Dear Mayor Horowitz:
The Santa Rosa City Council was extremely pleased that Council member
Maureen Casey was able to arrange her schedule to present your community
with the Burbank Bench. As you know, this bench was made from the
historic tree planted by Luther Burbank which, unfortunately, died thus
enabl ing the wood to be salvaged and made into a 1 imited number of
decorative benches. It is our understanding,that Mrs. Casey will present
this bench to your City as a gift from Santa Rosa's Operation Payback.
The visitation will also enable Mrs. Casey to directly visit your
community and witness the work which has been completed to date to restore
damage done by last year's floods. Unfortunately at this point it appears
that the weather may bring a recurrence of floods in your area and if such
does occur, we certainly hope it is held to a minimum.
The residents of Santa Rosa continue to be interested in the Operation
Payback Program and Mrs. Casey will be able to provide you w~th a progress'
report.
The entire Santa Rosa City Council wishes you the very best in your
efforts to restore your community.

Luther Burliankremains the most famous citizen of .Santa Rosa, having
contributed, to .the world hundreds of fruits, vegetables, flowers and trees out
of his agricultural genius. This ,bench carne from a Cedars of Lebanon tree
. which stood near Luther Burbank's grave until 1989. The.bench was designed by
Robert, Fergusonandmanufactured by El iDanfel, with the center panel carved by (j)
Angel Fargas. Instructions as to the construction and on-going care of this, ,
bench accompany it.
. As you may remember, Operation Payback came into being because the people ,
of Santa Rosa were reminded oftne generosity of people in, the mid-west who
funded the rebuilding of our city following the earthquake of 1903,. We hope
that the Burbank 'Bench will serve, as a visible reminder that friendship and .
caring know no limits of time or distance. .'

Dear Members of the Council,
On March 24, I met with Wildlife Biologist Tim Thompson,
Animal Control Supervisor Lisa Goodman and U of I Animal
Coalition members Steve ,Kouzounas and Grace Trifaro. We
met on North Dubuque Street to discuss options in solving
the frequent deer-auto COllisions on this street. Options
such as wildlife fencing and tunnels were discussed, but
were determined costly and ineffective. Simple solutions
agreed upon were flashing warning lights mounted on the
already existing deer-crossing signs, and possibly the
most effective, the wildlife warning reflectors. These
reflector systems have been tested and used for over twenty
years and have proven to greatly reduce deer-auto accidents.
I would like to emphasize that we did not target this as a
problem due to an over population of the deer, but rather
a problem of deer following a natural pathway, which happens
to cross over Dubuque Street.
North Dubuque Street is a heavily traveled entrance into
our city. Vehicles traveling on this street are greatly
surpassing the posted speed limit. Officer Kevin Berg with
the Iowa City Police Department, has trained me to perform
radar as part of a public awareness program. After checking
speeds on North Dubuque Street during a three hour period,
I concluded the average speed along this 35 mph stretch
was in the mid 50's--some twenty miles per hour over the
posted speed limit. With speeds this great and with the
deer moving along their chosen pathway, there will surely
be, at some point, a very serious accident.
Some considerations for the city to act on this issue could
include the cost of the police officers responding to these
accidents, the cost of the carcass removal, as well as the
protection of human life and property. I would like for
you to also deeply consider the deer. To assume these living
creatures don't suffer pain is ridiculous! These creatures
are living spirit beings, just as we are.
In witnessing deer injured and killed, this issue has become
very emotional for me. This winter, three different deer
came up to my house with shattered front legs. One doe
struggled with a severe hip injury, while others hit by
vehicles staggered into the woods to die. Just weeks ago,
a deer hit by a car crawled up into my yard and died. I
have witnessed fawns orphaned and fawns killed. It is
truly heart breaking.

The number of deer injured and killed is going to be much
higher than any report you will receive from the police
department, as many of these road kills are not reported.
Some carcasses, as I've witnessed, are even taken illegally.
I hope that you will contact Tim Thompson and Lisa Goodman,
as well as the U of I Animal Coalition, for further input
on this issue.
Our city, acting with humane compassion, can serve as an
example for other cities to follow. The gift of life is
very precious and can be taken away all to quickly. I
urge you to consider our need to co-exist, living in harmony
with all creatures.

speaking from an interested as opposed to a disinterested
standpoint. I own approximately 10 acres of undeveloped
woodlands located on the north side of Iowa City in the proposed
overlay zone. While I have no immediate plans to develop that
land, this proposed ordinance would very definitely impact any
future development of the property. Hence I am most directly
interested in the matter.
Since I know you will be receiving many comments from many
different persons I will try to summarize my concerns in a brief
fashion as follows:

1. Impact on individual homeowners. This ordinance will
require individuals owning property within the zone to
file a tree survey (section 36-33(d)) and obtain a
permit. The exemptions provided in section 36-33(c)(2)
would not apply to many single-family situations. For
example, my mother's home on Dubuque street exceeds
10,000 square feet in size and my home on Kimball Road
(assuming it is located in the zone) also exceeds
10,000 square feet in size, I believe. I have at least
five IIsignificant trees II on my home property and my
mother has several. I believe there are many other
property owners who are similarly situated. This
ordinance may well have the effect of requiring people
so situated to go through a lengthy and potentially
quite expensive bureaucratic process to take care of
their own property. I believe that most property
owners in Iowa City are quite responsible. We can rely
I believe to a significant degree on the common sense
and economic self-interest of individual property
owners not to abuse the trees on their own property.
Injecting the government into decisions such as
trimming or removing a tree on your own home site is
uncalled for.

2. Cost to developers. It is popular to assume that
measures that add cost to land development are paid by
"someone else". That "someone else" usually ends up
being the consumer. As mentioned above, I own
approximately 10 acres of land located north of Kimball
Road in Iowa city. The land is both heavily forested
and consists of many ridges and ravines. In order to
develop this land in the future under existing city
ordinances it will be necessary to spend a considerable
sum of money subdividing the property and obtaining

subdivision approval from the City of Iowa city.
Further, since the land is heavily sloped, considerable
engineering costs will be incurred in complying with
Chapter 70 of the Uniform Building Code as adopted by
the City of Iowa City dealing with excavation and
grading. That chapter requires extensive civil
engineering and soils engineering involvement in
developing this type of property. If the Tree
Preservation overlay Zone ordinance is adopted, in
addition to those costs I would be required to develop
and obtain approval of a "tree protection and
replacement plan" and obtain a tree removal permit from
the City. This requires submission of a "tree survey".
section 36-33(d) requires that this tree survey
identify the location of all existing trees, providing
the common or botanical name for each significant tree,
and be drawn to scale. There are literally thousands
of trees on my 10 acres, I am sure. I cannot even
guess at the cost of preparing the required "tree
survey". The cost would have to be astounding. In
addition to the tree survey, the ordinance appears to
require a "tree plan" and may also require additional
or more-detailed information such as topographical
surveys, aerial photographs, and the like. (See
section 36-33(d)(4)).

After obtaining all of the information described
above at whatever cost, my task will have just begun.
To develop the property I will then need to go through
the bureaucratic review process to obtain the permit.
A developer engaged in that process may well require
the services not only of a civil engineer but also
professional foresters, soils engineers, and also
excellent legal assistance. Further, the ordinance
provides that the City may hire, at the developer's
expense, its own qualified professional foresters,
engineers, soils engineers, testing labs, and other
specialists. (See section 36-33(e)(2)). Most
responsible developers, and even those not terribly
responsible but who are interested in making money, are
going to try to preserve and retain trees and forested
areas as much as possible in order to provide
homeowners with attractive home sites. An extensive
and expensive bureaucratic process is not necessary or
justified.

planners, Ms. Rockwell, asked the Commission whether
they wanted to II require II cluster housing in connection
with the development of wooded but also hilly or
highly-sloped land. To my relief, the Commission
seemed to indicate that they did not. Some of Iowa
City'S finest and most-attractive housing is built on
such land. For example:

I am sure the above list is by no means exhaustive.
Had "cluster development II been required in those areas,
some of Iowa City'S finest housing would not have been
built.

4. Tree "czar". The ordinance grants a great deal of
discretionary power to the Director of the Department
of Housing & Inspection Services or his or her
designee. This person in a sense becomes a tree
"czar". The only appeal a citizen has from his or her
decision under the ordinance is to the Board of
Adjustment. Appeals to the Board of Adjustment would
take considerable time and would involve a lot of
expense. There ought to be an intermediate
administrative appeals process, for example to the City
Manager or a committee consisting of the City Manager,
City Attorney, and some other appropriate City
official, so that disputes concerning interpretation of
the ordinance can be resolved without the necessity of
going to the Board of Adjustment.
Need. I fail to see or understand the need for the

Tree Preservation overlay Zone ordinance. Iowa City
has many beautiful wooded areas that have been
developed into excellent housing. I am not aware of
wanton and widespread destruction of trees in the
development of property in Iowa City. Most developers
want to maximize their economic return on their
investments and to be regarded as responsible citizens.
Homeowners generally like trees. I think we can rely
upon the marlcetplace to encourage homeowners and
developers to retain trees.
I realize this letter is quite lengthy, but I do hope that
you will consider the concerns expressed as you review this
ordinance. I also hope that you will not fee 1 obligated to
recommend this ordinance to the Council. The City Council is
entitled to recommendations based upon your own best judgment as
to the need for this ordinance, as well as other aspects of it.

It is the unanimous opinion of the members of the Airport
commission that the Iowa city Municipal Airport cannot exist
indefinitely at it I S present location, and a majority of the
Commissioners believe that Iowa city would be best served by
developing a Master Plan that included the eventual relocation of
the Airport.
While there are definitely benefits and costs to both staying at
the present location and relocating, from a technical and financial
perspective, relocating is an obvious first choice. Some reasons
for this choice are:
1. A relocated airport would provide more safety options than the
present location.

2. Fewer citizens would be adversely effected by a relocated
airport.
3. A relocated airport would require less funding from Iowa city
taxpayers than for renovating the current site.

The Commission recognizes, however, that a project of the magnitude
of an airport relocation cannot be undertaken without a clear
consensus on the part of all concerned parties; in this case, the
Commission, the city council, the city administration, and others.
We also recognize, particularly in light of the February 10, 1994,
meeting between the Council and the commission, that such a
consensus is lacking at this time.

Therefore, the Commission will continue to pursue the present
course of action, which is:
To take the necessary actions required to meet state and
federal guidelines and regulations for land and airspace use
to assure continued compliance for the Airport.
To maintain the highest possible level of airport utility
while maintaining compatibility with the community, consistent
with meeting the above goal.
To continue to work toward financial self-SUfficiency.
We appreciate the effort to maintain good communication between the
Commission and the council, and look forward to continuing that
communication during the development and implementation of the
Airport Master Plan.

Whereas, the existing paratransit service as provided by the SEATS
program is an important part of the effort of people with
disabilities and elde.rly to become integrated into th'is community on
a productive basis
and, Whereas, the history of' privatization efforts in this nation
indicates that in the rare instances in which cost savings are
realized they are secured by reducing service from previous levels in
this case it is' noteworthy that if the paratransit service is
contracted out to an out-of-town company, then that company would
be unlikely to have either incentive or accountability regarding
maintaining the current high quality of service
Be it resolved by the undersigned that we urge the members of the
Iowa City Council to proceed carefully in this matter with the
recognition that the vast majority of citizens with disabilities and
the elderly of Iowa City support the paratransit service as presently
constituted and operated by SEATS.

As the Council continues to discuss the issue of the Iowa City airport, I have one additional
consideration for you, Colonial Lanes has hosted Bowl For Kids' Sake for the last 11 years
without compensation. This is a very significant in-kind contribution for the children in Big
BrotherslBig Sisters, This year we raised $32,000 at Colonial Lanes on Community Day.
I realize that the status of the airport is a complicated issue and that you are carefully
weighing the impact on the community of all the alternatives, Please consider the loss of Colonial
Lanes not only as a business providing wholesome family fun but the loss of a business that has
generously contributed to a human service agency. The loss of $32,000 would be a significant
decrease in our income and would hinder our ability to serve the children of this community.

Pursuant to Section 23-160 of the Municipal Code of Iowa City, the City Traffic Engineer will
direct the installation of a stop sign on Langenberg Avenue at its intersection with Sycamore
Street so as to require traffic on Langenberg Avenue to stop and yield the right-of-way to
vehicular traffic on Sycamore Street. This actil>n will take place on or shortly after April 20,
1994.

Langenberg Avenue is the first street being developed in South Pl>inte Addition, Part One.
The paving for' Langenberg Avenue is in place and the contractors are currently placing
underground utilities and the ensuing final grading will soon be complete, The installation

City's arterial collector system.

The university of Iowa Hospitals and Clinics to suspend planning of automobile
access to the new South pavllllon off Melrose Avenue until the Environmental
Assessment which you are funding has been completed. we also ask you to request
that UIHC seriously consider giving up the Melrose Avenue curb cut In the Interest
of reducing the adverse Impact of its expanded facilities on the neighborhood.
on wednesday, March 30, members of the Association were invited to a meeting
by the Vice president for university Relations, Ann Rhodes. At this meeting, Mr.
Richard Gibson presented the university's current design for the entrances to the
new section of the Hospital. In spite of theJact that we have been trying to work
with the university and with the Hospital to obtain serious consideration of
perfectly feasible alternatives, the design we saw last week was, In Its essentials,
the same as the design we were first shown over a year ago. It Is a plan which has
the potential of substantially Increasing the flow of cars onto and off Melrose
AVenue.

The Melrose Avenue Neighborhood Association Is seriously concerned about the
Impact which the UIHC's proposed Melrose Avenue entrance will have on the
outcome of the Environmental Assessment which you have just voted to fund. An
entrance to the south pavllllon from Melrose Avenue may require a traffic signal
and a designated turning lane. A plan which presupposes the building of this lane
amounts to a pre-emptive decision which subverts the Environmental Assessment
process, We urge you to take the decisive action which prudent planning and
good government require In this case.
