I D CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF A CHAPTER 28E AGREEMENT BETWEEN THE CITY OF CORALVILLE AND THE CITY OF IOWA CITY REGARDING CERTAIN FINANCIAL OBLIGATIONS INVOLVING THE RECONSTRUCTION OFU.S. HIGHWAY 6 FROM FIRST A VENUE IN CORALVILLE EASTERLY TO ROCKY SHORE DRIVE IN IOWA CITY. Comment: This agreement fixes Iowa City's share of the construction cost and indemnifies Iowa City from acquisition costs and legal actions arising out of the consolidation of properly access points. '14 - '1 Action:~J J ~.vJ / k~ CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN ADDENDUM TO A PRECONSTRUCTION AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION AND THE CITY OF CORALVILLE FOR THE DESIGN AND CONSTRUCTION OF THE U.S. HIGHWAY 6 IMPROVEMENTS PROJECT FROM ROCKY SHORE IN lOW A CITY TO FIRST A VENUE IN CORALVILLE. /M4J% Comment: This agreement amends the agreement approved by the City Council in November of 1992 for the paving and storm sewer improvements to Highway 6 from Rocky Shore Drive to First A venue in Coralville. Although the amended agreement does not provide the same financial assurances from the !DOT as the original agreement, the 28B Agreement with Coralville from the previous item reestablishs the assurances. Fossel This item is related to the next item on your agenda.If you recall for about a year or two ago we approved a pre- construction agreement with the DOT for the funding and construction of this project. Since then some DOT policies have changed regarding their acquisition of access rights and because of that they want us to approve an addendum to that pre-construction agreement. We were uneasy with the addendum because we felt that it left us open to certain liabilities. Coralville and some creative lawyering was willing to take on those liabilities to keep this project moving. We were relying solely on a verbal commitment from the DOT and for us that the stakes weren't high enough to go after it. But it is high enough for Coralville so they are taking on that liability there for us. Novl So we are basically agreeing to pay Coralville and they will pay the DOT. Fossel Un, huh. Yep. So our financial commitment for the construction of the improvements remains the same only it is funneled through Coralville. Horowj Any other questions. Discussion. Roll call-(yes) Before we take on item #4, the adjournment, I would just like to ask two things. NUmber one that between now and next meeting, the 18th, you consider your calendars for spring break because the March line up of meetings has us meeting on the 15th which is the day that we get back. Some of us get back from the Legislative Conference in Washington so I just wanted to brief you and make sure that you have your calendars and have thought about spring break. Karrl That means-the meeting right now is not scheduled for spring break. That is an option to move the meeting of the 15th to the next week. The following week is spring break. Okay. Horowl And the second item I would like to ask is we have a school safety committee jointly with the school board and Karen and I have been on this with Steve and Darrel. We would like -we don't need but we would like a third person to join this and I would be interested in whether anybody would like to go along with this. We essentially meet with the school board members of this committee plus the safety rep from the DPO, the District Parents Organization, and review the problems around the various schools and what the ' traffic engineering imaginations can possibly be done or anything else. It is essentially for the safety for the kids. We usually meet during the day. So far we have gone on a nUmber of tours during the day to take a look at the problem areas. Our schedules are definitely flexible because all of us have to find at least an hour during the day for that sort of thing. Novl It is usually late afternoon after school is out. Horow/ Yeah. So I will be getting in contact with you aSking you whether you would be willing to join that because next meeting I would like to set a date for getting together again. Okay. Kubby/ I have another item and that is about the pesticide ordinance and the timing of the legislature. We had agreed that we were going to look at it at the 18th and there has been some talk about COllapsing that and I wanted to make sure there were at least six people willing to collapse.
