212 FEET OF THE ALLEY LOCATED BETWEEN
BURLINGTON AND COURT STREETS, WEST

WHEREAS, with the redevelopment of the
properties adjacent to the northern 212 feet of
the alley located between Burlington and Court
Streets, West of Dubuque Street (Block 1021,
those properties will no longer require the alley
for access; and
WHEREAS, properties adjacent to the
southern portion of the alley will gain access
from the alley to Court Street if the City
rescinds Ordinance No. 75-1771, vacating the
southern 97 feet of the alley.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION 1. VACATION. The City of Iowa
City hereby vacates the portion of the alley
located between Burlington and Court Streets,
West of Dubuque Street (Block 102) legally
described as follows:
The northern 212 feet of the north-south
alley of Block 102 of the original plat of
Iowa City, Iowa.
SECTION II. REPEALER, All ordinances and
parts of ordinances in conflict with the
provisions of this Ordinance are hereby
repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be Invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or
unconstitutional.
SECTION IV. EFFECTIVE DATE. This
Ordinance shall be In effect after its final
passage, approval and publication, as provided
by law.

subject: The Vacation of the North 212 Feet of the Alley in
Block 102, Iowa City
Hieronymi Partners hereby withdraws its application for
the vacation of the north 212 feet of the Alley in Block 102,'
original plat of Iowa city as revised. The application will
be resubmitted later in connection with the scheduling of
Phase Two of the Hieronymus square project.
We are submitting herewith the new plans for the
Hieronymus Square building which show a smaller building to be
constructed within the boundaries of Lot 8, Lot 7, and part of
Lot 6, in Block 102. The south building line will be at least
twenty (20) feet from the north wall of the existing Hieron
Building. The building will still contain a basement level
for parking and storage, two floors of retail space and three
floors of offices. The five story central atrium feature has
been retained, although it is reduced in size.
We initially intended to build on the alley right-of-way
to increase the efficiency of the project. The alley vacation
was required to do that and would have been in our best .
interest. However, further review showed that other
liabilities could outweigh those advantages. SubseqUently, we
have reduced the scope of the project in an attempt to
minimize ,those liabilities. Relocating utilities and service
access currently provided in the alley would apparently cause
undo disruption to businesses who would be remaining in the
area. We have discussed the potential disruption with them
and feel it would be better to vacate the alley during Phase
Two of this project when the existing businesses would no
longer be there.
We have also provided the 20' minimum separation to the
Hieron Building at the south side of the project as required
by the decision of the Iowa city Board of Appeals on
February 7, 1994.
The project design has had to be modified in other ways to
allow the reduced project scope to maintain the efficiency of
the initial proposal, but with the'help of Tax Abatement the
revised project will still be able to proceed.

The undersigned represents Wilfreda Hieronymus and Hieronymi
Partners. Mrs. Hieronymus has asked me to inform you that
Hieronymi Partners has revised its plans for the Hieronymus Square
Building. The building will be located within the boundaries of
the land west of the alley, leaving the alley open. Therefore,
the alley will remain' open so long as you can continue to occupy
The Electronics Cave building under the terms of your extended
lease. '
Mrs. Hieronymus regrets that she was unable to successfully
complete the negotiations with you to make the alterations to the
Cave building which would have permitted her to build the
preferred design. Hieronymi Partners did at all times act in good
faith in its negotiations with you, intending to leave you in a
better position with the remodeled building than you are.
Mrs. Hieronymus hopes the project as redesigned will receive your
full' support. She is certain that the new building, when
occupied, will be advantageous to your business.
Since you have made the negotiations with Hieronymi Partners a
public matter, a copy of this letter will be delivered to the City
Council along with the new plans for the building.
