Washington St. Iowa City, IA 52240 Dear Mayor Horowitz and Council Members, Within the past few months we, The Johnson County Coalition for Persons with Disabilities, have offered ourselves as a technical assistance resource to the council on issues related to disability. A few months ago we circulated a petition asking the city council to "proceed carefully" in regards to the para- transit system. In our efforts to educate the public about the two para-transit systems, it was brought to our attention that the level of service was not decided by the provider but by the city's contractual agreement with the provider. Consumer involvement was strongly encouraged by the directors of both transit systems. To facilitate this, we would like to re-extend our offer to provide technical assistance in determining the basic details of the contract with specific attention to the quality of service provided. As a constituent based organization we believe that we have,relevant input related to community issues. While this particular issue may be disability related we would like to work in a jOint effort to increase the level of involvement of persons with disabilities and the elderly on all Iowa City issues. We became aware that the council was considering this issue when we read Dan Hogan's February 19thPress Citizen editorial in opposition to extending the benefits. We have Mr. Hogan to thank for alerting us to the fact that it was important for us to speak up about this issue. We favor the change you are considering because it equalizes benefits to all employees. Extending health benefits to same sex partners is something our city can do to correct one of the many discriminations that homosexual couples face. It is time to move beyond prejudiced and homophobic ideas like those expressed by Mr. Hogan. Mr. Hogan attempts to lump all of us who are mamed and heterosexual together as part of the "majority". As a downtown business owner I hope the project does go forward. As a taxpayer, I object to public money being used to aid a project of this type, The property in question is not blighted or in need of renewal. The developer involved is not creating significant new jobs or production in our local economy. :;, '. , If the banks refuse to finance the development and if it is not viable without tax relief then perhaps the developer needs to invest greater equity capitol in the project. ','1~' '1,\ '" o :: Domestic Partner Benefits Research Summary The Issue While the issue of Domestic Partner benefits is a relatively recent phenomenon, a significant amount of research has been done, and many precedents do exist for these benefits. To date more 130 municipalities, companies, and academic institutions offer health care benefits to same-sex couples. That number is predicted to increase markedly before 1995, since domestic partner coverage is being proposed in more than 150 venues during the coming year, Fortune 1000 has seen this trend as inevitable and has proffered the accepting and adjusting to domestic partner inclusion as a critical topic at national corporate conventions, Statisticians predict that the inclusion of domestic partners will become common practice by the year 2000, People who are lesbian, gay and bisexual view domestic partner benefits as an issue of civil rights, The concern shown by lesbians and gay men for their life-partners is no different than the concern shown by heterosexual married people, Therefore it is offensive to these employees that benefits afforded heterosexual couples are denied to them, As a matter of fairness, of equal pay for equal work, and of individual equality, it seems institutions should cease discriminating against gay and lesbian relationships by providing parity benefits. The Questions Yet, reasonable people have questions when considering the inclusion of these benefits. The most common are: I. Utilization The VI study (as well as the previous studies it examined for its report) showed the highest end of utilization of domestic partner benefits to be 1,9% (the city of San Francisco) of employees enrolled. In each case there was no measurable increase in employee health claims following domestic partner inclusion. Since this figure falls within the median range, most insurance companies do not classify HIY disease as a catastrophic illness because its costs are considered marginal. In fact, nearly a dozen insurance companies have gone on record as offering domestic partner benefits at the same rate as legally married couples, There is no evidence to support any likelihood that the inclusion of domestic partner benefits will increase claims for HIV -related health care over single employee coverage, On the contrary, experience has indicated that those who register as domestic partners as less apt to make these claims, All employers and a national health care consulting finn (Hewitt)report that no adverse claims were realized after extending domestic partner plans. Even at the highest rate of employee utilization, HlY -related claims only (1,9%) only account for 1,7% of employee health claims. There is no measurable increase in HlY-related claims in plans that include domestic partners compared to those benefits paid on single-policy claims. In fact maternity care which accounts for 27% of family health care claims are of far greater concern to HMO's with respect to domestic partner inclusion than HIY or AIDS related claims. III. Benefit Exploitalion There is some concern that same. sex couples will stage a relationship for the purpose of receiving health care benefits. Employers have minimized this risk by requiring documented evidence of jointly-held financiul obligations, It is highly unlikely that couples would muke these types of finunciul commitments in the ubsence of u genuine re!utionship. Utilizution figures, of course, support this cluim, since fewer thun one tenth of the projected number of guy, lesbian, or bisexual employees actually enroll in the plan. Another reuson could be that this group utilir.es pregnancy benefits less thun married employees, PregmUlcy claims accounted for 27% of SUI hospitalization charges for 1989-90 and consistently represent the largest cost componelll of our inpmient charges, JlIlerestingly, Kaiser, one of the HMO's thm will be providing domestic panner coverage for the City of S:Ul Francisco, was more concemed aboUlthe high cost of mmemilY claims than HIY,relmed costs, While H1Y-relmed costs arc a valid concern in considering the extension of healih benefits to domestic pannelli, they have nUl proven to have a seriously negmive effect on other plans and should not be Ihe linchpin upon which we make oor decision, , ' -....... Hand delivered Madame Mayor: .r.- .t:- I wanted to elaborate on several points raised during the March council meeting regarding the proposed urban revitalization area located south of Burlington Street. First, though, I'm aware of some suspicion regarding my motivations for speaking up on this issue. I am not and never have been an employee, business associate, tenant, creditor of, nor lender to, Wilfreda Hieronymous, her family or her business interests. I am not related to Mrs. Hieronymous, nor do I move in the same social, professional or religious circles as she. The truth be told, early in my journalism career as a reporter at the weekly news, I was probably a thorn in her side and the likely object of her scorn, All is forgiven. That said, I want to again urge the council to approve this plan with as much dispatch as it can muster, I recognize this plan poses an important public policy issue which must be deliberated. I expect you and the other city council members to do just that. With respect to the procedural questions, (and assuming that the advice of your legal counsel on Tuesday last remains valid), I urge the council to proceed with the plan as it is now written and amend the plan to incorporate the design review and housing restrictions as discussed. I would urge the council to focus on the tax abatement policy issue regarding the proposed district and not consider the qualifications of a particular developer who may be waiting in the wings. The latest argument seems to advance the notion that downtown Iowa City office space absorption rates are so anemic as to make the need for new office space virtually non-existent. As a consequence, any new space built downtown will only result in a reshuffling of tenants out of older buildings and into newer ones. The upshot of any new development effort, it is argued, will simply result in one or two owners of new buildings profiting at the expense of established building owners, and all of this rigmarole financed on the back of Iowa City taxpayers. This is malarkey and it's beside the point anyway. It is a virtual certainty that a new Class-A office building downtown of the quality and size proposed by Wilfreda Hieronymous will result in some tenant relocation, You can probably expect several downtown law offices to relocate to such a building. I would expect the leasing agent for this building to aggressively court existing Iowa City professional office users as potential tenants. Frankly, I'm surprised this project has not already secured space commitments from such users. Be assured the building will attract some existing downtown tenants. But so what. This is capitalism, ladies and gentlemen. Some existing space users will find a new building more to their liking than existing space. The city council ought not concern itself unnecessarily with the reasonably expected consequences of offering tax abatements intended to spur certain kinds of development downtown. Yes, there will be tenant relocations and certain building owners may suffer some short-term hardship. But space vacated by existing tenants in older buildings will be taken over by new enterprises, either start-ups or other businesses that need space downtown. Mayor Susan Horowitz Page 3 office space downtown should be evaluated in the light of whether it will provide more opportunity for business activity in the central core, I believe it will. The argument against the revitalization area continues that the only reason new office space will be built downtown is because of the tax abatement incentive contemplated by the revitalization plan. Further, it's argued that tax abatement provides "unfair competition" to existing building owners. Again, so what. This argument, at its root, embraces the notion that city government has no legitimate interest in guiding land uses in the core. Nor does the city have any business shaping the market to intensify land uses where the market has failed. While some embrace a political philosophy that's friendly to these notions, I do not. I believe the city has a vital interest in the downtown core as both a retail and employment center. The two- and-a-half block area that's proposed for revitalization is woefully under-used. Although it is ideally located for commercial purposes, no developer has yet seen fit to upgrade these properties for more intensive commercial uses. The area is well served by the city's significant investments in parking facilities, our bus system, streetscapes and pedestrian mall. Despite the city's commitment to its urban core, suburban development poses a significant threat to the core's vitality as an employment hub. New office development on the fringe, in Coralville and at the Oakdale Research Park could easily relegate the downtown office space market to secondary status, important only to a narrow group of space users. This would be a tragic mistake. Whether you like it or not, suburban office developments offer several advantages that are attractive to business ow easy parking for employees and customers, proximity to new housing developments, lower costs and the opportunity to locate offices in park-like settings. Personally, I find such developments revolting, but then again, I don't rent much commercial space either. The point is, corporate location specialists o ,0 ' , '.'1' .... Mayor Susan Horowitz Page 4 do like such developments and they put buildings like that at the top of their scorecard when they're looking for new space, There is also a potential wild card. As part of the council's deliberations concerning the Iowa City Airport, the argument has been reasonably advanced that undeveloped land at the airport now owned by the city but not necessary to assure aircraft safety be sold to help defray the cost of certain safety improvements, Should the city decide to take this course of action, it's reasonable to expect private developers to build commercial and industrial buildings on this land. I'd be very surprised if the city did not also receive a proposal to build office space at the airport if land is sold. Finally, I want to address the issue of tax abatement and the myriad attempts during the council's deliberations to brand this tool as a "subsidy." Let me look at several arguments in turn, * Tax abatement constitutes a subsidy to wealthy doctorlIawyer tenants of a building with tax abatement. Rent for business premises is fully deductible on state and federal tax returns. If, as falsely claimed, rents in the proposed building are lower than elsewhere, tenants will pay less rent, but will probably also pay higher state and federal income taxes. But rents in the Hieronymous building will probably be at the top of the market. Tax abatement may allow the building owner to offer space at slightly less than the real carrying cost of providing the space, which may reduce the tenant's rent costs. Any reduction in rent simply increases the potential federal and state tax liability of the tenant. Some tenants of the building may have to raise their prices to afford the rents and protect their margins, but these are matters best left to the tenant and landlord. * Tax abatement constitutes a subsidy to a building developer who proposes a building that is not "economically feasible." Mrs. Hieronymous has done a pretty good job in outlining the pitfalls of financing commercial office space. Despite their credit ratings, Mrs. Hieronymous and other financially strong developers across the nation, are paying the price for the financial manipulations and outright crimes of the shysters who nearly destroyed the savings and loan industry. The price these developers must pay is that of finding money in a difficult marketplace for construction and permanent financing. Mrs, Hieronymous has also provided you with a good general explanation of the financial performance a commercial office building owner typically expects. The early years may be a little bumpy, depending on how fast the building rents up. Tax abatement simply allows the developer to build more building that he or she might otherwise be able to finance. Given the building design expectations of the proposed revitalization area, and the proposed design that Mrs. Hieronymous has submitted for your information, this is a fair trade. Larger, taller and more elaborate buildings mean higher property tax valuations and higher collections at the expense of a relatively modest forbearance during the lO-year abatement period, That Mrs. Hieronymous is willing to proceed with this particular project is all the more remarkable. Her determination to proceed displays the kind of deep commitment and concern about out city that should be recognized and encouraged. Tax abatement is a legitimate means of doing just that. ,Tax abatement confers an "unfair competitive advantage" to one or another building owner. Whoever said life is fair and where's the line to get squared away? The Code of Iowa has set out the legal requirements for tax abatement for a number of years, To my knowledge, the city has only considered one other application for tax abatement; that for a widely "uneconomic" Citizen Building project which would provide elderly housing. Property owners in Iowa City who've been unwilling to avail themselves of this tool have no one to blame but themselves. The time for presenting such information is now, during the public hearing process on the revitalization plan. Frankly, the effort by those who claim tax abatement will injure them has been unimpressive. * Tax abatement constitutes a special, and unprecedented "favor" not previously granted to business. First, the proposal you have before you offers developers the use of this tool only in a well- defined, compact area, for specific, well-defined purposes. Contrast this to the case in metropolitan Des Moines where the entire central city has tax abatement and many of the outlying suburbs offer it too, even on raw land! Secondly, I have attached the list of 18 active tax exemptions totalling $4.7 million for the current year, granted since 1989 by Iowa City to various industrial enterprises located within the corporate limits. There is ample precendent for the city's use of tax abatement as an ecomomic development tool for industrial purposes and this tool should be expanded to encompass commercial office space development.
