In reference to the above rezoning request for the Eagle Food
Store project by First Muscatine corporation, I formally request
that you utilize expedited procedures so that the final reading of
the zoning ordinance amendment requested by the applicant occurs
on May 24, 1994.
The expedited procedure is important to the applicant who faces a
May 26 deadline in its contract of purchase of the subject
property. Additionally, it will allow the tenants of the involved
mobile home park to receive assurances for financial assistance in
their relocation.

AN ORDINANCE VACATING A PORTION OF
THE LINN STREET RIGHT-OF-WAY LOCATED
WEST OF GILBERT STREET AND NORTH OF
BENTON STREET.
WHEREAS, the City no longer requires
certain street right-of-way in some areas of the
City; and
WHEREAS, a portion of the Linn Street right-
of-way located west of Gilbert Street and north
of Benton is no longer needed for pUblic access,
to properties in the area; and
WHEREAS, the City is retaining enough right-
of-way to accommodate an eight foot sidewalk
along Gilbert Street; and
WHEREAS, the City will retain a utility
easement over the property.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. VACATION. Subject to 1)
retention of a utility easement over the parcel
in a location to be determined by the Public
Works Department; 2) approval of a
development plan by the Director of Planning
and Community Development prior to the sale
of the vacated property; 3) establishment of a
conservation easement on the adjacent
property parallel to and to the top of the bank
of Ralston Creek; and 4) dedication of the
property shown on Exhibit A and legally
described on Exhibit B, which are attached
hereto and by rafarence made a part of this
ordinance, to the City of Iowa City, the City of
Iowa City hereby vacates the portion of the
Linn Street right-of-way legally described as
follows:
Commencing at the southeast corner of
Lot 4, Block 28 of County Seat Addition es
recorded in Deed Book 1 & 2, Page 301,
Johnson County Recorder's Office; thence
N 89053'17" E, 35.00 feet; thence N
00016'55" W/ 12.70 feet parallel to the
east line of said Block 28 to the Point of
Beginning; thence N 00016'55" W -
147.36 feet paraliel to the east line of said
Block 28; thence N 89051'13" E, 41.43
feet along the eesterly extension of the

adjudication shall not affect the validity of the

or part thereof not adjudged invalid or
unconstitutional.
SECTION IV. EFFECTIVE DATE." This
Ordinance shall be in effect after its final
passage, approval and publication, as provided
by law.

Re: VAC93-0006, Linn Street Right-of-Way Vacation
Attached is a drawing prepared by Landmark.Engineering, which depicts three cross-sections
of Gilbert Street near the proposed Linn Street right-of-way vacation. Also attached is a
survey of the area proposed for vacation, which depicts the adjacent property and its
relationship to Ralston Creek. These maps have been submitted to the City Traffic Engineer;
his comments should be available at the informal Planning and Zoning Commission meeting.
We have asked the Director of Parks and, Recreation Department to evaluate the possibility
of retaining the Linn Street right-of-way and acquiring the adjacent property for open space
or part of a Ralston Creek trail network. His comments should be available at the informal
meeting.

Dear Mr. Scott:
As I testified at the public hearing on 20 January, 1994, I believe that it is
not in the best interests of the citizens of the City of Iowa City to proceed with
this right-of-way vacation. The following points support this belief:
1) The size of the existing lot seems to be inadequate to support a viable
commercial building with the appropriate setbacks and necessary parking space.
Without the addition of this vacated right-Of-way, it seems unlikely that the
existing lot would support redevelopment. Even with this increase in area, this
tract still seems unsuitably small for a commercial enterprise.
2) The intersection of Benton and Gilbert Streets is a busy and dangerous one. The,
present business at this corner limits sight distance and the curb cuts on both
Benton and Gilbert cause safety hazards from entering and exiting traffic. The
proposed redevelopment of these tracts (even with the addition of the vacated
right-of-way) will do little to alleviate either problem.

3) On the west side of the private tract, both the existing and proposed commercial
buildings closely approach the bank of Ralston Creek. Furthermore, both the
private tract and public right-Of-way appear to be within the FEMA 100 Year
Flood Plain. The potential redeveloper has stated that it is his intent to fill
the lot and put a concrete retaining wall along Ralston Creek's bank. Raising
the east bank of the creek will force flood waters that would have spread
eastward to overflow farther and deeper to the west. Lining the creek bank with
concrete will degrade the semi-natural character of Ralston Creek and be yet
another step to turning it into a concrete-lined ditch. Neither of these
conditions is desirable.

The long-term interests of Iowa City would best be served by retaining this
portion of the Linn Street right-of-way. Since the useful life of the present
commercial building seems to be near its end, it would be desirable for the Iowa
City to acquire title to the present commercial tract (at best only marginallY
viable) and retire it from private use. Such a long-term strategy would permanently
resolve all safety and flood hazard concerns for these tracts. It also would allow
the restoration of this small segment of Ralston Creek's bank to a more natural
state, thus converting it from a neglected ditch to a civic amenity.

If the Planning and Zoning Commission does decide to vacate this part of the
Linn Street right-of-way, I strongly urge you to retain sufficient ground along the
entire eastern margin of these tracts to allow construction of an eight foot wide
sidewalk. I myself live on an arterial street with a narrow sidewalk only on one
side. This is a dangerous and inconvenient situation for both pedestrians and
bicyclists (children and more timid ones use the, sidewalk). I firmly believe that
all arterial streets should have eight foot wide sidewalks along both sides in order
to permit pedestrians and bicyclists to choose the most safe place to cross these
dangerous trafficways.
Furthermore, if this right-of-way is vacated, I strongly urge you to require
that the applicant give to the City of Iowa City a conservation easement on the bed
and bank of Ralston Creek at least to the top of the bank. Additionally, if these
tracts are redeveloped in the way proposed by the applicant, I urge you, for the
reasons stated above, to prohibit the placement of yet another bare concrete
retaining wall along this reach of Ralston Creek.
Finally, there seems to be a graveled, private parking lot placed on public
property along the east side of the present commercial establishment. This would be
an appropriate use for public property only if the private business,had leased this
ground from the City of Iowa City for that use. Does such a contract exist? If
not, what steps are being taken to insure that this irregular situation is
rectified? (I trust that you will forward this inquiry to the appropriate City
department.) ,

The enclosed letter from Thomas Anthony, dated March 17, 1994/ indicates that the
prospective buyer of the proposed Linn Street right-of-way vacation area has agreed to the
City's terms for the vacation. As suggested by one of the Commissioners, staff recommends
that a small portion of property currently owned by the prospective buyer at the corner of
Gilbert and Benton Street (see Exhibit A) be exchanged as part of payment for the vacated
right-of-way. Acquisition of this small portion of the property will allow the City to have a
consistent width of right-of-way along Gilbert Street in this area.
Staff recommends that the right-of-way vacation be approved subject to the following: 11
retention of a utility easement over the parcel as determined necessary by the Public Works
Department; 21 approval of a development plan by the Director of Planning and Community
Development prior to the sale of the property; 31 establishment of a conservation easement
parallel to and to the top of 'the bank of Ralston Creek on the "adjacent property; and 4)
dedication of the portion of private property as shown on Exhibit A.

On behalf of Merlin Hamm, we are requesting the vacation of Linn Street R.OW. be
, again placed on the Commission's agenda for discussion and subsequent approval.
Merlin will agree to relinquish the additional ten feet requested for future sidewalk from
his original vacation application. Merlin also agrees, as specified in the letter from
Public Works, dated February 8, 1993, to either provide permanent utility easements
over existing utilities or to relocate the utilities and easements at his expense to
accommodate development.

On behalf of Gerry Ambrose, the potential buyer, we are conveying his intentions
concerning development of the property. Gerry wants to retain the existing two story
southern portion of the building and remove the northern portion. He will remodel the
interior into office space and re-face the exterior. He plans to construct new parking
between the buildings to interface with his existing parking and possibly be shared by
both properties. The exact design details and development plan will be submitted to
City staff for review and approval later this spring.
We respectfully request this vacation application be approved and sent to Council.

Access to this property is via curb cuts
on Gilbert Street and Benton Street.
BACKGROUND INFORMATION:
The Public Works Department has identified this property as excess right-of-way no longer
needed for Gilbert Street. The City proposes to vacate the right-of-way and sell it to the
adjacent property owner, Merlin Hamm. Mr. Hamm has indicated that he may redevelop the
combined properties with an office building.
ANALYSIS:
Vacation of this right-of-way and the sale of the property to the adjacent property owner
would not remove access to Gilbert or Benton streets for other properties in the area. The
right-of-way does, however, contain public utilities and a utility easement would be required
over the vacated right-of-way. In the event that the property owner wishes to relocate these
utilities at his expense, the utility easement could be vacated. If there are private utilities
within the right-of-way, the easement may also be required to allow for them. Private utility
companies have been notified of the proposed vacation and have been asked to identify any
utilities which exist in the current right-of-way.

Given the prominent location of the subject property and the location of utilities within the
area, staff believes that there is need for close scrutiny of the redevelopment plan for the
property. This is especially the case in regard to the location of curb cuts and possible future
improvements at the intersection of Benton and Gilbert streets. For this reason, staff
proposes that, as a condition of vacating the subject right-of-way and transferring it to the
adjacent property owner, the City establish the right to approve a development plan for the
combined properties prior to the disposition of the subject tract.
There is currently a curb cut onto Gilbert Street near the northeast corner of the subject area.
The adjacent property to which this subject tract would be added also has a curb cut onto
Benton Street. Both of these curb cuts are in undesirable locations near the intersection of
two arterial streets. At the time of redevelopment of the subject parcel and the adjacent site,
it would be appropriate to redesign or relocate one or both of these curb cuts to minimize
traffic conflicts. Until an actual site plan is submitted, the most appropriate location for curb
cuts cannot be identified. Therefore, staff recommends, as a condition of the vacation and
in conjunction with the development plan review referred to above, that the City establish the
right to designate appropriate locations for curb cuts onto Benton Street and Gilbert Street
from this and the adjacent property, and, if necessary, prohibit the curb cut onto Benton
Street at the time of redevelopment of the property.
In the future, the City may wish to construct an eight foot wide sidewalk on at least one side
of Gilbert Street. For this reason, the area to be vacated should be reduced by 10 feet to
allow an 80 foot right-of-way for Gilbert Street. This will allow for construction of an eight
foot wide sidewalk and an adequate snow storage area, A four foot wide sidewalk presently
exists along the west side of Gilbert Street.

The City recently vacated an alley approximately one block south of the subject property. In
exchange for that vacation, the property owner who purchased the vacated alley established
a conservation easement along Ralston Creek. Staff proposes that a similar conservation
easement be established from the creek to the top of the bank of Ralston Creek on the
proposed redevelopment site.

Access to adjacent properties will not be diminished if this right-of-way vacation is approved.
Necessary utility easements will be retained. Purchase of the property by the adjacent
property owner will add the property to the City tax rolls, will provide the City the opportunity
to obtain a conservation easement along Ralston Creek, and will allow the City to close or
redesign two undesirable curb cuts. '

At your December 2, 1993, meeting, the Commission requested that staff report in April on a
request by Marv Fiegenspan, on behalf of the Living Word Christian Fellowship, to amend the
parking requirements for religious institutions in the CB-2 zone. Mr. Fiegenspan requested that
Section 36-20(g)(1) be amended to read that any religious institution located in the CB-2 zone
could expand without compliance with the off-street parking requirements. Currently the
exemption applies only to religious institutions established in the zone prior to August 7, 1962.
In reviewing this request, the City's interest in retaining religious institutions in the near downtown
must be weighed against the possibility of allowing facilities to be built without adequate parking.
In April of 1991, the Johnson County Council of Governments (JCCOG) conducted a study of
parking availability for downtown churches. The study found that there were approximately 4,100
spaces, both public(on- and off-street) and private, within three blocks of the five downtown
churches. The attached figure shows the location of these parking spaces. The study also
indicated that the total attendance for all Sunday services conducted between 7:30 a.m. and
12:30 p.m. was approximately 6,350. Parking availability was not analyzed in this study.
JCCOG also studied overall downtown parking in 1988. With regard to on-street unmetered
parking, the study shows that use of this parking is nearly 100 percent during the day but, that
by 7:00 p.m., only approximately 70 percent of the available parking is being used. Additionally,
during evening hours, more on-street spaces are available because parking is allowed on both
sides of the street. The attached figure and chart show the location of the parking spaces in the
study and the level of utilization of the spaces. Although these data are almost six years old, staff
feels that the data are reliable because no major changes in land use or increase in enrollment
at the University of Iowa have occurred since the study was conducted.
These studies appear to indicate that adequate parking exists in the vicinity of the CB-2 zone to
handle parking that cannot be provided by religious institutions, either on-site or through shared
parking agreements. Religious institutions will continue to be a special exception use in the CB-2
zone, providing the opportunity for case-by-case review by the Board of Adjustment. This review
should help assure that the maximum amount of on-site or shared parking available to religious
institutions will be provided.

The Commission asked that staff review the special exception approved for the Riverside Theater,
which allowed use of the City-owned parking lot adjacent to the theater. The Ordinance allows
a use that is adjacent to a City-owned parking lot to provide up to 1 00 percent of its required
parking in the City-owned lot if the Board of Adjustment substantiates that the additional parking
will not exceed the capacity of the lot. In the case of Riverside Theater, the Board was satisfied
that, due to the hours of operation of the theater - evenings and weekend afternoons, the
capacity of the lot would not be exceeded.
STAFF RECOMMENDATION:
Staff recommends that Zoning Ordinance Section 36-20(g)(1) of the CB-2 Zone be amended to
read religious institutions may expand without compliance with the off.street parking
requirements.

great deal of time to prepare. However, if the Commission wishes to consider this item in the
near future, another item on your work program may need to be deferred.

This letter is in support of Living Word Christian Fellowship, 318 Bloomington Street, Iowa City, in its
request to expand its facilities to include a gym/sanctuary complex on the lot north of the present church
structure.

The new addition is designed to serve as a multipurpose building, hosting both ministry and recreational
activities, We have planned a ministry/sports complex in order to best meet the needs of the community,
particularly the youth. We feel the addition of a new gym downtown serves a vital role in bringing Iowa
City youth off the streets and into a wholesome environment. We also want to comply with Iowa City's
historical position that it is in the best interest of the city to keep all churches in the downtown Central
Business Service Zone CB-2. Our intentions of remaining on Bloomington Street are complimentary to

It is our understanding that the proposed building addition will require 50 parking places. Unfortunately,
we will not be able to supply on-site parking for 50 cars, We do, however, have the guarantee of the
following arrangements:
1) Written agreement with A-W Insurance allowing 15 parking places, available every
weekday evening as of 6:00 p.m., as well as Saturdays and Sundays.
2) Verbal agreement with Mr. Armand Pagliai for more than 40 cars in Pagliai's Pizza
lot, available on Sunday mornings until 4:00 p.m. We understand that Mr. Pagliai's agreement is
problematic in that it is not a written lease.
3) Use of public parking lot within 300 feet of the church site. The church would have
access to this lot at all limes, allowing for a maximum of an additional 50 parking places, if available.
4) On-site parking for 3 vehicles, off-street, with continuous availability..
5) On-street parking on Sunday mornings, both sides of the street, from the church
property to a minimum of 5 blocks north, and from Dubuque Street to Dodge Street, east 10 west.
Several hundred parking places are available.
6) Neighbors surrounding Living Word Fellowship are in full support of our building
plans, and are willing to support our new parking measures.

If the Commission decides that the above parking provisions are still inadequate to accommodate the 50-
car requirement, we wish to propose an amendment to thc current Iowa City Zoning Ordinance. We
request a change in Section 36-20g of the Iowa City Zoning Ordinance for the Central Business Service
Zone CB.2. The Special Provision (1) of this Section currently states the following:
"Religious iustitulions which existed on August 7, 1962, may expand without
compliance with the off-street parking requirements."
We are approaching the Commission'to request that this ordinance be amended to state the following:
"All religious institutions may expand without compliance with the off-street
parking requirements."
We feel this amendment would best serve the interests of the community, as it would allow Iowa City
churches to expand while remaining within the preferred CB-2 Zone. We are most eager to provide a
downtown facility for young and old alike; one which functions as a ministry outreach, youth recreation
center, and family meeting hall.

Notice is hereby given that a public hearing
will be held on Tuesday, May 10/ 1994, at
7:30 p.m. in the Council Chambers, Civic
Center, 410 E. Washington Street, Iowa City,
Iowa. 403A,28, State Code of lowa, requires
this Public Hearing priorto undertaking these
housing projects. The Iowa City Housing
Authority intends to apply for 20 units Section
8 Existing Housing vouchers. If approved,
these units will be an extension of the present
Section 8 Housing Assistance Payments Pro-
gram now administered by the Iowa City Hous-
ing Authority. The units range in size from one
to two bedroom units. Funds for the Housing
Assistance Payments will be provided by the
Department of Housing and Urban Develop-
ment. The specific dollar amount is not known
at this time.
