handle so that
there was sufficient drainage from the house to the street. Kruse stated they also
moved the location of tha house back on the site about 8 feet so there would be more
maneuverability for cars. Kruse said the single door situation would make it necessary
to have more maneuverability room for cars.

Kruse stated they tried to do an approach so that Greb, who understands and likes
landscaping, can develop some Interesting spaces on the property. Kruse said Greb
agreed that the approech of the garage on the front Is considerably better then putting
a gerage to the rear of the property, especially II It were a two car garage. Kruse
stated he felt the gerage underneath the house was a lot better land use. Kruse lelt
this solution answered some of the questions raised; that the plan was daslrable end
useble to Grab. Kruse noted that they tried to preserve the trees on the present site
and not have to do a lot of regrading. He thought they had been successlul.

Eckhardt asked if Kruse felt the two car garage was most lea sible for the house.
Kruse replied that today no one builds one car garages. Kruse seid he had not workad
on a one car garage at all in his practice. Kruse noted he doesn't do a lot of residential
work, but once he was called upon to expand a one car garage Into a two car garage,
Kruse said that in today's world, the automobile Is a fact of IIle, Even though the
Reno-Berg house is an 1880s structure, the house Is in a dilferent time now and It can
be made to work and be useful In the transition. Kruse said its a 1500 square loot
house and most other houses of that size have two car garages. Kruse exprassed his
appreciation for the opportunity to talk with the Board and hoped the V would approva
the plan.
Susan Roaers. 1340 East Davenoort, said she would like to give her support at this
time for the two car garage with the offset design as shown today. Rogers said the
group 01 naighbors that signed the letter fait the design suited the house and it also
satisfied Greb's concern for safety. Rogers felt the two car gerage would maka the
property more desirable to future owners. Rogers said the lot was a difficult one to
move a house onto, but the preferrad design would be the best lor the neighborhood.
Adrian Rlttenmever. 1402 East Davenoort, relerred the Board to the letter from the
neighbors. Rittenmeyar emphasized that since the project appeared to be going
through, the neighbors would preler the two car garege.
BOARD DISCUSSION:
Vogelzang commented that this was the third meeting on the Issue. He thought that a lot of
past discussion had gotten away from the seven standards for decisionmaking. Vogeizang
said it was important to hear Input from the neighbors. But after reviewing the seven
standards, he lelt only the second standard had been at issue, that Is, whether it would be
injurious to the use and enjoyment of other property in the Immediate vicinity. Vogelzang said
he thought that the applicant had gone way bayond and above board to be considerate to the
nalghborhood. He stated he was more than In favor to allow the two car garage and gat the
house moved onto tha lot.
Eckherdt stated she agreed with Vogelzang. Although it may be aesthetically mora pleasing
to have a one cer gerage that looks better, the two cer garage Is a more practical solution for
future use. Eckherdt noted saving the house islmportent. She egreed that the applicant hed
gone out of her wav to please the neighbors and satisfy all the requirements. Vogelzang
added that the alignment 01 the garage doors with the upper historic portion of the structure
made the plan look great.
Baker said he was not going to make anv aesthetic Judgments, but noted he was glad to see
that some of the neighbors had joined In support of the applicant. That made the Board's
decision easier.

Vogelzang moved approval of an amendment to the June 9, 1993. Board decision approving
EXC93.0011, a special exception to parmit a single-family residential usa on a lot of racord
that is the south 125 foot portion of the 1333 Cedar Street property, now designated as
1334 East Davenport Street. subject to conformance with the site plan and elevation
submitted on October 20, 1993, illustrating the recessod, two car gerage design.
Conformance with the site plan, includes the retention and planting of trees as shown on the
site plan and tha placement of the residence a minimum of 27 feet from the Davenport Street

EXC93.0025. Public hearing continued from the October 13, 1993, Board meeting on
a request submitted by New Pioneer Co-op for a special exception to permit parking
on a separate lot for property located in the CB-2 zone at 20 S. Van Buren Street.
Rockwell statad she had discussed tha New Pioneer parking request with City staff,
Including Joe Fowler who is in charge of parking for the City. Rockwell stated the
Zoning Ordinance does permit parking on a separate lot within a municipal parking
facility if available capacity exists. Rockwell said that according to Joe Fowler, the
capacity was present to satisfy the New Pioneer request. II there was a naed to
increase the capacity for short-term parking, the City could diminish the number of
long-term parking permits issued. Rockwell said City policy encourages short-term
metored parking in municipal parking facilities to satisly parking requiremants In the
CB-5 and CB-10 zones. It would be consistent to apply that policy to the CB-2 zone,
a near downtown commercial district.
Staff recommended approval of EXC93-0025, the requested exception to permit one
required off-streat parking space to be provided on a non.designated. metered basis
in the Chauncey Swan municipal parking ramp to serva a 352 square foot expansion
of an office use at 20 S. Van Buren Street.

satlsfv the criteria. He lelt comfortable approving it.
Galer noted the change In the kind of parking space to a metered space made a lot of
diflerence. Galer asked about the effect If the use 01 20 S. Van Buren changed.
Bormann said the Board could limit Its approval to New Pionaer, but staff had
racommended not limiting It. Once tha building Is axpanded for an office use, and

BOARD INFORMATION:
Rockwell complimented the Board/s handling of the very difficult issues at the last two
meetings. Rockwell stated she felt the Board members had been patient and
discerning In the way thay handled public comments and sorted through the issues.
