AN ORDINANCE AMENDING THE ZONING
ORDINANCE BY CONDITIONALLY CHANGING
THE USE REGULATIONS OF 7.B6 ACRES OF
LAND lOCATED AT 2312 MUSCATINE
AVENUE, IOWA Cn;y, ,IOWA, FROM RFBH.
RESIDENTIAL FACTORY BUilT HOUSING, TO
CC-2, COMMUNITY COMMERCIAL.
WHEREAS, Towncrest Mobile Home Court
and Sales Co., Inc., the Owner, and First
Muscatine Properties Inc., the Contract
Purchaser (herelnaher 'applicant') have
requested that the City rezone 7.B6 Acres of
land located at 2312 Muscatine Avenue, Iowa
City, Iowa, from RFBH, Residential Factory
Built Housing, to CC-2, Community
Commercial; and
WHEREAS, the subject property Is located
adjacent to an existing area of commercial
development; and
WHEREAS, the City deems it appropriate to
expand the existing commercial area If the
applicant provides buffering between the
proposed commercial use and adjacent
residential uses and if concerns regarding
traffic improvements, the provision of
alternative housing for the current tenants of
the mobile home court, and site design can be
addressed; and
WHEREAS, Iowa law provides that the City
of Iowa City may Impose reasonable conditions
on granting applicant's rezoning request, over
and above existing regulations, to satisfy public
needs directly caused by the requested change;
and
WHEREAS, the City wants to ensure that
adjacent streets can accommodate traffic
generated from the proposed commercial use of
the property and to ensure 'a proper transition
between the proposed commercial use of the
subject property and adjacent residential uses;
and
WHEREAS, the applicant has agreed to the
terms and conditions of the Conditional Zoning
Agreement, attached hereto and incorporated
by this reference; and
WHEREAS, the applicants acknowledge
that the terms and conditions contained In the
Conditional Zoning Agreement are reasonable
to Impose on the, land under Iowa Code
1414.5(1993) and satisfy public needs directly
caused by the requested zoning change; and
WHEREAS, In voluntary cooperation with
the City, the applicant offered to provide partial
funding for a program to assist the current
tenants of the area to secure alternative
housing,

NOW, THEREFORE, BE IT ORDAINED 8Y
THE CITY COUNCil OF THE CITY OF IOWA
CITY, IOWA, THAT:
SECTION I. APPROVAL. Subject to the terms
and conditions of the attached Conditional
Zoning Agreement as authorized by 1414.5,
Code of Iowa (1993), the property legally
described below Is hereby reclassified from its
present classification of RFBH, Residential
Factory Built Housing, toCC.2, Community
Commercial.
Commencing at a point 3.52 chains East of
the southwest corner of the NW 1/4 of Sec.
13, Twp. 79 N., R. 6 West of the 5th P.M.
thence east 269.2 feet, thence north parallel
with the west line of said Section 1321 feet,
thence northwesterly 269.B feet to a point
1352 feet due north of the beginning, thence
south 1352 feet to the place of beginning,
containing 8.26 acres, more or less, except
commencing 1081 feet north of a point 3.52
chains east of the southwest corner of the said
NW 1/2 of Section 13, thence north easterly to
a point In the north line of the tract above
described, that is 19.1/2 feet easterly from the
northwest corner of said tract, thence
northwesterly 19.1/2 feet to e point that is

SECTION II, ZONING MAP. The Building
Inspector is hereby authorized and directed to
change the zoning map of the City of Iowa
City, Iowa, to conform to this amendment upon
the final passage, approval and publication of
this Ordinance as provided by law.
SECTION III. CERTIFICATION AND
RECORDING. The Mayor is hereby authorized
and directed to sign, and the City Clerk to
attest, the attached Conditional Zoning
Agreement. The City Clerk is further
authorized and directed to certify a copy of this
Ordinance and the Conditional Zoning
Agreement which shall be recorded by the
applicant at the Office of the County Recorder
of Johnson County, Iowa, upon final passage
and publication as provided by law.
SECTION IV, REPEALER. AIi ordinances and
parts of ordinances In conflict with the
provision of this Ordinance are hereby repealed.
SECTION V, SEVERABILITY. If any section,
provision or part of this Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provIsion
or part thereof not adjudged invalid or
unconstitutional.
SECTION VI. EFFECTIVE DATE. This
Ordinance shall be In effect after its final
passage, approval and publication, as required
by law.

THIS AGREEMENT is made by and between the City of Iowa City, Iowa, a Municipal Corporation
(hereinafter "City"), Towncrest Mobile Home Court and Sales Co, Inc, (hereinafter "Owne(') and
First MuscaUne Properties Inc, (hereinafter "Applicant"),
WHEREAS, the Applicant has contracted to purchase the property located at 2312 Muscatine
Avenue, Iowa City, Iowa; and
WHEREAS, Applicant, as contract purchaser and Owner, as legal tiUe holder, have requested
the City to rezone the 7,86 acres of land located at 2312 Muscatine Avenue, Iowa City, Iowa, from
RFBH, Residential Factory Built Housing, to CC.2, Community Commercial; and
WHEREAS, Iowa Code ~ 414.5 (1993) provides that the City of Iowa City may impose reasonable
conditions on granting the rezoning request, over and above existing regulations, to satisfy public
needs directiy caused by the requested change; and
WHEREAS, Owner acknowledges that certain conditions and restrictlon~ are reasonable to
ensure appropriate commercial development adjacent to residential neighborhoods in Iowa City
and ensure adequate traffic circulation.
NOW, THEREFORE, In consideration of the mutual promises contal~ed herein, the Parties agree
as foilows:
1. Towncrest Moblie Home Court is the owner and legal titie holder of the property located at
2312 Muscatine Avenue, Iowa City, Iowa, legally described as follows:
Commencing at a point 3,52 chains East of the southwest corner of the NW 1/4 of Sec,
13, Twp. 79 N" R. 6 West ofthe 5th P.M, thence east 269,2 feet, thence north parallel with the
west line of said Section 1321 feet, thence northwesterly 269,6 feet to a point 1352 feet due
north of the beginning, thence south 1352 feet to the place of beginning, containing 6,26
acres, more or less, except commencing 1061, feet north of a point 3,52 chains east of the
southwest comer of the said NW 1/2 of Section 13, thence north easterly to a point In the
north line of the tract above described, that is 19.1/2 feet easterly from the northwest corner
of said tract, thence northwesterly 19.1/2 feet to a point that Is 271 feet due north of point of

2. Applicant Is contract purchaser and equitable title holder of the property.
3. Applicant and Owner acknowledge that the City wishes to ensure appropriate commercial
development adjacent to residential neighborhoods and adequate traffic circulation, and
therefore, agree to certain conditions over and above City regulations to lessen the impact of
the commercial development on the area.
.3, In consideration of the City's rezoning the subject property from RFBH, Residential Factory
Built Housing, to CC.2, Community Commercial, the Applicant and Owner agree that develop-
ment and use of the subject property will conform to the requirements of the CC.2 Zone, as
well as the following additional conditions:
a. Applicant and Owner will grant access easements across the subject property to owners
of the James and Hansen properties to provide access to First and Muscatine Avenues.
b. The applicant will relocate the curb cut and driveway on Muscatine Avenue to align with
Wade Street, if and when the James property to the west redevelops.
c. Applicant and Owner will dedicate an additional 71\2 feet of rlght.of.way for First Avenue
and additional 7 feet of rlght-or-way for Muscatine Avenue.
d. The Director of Planning and Community Development must epprove a concept plan,
Including building elevation drawings and a landscaping plan prior to site development.
The concept plan shall include provisions for landscape buffers between the proposed
development and the existing residential development to the north and east of the subject
property,
e. Applicant and Owner will establish a pedestrian access easement adjacent to Ralston
Creek. The parties shall determine the location of the pedestrian access area at the time
of concept plan approval.
f. The Applicant and Owner shali relocate the existing storm sewer line located under this
property so that it does not conflict with any proposed structures, Applicant and Owner
shail grant an easement over the relocated line.
4. The Parties acknowledge that the Applicant has agreed to provide $25,000 for relocation
assistance for the current residents of the Towncrest Mobile Home Park and $45,000 for the
cost of upgrading the intersection of First and Muscatine. The Parties further acknowledge that
if the City grants tax abatement to Applicant for redevelopment of the subject property, the
Applicant will provide relocation assistance not to exceed $67,000 at the completion of the
rezoning and will provide $117,000 toward the cost of the Intersection improvements at the
time the improvements occur.
5. Applicant and Owner acknowledge that the conditions contained herein are reasonable
conditions to impose on the land under Iowa Code s 414.5 (1993), and that said conditions
satisfy public needs which are directiy caused by the requested zoning change.
6. Applicant and Owner acknowledge that in the event the subject property is transferred, sold,
redeveloped, or subdivided, ali redevelopment will conform with the terms of this Agreement.
7. The Parties acknowledge that this Agreement shail be deemed to be a covenant running with
the land and with titie to the land, and shall remain In full iorce and effect as a covenant
running with the tllle to the land unless or until released of record by the City. The Parties
further acknowledge that this Agreement shall inure to the benefit of end bind all successors,
representatives and assigns of the Parties,
8. The Applicant and Owner acknowledge that nothing In this Agreement shail be construed to
relieve the Applicant from complying with all eppllcable local, state and federal regulations.
9, The Parties agree that this Conditional Zoning Agreement shall be Incorporated by reference
into the Ordinance rezoning the subject property; and that upon adoption and publication of
the Ordinance, this Agreement shall be recorded In the Johnson County Recorder's Office.

Thank you for your assistance with Systems unlimited, Inc. 's
proposed zoning ordinance amendment. I, appreciate your
professionalism and prompt response time.
I would like to ask that the City of Iowa City Council consider our
request to handle the zoning ordinance in an expedited manner. We
will close on November 30th on the house at 1305 Brookwood Drive
and we will have two clients and one staff person move into the
house in December. Until the zoning ordinance is approved, we will
not be able to move in the third client. This will present a bit
of a financial burden to us since we will only be reimbursed for
two clients rather than the budgeted three clients.
Any consideration to expedite this zoning ordinance amendment would
be greatly appreciated.

Community Supervised Apartment Living Arrangements
Per the Commission's direction at your November 4, 1993, meeting, you will find a proposed
emendment to the Zoning Ordinance definition of "family care facility/family home."
Commissioners will recall that this ordinance amendment is requested by William Gorman,
Executive Director of Systems Unlimited Inc., to enable him to acquire an accessible dwelling
for three adults with disabilities end a live-in counselor in the City's lower density single-family
residential zones. The RS-5, RS.8 and RFBH zones allow three unrelated individuals to live
together but not four people es proposed by Mr. Gorman in his October 22, 1993, letter to
Mayor Courtney (attached).
The type of living arrangement proposed by Mr. Gorman is regulated by the lowe Code and
the Iowa Administrative Code es e "community supervised apartment living arrengement."
The providers of these homes ere obliged to meet the core standards imposed on all providers
of mental health, mental retardation and developmental disability services, as well as the
minimum eccreditation requirements for community supervised apartment living arrengements.
A copy of these latter requirements is attached for your information.
Licensed family care facilities are permitted by right in the PRM, Planned High Density Multi-
Family Residential, Zone, and as provisional uses in all of the other residential zones. The
Stete standards end requirements imposed on community supervised apartment living
arrangements ere intended to encourage the availability of a normalized living environment for
persons within the program and are expected to make the homes indistinguishable from other
homes In the City's residential neighborhoods. As a result, these dwellings are expected to
be compatible with other homes within the community.
STAFF RECOMMENDATION:
Steff recommends that the definition of "family care facilitylfamily home" be amended to
Include "community supervised epertment living arrangements" regulated under Chapter 225C
of the Code of lowe (1993) and Chapter 24 of the Iowa Administrative Code.

the plecement of manufactured homes, mobile homes and modular homes on lee sed

(4) Farm. An area of not less than 10 acres for which the principal use is the growing for
sale of farm products such as vegetables, fruits, and grain and their storage on the
land. The term "farm" includes the necessary accessory uses and buildings for treating
and storing the food produced.
(5) Feedlot. A lot, yard, corral, or other area in which livestock are confined, primarily for
the purposes of feeding and growth prior to slaughter. The term does not include
areas which are used for the raising of crops or other vegetation and upon which
livestock are allowed to graze or feed.

(6) Filling station. Any building or premises used for the dispensing or retail sale of motor
vehicle fuel or oil. When the dispensing or sale is incidental to the operation of a
commercial garage, the premises shall be classified as a commercial garage.

(7) Financial institution. An establishment for the receiving, keeping, lending of money,
and the exchange of funds by checks or notes, including banks, savings and loans,
credit unions, and similar establishments.
(7.1) Fitness centers and health spas. Facilities used primarily for physical exercise end
wellness programs and which include but are not limited to gymnasiums, aerobic
studios, weight lifting centers, racquetball courts, tennis courts and Jogging trails.
(8) Floor area. The total erea of all floors of e building or portion thereof measured to the
outside surface of exterior wells or the centerline of walls to ettached buildings or
uses. It does not include gareges, porches, balconies, and other appurtenances.
Space in the basement or cellar and all other space shell be included as floor area if
used for a principal or accessory use permitted in the zone in which the building is
located.

Dear Mr. Courtney:
As you probably are aware, Systems Unlimited provides a variety of
services for citizens with developmental disabilities in Iowa City.
'However, you may not be aware that we spend over $200,000 per year
, in rent for apartments so that our clients can live in normal
settings and the least restrictivd environment.
We have recently decided that the purchase of an accessible home
for three adults with disabilities and a live-in Counselor would be
a long term solution to our chronic problem of providing suitable,
affordable housing'in Iowa City.
In pursuing this strategy, we found that the Zoning Ordinance as it
is now written will not allow us to provide services in a house
located in a residential area that is zoned RS5 or RS8. A house
with four unrelated adults does not meet the definition of a group
care facility (section 36-4 (g) (6)) or a family care
facility/family home (section 36-(f) (3)) . The latter section most
closely describes the services we provide, except that these
services are ,not licensed, but are approved and regulated under
Chapter 36 of the State Code which is titled "Community Supervised
Apartment Living Arrangements".
We ask that we be placed on the agenda for the next working session
of the City Council to explain the need for a minor, but very
important change to the City'S zoning Ordinance. While we are not
lawyers nor expert in zoning matters, it seems that the addition of
the phrase "a Community Supervised Apartment Living Arrangements
under Chapter 36" to section 36- (f) (3) of the zoning ordinance
would allow us and other providers to provide housing in
residential areas zoned for single family dwellings.
We are sure that the zoning Commission did not mean to prohibit the
provision of services to the disabled in a normal, single family
dwelling when the ordinance was drafted and passed into law. But
the effect of the ordinance is that providers are prohibited. The

Attached is a request mada by William Gorman, the Exacutive Director of Systems Unlimited
Inc., that the Iowa City Zoning Ordinance definition of "family care facilities/family home" be
amended to include a "community supervised apartment living errangement." This request
is prompted by Mr. Gorman's interest in ecquiring an accessible dwelling for three adults with
disebilitias and a Iive.in counselor. In tha RS.5, RS.8, and RFBH zones, only up to thrae
unrelated peopla may live together in a dwelling. These three zones preclude the living
arrangement suggested by Mr. Gorman. In the othar residontial zones, at least four (4)
unrelated adults may live together in a detached dwelling unit.
Femily care facilities are permitted by right in the PRM, Planned High Density Multi-Family
Rasidential, Zone, and as a provisional use in all of tho other residential zones. By emending
the definition of family care facility/family home, as described by Mr. Gorman, housing could
be sought in any of the residential zones for residents with disabilities who need some
assistence but do not require the level of care and supervision provided in e licensed
residential care facility.
The question before the Commission for your deliberation on November 1 and 4 is whether
the Commission wishes to consider this Zoning Ordinance emendment. If the Commission
wishes to do so, the Commission must decide when the staff should have amendments
prepered for your consideration. This decision should be made in the context of the
Commission's pending list which is located behind tha agenda included in the meeting packet.
Staff will be present at your November 1 end 4 meetings to answer eny questions you may

As you probably are aware, Systems Unlimited provides a variety of
services for citizens with developmental disabilities in Iowa City.
However, you may not be aware that we spend over $200,000 per year
in rent for apartments so that our clients can live in normal
settings and the least restrictivd environment.
We have recently decided that the purchase of an accessible home
for three adults with disabilities and a live-in Counselor would be
a long term solution to our chronic problem of providing suitable,
affordable housing in Iowa City.
In pursuing this strategy, we found that the Zoning Ordinance as it
is now written will not allow us to provide services in a house
located in a residential area that is zoned RS5 or RS8. A house
with four unrelated adults does not meet the definition of a group
care facility (section 36-4 (g) (6)) or a family care
facility/family home (section 36- (f) (3)) . The latter section most
closely describes the services we provide, except that these
services are ,not licensed, but are approved and regulated under
Chapter 36 of the State Code which is titled "Community Supervised
Apartment Living Arrangements".
We ask that we be placed on the agenda for the next working session
of the City Council to explain the need for a minor, but very
important change to the City'S Zoning Ordinance. While we are not
lawyers nor expert in zoning matters, it seems that the addition of
the phrase "a Community Supervised Apartment Living Arrangements
under Chapter 36" to section 36- (f) (3) of tha zoning ordinance
would allow us and other providers to provide housing in
residential areas zoned for single family dwellings.
We are sure that the Zoning Commission did not mean to prohihit the
provision of services to the disabled in a normal, single family
dwelling when the ordinance was drafted and passed into law. But
the effect of the ordinance is that providers are prohibited. The

(1)(1) Factory.built housing park. A tract of land which has been planned and improved for
the plpcement of manufactured homes, mobile homes and modular homes on leased
spaces.
(2) Family. One (1) person or two (2) or more persons related by blood, marriage,
adoption or placement by a governmental or social service agency, occupying a
dwelling unit as a single housekeeping organization. A family may also be two (2), but
not more than two (2) persons not related by blood, marriage or adoption.
(3) Family care facility/family. home. A community.based residential home, which Is erl i

personal care, rehabilitation services, and supervision in a family environment by a
resident family for not more than eight (8) developmentally disabled persons.
However, family care facility does not mean an individual foster care family home
licensed under Chapter 237.
(4) Farm. An area of not less than 10 acres for which the principal use Is the growing for
sale of farm products such as vegetables, fruits, and grain and their storage on the
land. The term "farm" includes the necessary accessory uses and buildings for treating
and storing the food produced.
(5) Feedlot. A lot, yard, corral, or other eree in which livestock are confined, primarily for
the purposes of feeding end growth prior to slaughter. The term does not include
areas which are used for the raisIng of crops or other vegetation and upon which (
livestock are allowed to graze or feed.
(6) Filling station. Any building or premises used for the dispensing or ret~i1 sale of motor
vehicle fuel or oil. When the dispensing or sale Is incidental to the operation of a '
commercial garage, the premises shall be classified as a commercial garage. i

(7) Financial institution. An establishment for the receiving, keeping, lending of money, I
and the exchange of funds by checks or notes, including banks, savings and loans,
credit unions, end similar establishments. ' I

(7.1) Fitness centers and health spas. Facilities used primarily for physIcal exercise end I
wellness programs and which include but are not limited to gymnasIums, ae'roblc
studios, weight lifting centers, racquetball courts, tennis courts and Jogging trails.
(8) Floor area. The total area of ell floors of a building or portion thereof measured to the
outside surface of exterior walls or the centerline of walls to attached buildIngs or
uses. It does not include garages, porches, balconies, and other appurtenances.

WHEREAS, the City Council deems It
appropriate for single.famlly dwellings and
duplexes which access non-hard surfaced
alleys to use non.hard surfaced drives or aisles;
and
WHEREAS, utilizing non-hard surfaced
driveways to access Woodlawn Avenue will
maintain the historic integrity of that area,
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCil OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I, AMENDMENT. A. Chapter 36,
Article I entitled 'GENERAL', Section 36-4
entitled 'Definitions' of the Code of Ordinances
of the City of Iowa City, Iowa, is hereby
amended by repealing subsection (a1l61 and
adopting a new subsection (a1l61 to read as
follows:
(aIl6). Aisle. An asphalt, concrete or
similar permanent dust.free surface
connected directly to a parking or loading
space and designed to permit ingress or
egress of a vehicle. For e single family
dwelling or duplax abutting and accessing

repealing subsection (c)(ll and adopting a new
subsection (c)(l) to read as follows:

stacking spaces, drives and aisles shall be
constructed of asphalt, concrete or similar
permanent dust.free surface, except for
drives end aisles serving single famllv
dwellings or duplexes which abut and
access Woodlawn Avenue or a non.hard
surfaced alley.
D, Chapter 36, Article III, Section 36.5B Is
further amended bv repealing subsection
(c)(3Ia,2 and adopting new subsection (c)(3)a,2
to read as follows:
(c)(3Ia.2. In all R zones and all zones
abutting an R zone, except for drives and
aisles serving zero lot line dwellings, drives
and aisles shall not be located closer than
three (31 foot to a lot line or an R zone
boundary unless the drives and aisles are
pitched or curbed and drained to prevent the
flow of water onto adjoining property or
unless a drainage course has been
established along lot lines for the purpose of
storm water runoff. Under no
circumstances may a non-hard surfaced
drive or aisle be located closer than three (3)
feet to a lot line or R zone boundary.
SECTION II, REPEALER. All ordinances and
parts of ordinances In conflict with the
provisions of this Ordinance are hereby
repealed,
SECTION III. SEVERABILITY. If any section,

Dear Council Members:
I support an ordinance which would require lawn care applicator to pre-notify
and make large visible post.application signs, There are compelling reasons
for my opinion. The health qonsequences of pesticide use among farmers and
pesticide applicators Is currently an area of intense research. The University of
Iowa is one of two sites which recently began a $15 million prospective study
Investigating this issue. Unfortunately, the results of this research will not be
available for five years or more, however the fact that the National Institutes of
Health and the National Cancer Institute have committed to a study of this size
suggests that there is significant medical concern,
On a personal note, I enroll In the pre-notification plan last spring and during the
summer received pre.notification. In September, while I was standing in my
yard and clearly visible, an applicator proceeded to spray my neighbor's lawn. I
received no pre. notification and the applicator said nothing to me during or after
the spraying. The Iowa Dept of Agriculture and Land Stewardship has taka an
affidavit fiOm me regarding the Incident, and I am waiting to hear the outcome. I
am aware of one other person on our end of town who filed a similar complaint.
From my experience and the stories appearing In the paper over the past few
years, It seems as if the lawncare company's have little concern for public
safety, and have brought on the need for ordinances which regulate their
activities.
Iowa City banned leaf burning several years ago primarily because of the
potential health risks. It seems appropriate that because of the potential health
risks associated with pesticides that we enact ordinances which inform citizens
of there presence.
