HUD has published new FMRs for Johnson County and the surrounding counties, Due to changes i~ Federal Law, the Iowa City Housing Authority now serves some contiguous areas that have no Housing Authorities. In 1992, our firm designed and built a new two story 18,000 sf office facility for Noel/Levitz Centers at 2101 ACT Circle on land owned by Kay Shive-Henry. Noel/Levitz moved from their former location in Coralville to Iowa City to enhance their growth potential and to provide a pleasant wooded site for their employees. ,( r'-'~ \ :, \ ~ I I I> I I I Confident in their ability to expand their business, Noel/Levitz commissioned our firm to investigate the addition of another similarlY sized building on their site, A preliminary location for the additional building and necessary parking has been established. Because their site is heavily wooded and has a varying topography due to the presence of ravines, some mature trees would have to be removed. , , , I I After reading through the draft copy, I became concerned about the costs associated with the proposed ordinance including the Tree Survey, Grading Plan and Tree Plan, To that end, I asked Shive-Hattery Engineers to put together a cost estimate on the cost of implementing the proposed ordinance. As you can see by the enclosed copy of Phil Larson's memorandum, the estimated cost of complying with the proposed ordinance could easilY be in the $25,000.00 to $30,000.00 range for this project. Depending upon how a final version of the proposed ordinance is written, the ordinance might effectivelY cancel Noel/Levitz's future expansion, ~: !! . , . , , , I . l Q~ There is a need to further our community's efforts to balance the protection and enhancement of our environment without penalizing our local businesses for being successful to the point that they need to expand. As a businessman and taxpayer, I feel that a cost/benefit analysis needs to be undertaken before ordinances are drafted. Why not consider establishing community "environmental friendlY" awards or partial tax abatement for businesses who meet certain guidelines for tree preservation and/or tree replacement when they expand or relocate in areas which, by their nature, are susceptible to disturbing the existing environment? To do otherwise will over time, I feel, cause Iowa City to lose businesses to our neighboring communities, thereby usurping any control from Iowa City and eroding our tax base while enabling the businesses and their employees to still enjoy many of the services our community provides. To me, it also says that the City Council does not feel that the business community has any interest in preserving our environment and that a narrow based constituency within our community has all of the correct answers. Phil Larson, Shive-Hattery ~ April 25, 1994 City of Iowa City Proposed Tree Ordinance As you are aware, the City of Iowa City is currently considering a new tree ordinance. We have obtained a copy of the proposed ordinance and, out of curiosity, made a preliminary evaluation as to the effect on development of the Empire Addition tract (the remaining tract of the Noel-Levitz site). The intent is to save as many "mature" and "significant" trees as possible. A mature tree is .:: a-inch diameter, and a significant tree is .:: 18-inch diameter - both measured at 4.5 feet above the ground. Saving a tree includes special construction practices such as erecting a fence around the drip line and observing a 20-foot setback from the drip line to the construction area. The number of trees that must be saved varies by zoning. For this site, at least 20% of the mature/significant trees must be saved. We believe the development process will be similar to the following: Conduct a tree survey during the site design survey. Site design surveys will cost a little more on heavily wooded sites since it will take more time to accurately locate, identify, measure trunk size, and estimate drip line diameter for each tree close to and larger than a inches in diameter. Prepare a tree plan. This is to present the information from the site survey and show critical root zones, construction limits, protective barriers, etc. This also identifies the trees removed and new trees planted. The tree plan is just another element.of the Site Plan/Erosion Control Plan. This will add cost (minimal) to the Site Plan preparation. Conduct a special meeting with the City Forester and perhaps other City Staff. The meeting itself will cost dollars, but as with any review process, the cost is in the design revisions as a result of the meeting, What is not known is what will be negotiable. For instance, will the City be more apt to allow a parking variance to save a tree? The cost of the bond will obviously add to the development cost. This might be a problem area, depending on how strictly the rules are enforced. If an inspector sees construction equipment driven (accidently) within the 20- foot setback, will the bond be forfeited? , , " ~ 5. Replace trees that were removed at a ratio of 2:1 for mature trees and 3:1 for significant trees, We estimate that about 70 mature trees and 27 significant trees may need to be removed to accommodate the proposed construction at the Empire site. Using 1.5-inch (minimum) diameter replacement trees, costing about $100 each, the cost for replacement trees alone (not including labor, stakingl mulch, etc.) will be in the range of $221000. 6. If the site physically cannot hold the replacement trees, the Contractor may plant the trees at another approved site or the cost of the trees can be relinquished to the City's tree fund. To summarize, the tree ordinance will have a significant impact on the proposed development. At this timel we anticipate that the ordinance will add $25,000 to $301000 to the Empire project cost. , , "I It should be noted that this ordinance is being sent back to committee for revision. R, Green has predicted a steady rise in water usage per capita of approximately 1 gallon per year over the next forty years. The engineer assumes that population growth, which is predicted to increase at a steady rate of about one thousand people per year, will cause this increase in water usage by adjusting development patterns which favor increasing proportions of commercial and industrial water users. Is this assumption supported by past records of water usage in Iowa City? The engineer had available a 23 year record of average daily water plant pumpage for Iowa City (spanning 1970-1993) along with population census data for the years 1970, 1980 and 1990. This record was used by the engineer to forecast future water usage for the forty year design life of the proposed water plant. Using this same infonnation, I derived the past 23 year trend in water usage, shown below. A solid line connecting the three census data points shows the coinciding trend in service population growth. The plot shows a dramatic rise in water usage from 1970 to 1984, which seems to support the engineer's main forecasting assumption. However, from 1985 to 1993 the plot shows an equally dramatic decline despite continued population growth. The current water usage per capita in Iowa City is actually about 104 gallons, not 123 gallons as was cited in the Press-Citizen. What is the cause of this 8-year decline? It contradicts the Engineer's main assumption which relates trends in water usage only to population growth. Also, it does not appear to be due to any natural trend in water availability (wet/dry cycles) which generally causes more water usage during dry periods relative to wet ones. Total annual rainfall data for Iowa City collected by the National Weather Service over the same 23-yr period suggests that water availability was about the same during both the 8-yr. decline and the 14-yr. rise (see plot below), One possible influence contributing to the decline may have been the increase in water rates by the City starting in 1986, but I am not sure that this alone is responsible. This includes work within our committee, and recommendations we recently made to the Transportation Technical Advisory Committee (ITAC). RTBC is currently focusing on trails planning and the Long Range Transportation Plan as it applies to bicycling, as mandated by the 1991 ISTEA Legislation. This City property further served as a platform for continued dumping onto adjacent private properties, forming a 30-foot tall steep embankment of concrete and asphalt rubble, dirt, and lumber', with numerous open c~,vities. The fill is in clear violation of the City's slope ordinance, and it visibly contains state EPD-regulated materials. City offices were contacted at the inception of this filling, but no actions were taken to ver'ify design, legality, or neighborhood approval at that time. Fill was dumped onto our property without any discussion or notification from any of the involved parties (Noel or City). Repeated statements from the C1ty offices to remediate this hazardous and unstable fill have been merely empty promises up to this point. The City did, however, contract an engineer's survey of this fill (May 1992), which correctly concluded that both slope and materials are inadequate and unstable. The toe of the slope continues to encroach onto our property, but the most. significant damage has occurred on t.he adjacent. property of Mr. and ~lrs. Leo Zei thamel. They have involuntari ly accrued the 1 iabil i ty clf a hazardous "attract.ive nuisance" for neighborhood children, and numerous large trees are now dead as a result of the fill ing. The Zeithamel and Witzke properties have experienced notable negative changes from this unsightl>' and poorly constructed fill. We have been patient, forthcoming, and cooperative with the Cit.y during these past four years. We have even agreed with City plans to sacrifice 25-feet. of our property at no cost in order t.o provide a safer slope for the neighborhood's children. Cooperation has gotten us nothing but frustration and inactivity. By contrast, the Noel and Humble properties perceive significant. capit.al improvement. They refuse to cooperate with City plans. Gary Noel has continued to periodically dump truck-loads of material with impunity, ignoring Ci ty notices. The moral seems clear: cooperation gets one nOWhere, whereas violating ordinances and fighting City plans achieves the desired result.. Four years is a long time. Please take the necessary actions to insure a safer slope, and to correct a recurring pattern of City ineffectiveness. Iowa City's ravines are a beautiful asset to our community, providing greenbel ts and enhancing property values. We are saddened to see our particular ravine compromised by the actions of a few. Even the City plan will for'ever modify our pr'operty in a manner that we never intended. We can bite the bu 11 e t, bu t don't make us 1 inger' any more. We felt this was the best way of assuring the goals we set forth. The city council took the recommenpation of the city manager who viewed cable as an "entertainment business." In light of his recommendation, the franchise process was utilized. We indicated, at the time, that granting a franchise was like giving a license to print money. In fact, this. has proven to be true. After'listening to the presentation last night, please let me offer some views for your consideration. I believe that there are sufficent grounds of non-compliance by the cable companies to warrant your not granting T.e.I. a franchise renewal. Please review the promises made and not fulfilled. Some examples are: arm chair tuning with a remote-control channel selector; free program guide; a medical channel; and more locations from which to originate programs around town, including the Recreation Center and Mercy Hospital. Please review the lack of fiscal data provided In a timely manner through the years. Please review the breach of franchise when the system was sold to T.C.I. without city approval. If I am correct that these are sufficient grounds for not renewing the franchise, then I trust you will consider public ownerShip. I am prepared to discuss with you five forms of public ownership. Data indicates that T.C.I., most years, probably made a profit of over one million dollars. With the many new services that will be added, some mechanism of rate control needs to be in place to protect the citizens of Iowa City. Cable is very much like a utility and profits need to be controlled. 2) A provision that failure to carry out any provisions shall be acknowledged to be grounds for not renewing the franchise. ' '; This would give the city the enforcement power it needs. In the past, promises were made and not fulfilled. We need to protect against this happening in the future. ' 3) A buy-out provision at the end of the franchise period. This provision would not obligate the city to buy the system, It would, however, give the city that option. I think this is wise planning for the unknown future. 4) No charge for city services using the fiber network. City services might Include reading water meters, at a long-term cost saving to the city. The system could also be utilized to provide increased fire and police protection. I believe the city should be able to utilize the fiber system for this and other services without payment to T.C.I.. In addition, let me suggest, in relation to the provisions presented to you: a) I question whether 78 channels Is sufficient In light of my understanding of the present state-of-the-art. I have read, as I am sure you have read, of systems of 160 channels. " ,...~ , (, "1,' e\ ~ ~ ~ 1 b) The provision for state-of-the-art, which I heard Is yet to be neglotated, Is Imperative. T.C.I. should be required to update In the fourth and seventh year of a ten-year agreement. This provision should also Identify who would make the state-of-the-art determination. c) Do you really only wish 40% of the system to be underground? I think much more Is reasonable and desirable. ii, In closing I think that T.C.I. has an excellent manager In Iowa City. None of my remarks should be considered negatively. My comments today have but one purpose, , that is to help you by sharing what I believe to be the best course of action based on my experience.
