RESOLUTION NO. 94-183
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST A RELEASE OF LIENS FOR PROPERTY LOCATED AT 1310 YEWELL
STREET, IOWA CITY, IOWA.
WHEREAS, on October 28, 1988, the property owner of 1310 Yewell Street executed a
Promissory Note in the amount of $1,800 in exchange for a no interest loan; and
WHEREAS, on November 9, 1989, the owner executed a second Promissory Note in the
amount of $1,200 in excha(lge for a no interest loan; and
WHEREAS, on February 12, 1991, the owner executed a third Promissory Note in the amount
of $2,280 in exchange for a no interest loan; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the Mayor is authorized to sign and the City Clerk to attest the attached Release
for recordation, whereby the City does release the property located at 1310 Yewell Street,
Iowa City, Iowa, from an obligation of the property owner to pay to the City the principal
amounts of $1,800, $1,200, and $2,280, which obligations were recorded in Book 1034,
Page 153; Book 1093, Page 519; and Book 1206, Page 151, respectively, of the Johnson
County Recorder's Office.

WHEREAS, said Notes created liens against the subject property totalling $5,280; and
WHEREAS, the balance due under all loan instruments was paid in full on May 20, 1994.

RESOLUTION ACCEPTING THE WORK FOR THE SANITARY SEWER, STORM
SEWER, WATER MAIN AND PAVING PUBLIC IMPROVEMENTS FOR PARK
WEST SUBDIVISION, PARTS THREE AND FOUR, AND DECLARING PUBLIC
IMPROVEMENTS OPEN FOR PUBLIC ACCESS AND USE.
WHEREAS, the Engineering Division has certified that the following improvements have been
completed in accordance with the plans and specifications of the City of Iowa City,
Sanitary sewer, storm sewer, and water main improvements for Park West Subdivi-
sion, Parts Three and Four, as constructed by Maxwell Construction Inc, of Iowa City,
Iowa.
Paving improvements for Park West Subdivision, Parts Three and Four, as constructed
by Metro Pavers, Inc. of Iowa City, Iowa.
WHEREAS, maintenance bonds have been filed in the City Clerk's office; and
WHEREAS, traffic control signs have been installed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, THAT:
Said public improvements are hereby accepted by the City of Iowa City, Iowa, and that all
dedications and public improvements previously set aside as not being open for public access
are hereby formally accepted and declared open for public access and use.

I hereby certify that the construction of the sanitary sewer, storm sewer, water

Four, has been completed in substantial accordance with the plans and
specifications of the Engineering Division of the City of Iowa City. The required
maintenance bonds are on file in the City Clerk's office for the sanitary sewer,
storm sewer and water main improvements constructed by Maxwell Construction
Inc. of Iowa City, Iowa, and for the paving improvements constructed by Metro
Pavers, Inc. of Iowa City, Iowa.
I recommend that the above-referenced improvements be accepted by the City of

BACKGROUND INFORMATION:
The applicant, Windsor Ridge Development Co., is requesting final plat approval of Part Five
of Windsor Ridge. Part Five contains 9.31 acres, of which 1.1 acres are open space, and 16
lots.

Comorehensive Plan
Prior to its annexation into the City, the proposed Windsor Ridge Subdivision was located
within an area designated in the Comprehensive Plan as Fringe Area 5. According to the
Comprehensive Plan, Fringe Area 5 is excepted to develop for residential uses at low to
medium densities. The proposed final plat is consistent with the land use policies set forth
in the Comprehensive Plan for this area on the eastern edge of Iowa City.
Zonina Ordinance
The final plat has been reviewed and appears to conform with the general requirements of the
RS-5, Low Density Single-Family Residential Zone.

In accordance with the City's annexation policy, the developer has agreed to pay for all of the
costs associated with providing infrastructure, including construction of sewer lines, water
mains and streets, for the Windsor Ridge Subdivision. Because this is considered out-of-
sequence development, the developer is expected to pay full costs for all oversized
infrastructure as well as the local facilities.

The proposed final plat for Part Five of the Windsor Ridge Subdivision appears to be in general
compliance with the City's subdivision regulations. However, the legal papers must be
approved by the City Attorney's Office, and construction plans and design calculations must
be approved by the Public Works Department prior to Council consideration of the final plat.
These requirements and other technical deficiencies are listed at the end of the report.

The final plat contains one deviation from the approved preliminary plat. The final plat shows
Sutherland Avenue as a loop street, where the preliminary plat showed Sutherland Avenue
connecting to Taft Avenue. This connection would require a change in the elevation of Taft
Avenue which could only be accomplished by improving Taft Avenue from American Legion
Road to Lower West Branch Road. It is not feasible to improve Taft Avenue at this point in
time, so the change is justified. A temporary road for emergency access only will be provided
so that secondary access is available for Part Five.

BACKGROUND INFORMATION:
The Planning and Zoning Commission recommended approval of the preliminary plat for
Southwest Estates, Parts Five and Six on November 5, 1992 and the City Council approved
the preliminary plat on November 24, 1992. In addition, development of this property is
subject to the Conditional Zoning agreement approved by the City Council on February 23,
1988, when the entire Southwest Estates tract was rezoned.

Approval of the final plat for Part Five of Southwest Estates contained a condition that no
building permits could be issued for the subdivision until the contract for improvement of the
Westside Trunk Sewer had been awarded. This condition, which was recommended by the
Commission, was placed on the plat approval, because sanitary sewer capacity would not be
available for the subdivision until the improvements were complete, The contract has been
awarded for the Westside Truck Sewer improvements and work has begun on the project.
A similar condition will not be necessary for the proposed final plat for Part Six.

ANALYSIS:
Staff has reviewed the final plat, and has found that it is consistent with the preliminary plat.
Construction plans and calculations have been submitted to the Public Works Department and
are being reviewed. Legal papers have been submitted to the City Attorney's Office and are
being reviewed.
STAFF RECOMMENDATION:
Staff recommends that the final plat of Southwest Estates, Part Six be approved subject to
approval of legal papers by the City Attorney's Office and construction plans by the Public
Works Department prior to City Council consideration of this item.

The Planning and Zoning Commission recommended approval of the preliminary plat of Dean
Oakes Fourth Addition January 6, 1994. The City Council approved the plat in January 1994.
ANALYSIS:
Staff has reviewed the final plat and has found it to be consistent with the preliminary plat,
except as noted in the deficiencies and discrepancies listed at the end of this report. Legal
papers have been submitted to and are being reviewed by the City Attorney's Office.
Construction plans have been submitted to and are being reviewed by the Public Works
Department.

The Sensitive Areas Inventory, Phase I shows wooded areas and steep slopes in the northern
portion of this site. No ordinances are in place to address these issues at this time, Staff
feels it is appropriate to point out that potentially sensitive areas are located on the site.
STAFF RECOMMENDATION:
Staff recommends that the final plat of Dean Oakes Fourth Addition be deferred pending
resolution of the deficiencies and discrepancies listed at the end of this report, but that upon
resolution of the deficiencies and discrepancies the plat should be approved.

RESOLUTION NO.
RESOLUTION AUTHORIZING CONVEYANCE OF A VACATED PORTION OFTHE
LINN STREET RIGHT-OF-WAY LOCATED WEST OF GILBERT STREET AND
NORTH OF BENTON STREET TO MERLIN HAMM.
WHEREAS, the City Council adopted an ordinance vacating a portion of the Linn Street right-
of-way located west of Gilbert Street and north of Benton Street; and
WHEREAS, Merlin Hamm owns the pr?perty adjacent to the right-of-way; and
WHEREAS, Mr. Hamm has offered to purchase the right-of-way for $2,500, the appraised
value of the property; and
WHEREAS, the City does not need the portion of the right-of-way to provide access to
property in the area; and
WHEREAS, the City will retain enough right-of-way to accommodate an eight foot sidewalk
along Gilbert Street and will retain a utility easement over the right-of-way; and
WHEREAS, on May 24/ 1994, the City Council adopted Resolution 94-180 declaring its intent
to convey its interest in the vacated right-of-way, authorizing public notice of the proposed
conveyancer and setting the date and time for public hearing; and
WHEREAS, following public hearing on the proposed conveyance, the City Council finds that
the conveyance is in the public interest.
NOW, THEREFORE, BE IT HEREBY RESOLVED BYTHE CITY COUNCIL OF IOWA CITY, IOWA,
THAT:
1. The Mayor and the City Clerk are authorized to execute a Quit Claim Deed conveying
the City's interest in the property legally described below to Merlin Hamm, for and in
consideration of $ 2, 500.00/ subject to the City reserving and retaining a utility
easement over the parcel in a location to be determined by the Public Works
Department:
Commencing at the southeast corner of Lot 4, Block 28 of County Seat Addition as
recorded in Deed Book 1 & 2, Page 301/ Johnson County Recorder's Office; thence
N 89053'17" E, 35.00 feet; thence N 00016'55" W, 12.70 feet parallel to the east
line of said Block 28 to the Point of Beginning; thence N 00016'55" W -147.36 feet
parallel to the east line of said Block 28; thence N 139051 '13" E, 41.43 feet along the
easterly extension of the north line of lot 3 of said Block 28 to a point that lies 45.00
feet westerly from the centerline of Gilbert Street; thence S 15025'50" W, 152.98
feet along said line lying 45.00 feet from the centerlille of Gilbert Street to the Point
of Beginning. Said tract contains 3,052 square feet or 0.070 acres more or less.

The City Attorney is authorized to deliver said Quit Claim Deed to Merlin Hamm. The
deed and other documentation required by Iowa Code ~364.7 (1993) shall be recorded
in the Johnson County Recorder's Office at Mr. Hamm's expense.

AND ESTIMATE OF COST FOR THE CONSTRUCT/ON OF THE ROHRET ROAD
RECONSTRUCTION PROJECT, PHASE 1, ESTABLISHING AMOUNT OF BID
SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH

1. The plans, specifications, form of contract, and estimate of cost for the above-named
project are hereby approved.
2. The amount of bid security to accompany each bid for the construction of the above-
named project shall be in the amount of 10% of bid payable to Treasurer, City of Iowa
City, Iowa.

The City Clerk is hereby authorized and directed to publish notice for the receipt of
bids for the construction of the above-named project in a newspaper published at least
once weekly and having a general circulation in the city.

RESOLUTION APPROVING AMENDMENT TO AGREEMENT NO. 92-F-9
RELATIVE TO THE REPLACEMENT OF THE MELROSE A VENUE BRIDGE WHICH
SPANS THE IOWA INTERSTATE RAILROAD NEAR KINNICK STADIUM.

WHEREAS, the City of Iowa City approved Agreement No. 92-F-9 on March 17, 1992,
relative to the Melrose Avenue Bridge Replacement Project; and
WHEREAS, the Iowa Department of Transportation approved Agreement No. 92-F-9 on April
13, 1992; and
WHEREAS, Agreement No. 92-F.9 used the old project number BRM.4066(1 )..8N.52 which
was changed on October 29, 1992, to BRM-3715(11-.8N.52; and

WHEREAS, the Iowa Departmentof Transportation has presented to the City of Iowa City an
amendment to said agreement; and
WHEREAS, the City Council deems it is in the public interest to approve the amendment to
Agreement No. 92-F-9, which allows for a two (2) year time extension for location/design
study report approval for this project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1, The Amendment to Agreement No. 92.F.9 attached hereto is in the public interest, and

Federal-aid Highway Bridge Replacement and Rehabilitation Program (HBRR)

1. Contract for construction of the ,works of improvement
described in section A.
2. Provide In-Kind contribution of design, construction,
inspection, and contract administration equal to 25 percent
of the estimated cost of construction for the work described
in section A.
3. Accept all financial and other responsibility for excess
costs resulting from their failure to obtain or their delay
in obtaining adequate land and water rights, permits, and
licenses needed for the work described in section A.
4. If applicable, complete the attached "Clean Air and Water
Certification:' and comply with the attached "Clean Air and
Water Clause".
If needed, upon completion of emergency protection measures
and the elimination of the threat, take action to bring the
measures up to reasonable standards by other means and/or
authority. Unless the measures are brought up to reasonable
standards, the sponsors will not be eligible for future
funding under the Emergency Watershed Protection Program.

6. ses may terminate this agreement in whole or in part when it
is determined by SCS that the sponsors have failed to comply
with any of the conditions of this agreement. The SCS shall
promptly notify the Sponsors in writing of the determination
and reasons for the termination, together with the effective
date. Payments or recoveries made by SCS under this
termination shall be in accord with the legal rights and
liabilities of SCS and the Sponsors.
.7. This agreement may be temporarily suspended by SCS if it
determines that corrective action by the Sponsors is needed
to meet the provisions of this agreement. Further, ses may
suspend this agreement when it is evident that a termination,
is pending.
8. The program or activities conducted under this agreement
will be in compliance with the nondiscrimination provisions
contained in the Titles VI and VII of the civil Rights
Restoration Act of 1987 (Public Law 100-259); and other
nondiscrimination statutes: namely, Section 504 of the
Rehabilitation Act of 1973, Title IX of the Education
Amendments of 1972, and the Age Discrimination Act of '1975.
They will also be in accordance with the regulations of the
Secretary of Agriculture (7CGR-15, Subparts A & Bl, which
provide that no person in the United States shall on the'
grounds of race, color, national origin, age, sex, religion,

RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN
AGREEMENT WITH SHIVE.HATTERY ENGINEERS AND ARCHITECTS, INC. OF
IOWA CITY,IOWA, FOR ENGINEERING CONSULTING SERVICES RELATIVE TO
THE EMERGENCY WATERSHED PROTECTION PROGRAM.
WHEREAS, the City of Iowa City desires to complete certain repairs adjacent to the Iowa
River caused by the flood of 1993 relative to the Emergency Watershed Protection Program;
and

WHEREAS, an agreement has been negotiated with Shive-Hattery Engineers and Architects,
Inc. to provide engineering consulting services to the City of Iowa City, which agreement is
attached hereto; and

WHEREAS, the City Council finds it to be in the public interest to enter said Agreement.

THIS AGREEMENT, made and entered into this day of .1994

as the City and Shive-Hatterv Enqineers And Architects. inc" of Iowa Citv ,

WHEREAS, The City of Iowa City wants to repair 1993 flood damage under the Soil
Conservation Service Emergency Watershed Protection Program (EWP) at the
locations listed below:
1. Iowa River at Crandic Park - Bank Stabilization (DSR 364-40)
2, Iowa River and Power Company Dam Spillway (DSR 364-42)
3. Iowa River Miscellaneous Storm Sewer - Sedimentation Removal
(DSR 364-48)
4, Iowa River at Terrell Mill Park, City Park, and Dubuque Street - Bank
Stabilization (DSR 364-50) i
5. Iowa River at Rocky Shore Drive - Bank Stabilization (DSR 364-51)

NOW THEREFORE, it is agreed by and between the parties hereto that the City does
now contract with the Consultant to provide as set forth herein.
I. SCOPE OF SERVICES

Consultant agrees to perform the following services for the City, and to do so in
a timely and satisfactory manner.
GRANT ASSISTANCE AND ADMINISTRATION
A. Shive-Hattery will attend a kick-off meeting with the City of Iowa City
staff. Shive-Hattery will contact SCS and assist The City with '
preparation of DSR 364-76.
B. Shive-Hattery will assist the City of Iowa City with the preparation of
various documents, grant agreements, forms, and other paperwork
necessary to satisfy the Soli Conservation Service under their EWP
Program.

DESIGN PHASE
A. Shive-Hattery will meet with the Soil Conservation Service to review each
of the DSR's to assure that there is concurrence of design approach,
methodology, and construction detailing.
B, Shive-Hattery will survey each of the seven (7) sites previously outlined
and prepare a plan view of each of the sites, along with cross-sections of
various banks and stream channels as is appropriate.
C. Shive-Hattery will prepare a preliminary design of each of the sites and
review the preliminary with the Soli Conservation Service and obtain their
concurrence,

D. Shive-Hattery will prepare final plans, specifications, and bid documents
for the improvements of the various sites,
E. Shive-Hattery will submit the plans and specifications to the City of Iowa
City and the Soil Conservation Service, along with other regulatory
agencies as is deemed appropriate by the Soil Conservation Service.
BID AND CONSTRUCTION SERVICES

A. Shive-Hattery will prepare and mail a notice to contractors that may be
interested in this project and file a set of plans and specifications with
regional planhouses,
B. Shive-Hattery will furnish the City three (3) sets of plans and
specifications for their use.
C. Shive-Hattery will have 40 sets of plans and specifications printed for bid
purposes and handle distribution to contractors.
D, Shive-Hattery will answer contracto~s questions during the bid period,
attend bid opening, and prepare a bid tabulation and recommendation of
award of the contract.

B. Should the City terminate this Agreement, the Consultant shall be paid
for all work and services performed up to the time of termination.
However, such sums shall not be greater than the "lump sum", or not-to-
exceed amounts listed in Section IV. The City may terminate this
Agreement upon seven (7) calendar days' written notice to the
Consultant.

This Agreement shall be binding upon the successors and assigns of the
parties hereto, provided that no assignment shall be without the written
consent of all Parties to said Agreement.
It is understood and agreed that the retention of the Consultant by the
City for the purpose of the Project shall be as an Independent contractor
and shall be exclusive, but the Consultant shall have the right to employ
such assistance as may be required for the performance of the Project.

CONSULTANT AGREEMENT
E, It is agreed by the City that all records and files pertaining to information
needed by the Consultant for the project shall be available by said City
upon reasonable request to the Consultant. The City agrees to furnish
all reasonable assistance in the use of these records and files.
F, If is further agreed that no Party to the Agreement shall perform contrary
to any state, federal, or local law or any of the ordinances of the City of
Iowa City, Iowa.
G. At the request of the City, the Consultant shall attend such meetings of
the City Council relative to the work set forth in this Agreement. Any
requests made by the City shall be given with reasonable notice to the
Consultant to assure attendance.

H. The Consultant agrees to furnish, upon termination of this Agreement
and upon demand by the City, copies of all basic notes and sketches,
charts, computations, and any other data prepared or obtained by the
Consultant pursuant to this Agreement without cost, and without
restrictions or limitations as to the use relative to specific projects
covered under this Agreement. In such event, the Consultant shall not
be liable for the City's use of such documents on other projects.
I. The Consultant agrees to furnish all reports, specifications, and
drawings, with the seal of a professional engineer affixed thereto or such
seal as required by Iowa law.
J. The City agrees to tender the Consultant all fees in a timely manner,
excepting, however, that failure of the Consultant to satisfactorily perform
in accordance with this Agreement shall constitute grounds for the City to
withhold payment of the amount sufficient to properly complete the
Project in accordance with the Agreement.
K. Should any section of the Agreement be found invalid, it Is agreed that
the remaining portion shall be deemed severable from the Invalid portion
and continue in full force and effect.

IV. COMPENSATION FOR SERVICES
The Grant support services, including reimbursables for mileage and printing,
will be provided on a time and expense basis with a not-to-exceed cost of
$6,000,00 without authorization of The City.

Clerk of the City of Iowa City, Iowa, until 10:30
AM, on the 31st day of May, 1994, and shall be
received in the City Clerk's office no later than
said date and time, Sealed proposals will be
opened immediately thereafter by the City Engi.
neer. Bids submilled by fax machine shall not
be deemed a "sealed bid" for purposes of this
Project. Proposals will be acted upon by the
City Council at a meeting to be held in the
Council Chambers at 7:30 P,M, on June 7,
1994, or at such later time and place as may
then be scheduled,
The Project will involve the following:
Selected exterior repairs involving hypalon
roofing, masonry restoration, renovation of
existing skylight, including window installa-
tion and interior finish work,
All work is to be done in strict compliance with
the plans and specifications prepared by
Howard R. Green Company, 4250 Glass Road
NE, P,O, Box 9009, Cedar Rapids, Iowa, which
have heretofore been approved by the City ,
Council, and are on file for public examination in
the Office of the City Clerk, '
Each proposal shall be completed on a form
furnished by the City, and must be accompanied
in a sealed envelope, separate from the one
containing the proposal, by a bid bond executed
by a corporation authorized to contract as a
surety in the State of Iowa, in the sum of 10% of
the bid, The bid security shall be made payable
to the TREASURER OF THE CITY OF IOWA
CITY, IOWA, and shall be forfeited to the City of
Iowa City in the event the successful bidder fails
to enter into a contract within ten (10) calendar
days and post bond satisfactory to the City
insuring the faithful performance of the contract
and maintenance of said Project, if required,
pursuant to the provisions of this notice and the
other contract documents, Bid bonds of the
lowest two or more bidders may be retained for
a period of not to exceed fifteen (15) calendar
days until a contract is awarded, or until reJec-
tion is made. Other bid bonds will be returned
after the canvass and tabulation of bids Is
completed and reported to the City Council.
The successful bidder will be required to
furnish a bond In an amount equal to one hun.
dred percent (100%) of the contract price, said
bond to be Issued by a responsible surety ap-
proved by the City Council, and shall guarantee
the prompt payment of all materials and labor,

A $35 refundable fee is required for each set

the form of a check, made payable to the City of

Prospective bidders are advised that the City
of Iowa City desires to employ minority contrac-
tors and subcontractors on City projects,
Bidders shall list on the Form of Proposal the
names of persons, firms, companies or other
parties with whom the bidder intends to subcon-
tract. This list shall include the type of work and
approximate subcontract amount(s),
The Contractor awarded the contract shall
submit a list on the Form of Contract of the
proposed subcontractors, together with quanti-
ties, unit prices and extended dollar amounts,

RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND
BETWEEN THE CITY OF IOWA CITY AND R. M. BOGGS CO. TO PROVIDE
EMERGENCY FLUE REPAIR SERVICES FOR THE IOWA CITY SENIOR CENTER.
WHEREAS, inspection of the flue at the Iowa City Senior Center has confirmed that numerous
seam welds are broken, leaving large holes in its entire length; and
WHEREAS, the resulting condition presents a potential hazard to occupants of the building;
and
WHEREAS, the City of Iowa City desires to perform immediate repairs to remedy existing
condition; and
WHEREAS, a proposal to perform said repairs has been submitted by R. M, Boggs Co. of Iowa
City, Iowa; and
WHEREAS, it is in the public interest to enter into said Agreement with R. M. Boggs Co.
NOW, THEREFORE, BE iT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,

1994 MAINTENANCE AND REPAIR PROJECT
CAPITAL AND DUBUQUE STREET PARKING
RAMPS PROJECT
!
Sealed proposals will be received by the City
Clerk of the City of Iowa City, Iowa, until 10:30
A,M, on the 26th day of May, 1994, and shall be
received in the City Clerk's office no later than
said date and time, Sealed proposals will be
opened immediately thereafter by the City
Engineer, Bids submitted by fax machine shall
not be deemed a "sealed bid" for purposes of
this Project. Proposals will be acted upon by
the City Council at a meeting to be held in the
Council Chambers at 7:30 P,M, on June 7,
1994, or at such later time and place as may
then be scheduled,
The Project will involve the following:
Repair of concrete delaminations, expan-
sion joint repair, expansion joint replace-
ment, waterproofing membrane, miscella-
neous painting and bird control.
All work is to be done in strict compliance with
the plans and specifications prepared by Shive.
Hattery Engineers and Architects, Inc" of Iowa
City, Iowa, which have heretofore been ap-
proved by the City Council, and are on file for
public examination in the Office of the City
Clerk,
Each proposal shall be completed on a form
furnished by the City, and must be accompanied
in a sealed envelope, separate from the one
containing the proposal by a bid bond executed
by a corporation authorized to contract as a
surety in the State of Iowa, in the sum of 10% of
the bid, The bid security shall be made payable
to the TREASURER OF THE CITY OF IOWA
CITY, IOWA, and shall be forfeited to the City of
Iowa City in the event the successful bidder fails
to enter into a contract within ten (10) calendar
days and post bond satisfactory to the City
insuring the faithful performance of the contract
and maintenance of said Project, if required,
pursuant to the provisions of this notice and the,
other contract documents, Bid bonds of the
lowest two or more bidders may be retained for
a period of not to exceed fifteen (15) calendar
days until a contract is awarded, or until rejec-
tion is made, Other checks or bid bonds will be
returned after the canvass and tabulation of bids
is completed and reported to the City Council,
The successful bidder will be required to
furnish a bond in an amount equal to one hun-
dred percent (100%) of the contract price, said
bond to be issued by a responsible surety ap-
proved by the City Council, and shall guarantee
the prompt payment of all materials and labor,
and also protect and save harmless the City

contract, and shall also guarantee the mainte-
nance of the improvement for a period of two (2)
years from and after its completion and formal
acceptance by the City, Waterproofing mem-
brane work shall be guaranteed for a period of
five (5) years.
The following limitations shall apply to this
Project:
Working Days: 60
Completion Date: August 18, 1994
Liquidated Damages: $200,00 per day
The plans. specifications and proposed con-
tract documents may be examined at the office
of the City Clerk, Copies of said plans and
specifications and form of proposal blanks may
be secured at the Office of Shive-Hattery Engi-
neers and Architects, Inc, of Iowa City, Iowa, by
, bona fide bidders,
Prospective bidders are advised that the City
of Iowa City desires to employ minority contrac-
tors and subcontractors on City projects,
Bidders shall list on the Form of Proposal the
names of persons, firms, companies or other
parties with whom the bidder intends to subcon-
tract. This list shall include the type of work and
approximate subcontract amount(s),
The Contractor awarded the contract shall
submit a list on the Form of Contract of the
proposed subcontractors, together with quantI-
ties, unit prices and extended dollar amounts,
If no minority business enterprises (MBE) are
utilized, the Contractor shall furnish documenta-
tion of all reasonable, good faith efforts to recruit
MBE's,
A listing of minority contractors is available at
the City, and can be obtained from the Civil
Rights Specialist at the Iowa City Civic Center
by calling 3191356-5022,
By virtue of statutory authority, preference will
be given to products and provisions grown and
coal produced within the State of Iowa, and to
Iowa domestic labor, to, the extent lawfully re-
quired under Iowa Statutes. The Iowa Recipro-
cal Preference Act, Section 23,21, Code of Iowa
(1991), applies to the contract with respect to
bidders who are not Iowa residents,
The City reserves the right to reject any or all
proposals, and also reserves the right to waive
technicalities and irregularities,

RESOLUTION CHANGING THE NAME OF ASER AVENUE LOCATED IN TY'N
CAE, PARTS 1 & 2 TO ASER AVENUE WEST
WHEREAS, on November 22,1977, the City Council approved the final plat of Ty'n Cae; and
WHEREAS, said plat was recorded on November 29, 1977 in Plat Book 17, Page 24 in the
Johnson County Recorder's Office; and
WHEREAS, on February 4, 1993, the City Council for the City of Iowa City approved the final
plats for Park West Subdivision. Parts Two, Three and Four; and
WHEREAS, at that time the City Council decided noUo connect the two sections of Aber
Avenue but instead to extend Teg Drive to connect with the easterly section of Aber Avenue
located in Bryn Mawr Heights. Part Thirteen; and
WHEREAS, due to the bifurcation of Aber Avenue, the Police Department, Fire Department,
and ambulance service have concerns about potential problems with response time for
emergency services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:

The name of Aber Avenue located in Ty'n Cae, Parts 1 and 2 is hereby changed to
Aber Avenue West.
2. As required by Iowa Code ~354.26 (19931, the City Clerk is directed to certify a copy
of this Resolution and to file this Resolution with the Johnson County Recorder, the
Johnson County Auditor, and the City Assessor.

WHEREAS, on February 4, 1993, the City Council for the City of Iowa City approved the final

WHEREAS, the final plat of Park West Subdivision, Part Four, was recorded on July 27, 1993
in Plat Book 33, Page 265 of the Johnson County Recorder's Office; and

RESOLUTION AMENDING THE BUDGETED POSITIONS
IN THE CITY ATTORNEY'S OFFICE AND THE CONFIDENTIAL PAY PLAN
WHEREAS, Resolution No. 94-70 adopted by the City Council on March 8, 1994, authorized
permanent positions in the City Attorney's Office for FY95; and
WHEREAS, Resolution No. 94.149, adopted by the City Council on May 10, 1994,
established a classification/compensation plan for Confidential employees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the budgeted positions in the City Attorney's Office be amended by:
1. The deletion of one full-time Administrative Secretary, paygrade 24;

WHEREAS, the City has adopted the parking
facility impact fee ordinance to assist in the
implementation of the Near Southside
Neighborhood redevelopment plan, and guide
the use and development of land so as to
assure that new residential development in the
Near Southside Neighborhood bears a
proportionate share of the cost of capital
expenditures necessary to provide parking in
the Near Southside Neighborhood of Iowa City;
and
WHEREAS, the City finds it necessary to
establish a mechanism in the parking facility
impact fee ordinance to ensure that the parking
facility impact fee paid by fee payors reflects
current parking facility development costs.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. AMENDMENT, That Chapter 31 ,2/
Iowa City Code of Ordinances, Article VI,
entitled "Parking Facility Impact Fee Ordinance"
is amended by repealing Sections 32,1-115 and
32,1-123/ and adding thereto new Sections
32.1-115 and 32.1-123 to read as follows:
Section 32.1-115. Computation of the
Amount of the Parkina Facilitv Impact Fee.
A. The impact fee imposed by this ordinance
is based upon current best estimates of the
capital improvement costs of the
construction of a parking facility in the
Near'Southside Neighborhood, Based upon
1992 architects' estimates of construction
costs of $10/000 per parking space
constructed, and land costs of
approximately $16 per square foot, the
City Council finds that such capital
improvement costs total in the amount of
at least $12,000 per parking space in
1992.
B. The City Council further finds that given
current Department of Planning and
Program Development estlmetes of new
residential development in the Near
Southside Neighborhood, end given the
City's ab1l1ty to manipulate perking system

rates, monthly permit policies and on-street
parking ordinances, the use of a parking
facility in the Near Southside Neighborhood
will be apportioned 33Va% to users
attributable to new residential development
in the Near Southside Neighborhood and
660/3% to users from other areas,
C. Based on the foregoing, the amount of the
parking facility impact fee required by this
ordinance, in 1992 dollars, shall be $4,000
per parking space, The parking facility
impact fee shall be adjusted annually
according to provisions of Section 32.1-
123.
D. In order that available land in the Near
Southside Neighborhood is intensively
used, and that a portion of residential
parking is combined in a parking facility
rather than scattered throughout the Near
Southside Neighborhood, the Council finds
that the parking facility impact fee shall be
paid in lieu of providing 50% of the parking
spaces otherwise required by the Zoning
Ordinance for residential uses,
E. The total parking facility impact fee
required by this ordinance shall be
calculated by multiplying by 50% the
number of parking spaces otherwise
required by the Zoning Ordinance for
residential uses, and mUltiplying that
product by the per space parking facility
impact fee amount, as expressed in the
formula:
(RPS x .51 x IF = TF
where RPS is the number of parking spaces
otherwise required by the zoning ordinance
for residential uses, IF is the per space
parking facility impact fee, and TF is the
total parking facility impact fee required by
this ordinance.
Section 32.1-123. Miscellaneous.
A. To ensure accurate estimates of current
parking facility development costs, the
amount of the parking facility impacts fee
required by the ordinance shall be adjusted
annually based on the national historical
cost indexes contained in the most recent
edition of Means Square Foot Costs
manual.
B. The calculation of parking facility Impact
fees and the receipt thereof by the City
shall be documented in a form recordable in
the Office of the Johnson County Recorder.

SECTION II. REPEALER. All ordinances and
parts of ordinances in conflict with the
provisions of this Ordinance are hereby
repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or
unconstitutional.
SECTION IV, EFFECTIVE DATE. This
Ordinance shall be in effect after its final
passage, approval and publication, as provided
by law.

SECTION I, Chapter 32.1, Article IV, subsec.
tion 23-277, of the Iowa City Code of Ordi-

RESOLUTION NO,
RESOLUTION CERTIFYING UNPAID SANITARY SEWER SERVICE UTILITY
CHARGES TO JOHNSON COUNTY FOR COLLECTION IN THE SAME
MANNER AS A PROPERTY TAX.
. WHEREAS, Section 384,84 of the Code of Iowa provides that the City Council may certify
unpaid charges for the services of sanitary sewer systems, sewage treatment, solid waste
collection, water, and solid waste disposal to Johnson County, for collection in the same
manner as a property tax; and
WHEREAS, there exist unpaid sanitary sewer service utility charges for the owner and
properties, and in the amounts specified in Exhibit A, attached to this Resolution and by this
reference made a part hereof; and
WHEREAS, the Council finds that the property owner has received a written notice by certified
mail, return receipt requested, of the date and time for the City Council's consideration of this
resolution, at which time the property owner may appear before the Council and be heard
concerning the unpaid charges,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
That the City Clerk is hereby authorized to certify to Johnson County, Iowa, for collection in the
same manner as a property tax, unpaid sanitary sewer service utility charges, as stated in
Exhibit A, attached,
