Horow/ (#2) Horow/ We have a special presentation of checks to the
city of Iowa city from the city of Santa Rosa, California and
Darrel courtney, our former mayor is here to present-actually
I already have them but, corne on Darrel.
Darrel courtney/ Good evening. I thought the bench presentation
was going to be the final chapter but I got a surprise phone
call a couple of weeks ago and they sent some checks in and I
think probably the most apt way to sum this thing up- I got a
final report in which I think t'lent in to the newspaper in
Santa Rosa from the Operation Payback Committee and I will
just quickly go through it because I think it really sums up
the effort that sums up the effort that was put forth out
there as well. Ten months ago a series of events and letters
led to the formation of a group of people in Santa Rosa whose
common interests was in helping flood victims in America's
midwest. Part of their motivation came from reflecting on the
help which midwesterners gave to Santa Rosa after the 1906
earthquake. That is why the term payback became part of our
name. Subsequently we have met a great many obstacles in
attempting to send people, money and material goods nearly
2,000 miles to the Iowa city area. We also benefitted greatly
here in the Santa Rosa area from our payback experiences. We
built relationships to new friends in Iowa city as well as
within the Santa Rosa area. Relationships that will be with
us for a long time to come. Links were made from California
to Iowa between elementary schools, between ministries and
churches, between governmental officials and agencies and
between businesses. We learned that partnerships are not
nearly as difficult to form as often portrayed. We saw
distinctions blur and cooperation built as representatives of
government, and religious groups and private sector worked
together to send relief to people in need far away.
Bureaucratic processes were expedited, difficulties were
minimized and our problems became simple challenges as we
combined our efforts to overcome inconveniences and barricades
surrounding our usual routines. We will remember that our
mutual interests will allow for exceptional achievement when
the situation demands it. In many ways it was revealed to us
that small tasks and simple gifts can be especially valuable
as outsiders bringing together estranged parties under stress
and Iowa city seemed almost natural. The result is a new
level of understanding and even love among them. The Santa
Rosa teens traveling by train at their own expense to wash
Iowa River mud off of mobile home skirts spoke volumes to the
people of Iowa. We realized that philanthropy is generosity
in many forms all of which needs to be delivered by cash,
check or money order. Your generosity provided concrete
blocks and mortar to raise a home and to purchase food, clean
supplies, clothing and paper products to help serve food and

beverages to volunteers in Iowa city. Your money rented porta
johns, paid for chemicals to clean mildew off of flood soak
basement walls, and to give a fund raising boost to a group
who works with at risk teens, a program site that was washed
away three times by rampaging flood waters. Your
contributions will help restore the Little League baseball
fields that sat under water for five months and to plant trees
in city park that became a lake for most of last year. Your
donations of canned and dry goods went into the kitchens of
families that did not see the inside of their rain saturated
homes for many weeks. Your telephone calls of support, here
and there, your prayers and your many gifts reflected such a
genuine concern that your mark will soon not be forgotten in
Iowa nor will it be forgotten here. Thank you Santa Rosa. To
that I say amen. And the final chapter is on behalf of
operation Payback and the citizens of the Greater Santa Rosa
area, I am pleased to forward the enclosed checks to the Iowa
City PIR Foundation. $1,000 is donated to the Foundation for
the Little League Baseball Complex. I wonder where they got
that idea. $3,000 is given to purchase trees and shrubbery for
the city Park which was also devastated by last year's
flooding. In addition, approximately $2500 will be sent
sometime in the next week to Iowa city Salvation Army
specifically for direct assistance to homeowners for flood
reclamation expenses which do not qualify for other forms of
financial support. Wi th these contributions, operation
Payback will, for practical purposes, no longer be in
operation. For legal and financial purposes, our records will
remain open for six months. Small ways in which we were able
to offer personal and financial support to the citizens of the
Iowa city area have had a very important impact on the
cooperati ve potential of the public , private and' church
sectors of Sonoma County. New relationships were established
and a greater levels of understanding were reached. Your
suffering and sacrifice contributed to our gain. May God
continue to bless both communities particular Robert W.

city and the Riverfront and Natural Areas Commission I hereby
present to you the 1994 Iowa River Month Special Recognition
Award.
Mumford! And it is with great pleasure that we recognize you for
your contribution and focusing attention to the Iowa River for
your tireless efforts in promoting and raising awareness of
the Iowa River Corridor Trail. The work of FIRST members
Casey cooke, Terry Dahmes, and Feather Lacey is to be
especially commended. Casey and Terry for their work
advocating construction of the trail and Feather for her work
coordinating the first bike and hike. Congratulations.

Casey Cooke! We know you have got a backed agenda and a full house
tonight so we will be brief. I wanted to return the favor to
the council and I also wanted to make it clear that this is a
great honor for us and we are very clear that we are accepting
this on behalf of the 325 members of the FIRST. Secondly, I
also want to thank the council for their work in putting
through the trail segment between Iowa Avenue and Burlington
Street and will be looking forward to a ribbon cutting. We
will keep you posted on that. Finally, I particularly want to
call your attention to the outside plan on that which is the
Willow Creek Plan. And if you are looking for ideas as to how
to spend your $180,000 in neighborhood trails fund that might
be one to take a hard look at. I also want to note for the
audience here and for the television audience that we are
planning the bike and hike this year September 25 and I look
forward to as many of you joining us as possible and finally
I want to make a pitch for new members to join us in these
efforts with FIRST and you can do that by writing to me at my
office at 1929 Keokuk, that is in Iowa City.

Riverfront and Natural Areas Commission I hereby present you

contributions and focusing attention to the Iowa River through
assistance and preparation of the Iowa River Corridor Study
Update Trails. The graphic elements of the study update,
prepared by Fred, have increased the awareness of and created
a greater understanding of the concept of the Iowa River
Corridor Trails. Thank you.

and Natural Areas Commission I hereby present you with 1994
Iowa River Month Special recognition Award.
Mumford/ We are especially thrilled about Bill's contribution in
focusing attention to the Iowa River through preparation of a
trial of two cities. This slide show and video that Bill
prepared giving proponents of the Iowa River Corridor Trail a
valuable tool to foster public support for the trail.
Horow/ I would like to invite Emily Rubright, co-chair of project
Green to join Karen Mumford and me to present the cash awards
to the top three winners of the 1994 Iowa River Photo Contest.

Each year for the past eight years the Riverfront Commission
invites submission of photographs which capture the natural
beauty and recreation value of the Iowa River in Johnson
county. Nancy Sieberling, I appreciate you standing in for
Emily.

cash award which is donated by Project Green is Steven Miller
of Iowa City. Is Steven here tonight.

have the winners from this year's photos contest on display.
The photos are on display in the public library and will be
through the month of June and then they will be in the civic
Center through the month of July. We encourage everyone to go
down and look at the terrific photos that community members
produced. Very quickly, on behalf of the Riverfront and'
Natural Areas commission, I want to thank the people who did
participate in the photo contest. It was very e~citing to see
the different types of photos of the Iowa River. I want to

KUbby/ So is traffic going to stop. They do that in some country.
It is a really interesting way to-
Horow/ We haven't received notice about that. But I do hope that
everybody does sort of pause on that time and think about the
flag. Having lived overseas and gone to ceremonies at the
ambassador's compound, I can assure you it is a very emotional
moment when you see your flag on foreign soil. You really
learn to appreciate it.
I am taking the mayor's prerogative of also mentioning
something else. I recently had the honor of representing city
council at the Memorial Day services at Oakland Cemetery last
Monday. And during the course of my speech there I reflected
on those members of Iowa city, Iowa city citizens, who are not
there because they were in France celebrating the memory of 0-
Day. And I said so many of our brave young people made the
ultimate sacrifice as the invasion of Nazi occupied Europe
began and on this 50th anniversary year of D-Day we pay
special tribute to those who lie beneath the rows of white
crosses and Stars of David in France. Some youngsters or
recent citizens might question what the day is all about. But
by gathering here we have dignified, legitimatized the time
honored tradition of remembering our dead and their part in
history. And I just wanted to let everyone know that I really
appreciate taking part in these ceremonies. They do mean a
great deal to me and to the rest of the citizens. Thank you.
Pigott/ Sue, could I just add a word to that. You know because it
is 50 years ago yesterday that my dad was one of the hundreds
of thousands of people that were involved in the D-Day
invasion. He and his friends stepped off of a boat into the
cold and choppy waters near the Normandy beaches and he saw
many of his friends die on those beaches and I think that they
indeed sacrificed to insure our freedom and today, election
day, we celebrate that freedom by casting a ballot for
Governor, U.S. House of Representatives, and various local
offices that are up for election today. I just wanted to take
a moment to thank those that we all know who served and the
families of those 9,000 people who died who were not as lucky
as my father to make it through that day and never got to hear
a thank you from their sons, their daughters, their brothers,
their sisters, mothers or fathers. And all for that selfless
sacrifice, we enjoy the right to again to continue the freedom
to vote. So I just wanted to say thank you, dad, and thank you
to all those who served.

Horow/ (#5) Public Discussion. I would like to preface this time
right now by telling you that #21 on the agenda I will be
asking council to defer that. This has to do with naming Aber
Drive West or West Aber Drive. The neighbors in that area
have asked for a week to consider a totally new name change in
that area and so I just want to let you know that this is an
issue that is really sort of moot at this point. Also #x on
the agenda, that having to do with Foster Road. Council last
evening in discussing this adopted the recommendations from
P/Z Commission regarding the recommendation of Foster Road,
not making a decision about whether or not to put Foster Road
through. So we have asked the staff to involve the property
owner in terms of working out those issues that assault the
environment, those issues that deal with street patterns,
zoning, open space and drainage. So if any of you are here to
discuss this, please know that this is where it is at right
now. We have asked staff to come back to us and we have heard
your concerns about these issues and if you wish to address
them this evening you certainly may. But I wanted you to know
where we were.

Kubby/ Sue, could I make one clarification on that. And one of the
things that we discussed last night was that the only way
really to have any control over some of those issues about
steepness of slopes and preserving trees and open space and
trails through that area was by talking about putting the road
through. By saying if we put the road through it is the only
way we will allow you to develop and the only way we will put
the road through is if some of these issues are taken into
account. And we haven't finalized what that list of issues
are or how to negotiate that. But it is the only way to have
some negotiating power with the developer. At least that we
talked about last night.
Horow/ And it starts it off. It starts the process off. Also #26,
having to do with parking fees, we have chosen to defer this
matter pending having a full council. We also talked about
alternate including charging for a half hour at 30 cents or a
whole hour at 55 cents. We seemed to wish to have staff
pursue that arrangement. Still to be discussed is an alternate
mechanism for diverting parking from Old capital Mall to
Dubuque Street. In other words we still have to figure that
one out. We wish that citizens will realize that the bus
system is heavily subsidized from property taxes right now and
some of the money that would be generated from such an action
as parking fees being raised would be going into the Transit
system as a whole. You know that recently we combined the
Transit and Parking Departments and so we are looking at this
as a whole Transportation System. So, if you wish to address

in d.t. And I have got another handout for you I would like
to deliver this.

okay. All right. Okay. I am just going to go over these
viewpoints. Again, I am representing the DTA and our Board of
Directors and we have all talked this over and these are our
thoughts. I will just go through them quickly and I know some
other people would like to talk about this issue to you, too.

An example I understand there are some disability things that
have come through that are expensive but I really think they
need to be looked at as an expense situation. For example, on
the bus system in 1984 as a percentage of total property taxes
collected, between the different agencies of Transit, Library,
Police and Fire-from '84 to '94 a percentage of all of our
property taxes that went to these areas, Fire has increased,
what we spend on the Fire Department has increased one half
percent from where it was. It was 15%, 15.3 and now it is
15.9%. Taxes for the Police Department have increased 2.5%,
from 26% to 29%, roughly a little less than 3%. Library has

increased slightly, 3%. The percentage of our property taxes
to Transit has more than doubled. It has gone from 6% of
property taxes to almost or over 13%. So I really think it
needs to be looked at and I think that is one of the
alternatives that you can do without raising parking ramp
fees. I think, it is bad political words, but I think it is
a tax and spend philosophy. I think you keep raising parking
rates to make up for other areas that the expenses are going
crazy on and I am pro bus system and I am pro SEATS. Yet I
think something has got to be done. It looks like the figures
here that expenses are out of control. Again from those ten
years, the bus budget in 1984 was $1.8 million and the fees
collected from ridership was $785,000. For FY94, ten years
later, the budget is $2.8 million. It has gone up $1 million
and the fees collected from ridership is $630,000. It has
gone down $155,000. I think no matter how much you raise
parking ramp rates and it has been done the last 9-10 years
without raising the bus rates. People are still driving their
cars. You are not going to change that lifestyle. The only
thing you may change by raising the ramp rates is it just
makes those people drive elsewhere to shop. We talked to a
few councilors and they said to us to come up with
alternatives. We came up with one. We don't really like it
but we think it is a good fair alternative and we could save
maybe $20,000-25,000 a year and that is start enforcing
parking meters in the morning in d.t. at 8 AM instead of 9 AM.
That is still common business hours. You are enforcing the
ramps rates at that time and I am not sure on the dollars but
I bet it would be anywhere between $15,000-25,000. So I think
from our view point we don't think it is fair to raise the
ramp rates again and not at this time and we think there are
other'alternatives on the expense side of the issue and also
on maybe some of these other alternatives with meters. And we
would like you to vote no on this and consider the other
alternatives for now.
Horow/ I have a question. Has the DTA made any major effort to
increase the Park and Shop ticket reimbursement program.
Especially those stores in Old Capital Mall that are not now
taking part in it.
Murphy/ We have talked about that and we want more people to take
part of it. We haven't done anything lately. We always push
it whenever we get a new member. We feel it is a real
important thing and we-
Horow/ suggestions that were made to me. I was in the mall today
and I purchased $20 worth of books and I almost tore up the
check. I went through with it but I really considered tearing
up the check and telling them why I wasn't going to buy and

the comment Ivas made that they had suggested to the mall
ownership at the mall stamp the tickets rather than the
individual store owners and I wondered how aggressive the DTA
feel they could even get towards increasing this program.
Murphy/ We have 82 participants now and it is something that when
they join the DTA it is an option. It is a big expense for a
lot of these stores. And it is like a promotional expense to
me. I think it is a great thing but it is not something that
you can just walk in and say you need to spend $1000 on Park
and Shop if you want to be in the DTA. So it is an expense.
I don't see it happening-I think it is unique and I think you
should praise the DTA. We think it is good and we think it
helps business, too. But I think you should at least praise
us for at least having it. How many towns that have meters
say oh here, we are going to pay for your parking. But I think
the perception may be that everybody thinks that every
merchant is involved and maybe that is a misperception. But
it is an option of the retailer and it is not something we can
mandate.
Nov/ I realize that you cannot mandate this but I also run into
retailers who will say okay to stamping your parking meter
ticket, rather your parking ramp ticket, but they do not offer
you the bus ticket. So they are selective about this and I
hope when you encourage people to participate you will
encourage them to participate in the bus system also.
Murphy/ I will make a point of that. I think we are getting away
from the issue here. Any other questions.

we are members of the DTA and have been for 17 years. I would
like to also address the proposal to increase parking rates.
As part of the DTA I definitely share John's views that the
board is expressing. I would like to add a couple of things.
First of all I would like to reiterate the DTA is very pro
Transit system and very pro SEATS and in these figures that

John gave we certainly don't want the perception to be that we
think the Transit system should be disbanded or in anyway
affected. However, one of the things about parking d.t., as
you all know, there is a perceptual problem which we as
members of the DTA are constantly addressing and to that end
encouraging very strongly our members to participate in the
Park and Shop and Bus and Shop programs. And actually at one
of our last meetings it is something that we are addressing
with Old Capital Center. They are a mall entity \~ithin
themselves and they do function separately from the DTA and so
a separate issue as John said. Secondly, I think it is
important to note that d.t. businesses are extremely active in
supporting many many projects. Supporting the arts, the Iowa
Arts Festival. Literally the DTA is funding the Friday Night
Concert Series which, as you know, is a 17 week free live
music program every Friday night throughout the entire spring
and summer in d.t. And the reason that we do all of these
things and this is money that d.t. businesses are writing out
checks to support. The reason that we are able to do that to
the extent that we do it is because we are able to make money
at our businesses. If we are not able to make money or the
less money we are able to make then we can't write checks to
the Iowa Arts Festival and we can't write checks to United Way
and we can't write checks to Friday Night Concert Series. And
I think it is an important point because sometimes there is
this feeling that d.t. businesses should be paying for
everything in the city. And boy, we are paying for a lot. And
we want to and we want to be able to do that. But we have
this problem with parking and it is a problem. You hear
customers, and Sue is one of them, tonight complaint about
parking situations in various forms. We are addressing from
our end as aggressively as we possibly can. I think we do
need the support of council and we need to feel that you are
pro business because without businesses there is no tax base.
Literally this is the bottom line here. People can't buy
homes, they can't do anything, buy groceries. So to ask the
people who shop d. t. and work d. t. to subsidize or pay
increases in a county wide program seems to us to be a little
bit of a odd approach to solving the problem. We certainly
want to contribute. We certainly want to help contribute to
solving this problem but the way it looks in the presentation
when we talk about needing money to make up a deficit or help
attack an increase in a county wide program by raising parking
rates d.t. I think you can probably understand my point here.

when the best time to ask this question would be and it would
apply to anyone speaking on this issue. Both you and John

mean that you and many other people think there is ample
parking in the d.t. area but there is a problem in terms of
what people think is available. And that is in part, I
suppose, related to the lack of large open free lots like one
might find out at Sycamore Mall or some other such places. So
I am curious about what you think we could do to alter the
negative perception.
Gilpin/ I am really glad to you asked that question because I
actually-not that I feel that there is plenty of parking in
d. t. Iowa city. There is plenty of parking in d. t. Iowa city.
We have parking structures that are rarely full and at least
one or two of them are really easy to get in or out of at any
time of the day or night. So, the problem is with perception
and the DTA supports this also and has looked at certain
campaigns for improving the perception via education by saying
there are this many stores that will pay for your parking if
you shop in their businesses despite the confusion of some
that don't. You asked a second part of that.
Throg/ If the city chose to spend some money to help alter those
perceptions through advertising and other means, would that be
a good thing.
Gilpin/ I think it would be and one point that you brought up is
that we have a lot of small towns in Iowa where you can pull
your car up in front of any business and park for free and
walk a few steps into the door and come back out to your car.
And so-as we all know, a lot of our population comes to Iowa
city for the University and they maybe small towns and they
also may be from large towns where you have to pay $5.00 an
hour. A ramp that you have to walk six blocks and this is
convenient. So, yeah, I think it is an educational thing. You
can park in a ramp d.t. and literally the farthest you are
going to walk to a d.t. business is six blocks. That is the
farthest. You actually can walk a half a block or a block to
most of the businesses in d.t. So, when you think of it like
that and very often have your parking paid for by somebody
else. You park all day long, you don't have to plug meters,
there really isn't a problem. It is a bit of a mentality. I
am fond of saying that if you could park your car in d.t. Iowa
city in front of my business and walk in for free probably my
business wouldn't be there. There wouldn't be anything going
on d.t. if this were the case.

the time at the store and we try to explain to people well, if
it weren't an hour turnover program it would be a parking lot
d.t. You would never be able to get a meter ever. So, it is
a matter of sort of letting people know \qe have a really
really vibrant d.t. area. And it is full of people. And the
reason that we have a perceptual problem with parking, I feel,
is because of that. So if we let people know that we have a
great d.t. and it is really busy and there are a lot of people
coming d.t. and that is the reason we have to park in the
ramps. Then this is the good news. This is not the bad news.
And on Friday nights, during the Friday night concert series,
when there is 3,000 people down there which there probably
will be this Friday night. You see these people parking their
cars in ramps and unloading strollers and children and seniors
and I think this is very very good news. The DTA is working
pretty hard to maintain the vitality of d.t and we would like
your help.

probably as part of our considerations were thinking about
charging half an hour, 30 cents for a half an hour in some of

perhaps some turnover in the parking lot. Perhaps addressing
some of the perception. I just wanted to get your input about
that other idea in connection with that as well. How you felt

this particular issue with board members. But I think it is
a very good idea, you know. I think that helps people feel
that they can park a short time and run in and run out. And I
can only hope that all the stamps that I do at my business

like to say that you know I think the Park and Shop and Bus
and Shop programs are great. We ask every single customer if
they would lilte a bus pass or if they have parked in the ramp
and take that opportunity to explain the program to them when
they say what is that or no. Although I must say that a lot of
people say gee I am so glad you asked. So many people don't
ask and I get back to my car and I have forgotten and I don't
use the program because of that. So Preferred Stock has taken

it. It is part of our advertising budget. We spend $200-300
a month on Park and Shop and Bus and Shop. I would also like
to say I was talking to Karen Kubby about this not too long
ago that over the years when you look at our monthly billing
statement and you see the ratio of bus users that we are
gi ving out bus passes to parking, it has grown a lot and
although ridership may have gone down the user fees on our
bill use to be about one third bus and two thirds parking and
very often it is about half and half now. And a lot of people
are really really happy that you have as]ced them for a bus
ticket. So I support the half hour. Absolutely that is a good
idea.
Horow/ I am going to have to ask that further speakers keep adding
stuff. Let's try not to duplicate what has already been said.

Preferred Stock. And I actually had the opportunity to speak
to a number of you on the phone and most of you know my long
version and therefore I will condense it to just a couple
quick notes. One thing I would like to say is that one way to
not combat-I probably don't even need this. One way-we do have
a perceptual problem and to increase the parking is not going
to help it. Let me just tell you that. It is going to make it
worse.So I would appreciate consideration. I know talking
a=with you Sue that you have said can you come up with some
creative solutions and unfortul1ately I do feel like I am a
creative person and I personally have not come up with any
creative solution. That is your job. But I would like to say
it needs to be equitable and I don't feel that it is equitable
by raising the rates in the d.t. parking ramps. I will say
that. I would hope that most people would agree with me. I
do feel like it is a good'program and if we need to make up
some money somewhere we all need to share the cost and I
really strongly feel that by raising the rates in the parking
ramp is not the fair or the right way to do it. And I don't
feel like you should do it just because you can. Granted we
all know there are people who are going to come down to town
no matter what. If they have to pay a dollar to park in the
ramp, there will be some people who will come down. But I
guarantee you it won't be a lot of my customers. I mean I
stand at my counter everyday and I hear people complain and we
try to do what we can by offering the Park and Shop and Bus
and Shop, carry their packages to their car, whatever we need
to, call a taxi, whatever it might be. But we do still have a
large amount of customers who complain and are concerned about
having to pay the fees here in d.t. Iowa city and I do feel
that we are paying a fair share of this already by choosing to
have our location d.t. and by paying taxes, by funding concert

before we knew the amount that the increase in SEATS was going
to be so dramatic. Isn't that right. This was something we
were talking about before the SEATS deficit was looking at us.
Nov/ And we also talked about the fact that we needed to start
putting some money away for ramp south of Burlington.
John Gross/ Mr. Throg. for your information, I serve on the Transit
Committee with the DTA. I am working very closely with Joe
Fowler. Over the past 5-7 years we have offered many
incentives to try and break the perception of parking ramps
that many people have. We have had free days, cooperative
ads, we collect a fee from each participant and spend that on
Park and Shop and Bus and Shop promotion. In my opinion the
only way to break the perception or the negative of parking in
the parking ramps is to wait for the old guys to die. It is
pretty ingrained. I have neighbors who won't come d.t. Who
won't come d.t. because they don't want to park in parking
ramps. We have to wait awhile. I think another generation to
solve that. My point is that over the past five years we have
seen a significant decrease in business in our store d.t. As
a result we have had to right size our firm, we let about five
people go over the past two years. These are people who pay
rent, who buy groceries, who pay taxes, who get their cars
fixed, who buy pots, who buy suitcases. Five good citizens of
Iowa City aren't employed d.t. anymore. I am on the process
of expanding our store in Coralville by 50%. We see more
business growth in Coralville than we do here. I don't
anticipate hopefully making any other changes d.t. If it
continues to decrease as it has been there isn't the volume of
business d. t. The 20 people we have employed d. t. we may have
to move elsewhere. I am wondering if the councilors are aware
of what an acre of good commercial property pays in taxes.
And then compare that in your mind to what an acre of
residential property pays in taxes. I think you will find
that there is significantly greater difference and I feel that
because of that the d.t. with its substantially higher tax
rate, not tax rates but tax dollars, deserves your attention

as care takers of the budget in the city of Iowa city. I feel
that we deserve your attention. That you need to recognize
that you represent the entire cHy and that it is important
that you give attention to this major tax base for the cit of
Iowa City that provides funds for all of you. I was very
disappointed last month when you refused to support a major
expansion, a major project in d.t. Iowa city which would have
brought jobs, which would have brought shoppers d. t. and would
have brought big tax dollars d.t. You refuse to support the
health and growth of d.t. Iowa city. Now you are looking at
raising the parking rates and trying to milk d.t. a little bit
more. But just last month you refused to feed us. It doesn't
seem to make sense to me. I feel that any councilor with the
interest of the entire community will not raise taxes for the
d.t. parking. Thank you.

Kubby/ I think I want to make a clarification about something what
John said. I want to make a clarification on something John
said that we did not support a certain financial incentive
that a developer may have chosen to use and that developer
could have chosen to do that development with or without that
particular kind of financial incentive. We did not say we did
not support any particular development.
Darrel courtney/First time I have been up here without having
introductions. 1 Princeton Court. Also ad. t. business
person. I think as all of you were elected and as well as the
two terms I spent you all come in having visions of certain
things and seeing things in the future and hopefully you do
look into the future by more than one FY or two FYs and we had
a group of five people that sat up there in the early and mid
70's that had a vision and it was a vision of a regional
shopping center d.t. It was to compete with Wardway. It was
to compete with Sycamore, with the new malls that were going
up in Cedar Rapids and it was called Urban Renewal. And they
envisioned this to be a regional retail shopping center. I
would suggest that that vision has come and gone. The
retailers are leaving d.t. If you can just vision in your
minds as I read these off what these store fronts look like:
Jacksons, A.J. August, Josepheson's, Rocky Roccoco, Reliable
Drug, Motts Drug, Concord Cleaners, stephens, Legions, Dill
Burger, Taco Johns. These have all closed within the last
year and year and a half. Some within the last two or three
weeks. D. t. is becoming like many big cities. Like the
Minneapolis of the world if you visit d.t. Minneapolis. It is
becoming service oriented. We have got the home offices of the
banks, lawyers, brokers, accountants, property management

people. It is all service oriented. Now those service people
will support some retail trade but they won't support the
retail trade that was envisioned by those five people when
they decided to do the Urban Renewal. That was $70-75 million
worth both private and public money that was put into the d.t.
I think what you need to ask yourself next week is what is
your vision for the future of d. t. will you continue to price
them out of the market by raising the parking fees once again.
Or will you find other ways to fund your Transit system and
your budget. Thank you. I have a baseball game to get to. I
didn't want to wait until the end.
Throg/ That is a terrific challenge, Darrel. I would like to make
a very quick response. I would completely agree that it is a
wonderful place to shop and do retail trade and so on. And I
know that you would agree with this. That is not all that the
d.t. is. It is also a vital place for interaction among
people who live and work in the whole area.
Denney Visser/ 113 Post Road and I also manage a business in d.t.
Iowa City which is just a block away at 328 E. Washington
street. I am a manager of Northwestern Mutual Life. And I
have enjoyed living in Iowa city for the last 27 years. Two
years as a student and the last 23 years as a business person.
And Iowa city is a great place for many reasons such as parks
and its schools just to name a few. Ten years ago as Darrel
mentions there was a whole revitalization that was happening
to Iowa city and I chose to be a part of that and city council
was very supportive of that measure. In the process there
were things such as industrial revenue bonds made available
and that with the private sector were able to remodel a
building in d. t. Iowa city and this was a very posi ti ve
business environment at that particular time and I chose,
along with other people, to seize some of that vision that was
taking place in d.t. Iowa City. I would like to register a
strong protest to the current idea of increasing the parking
fees that are seeming to escalate. I think there is a problem
that you are attempting to address and I would suggest that
along with John earlier that one of the solutions that I would
suggest is increasing the tax base that is in the d.t. area of
Iowa City. We took an old building which was the Knights of
Columbus Building which was just a deteriorating phase and was
probably contributing about $1000-2000 a year of property
taxes. And due to the improvements this is juts about a 5000
sq. ft. area. Now it generates about $14,000 of annual taxes
to the city of Iowa city which I would submit helps to do a
lot of the services that are taking pace and to add a nickel
here and a nickel there is I think penney wise and pound
foolish for some of the good things that Iowa city does in its
d.t. area. And I would encourage you to take a much more

longer term view and promote some of this high intensity tax
base that is possible within the Iowa city area. I represent
a number of people that work in my office who are
administrative staff as well as associates who do have to pay
the costs for parking to work d.t. and just that continuous
increase is one of the problems of hiring good quality people
because many of these people do commute from rural areas and
they do have to park. They don It even have access to SEATS or
to the city bus system. SO a large amount of Iowa city's
population is not just accessible by these particular
services. I submit to you that doing a parking increase such
as you are proposing, I know there is some innovation involved
with it is short sighted. I encourage you to take a much
longer term view and raise the tax base of Iowa city. Iowa
city is a great place to live and work and I would like to
continue to have to see that continue and I don't think
increasing the parking rates would help that. Thank you very

Lelia Helms/ I am here to speak on behalf of the Penney Bryn
Neighborhood Association, the willow Creek neighborhood area
that is. I last spoke to you on April 26, made a presentation
about our concerns which deal with the impending Teg/Aber
connection which is part of your consent calendar tonight. At
least the dedication of the street, the opening-the formal
opening of the street. This is a connection which runs
parallel to the park more or less the length of Willow Creek
Park from Benton street to Sunset and Highway 1. Reacting to
my presentation we received from the city manager a response
to our concerns enunciated. I hope you all have a copy of
that. Tonight I would like to speak about our further concerns
which the city manager has provoked in terms of discussion
among the association. We feel that the memo side stepped our
concerns. However the memo did in fact confirm the existence
of a speeding and safety issue in this area. We are
requesting the council to put on their agenda our concerns
formally about safety and speeding raised by the opening of
the street connection. The city manager's memo indicates that
there are these problems. Specifically we are requesting that
the council consider adopting one of the following options
and you will see them listed there. Installation of stop signs
on Teg preferably at Hafor Drive or lowering of the speed
limit to 15 mph or installation of breakaway barriers. Let me
discuss each one of these options in order. The first one to
deal with stop signs. We requested in our initial
presentation the presence of stop signs to be added. The

purpose of this was to break the speed, the pattern of
speeding as people begin to pick up speed through the straight
away in this area. There is a semi blind corner and that is
exactly where most cars pick up speed. In the memo the reply
indicated the reluctance to employ this method of slowing
traffic. That it had limited effectiveness and it increased
the city's exposure to liability. We would request that the
council consider this matter in that the city has used this
method of breaking speed for these purposes in at least two
areas which we could name off the top of our heads. Lexington
Avenue and Koser , although that may be University Heights.
Secondly, in terms of the liability concerns, if the city has
knowledge and evidence of a significant speeding problem
before hand as it does in this case and does nothing there may
be liability also for non-action. And that is a second
consideration to raise. Secondly we would ask as a second
option to lower the speed limit to 15 mph. The city manager's
response did not go into the specifics of this request.
specifically I am citing two code sections, Iowa City Code
23.188b.5 and 23.188c. B.5 provides for a 15 mph speed limit
in the park. Now state law and other provisions in the city
code do say 15 mph within a park. But this specific provision
states in a park. Teg may be viewed as in a park. It certainly
parallels a whole length of willow Creek Park. That is all the
parking activity takes place for access to the park. If you
employ the language of the statutory construction as set forth
in the preface of the Iowa city Code, in fact I think you
could reasonable argue that this would be a 15 mph speed in a
park. Alternatively, provision C. empowers the council upon
a finding by the city engineer of a danger Le. excessive
speeding to set its own speed limits. This is a general
enabling provision which allows city council discretion to act
over and above a specific state requirements. We think you
have the option to act regardless. Third, is the option of
break away barriers. We might ask as a third option to
install break away barriers to stop through traffic from using
the connection and yet to allow for emergency traffic through
in case of need. This option was not presented to council the
last time we spoke because in our neighborhood meeting with
Mayor Horow and Jeff Davidson they indicated that this is not
an option which had ever been used. In fact that we have
learned that it has been authorized for California Street in
the same or parallel circumstance. So that for exactly almost
the same reasons we would feel that this might be something
that you would consider as a third possible alternative for
dealing with the problem. Finally, to respond to the larger
considerations raised by the memo. The city manager's
response to the convenience that the Teg/Aber connection
provides for the new development which has gone in on one end
of Teg. In particular, for convenience for Parkwest residence

was emphasized. In response we would ask you to consider two
things. First of all, we are the primary beneficiaries of
this connection. We in the neighborhood. The Penney Bryn
Neighborhood Association is an association of roughly 125
families who have been there for long years. Not necessarily
25 new residents. We feel strongly that the safety issues
which are raised up by speeding and traffic outweigh any
argument for convenience. This is a product of our long term
experience and after all we are the people who are going to
pay the primary price in terms of having to go more slowly
and/or use alternative routes, whatever the option of the
decision is. We value the common good rather than the
convenience and recommend to the city council that they take
that particular perspective on this problem. Finally in terms
of the existing situation. The traffic is getting worse. The
road has opened it. We have Faraway, Cubs and Mennards which
are all opening soon within the foreseeable future.
Commercial vehicle traffic will increase. The Teg/Aber
connection offers the only direct connection between Melrose
and Highway 1 which provides stoplight access to Highway 1.
That is the most convenient access. In addition there is no
school zone to slow anybody down on the interim routes.
Speeds we suspect are already increasing although there has
not been another study and I realize that more would need to
be done. We are simply asking tonight that you put this issue
on the agenda and consider some various options for dealing
with what we all agree has been a documented problem of
speeding and potential safety concerns here. Thank you.

excessive speed on Teg documented by the city's data showing
about 3/4S of all cars exceed the speed limit by more than 5
mph. About half of all cars exceed the speed limit by about
20 mph. Third, the efforts to reduce these speeds by
increasing police patrol alone has not be effective. Resident
report that the number of speeders appears to be increasing
and not decreasing. Fourth, the traffic on Teg will be
dramatically worse if abatement procedures are not taken.
Connecting Teg with Aber creating a "shortcut" between Mormon
Trek and Benton intersection to Highway 1 and Sunset
intersection will first increase the number of vehicles
passing through this neighborhood and two, change the type of
traffic in ways that will make it still more dangerous. This
will be in effect a cut through between those two
intersections of Mormon Trek/ Benton and Highway 1/sunset for
individuals who are too impatient to take the longer route.
And those drivers will be from outside the neighborhood and
therefore presumably much less aware of the risks in the
neighborhood. So, I would like to urge council to take the
needed action to correct the existing problem of excessive
speeds on Teg and prevent further erosion of the safety of our
children and others in the neighborhood. The action I would
like to suggest is to reduce the speed limit on Teg to 15 mph
and then to enforce that. And the rationale is as a practical
matter, Teg which runs along the eastern margin of willow
Creek Park is in fact part of that park. willow Creek is one
of the larger parks in the city system and is certainly one of
the more heavily used. It is perhaps the only park among the
larger and heavily used ones which has no off street parking.
In effect, Teg serves as that parking area for the park. As
a practical matter then Teg is part of and within willow Creek
Park and is fair and proper to set the speed limit to 15 mph.
I ask you not to wait for another fatality, act now to protect
our children from this established-

Ruth/ The photographs taken last Sunday (can't hear). I am here
tonight to urge the city council to consider very carefully
the proposed extension of Foster Road and the expansion of
Bruce Glasgow's Plum Grove Acres. The area of land in
question, almost entirely owned by Mr. Glasgow, is part of I
believe of a much larger system. This land is an integral
part of a large habitat corridor which connects the river and
the land adjacent to it. Although I am no scientist, I am a
person who grew up roaming these ravines. It is my fear that
to allo~l the construction of this road and the subsequent
development would irreparably damage the integrity,
biologically and geologically of this land. The city has
already acknowledged this tract of land is environmentally
sensitive area. It has been labeled highly erodible. I am
here tonight to reassert these facts. But I am also here to
remind the council of creatures that inhabit this land who
cannot speak before us. There are innumerable species of
plants and animals here. On the days that I have walked I saw
no less than 10 different wild flowers, flocks and daises,
spring lilies, blackeyed susan and clover. There are great
bushes and ground swells of wild roses, bumble bees and
butterflies. The canopy of trees is home to a veritable
symphony of birds. The trees themselves, some are oaks, over
inches in diameter. There is a stand of aspens I am sure many
of you have already heard about. Indeed this land is some of
the last of its kind in the area. To level it for a road and
subdi vision would be a travesty. I urge the council to
carefully consider this proposal's long term impacts. This
council has the power to impact the health and stability of
crucial habitat corridor and an integral part of the areas
water shed. It is my hope that the council will choose to
apply a strengthen version of the erosion control ordinance
and the woodlands conservation plan to any decision made. At

the very least Bruce Glasgow should be directed to follow the
most stringent environmental restrictions available. At the
very best, this land will be preserved for all species for
generations to come. I also have photographs of (can't hear)"
Horow/ Thank you very much. I would remind people that we are, last
evening we discussed accepting the recommendations of P /z
Commission about this parcel. However within the context of
working with the property owner regarding those issues about
the environment, the street pattern, the zoning, the open
space and the drainage and the only way this can take place is
for us to consider a road. We have to consider something in
order to work with the property owner. We have accepted the
recommendation, not necessarily putting the road through at
this point.
Baker/ Sue, can I respond to that because I didn't say much last
night. I don't necessarily accept that rationale that that is
the only way we can achieve the other goals that we have. I
was interested in Laura's presentation. I use to live in that
area. And I use to look at those ravines, trees, that wooded
area every day. And I am not convinced that a collector road
is indeed the only way we can control the development that
occurs there and that is what I am going to be looking at. I
am not convinced that even P/Z unanimously agrees that a
collector road is the only way to control it. So I don't want
to mislead the public into thinking it is a foregone
conclusion that it will happen. I, for one, am going to look
for a way to avoid those other problems without having a
collector road established through.
Horow/ But you do have to start with something. I would prefer to
take public input right now.
Kent Williams/ 1441 Oaklawn. My property and the property of the
neighbors on west side of that street directly abuts some of
the land Mr. Glasgow is proposing to develop. Hence, my
interest. You have gotten a letter from me at home addressed
to all of you. So I am not going to reiterate some of that-any
of that information. Making some calls, I believe I have some
new points to raise. I will just go through those very
carefully. One of the phone calls we made initially came up
with the council people. The issue came up that the city wants
to proceed carefully so as to avoid the potential for
litigation with the developers and I know that the potential
is there. As I understand the law if a developer comes up
with a correctly zoned and technically correct subdivision the
city has to show some pretty extraordinary reasons why they
shouldn ' t be allowed to develop. I understand that. I
certainly think that in this case there are some of those

issues are there that could preclude him having a free hand.
But I did consult with my lawyer and asked him about the
history of litigation in that area in Iowa city and his
conclusions or statement was that litigation is actually
fairly rare. He.remembered some cases in the 70s that the city
lost but he didn't give me details. I don't know how long the
insti tutional memory is on the council but that-The most
recent suit was filed by dean Oakes when he disagreed with the
city's rulings on one of his subdivisions having to do with
access and he wanted to build a subdivision with one access
and the city wanted to require more than that. I don't know
of the court dates of this one. I could look it up if the
council is interested. And he lost that case and took it to
the Iowa Supreme Court and lost. So I think the council should
consider that as long as the cpuncil does everything right in
terms of considering the law and have the city to consult on
these issues that a possibility of litigation shouldn't be an
issue. Of course we don't want to get into legal battles
either. I don't think Mr. Glasgow- Second issue, traffic and
access. There is a problem that council may be aware of but
I haven't seen it in any of the public discussion with the
connection to prairie du Chien Road. The proposed street,
Foster Road, is a collector street which is a technical term
for people who don't follow this stuff, I am just learning
about it, means that it takes the lowest classification for a
street is locals streets and they feed into collectors and
collector streets into arterials. And the city has
engineering requirements to developments on all of those
different kinds of streets. The current requirement is that a
collector street be at least 31 feet wide. Furthermore
collectors are suppose to feed to the arterials or other
collectors and to take traffic from local streets to
collectors or other arterials. prairie du Chien presently is
24 foot wide between Dodge Street and Virgina r. o. w. There is
no street 0 the Virginia r.o.w. there. It is roughly parallel
with the end of Oaklawn Street. Then 28 feet out past the
city limits. That means that the prairie du Chien is
substandard and cannot be considered at this point as an
arterial or a collector street and os there would be a problem
with being up to the city's engineering standards by
connecting Foster Road directly to prairie du Chine since
Prairie du Chine isn't up to standards as a collector.
prairie du Chien, the r.o.w. is 66 feet which means that the
city could conceivable widen prairie du Chine and that is an
expense which will not be born by Mr. Glasgow. The will be an
expense of the city entirely and I don't have to tell you it
will also be a political issue when you start taking front
yards away from people on prairie du Chien. So that is an
area of concern is that you are setting up yet another
situation in Iowa city where you have engineering standards

that streets are not up to. And a lot of those problems right
now are grandfathered in. The city should think a long time
before you create it on purpose. And there has been a lot of
talk about green space. In talking to my lawyer I guess there
is a case before the U. S. Supreme Court where they are
considering an issue of whether or not a city can actually
require a developer to donate his own land to parks. So that
is really an open issue. If Mr. Glasgow is going to donate any
land for greenspace or parks at this point the city can't
really require it. He is going to have to do it out of the
goodness of his heart. And I hope that happens. But I wanted
to bring up the parkland acquisition fund the city has. It is
controlled by the P/R Department. Speaking with a friend of
mine, Sue Scott, who is the part of the Longfellow
Neighborhood Association and apparently there is a
considerable sum of money in this account for parkland
acquisition that hasn't been spend and I don't know the exact
figure because I ran out of time trying to contact P/R but she
indicated that it was somewhere in excess of $.5 million and
none of that money had ever been spent in acquiring parks in
Iowa City. And if I am wrong I am sure someone will correct
me. I think it would be an excellent use of some of that money
to try and actually build a park in that neighborhood and it
would probably make Mr. Glasgow feel a little bit better about
setting aside some of that land-donating it to the city. Also
if the city is willing to pay for some of that land, they have
a better choice. They can choose what they want. So, thank
you very much.
Norval Tucker/1600 prairie du Chien Road. I am also speaking to
this subject. I would agree with the people who said it would
be nice to develop it. My comments are based on being in the
paper that one of the council members that is will be
developed. It is nice to here that the practice of just
drawing a line on a map and saying let's put a road here maybe
in the past. A few years ago when we move dot prairie du Chien
Road I checked the mileage for the three routes to drive from
our house to the corner of Church and Dubuque Street which was
a convenient corner for me. The most direct route to that
point was by way of Dodge Street and the most direct return
was by way of Governor Street. So if, and I think it is a big
if, residents of prairie du Chien Road are the ones who are
causing traffic problems on the other streets and not the
people who live over there I think the reason is the traffic
bottleneck at the corner of prairie cu Chine and Dodge Street.
If you want to help the traffic go towards d.t. you would do
it best by installing a traffic lights at the problem corner.
If you want a road from the proposed development area into
town and one from that area to Dubuque street, not necessarily
using B'Jaysville Lane, would be sufficient. The suggestions

that I am making now about development are primarily the
result of going on the Parade of Homes. Judging from this
public display of homes there is no apparent recognition of
local builders of the existence of low to moderate income
families in Iowa city or of energy saving devises such as
passive solar heating or that some homes should have
handicapped access. It would not be possible to retrofit a
single one of those homes for handicap access. I heard one
builder tell a friend that he was cutting down 25 trees that
day. Sort of the way you would say I am having chocolate and
raspberry torte for dessert. So I suggest that when you
consider this large area of development that a newspaper said
is 200 acres, you make a firm requirement that 1-the access
road and the general development maintain the environmental
integrity of the area. 2-That all of he houses be affordable
for low to moderate income families and at least some of the
houses be accessible by wheelchair. If you have the authority
to condemn existing rental homes for road construction as P/Z
says in their notes surely you can state firmly that Iowa
city's low and moderate income families have a right to live
in an area which is not been bulldozed into bareness. The
proposed development would be a good opportunity to be sure
that the overall and long term welfare of our citizens is
considered. Thank you.

KUbby/ Jeff, could you just shake your head from the back of the
room. At the time of the line on the map of the proposed
street, does not take away any housing at this point. Is that
correct. He is shaking his head yes. So there are no homes
that are currently built that would be taken away with the
proposed alignment. There is some trailer court land but not
on any lot where trailer courts are.
Caroline Dieterle/ I live on Walnut Street. I lived in Iowa city
for a long time and for a while I served in the county
Condemnation Commission and I have seen an awful lot of
property condemned and an awful lot of people suffer
supposedly for the public good including you know a lot of the
properties that were condemned for urban renewal as Darrel
Courtney mentioned earlier. The number of businesses that
were lost in the last year of d. t. Iowa city was nothing
compared to what went out of business from condemning
buildings for urban renewal. And if you all you know think
about the law for eminent domain you will remember that there
was quite a controversy about whether urban renewal was really
a fit subject for the law of eminent domain because it was a
taking of private property by a public body not to be kept in
the public trust but to be resold to private person again and

there was a lot of acrimonious fighting going on over that. I
also was active n the struggle to keep Burlington street from
being widened from Summit street to First Avenue. And at that
time the council was proposing to take so much of some
people's lots to do that that the lots would no longer be
buildable. And there was nothing in the plan to then
compensate them for the entire value of their home. I also
fought the idea of the Ralston Creek cheap solution of not
putting in new sewers and separating the storm water for the
sanitary sewers. But actually simply declaring that after a
certain number of years the value of all of the properties
along Rundell Street and some of the other streets near the
creek would simply be amortized which is the sanitized way of
saying the properties would no longer be worth anything. And
so the list goes. I guess that I would like finally to see
the council use the law of eminent domain truly for something
that I think it is a good cause. Namely to take some of the
public's money and buy nearly all or all of this property for
a large park because if you look at an overview of Iow~ cit
you will see that aside from Hickory Hill there is no other
large body of land that is like this that has this kind of
diversity, that has this kind of ecological sensitivity and if
you think about the fact that now we have had proof positive
that we are not going to be growing at the slow rate that we
were told that we would grow when we did the Iowa 2000 Plan.
That we got a much bigger population burgeoning. We have a
population problem allover the united states. We really have
exceeded the carrying capacities of the earth generally but we
are doing it here in the united States, too. And I think that
in the very near future we are not going to have to be trying
to convince people to come to Iowa. We are going to have to
worry about what we are going to do with them all when they
get here and you know one of the things that we are going to
be short on is going to be public property that is easily

And I think one last thing I would like to say about the photo
that you had. Didn't you say that the second set of photos
were taken just this past week. So, I don't know, any time
you that you look at you know a natural area being basically
raped that way I just can hardly stand it because it takes
years and years and years to build something back again. And
we just don't have that kind of time and we don't have that
kind of area anymore. And the pretty soon you know we are
going to be an urbanized area. We are going to look like the
area between Ann Arbor and Detroit and there isn't going to be
anything in between. There is no oasis. And it is the kind of
thing that if people get into large area where there is no
refuge like that I think it is part of the general picture

where people get stressed and they have no relief and no green
and it looks like something out of Brazil, the movie.

Horow/ Folks, I will have to ask you to keep your comments brief.
We have not even got out of public discussion yet. And we have
got 26 zoning items and quite a lot of resolutions.
Grace Trifaro/ I live at 902 N. Dodge street and I am here tonight
because, like Laura and Caroline, I would like to urge the
council to look and work very hard to prevent any kind of
construction of the Foster Road area. At the end of May I
sent the council a letter which I had written to Larry Wilson,
The director of the DNR, regarding a possible hunt at Kent
Park. The reason I sent this letter was-the reason I sent you
a copy was to provide you with a warning with what could
possibly happen in Iowa City if habitat such as the one near
Foster Road area is destroyed. I think that when we talk
about losing this area, not only do we talk about losing a
rich eco system but we talk about displacing a lot of animals.
There are a lot of deer that live in this area. There is less
and less habitat for the deer. At the same tie there is more
and more complaints about deer vehicle collisions on Dubuque
street for example. And complaints of deer damage. If this
area is lost for construction and development you are going to
here a lot more complaints and you will probably see me in a
couple of years protesting to defend the deer from possible
sharp shooting or bow hunting in Iowa city. So I urge the
council to look for alternatives and I also want to thank you
for trying to look for ways to solve this problem and please
think about the deer and the other wildlife that live in this
area. They don't have any place to go. There is less and less
habitat for that and I just wanted to thank you again for
working on this issue.

Bob McKray/ 1438 Oaklawn. I attended last night's informal council
meeting. I was very pleased and encouraged by the council and
the staff discussion on the Foster Road issue. I will try to
make this brief. I would still like to take this opportunity
to highlight major points that I have developed with numerous
members of the Shimek area neighborhood for the record
tonight. I would also like to thank you for the opportunity to
present my own and many of my neighbors interest in this area.
I believe all of you have probably received correspondence
from me. It was probably distributed Monday. However in that
correspondence I promised that a copy of our meeting announce

that attached. During the first half of May when this
development issue became known to the resident of Oaklawn
Avenue an informal neighborhood meeting was held to
disseminate information about the issue and to survey the
neighbors interests and concern over such land development.
A core group of approximately 20 neighbors attended the P/Z
meetings and May 16 & 19. Several designated spokespeople
addressed the commission to convey concerns which the
neighborhood group shared. I was one of those designated
spokespeople. The residents of the area have since held a
second informal neighborhood meeting which was announce with
the distribution of 200 of those notices. It was held at
Shimek School on June 1. It was attended by about 35
neighbors and it afforded a broader group of area residents
the opportunity to learn about the various facets oj; this
development issues and express their opinions concerning them.
In addition, the possibility of forming an officially
recognized neighborhood association was also addressed and the
formative stages of establishing a Shimek Area Neighborhood
Association are now ongoing with the city's designated
coordinator in the Office of Neighborhood Services. Numerous
issues were addressed. I will just try to highlight the main
issues. I have broken them down to four main categories.
Future neighborhood traffic flow; neighborhood open space,
greenways and Foster Road alignment; environmental issues and
Shimek School enrollment pressures. city P/Z staff report
that Foster Road between Dubuque Street and prairie du Chien
Road will have attributes of both a collector and arterial
transportation route. My own personal belief that as the
development proceeds to north of I-BO off of prairie du Chine
a future Foster Road cn be expected to carry increasing
commuter traffic from outside the surrounding neighborhood.
I believe that with time and future growth the proposed
collector nature of Foster Road may be transformed into an
arterial function. Neighbors have expressed, particularly
people who live on prairie du Chien, have expressed concern
over increased traffic on prairie du Chien, speeding on
prairie du Chien, and magnified bottleneck at the intersection
of prairie du Chine and Dodge. We are all aware of that.
Resident so subsidiary streets in the neighborhood, that is
st. Annes, Buresh and Oaklawn, are also very concerned that
future connections to Foster Road will facilitate increased
traffic flow on these residential streets as drivers seek
shortcuts to N. Dodge Street. I might add that this probably
reali ty was even expressed by Mr. Glasgow at the May 16
informal P/Z meeting. Although he characterized it as a
positive aspect the development. This is the view not shared
by any of the residents that I have thus far encountered.
Addi tionally the use of Foster Road as an access way to
prairie du Chien will in fact add to the already crowded

intersection. Second major category, neighborhood open space,
greenways and Foster Road alignment. The region bounded by
Kimball Avenue north to 1-80, Dubuque Street east to prairie
du Chien Road is within District J, Mayflower Shimek District,
of the Iowa city Neighborhood Open Space Plan. The plan
classified District J as a developing district because of the
large acreage of undeveloped land within it. A majority of
this undeveloped land is within an area that would be affected
by any eastward extension of Foster Road and the ensuing
associated subdivision development. The plan recognizes the
District J is deficient in neighborhood open space by
approximately 10 acres. The plan also emphasizes linking
neighborhood open spaces, community parks, the Iowa River
Corridor with trail systems which parallel water parcels and
drainages. Many of the residents of our area are aware of the
proposed greenway linkage of upland areas around prairie du
Chien, with the Iowa River Trail system as proposed in the
Iowa River Corridor Study Update which was presented and
approved by city council in November of 1993. It is our
contention that any consideration of an eastward extension of
Foster Road or Foster Road area subdivision must seriously
consider the placement of and negotiation for neighborhood
open space and greenway trail linkage with the Iowa River
Corridor. We hope that the council, P/z commission and staff
will display receptiveness to the neighborhood's needs for
open space as documented in the city's planning documents.
The alignment of any proposed Foster Road and acquisition of
r.o.w. for such road needs to be cognizant of the need for
open space and greenway trail link along the major east west
drainage through the area. On the letter that I sent you I
enclosed a small map with a potential greenway space shaded
for the area of concern. Funding for acquisition of greenway
and open space should also be an integral part of any costs
that the city might calculate for Foster Road development
within its CIP budget. Lastly here, environmental concerns.
The area of the proposed Foster Road and associated
subdivision built within a moderately wooded steeply ravined
portion of the city which has been identified as a sensitive
area according to several criteria documented in the city's
recently complete Sensitive Areas Inventory. Wooded steeply
ravined nature in the north part of Iowa city is well known
and is considered by many to be an extremely positive and
integral part of the character of the area. It makes the area
pleasing to live in, it helps enhance property values. Most
of the existing subdivisions within this portion of the city
have been developed around the ravines in harmony with the
existing ridge tops and valleys. An aerial view demonstrates
this fact very well. All the residents I have spoken to are
very concerned about excessive tree removal, excessive ravine
filling, excessive hilltop scalping and excessive landscape

modification which might accompany large scale development in
the Foster Road area should the city not take a forceful stand
in shaping that development. We urge the city to careful
review the environmental aspects of any plans for the
development of this area including the city's involvement in
the design and alignment and construction of Foster Road.

Dawn Harty/ I understand your time is strapped and I will try to be
very brief. 1521 prairie du Chien Road. I am also ad. t.
business owner. And a mother of small children that love on
prairie du Chine Road. I have only lived on prairie du Chien
Road for just under a year. My property goes into a ravine
which was flooded when I moved there. One of my primary
concerns comes from the environmental issue of bottlenecking
the front end of that ravine up to north of my home. If you
are to lob off the top of the ridges and fill ravines, I think
that this ravine will flood not only in times of the great
down pour but as a standard. The creek runs through there on
a daily basis and always has water in it. I am also concerned
with the widening of prairie du Chien Road which would have to
happen in the event of this. This would go by my children's
play space. I am sorry I came up here thinking you were going
to bulldoze through that trailer court at the end of prairie
du Chien Road and finding out that that is not true. I was
concerned with that as another issue. I, on Sundays, trek
through those ravines, with my children as our Sunday hobby
and have also recently spent time out at Kent Park and
noticing parallel issues of the ground out there and the
grounds around my home. I have been on the property in
question of being developed and the ravines are very deep and
the water runs through them fairly swiftly for creeks, the
trees are very large. I actually measured around those trees
and they are quite large. Some of them reach 100 feet tall
and even if some of these trees are not necessarily going to
be cut, they are talked about being sculpted around. If you
start sculpting the ground around a big old growth tree it is
going t.o fall whether you cut it or not. Mainly I just wanted
to let you know that there are neighbors in this area that are
very concerned and feeling quite threatened with the land
eroding around them. That is all I have to say.

Horow/ Oh, all right. We are still in p.h.
Robert Hageman/ I would like- I did want to give the developer a
chance to speak first because I think open public reasons
about an important proposal are important. I would like to
state my opposition to this annexation because currently this
18.6 acre tract is unserviceable in terms of sewer, water
pressure. And it would also mean two other serious detriments
to the community. One is that Rohret Road would likely be
extended to the new city limit which would be .6 to .7 of a
mile further west and that would be at very significant public
expense. The prime beneficiary of this pUblic expense would
be two developers who themselves are not citizens of this
community. The second thing is it would encourage, under the
proposal-it was a three part proposal, part of which was a
fairly high density pattern and it would encourage traffic by
the new elementary school. For those reasons I do oppose. In
addition I would like to state that if the area is annexed I
would encourage the council not to resize the lift station at
the landfill to fit the servicing of land in Old Man's Creek
water shed. Finally, a comment, I did wait to speak because
I did want to hear reasons from the developer as to what is
going on here. I attended both public meetings in front of the
P /Z Commission and the developer never spoke at either of
those. In fact, your comments indicate that the P/Z
Commission voted 6-0 in favor of this proposal but no citizen
spoke in favor of this proposal. No developers came and gave
reasons. In other words, there must have been information
into the P/Z Commission that was not done at the open p.h. And
for that reason I would encourage that this body require that
people who put forth important private proposal come forth and
state their reason for doing so.

too much to ask a proponent who puts forth a proposal that he
come and state his reason. Not the city's reason. The city
occupies quite a different position from the proponent. The
city sits up with the P/Z Commission. In fact, the image that
I got. I don't mean to suggest that anything was done
improperly. I admire the P/Z Commission for the work that
they do. But I do mean to state that the image that is got if
you allow a developer not to come and speak at these important
formal meetings is that what happens is all the citizens come
and speak against and the city and the P/Z Commission take the
posi tion for the developer. It pitches me against the P /z
commission, not me against the developer.
Horow/ You understand that we don't permit them to come. It is
they choose not to come.
Hageman/ yes and I think for failure to not to come and state
public reasons I think the penalty for that should be non
recommendation. Thank you.
Horow/ Is there anyone else who wished to address council on this
issue.
Jayne Sadler/ 41 Tuscon Place. I am also speaking in opposition of
the annexation. One of the things that was brought forward at
the P/Z Commission was that this was a voluntary annexation
and that the opportunity for voluntary annexation may not
arrive all that frequently and that the city should take
advantage of that. My feeling about that is that presently
this land is zoned one to the acre in the county and the
county is really not interested in rezoning it for more units
to the acre. Additionally at this time by reannexing it the
additional expense to the tax payers at this time prior to
sewer services being available, the expense of having the
maintenance of it, law enforcement which is pretty limited
where we are probably as other parts of the city, straining
the budget of the city for those services could be avoided at
least until the lift station is in and further information
could be received regarding the servicing of that particular
area and the plans the developer has for that area. One of
the other comments that was made by P /Z is the expense of
doing the road at this point in time as Rohret is being
readied for improvement would be less expensive to the city
than waiting. At the time when Slothower Road is improved upon
it can be done at that time. It is not much to turn a corner
and go down .7. of a mile. So at this point in time I just
wanted to register my opposition. Thanks.

comments, I was at all of the meetings and I represent the
developer. The reason that there was no comments made was the
merits of the staff report were so much our own objectives
that there was no need to (can't hear) and spend more time.
In regard to some of the comments that were made last night at
the work session. There was discussion about the undue
financial burden to the city. The annexation will allow for
development of a better street pattern that will allow a much
better transit operation. Right now we have got a bottleneck
si tuation there at the corner. If we develop up to the
corporate limit line, across the section line, we don't have
access to Rohret Road through this parcel then you have got a
bottleneck in your transit operation. There is a substantial
area of ground that needs to be developed before we get to
this parcel but it is a step in that direction.

Baker/ what, I read the report but reiterate the staff's position-
Franklin/The reasons that we have supported this annexation is
because it is wi thin the designated growth area that the
council has adopted for the future growth of Iowa city. It is
a voluntary annexation. I think a statement was made on
something about voluntary ann~xation don't always come along.
That is not necessarily so but it is easier to annex when it
is voluntary as opposed to involuntary. There cannot be
service provided to this area right now as I said to you last
night. But it maybe able to be provided after we do an
analysis of the sewer system on the west size to determine if
there is adequate capacity in the trunk lines at which time
then the developer would be responsible for putting in the
local-that is the facilities that are necessary within the
development to sewer the area. It is potentially sewerable.
I think the larger reason is that because it is in the growth
area and it is an area that is an entrance to Iowa City and an
area that we would prefer to have control over in terms of
city control vs. county control. It gives us an opportunity to
do that.

is a traffic issue and as we have heard in the P.h. tonight

would like for us to look at this in conjunction with the
whole northeast area development, traffic patterns to begin
with. But all of those issues and we if we are not going to
do this I think P/Z wants us to think about doing something.

directing staff to do is to say development is only acceptable
in this area if the environmental concerns are taken into
account, including trees, steep slopes, highly erodible soil,
drainage ways, open space, trail issue, neighborhood traffic

Kubby/ possibly an OPDH. And my viewpoint has been, through our
discussions last night, that the only way we can have any
negotiating power with the developer is to say we will put-the
only way you can develop is to put the street through and the

might be some other ways. So, I don't know what those other
ways are. I guess I would like to know what our options are
to say you have to follow these additional considerations that
it seemed last night we had all agreed were very highly held
community values that we wanted to act upon. Is that fair to

clustered housing and more open space.

west drive of the school site. And that will happen this year
and Phase 2 will be from the mostly easterly access to the
school site to Mormon Trek but next year.

for that whole stretch, from Mormon Trek to the city limits.

Pigott/ I have two things. First is this weekend is the kickoff,
this Friday night, is the kickoff of the Iowa Arts Festival
which is a week long celebration of our local arts talent and
it ~s, as everyone in town probably already knows, a
tremendous display of the artistic talent in town. I just
wish that everybody come d.t. to the parking lot across from
the Library Friday night to help kick off.
Horow/ Is that the Taste of Iowa city.
Pigott/ The band, the Orchestra Salsa Band and everybody will be
dancing in the streets. So I look forward to that with great
anticipation as do most residents I am sure. The second issue
was one regarding the boards that have been displayed outside
of bars in Iowa city and there has been some controversy about
the whether those chalk boards or marker boards violate the
spirit if not the real intent of the law. And I wondered,
Steve, if you could just give us a rundown as to what the
process is now. I understand Doug Boothroy is going to give
an opinion. Or perhaps Linda would be the person to talk to
about this.
Atkins/ To follow up from last night, Linda and Doug and I will
meet to prepare something to give you a memo pointing out
whether that is in fact enforceable and we will do that fairly
quickly. It seems to be pretty straight forward.

I went to a so called ground breaking in Coralville for the
Highway 6 Extension and it turned out to be not a ground
breaking but a ribbon cutting and the ribbon was up in the air
and three of us stood up in the front of a front end loader
and my grandson is absolutely thrilled. And I am saving my
plastic so called hard hats in order to give it to him when he
comes next.

Kubby/ I had brought up an issue a couple of weeks ago about the
escalating parking tickets and my belief that people should be
able to tell the city which ticket the payment they are giving
to the city is for. And ~Ie haven' t heard back from staff
about that.
Atkins/ I owe you a memo. It is on my list.
Kubby / I also want to let people know about June 9, the Human
Rights Commission is holding a p.h. at the Iowa City Public
Library, Room A, 7: 00 PM, to discuss changes to our Human
Rights Ordinance. We do a regular update and encourage people
to go to that p.h. I do have a couple of other things. A
couple weeks ago, it is very unusual for me to get 15 calls in
a two day period about the exact same issue. So it caused me
to investigate it a little bit. And the issue was a
particular lawn care company who was giving prenotification
but basically just saying we are going to be in Iowa city or
we are going to be in your neighborhood Monday through Friday.
And I talked to the company a little bit about what they were
doing and it wasn't very helpful to people who were receiving
the prenotification and just wanted to remind the residents
that the state regulation says that people must notify you at
least 24 hours in advance. They might be notifying you more
than 24 hours in advance and that is quite legitimate under
state law. But the prenotification must also say date and

approximate time of day of application. So if you are getting
prenotified without that kind of specific information, I
recommend before calling the Department of Ag. and Land
Stewardship that you call the chemical company first and ask
some questions and to tell them this kind of prenotification
is not adequate. And if you get inadequate prenotification
again, that you call the Department of Ag. and Land
Stewardship to make a complaint against the company and you
can reach them at area code 515-281 3981. Anybody can call me
at home to get that number, the Public Library, Des Moines
information. And I have one last item. And that is in our
last issue of the Iowa League of Municipalities magazine. But
it says that this month they are going to be gathering to
create a document of the state of the cities for Iowa. And
mostly what I fear will be in the document will be a huge
whining session about mandates and what I would like us to do
as a council is to ask our mayor to write a letter saying that
it is not the mandate that we are screaming about because most
of the mandates from the state and federal government to many
of them are concerns for environmental health and public
health issues. And I don't mind state and federal government
talking to cities and telling cities you need to do some
things. I think there needs to be some flexibility in those
regulations and I think there should be money coming down.
But what is happening is the conversation is shifting from the
public health policy to saying we don't want to do them and I
don't think that is really the message that I want to
participate in maldng. So I would like us to write a letter
to ask that the emphasis be talked about the benefits of
those.
Horow/ I don't disagree with you on this but I am glad you brought
it up simply because this city is taking part with the local
government environmental council that has essentially said to
DNR here we are and we are ready to help you. We are ready t
help you carry out those guidelines, help you write the
regulations and in other words we are taking a positive
approach towards it rather than just saying no and I would
prefer to have the letter or our contribution to the state of
the cities be positive in terms of what we can do.
KUbby/ That is exactly what I am asking for.
Horow/ Great. No problem.
Kubby/ Is a letter to say we are not whining. I am really tired of
whining by public officials all across country about this and
I want us to be taking positive stand-

Kubby/ As well as, I read in there that the Mayors of the Nasty
Nine, the Mayors of the Big Nine Metropolitan Areas in Iowa
will be gathering to talk about some policy input and I would
like people to start thinking about how we can give input to
Sue so she can represent us at that meeting instead of just
being Sue representing the city. She needs to represent all of
us. She needs our help or else her only choice is to talk
about her issues.
Horow/ You know me, I don't mind talking about my issues. But I
see through glasses public health anyway. So if you have any
other angle, let me know, and that meeting is 30 of this

Atkins/ For Karen's information and the rest of council, the large
city mayors have really been I think fairly positive about the
mandates. They hate being painted as anti this and anti that
because they complain about the mandates when they recognize
the importance of the state and federal government being able
to set these broad agendas ut the problem is you keep denying
us the resources to carry them out and the mayors have been
pounding away on that point.
Kubby/ And that is what gets heard then and the other stuff gets
lost. And I guess I really do have one more-And that is we
had letters out to different communities asking if they would
be interested in joining us on a petition to the Department
and Ag. and Land Stewardship about sign changes state wide for
post notification for pesticide application and wanted to
know-
Horow/ We got one reply from Waterloo.
KUbby/ I know that some officials in Dubuque and Cedar Falls are
interested also. I would ask permission of council to do some
follow up calls to the people that Sue sent the letters to
just to see what their silence indicates. I don't believe it

I just wanted to mention-Thank you, Marian, for getting that
for us. I wanted to mention that last weekend, as some of you
might have read in the Press citizen yesterday I think it was.
Last weekend a group of boy scouts from several troops around
town, under the direction of Mike Finley, provided
approximately 190 service hours spreading wood chips on the
trails on Hickory Hill Park. Chips were provided by our
Forestry Division. While the scouts were unable to complete
the whole of the trail system, they did put forth a
substantial effort. So I would really like to thank them very
much and their families for supporting them on this. That is
about all we have.

Replacement Project. The amendment allows for a two (21 year extension for

relative to Agreement No. 92.F.9, The first amendment passed and approved by
City Council March 2, 1993, increased the maximum project participation in Federal.

KUbby/ Yes, when it says stabilizing river embankments, I would
hope that we would look at various options and that not every
embankment needs this the same thing and what I really don't
want to see happen-I don't think this is it but just to say it
out loud is I don't want rip raf everywhere.
Fosse/ That is probably the option that we will look at and the
reason for that is the type of flood that we experienced last
summer, the vegetative protection didn't hold because it was
under water for so long that those plants died and the roots
were eroded away and there are some good examples of that in
that stretch of the river in Iowa City and Coralville. Little
pieces of rip raf were quite stable but the other parts of the
bank that were protected by plants and vegetation didn't
survive.
KUbby/ Is it possible to do rip raf with vegetation growing through
it. It may get ripped out during a huge flood but the rest
the time of the year it looks overgrown with green.
Fosse/ I don't know if it is or not. We can look into that. I
don't think we can get trees growing up through there very
well. Usually things do start growing on it.
KUbby/ I know there are some grasses that might be able to work
among a rock. I would like us to look if there are other
options than just rip raf. I mean this is a great program but
if all we have on the river bank is rip raf to me that is not
as positive of a way of doing it if possible. If that is the
only way we could do it, that is the only way we could do it.
Horow/ consistency sake-
Nov/ Some of the areas I have seen you are going to need something
like putting some dirt in order for the rip raf to have
something to sit on.
Fosse/ Yes, there will be some grading before the rip raf is
placed.
Nov/ It is just about to the edge of the sidewalk. By the way,
speaking of sidewalks, can you include something like an
ordinary drainage ditch storm water kind of thing.
Fosse/ Some of those along Dubuque street are included in this.

Comment: Due to a recert spring wind storm the flue cap at the Senior Center was
damaged. Upon inspection it was discovered that the entire flue had seam welds
broken leaving large holes in the entire length of the flue, creating a dangerous
situation that could allow carbon monoxide to enter the building. Carbon monoxide
detectors have been placed on each floor to allow continuous use of the building
while flue repairs are undertaken. R.M. Boggs Co. has submitted a proposal for both
temporary and permanent repairs to the flue totaling $10,340, It Is the recommen.

deference to our city attorney and our city clerk a job well
done.

Horow/ Yes. Thanks. It was monumental undertaking.
Kubby/ And within that big task I did not take responsibility to
read the ne~l code, compare it to the old code, see every
change. And just by chance I looked at one of the changes and
felt that it would create many households being illegal in
terms of their compost piles. So there has been-one of the
significant changes from when the city clerk and city attorney
and staff went through it was the definition of compost pile.
I still have some problems with it and still think that about
50% of the community is going to be illegal and I think we
need to-It is like a budget. There are going to be things you
don't like and things you do like and we are going to come
upon some of these specifics through experience and at that
point we will need to deal with the specifics of the language
in the new code. I also cannot stand, this is very picky, the
kind of binders that we received the code in because you can't
turn the pages very easily with the kind of angle that the
ring is in. So I hope we get binders that make our new
functional code more so.
Horow/ But they are certainly better than the original ones. Those
original ones were enough to drive me crazy.
Kubby/ And I look forward to the new index so I can find stuff I
need.

Comment: This ordinance amends Chapter 32, Section 32-1-63, subsection
23-277. This amendment will increase hourly parking fees in the Capitol
Street ramp (Ramp A) from $.50 to $,55 per hour and in the Dubuque Street
ramp (Ramp B) from $.45 to $,50 per hour, The intent of this increase is to
provide additional funds to the Transit Division to fund paratransit service
(SEATS), The effective date is August 1,1994,
