NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:30 p.m. on the 24th day of May,
1994, in the Civic Center Council Chambers,
410 E. Washington Street, Iowa City, Iowa; at
which hearing the Council will consider the
~IOWing:
1. An ordinance amending the Zoning
Ordinance by changing the use regulations
of properties generally located on both
sides of Church Street between Dubuque
Street and Dodge Street from RM-12,
Medium Density Multi.Family Residential, to
RNC-12, Neighborhood Residential
Conservation Zone.
2. An ordinance amending Section 36-18 of

ORDINANCE AMENDING THE ZONING
ORDINANCE BY CHANGING THE USE
REGULATIONS FOR PROPERTY GENERALLY
LOCATED ON BOTH SIDES OF CHURCH
STREET BETWEEN DUBUQUE STREET AND
DODGE STREET FROM RM.12, LOW DENSITY
MULTI-FAMILY RESIDENTIAL, TO RNC-12,
NEIGHBORHOOD RESIDENTIAL
CONSERVATION ZONE.
WHEREAS, the area is currently zoned RM-
12, Low Density Multi-Family Residential; and
WHEREAS, a property owner in the area
requested that the City rezone the property to
stabilize the existing character of this portion of
Church Street; and
WHEREAS, 71 % of the properties in the
proposed area are developed with single-family
homes or duplexes; and
WHEREAS, the majority of the multi-family
buildings in the area are structures originally
constructed as single-family homes; and
WHEREAS, the predominant visual character
of the area is one of a single-family residential
neighborhood rather than a multi-family
neighborhood; and
WHEREAS, the Comprehensive Plan notes
that previous downzoning efforts in this area
were intended to reduce the incentive to
replace older dwellings with new multi-family
structures; and
WHEREAS, the inner-city area study and the
preservation plan elements of the
Comprehensive Plan contain the goal of
preserving and protecting the existing housing
stock of the North Side neighborhood; and
WHEREAS, the Planning and Zoning
Commission recommended rezoning the subject
area to RNC-12 to further the goal of stabilizing
the character of the neighborhood without
creating additional nonconforming uses.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF IOWA CITY, IOWA, THAT:
SECTION I. APPROVAL. The property
described below is hereby reclassified from Its
present classification of RM.12, Low Density
Multi-Family Residential, to RNC-12,
Neighborhood Residential Conservation:
An area containing the south half of Block
31, except for Lot B; the south half of
Blocks 34, 51 and 54; the south half of
Block 72, except for Lot 5; the north half
of Blocks 35, 50 and 55; and the north half
of Block 71, except for Lot 4; all of the
Originel Town, Iowa City, Iowa.

SECTION 11. ZONING MAP. The Building
Inspector is hereby authorized and directed to
'change the zoning map of the City of Iowa
City, Iowa, to conform to this amendment upon
final passage, approval, and publication of this
Ordinance as provided by law.
SECTION III. CERTIFICATION AND
RECORDING. The City Clerk is hereby
authorized and directed to certify a copy of this
Ordinance which shall be recorded by the
owner at the" Office of the County Recorder of
Johnson County, Iowa, upon final passage and
publication as provided by law.
SECTION IV. REPEALER. All ordinances anp
parts of ordinances in conflict with the
provisions of, this Ordinance are hereby
repealed.
SECTION V. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or
unconstitutional.
SECTION VI. EFFECTIVE DATE. This
Ordinance shall be in effect after its final
passage, approval and publication, as provided
by law. .

The applicant, Joni Kinsey, has submitted a request to rezone portions of the Church Street
residential area, which is generally located east of Dubuque Street and west of Dodge Street
from RM-12, Low Density Multi-Family, to RS-S, Medium Density Single-Family. The
applicant has indicated that concerns about potential redevelopment in the neighborhood
compelled her to submit the proposed rezoning. She desires to stabilize the existing character
of this portion of Church Street.

The Comprehensive Plan designates this area for residential development at a density of 8-16
dwelling units per acre. 80th the existing RM-12 zoning and the proposed RS-8 zoning are
consistent with the Comprehensive Plan land use designation for this area. Staff has
conducted a land use survey of the area to help determine the most appropriate zoning
designation to guide further development in this neighborhood.
ANALYSIS:
land Use Survey:
Using the City Assessor's records, staff completed a land use survey of the RM-12 zoned area
generally located on both sides of Church Street between Dubuque and Dodge streets. The
survey revealed that the majority (approximately 71 %) of the properties within the area are
developed with single-family homes or duplexes. Approximately 51 % of the lots contain
single-family homes. Ofthese, 54% are owner-occupied. Approximately 20% of the lots are
developed with duplexes. Approximately 30% of the duplexes are owner-occupied in that the
owner lives in one of the two units. Approximately 20% of the lots are developed with multi-
family buildings. The area also contains a group home, four rooming houses and one house
which is being used as a national fraternity office building.
This information indicates that the general character of the area is that of a single-family and
duplex neighborhood, with some multi-family buildings. The majority of multi-family buildings
tend to be structures that were built as single-family homes, but were later converted into
three or more units. Only four structures within the neighborhood were built as multi-family
buildings. Therefore, the predominant visual character of the area is one of a single-
family/duplex neighborhood rather than a multi-family neighborhood.

The existing RM-12 zoning allows lots within this area that have minimum lot areas of 8,175
square feet and meet the other requirements of the RM-12 zone to redevelop with multi-family
structures. The aggregation of two or more lots within the area to achieve the 8,175
minimum lot area requirement could allow further redevelopment for multi.family structures
according to the RM-12 regulations. The RM-12 zoning designation encourages redevelop-
ment of property in this area to maximize the permitted density. This leads to the aggregation
of properties and the removal of existing housing stock in the area.
Alternative Zones:
The applicant requested that the City consider zoning amendments to help stabilize the single-
family/duplex character of this area. In particular, she requested a rezoning from RM-12 to
RS-8. If the area were rezoned to RS-8, construction of multi-family buildings or the
conversion of existing buildings to multi-family units would be prohibited. Existing multi-
family buildings and rooming houses would become legal nonconforming uses and would be
subject to the nonconforming requirements of Division 4 of the Zoning Ordinance. The
construction of duplexes or the conversion of existing buildings to duplexes would be allowed
for lots which contain a minimum area of 8,700 square feet and meet the other dimensional
requirements of the RS.8 zone.

To help stabilize the current character of this neighborhood, an appropriate alternative to RM-
12 or RS-8 zoning may be the Neighborhood Conservation Residential Zone (RNC-121 zone.
The RNC-12 zone was used for similar reasons in the Jefferson Street and Market Street
areas. The RNC-12 zone contains special provisions which allow existing multi-family
buildings and rooming houses that do not exceed the RM-12 density to continue as
conforming uses within the new zone. Rezoning the subject area to RNC-12 would contribute
to the goal of stabilizing the character of the neighborhood without creating additional
nonconformities.
Comprehensive Plan:
As noted, both the existing RM-12 zoning designation and the proposed RS-8 zoning
designation are consistent with the Comprehensive Plan land use recommendations for this
area. The RNC-12 zone proposed by staff would also be in compliance with the land use
recommendations of the plan as well as the policy statements contained in the plan. The
inner-city area study and the preservation plan elements of the Comprehensive Plan contain
the goal of preserving and protecting the existing housing stock of the North Side neighbor-
hood. The Comprehensive Plan notes that previous downzoning efforts were intended to
reduce the incentive to replace older dwellings with new multiple structures. The proposed
RNC-12 zone would further promote the achievement of this goal.
It may be appropriate to consider rezoning other nearby portions of the North Side from
RM-12 to RNC-12. The North Side Neighborhood Association has expressed an interest in
conducting such a study. The current proposed rezoning could proceed at this time, while the
larger area is studied and considered for rezoning as the staff work program permits. The
applicant has consented to amend the rezoning application to change the land use
classification of the area currently under consideration from RM-12 to RNC-12.

STAFF RECOMMENDATION:
Given the general single family/duplex character of the neighborhood, staff believes there may
be merit in conserving its character. The housing stock in the area is predominantly single-
family and duplex structures. Given the ages of these structures, they tend to be more
affordable for entry level home buyers than newer single-family or duplex developments. The
existing RM.12 zoning provides incentives for the destruction of single-family and duplex
housing stock, and its replacement with multi-family structures. Staff recommends and the
applicant agrees that the area be rezoned RNC-12 rather than RS.8 to avoid the creation of
nonconformities.

Dear Commission Members;
This letter is our response to the re-zoning application submitted to you
by Joni Kinsey for Church Street, approximately from Dubuque to Dodge
streets. We understand that the change would be from RM-12 to RNC-12, and
that RNC-12 limits new construction to single-family and duplex structures.
The Northside Neighborhood Association has recently considered
applying for re-zoning the entire area currently zoned RM -12 (between
Church and Bloomington streets), but we chose to delay the project in order to
determine the extent of support from affected property owners. However, this
application prompts action by us now.
Northside residents find themselves increasingly surrounded by new,
multi-unit buildings. It is not a pleasant thing to discover that a house next
door is to be demolished to make way for a four-plex. Neither is it pleasant to
see a large, nicely-kept lot divided so that apartments can be built on half of it.
Such projects as these have gradually eaten holes in the fabric of our
neighborhood and should be stopped. Failure to halt such construction will
surely result in the destruction of the presently enjoyable character of our
neighborhood.
Few of us want to live next-door to or across the street from an
apartment building. Not only does the higher density increase the levels of
noise, pollution and traffic; but not knowing one's neighbors (which is
usually though not necessarily the case) tends to make one uncomfortable, and
makes it easier to sell one's property to a developer in order to escape the
pro b I ems crea ted.
What's more, beautiful, unique homes too frequently become the victims
of dense development.
Just two blocks north of Chrch Street is Brown Street which, a month
ago, you recommended be designated an historic district. It would be a shame
to one day find ourselves with rows of new apartment buildings so very near
Brown Street.
This is your opportunity to say no to that fate, and to say yes to
maintaining our fine neighborhood while it is intact.
We urge you to approve Ms. Kinsey's application

Dear Commissioners:
I attended last evening's meeting of the Commission, and
had to leave before you reached this item on the agenda.
I came to speak in support of the application, and am
writing now instead.
I have owned a home in Iowa City for eleven years. I had
a chance to but a beautiful home on the North Side in 1992,
and moved there thinking I would settle in for a long time.
I was excited about being in this area of town because the
property is well-maintained and because the people who live
here make investments of time, energy, and caring to make
it a pleasant neighborhood.
During my first six months here, I questioned that deci-
sion many times. The rental properties on my block are an ,
eye-sore much of the time. The yard across the street was
full of garbage for days and weeks at a time. The tenants
were rude and noisy--I called police on at least three occa-
sions when noise was unbearable at 1:00 or 2:00 A.M; I was
called obscene names when I asked them to turn down loud
music and yelling. I had to listen to tires squeeling and
put up with beer parties. (I must say that there are other
rental properties that are well-maintained, and whose tenants
are respectful and neighborly.) I probably will not stay
here for years and years, as I had originally hoped. I will
find a neighborhood without rental properties.
My house is one house away from Church Street. If Church
Street goes to more and more apartment buildings, this en-
tire neighborhood will be badly effected. In addition to
the problems above, I must add that there is a terrific par-
king problem in the area already. Adding to the population
in the area would only magnify this problem.
Please consider and support this proposal for rezoning.

grew up at 419 Church St. (1943-1966) and have recently returned to live there
again. I would like to see the neighborhood retain a "fami ly" atmosphere and

TIONS OF APPROXIMATELY 3.57 ACRES OF
LAND LOCATED NORTH OF COURT STREET
AND WEST OF SCOTT BOULEVARD FROM
CN-', NEIGHBORHOOD COMMERCIAL, TO
RM-20, MEDIUM DENSITY MUL TI.FAMIL Y
RESIDENTIAL.
WHEREAS, the owner, Plum Grove Acres,
Inc., has requested the City to rezone approxi-
mately 3.57 acres of land located north of
Court Street and west of Scott Boulevard from
CN-1, Neighborhood Commercial, to RM-20,
Medium Density Multi-Family Residential; and
WHEREAS, the subject property is located
adjacent to existing multi-family development.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. APPROVAL. The property de-
scribed below is hereby reclassified from its
present classification of CN-l, Neighborhood
Commercial, to RM-20, Medium Density Multi-
Family Residential:
Lots 171, 172, 173, 174, 175, and 176in
the Court Hill-Scott Boulevard Addition,
Part IX, an addition to the City of Iowa
City, Iowa, according to the plat thereof
recorded in Book 31 , page 47, Plat Records
of Johnson County, Iowa.
SECTION II. ZONING MAP. The Building
Inspector is hereby authorized and directed to
change the zoning map of the City of Iowa
City, Iowa, to conform to this amendment upon
the final passage, approval end publication of
this Ordinance as provided by law.
SECTION III. CERTIFICATION AND RECORD-
ING. The City Clerk is hereby authorized and
directed to certify a copy of this Orainance
which shall be recorded by the owner at the
Office of the County Recorder of Johnson
County, Iowa, upon final passage and publica-
tion as provided by law.
SECTION IV. REPEALER. All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION V. SEVERABILITY. If any' section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the

The applicant, Plum Grove Acres, Inc., is requesting an existing CN-1, Neighborhood
Commercial, zone be reduced in size from 7 to 3 acres. The area at the corner of Court Street
and Scott Boulevard was zoned CN-1 in 1983. It was platted into 12 commercial lots in 1990
as part of Court Hill-Scott Boulevard, Part IX. The plat included approval of a private street,
Scott Court, to serve the anticipated commercial development. A dental office has been built
on the west side of Scott Court.

family development at a density of approximately 24 units per acre according to the provisions
of Section 36-12 of the Zoning Ordinance.
ANALYSIS:
Although the proposed RM-20 zone would be compatible with the adjacent RM-12, Low
Density Multi-Family, the existing RM-20 zone to the west, and the three acre CN-' zone that
would remain to the south, the proposed rezoning would remove a substantial portion of a
CN-1 zone intended to serve a large portion of eastern Iowa City. Pages 45 through 48 of the
Comprehensive Plan provide a detailed discussion of the purpose and location criteria for
neighborhood commercial zones. Conveniently located neighborhood shopping centers which
are well integrated with surrounding residential areas are an important element of a well
designed neighborhood. Such centers should provide a convenient location for surrounding
neighborhoods to do day-to.day shopping. When appropriately located, neighborhood centers
can help minimize traffic through a neighborhood and elsewhere in the city, in that they
provide goods and services in close proximity to their customers.
The existing CN-1 zone at the corner of Scott Boulevard and Court Street is an excellent
location to serve the neighborhoods in the northwest and southwest quadrants of the
intersection of Scott Boulevard and Court Street and the areas east of Scott Boulevard which
have recently been annexed into the City. There are few other locations in eastern Iowa City
which are located at the intersections of major trafficways and which have good topographic
characteristics, which are appropriate for a neighborhood shopping district.
As eastern Iowa City more fully develops, there will be increased demand for commercial
services. Reduction of the area currently zoned CN-' may result in the need to establish other
CN-1 zones in areas that are less suitable for commercial development. For these reasons,
it may be inappropriate to reduce the size of the existing CN-1 zone at this intersection.
The applicant's letter expresses concerns regarding the development requirements for the
CN-' zone. Based on these and similar concerns expressed by other property owners, the
Commission has scheduled a review of the CN-1 requirements in March of 1994. Rather than
eliminating CN-' zoned areas, it may be more appropriate to amend the CN-' zone regulations
if upon review they are found to be unworkable.
The special provisions section of the CN.' zone states that in no case shall an area zoned
CN-1 be less than three acres or more than seven acres. The original rezoning application
submitted by the applicant would have resulted in a eN-' zone of less than three acres. In his
letter dated November 11, '993, the applicant indicated that he would amend the rezoning
application to include only four acres leaving a three acre CN-l zone. A revised legal
description reflecting this amendment should be submitted.
STAFF RECOMMENDATION:

The NC-l zone is supposed to take care of the neighborhood
needs. This zone has square foot limitations on building size and
building use. There is a special use provision for uses not
specfically set forth in the ordinance, This special use provision
allows a prospective business person to appear before the
Board of Adjustment" and plead for a provisional use.

The allowable uses in this NC-l zone when it was copied from some
other municipality who had copied it from some other town were
changed to accomodate those business that already existed in the
proposed zone. A food store was allowed becuase there was one,
a gas station was allowed because there was one, a bank was allowed
because there was one. Then the City added in the politically correct
beauty shop, barber shop, and dry cleaners " pick up only" approved uses,

The food store square footage was set out at 40,000 sq. ft of
space under one roof. The offices were set out at 1800 square
foot of space per professional use. These square footages are
"chronologically gifted" to use the correct political designation,
The modern food store now includes the deli, the eating area, the
greeting card section, the hardware section, the post office, and
last but not least...the food section, This use can not be
accomplished in 40,000 sq. ft.

The professional person,...use the dentist as an example..can not
function in 1800 sq ft of space without giving up some vital area
of work space. The square footage requirement in the NC-l zone
is old, out of date and frankly should not be any concern of the

When this NC-1 ordinance was adopted, buildings were allowed
to have apartments on the second floor and in the lower floor but
not on the main floor, This is a good concept for a seven acre
commercial space. At ten o'clock or earlier and all day Sunday
the work place area is vacant and in the evenings it is dark. The
presence of apartment dwellers above the stores gives the
area the desired protection needed. Those tenants can use the 911
system and police the area. This allowable use of apartments in the
NC-1 zone was eliminated so secretively two years ago by P&Z and
Council that the 8uilding Department did not know about it and
neither did the City Council. As a result, I now have a commercial
building with three apartments on the second floor that was built
with full permission of the Building Department and the structure
in now a "Non-conforming use" which reflects on the mortgage and
future value.

The area under consideration for rezoning to apartments was the
selected site for two food stores. Since common sense is not part
of the zoning process, these two food stores were told by staff
that there was no way that they could fit into the Neighboorhood.
The P&Z commission and Council now faces the desired alternate of
eliminating 70 trailer homes and two existing businesses to
do the same thing that this food store wanted to do on
seven acres.
The application process to the "Board of Adjustment" is a humiliating
experience for any established business person in Iowa City,
Le~set down in print section D of the application:
"The applicant is required to present specific evidence,
not just opinions, that the general standards for granting
of a special exception will be met:
1. That the specific proposed exception will not be detrimental
to or endanger public health, safety, morals, comfort or general
welfare.."
How would you answer that question? Many of my prospective customers
said,."Do you have any other land outside of this ____ city?"

Now for a discussion of the staff application of the NC-1 ordinance.
The ordinance calls for professional offices to be limited to
30X of the existing commercial space.' The first office application
was denied by the Building Dept. because there was no commercial
building in the area. Their comment was" 30X of nothing is nothing".
Catch 22, It took two months of high level staff meeting to
agree to allow the first building to be built for offices.
Then: the Building Dept. issued a statement to the office builder
that they could not cement the basement floor but thay had
to put down a sheet of plastic and hold it down with cement
blocks. A month of negotiation between my customer's lawyer and the
building department resulted in a compromise,..the building dept
would allow a 20 x 15 foot concrete slab to be poured in the
basement for use of the furnace and water heater and water softener'
That compromise was followed by another 10 momths of negotiation
between lawyer and building department with no further committments,
The city's position was that since this was a dental office and
it was allowed to have only 1800 sq, ft. and if the basement
were alllowed to be cemented and since the city does not have
enought inspectors to make sure that the dentist is not pulling
teeth in the basement in violation of the NC-1 ordinance, then
the basement should not be allowed to be cemented,

This fiasco was brought to a head when I had to take over the
building because the dentist refused to put up with any
I more of the hassle with the city and left the project. My suggestion
l to the building dept was to take this matter to city council and get
(~ on television and tell the entire city about the of the impracticallity
\ of the interpretation of the NC-l zoning requirements,
The building department allowed basement floors to be cemented that
4 same day.

Trying to do a nice job on a commercial prea and finding that
every body and his brother in Iowa City wants to tell the business
person what to do and where to do it and having to spend one and one
half years to get a building permit thru Iowa City and the Board of
Adjustment leaves me no choice. Let's get out of the commercial
business, The City does not want any commercial business.. ,so
let~s do apartments.

Sign Regulations Amendment
David L. Long of Dave Long Protective Products, Inc. has requested, on behalf of Protein
Blenders, 2420 Old Highway 218 South, that the sign regulations of the 1-1 zone be amended to
permit awning signs. An approximate 5'x13' awning has been placed above the north office
entrance of the Protein Slenders building but an application for a sign permit to place a 2Wx3'
sign on the awning was denied by the City because "awning signs" are not allowed in the 1-1
zone. A copy of illustrations that accompanied the sign permit application and a letter from David
Long to Tom Scott are attached.
The 1-1, 1-2, ORP and RDP zones all have the same sign regulations. Within these zones, a use
is permitted facia signs, window signs and either an identification monument sign or an
identification free-standing sign. These signs are restricted in size by the dimensional
requirements of the zones' sign regulations..
An awning only becomes a sign if it is visible from a public right-of-way and if any reading matter,
inscriptions, emblems or trademarks are affixed to the awning. Without these components, the
awning is not a sign and is, therefore, not governed by the restrictions of the sign regulations.
Awnings themselves are not expected to be inappropriate fixtures on a building located in the 1-1,
1-2, ORP and RDP zones. However, it may be desirable to restrict the area of the awning that
contains a sign. The staff is forwarding the recommendation that the sign regulations of the 1-1,
1-2, ORP and RDP zones be amended to allow awning signs but to restrict the maximum area
of a sign placed on an awning to 25% of the surface of the awning or 12 square feet, whichever
is less.
Additional regulations restricting the size of awnings themselves may be forwarded to the
Commission at a later date by the Department of Housing and Inspection Services. Until then,
the staff recommends that the Commission recommend approval of the accompanying
amendment to the sign regulations of the Zoning Ordinance to permit awning signs in the 1-1, 1-2,
ORP and RDP zones but to restrict their maximum area to 25% of the surface of the awning or
12 square feet, whichever is less.

When two (2) or more uses are located on a lot, a common
monument or free-standing sign may be erected. The maximum
area of the common sign may be 50% larger than the area of the
maximum individual sign allowed.
2.
In the 1-1 and 1-2 zones, two free-standing or monument signs or
one free-standing sign and one monument sign are permitted
provided that frontage along a single lot is not less than 160
feet. The distance between two free-standing signs shall be no
less than 150 feet as measured along the frontage of a single lot.
c.
Dimensional requirements.
1. Uses in this zone shall be allowed a maximum building sign area
per sign wall equal to 15 % of the sign wall on which the sign is
to be located.
2.
Individual signage allowances.
a. Skm: Facia.
Maximum Area: Fifteen percent (15 %1 of the sign wall
area.
Maximum Heiqht: None.
b.
Siqn: Monument.
Maximum Area: Two (2) square feet per lineal foot of lot
frontage, not to exceed 150 square feet or 75 sq. ft. per
sign face.
Maximum Heiqht: Five (5) feet.

NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:30 p.m. on the 24th day of May,
1994, in the Civic Center Council Chambers,
410 E. Washington Street, Iowa City; Iowa; at
which hearing the Council will consider the
following:
1. An ordinance amending the Zoning
Ordinance by changing the us~ regulations
of properties generally located on both
sides of Church Street between Dubuque
Street and Dodge Street from RM-12,
Medium Density Multi-Family Residential, to
RNC-12, Neighborhood Residential
Conservation Zone.
2. An ordinance amending Section 36-18 of
the Zoning Ordinance to modify the require-
ments of the Neighborhood Commercial
(CN-1) zone.
3. An ordinance amending the Zoning
Ordinance by changing the use regulations
of four acres located west of Scott
Boulevard and north of Court Street from
CN-1 to RM-20.
4. An ordinance amending Zoning Ordinance
Section 36.55(m)(1), Additional Regula-
tions, to permit religious institutions to be
established or expanded with access to a
collector street.
5. An ordinance amending the sign regulations
of the 1.1, 1.2, ORP and RDP zones to
G permit awning signs.
6 An ordinance amending the Zoning
Ordinance to add Division 7, entitled
"Minor Modifications."
7. An ordinance repealing the vacation of the
easterly ten feet of Maiden Lane south of
Court Street and north of Harrison Street.

AN ORDINANCE AMENDING CHAPTER 36 OF
THE CODE OF ORDINANCES OF THE CITY OF
IOWA CITY, IOWA, ENTITLED "ZONING" BY
ADOPTING ARTICLE IV, DIVISION 7 ENTITLED
"MINOR MODIFICATIONS".
WHEREAS, many of the special exception
applications considered by the Board of Adjust-
ment involve minor deviations from the require-
ments of the Zoning Ordinance; and
WHEREAS, the minor modification procedure
will improve administration of the Zoning Ordi-
nance by saving both the property owner and
the City time and expense; and
WHEREAS, the Board of Adjustment and the
Planning and Zoning Commission recommend
approval of the minor modification procedure.
NOW, THEREFORE, BE IT ORDAINED BYTHE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. AMENDMENTS
Chapter 36, Article IV entitled "General
Provisions" of the Code of Ordinances of the
City of Iowa City, Iowa, be and the same is
hereby amended by adopting Division 7 and
Section 36-95 to read as follows:
Division 7. Minor Modifications.
Sec. 36.95. Minor Modification Procedures.
(a) Purpose
These provisions shall ensure the follow-
ing:
(, ) Minor modifications from standards
contained in this Chapter may be
granted only when, due to special cir-
cumstances applicable to a property,
strict application of this Chapter is
impractical and deprives that property
of privileges enjoyed by other property
in the vicinity end in identical zoning
districts.
(2) Any minor modification granted shall
be subject to the requirements of this
section and in conformity with the
intent and purpose of this Chapter.
(bl Application
An application for a minor modification
shall compiy with the requirements set
forth in this section.
lcl Applicability
The building official may grant minor modi-
fications from the requirements of this
Chepter in compliance with the following
standards:
(,) Parking for commercial uses may be
reduced up to 10 percent.
(2) Height of a wall or fence may be
increased up to 25 percent, but In no

case shall a minor modification allow
a fence greater than 8 feet in height.
(3) Height of a building may be increased
up to 10 percent.
(4) Sideyards may be reduced up to 2
feet, but in no case shall a sideyard be
reduced to less than 3 feet in width.
(5) Other yards may be reduced up to 15
percent of the required setback.
Any requests for modifications which ex-
ceed the limitations set forth above and all
other requests for modifications of the
requirements of this Chapter require the
filing of a special exception and/or vari-
ance application with the Board of Adjust-
ment.
(d) Administrative Hearing and Notice
Upon receipt a complete minor modifica-
tion application, an administrative hearing
shall be set. Ten (10) days prior to the
administrative hearing, written notice shall
be sent to property owners within 200
feet of the exterior boundaries of the
property.
(e) Findings
Following an administrative hearing, the
building official shall issue a written deci-
sion which recites the findings upon which
the decision is based. The property owner
shall record the decision in the office of
the Johnson County Recorder.
The building official may approve and/or
, modify an application, in whole or in part,
with or without conditions, only if the
building officials makes all of the following
findings:
(1) Special circumstances apply to the
property such as size, shape, topogra-
phy, location or surroundings.
(2) The minor modification will not be
detrimental to the public health, safe-
ty, or welfare or be injurious to other
property or improvements in the vicin-
ity and in the zoning district in which
the property is located.
(3) The minor modification does not ex-
ceed the minor modification standards
or allow a use or activity not other-
wise expressly authorized by the
regulations governing the subject
property .
(4) The minor modification Is in conformi-
ty with the Intent and purpose of this
Chapter.
(5) The minor modification does not, In
any way, alter tha applicant's obliga-
tion to comply with other applicable
statutes, ordinances, laws or regula-
tions.

(fl Precedents
The granting of a minor modification is not
grounds for granting other minor modi-
fications for the same or differing proper-
ties.
(g) Burden of Proof
The applicant bears the burden of proof
and must support each of the required
findings by a preponderance of the evi-
dence.
(hI Minor Modification Expiration
A minor modification must be exercised
within 180 days from the date of approval
or the minor modification shall become null
and void.
(i) Time Extensions
For good cause, the building official may
grant time extensions not to exceed a total
of 12 months from the date of the deci-
sion. Prior to granting an extension, the
building official shall ensure that the minor
modification complies with all current
Zoning Code provisions.
(jl Revocation
The building official may revoke or modify
a minor modification if anyone of the
following occurs:
(1) The grantee has not substantially
exercised the rights granted by the
minor modification.
(2) The minor modification was obtained
by misrepresentation or fraud.
(3) The applicant ceases or suspends
work on the improvement authorized
pursuant to the minor modification
for six or more consecutive calendar
months.
(4) The improvement authorized pursuant
to the minor modification violates any
applicable statute, ordinance, law or
regulation.
(5) The improvement permitted by the
minor modification is detrimental to
the public health, safety or welfare or
constitutes a nuisance.
(kl Appeals
The applicant may appeal the decision of
the building official to the Board of AdJust-
ment.
SECTION II. REPEALER. All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudlclition shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconsti-
tutional.

ORDINANCE TO ADD DIVISION 7 ENTITLED
"MINOR MODIFICATIONS".
WHEREAS, the minor modification procedure
will improve administration of the Zoning Ordi-
nance by saving both the property owner and
the City time and money in matters commonly
granted by the Board of Adjustment; and
WHEREAS, the Board of Adjustment and the
Planning and Zoning Commission recommend
. pproval of the minor modification procedure.
NOW, THEREFORE, BE IT ORDAINED BY THE

increased up to 25 percent but in no
case may a minor modification allow
a fence greater than 8 feet in height.
(3) Height of a building may be increased
up to 10 percent.
(4) Sideyard may be reduced up to 2 feet,
but in no case can a sideyard be re-
duced to less then 3 feet in width.
(5) Other yards may be reduced up to 15
percent of the required setback.
Any modification request which exceeds
the prescribed limitations outlined in this
section shell require the filing of especial

sion and shall recite therein the findings
upon which the decision is based. Th

At its meeting of March 1, 1994, the City Council referred to e Board of Adjus ent and the
Planning and Zoning Commission a proposal to amend e zoning code al owing minor
modifications to be granted administratively without the nece sity of going before the Board of
Adjustment. Council person Larry Baker pointed out that a minor modification procedure could
save both the property owner and the City time and money in matters which are commonly
granted by the Board of Adjustment.

In response to Council's action, I have prepared for your review and recommendation to the City
Council an ame'ndment to the Zoning Code which would establish procedures allowing the
Building Official to administratively grant minor modifications. Generally, the procedure limits the
type and extent of a minor modification, requires notification of adjacent property owners, and
establishes standards for granting a minor modification. All decisions of the Building Official can
be appealed to the Board of Adjustment.

These provisions shall ensure the following:
(a) Minor modifications from standards contained in this Zoning Code may be
granted only when, because of special circumstances applicable to the
property, the strict application of this code is impractical and deprives such
property of privileges enjoyed by other property in the vicinity and within
identical zoning districts.

section and in conformity with the intent and purpose of this code.
2. Application
An application for a minor modification shall be filed in a manner consistent with the
requirements obtained in this section.

AN ORDINANCE AMENDING CHAPTER 36 OF
THE CODE OF ORDINANCES OF THE CITY OF
IOWA CITY, IOWA, ENTITLED "ZONING" BY
ADOPTING ARTICLE IV, DIVISION 7 ENTITLED
"MINOR MODIFICATIONS",
WHEREAS, many of the special exception
applications considered by the Board of Adjust-
ment involve minor deviations from the require-
ments of the Zoning Ordinance; and
WHEREAS, the minor modification procedure
will improve administration of the Zoning Ordi-
nance by saving both the property owner and
the City time and expense; and
WHEREAS, the Board of Adjustment and the
Planning and Zoning Commission recommend
approval of the minor modification procedure,
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. AMENDMENTS
Chapter 36, Article IV entitled "General
Provisions" of the Code of Ordinances of the
City of Iowa City, Iowa, be and the same is
hereby amended by adopting Division 7 and
Section 36-95 to read as follows:
Division 7. Minor Modifications.
Sec, 36-95, Minor Modification Procedures.
(a) Purpose
These provisions shall ensure the follow-
ing:
(11 Minor modifications from standards
contained in this Chapter may be
granted only when, due to special cir-
cumstances applicable to a property,
strict application of this Chapter is
impractical and deprives that property
of privileges enjoyed by other property
in the vicinity and in identical zoning
districts,
(2) Any minor modification granted shall
be subject to the requirements of this
section and in conformity with the
intent and purpose of this Chapter,
(bl Application
An application for a minor modification
shall comply with the requirements set
forth in this section,
(cl Applicability
The building official may grent minor modi-
fications from the requirements of this
Chapter in compliance with the following
standards:
(11 Parking for commercial uses may be
reduced up to 10 percent,
(21 Height of a wall or fence may be
increased up to 25 percent, but in no

case shall a minor modification allow
a fence greater than 8 feet in height.
(3) Height of a building may be increased
up to 10 percent.
(4) Sideyards may be reduced up to 2
feet, but in no case shall a sideyard be
reduced to less than 3 feet in width.
(5) Other yards may be reduced up to 15
percent of the required setback.
Any requests for modifications which ex-
ceed the limitations set forth above and all
other requests for modifications of the
requirements of this Chapter require the
filing of a special exception and/or vari-
ance application with the Board of Adjust-
ment.
(d) Administrative Hearing and Notice
Upon receipt a complete minor modifica,
tion application, an administrative hearing
shall be set. Ten (10) days prior to the
administrative hearing, written notice shall
be sent to all~ttiA!l property owners within
200 feet of the exterior boundaries of the
property.
(e) Findings
Following an administrative hearing, the
building official shall issue a written deci-
sion which recites the findings upon which
the decision is based, The property owner
shall record the decision in the office of
the Johnson County Recorder,
The building official may approve and/or
modify an application, in whole or in part,
with or without conditions, only if the
building officials makes all of the following
findings:
(1) Special circumstances apply to the
property such as size, shape, topogra-
phy, location or surroundings.
(2) The minor modification will not be
detrimental to the public health, safe-
ty, or welfare or be injurious to other
property or improvements in the vicin-
ity end in the zoning district in which
the property is located.
(3) The minor modification does not ex-
ceed the minor modification standards
or allow a use or activity not other-
wise expressly authorized by the
regulations governing the subject
property,
(4) The minor modification is in conformi-
ty with the intent and purpose of this
Chapter,
(5) The minor modification does not, In
any way, alter the applicant's obliga.
tion to comply with other applicable
statutes, ordinances, laws or regula.

(fl Precedents
The granting of a minor modification is not
grounds for granting other minor modi,
fications for the same or differing proper-
ties.
(gl Burden of Proof
The applicant bears the burden of proof
and must support each of the required
findings by a preponderance of the evi-
dence.
(hI Minor Modification Expiration
A minor modification must be exercised
within 180 days from the date of approval
or the minor modification shall become null
and void.
(i) Time Extensions
For good cause, the building official may
grant time extensions not to exceed a total
of 12 months from the date of the deci-
sion, Prior to granting an extension, the
building official shall ensure that the minor
modification complies with all current
Zoning Code provisions,
(j) Revocation
The building official may revoke or modify
a minor modification if anyone of the
following occurs:
(1) The grantee has not substantially
exercised the rights granted by the
minor modification,
(21 The minor modification was obtained
by misrepresentation or fraud,
(31 The applicant ceases or suspends
work on the improvement authorized
pursuant to the minor modification
for six or more consecutive calendar
months.
(4) The improvement authorized pursuant
to the minor modification violates any
applicable statute, ordinance, law or
regulation,
(51 The improvement permitted by the
minor modification is detrimental to
the public health, safety or welfare or
constitutes a nuisance,
(klAppeals
The applicant may appeal the decision of
the building official to the Board of Adjust-
ment.
SECTION II. REPEALER, All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed,
SECTION III. SEVERABILITY, If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the.
Ordinance as a whole or any section, provision
or part thereof not adjudged Invalid or unconsti-
tutional.

ANALYSIS:
The above mentioned improvements to Maiden Lane include paving the street, installing
sidewalks on both sides of the street, providing metered parking on the west side of the street
and constructing a pedestrian bridge over Ralston Creek, The attached plan illustrates these
improvements, The sidewalk along the east side of Maiden Lane is located within the area
which was previously vacated. Repealing this vacation will allow construction of the
proposed improvements and will provide legal public access to these improvements,
STAFF RECOMMENDATION:
Staff recommends that the proposal to repeal the vacation of the easterly 10 feet of Maiden
Lane between Court and Harrison streets be approved,

NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:30 p,m. on the 24th day of May,
1994, in the Civic Center Council Chambers,
410 E, Washington Street, Iowa City, Iowa; at
which hearing the Council will consider the
following:
1, An ordinance amending the Zoning
Ordinance by changing the use regulations
of properties generally located on both
sides of Church Street between Dubuque
Street and Dodge Street from RM-12,

AN ORDINANCE AMENDING CHAPTER 36 OF
THE CODE OF ORDINANCES OF THE CITY OF
IOWA CITY, IOWA, ENTITLED "ZONING" TO
PERMIT RELIGIOUS INSTITUTIONS TO BE
ESTABLlSH~D OR EXPANDED WITH ACCESS
TO A COLLECTOR STREET.
WHEREAS, religious institutions required to
comply with Section 36-55Im1(1) of the Code
of Ordinances must be located with access to
arterial streets or on streets with paving wider
than 28 feet; and
WHEREAS, the additional access regulation
for religious institutions is intended to keep
local residential streets from being inundated by
large amounts of traffic; and
WHEREAS, in certain cases, a street
classified as a collector street can
accommodate the traffic generated by a
religious institution; and
WHEREAS, in lower density residential zones,
religious institutions seeking to establish or
expand must submit an application for a special
exception to the Board of Adjustment, which
considers public health and safety, impacts on
the use and enjoyment of property in the
immediate vicinity, and traffic congestion; and
WHEREAS, the Board of Adjustment's review
provides an additional safe'guard against the
expansion or establishment of a religious
institution on a street with insufficient capacity
in the lower density residential zones.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. AMENDMENT. Chapter 36, Article
II "PRINCIPAL USES AND REQUIREMENTS",
Section 36-55 entitled "Use and requirements"
of the Code of Ordinances of the City of Iowa
City, Iowa, be hereby amended by repealing
Section 36.55(m1l11, and adding e new Section
36-55(m1l1) to read as follows:
Subsection 36-55Im1(1). Religious
institutions shall have access to arterial or
collector streets or on streets with paving
wider than twenty eight feet (28'),
SECTION II, REPEALER, All ordinances and
parts of ordinances in conflict with the
provisions of this Ordinence are hereby
repealed.

SECTION III. SEVERABILITY, If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision

The requirements of Section 36-55(ml of the Iowa City Zoning Ordinance, "Additional
Regulations", pertain to religious institutions located in residential zones and the Commercial
Office (CO-1l zone, Religious institutions are permitted in all R zones by special exception or
as provisional uses. I recommend the Commission amend paragraph 1 of this subsection, as
I feel it is unnecessarily restrictive. This matter was brought to my attention during discussion
of the proposed expansion of the First Mennonite Church located at 405 Myrtle Avenue.
Religious institutions shall be located with access to arterial streets as identified
on the Comprehensive Plan map or on street pavements wider than 28 feet.

Collector streets are between arterials and residential streets in the street functional
classification hierarchy. The important distinction between collector and residential streets
is that traffic circulation and property access are equally important on a collector street. It
would be appropriate for a collector street to circulate a relatively small amount of traffic (less
than 2,500 vehicles per day) that might be generated from a church, In addition to the First
Mennonite Church, examples of this in Iowa City occur on Phoenix Drive, Washington Street
east of First Avenue, and Village Road, I do not perceive the churches on these collector
streets to be causing inappropriate traffic conditions,

In the lower density residential zones (See Attachment A), the 80ard of Adjustment reviews
special exception applications for establishing or expanding a religious institution, Before a
special exception can be approved, the applicant must demonstrate seven general standards
are met. These standards include consideration of public health and safety, impacts on the
use and enjoYlllent of property in the immediate vicinity, and minimizing traffic congestion.
The Board review provides an additional safeguard in the lower density residential zones, The
proposed change in the ordinance does not automatically permit the establishment or

(1) Religious institutions shall be located with access to arterial streets as identified
on the Comprehensive Plan Map or on street pavements wider than 28 feet.
(2) Dimensional requirements,
a. Minimum lot area: 40,000 square feet.
b, Minimum yards, Two feet of horizontal distance shall be provided for
each foot of building height measured between the nearest point of any
lot line and the nearest point from which the height is measured.

RE: First Mennonite Church
Dear Department Members:
The First Mennonite Church of Iowa city, Iowa has an application
before the Iowa city Board of Adjustment asking to expand its
religious facility by building a wing onto the building for
Sunday School classrooms. A problem that has arisen appears to
be that Iowa city Zoning Code permits churches only on arterial
streets. The street past First Mennonite Church is a collector
street.
It is my understanding that staff is recommending amending the
Zoning Code to permit churches on collector or arterial streets.
First Mennonite Church supports this amendment. Furthermore,
First Mennonite Church asks that expedited consideration of the
amendment be done since our building project is now on hold until
this matter is formally resolved.

7. An ordinance repealing the vacation of the

Public notice is hereby given that the City
Council of the City of Iowa City, Iowa, will
conduct a public hearing on plans, specifica-
tions, form of contract and estimated cost for
the construction of the Iowa Avenue Senior
Center Parking Lot Retaining Wall and Rail Im-
provement Project in said City at 7:30 p.m. on
the 24th day of May, 1994, said meeting to be
held in the Council Chambers in the Civic
Center in said City.
Said plans, specifications, form of contract
and estimated cost are now on file in the office
of the City Clerk in the Civic Center in Iowa
City, Iowa, and may be inspected by any
persons interested.
Any persons interested may appear at said
meeting of the City Council for the purpose of
making objections to said plans, specifications,
contract or the cost of making said improve-
ment.
