WHEREAS. with the redevelopment of the
properties adjacent to the northarn 212 feet of
the allay located batween Burlington and Court
Straets, West of Dubuque Straet (Block 102).

WHEREAS, propartias adjacent to the
southam portion of tha aliey wili gain accass
from tha aliey to Court Street if the City
rescinds Ordinance No. 75.1771, vacating the

NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION 1. VACATION. The City of lowe

described as foliows:

AN OROINANCE AMENDING THE ZONING
ORDINANCE BY AFFIRMING THE SINGLE.
FAMilY CHARACTER OF THE RNC.12,
NEIGHBORHOOD CONSERVATION
RESIDENTIAL, ZONE AND RESTRICTING THE
NUMBER OF PRINCIPAL 8UILDINGS
PERMITTED ON A LOT IN THE RNC.12 ZONE.
WHEREAS, the City Council acknowledges
that it intended the RNC.12 Zona to be a
slngle.family resldential/duplax zone; and
WHEREAS. the requirements of Section 36.
3(1)(1) of tha Zoning Ordinance. which permits
only one principal building on a lot in single.
family residantial zones. should epply to the
RNC-12 zone; and
WHEREAS, by including multi.family
residential dwellings as a provisionel use in the
RNC-12 Zona, the City Intended to allow the
continued use of existing multi.famlly
structures as legal conforming uses in the RNC.
12 Zone, not to imply that the RNC.12 zone is
a multi.famlly residential zone; and
WHEREAS, the RNC.12 zone does not permit
construction of new mUltl.famlly residential
dwellings.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA. THAT:
SECTION I. AMENDMENT,
A, Chapter 36, Article I entitled "GENERAL,"
Section 36.3 entitled "Generel Effact of
this chapter" of the Code of Ordinances of
the City of Iowa City, Iowa, is hereby
amended by repealing subsection If)(ll and
adopting a new subsection (1)(11 to read as
follows:
If)( 1) In the RS zones and the RNC-12
zona, there shall not be more than
one (11 principal use or building on a
lot. There may, however, be more
than one (1) accessory use or
structure on a lot.
B. Chapter 36, Article II entitled "PRINCIPAL
USES AND REQUIREMENTS," Section 36.

AN ORDINANCE AMENDING CHAPTER 33
ENTITLED "UTILITIES" OF THE CODE OF
ORDINANCES OF THE CITY OF IOWA CITY.
IOWA, BY ADOPTING A NEW SECTION 33.
10.4 ENTITLED "TAP-ON FEE FOR THE
NORTHWEST SANITARY SEWER PROJECT".
WHEREAS. Section 33-10,3 of the Code of
Ordinances of the City of Iowa City, lowe
euthorlzes the City to adopt and implement
project-specific tap-on fee ordinances to
provide for the equltabla apportionment of
costs associated with extension of public
utilities; and
WHEREAS, collection of costs by way of a
tap-on fee ordinanca must be based on actual
project costs; and
WHEREAS, the City completed construction
of the Northwest Senit3ry Sewer to serve the
northwest area 01 thu City within the Clear
Creek drainage basin and the costs of
construction are now subject to formal
collection via the "tap.on fae structura"; and
WHEREAS. it Is In tha public Intarast to
equitably apportion the costs associated with
extension of senitary sewer to those propertlas
benefitted by the extension,
NOW THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION 1. AMENDMENT Chapter 33
entitled" Utilities" of the Code of Ordinances of
the City of Iowa City, Iowa, Is hereby amended
by adopting a new Section 33-10.4 to read as
follows:
Section 33-10.4. Tap-on Fee for tha
Northwest Sanitary Sewar Project
a. Generel project description. The Northwest
Sanitary Sewer Is a trunk sanitary sewer
serving the northwest area of the City
within the Claar Craek drainage basin, The
Northwest Sanitary Sewer ProJect
("Project"llncludes the construction of one
11ft station, aighteen (18) manholes, and
6,071 lineal feat of sewer pipe ranging In
size from eight (8) Inches In diameter to
forty-two (42) Inches In diameter.
The City Council determined that
Installation of the Project would facilitate
development of the araa generally located
nerth of Melrose Ava. and west of property
owned by tha Unlvarsity of Iowa since this

area was not expected to develop due to
the lack of sanitary sewer on the University
property,
b, Actions taken by City Council in approving
the project. On October 2. 1990. the City
Council edopted Resolution 90.183
euthorizing an agreement with MMS
Consultants to design the sewer. On April
2, 1991, the City Council held e public
hearing on the plens, specifications, form
of contract and cost estimate. Following
the public hearing, tha Council pessed
Resolution 91.53 approving the plans and
specifications of the project and authorizing
advertisement for bids. The City awarded
the Northwest Sanitary Sewer Project
contract to Maxwell Construction Company
on April 22. 1991. by Resolution No, 91.
83. In Resolution 91.293 adopted on
December 10, 1991. the City Council
eccepted the work for Improvements
covering the Northwest Sanltery Sewer
Project.
The City Council euthorlzed the issuance
of general obligetlon bonds es Interim
financing to pey the construction costs of
the Project In Resolution No. 90.227.
The developers of Galwey Hills
Subdivision end Walnut Ridge Subdivision
egreed to prepay tep.on fees for lots In
those subdivision developed prior to the
adoption of this Ordinance.
c, Total project cost. The total actual cost of
the Project, as certified by the City
Engineer, Is $807,646.94, This cost
Includes $213,220.70 In Interest costs.
d. Total 8re8 benefitted, The Northwest
Sanitary Sewer Project banaflts e totel of
865.7 acres. The 865,7 ecres has baen
divided Into eight (81 subareas lebeled A
though H for cost allocation purposas. See
Figure 1-

ORDINANCE AMENDING CHAPTER 34, ENTITLED "VEGETATION," CODE OF ORDINANCES
OF THE CITY OF IOWA CITY, IOWA, BY ADDING A NEW ARTICLE IV, DIVISION II ENTITLED
"PRIVATE PESTICIDE APPLICATION," WHiCH ARTICLE SHALL PROVIDE FOR REGULATING
PRIVATE APPLlCA nON OF PESTICIDES AND PROVIDE FOR THE ENFORCEMENT THEREOF.
SECTION I. The Code of Ordinances of the City of Iowa City, Iowa is hereby amended by
adopting the following:
Section 34-77 Scooe and Puroose
State and federal law permit a city to exercise any powers or perform any functions
under home rule which the city deems necessary, in order to protect the health, safety and
welfare of its citizens; and said home rule extends to the exercise of powers also
undertaken by the state or federal government where, as here, not pre-empted by state or
federal law . The City Council for the City of Iowa City therefore adopts this ordinance
concerning private application of pesticides to outdoor vegetation, in order to protect the
health, safety and welfare of the citizens of Iowa City, Iowa.
Section 34-78 Definitions
a. "Private Application" means all broadcast application of pesticides to outdoor property,
excluding commercial application and also excluding application by a certified
applicator who uses or supervises the use of any pesticide classified for restricted use
for producing an agricultural commodity and as governed by federal law. "Broadcast
applic,ation" is not intended to include spot applications.
b. "Farm" shall have the same meaning as that set forth in the Iowa City Zoning
Ordinance, Chapter 36, Iowa City Code of Ordinances, namely "an area of not less
than 10 acres for which the principal use is the growing for sale of farm products such
as vegetables, fruits, and grain and their storage on the land. The term 'farm' includes
the necessary accessory uses and buildings for treating and storing the food
produced. "

c. "Pest" means (1) any insect. rodent, nematode, fungus, weed, or (21 any other form
of terrestrial or aquatic plant or animal life or virus, bacteria, or other micro-organism
(except viruses, bacteria, or other micro-organisms on or in living man or'other living
animals) which the Administrator declares to be a pest under section 136w(c1l11 of
7USC! 136 (FIFRA).
d. "Pesticide" means (1) any substance or mixture of substances intended for preventing,
destroying, repelling, or mitigating any pest, and (2) any substance or mixture of
substances intended for use as a plant regulator, defoliant. or desiccant, except that
the term "pesticide" shall not include any article that is a "new animal drug" or that
is an animal feed bearing or containing a new animal drug as defined by federal law .
e. "Plant regulator" means any substance or mixture of substances intended, through
physiological action, for accelerating or retarding the rate of growth or rate of
maturation, or for otherwise altering the behavior of plants or the produce thertiof, but
shall not include substances to the extent that they are intended as plant nutrients,
trace elements, nutritional chemicals, plant inoculants, and soil amendments. Also, the
term "plant regulator" shall not be required to include any of those nutrient mixtures
or soil amendments are commonly known as vitamin-hormone horticultural products,
intended for improvement, maintenance, survival, health, and propagation of plants,
and as are not for pest destruction and are nontoxic, nonpoisonous in the undiluted
packaged concentration.
f. "Defoliant" means any substance or mixture of substances intended for causing the
leaves or foliage to drop from a plant, with or without causing abscission.
g, "Desiccant" means any substance or mixture of substances intended for artificially
accelerating the drying of plant tissue.

h. "Private applicator" means any person or entity who applies or causes broadcast
application of pesticides to outdoor property whether by spraying. misting. fogging, '

dusting, dragging, spreading or other means, excluding commercial applicators as
defined by state or federal law , and also excluding certified applicators who use or
supervise the use of pesticides classified for restricted use for purposes of producing
an agricultural commodity, as governed by federal law.
i. "Property" shall mean any lot, lots, tract or parcel of land within the jurisdictional limits
of the City of Iowa City. Iowa, excluding farms.
Section 34.79 Notification Siqn Requirements
a. Prior to the priVate application of pesticides to property, private applicators shall place
notification signs on each such property. Said signs shall be City-provided signs, with
a fee to be established by Resolution, the signs to be of a material thatis rain.resistant
for at least twenty-four 1241 hours, shall be a minimum size of 8.5 inches x 11 inches;
shall have bold black lettering on a bright yellow background; shall be easily readable;
shall include the date of application; and shall contain cautionary warnings to the
public to keep off the treated area using the following language and logo:

b. After private application of pesticides to a property, a private applicator shall leave the
notification signs in place for at least twenty-four (24) hours.
c. Location and spacing of said notification signs for private application shall be posted
on a lawn or yard between two (2) feet and five (5) feet from the sidewalk or street.
When landscaping or other obstructions prohibit compliance with the minimum
distances, the notification signs shall be placed in a manner reasonably intended to
give public notice.
d. State rules otherwise established by the Iowa Code and the Iowa Administrative Code
governing golf courses, public rights-of-way, and parks, playgrounds and athletic fields
are not intended to be altered or affected by these notification requirements.
Section 34.B 1 Penalties
Violation of this ordinance shall be deemed a simple misdemeanor, or a municipal
infraction. Said enforcement provisions shall be deemed cumulative in nature, and the
City's election of one enforcement provision shall not preclude the City from pursuing
another.
SECTION III. REPEALER.' All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
SECTION IV, SEVERABILITY. If any of the provisions of this Ordinance are for any reason
declared illegal or void, then the lawful provisions of this Ordinance are deemed severable and
shall remain in full force and effect.
SECTION V. ' EFFECTIVE DATE, This Ordinance shall be in full force and effect from and
after its final passage, approval and publication, as provided by law.

b. After private plication of pesticides to a property. a private applicator shall leave the
notification sign in place for at least twenty.four (24) hours,
c. Location and spac'ng of said notification signs for private application shall be posted
on a lawn or yard b ween two (2) feet and five (5) feet from the sidewalk or street.
When landscaping or other obstructions prohibit compliance with the minimum
distances, the notificati signs shall be placed in a manner reasonably intended to
