NDING ARTICLE VI, ENTITLED "PARKING FACILITY IMPACT FEE
ORDINANCE" .
Comment: At its meeting of March 8, 1994, the City Council
directed staff to prepare an amendment to the parking facility
impact fee ordinance requiring new commercial development in
the Near Southside Neighborhood to pay a parking facility impact
fee.

(2) CONSIDER RESOLUTION SETTING PUBLIC HEARING FOR APRIL
12,1994, ON PLANS, SPECIFICATIONS, FORM OF CONTRACT
AND ESTIMATE OF COST FOR CONSTRUCTION OF THE ROHRET
ROAD PEDESTRIAN BRIDGES PROJECT.
Comment: This project consists of the construction of two (2)
free-standing pedestrian bridges over U.S. Hwy. 218 adjacent to
the existing Rohret Road bridge. The approach pavement, minor
grade widening, and limited sidewalks on each side is also includ-
ed. The preliminary construction cost estimate is $740,903.00
with Federal STP funds available up to $481 ,487.00. This project
will be bid by the Iowa Department of Transportation.

FILL LEACHATE CONTROL SYSTEM PROJECT.

Comment: This project consists of the construction of a leachate
control system along the east edge of filled landfill cells. The
leachate will be collected and pumped through a lift station into
the City's sanitary sewer system. The estimated cost of con-
struction is $447,000.

12,1994, ON PLANS, SPECIFICATIONS, FORM OF CONTRACT
AND ESTIMATE OF COST FOR CONSTRUCTION OF THE PRIMA-
RY ROAD SYSTEM PROJECT NO. STP.6-7(42)-.2C-52.
Comment: This project consists of paving, storm sewer, flood
control, water main, sidewalk and landscaping improvements to
Highway 6, from Rocky Shore Drive to First Avenue in Coralville.
The estimated cost of construction is $2,200,721. Iowa City's
financial commitment is approximately $130,000. This project
will be bid by the Iowa Department of Transportation.

(51 CONSIDER SETTING A PUBLIC HEARING FOR APRIL 12,1994,
ON THE CITY'S 1994 COMMUNITY DEVELOPMENT BLOCK
GRANT (CDBGl PROGRAM STATEMENT AND THE CITY'S HOME
INVESTMENT PARTNERSHIP (HOME) PROGRAM DESCRIPTION
FOR THE 1994 PROGRAM YEAR.
Comment: Iowa City is required to prepare a Program Statement
which details how 1994 CDBG monies will be allocated. A public
hearing is required prior to Council's approval of the Program
Statement. CCN's recommendations will be forwarded to the
Council and published in the Iowa City Press-Citizen, prior to the
Public Hearing.
Iowa City is also required to prepare and hold a public hearing on
a Program Description which details how 1994 HOME funds will
be allocated. The proposed use of funds has been discussed by
the Housing Commission and will be available for public review
prior to the public hearing.

right, now we are back to the main motion and that is to
consider the adoption of the consent calendar minus those
items.

Now we are back to the items pulled out. Let's begin with
#3f(2).
Kubby/ Well, two things that we pulled out about what to do about
parking on City High are in conflict with each other and we
can't do both of them. At least that is clear if nothing else
and so those are two choices. I had presented a third choice
last night and people were uncomfortable with doing that
because the whole neighborhood had not been contacted about it
and we thought we need to deal with options that everyone
knows about and has been notified about. And in terms of
process I agree with that. I would like to move that we
consider the resolution that is the neighborhood compromise
about prohibition of parking on the south side of Glendale
with certain conditions and the west sides of Morningside
Drive under the certain conditions.

compromise means that not everybody agrees when you walk away
from the table.
Nov! Can we discuss all of these together before we start one at a

Nov! And it is D that is in conflict with the neighborhood
compromise.

Nov! So if we decide to approve the neighborhood compromise we vote
no on item D.
Kubby! There was some discussion last night after the meeting and
somebody said that if the real reason you want to ban parking
on the curve on Morningside is safety issues and especially
construction trucks for this interim period and the
construction vehicles are there before 8:00 and they are most
likely there after 5:00 because construction happens dawn to
dusk basically, why is the parking prohibition from 8:00 to
5:00 instead of basically all of the time or from dawn until
dusk. My basis has been safety issues I didn't really have an
answer and wanted to bring that question to this group to see
if someone else had an answer or if we just need to stick to
8:00 to 5:00 because that is what-

Horow! consistently throughout the city it is 8:00 to 5:00 any
prohibitions or any parking prohibitions.
Kubby! That is not true.
pigott! Most of the parking in that area and most of the cars in
that area are parked there from 8:00 to 5:00 and it clears up
after those times or i.s that not correct. I just wondered
whether the area cleared up.
Nov! It probably clears up by 3:00 because-
Kubby! This person was saying if you are really trying to deal with
safety issues and not trying to target students and maybe that
is hard to separate out at this point. That you would really
want to put 3:21 on the sign or whatever. But saying 8:00 to
5:00 is everywhere in the city is not correct because we have

speeding because there is no parking. I am not saying I am
promoting parking but I was there this morning too at the time
the kids were going to school. They were just dashing. The

of the compromise, I am a little concerned that people might
simply speed because it is easier to drive through there and

Nov/ I have some discussion on this one and this would also apply
to the next one which is a parking prohibition on the cul de
sac on Dunlap Court. There are some people there who have
been talking to me about the need for parking during the day
on occasion. For example they have grown children and the
three families all get together for the week of Christmas to
New Year's and other such time. There isn't enough space on
driveways for everyone to have all of these cars on the
driveway and we need to think about the possibility of a
special permit for a limited time. Other cities have done
this kind of thing. You can do it by a phone call of a letter
that says this car with this license number will be visiting
for the specific period of time, specific date and it can be
given a permit for just those few days. And if the council
will agree to do this kind of administrative compromise on
occasional guest parking I think that I can support this.

we simply required the people to call in with a vehicle
description, plate number and it just simply went out to that
particular watch and we usually limited it to a couple of days
and if it was anything longer than that then they called back

I got this feeling that the other three people for the tax
abatement, if it weren't linked, would not find the parking
impact fee the best policy decision. It didn't seem like there
was big support for it. But the three people who were willing
to it to get the tax abatement and the three people who don't
want tax abatement I felt were interested in the impact fee
but I felt myself hanging back because I didn't want to give
Larry four votes for an impact fee because I didn't want the
tax abatement to occur. And so there were six people on
council possibly that were going to make a policy decision
that they really didn't think was in the best interest of the
city because of the political system and I don't want to base
my policy decisions based on that kind of a situation. And so
I will be, even though I said last night I may not be
interested, I really was. I was playing a game. I don't like
to be playing those games so I am not going to be playing them
anymore.

Larry Quigley/There is a group of us here tonight that are
addressing the city council an issue that I have addressed
before. I have a letter. I don't know how many people got the
letter. There originally were 15 copies.
Horow/ We all have it.
Gentry/ Not all of us got it until now.
Quigley/ Some of them got distributed somewhere else. I also have
a copy of the ADA Handbook, section 3604 Removal of Barriers,
Title 3 which is also in the letter I made reference to the
priority issue. It is really important that people understand
the ADA ACT is designed to stop current discrimination against
people with disabilities. As far as I am concerned and as far
as a lot of people are concerned it is blatant discrimination
and the issue the money is always brought up. I hear lots of
dollars being floated around here tonight. I think the city
needs to spend some money and I am not ashamed to say that. I
think they need to spend some money on people with
disabilities. And there needs to be some changes made.
Attitudinal changes made with the businesses around here. And
also the city. The city needs to be more proactive and there
needs to be more done. So I have the letter. I guess I will
read the letter so that everyone here knows what it is about.
(Reads Letter) So that is it. The city is actually in
violation and that is the way I read it and that is the way I
want the city to look at it. There are things that need to be
done and some people are really getting tired of waiting. So
I guess that is all I will say.

Gentry/ I am at a disadvantage, Larry, because this is the first I
have seen it. I know that Dale Helling and I have talked last
week about getting together with Chuck Schmadeke who is Public
Words Director and Doug Boothroy who is the Director of H.I.S.
Those two people were both on vacation and we plan to meet
with them today on establishing some parameters for easements
on public r.o.w. Those can only be done on a case by case
basis based on whether you are creating an obstruction or a

any initiative on the part of the city or the businesses to
get the easements put in. So what I am saying there needs to

to inquire about it. Someone can come out and make an
inspection to say you could do this kind of thing but not that

Gentry/ And Doug has his concerns under the UBC and Chuck has his

Quigley/ I talked to Karin Franklin, Community planning, I guess
the procedure goes like the business comes to the city
Attorney. The City Attorney, then, needs to go the Public
Works. Public Works and the City Attorney need to determine
whether of not an easement is possible, a criteria assessment
kind of thing and then they come to the city council and the
city council has to approve the easement. That is correct.
And then the easement-then the city council has to go to the
Public Works Department to determine whether or not the
easement is doable. So it is kind of a back and forth
process.
Gentry/ No. Once Public Works makes a recommendation and my office
makes a recommendation, then it comes to the city council.
This, you have to understand, is dictated by Iowa property law
and municipal law. It is not something I made up and I am
just enforcing Iowa law as we have it today.
Quigley/ I think it was October the first time I brought this up.
I don't know how many months have passed.
Gentry/ And my assistant has been at all of your meetings.
Horow/ Larry, I think sometimes these things appear to be very very
frustrating. They have got to be done accurately so that you

I think that is important that we understand that easements
over public property are not that difficult to obtain as long
as they satisfy the legal and technical requirements of the
bureaucracy of Public Works.
Kubby / But there are two questions here. One are about those
businesses who need to comply with ADA on their own and others
that may need to through processes that we have some control
over.

against. And if it was another minority it would be
recognized. But in the name of the cost of renovations,
readily achievable language, we are always bringing the money
aspect into it and anything or any change has cost money. And
I am saying that the relative change for ramps or easements or
whatever it takes to make these ramps-to make these businesses
accessible that maybe the city needs a program. Maybe the
city needs a program and they need procedures as they do with
housing rehab so that people can apply for money. Businesses
can apply for money to do these.
Pigott/ Sort of an incentive program perhaps that would encourage
them through CCN funding to give them money to carry out these
procedures. Is that what they are saying.

easier because I don't think the actual cost is that high. It
is just ramp costs.
Kubby/ I have got to believe that there is also some grant money
out there. That as this issue becomes more and more important
for communities and communities wanting to take some action
that there has got to be some foundation money that we could
explore, looking for, actively looking for to have so that
when Coalition members and Chamber members go together to
businesses they can say there is this money to apply for
through the city or through the foundation or that foundation
They can have all that laid out so that it is easy.
Quigley/ Also, I think there is a need for the city also to take
some responsibility. Now who is saying that, for example,
that businesses along Dubuque street and along Clinton street
that are one step are out of compliance. Maybe the sidewalks
have to comply. Maybe we need to raise a sidewalk. Okay.
Horow/ I think we will look into it. Not just us. We have already
started with the city Attorney's office. We are asking CCN
then to look at their program. These are all city programs we
would have to start giving direction to. What I would like to
know if there is anyone else who would like to speak along the

to bat for many many people here in the community that don't
speak out and don't come to meetings and don't even attend
groups for advocacy and maybe they think it is they are going
to get sort of kicked out the door or looked down on and I
think what he is asking and what we are asking is that
person's with disabilities are considered regardless if they
are here or not. We have the right to be able to get into any
of these facilities d.t. that anyone else. And, by law it is
required that new buildings or new facilities, new businesses
going in and renovating are made accessible and that is what
we are asking to have done. I am sure they went in and
renovated or did whatever they wanted to make the changes
inside the Texas Steak House to make a change for the burger
place that it was and by law my understanding of it is then it
is a new facility or new establishment and that under that it
falls into be able to be-it has to be made accessible. And I
know that there are city guidelines with having a distance of
the ramp and I know there is always the issue of the cost of
having a ramp and that we as a group went at one time-we had
another group who went to the Mill and had spoken with the
owner of the Mill and everything else and he brought up the
thing of saying that well, he was going to have to shut down
the front door if he was going to have to build a ramp there
and he wouldn't be able to get shipments in and all kinds of
things are brought up that were just outlandish and ridiculous
in my opinion. stating that it was going to cost him however
many dollars to shut down to make it accessible. Well, in the

long run he did make a ramp. It is in the side back. I don't
know how that happened. It came out. It was put there. I am
sure it wasn't that big of a deal afterwards but in the
beginning it was stated that way and it was going to be a
horrendous affair. And so there is an example that it
obviously wasn't such a bad deal. It can be done and we are
just asking. A few of us did show up more than just Larry and
we are just here to say please help us in making it accessible
for the people now and in the future that have disabilities.

Renee paine/ I will just get started here and then I will sign my
name after. I live at 4347 River Bend Road S.E. here in Iowa
city. I am the Director of Public Access here in Iowa City and
I just want to give you a quick update as to what is going on
at the access center. We have a lot going on these days. Last
week we were involved with the spring science Center workshops
and we hosted two groups of kids and they got a chance to find
out a little bit about how television is made and that was
pretty exciting. We are looking forward to being one of the
judging sights for a national video contest. The Home Video
Festival and that is sponsored by the Alliance of Community
Media and if you don't know what that is it is a national
organization that is dedicated to access issues and the medium
of television and other kinds of communication fields. We are
having a free grant writing workshop coming up on May 4, 7-9
PM, Meeting Room A of the Iowa City Public Library and this is
sponsored by the Iowa Humanities Board and everybody is
welcome to attend that. We are going to be concentrating
mostly on writing grants for our producers and also for the
Access Center as an organization. We are looking forward also
to a hosting a regional spring conference for the Alliance for
community Media. That is going to be here in Iowa City on May
20 & 21. And that is a nine state event. Nine states are
involved and once again that is people who are interested in
issues in access and it is really exciting time because of the
information super highway and all of that. So we are looking
forward to about 150-200 people being a part of that are in
Iowa city and that is coming up in May and finally we
encourage everybody to tune in to Open Channel and come on
down to the Public Access Studio. It is every other Friday
night. The next show is April 8 and it is a live program from
5-6 PM on Friday evenings. Just come on down. You can call
ahead to make sure that you can reserve a place or just come
on in that night. You can talk about whatever you want. Do
whatever you want and that is a way that we try to accommodate
people who don't want to go through the workshops and don't
have the time to do that and still get their message out. So,

Anyone else who would like to address
Linda Heneghan/ I am a member of Johnson county Coalition for
Person's with Disabilities and besides the easement issue
another issue with the accessibility is transportation and
there were a couple of facts that I found out recently that I
would like to just tell the city council about. In 1973 they
passed an act to make public transportation wheel chair
accessible and it has never been done in Iowa City until 1993.
You know, that is 30 years-20 years. Also, one of the needs I
feel that persons with disabilities have are like call ahead
service. I don't know anybody that plans-well, they try to
plan their day maybe a day ahead or 14 days ahead. But how
many plans stick to what they have decided to do you know for
the next two weeks. And I don't feel that I am any different
than you. My word for persons are temporarily able bodied
other than me who is disabled. A person with a disability.
Another issue that was brought up was as long as these
businesses are open it would be nice if some of us had
transportation to get to and from them. Like bars close at 2
o'clock. That is not my issue but it was mentioned by
somebody. Also another thing they do make public transit buses
that will hold six wheelchairs. Right at the moment the public
transit only hold two and with more and more buses coming in
I think by 1996 there are suppose to be something like 15.

opportunity to come and go at more free will. So, this may be
a consideration to tell the DOT. I think that is all I have
got to say for the moment.
Kubby/ In terms of all of these issues. The city is updating-we are
going to update our comp plan and before-for other people out
there, there are lots of opportunities to get involved in some
of these issues by getting on one of our task forces that will
give us some suggestions on how to update our comp plan and I
hope that a lot of people that are here tonight will put their

lived here most of my life. I do have a disability. The
disability is not well know. Well, I would like to say that
we do need easements and we do need transportation and these
all come together and Hawkeye Advocates which I am a member
and you have probably seen my name. We would like to have our
voice known in these boards and commissions. I am one person
who is with the County Board for Mental Health Mental
Retardation. There is the other two. But it seems to me when
we find out we found out a day later and we as people with
disabilities want to know. We want to go through the process
with these people and this is 1994 and if it is Larry Quigley,
if it is Tim Clancey, if it is me, we need the council and we
need the Coalition, we need everybody from the community to
come together because why do we even have this active-these
buildings are not accessible. We need these places and these
places-these people that SEATS or Transit get together. That

bringing up one thing, don't need to be anything such a small
thing and please proceed on the higher scale and I just wonder
who your interim director you have for transit director. How

are definitely human as anyone else and if we cannot
participate in this community as a credible person, the

this country with other minorities being put down or put into
a corner or put into certain part of town because they are
different. But everybody forgets and I don't mean to be
dramatic but everybody here is a step away from a disability
and then you begin to realize what discrimination is. How

throughout the evening I have heard a term being used. I work
with Independent Living Inc. and I am also a member of the
Johnson County Coalition for Persons with Disabilities. I
have heard a term that is being used that to me is very
derogatory and it kind of gives me like the hair on the back
of the neck kind of raises up and that term is handicapped.
The term handicap is derived for an English term that is this:
cap in hand. You are basically saying that the individuals
who have disabilities within this community are beggars. That
is what the term is derived from. As an advocate it has been
stressed to me to make emphasis on the individual first. They

Ten Inn and remembers the car hops, I was one of those car
hops. Now, I am here tonight as President of the Iowa city
Women's Bowling Association. We have a membership of 1500. We
are one integer in a family of four. The Men's Association,
the Women's Association, the Junior Association and the
Bowling Proprietors. A year ago the Women's Association
decided to bid for the 1996 state Tournament. We had a signed
letter for the former mayor, Darryl Courtney, signed June 6,
1993 supporting our bid. I am shaking like a leaf because I am
so angry at this council and what they have done to the
merchants of Iowa City and to the Chamber, I am sorry to the
Convention and Tourism Bureau and in particular, Wendy Ford,
who worked with us for over a year to submit a bid and two
weeks before we were to go to our state convention this
council and the Airport Commission torpedoed us. We were
bidding against two other very large organizations, cities:
Cedar Rapids and Davenport. We could not overcome the negative
press and t.v. coverage this council generated and that $2
million worth of business that \vould have come into this
community was lost 25 miles north. If you, as a council, and
specifically the mayor are going to sign a statement
supporting us don't torpedo us. We were just devastated. Our
people have worked for a year on this. I passed along the
delegate gifts that we gave the members of my board who worked
diligently raising money for the gifts. The men bowlers, the
junior bowlers, the proprietors supported us and especially
Wendy Ford from the Convention and Tourism Bureau. She worked
her fanny off helping us. The merchants of Iowa City very
generously donated over 150 door prizes. And I am not talking
rinky dink door prizes. I am talking diamond necklaces. I am
talking 5 X 7 area rugs. Now how do you think those merchants
feel about contributing the next time someone walks in the
door and asks for a contribution for an event.
Throg/ May I ask you a question. I saw your letter in the paper
today and I assume it is the same.
Preston/ It is similar, yes.
Throg/ I understand that you are angry.
Preston/ Yes, I am angry.
Throg/ But you are going to have to help me understand what you
think we did or what we did do to as you say torpedo. Help me
understand.
preston/ Let me explain. As a bowling organization you don't bowl
in the streets. We bowl in bowling centers. Colonial Lanes in
one of the two centers in Iowa City that is large enough to

hold this event. out state rules state that you must have at
least two 24 lane bowling centers. When it was announced
prematurely or what have you a couple of weeks ago that the
airport would be expanding and Colonial would be gone in the
year 1996 the bowlers across the state saw and read that
information. Our delegates vote. We could not generate enough
publicity and enough information to those delegates to
reassure them that Colonial Lanes was still going to be there.
Do you have any other questions on this.
Horow/ I would like to then pick up on this because Charlie Roberts
and I have been on the Kirkwood Avenue Association for a
number of years. She called me and I got a letter pulled
together very quickly which I had assumed was what she wanted
and what you wanted.
Preston/ Yes, Charlie, very nicely-we did-but we were also assured
and we were told that we did not need to go to that Airport
Commission meeting last week. But we were assured or at least
she assumed that we were assured that the statement would be
made that Colonial Lanes would still be there in 1996.
Horow/ That was not one of the threads that I picked up to tell the
Airport Commission.
NoV/ I did read that in the paper though.
Horow/ I am at a loss to know how we could have anticipated that
the press would have even published it if they had said it.
Preston/ My question to this council is do you not work closely
with your Convention and Tourism Bureau to know what events

Preston/ You can control what is on this agenda and two weeks
before our delegates from across the state went to that
meeting you did not have to have that airport issue on the

they are worried about Colonial Lanes.
Preston/ I am fairly confident that we did not get it because of
the bad publicity. The first vote for the three cities: Cedar
Rapids, Davenport and Iowa City was Cedar Rapids-89; Iowa
City-87; and Davenport-82. And the way our organization runs
is the one with the least amount of votes drops out. Those 82
votes of Davenport's and I have no way of knowing. Those
people were not all from Davenport. They are only allowed a
certain number of delegates. But the people that voted for
Davenport were the ones that made the determination between
Iowa City

how rumors are taken as fact and I just don't want it to
happen to another group that is trying to bring $2 million
worth of revenue into our community and the only reason I am
here tonight is because I want our merchants to know that we
fully appreciated all of their efforts and some day we will be
back asking and I don't want them to say what is going to
happen to the next time.
Lehman/ I am a bowler first of all. Not a real good bowler and I am
also a business person. I also gave a door prize and I can't
believe that we lost that strictly because of the airport.
Nobody who is voting on a convention would assume that any
city would be bidding if they couldn't provide the facilities.
Preston/ Well Ernie, to be real frank with you the city that is
going to host the tournament next year had a bowling center
close and the state secretary was not informed until she got
to the state meeting last Wednesday that that center was
closed. She indicated to the delegates to make sure that there
was proper facilities and it doesn't take a lot of subtle
things being said. Iowa City only has two centers large
enough. We are not like Cedar Rapids. We don't have a half a

dozen that has over 24 lanes. Between that and this it was
enough. It really was.
Kubby/ The other suggestion I had maybe was Bruno since you are our
representative on the eVB that especially in this particular
instance where we had a meeting planned and it got cancelled
due to weather that that could have been something that the
eVB saw as kind of a flag. Make sure that this point is
emphasized so maybe you could relay that it is a two way
street of communication and that us being informed of pending
events is equally important to us.
Pigott/ I would be happy to relay that to them. Happy to, great.
Preston/ And if you need more information we will be glad to
furnish you with it with anything else and mayor, also with
your proclamations I would like to stress (a) and (e).
Bowling is the type of sport that relieves family stress,
promotes emotional well being and also promotes time together.
The bowling center in question is not just a bowling center.
It was well ahead of its time when it was built in 1959. It
originally had 16 lanes. Where the last 8 lanes are was the
put put that is now over on the north end of the building and
in the north end of the building that was filled with billiard
tables. That is not used just by bowlers. The Big Brothers/Big
sisters use the lanes every year free of charge for their
promotion. The Boy Scouts and Girl Scouts come down, the
churches. I teach junior bowlers. We have over 100 junior
bowlers every saturday morning. Also the handicapped come in
and use it and especially Playmor. If anybody wants to bowl at
Playmor they have got ramps to go down. It is used by hundreds
of people that have no connection with our association.
Birthday parties. I coach a youth/adult league where the
parents and children bowl together on sunday evenings and when
we get done at 8 o'clock there are people standing in line
waiting for those bowling lanes. So I want you to know that
that bowling center serves the total community and not just a
small portion of the community. And I thank you for your
attention.

Bakerl Madam Mayor, in a continuation of our discussion we had last
night. We had discussed various options for setting the
public hearing and there seemed to be a tentative agreement
last night that 1800 sq.ft. would be the figure that we would
use. At that meeting that night I suggested that perhaps we
ought to start at 900 to allow us more flexibility if we
wanted to amend it in the other direction instead of starting
at one figure and amending it down to make it more
restrictive. I would like for us to consider that before we
vote on this tonight and use the 900 figure again and with the
possibility that it can be amended up. But I would like for
us to start at that figure and begin our deliberations and
allowing ourselves a little more flexibility. I would like to
offer that as a suggestion to see if there is anybody out
there that would like to support that idea.

with-is there another portion later on about parking impact

total benefits from the proposed development consistent with

and by soon I understand that to be some time probably during
the month of May. Right. The second understanding would be
that design study would include the basic features contained
in the proposal that Bruno and I suggested three weeks ago.
I don't want to reiterate them right now. If you would like to

that any new parking structure that might be built as a result
of this situation provide-consist of office and retail space
on the first floor. And I guess fourthly that I will oppose
locating a new public parking structure in the 3 1/2 block

parking lot in that area would be misguided and wasting
valuable commercial office space. So I think that is what I

design standards for that area. specifically the Dubuque
Street area that we talked about possibly closing including a
pedestrian mall. That would be something that I would like to
see.

point about the basic elements contained in the memo that
Bruno and I wrote to involve those design features. I did-I
omi tted one other point and that would be a net gain of
affordable housing in the Near South Side.
Baker/ Can I respond to several of those things. certainly with
almost all of those I adamantly agree up front. I have two
sort of clarifications that I would like to get across. When
you are talking about you could not support putting a parking
ramp in the CB-5 zone I am assuming you are stating what you
would like to see happen but you are not asking for a
commitment from us to guarantee that that happens now. It is
just something that you want us to be aware of.
Throg/ I would think that would be a bad place to put a parking
structure and I would personally oppose it.
Baker/ I would not rule it out putting it in that zone. I certainly
think that we ought to allow ourselves time and some
flexibility to put it where we think it is the most
appropriate place and I don't rule out the CB-5 zone now as

plan and there seemed to be people on council that liked the
idea. Liked some design standards down there and want to talk
about those things. I understand your misgivings about this
particular revitalization plan not including your plans at
this time and I think I went on record saying that I support
it in general your ideas and would like to see some version of
them passed. So I am comfortable with what you are interested
in now but again with a couple of minor reservations I
certainly am not going to commit myself to absolute fidelity
to it.
Kubby/ So you are willing to make your vote on revitalization plan
pending on something very specific but you are not willing to
have-to make other people's votes for the revitalization plan

Douglas Russell/ I am the chair of Iowa City HP commission. I
appear you before you on behalf of my fellow commissioners.
The proposed Brown street Historic District is an idea whose
time has come and I would like to give you some information
briefly. I am going to proceed without audio visual aids in
the interest of brevity. The HP Plan was adopted by this
council in December 1992. It identified the north side as one
of 12 older neighborhoods that should get the attention of the
city council for historic preservation purposes. It identified
Brown street and a Brown street Historic District as one of
the key objectives for the North Side neighborhood. In March,
1993 the Commission obtained a grant to have a professional
consultant complete a survey of the Brown Street area and
prepare the historic district proposal. The proposal that you
have before you we are satisfied is a good product and it is
justified historically, architecturally and politically. In
April, 1993 in cooperation with the North Side Neighborhood
Association we distributed packets of information about the
proposed district to every household in the proposed district.
In september 1993 the consultant held a public meeting in Iowa
ci ty to which the public was invited. This topic has been the
subject of numerous neighborhood meetings and many many HP
Commission meetings. The proposal before you is in compliance
wi th the city ordinances in all of its respects. Every
property owner in the proposed district received written
notice by mail before the Commission held its own hearings.
In January this year the HP Commission gave its unanimous
approval after a p.h. In February this year the P/Z Commission
gave its unanimous approval. Following another p.h. the city
staff concurs with the proposal. The proposal has been
approved by the State HP office. The proposal has been
endorsed by the board of the North Side Neighborhood
Association and we have taken the liberty of conducting a
survey in the past two weeks of the Brown Street residents to
see what the public interest was in the matter. There are 100
households in the proposed district. 73 of them gave an
ans~Jer, 27 were unavailable to comment, 61 or 84% were in
favor of the proposed historic district. 84% of the answering
households, 10% on the answering households were opposed, 6%
of the answering households had no opinion or were uncommitted
on the issue. Although this is not a referendum, these numbers
should be illustrative of the feeling on the North Side. You
have an opportunity with this ordinance to make historic by
preserving a portion of Iowa City history. On behalf of my
colleagues on the Commission I urge you to approve the
ordinance when the time comes to do so. It will be good for
Iowa city today. It will be good for all of Iowa City and not
just Brown Street property owners. And it will be good for

Iowa city in the future. I think if you approve this
ordinance, create this first historic district in 11 years
since Summit Street and Woodlawn were created that future
generations will comment favorably on your wisdom. Thank you.
Pigott/ Doug, can't I ask a question. You have mentioned a number
of p.h.s and surveys. Could you just tell me how many you
folks had. It was a good number.
Russell/ There were five block meetings on the Brown Street
District. There was a separate block meeting for the Bella
vista neighbors. There were-every HP Commission is a p.h. and
there have been literally dozens of those over the years. On
this particular ordinance there was a p.h. in the HP
Commission and a separate one in the P/Z Commission.
pigott/ I just thought that that was wonderful that you folks went
out to the public like that and I want to commend you on that.
Of bring it and including the public in the process and I
think we can learn a lesson from that in all of our
activities. I think it was marvelous.

haven't talked to anybody on the approved of this.

Jensen/ And I haven't run into anybody that approves of it and the
only person I know of that approves of it has a vested
interest in making it a historic place because he does
historic reconstruction work and design painting and it is to
his-well, he is going to profit from it because he is going to
get more work doing this type of thing and I believe he is the
one that was pushing it. He can come up here with all kinds
of figures but I haven't talked to anybody that is in favor of
it. You keep saying they want it, they want it. Well, where
are the people that want it. They never come up here and say
they want it. Your last meeting there wasn I t anybody standing
up here and say I live on Brown Street and I want to be
historic neighborhood. All we are hearing is figures but no
people. I can come up here and say 99% of the people of Brown
Street don't want to be a historic neighborhood because it is
going to cost more money. You got to get okay on everything
you do. You have to pay a commission, a fee, to come out and
get their opinion. And we don't want it. We got along great.

And now we have somebody comes into the neighborhood restores
a couple of houses and decided well, let's make everybody here
restore their houses the way we want. Not the way they want
them, the way we want them. The Historical Society is trying
to take over the whole north side. They couldn't get it done
about three or four years ago. So now they have backed up and
they are going to try and do it one street at a time. Start on
Brown Street. Next year you are going to hear about Ronald
Street. The year after that Church Street. Then Fairchild.
Then Davenport. Then Bloomington. Pretty soon it will get down
here and we can make this place historical.

Kubby/ I do want to correct three things that you said. That l-one
don't have to pay a fee when you talk to the HP Commission
about changes you make to your property. 2-It is only certain
things that you have to check in with them about. You don't
have to check in with them about painting and some other
things. But any external structural changes you need to go to
the HP Commission to get a certificate of whatever from them.
So, whether or not I agree with your views, just make sure
that people are getting correct information.
Jensen/ Another thing is he said that everybody was contacted.
Nobody ever contacted me. I am retired. I am home all of the
time. Nobody contacted me. They said some of them weren't
home. Maybe I wasn't home but they could have called back. I
don't remember any questionnaire to fill out whether I want to
be historical or not. I am historical. But that house isn't.
It is just an old house.

Illene Holbrook/ I have lived on Brown Street more than most and
less than some. I also was notified one time Doug of a meeting
and that was by telephone. Last week was the first time
anybody came to my door and that was for the survey. I am not
against anything historical. Some of you that have been on the
council know that I have been here before in favor of
preserving and so forth. Our house was built in '24, nothing
historical about it. I guess what I don I t like is to be
dictated to. I think individual homes to be on the historical
list is a wonderful thing. If either one of you had a home on
Kirkwood or Brown Street or wherever in town and it was an old
house that you had restored as a historical home, that is
wonderful if you want to get in on the HP list. But I don't
think that we who do not want our homes on a historical list
should be deemed to do so and I think it is against our
constitutional rights actually because you are under a

have to get somebody's permission or you want to do a little
trimming on your porch or maybe you want to add a deck or do
something else to the exterior of your house and you have to
have a commission come in and say you have got to do this and
you have got to do that. There is something wrong there.

from the sidewalk on a pedestrian area.
Holbookj I now there are little nicks and curves and in betweens
and all of this. But the idea is-I really think it is against
our rights. There is nothing historical about our house. It
is a too big house that we are having a hard time selling
because it is too big. In fact there is the vonnegut house you
all know. That is the type of home that should be on the
historical list. It is. But I don't know why Brown street has
to be an historical street. All the homes aren't all old
homes. And I would like to know what happened with the other
percent of people that weren't home. I think they could be
contacted also. And there is just a few of us here tonight
but I know of more that have contacted me. In fact that is
kind of how I knew how one of these meetings was going on was
from another neighbor that lived up in the next block. Was a
little hot and heavy about it and I guess it is everybody's
fault if those hot and heavy people don't want it and they
don't come out here like the rest of us and speak up. Possibly
we won't be living there much longer, hopefully. But I just
hate to think that anybody has to live under the thumb of
somebody else. I think that it is our freedom here to do what
we want to do with our homes and if we want them on the
preservation list, fine. And Mr. Jensen was right because one
person buys up homes on Brown street and redecorates them and
wants Brown street. This is the way it all started. One man
pushing it and that man got his way and I don't think it is
fair to the rest of us. I have been kind of hot and heavy with
you guys over a couple of other things tonight. I was sitting
there thinking hold back your temper Eileen. And I am doing
that; But I guess it is a late in the game now. I should have
been one of those at those meetings and had I known that they
were all going on. I was coming to one and ended up out of
town. I would have been there but I was notified one time and
one time only and the only other time outside of friends I
talked to in the neighborhood. But the only time anybody from
this commission contacted me was a representative that was

steve Vanderwoude/ I live at 730 N. Van Buren. I have lived in the
neighborhood for 20 years and I have pretty much been active
in revitalizing the North Side Neighborhood with newsletters,
the neighborhood association, neighborhood fairs and I think
districting is another tool in the ongoing process. Somehow
I have polarized my neighbors. I didn't mean to. I
appreciate your support.
Charlie Grunewald/ I want you to know one thing that I am not
against a historical area. The only thing that I do say is my
mother was probably one of the first ones that had petunias
planted up and down the places. I can remember helping here
and that was one heck of a job. I don't know how many
thousands of plants that they did plant up and down Iowa
Avenue and around the areas of where ever the Veteran's
Hospital out here and so forth. The thing that bothers me
more than anything is the fact that someone who can get money
for the historical area to buy homes and revamps them and so
forth and I have not been able to buy any homes without paying
my interest rate and not any forgivable interest. Now this is
getting to be just a little bit too far. I think there are
only two homes there that are historical. On Kimball Avenue
and Dubuque Street the lawyers house that sits up there on the
hill. That is beautiful and that should be preserved. The
other one, home, is it is just being remodeled and I think
that is on N. Van Buren and Brown. Back out there and the lady
is spending thousands of dollars up there to make that a
beautiful place. It is five acres. Those are the only two
beautiful homes in historical area that have been around for
a long long time and I will go along with that. But with
Brown Street I cannot go along with that. My house is an
apartment house. That is what it is and it will always be that
way. I don't have any family. I don't have anybody to look
after. The only thing I am is a bachelor farmer. And when you
are a bachelor farmer you bring home calves quite a few times
or a lost mother or lightning struck. I can remember having a
cat that mother was-it was just shortly born and it was struck
by lightning and I brought her home. I put it out in the
backyard there, tied it up, I had the Police Department, I had
the dog catchers and everybody say hey you can't have a calf
in there. Well that was the most beautiful thing that
happened in the neighborhood. I had more kids coming around
there playing with it. I said that calf is no different than
a police dog. It is going to stay there until he is able to
eat by himself. I said you want to go to court you are talking
to the right kind of guy. Well nobody took me to court.

Grunewald/ I have had a lot of nice friends in this town. I have
taken many animals down to schools to the first, second and
third graders. I have gotten a lot of nice letters back. I
have had ponies where I took the kids and go out and ride the
ponies out there. So I have been kind of a young mother for a
lot of them. But another thing I want to say we have Black
village out there. Have you ever been in those places all of
you. Not a damn one of you have. Or you would see the sheets
as the dividing line. If that is suppose to be historical up
there then by God somebody better clean it up pretty soon. It
is unbelievable. Here is a kitchen with one bathroom in it
and they use sheets to put across to divide the thing up. I
was talking to a girl one day and somehow Black Village came
up and she said you know I had spend the whole day just
cleaning up the kitchen, a small little kitchen there. And
that kitchen was so filthy that it took me the whole day to
clean it up. And after I got through the next day I went in
there the people that lived there they didn't have any-it was
just about as dirty. She had to just move out. You people had
better start looking around some of that Brm'ln street up
there. You had better go up there and start looking at it.
Look at the stuff and junk that is up there. I am just
surprised that you people hadn't done that already. If it had
been my house you would be all-I would be on report so damn
many times it would be pitiful. And if you are going to do
this I may have to sue. Thank you.

Al Soucek/ 801 Brown Street. I also own another house on Brown
Street at 727 Brown which happens to be the house I was born
in. So I think I'll probably take my little priority as far
as longevity and all that goes on Brown street. I am here to
express my strong approval of the proposed HP District. I have
been all through it. I don't think anyone was denied any
chance to attend a meeting or to express their opinion. I
think Mr. Russell have given his facts and figures and they
are there. I personally, I am not going to spend a lot of time
without a (Can't hear) like some people have. I am going to
get down to the point. I did go from kindergarten to high
school, City High, and then four years of liberal arts and
four years of dentistry and stayed there until the wars came
along and I was gone for about 12 years and likewise with two
older brothers one of whom took medicine and later became a
psychiatrist and another one took engineering and became a
hydraulics engineer. So we were the very popular people
around there because we carried papers and we did lawns and
did snow shoveling so I got to know the people very well. One

of the things I want to express to you and I don't think it
has been brought up before. And that is that there are a lot
more to that district than just the wood and the brick. I
want to take you down a little trip and not going to spend a
lot of time but in the 700 block of Brown street where I was
born, on the corner, on the southeast corner of Dodge and
Brown was born will Hayek, very prominent lawyer, good
soldier, when in as a lieutenant colonel in WW II and came out
a brigadier general. Next door, he lived most of his life when
he first started his practice. On the corner across the street
from him Dr. Chase lived. A pioneer in public health and
preventive medicine at the Uni versi ty . He also doubled as
health officer of the city. He house was later occupied by
White who is in the Department of Romance Languages.
Next to him Fred Racine, the big house that is now occupied by
Mrs. Hickerson. Fred Racine was a big businessman. He had
three cigar stores in Iowa City. Anybody who ever went to
college knew about him. Loren Hickerson took it over and now
his widow is living there. On the south side of the street 600
block was Professor House who was a distinguished professor of
spanish. Now let's go up to Johnson street.
Horow/ Mr. Soucek, you have one minute.
Soucek/ Okay. I am talking about Rolly William, Eddy Anderson,
Professor Shimek, Professor Bartel, Dr. Bye, Dr. ,
Hayden Raymond, lot of famous people lived there. So it is not
just an ordinary garden variety neighborhood. You have had
two mayors from there. So I, again, voice my approval, 100%
for the proposal. Than]{ you very much.

Liz Miller/ I am the President of the Northside Neighborhood
association. I am also one of the people who was doing this
survey that Doug Russell reported about. And just in case
anybody wonders I went to every house three times if need be.
On a few occasions I couldn't get people at all. One is in
D.C., three are out of the country, what can we do. That is
where the unknowns come in, things like that. The Northside
Association has supported this project from its beginning. In
september our Board voted unanimously in support of it. We
have been doing all of these things you have also heard about
the block meetings, distributing things door to door, we have
reported things in our newsletter. Either Doug Russell or
carolyn were at all of our meetings. We have tried to
encourage everyone to call people if they had questions, let
their opinions be known about it and we think that everybody
has had that opportunity. We believe that the historic
district will benefit all the people who live there and we

also believe that it is a good thing for the entire north
side. Perhaps the appeal of the district will ooze out into
the rest of the blocks and make the rest of us as important as
it would be. One of the problems that we deal with very often,
our association does, is lack of care for the architecture and

side. Perhaps a historical district would be a reminder to
everyone that we should acre about these things. It is obvious
that the people who live on Brown street do care. All you have
to do is look at it. You know that everybody likes their
homes, takes care of them and it is not just that the homes
are historical but that they are so nice. They have taken good
care of them over all of the years. Everyone has. For those
reasons the people who live there do deserve to have their
area declared a historic district. It would be an honor to
them and to the people who have been there before them. I
don't happen to live in that district but I am right on the
edge of it and it would be very nice to me if I had been
included but I am not. So I can just be happy that I would

there are many of us on Brown Street and in the north side who
appreciate people like steve Vanderweirte and other property
owners who have done really wonderful things with old houses
and I wanted to tell you that I have lived in Iowa city for 20
years and I have always wanted to live on Brown Street and I
have lived there for four years now and I couldn't be more
pleased about this and I encourage you to approve it.

First as President of Friends of Historic Preservation which
very strongly supports this proposed designation. And secondly

homes have been very carefully maintained. You will also
notice that many other homes have been remodeled or have had

in the past. But it is also my hope that future home owners in
the district will buy their old houses because they love old
houses which would be kind of a novel idea in Iowa city and
also because they take pride in the neighborhood and the

role as a caretaker for those houses and for that

Sue Scotti I live at 722 Rundell Street and I am president of the
Longfellow Neighborhood Association and on behalf of our
association I would like to ask you not to expedite
consideration of this rezoning request. Specifically because
of some unresol ved questions regarding possible PCP
contamination on this particular site. I just like to note
that the neighborhood association is not resisting the R-8
rezoning. In fact we have gone on record in support of Mr.
O'Brien's request. We are just asking you not to rush through
the process until we have had a chance to be assured by either
the city or the property owner that the property is safe.
Kubby/ We talked about this a little bit last night and our City
Attorney is recommending that the best time to deal with the
issue of contamination is during the platting process. Then
before we accept any public dedication of the road that that
area and we talked about areas around that area that may not
be right where the public dedication is-that that whole area
get a clean bill of health before we would approve a plat.
Would that be acceptable to you.
Scotti I think so. One of the things that people have talked about
when we have discussed the issue is that there is a
possibility that maybe we shouldn't worry about this because
they are just going to pave over that site with a roadway
anyway. And our concern is that there is going to be a fair
amount of earth moving going on during the construction
process and there is no guarantee that any particular pieces
of soil are going to remain in anyone place of that they are
going to be moved here or there or taken off site. We just-
again, I would just like to say we are not trying to delay
development of the property. We concur that RS-8 is the
proper zoning for this particular site because it is in
keeping with the surrounding land as well as the surrounding
property. There is just a lingering question about that that
has recently been brought to light. We would just like to

Kubby/ We had talked last night about wanting to merge lots 7 & 8.
And I spoke with the developer today and when I asked the
question last night if we merge them and have a note on the
plat or don't merge them and have a note on the plat, in a
functional way does it make any difference and the answer was
no. The developer said that in order to negotiate with the
utility company to have a smaller easement that needs to be a
separate lot or else they have told him they don't believe
that there is anything to negotiate about because they have
room on lot 7 to build the residential structure. And so, in
order for it to become a buildable lot it need to be to a
separate lot so those negotiations can take place so the
easement can shrink and then functionally it becomes a
buildable lot. So I would like to leave it as it is to afford
that opportunity for negotiation.
Baker/ And that was P/Z's recommendation.
Kubby/ And that was P/Z's recommendation which is the resolution
before us.
Nov/ And this did not come out in yesterday's discussion. Also the
builder/developer would like to have lot 7 as commercial and
lot 8 as residential.

access was out onto Highway 1 that they would have more
comfort with that than if it were commercial.

that if this is commercial and it gets access to Highway 1
that is not something that they want.

They have no access to Highway 1. The only way they can get
to lot 8 is going through lot 7. The only way they can get
access to Highway 1 according to the papers right now and the
plat is to rezone lot 8 to residential and develop it
residentially.

Throg/ I wonder if steve could clarify the meaning of the words
IIlevying a taxll here. Just to look at it it sounds like a tax
that is being added onto stuff.
Atkins/ General Obligation bonds require you to pledge the full
faith and credit and that you would levy an irrevocable tax to
pay for that bond issue. This is the authority to do that if
it became necessary . We are suggesting you sell general
obligation bonds because of the lower interest rate. It is our
intent to repay the debt service through fees and changes
other than taxes on a substantial portion of these. Those are
strictly at your discretion. Sometime in the future you could
change that. The bond holder has the confidence in this
particular bond that you have no choice but to levy the tax if
it became necessary.

I just want to very briefly expand on something that we talked
about in the beginning of this three hour meeting about this
proposal for the South Side Redevelopment Revitalization and
I think one of the things that Jim talked about was getting
some sense of starting the ball rolling. Getting staff headed
in that direction sort of officially and let staff know there
is a majority if not a consensus that wants them to start
doing that. And I talked briefly with Karin at break about
what she could do and I am wondering-I want to make sure on
the council's part that indeed we do want staff to start the
process where you come to us, not with specifics, but with how
the process is going to start, at least, as soon as possible.
Karin, could you just very briefly just tell us what you could
do.

is we are entering into a pretty major project in this
community visioning and long range planning which is going to
take up a lot of our staff time and I think it is a very
important effort for us to undertake. The Near South Side or
South Town, Jim, which ever you want to call it. As we get
into this next step beyond the general policy that we have
already set for it and try to look at more specifics in terms
of design, it is going to take time to do it well and may take
expertise we don't have. I need to think about this, bring an
outline and proposal to you as to how we might address this
and I would certainly be happy to do that in May.

Kubby/ Can you do that without taking anything off the current work

Throg/ To clarify what I had in mind in terms of a design plan.
This comes from a conversation that Karin and I had a couple
of days ago. We were talking about how many of the ideas that
Bruno and I suggested were kind of clear on the surface but
fuzzy when you would start thinking about precisely what they
mean and I understand that. And furthermore several of the
elements need some clear focus in terms of the design-
somewhere in our memo we talk about, how did we put it, the
design patterns of the pedestrian mall and wanting to extend
them to south of Burlington to a new pedestrian mall. What
does that mean. wi th the design plan we could have some
sketches or renderings from an urban design consultant or an
archi tectural consultant who would present a hypothetical
about what that kind of mall could look like and what design
patterns that are consistent with the pedestrian mall would
look like and likewise for a creek walk. What does that mean.
We could have some design sketches of what that would entail
and specific pedestrian oriented amenities in the area that go
beyond what is in this south landscaping plan or the
streetscaping plan and so on. That is the kind of stuff we
are thinking about.
Baker/ And if we go out of house obviously we are going to have to
be willing to spend some money.

Nov / And at one point you said the Maiden Lane Streetscape was
pretty close to being finished design.
Franklin/ The Maiden Land project is scheduled for this summer. We
will be starting the sewer work first south of the creek and
then putting in the paving and the parking spaces, the street,
lights, any furniture that goes in there and then the bridge
over Ralston Creek, pedestrian bridge not cars.

Throg/ I want to bring up two things. Four of us, I think it was
four, went to the National League of cities Conference and one
of the things that struck probably you and I think it struck
Bruno and probably Karen, I don't know was how important PATV
is as we heard from Renee earlier. How important it is in
enabling people in this community to take part in conversation
about life in Iowa City and how threatened that is by
legislation pending in congress, RH3636. In other words, we
can build an information super highway that makes people into
passive consumers of goods and entertainment or we can build
a network that enables them to engage in public democratic
conversation about life in the community. And I just want to
reinforce what my own sense about that is and many of you
share it I am sure. That we need to do what we can to try to
create that kind of network here in Iowa City. The other
thing has to do with a conversation I had with a family near
Wales street and they are concerned about parking and I don't
want to make light of it but many of the issues that come
before us have to do with parking and their concern is that
there are construction vehicles parking on the street and many
other vehicles that seem not to have anything to do with the
neighborhood parking there and it creates problems for the
flow of traffic on Wales street. So I am wondering if staff
can look into it for us. Just off of Court.

Pigott/ Jim, could I borrow a minute of your time. I would like to
interject. That PATV did bring me back to something I was
going to mention but I will bring it up anyway just because it
has to do with the interactivity and you talked about the
importance of PATV. I would like to just make one of my
endless plugs for the Internet and the constant creation of a
community. We are doing it not only here on the city level by
providing some of the minutes but also the library is playing
a part in this and they have a proposal to do this and I would
like to coordinate with them and keep it in the back of our
minds a coordinated effort with them with a neighborhood net
and with the library would make information kiosks and that
sort of information-interactivity so much greater. So, just
another little plug.

I know that the city was involved in some negotiations and
being involved in a feasibility study and are doing some
composting and that the city chose to take itself out of that
effort in terms of the feasibility study.
Horow/ The study is with Cedar Rapids and the composting study was
collection and analysis and final disposition and part of it
there was to be a survey of the elements of what the various
were but Cedar Rapids is also interested in
c'ollection and how they manage it which is what we really
weren't interested in. However we did have a discussion with-

Brad and Floyd and Dave Hogen from Cedar Rapids in terms of
since Iowa City was going to do a survey of what our
composition of material was anyway to make sure that we worked

some people. One of them is John Lundell, our Transit
Manager, who resigned from city staff to take a position with
the University and I want to thank him for his years of
service and wish him well on his new endeavors. Secondly I
want to thank David Osterberg who even though he doesn't
directly represent us here in Iowa City has chosen not to run
for reelection for the state legislature and I feel that Iowa
is a better place to live because of many of his efforts that
he has made. Specifically with ground water protection and
other environmental things. He is a great role model for me.
Lastly, in terms of thanks, I want to thank the crew. I thank
the crew a lot at night but it is really far into the night
and you are still standing up so I appreciate it. I think you
should get some kind of stool so that it bumps you awake every
once in awhile or something so you don't have to stand the
whole time. I appreciate your efforts. I don't think that our
video crew and staff are paid anywhere near what they are
worth and they really help us have that conversation about
life in Iowa city. And I will save the rest for another day.

Novj I would just like to report that Susan and Karen and I all
went for a meeting at the Soil Conservation Service. We had
a forum on Women in Government. Not just local government, our
state legislators weren't able to be there but we had a couple
of representatives from the national level: Beth Freeman from
Senator Harkin's Office and Jennelle Redick from
Representative Leach's Office and they all were very
interesting people. They provided excellent information on how
to contact your local folks. Call us, we are already to listen
and we made that point very strongly and then I have to give
you an example of what happens when people do call us because
people on Teg Drive, Aber Avenue area called city council
members because they were concerned about traffic. We referred
them to our neighborhood coordinator. She pulled together a

meeting. It is April 7 at 7 PM including our planner for
transportation. Including our mayor and all you need to do is
call and ask. I thought it was a terrific way to handle it.
Also for those who are interested in the tree ordinance you
can go to the P/Z meeting on April 7 instead of the Teg Drive
meeting. That is at 7:30 here in the council chambers. And the
other one is in the neighborhood at 7 o'clock.
Horow/ This evening I would like to use my time asking citizens to
consider taking part in the community comprehensive Plan
Update. We need your applications. We need them in the
interest of the various task forces. We are encouraging you to
contact the city clerk's office, the city manager's office or
the Department of Planning for information and application.
This is an opportunity for citizen participation to take part
in updating our comp plan. The task forces will be on
transportation, housing, parks, recreation, open space, social
services, art, cultural, human development, environmental
protection, public safety, economic well being, land use and
urban patterns. This is a time for you to get involved. This
is going to take approximately a year, over a year's period.

Atkins/ The citizens' participation process is about 75 days. The
process is about a year by the time we get you an updated comp
plan.
Nov/ When we are asking people to commit to a task force, we are
asking people for a few weeks.

There will be more information about this on Channel 4, the
Information Services Channel. But I really urge you to
consider taking some time, getting involved in this. It is
not going to be that much of a commitment. You will learn a
lot about the city and help us build the city for the future.
I also would remind citizens we are moving into construction
season. The key word is patience. If you have any specific
streets that you think need to be repaired drastically let our
ci ty Department of Public Works know. I now I have had
requests on brick streets on Fairchild between clinton and
Dubuque. Bricks are really settling in and there are some pot
holes. But the main thing is patience. I know Kirkwood Avenue
is about to be reconstructed from my driveway to Franklin. If
anyway thinks I am going to be anywhere on time, you have got
another thing coming.

on the project because of $850,000 in federal funds which will be used for
the bridge reconstruction. The scope of consultant services was approved by
the Melrose Avenue Focus Group. The not to exceed fee is $83,873.51.
The project will be completed in approximately 12 months.

GJ/- - <il /l CONTRACT FOR CONSULTING SERVICES WITH RICE, WILLIAMS ASSOCI-

Comment: The Cable Television Consumer Protection and Competition Act
of 1992 grants certain rate regulation authority to the City as a franchising
authority, consistent with a complicated set of regulations and formulas
created by the Federal Communications Commission. Rice, Williams Associ-
ates has agreed to amend the scope of services in the current contract to
include a Benchmark Rate Analysis to determine whether or not basic rates
charged by the cable company are consistent with FCC formulas. The cost
of these expanded services shall not exceed $8,000. Revenues from the
franchise fee will cover these costs.

Comment: The proposed urban revitalization area includes the area zoned
Central Business Support Zone, CB-5, located between Burlington and Court
Streets and is required to implement the Urban Revitalization Plan; therefore,
final passage should occur only after the Council's adoption of the Plan.
Designating this area an urban revitalization area would grant property tax
exemption to qualified improvements as designated in the proposed plan.

Pigott/ I was just going to ask Dale if he could just explain
perhaps for people who don't have the memo and what the bench
mark rate analysis is.
Helling/ In restoring some regulatory authority to local the
federal legislature empowered the FCC to create this process
and the FCC-the main type of regulation that they are looking
at-they created certain bench marks for certain types of basic
services. The idea was to keep it simple so that the locals
could deal with it. Some months and 100 and some pages of
simplicity later and it is still coming by the way. It keeps
changing. It \"as pretty clear that it would be take up a lot
of time and a lot of energy on the part of the legal staff,
Finance and everything to go through all of these formulas and
try to apply it locally and be able to defend that if in fact
the rates are inconsistent and we want to force the company to
come into compliance. So Rice, Williams has done this for a
number of other communi ties. They are in the process of doing
it for a number of other communities and have that expertise.
Made a lot of sense to use them.

Atkins! Outdoor cafes have been a subject of some debate amongst
councils for some time and I had specifically asked for
departments to look through our fee schedules and just
throughout where haven't we kept current and where haven't we
moved these things along and this one had been sitting there
for a number of years. We raised the cart fee I remember a
couple of years ago for the plaza and it just seemed to make
sense to bump this thing up. There is no magic number. No
scientific analysis went into it other than it appeared to be
fair given-
Nov! Have other fees gone up that much in ten years.
Atkins! Other than the carts. Carts in the plaza went up
dramatically. We bumped them from $400 or $500 to $750 in one
jump. And we haven't bumped them in a couple of years.

sidewalk cafes. We have the distinction between outdoor
service areas and sidewalk cafes. That should be noted.

Kubby/ In a certain sense I don't mind a fee when you are using
public property and you are gaining a profit even though it is
a great amenity to the city I believe.
Pigott/ In some ways I think of it as a slight disincentive. I
would love to encourage it. I would love to reduce the fee
even though it is on public r.o.w. because I, myself, am in
favor of that. I would love to see the proliferation of them.
Throg/ So the question I have is would it make any difference if
this council was strongly for having (can't hear). Would it
make a difference.
Atkins/ To me it would not make a difference. I imagine it
wouldn't make any difference to the proprietors out there that
might use it. You just charge more or less than the other
guy.
Kubby/ Or you are increasing your usable space of your restaurant
on a seasonal basis. $500 is a very small investment for the
benefit.
Throg/ No. I must not have stated my question clearly. If this
council was really strongly supportive of sidewalk cafes,
period, and have nothing to do with the fee-would that make

Kubby! I did want to make a few comments because of a question
Larry asked me last time that I didn't answer correctly. He
said you don't really want affordable housing in CB-5. For
some strange reason I said no I don't. And that is not true.
You asked me and I answered no I don't want it and really my
answer is yes.
Baker! That is what I thought.
Kubby! So I wanted to clear that up and try to explain why very
briefly. People who have property south of Burlington Street
have a really valuable resource and revitalization of the area
will do nothing but increase the value of this resource. If we
are going to use tax abatement to spur redevelopment I believe
we need to make sure that that public benefit is worthy of the
abatement and I know people think just the increased tax base
is a positive pUblic benefit and I think that that is too but
I don't believe that it is enough in and of itself to warrant
abatements in this very viable area of our community. An area
I think will develop on its own in the near future anyway.
And Additionally I think that affordable housing should be
linked to tax abatement as an additional public benefit. One
of the biggest problems in our discussion of affordable
housing is the price of land. The cost of the land drives
much of the housing costs. An here is an opportunity to have
people who own this very valuable resource, the land, to use
it in part if they want the abatement to increase the
affordable units. That is not part of the plan, I can't
support it and will be voting no.
Baker! This is not specific to your opposition but the discussion
since we have had since January since this group has been
together about the term affordable housing. When you say
affordable housing I here Section 8 Low Income Housing. Is
that what you are saying.
Rubby! Yeah and especially in this area because with subsidized
housing with either vouchers or certificates the landlord gets
that fair market rent. It is just a split between the tenant
and the federal government as to who pays it. You are still
getting that fair market rent for that unit. It is just
ensuring that not just an elite group of people live in these
valuable areas and we are increasing the cost and that value
of that land, that is the thing for me that triggers the cost-
one of the big things that triggers the cost of housing. So
there is a link.

opposes the idea of section 8 Low Income Housing in as many
places as possible. There are, I think, many people on council
and I am one of them who thinks the intensely commercial zone
is probably inappropriate for section 8 Housing of that kind
and let's take those efforts and put them in the South Side
Revitalization Area that we are talking about further south of
Court. I don't see any possible residential development in
this zone being for an elite tenant. I see it as just more
student housing happening down there.
KUbby/ It is not going to be a cheap apartment.
Baker/ Whatever it is there are going to be exorbitant rents just
like they are most places in town.
Nov/ It is my preference to have the housing in areas other than
CB-5. I think we ought to really concentrate that area
commercial.
Kubby/ And concentrate and exclusively commercial are two different
things. We have already decided that one of the amendments
that we are going to make is that there is a possibility for
up to 20% housing in CB-5. We have already said this is an
appropriate place.
Horow/ But we are still concentrating on commercial.
Kubby/ And I don't disagree with that concentration.
Throg/ I don't want to rehash arguments that have been made at
previous meetings. All I want to say is that tonight I intend
to vote against this ordinance but given the other things that
we are doing with regard to the parking impact fee I may find
myself voting for it at another point two or four weeks from
now when we get to this stage. I think the sequencing is
important for me. If we do the impact fee given the
understanding that we have had then the chances are pretty
darn good I am for this ordinance but I can't do it tonight.

into a tentative agreement for a two-year contract (FY95-96). It provides for
a 3 % across-the-board wage increase at the beginning of each year, overlay-
ing of the Blue Cross/Blue Shield Alliance program on the existing health
insurance program, implementation of the 1993 job classification study, an
increase in the reimbursement to employees for safety shoes, the provision
of rain gear for employees who regularly work outdoors, and a number of
other language changes reflecting contract administration. A copy of the
tentative agreement is included in Council's agenda packet.

just contract jargon that I am not getting. It is the Transit
Division where it says for equalization purposes employees who
refuse extra hours will be charged the same number of hours as
for- That doesn't sound very good.
Helling/ The same way we do for overtime. Basically, only this
would be for certain other kinds of assignments. What it is
is that we want to give everybody equal opportunity to have
the extra hours. So what happens is you contact people
systematically and if somebody is contacted, they are reached,
and they refuse it, that is fine, that is their prerogative.
But they are then credited with 8 hours of opportunity if you
will so that everybody gets the same opportunity. That way
people who don't want to do the extra work don't have to but
they can't come back later and say they didn't get their fair-

side letter that says at mutually agreed upon times during the
94-96 contract the investigation and discussion of on site

it is wonderful that we are going to start-encourage us to be
the initiators of those discussions and not wait for the union
to contact us.
