Over the past schoolyear, the entire team at Public Access TV was of Invaluable assistance In providing an exemplary educational experience for my 60+ elementary students in the gifted program at Hoover School, They assisted wnh planning and preparation for our video experience, and then gave us major support in the filming and ednlng of a year-long grant project. Their team came in extra hours to accomodate our school schedule. Their expertise was Invaluable, and they were highly effective In dealing wnh grades 3-6 students, They did some field work with us as well, both at Hoover and around town. When we had deadlines to meet, they worked extra time to make sure we had what we needed. My students felt privileged to be featured on their weekly promotion, which highlighted our project for several weeks. Because of their assistance, we won a First Place award In the youth division of the 1.0.W,A. Video Festival, which of course thrilled our students and parents as well, When a TV production crew came from New York City to film us, the crew at PATV hosted us in their studio so we could get footage of how our partnership with them had proceeded. I hope that PATV is not In jeopardy of being cut, as there was so much that was possible for our project because we live in a communny which had the vision to Initiate such productive and creative options for Its townspeople and schools. We hope the PATV options will be there for the next time we have such a need. We feel that the reason we were funded for the grant In the first place was because we live In a community that Is known for Its sophisticated options. , 'J . We are compelled to continue to object to this proposed ordinance as it is currently written. Section 34-77 of the proposed ordinance defines the scope and purpose as follows: "In order to protect the health safety and welfare of the citizens of Iowa City, Iowa." As written, the proposed ordinance does not accomplish its goal at all. By ignoring homeowners and other users of pesticides, it leaves out the vast majority of applications that take place in Iowa City and therefore misses the mark. It actually discriminates against the professional applicators, who are trained, licensed and certified in the use of these products. National statistics indicate that trained, licensed professionals make only fifteen (15) percent of the product applications that take place. That leaves eighty five (85) percent, the overwhelming majority, to the untrained property owner and other individuals. Yet the proposed ordinance does nothing to address these untrained applications, but instead places additional burdens on the professional applicators who are already licensed and regulated by the Iowa Department of Agriculture and Land stewardship. Iowa Administrative Code Chapter 45.50 (1) already requires the commercial applicator to post a pesticide application. Chapter 45.50 (6) provides explicit requirements for the process and the composition of the sign. 'I I !I ii I' , " We, as business people, employers and citizens of the community of Iowa City would like to express our concerns regarding the proposed ordinance amending Chapter 34 of the Code of Ordinances of the City of Iowa City entitled 'Vegetation,' and more particularly, the new Article IV entitled 'Iowa City Commercial Application of Pesticides Ordinance', A minority of the Iowa City Council members have advocated the passage of this local pesticide ordinance for more than 1-1/2 years last past. In excess of $100,000 of City funds, taxpayer funds, has been spent in pursuit of passage of this special interest ordinance. If the Iowa Legislature follows the lead of many other states in this area, we may soon have legislation preempting the passage of any local ordinance regarding pesticide application. State preemption would render any local ordinance moot and further underscore the waste of taxpayer funds in pursuant of this local pesticide legislation. The proposed ordinance states as its purpose the protection of the health, safety and ,welfare of the citizens of Iowa City. The actual affect of this amendment is solely to provide for the regulation of commercial application of pesticides within the city limits of Iowa City, The proposed ordinance falls short of its stated purpose in that only commercial applicators (as defined in the ordinance) are regulated and the private applicator or homeowner remains unregulated and unsupervised in the application of pesticides to his or her property. The results of a 1991-92 National Gardening Survey conducted by the Gallup organization for the National Gardening Association indicates that 85% of the pesticides purchased for lawn application were purchased by homeowners as compared with 15% by professional pesticide applicators, Currently, commercial pesticide applicators must pass an examination regarding laws, safety, pesticides in the environment, pesticide application and integrated pest management to be licensed in the state. The commercial applicator must further pass 'examinations every three years to maintain its certification. In addition, commercial applicators must obtain four hours of continuing education credit each calendar year on the proper and safe use of pesticides. Should not pesticide application within buildings also be subject to pre- and post-notification requirements? The complexities of pesticide policy cannot be adequately addressed ~ local government. Legislation from the state level provides uniform notice requirements of pesticide application for everyone within the state. The state of Iowa currently has a set of laws and regulations in place to control the licensing of , commercial pesticide applicators and to monitor the application of these pesticides by the commercial applicators in the state of Iowa. Existing state and federal regulations and penalties provide the citizens of Iowa City the proper pre- and post- application notice of commercial pesticide application. Further, the,existing state and federal regulations and penalties give the same citizens relief for violations of pesticide application laws and adequately punish the commercial applicators who violate these laws and regulations. It has been over a year now that TCI has been allowing Channel 9 news to take over the last 5 minutes of the CNN program, This I find not only irritatin~ but also improper in that I am not getting what I pay for. I enjoy the last 5 mmutes and find it aggravating to be interested in a stol)' CNN says is commg up later (i.e. in the last 5 minutes) of the pro~ram, only to Wlllt and find that I get channel 9 instead. I can watch channel 9 for free, If I wish, and never do because I do not like them. Now I find myself paying for a forced channel 9 segment while missing the segment I want on CNNr I have tried dealing with TCI as well as asking Mr. Schaffer, the city administrator who handles such matters, to help, but nothing has been done in the year that I have tried to approach this, ' I will outline the violations, I feel, are being committed and explain why. It is a letter similar to which I wrote Mr, Schaffer. I feel that TCI is guilty of: 1. violating my contract with them 2, misrepresentation 3, improper billing. TCI is guilty of misrepresentation. They advertise that they provide CNN. People such as I si~n up to see CNN, but find, in fact, that they provide only 3/4 of the CNN format, which is major news, business and sports. For those of us who enjoy the miscellaneous stories, TCI does not deliver, If TCI cannot be stopped from stealing those 5 minutes, they should at least be required to have proper advertising, All of TCI's advertising pertaining to CNN, printed or otherwise (as well as the information meted out by their office personnel pertaining to their offering CNN), should be required to qualify that, in fact, they do not provide CNN in its entirety. I would like the commission to be aware of the fact that I asked TCI for a monthly adjustment on our bill to compensate for the portion of CNN we are not getting and they declined to do so, I question their right to charge me for something I am not getting. Is it legal? More troubling is the fact that I think it is very likely that TCI is getting paid twice for the same 5 minutes...once by me and again by channel 9. They win, I lose. Mr, Schaffer explained that the city was not allowed to interfere with programming, This is not interfering with programming but asking TCI to deliver what they promise and what they are charging for. In addressing this problem the city will be addressing just what are the limits of what a cable company can do and whether it will be held accountable to the public, Other lucrative proposals may come their way and the , encroachment could expand to other programs or in ways yet unknown, If the scenario were reversed, that is, ifTCI was not delivering thefirst 25 minutes of the CNN format yet advertised and charged as if they did, I believe the cable commission would immediately address the problem and consider the three charges I made valid. The last 5 minutes are no less significant. It is still a violation and as a matter of principle a precedent must be established, I feel it improper to be paying for something I am not getting, Your help with this matter will be greatly appreciated. I Included the language 'certified" in the definition 01 "commercial applicator,' In order to b& caria!n that the City can enlorce this Ordinance against employees, as well as the owner 01 the commercial applicator business, 2, The definition 01 "pesticide" has been clarified and simplified, note the strikeout portions In the definitions 01 'pesticide" and "plant growth regulator." This clarification simply points out that the typical yard or garden organic nutrients are not 'pestlcldes' under either state or local law: compost, peat, composted manure, bone meal, blood meal, ash, epsom salts, topsoil, 812 growth stimulator snd nitrogen. 3. Location snd placement 01 ths signs shall be according to state law, as lound in the Iowa Administrative Code. Both signs are a minimum 01 4 Inches by 5 Inches and must be 'contrastlng colors" with a type size of not less than 3/8 Inches, State location and spacing requirements are now a minimum 01 one sign In a front area within 2 . 51eet 01 the curb or sidewalk, and at leas\ one sign within 2 . 5 leet Irom a back lot line 11 unlenced. In order to assure unilormlty and avoid requiring two signs, I recommend that the City require the commercial applicators to use the already-approved language and logo attached hereto, as provided by Mr, Eckermann, Thus, the commercial applicators would have one sign which satisfied state requirements, and also satisfied City requirements - simply by being larger, I trust this will be 01 some assistance to you, and I will be available lor questions at the January 12 meeting, as needed. Green Company, consulting engineers; R, RAJAGOP AL, Professor, Geography and Civil and Environmental Engineering, The University ofIowa. Mr. Moreno has an MS in Civil and Environmental Engineering, He worked on water quality for the Iowa Department of Natural Resources 'and The University ofIowa water plant before joining the Iowa City water plant in 1987. Mr, Moreno will discuss Iowa City's current sources of water, treatment plant, treatment system, regulations, and problems. Mr. Russell has a BS in Civil Engineering and has worked for H,R. Green Company since 1969, He has been the chief administrative officer since 1983. As head of the water department, Mr, Russell has supervised the finn's work in water supply, distribution, storage, and treatment. H,R. Green Company has contracted with the City ofIowa City to provide recommendations for Iowa City's future water needs for both quality and quantity, Mr. Russell will discuss his investigations of groundwater sources, evaluations of our future needs, and recommended course of action, , Professor Rajagopal is a well-known expert locally and internationally for his research on water quality. He will give us a summary of his research in our community and his outlook for the future ofIowa City's water treatment to meet Environmental Protection Agency drinking water standards, * We will also try to provide a fourth panel member, an expert in methods of projecting quantities for future water usage planning, The League of Women Voters of Johnson County president, Kathy Penningroth, will be panel moderator and will provide some background on L WV national studies of water and the current League of Women Voters of the United States' position on water. There also will be time for questions and comments from the audience. Everyone who drinks Iowa City's water and/or pays for Iowa City's water will have an interest in the discussion at this meeting, Try to join us at 7:00 pm at the Iowa City Public Library on February 3 and bring a friend or two. If you cannot attend, watch for the video broadcast on cable television in subsequent weeks or borrow the videotape from the library.
