AN ORDINANCE VACATING THE NORTHERN
212 FEET OF THE ALLEY LOCATED BETWEEN
BURLINGTON AND COURT STREETS, WEST
OF DUBUQUE STREET (BLOCK 1021
WHEREAS, with tha redevalopment of tha
properties adjacent to the northern 212 faat of
the alley located between Burlington and Court
Streets, West of Dubuque Street (Block 102),
those properties will no longer require the alley
for access; and
WHEREAS, properties adjacent to the
southern portion of the alley will gain access
from the alley to Court Street If the City
rasclnds Ordinance No, 75.1771, vacating the
southern 97 feat of the alley,
NOW, THEREFORE, BE iT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION 1. VACATION. The City of Iowa
City hereby vacetes the portion of tha alley
located between Burlington and Court Streets,
Wast of Dubuque Straet (Block 102) legally
described as follows:
The northern 212 feet of the north,south
alley of Block 102 of the original' plat of
lowe City. Iowa.
SECTION II. REPEALER, All ordinances and
parts of ordinances In conflict with the
provisions of this Ordlnence era hereby
repealed.
SECTION III, SEVERABILITY. If any section,
provision or part of the Ordinance shell be
, adjudgad to be Invalid or unconstitutional, such
adjudication shall not affect the velldity of the
Ordinance as a whole or any section. provision
or part thereof not adjudged Invalid or
unconstitutional,
SECTION IV, EFFECTiVE DATE, This
Ordlnence shall be In effect after Its final
passage. approval and publication, as provided
by law,

Re: Value of North-South Alley In Block 102
I am responding to your request In regard to determining the value of a portion of the north-south
,alley In Block 102. This alley segment Is shown on the attached plat map,
In determining the value of a piece of land or Improved property, the method most commonly
utilized Is called the comparable market approach. Basically, this method compares the subject
property with other similar properties that have recently sold, making cost adjustments either
higher or lower for differences between the subject property and the property to which It Is being
compared. In this particular situation, a problem arises In finding sales of vacant land with a
similar location. I have checked the records and consulted with staff at the assessor's office, and
there are no recent sales of vacant land In the downtown area or central business district.
I have attached a list marked 'Exhibit A' of several sales that have occurred that are similar In
other aspects to the subject. As you will note, these parcels were all purchased by adjacent
property owners, The purpose of these purchases was to add a 'segment' of vacant land to an
already eXisting parcel. The locations of these parcels are south of the subject propertY and not
In the central business district area. Also, some of ,these sales are dated and a 5% adjustment
per year for Inflation would be quite reasonable, '
As I have mentioned In prevIous situations, the value of the subject property along with the ones
noted on the attached chart may be minimal If sold on the 'open market'. Typically the size and
the shape of such parcels affect the value In a negative way. (Sometimes these parcels are not
buildable by themselves due to limited square footage, sometimes they are land.locked, etc,)
However, In contrast, parcels of this kind are usually quite valuable to the adjacent property
owner(s). These parcels can be added to existing parcels with the result of providing a larger
parcel for a building, parking, etc.
If we use the transactions between Kennedy and Hills Bank and the City of Iowa City and
McDonald as a guide, the value of the alley would be computed at the rate of $1.00 to $3,00 per
square foot. I would suggest that the value be adjusted upward towards the $3.00 per square
foot price since the subject property has a better location In terms of being in the downtown area.
It Is my understanding that there are a number of utilities located In the alley way and it will be
the financIal responsibility of the purchaser to accommodate and work with these utility
gompanles. Therefore, I would adJust the price downward from the $3.00 per square foot value,
If we use $2.00 per square foot, the value would be computed as follows:
4800 square feet X $2,00 per square fool = $9,600

In contraet to the comparable market approach, you may want to take Into consideration the
assessed value of the adjacent parcels. According to the location map and the figures from the
Assessor's records, the assessed land values of the adjacent parcels range from approximately
$13.60 to $20.00 per square foot. I would assume that the value 01 this subject alley, once
incorporated Into the adJacent land parcel, would be assessed at the rate somewhere between
$13.60 and $20.00 per square foot. '

If you average the assessed values of the adjacent parcels, the value of the subject vacated alley
segment would be computed as follows:
4,800 square feet X $16.80 per square foot = $80,640
However, I wish to emphasize that the value of the subject property will probably be assessed
, at this new valuation, but only after It becomes part of the adjacent property.
In conclusion, I would suggest you use the $2.00 per square loot figure In establishing the value
of the subject alley.

BACKGROUND INFORMATION:
The applicant, Hieronymi Partnership, Is requesting that the northern 240 feet of the alley
south of Burlington Street In Block 102, be vaceted. The applicant wishes to purchase the
alley from the City. The southern portion of this alley was vacated by the City Council on
June 24, 1975, However. the City never disposed of this portion of the alley and it is
consequently still used for access by the Mid.Amerlca Bank. The alley proposed for vecation
is to be Incorporated into the redevelopment of the portions of Block 102 owned by the
applicant.

ANALYSIS:
Hieronymi Partnership is proposing to redevelop portions of Block 102 under their ownership
in two phases. Phase one, illustrated on the attached drawing, includes a portion of the alley
which the applicant has asked to be vacated. In conjunction with this requested vacation, the
City will pursue reversing the vacation of the southern portion of the alley so that access to
Mid.America Bank and Electronics Cave via the alley will remain,
Relocation of utilities in the alley should be addressed prior to the approval of the requested
vacation. 10wa'lIlinois Gas and Electric, U.S, West, and TCI of Eastern Iowa all have
easements and utility lines located in the alley. All three companies are concerned about
providing services to properties not currently owned by the applicant, and franchise
agreements with all three companies require that the applicant pay the cost of relocating any
utilities. The applicant has been working with the utilities on these issues and staff
anticipates that the issues can be resolved.
STAFF RECOMMENDATION:
Staff recommends that the request to vacate the northern 240 feet of an alley in Block 102
between Burlington and Court streets be approved, subject to resolution of issues related to
the relocation of utilities.

January 4th. as well as previous public hearings before the City
. Council and the planning and zoning commission. Eagle Food
Centers respectfullY requests that the City Counail's
consideration of the Towncrest rezoning be continued to a later
date.
rt should be apparent that the needs of the Xowncrest residents
have not been ignored by Eagle or the owners of Towncrest Mobile
Home Park. At your last Council meeting. an appropriation was
approved for the acqUisition of property suitable for development
of an affordable mobile home park. We understand this is
primarilY for residents of parks who wish to move from parks that
flooded last year. We have been in contact with a mobile home
park developer to determine if there is a possibility we can be
of assistance in making this a near term reality.
With this in mind. Eagle wishes 90 days for this possibility to
be explored. At that time, a clearer Indication may be available
as to whether an affordable alternative can be made available to
Towncrest residents. Eagle requests the project be removed from
consideration until your scheduled meeting of April 12. 1994.

INTRODUCTION
Eagle Food Stores, Inc. Is pursuing a proposed redevelopment of properties north
and'east of the 1st Avenue/Muscatine Avenue intersection in Iowa City. The site
contains approximately 12 acres and currently is occupied by a car wash, a
restaurant, a storage facility, an unoccupied convenience store, and a mobile home
court, Proposed development Includes a 53,512 S,F. grocery store and a 10,920
S,F. retail shop. In addition to the proposed building, parking lots and a stormwater
detention basin will be provided. Access to the site Is proposed at four locations; one
off MuscaUne Avenue and three off 1 st Avenue.

Turning movement counts were obtained over a two-day period (November 29 and
3D, 1993) at the Intersection of 1st Avenue and Muscatine Avenue, These counts,
projected values, and assumptions pertaining to distribution of traffic were used to
determine the Intersection capacity and level of service. Procedures outlined In the
lilghwav CaDacltv Manual SDeclal RaDort 209 (published by the Transportation
Research, Board National Research Council) were followed to complete the analysis.
Capacity Is a measure of the traffic volume which can be accommodated. Level of
service (LOS) for an intersection Is an Indication of the delay experienced by the
average driver during a specified period. Based on these findings, the need for the
1st Avenue reconstruction was evaluated. Also, using the project costs Identified by
JCCOG, the proportional share which could be associated with the redevelopment
was determined.
TRAFFIC IMPACT ANALYSIS
Estimated traffic generated by the proposed stores follows below in Table 1. Table 2
presents four factors used to adjust the trip values. Assumptions and explanations
are provided where applicable.

The multi-purpose adjustment accounts for trips which result In the use of more than
one establishment I.e., a single trip to the grocery store AND the shopping center.
Pass-By adjustment relates trips which are not addlllonal traffic generated but traffic
diverted from the existing stream, Directional distribution allows for the allocation of
traffic to the various access loCations. Existing use adjustment reduces the total by
the amount generated from the existing restaurant and mobile home park. The
adjustment rates given above are those In the JCCOG report and have been verified
using the Trip Generation manual.
The average daily traffic (ADT) on 1st Avenue Is currently 9,983 vehicles per day
(vpd). This Is based on counts taken by the City of Iowa Clly south of F Street over
a three-day period in October 1993. Slmllarty, on counts taken on Muscatlne Avenue
east of Wade Street, the average ADT Is 8,848 vpd. JCCOG reported volumes on
1st Avenue for 1985 (13,900 ADT) and 1990 (7,600). The 1985 value was used
since the 1990 counts were taken In the summer and were not considered
representative of normal traffic condlllons.
Growth,rate Is somewhat difficult to accurately estimate, However, JCCOG has the
benefit of a traffic model which makes such estimates, Using lis value of 15.6% total
. growth by the year 2000, and the 1993 counts, ADT on 1st Avenue should be
approximately 10,228 vpd. Assuming net traffic created by the study area remains
fairly constant at 2,073 vpd, the amount generated represents 15,2% of the total ADT
on 1st Avenue. However, if the 1985 counts are used In the calculation, the
percentage created by the new development Is 11.4%.
INTERSECTION CAPACITY AND LEVEL OF SERVICE
A significant focus of the proposed redevelopment Is its Impact on the 1 st
Avenue/Muscatlne Avenue Intersection, The existing intersection maintains one

exiting and two entering lanes on each approach, A protected left turn only lane is
provided along with a shared through/right turn lane. All approaches are equipped
with detector loops making the traffic signals fully actuated. The Intersection currenlly
operates at a high volume to capacity ratio (v/c) during the afternoon peak hour (v/c
for three of the four approaches Is greater than 1.0,). Approximately 1,900 vehicles
per hour pass through the Intersection at this time and level of service Is E or below
for each approach, Ideally, vlc would be less than 1,0 and LOS would be C or
higher. Therefore, the current condition warrants Improvements, A table relating
level of service to delay Is given In the Appendix.
Obviously, additional traffic volumes using the existing Intersection would add to
congestion. The appendix includes turning counts and computations documenting
. the analysis.
1ST AVENUE PROJECT DESCRIPTION
The JCCOG report briefly discusses a reconstruction project for 1 st Avenue.
Interviews with a JCCOG representative and City of Iowa City engineering staff were
completed to obtain a more accurate project definition. Detailed information Is not
currently available because the project has not been planned In sufficient detail to
accurately account for all project costs, F0110wlng Is a description of the conceptual
plan:
1st Avenue Is to be widened and reconstructed from D Street to Bradford
Drive. Four lanes will be provided with a fifth turning lane at the Intersection.
Widening will necessitate right-of-way acquisition and traffic signal relocation
and adjustment. Sidewalk reconstruction and drainage structure replacement
for the Ralston Creek crossing are also planned.
JCCOG and City staff recommended Eagle be asked to provided their share of the
reconstruction cost based on their net Impact of the area from the Intersection to the
north. This represents a reasonable approach to project funding. Although
numerous methods can be used to assess projects costs, a normal approach would
be to assess 7 properties adjacent to the Improvements. However, the City Planning
and Zoning Commission has asked for a larger proportion of the total cost.
Intersection capacity analysis for projected volumes and the proposed Improvements
Indicate the 1st Avenue approaches would operate with an acceptable level of
service, However, Muscatlne Avenue approaches would continue to experience
pertods of congestion.
