MEMORANDUM
TO: Stephen Atkins, City Manager

RE: John's Grocery
DATE: January 24, 1994
On January 19, 1994 I spoke with the owner and attorney for John's
Grocery reference the arrest for supplying liquor to an underage
person. I was Informed that the Individual who sold the liquor was
terminated and the remainder of the employees were all informed of the
need to comply with the law.
The department was requested to assist In a training session for all
employees on the liquor law and false ID. The. training session will be
handled by Officer Berg In the near future. The owner also requested
.
walk throughs by the evening and late night- officers which will take
place.

With the TCI contract coming up for renewal, I would appreciate your addressing a
problem TCI has not answered to in my attempts to deal with them.
When we signed on to TCI, it was mainly for CNN and FSPN, since those are usually
the only TV programs we watch. Therefore, any problems we have with those channels
have a great Impact on us.
It has been over a year now that TCI has been allowing Channel 9 news to take over
the last 5 minutes of the CNN program. This I find not only irritating but also
improper in that I am not getting what I pay for. I enjoy the last 5 minutes and find it
aggravating to be interested in a story CNN says is commg up later (i.e. in the last 5
minutes) of the pro$ram, only to Walt and find that I get channel 9 instead. I can watch
channel 9 for free, If I wish, and never do because I do not like them. Now I find
myself paying for a forced channel 9 segment while missing the segment I want on
CNNI
I have tried dealing with TCI as well as asking Mr. Schaffer, the city administrator
who handles such matters, to help, but nothing has been done in the year that I have
tried to approach this.
I will outline the violations, I feel, are being committed and explain why. It is a letter
similar to which I wrote Mr. Schaffer.
I feel that TCI is guilty of:
1. violating my contract with them
2. misrepresentation
3. improper billing.
The manner in which the above three points are involved are as follows:
I signed up for CNN and am paying for CNN, but am not getting the complete
program. By deleting the last part, which I enjoy, and substitute channel 9. TC/lIas
breaclIed lis contract to provide me willI CNN. Furthermore, not only do I not get to
see those 5 minutes of CNN that I pay for, I am also being forced to pay for channel 9
which I can get FREE.

If they take 5 minutes from every half hour, it is not a small point. If this is calculated
out over a year, I am being denied 1,460 "ours of CNN that I pay for and am paying
for 1,460 !,OUrs of Channel 9 that I should be gelling free!
TCl is guilty o/misrepresentation. They advertise that they provide CNN. People
such as I sign up to see CNN, but find, in fact, lhatthey provide only 3/4 of the CNN
format, which is major news, business and sports. For those of us who enjoy the
miscellaneous stories, T~I does not deliver. If TCI cannot be stopped from stealing
those 5 minutes, they should at least be required to have proper advertisin~. All of
TCI'sadvertising pertaining to CNN, printed or otherwise (as well as the mformation
meted out by their office personnel pertaining to their offering CNN), should be
required to qualify that, in fact, they do not provide CNN in its entirety.
TCl is also guilty 0/ improper billing. I would like the commission to be aware of the
fact that I asked TCI for a monthly adjustment on our bill to compensate for the
portion of CNN we are not getting and they declined to do so. I question their right to
charge me for something I am not getting. Is it legal?
More troubling is the fact that I think it is very likely that TCI is getting paid twice for
the same 5 minutes...once by me and again by channel 9. They win, I lose.
Mr. Schaffer explained that the city was not allowed to interfere with programming.
This is not interfering with programming but asking TCI to deliver what they promise
and what they are charging for. In addressing this problem the city will be addressing
just what are the limits of what a cable company can do and whether it will be held
accountable to the public. Other lucrative proposals may come their way and the
encroachment could expand to other programs or in ways yet unknown.
If the scenario were reversed, that is, if TCI was not delivering the first 25 minutes of
the CNN format yet advertised and charged'as if they did, I believe the cable
commission would immediately address the problem and consider the three charges I
made valid. The last 5 minutes are no less significant. It is still a violation and as a
mailer of principle a precedent must be established.
I feel it improper to be paying for something I am not getting. Your help with this
mailer will be greatly appreciated. I know there are others who feel as I do.

We wish to inform you that Goodwill does not intend to enter into a contract with SEATS for trips by
our ADA eligible clients and/or employees for daily trips to and from their home and their work or
program location. It is our understanding of the ADA, from Appendix D to Part 37.Construction and
Interpretation of Provisions of 49 CFR part 37, that such rides should be considered subscription
service paid by each individual. In addition low income discounts should apply on the same basis as
for fixed route service. We would, of course, continue to contract at a negotiated rate for trips for
Goodwill program purposes or events. '

We would also like to express our concern and dismay that the City of Iowa City is considering
contracting with a paratransit provider other than SEATS because of perceived or initial cost savings.
Such action would be financially short sighted, would put consumers at risk of poor service and
would be disruptive for all. On the face of it, this idea just doesn't make sense. Surely local
government officials have the necessary skills, good faith and temperament to sit down and work out
an agreement that, although perhaps not perfect, will be mutually and collectively more beneficial for
all citizens, including paratransit customers,

Thank you for providing an opportunity to comment on paratransit
services provided by SEATS and the proposed timetable for
implementing comparable paratransit services, in Iowa City and
Johnson County. Thank you also for, sending copies of the Iowa
city Urbanized Area Complementary Paratransit Plan (December
1991) and, applicable federal rules and regulations (49 CFR Part
37). These documents have been most helpful,
It has also been helpful in, formulating these comments to have
discussed paratransit issues with Bill Gorman, Executive Director
of systems Unlimited Incj Bette Meisel, Senior Cenb~r
Coordinatorj Larry Olson, SEATS Director; and yourself. I would
like to take this opportunity to say that we have always
appreciated the excellent cooperation, responsiveness and
service of both Iowa city Transit and Johnson County SEATS,
John Lundell, Larry Olson, drivers and dispatchers have all
provided distinguished services for many years.
In general, the Paratransit plan and timetable present a logical
progression of service that is in compliance with the spirit and
letter of the ADA.' However, I would like to make a few
suggestions that might make the whole system more user-friendly
and integrated. It is intended that these suggestions would also
enhance the capacity, flexibility and responsiveness of the
paratransit system.
Capacitv Expansion: It is important that current capacity
constraints be reduced. The plan calls fo. the purchase of
additional accessible vehicles for fixed routes andlor
retrofitting existing vehicles. This will help reduce the
'demand for paratransit service to some extent once implemented.
However, plans to reduce the currept capacity ~onstraints for
demand response service by SEATS are not clear. There is mention
of Johnson county purchasing additional vans and a small bus, but
the number of vehicles, timeframe and effect on capacity did not
appear to be in the plan. These issues should be clarified.

encouraged and expansion of this service should be considered.
cabs are more accessible and convenient for many eligible
persons, in particular many who do not use wheelchairs, and cabs
may provide service at lower cost.
Reservation Access: I strongly urge that the paratransit system
have one telephone number for reservations that would be widely
published. A number that is easy to remember (e.g. 337-RIDE)
would also be helpful. The number would access one
reservationldispatch center that could determine, with the user,
whether paratransit or cab service would be most appropriate. I
do not believe that this would require the cab contract to be
part of an umbrella para transit contract, although such an
umbrella contract would seem to have merit.

Fares: The plan to charge double the fixed route fare, currently
$.50, is justified. However, discount andlorwaiver of fares for
low income citizens should apply to paratransit fares equally.
In addition, I recommend that monthly passes for paratransit
service also be offered at twice the cost of fixed route passes
(currently $18) and that discountslwaivers also apply to these
passes. In addition, I recommend that monthly paratransit passes
be honored on all fixed routes. Further, I recommend that
eligible persons who hold fixed routes passes, and normally ride
fixed routes, be allowed to use paratransit service for $.50 per
ride.
Guaranteed and subscription Service: SEATS currently provides
IIguaranteed" service under contract with Systems unlimited for
transporting eligible persons from home to the Nelson Center.
SEATS also provides a similar service under contract with'
Goodwill Industries, but on a non-guaranteed basis. The fares
for these rides are based on actual costs, currently $6.61 per
trip 'for Goodwill. Although Section 37.131 (c) (4) permits such
fares under certain circumstances, Appendix D to Part 37 -
Construction and Interpretation of provisions of 49 CFR part 37
seems to restrict such negotiated fares to trips guaranteed to
an agency for its program use, not for transporting eligible
persons to and from work or program, whether or not reservations
are made by the agency on behalf of its clients. Therefore,
trips for eligible per50ns between home and Nelson or Goodwill,
would be considered subscription service paid by each
individual, not agency trips paid at a higher negotiated fare.
Service Area: The plan calls for reducing the Iowa city service
area to the minimum 3/4 mile requirement July 1, 1994. It,is my
understanding that this will leave Chatham Oaks, and perhaps
the homes of other eligible persons, outside the service area.
while I support continued financial support for paratransit by
Johnson county, such support may be restricted to areas outside
city limits. If this should be the case, I strongly urge the
city, of Iowa City to extend its service area to the maximum 1 1/2
mile limit whenever needed to include eligible persons.

I am writing as chair of the Mental Illness/Mental Retardation/Developmental
Disabilities/Brain Injury Planning Council. The Council includes consumers, parents,
service providers, and government representatives and meets monthly to plan for
services to people with these four disabilities In the Johnson County area.
It is the position of the MI/MRlDD/BI Planning Council that maintaining para-transit
service Is crucial to people with disabilities. For many people with disabilities, public
transportation is the only alternative. Many have no rlher means of transportation.
Without public transportation they would be unable to get out of the house and
participate In activities in the community, including crucial activities such as food
shopping and medical appointments. SEATS has met this need in an effective manner.
The Planning Council encourages support for high quality, timely, and accessible para-
transit services.

I have been a frequent rider of the S.E.A.T.m.
paratransit system for the past four and one half years
and am very concerned about the possibility of privitization.
The current system has met my needs and made it possiitle for
me to lead a more normal life.
The drivers and dispatchers have alwa~y~ been friendly
and poll te as has Mr, Olson. Being treated as a real human being
and not as a passenger with ambulatory problems has helped with
my ability to functiun in the real world.
I have heard nothing good about the non-local bidder
and am concerned that the quality of service will decline sev-
erly. S.E.A.T.m. is one of the reasons I live in IOwa Oity and
I don't want to see it replaced.
Please consider any changes very carrfully and keep
quality of service foremost.

On behalf of Systems Unlimited, Inc., I would like to express
our thoughts in regard to the development of the FY-94 Update of the Iowa
City Urbanized Area Complementary paratransit Plan.
As you may be aware, Systems Unlimited has a contract with Johson County
SEATS to provide transportation for our reaular and predictable qroup routes
from our group homes and apartments to our vocational program. For all other
transportation in evenings, weekends and special trips, we provide the
transportation .QJ;: the people we serve schedule these trips 3-7 days in
advance with SEATS.
With the advant of the Americans with Disabilities Act, we do not feel
that we should need a contract for our reaular. predictable qroup transporta-
tion needs and would hope that this could be worked out by the start of the
next year fiscal year (July 1, 1994). We would certainly welcome the City of
Iowa City'S thoughts on this matter. At this time, until we know more of the
specific plans for next year's paratransit system, we are reluctant to
request that the contract be dropped. However, we do believe this should be
a goal that can be attainable.
Also, for your information, I have enclosed a copy of my letter to Kevin
Doyle which summarizes all of our comments pertaining to the Update of th~
paratransit Plan.

comments in regard to the existing complementary paratransit plan
in preparation for your development of the FY'94 update of the Iowa
City Urbanized Area Complementary Paratransit Plan.

First, let me state that overall we have been pleased with the
service and relationship that we have maintained with Johnson
County SEATS. We view the requirements of the ADA as an
opportunity to continue to improve the transportation for all of
Iowa City'S residents (including individuals with existing
disabilities and individuals who will become disabled in the
future) .
The one major issue that undoubtedly will be pointed out time and
time again relates to the amount of advance notice that must be
provided to Johnson County SEATS in order to get transportation for
trips which are not scheduled on a regular basis. Frequently, this
can be extremely difficult to achieve. Improvement in this area
would be greatly appreciated. Also, concerns have been expressed
that people with disabilities do not notify SEATS when they decide
they no longer need a scheduled trip. There certainly are cases
when this has happened, but on other occasions there has not been
a dispatcher on duty to take a call when a person with a disability
has tried to cancel a trip. Increased phone accessibility would
help in this area.
In regard to the FY'94 update I would like to provide the following
comments/suggestions:
1. The ADA will require by January 1997 next day service for a
paratransit service. This will undoubtedly require an
increase in the capacity of the bus service and/or the
existing paratransit service and/or a new service. We would
certainly welcome other options such as a taxi service. (Many
of the individuals with disabilities whom we service may not

3. We believe that people with disabilities should pay some
amount for their transportation needs. At present, the system
is based on a voluntary basis. We believe this could
appropriately be changed to a requirement as lonq as there is
an exceotion for low income. Most people with disabilities
unfortunately have a low income; however, some payment could
be made. The key will be keeping the payment system simple so
a significant amount of time is not spent in collecting small
amounts of money.

4. The needs of the elderly and the needs of people with
disabilities aren I t significantly different. As we
understand, virtually all seniors who want to use the
paratransit service meet the disability test and thus can use
the service. Convenience is the maj or concern. Thus, we
would again suggest that a taxi service should be investigated
to see if it could fill in the gaps of the existing services.
Perhaps a contract with the existing taxi service could be
arranged.
5. Whatever set of services are developed, we strongly encourage
the development of a centralized dispatcher service so that
only one phone number needs to be called. The dispatcher
could then help sort out whether an individual could use a
bus, van or car.
6. It would also be useful for a person with a disability (and
seniors who meet the disability test) to have an inter-
changeable pass so that they could use a bus, van or car.
There would be one fare (pass) to use the various elements of
the transportation system. Again, keeping the system simple
will reduce administrative costs.
7. John Watson with Goodwill Industries, Bette Meisel with the
Senior Center and I met to discuss the current transportation
system and future needs. I believe we concluded that our
organizations stand ready to work together cooperatively with

Ladies and Gentlemen:
I received a copy of a memoradum from James Brachtel to the Mayor and the
City Council dated January 10 with respect to parking on Third Avenue. I
haven't had anything to do with this one way or the other, but you should know
that there are two businesses on this street which require up to five parking
places for their workers and/or customers. They presently use streetside parking.
There are three other people on the street who have also had small businesses in
Iowa City in the past and who provided off street parking as required. You will
never hear from these people, but you can imagine what they think of the City's
"fairness" in this case.

I have come to find out over the past week the city council has not
been told the whole story on the proposed development for the block
which contains my business. The plans that were presented to you
showed the building that contains my business with twenty feet removed
from the back (see exhibit A). While I have been negotiating with my
landlord, Hieronymi Partnership, to make these changes we are far from
finding a workable solution, and getting farther every week. I
currently have a lease through July 31, 1999.
As the building currently sits the alley provides a loading area
for my business. This loading area is required by city code (36-59-a).
The code also requires that semi trucks be able to enter and exit the
loading area without backing up (36-59-d-l). None of this is possible
without an alley there. The alley is also my only entrance to my
install bay which is an essential part of my business.
I also have serious concerns with the quality of the work from the
architecture firm chosen for this project. On exhibit A you will see
that the Hieron Building was mislabeled the Goodyear Building, and the
position of the loading dock on the new build would block the exit from
my parking lot. On exhibit B you will see 5 parking spaces labeled as
"6", and two of the five labeled as compact, when in fact three of the
fi ve are compact. On exhibit C they question if a parking space is
legal when their drawing clearly shows that it is legal, and there are
already three parking spaces on this block that are setup the same way.
They also show removal of a pedestrian aisle that is required by code,
and a loading position for a semi that is virtually impossible to
enter.

My biggest concern is that the team working on this project is not
be up front with you, the city council, or me. I have found these
problems through my attorney, my architect, and my own research of the
city code. I don't feel that vacation of the alley would be wise until
a complete plan for all parties concerned is finalized.

1. Forecasts
· Population
Is the forecast for population growth accurate?
Does it match forecasts by other local and regional agencies?
· Water Use
The Study estimates that per capita water use will increase annually by one
gallon per person per day for the next 40 years - from 123 to 161 gallons
per day. Is this reasonable and accurate?
The forecast of water use should be divided into categories (e.g., residential,
office, industrial, institutional, etc.). This would make the forecast more
understandable and provide useful information.
2. Information
. Leakage
How much water is currently being lost through leakage in the distribution
system? Can this amount be reduced in a cost,effective manner?
. Costs
What are the expected operating costs of the new water treatment plant? How
do these costs vary according to different regulatory scenarios?
What is the total cost of the new treatment facility over its design life? What
is the cost per 1,000 gallons of water treated? What is the expected
increase in the water bill of the average home?
. Water Use
Who uses our drinking water? Who are the major consumers of treated water?
How is water consumption divided between industry, offices, institutions,
apartments, and single. family households?
3. Watershed Protection
· Coralville Reservoir
Preliminary research indicates that some improvement of the water quality of
the Iowa River takes place in the reservoir. This means that local
watershed protection could substantially affect the water quality, of the river.
· Johnson County Soil & Water Conservation District .
The JCSWCD 5-year plan estimates that an investment in soil conservation
measures in local watersheds would result in a significant reduction in the
turbidity of the Iowa River.

4. Conservation
I Reducing the amount of drinking water consumed could reduce 1) capital costs of
the new plant, 2) operating costs over the life of the plant, and 3) the amount
of sewage to be treated. Reducing the amount of water treated would also
increase the City's ability to adjust to changes in US EPA drinking water
regulations.
I Conservation measures can be structural as well as behavioral changes. This
would result in predictable and constant changes in water usage.
I Conservation measures could include:
1) changes to industrial processes
2) installation of water efficient fixtures
require in new construction
replace existing fixtures
typical savings range from more than 40% in office buildings to more
than 10% in residential use
3) change water rate structure
4) water audits
I There is extensive experience and a sizable body of literature in water

Survey Says Water Utility Advisory
Councils Are a Success

This article reviews tile results of a sUlVey of water utilities that have had
experience \lith public advisory groups. A\VlVA's Public Infonnation Commit,
tee conducted the sUlVey. Responding utilities state that the topics most
frequentiy addressed by groups in their communities nre conselVation, rates,
and water supply projects. Most advisory groups met specific goals. Utilities
found that the participation of the advisory groups improved utilities' opera.
tions rather than detracting from them, in same cases increasing community
support for projects. The author reviews the experience of the Bridesbul'l1
Community Advisol')' Council in Philadelphia, Pa" which selVes as a commu'
nity sounding board for controversial projects at tile water department's
wastewater plant. The article concludes \lith advice and general comments
from sUlVey participants who have fonned community adlisory groups.

Committee surveyed water utilities to ob-
tain infonnation about their work with
advisory councils, Questionnaires went
to 244 member utilities that had identi,
fied themselves as interested in public
involvement-by participating in AmV A
workshops, for example. or serving on
committees, Twenty,five utilities re'
sponded (fable I), Of the 25 respon'
dent~, 22 have formed advisory groups in
their communities to discuss issues and
resolve problems,
