AN ORDINANCE AMENDING CHAPTER 36 OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, ENTITlED "ZONING" BY PERMITTING NON.HARD SURFACED AISLES AND DRIVEWAYS FOR SINGLE.FAMILY AND DUPLEX DWELLINGS WHICH ACCESS WOODLAWN AVENUE OR NON.HARD SURFACED ALLEYS. WHEREAS, the City Council deems it appropriate for slngle.family dwellings and duplexes which access non.hard surfaced allays to use non.hard surfaced drives or aisles; and WHEREAS, utilizing non.hard surfaced driveways to access Woodlawn Avenue will maintain the historic integrity of that area. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: SECTION I. AMENDMENT. A. Chapter 36, Article I entitled "GENERAL", Section 36.4 entitled "Dafinitions" of the Code of Ordinances of the City of Iowa City, Iowa, Is hereby amended by repealing subsection (a1l61 and adopting a new subsection (aIl6) to read as foilows: (a)(61. AND FOR CABLE PROGRAMMING SERVICE TIERS AND RELATED EQUIPMENT. WHEREAS, on October 5, 1992, the United States Congress enacted the Cable Television Consumer Protection and Competition Act of 1992, which Act provided that the basic service tier rates and the charges for related equipment. instellation and services of a cable television system shall be subject to regulation by e franchising authority according to regulations prescribed by the Federal Communications Commission ("FCC"I: and WHEREAS the City of Iowa City ("the City") is a franchising authority and has the legal authority to administer and shall enforce against any non,munlclpally owned cable television system operator, as permitted therein. the provisions of Part 76, Subpart N of the Rules and Regulations of the FCC. concerning Cable Rate Regulation, 47 C.F.R. ! H6.900 ~ sec.. as they currently read and hereafter may be amended, which are herewith Incorporated by reference; and WHEREAS, the City has filed with the FCC the required Certification form (FCC Form 328) on September 22, 1993; and WHEREAS. the City shall regulate the Basic Service Rates and Charges of Cablevlsion VII, Inc., and any other franchisee hereafter operating in the City, and shall do so In accordance with the FCC Rate Regulations; NOW, THEREFORE, BE IT ORDERED BY THE COUNCil OF THE CITY OF IOWA CITY, IOWA, AS FOllOWS: Section 1. The public notice shall contain a statement that cable television rates are subject to municipal review and shall explain the nature of the rate review in question; that any interested perty has a right to participate In the proceeding; that public views may be submitted In the proceeding, expleinlng how such public views are to be submitted and the deadline for submitting such views; that a decision concerning the reasonableness of the cable television rates in question will be governed by the Rules and Regulations of the Federal Communlcetlons Commission ("FCC"); and that the decision of the City is subject to review by the FCC. c. The City shall conduct a public proceeding to determine whether the rates or proposed rate Increase are reasonable. The City may delegate the responsibility to conduct the proceeding to the Iowa City Broadband Telecommunications Commission ("BTC"I or to any duly qualified and eligible Individual or entity. If the City or its designee cannot determine the reasonableness of a proposed rate increase within the time period permitted by the FCC Rules end Regulations, It may toll the effective date of the proposed rates for an additional period of time as permitted by the FCC Rules and Regulations, and may Issue any other necessary or appropriate order end give Public Notice accordingly. d. In the course of the rate regulation proceeding, the City may request additional Information from the cable operator that Is reasonably necessary to determine the reasonableness of the basic service tier retes and equipment charges. Any such additlonel Information submitted to the City shall be verified by an appropriate official of the cable televlsloll system superVising the preparation of the response on behalf of the entity, and submitted by way of Affidavit or under penalty of perjury, stating that the response Is true and accurate to the best of that person's knOWledge, Information and belief formed after reasonable Inquiry. Furtharmore, said proprietary information may ba used only for the purpose of determining the reasonableness of the rates and charges or the appropriate rate level submitted by the cable operator. The City may exercise all powers undar the laws of evidence appilcable to administrative proceedings under the laws of the State of Iowa to discover eny Information relevant to the rate regulation proceeding. including, but not limited to, subpoene, interrogatories, production of documents, and depositions. e. Upon termination of the rate reguiation proceeding, the City shail adopt and release e written decision whether the rates or proposed rete increase are reasonable or unreasonable, and, if unreasonable, its remedy. including prospective rate reduction. rate prescription, and refunds. f. The City may not impose any fines, penalties. forfeitures or other sanctions, other than permitted by the FCC Rules and Regulations, for charging an unreasonable rata or proposing an unreasonable rate incraase. However. the City may impose fines or monetary forfeitures on a ceble operator that does not comply with a rate decision or refund order of the City, directed specificaily at the Cable Operator, pursuant to the laws of the State of Iowa and the Iowa City Code of Ordinances. g. Consistent with FCC Rules and Regulations, the City's decision may be reviewed only by the FCC. h. The City shail be authorized, at any time, whether or not in the course of a rate regulation proceeding, to gather Information as necessary to exercise Its Jurisdiction as authorized by the laws of the State of Iowa, the Communications Act of 1934, as amended, and the FCC Rules and Regulations. Any Information submitted to the City shail be verified by an appropriate official of the ceble television system supervising tha preparation of the response on behalf of the entity, and submitted by way of Affidavit or under penaity of perjury, stating that the response Is true and accurate to the best of that person's knowledge, Information end beilef formed after reasonable Inquiry. With regard to the cable programming service tier, as defined by the Communications Act of 1934. as amended. and the FCC Rules and Regulations, and over which the City Is not empowered to exercise rate regulation, the cable operator shall give notice to the City of any change In rates for the I cable programming service tier or tiers, any , change In the charge for equipment required to ~ receive the tier or tiers. and any changes In the ! ~ nature of the services provided, including tha I program services Included In the tier or tiers.
