1. A public hearing on plans, specifications, form of contract, and estimate of cost for the
construction of the above-mentioned project is to be held on the 28th day of November,
2006 at 7:00 p.m. in Emma J. Harvat Hall, City Hall, Iowa City, Iowa, or if said meeting
is cancelled, at the next meeting of the City Council thereafter as posted by the City
Clerk.
2. The City Clerk is hereby authorized and directed to publish notice of the public hearing
for the above-named project in a newspaper published at least once weekly and
having a general circulation in the City, not less than four (4) nor more than twenty (20)
days before said hearing.
3. The copy of the plans, specifications, form of contract, and estimate of cost for the
construction of the above-named project is hereby ordered placed on file by the
Director of Housing and Inspection Services in the Office of the City Clerk for public

RESOLUTION SETTING A PUBLIC HEARING FOR NOVEMBER 28, 2006 ON THE
UPDATE OF THE IOWA CITY HOUSING AUTHORITY'S HOUSING CHOICE VOUCHER
(HCV) ADMINISTRATIVE PLAN.
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing Authority
and the Department of Housing and Urban Development requires adoption of an updated Annual
Plan; and
WHEREAS, the HCV Administrative Plan defines the Iowa City Housing Authority's policies for
the operation of the HCV Program, incorporating Federal, State and local law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT;
1. A publiC hearing for the Iowa City Housing Authority's amended HCV Administrative Plan
is set for 7:00 PM, November 28, 2006, or if said meeting is cancelled, at the next meeting
of the City Council thereafter as posted by the City Clerk, to permit any citizen to be heard

Choice Voucher (HCV) Administrative Plan and Admissions and Continued
Occupancy (ACOP) Plan
>> HCV Plan: Due to low lease-up rates (less than 95% in the HCV program for FY06),
increased staff time for processing applicants, and the rising costs of HCV participants
exercising their portability rights, the Iowa City Housing Authority I CHA proposes the
following changes to our admission preferences for the HCV Program (Changes are in Bold
and Underlined):
The Iowa City Housing Authority will select families based on the following preference:
A. Displaced: Individuals or families displaced by government action or whose dwelling
has been extensively damaged or destroyed as a result of a disaster declared or
otherwise formally recognized pursuant to federal disaster relieflaws.
B. Families with children under the age of 18 or elderly or disabled families who are
residents (have a lee:al domicile) in the Iowa City Housine: Authoritv jurisdiction
24 CFR 982.207(b)(1);
C. Families with children under the age of 18 or elderly or disabled families who are
not residents (do not have a lee:al domicile) in the Iowa City Housine: Authoritv

>> ACOP: To maintain consistent admission preferences between the HCV and Public Housing
Programs, the Iowa City Housing Authority proposes the following changes to the
Admissions and Continued Occupancy Plan (ACOP) (Changes are in Bold and

The ICHA will select families based on the following preferences within each bedroom size
category 24 CFR 960.206 (a) (I):

~ HCY Plan: Another measure the Iowa City Housing Authority proposes to increase lease-up
rates for the HCY program is making changes to Section 6.0 Assignment of Bedroom Sizes
(Subsidy Standards). In the Johnson County market, there is a greater supply of suitable 2
bedroom units v. I bedroom units. These changes will increase eligible families' ability to
more quickly find and lease-up suitable units. (Changes are in Bold and Underlined):
D. One-bedroom will be assigned to a single adult with a child under the aee offour (4).
NOTE: Modification. Prior age was seven (7).
F. One-bedroom will be assigned for children of the opposite sex who are both under the
aee of nine (9). NOTE: Modification. Prior age was eleven (II).
~ HCY Plan: The Department of Housing and Urban Development issued Supplementary
Guidance in the Federal RegisterNol. 71, No. 68 regarding the Eligibility of Students
for Assisted Housing Under Section 8 of the U.S. Housing Act of 1937. This notice
requires that Housing Authorities update their Administrative Plans to reflect the new
income eligibility restrictions for students. We are adding a new section to address this
HUD requirement:
Section 20: Eligibility of Students for Assisted Housing under Section 8 of the U.S.
Housing Act of 1937:
Family Characteristics - Subject to Student Eligibility and Income Rules: Any financial
assistance, in excess of amounts received for tuition that an individual receives (see below)

shall be considered income to that individual. Loan proceeds are not considered "financial
assistance" under this section:
1. Persons under the age of 24;
2. Persons age 24 and older without dependent children.
Family Characteristics - Excluded from Student Eligibility and Income Rules: The full
amount of student financial assistance paid directly to the student or to the educational
institution is excluded from annual income:
1. Persons age 24 and older with dependent children;
2. Students currently living with their parents participating in the Section 8 program.
INCOME FACTORS:
1. Count as income: Any financial assistance, in excess of amounts received for tuition
received from the following sources:
. Higher Education Act of 1965 (i.e., Pell Grant, FSEOG, Federal Work-Study
programs);
. Private sources;
. Institute of Higher Education;
. May include Federal, State and local grants & scholarships (athletic & academic)
and student educational financial assistance from parents, guardians or other
persons residing outside of student family household.
2. Do not count as income: Although considered financial assistance under the Higher
Education Act of 1965, the following sources are not considered income for purposes
of determining student eligibility for Section 8 housing assistance:
. Perkins loans;
. Stafford loans; and.
. Plus loans.

Re: Mackinaw Village - Part Two
Dear Honorable Mayor and Councilpersons:
I hereby certify that the construction of the sanitary sewer, force main, lift station,
storm sewer, water main, tree buffer, paving improvements, trail (across Outlot
C), and certain sidewalk improvements (across a portion of Outlot B) for
Mackinaw Village - Part Two has been completed in substantial accordance with
the plans and specifications of the Engineering Division of the City of Iowa City.
The required maintenance bonds are on file in the City Clerk's Office for the
sanitary sewer, force main, lift station, storm sewer, and water main
improvements constructed by Dave Schmitt Construction Co Inc. of Cedar
Rapids, Iowa, and for the paving, trail and sidewalk improvements constructed
by City Wide Construction Corporation of Cedar Rapids, Iowa.

BY-LAWS
ARTICLE 1 THE COMMISSION
Section A. The name of the Commission is the Housing and Community Development Commission of
Iowa City, Iowa, as established by Resolution No. 95-199 of the City Council ofIowa City, Iowa, pursuant
to Chapter 403A, Code ofIowa (1995).
ARTICLE 2 PURPOSE
Section A. The purpose of the Commission is to assess Iowa City's community development needs for
housing, jobs, and services for low and moderate income residents, and to promote public and private efforts
to meet such needs.
ARTICLE 3 DUTIES
Section A. Duties of the Commission shall include: 1) assess and review policies and planning documents
related to the provision of housing, jobs, and services, for low and moderate income residents of Iowa City;
2) review policies and programs of the Public Housing Authority and Community Development Division
and make recommendations regarding the same to the City Council; 3) review and make recommendations
to the City Council regarding the use of public funds to meet the needs of low and moderate income
residents; 4) actively publicize community development and housing policies and programs, and seek
public participation in assessing needs and identifying strategies to meet these needs; 5) recommend to the
City Council from time to time amendments, supplements, changes, and modifications to the Iowa City
Housing Code.
ARTICLE 4 MEMBERSHIP
Section A. The Housing and Community Development Commission shall consist of nine (9) members
appointed by the City Council of Iowa City. All members shall be qualified electors of the City of Iowa
City, Iowa, and shall serve as such without compensation but shall be entitled to the necessary expenses,
including traveling expenses incurred in the discharge of their duties.
Section B. In order to satisfy the purpose and intent of this citizen commission, when possible, at least one
person shall be appointed to the Housing and Community Development Commission with expertise in
construction and at least one person with expertise in finance. In addition, when possible, the Commission
shall include one person who receives rental assistance.
Section C. The term of office for each member shall be three (3) years. In order to ensure a staggered
turnover, initial appointments shall be three (3) members for each of one, two, and three years respectively.
Section D. The Chairperson and Vice-Chairperson will be elected annually (in September) from the
Commission membership. The Chairperson shall, when present, preside at all meetings, appoint
sub-committees with the approval of the Commission, call special meetings and in general perform all
duties included in the office of a Chairperson and such other duties as may be prescribed by the members
from time to time. The Vice-Chairperson shall take over the above duties of the Chairperson in the event of
the Chairperson's absence.
Section E. Three (3) consecutive, unexplained absences of a member from regular meetings will result in a
recommendation to the City Council from the Commission to discharge said member and appoint a new
member.

Section F. If a position becomes vacant by reason of resignation or otherwise and results in an unexpired
term the Council may choose to fill the unexpired term in such a manner that the appointee shall continue in
the position not only through the unexpired term but also through a subsequent regular term.
ARTICLE 5 MEETINGS
Section A. Meetings of this Commission shall be on a regular monthly basis. A meeting date and time will
be established by the Commission. A regular meeting may be cancelled if no urgent business requires a
meeting.
Section B. Special meetings of the Commission may be called by the Chairperson and shall be called by the
Chairperson at the request of a majority of the membership.
Section C. Meetings shall be held in an accessible, public meeting place. Notices of meetings (agenda) for
all regular and special meetings shall be posted and distributed to members and the media at least 24 hours
before any meeting is held. All provisions of the State Open Meeting Law shall be followed. The
Chairperson or a designated representative, together with appropriate members of the City staff shall
prepare an agenda for all meetings. Agendas shall be sent to Commission members at least three (3) days
prior to the regular meetings.
Section D. A majority of the members of the Commission (five or more) shall constitute a quorum of any
meeting and the majority of votes cast at any meeting, at which a quorum is present, shall be decisive of any
motion or election.
Section E. There shall be no vote by proxy.
Section F. Time shall be made available during all regular meetings for open public discussion.
Section G. Minutes of all meetings shall be prepared and distributed to the City Council within three (3)
weeks of the meeting in the manner prescribed by the Council. Minutes of all regular and special meetings
will be mailed to all the Commission members during the week prior to the next meeting. Specific
recommendations for the Council shall be set off from the main body of the minutes.
ARTICLE 6 AMENDMENTS
Section A. The By-Laws of the Commission shall be amended only with the approval of at least a majority
ofthe Commission (at least five votes) at a regular meeting or a special meeting.
Section B. Policy changes or By-Law changes may be adopted at the meeting following the meeting at
which open discussion was conducted on the specific changes.

Recently a City Councilor inquired into the practice of asking applicants to HCDC whether, for
example, they are persons of color and recipients of rental assistance. Attached is a copy of
page 4 of the current application form.
The origin for the language in the application is probably the bylaws, a copy of which I am also
enclosing. Article 5/Section B of the bylaws provides:
In order to satisfy the purpose and intent of this citizen commission as required by the
U.S. Department of Housing and Urban Development, when possible, at least one
person shall be appointed to the [HCDC] with expertise in construction and at least one
person with expertise in finance. In addition, when possible, the [HCDC] shall include
one person who is a member of the Local Homelessness Coordinating Board, and one
person who receives rental assistance.
Please note the introductory phrase that states "as required by [HUD]." Perhaps HUD had such
a requirement in 1995, but there is no such present regulation. In distributing HOME funds, the
City must, as a "participating jurisdiction," follow its citizen participation plan, which is part of the
consolidated plan, a/k/a City STEPS. 24 C.F.R. 91.100-.115. The City's citizen participation
plan does not require certain groups to be represented. Tracy Hightshoe also inquired about
this, and HUD staff confirmed that the only current requirement of this nature is citizen
involvement in the consolidated plan.
The City Council resolution establishing HCDC, Resolution No. 95-199, a copy of which is
enclosed, also does not impose any such requirement.
As a result, there is no reason for the application to ask about skin color, age, income, or
disability, and I have recommended to staff that the application form be modified accordingly.
Additionally, given that HUD has no requirements, I suggest that the bylaws be amended to
delete the reference to "as required by [HUD]."
Although there is no legal prohibition against maintaining the present membership criteria in the
bylaws, HCDC may want to discuss how the "when possible" is implemented. Because City
Council does not, for example, recruit a person with expertise in finance or construction, it is
unclear to me how word gets out, so to speak, that a finance person is desired. In contrast, the
Board of Appeals must include members of a specific trade or profession including a plumber
and electrician. When the "plumber slot" is open, the City then specifically recruits plumbers.
One downside is that the position remains open on the Board of Appeals until a plumber applies
and is appointed.
If HCDC does wish to amend the bylaws, please review Article 6. The bylaws will need to be an
agenda item, as it is on July 20. At that meeting, the proposal can be discussed. At the
following meeting, there will be a vote on the proposal. The two-meeting procedure is unusual.

Additionally, bylaws usually require notification to all members of the proposed amendment. I
am enclosing an excerpt of the Senior Center Commission bylaws that contains a more
common amendment provision. HCDC may want to consider changing this provision as well.
If HCDC does pass a motion to amend the bylaws, the amendment is not effective until
approved by City Council. First, the two-member Rules Committee of the City Council will
review the proposed change and then Council will consider the proposed amendment.

BACKGROUND INFORMATION:
The City Council approved the preliminary plat for Part Four of this subdivision in January 2006.
Prior to the preliminary plat approval, a 'Grading and Development Agreement and Covenant' was
recorded for this property to resolve a violation of the flood plain regulations. Per this agreement,

a grading permit was issued with conditions that require further scrutiny and/or information prior to
conducting development activity. The applicants, Paul M. and Mary F Kennedy, are now
requesting approval for the final plat for this commercial subdivision on approximately 4.91-acre
land. The property is located east of S. Gilbert Street on Southgate Avenue.
ANALYSIS:
Conformance with Preliminary Plat:
Although the applicant has proposed a few changes, the final plat is generally consistent with the
preliminary plat. At the time of preliminary plat approval the subdivision included five lots, but the
applicant is setting aside lot 5 of the subdivision for future development as Outlot B. The
subdivision now consists of four lots all of which can be accessed only from Southgate Avenue.
The applicant has also proposed adding a small portion of land to proposed lot 2, by deducting
it from lot 1. Despite these changes the overall design of the subdivision remains similar to the
previously approved preliminary plat and complies with the code requirements. The construction
drawings have been reviewed and approved by the City Engineer, and the legal papers are
being reviewed by the City Attorney.
Access Control:
The city's access control policy aims to achieve enhanced safety and traffic circulation benefits
by limiting access to arterial streets. Accordingly, lot 1 will not have direct driveway access to
Gilbert Street, which is an arterial street. Because of the close proximity to the intersection of
Gilbert Street and Southgate Avenue, the number of access points on Southgate Avenue for
the proposed lots should be limited. To achieve this, shared access points are created, one
each for lots 1 & 2 and lots 3 & 4. The 50-foot wide section of Outlot B will serve as access
point for any future development on this outlot. To accommodate the need to widen Southgate
Avenue for tum lanes a 1 O-foot wide right-of-way along the south boundary of proposed lot 1 is
required. Outlot A is reserved for the dedication and is noted on the plat accordingly.
Environmentally Sensitive Areas:
The Sensitive Areas Inventory identifies that the property is in the Iowa River 1 DO-year flood
plain, and contains potential wetlands and upland woods. According to a notification from the
Corps of Engineers, no jurisdictional wetlands were found on the property and therefore the
potential wetlands on the property are not regulated by the Sensitive Areas Ordinance.
However, adequate storm water management measures are required to develop this property.
The plat shows an easement for the storm water management facility and other drainage
easements. The City Engineer has reviewed the plat along with the storm water detention
calculations and the grading and erosion control plan.
In a previous action, the applicant placed a substantial amount of fill on the property and re-
graded it, with no prior permit. As the property is in the flood plain, the Grading Ordinance
requires a permit to perform such grading or filling work. The City agreed to issue a permit for
this unapproved fill with conditions and entered into an agreement and covenant. According to
this agreement, prior to initiation of any development activity on certain portions (primarily on
proposed lots 3 and 4) of this property, a geotechnical report is required. This is necessary to
ensure the safety of any construction activity and structures on this ground. The area governed
by the agreement and covenant is delineated on the plat and recorded with County Recorder's
office. The legal papers should duly address this issue.
Infrastructure fees:
The property is subject to water main extension fees of $395 per acre (a total of $1939.45 for 4.91
acres) and the applicant/owner is required to dedicate land toward the right-of-way for future
expansion of Southgate Avenue (indicated on the plat as Outlot A).

STAFF RECOMMENDATION:
Staff recommends that this SUB06-00009, a final plat of Kennedy's Waterfront Addition, a 4.91-
acre, 4-lot commercial subdivision located on Southgate Avenue, be approved subject to legal
papers being approved prior to Council consideration.

RESOLUTION RESCINDING PRIOR RESOLUTION NO. 02-11 AND IN LIEU
THEREOF SETTING FEES AND CHARGES WITH RESPECT TO THE
ADMINISTRATION OF REGULATIONS OF TAXICABS, BY REPLACING
"VEHICLE FOR HIRE" REFERENCES WITH "TAXICAB"
WHEREAS, Title 5, Chapter 2 of the City Code of the City of Iowa City, Iowa,
established regulations for taxicabs and drivers operating such vehicles within the City
of Iowa City; and
WHEREAS, Council adopted an ordinance replacing the term "Vehicle for Hire," wit,h
"Taxicab"; and
WHEREAS, Taxicab Parking Stands occupy metered spaces and should generate
revenue estimated for that space.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA, THAT:
1. Prior Resolution No. 02-11 establishing certain fees and charges for vehicles for
hire is hereby rescinded effective March 1, 2007 and this Resolution adopted and
approved in lieu thereof.
2. The following fees are hereby established for taxicabs as follows:
a. Processing a company application: $20.00 for a one-year period expiring
March 1 unless suspended or revoked, with no refunds.
b. Issuance or replacement of a decal: $40.00 for each six month period
expiring March 1 and September 1 each year, unless suspended or
revoked. A $20.00 credit for each decal returned to the City Clerk will be
issued per company licensing year. If the City is notified by the insurance
carrier of cancellation of insurance, the decal will be removed and
returned to the City Clerk's office, with no refund or credit. The credit can
only be used within the licensing year and does not carry over to another
year or is not transferable to another company. No credit will be applied to
a company for a decal confiscated by City staff.
c. Issuance of driver's badge: $7.50 each driver specific to taxicab company
for a one-year period, or the remaining period of Chauffeur's/Operator's
License if under one year. Issuance of additional badges (duplicate,
another company or change of company) requests are $7.50 for the same
individual and the same expiration date.
d. Designation of a parking stand: Actual dollars earned from monthly
parking meter fee established by ordinance for the area.
e. All such fees shall be effective March 1, 2007.

3. The minimum limits for taxicabs liability insurance are to be quoted "individual"
liability amounts, or in lieu thereof as a "combined" liability amount, said liability
minimum amounts to be established at the following limits with a deductible not
to exceed $500, and shall also comply with all state and federal requirements if
greater:
a. "Individual" Liability Amounts
1) To cover the insured's liability for bodily injury or death of one
person, as a result of one accident or other cause, Five Hundred
Thousand Dollars ($500,000.00).
2) To cover the insured's liability for bodily injury or death of more than
one person as a result of one accident or other cause, One Million
Dollars ($1,000,000.00). If the taxicab has more than ten seats, the
insured's liability for bodily injury shall be Two Million Dollars
($2,000,000.00).
3) To cover the insured's liability for damage to or destruction of
property other than that of the insured as a result of anyone
accident or other cause, One Hundred Thousand Dollars
($100,000.00).
b. "Combined" Liability Amount
To cover the insured's liability for bodily injury or death of one or more
persons as a result of anyone accident or other cause, and to cover the
insured's liability for damage to or destruction of property other than
that of the insured as a result of anyone accident or other cause, One
Million Dollars ($1,000,000.00) combined. If the taxicab has more than
ten seats, the insured's liability for bodily injury shall be Two Million
Dollars $2,000,000.00).
4. The minimum limits for pedicabs and horse-drawn vehicle operator's liability
insurance are to be quoted as "individual" liability amounts, or in lieu thereof as
a "combined" liability amount, said liability minimum amounts to be established
at the following limits with a deductible not to exceed $500, and shall also
comply with all state and federal requirements if greater:
a. "Individual" Liability Amounts
1) To cover the insured's liability for bodily injury or death of one

amount of $320,000 from the City as part ofthe project financing for our Low-Income Housing
Tax Credit application to the Iowa Finance Authority to preserve 14 units of affordable rental

amortized at twenty years, We had initially asked for a loan in the amount of $250,000 to be

Increasing the amount of bond financing, at a lower rate, will decrease our interest expenses - a
savings we will be able to pass to tenant households in the form of lower rents.
The project addresses are:
424 and 441 Douglass Court
2160 - 2162 Taylor Drive
913 - 913 y, N. Governor Street
8 - 16, II -19,24 -32, and 27 - 35 Coneflower Court
I have provided the project financials to Kevin O'Malley including the financing sources and uses
and a 25 year investment proforma analysis.
The application is due to the Iowa Finance Authority on November 20, 2006. Initially the project
was to preserve 16 units. However, our duplex located on Hotz Avenue was severely damaged
by the tornado and is currently under repair. This project now includes 14 units of affordable
housing owned by The Housing Fellowship.
The units are eligible for a reservation of Low Income Housing Tax Credits (L1HTC). A for-
profit Limited Partnership will be established, with the Housing Fellowship as the Managing
General Partner. An equity investment of $1 ,031,800 will be raised through tax credit investors.
The investors then become owners within the Limited Partnership.
The Limited Partnership will purchase the units from The Housing Fellowship for $1,327,860.
The current debt on the units is approximately $450,000 (depending upon the date of closing).
Sales proceeds to The Housing Fellowship of$831,325 will be contributed as equity back into
this project. The remaining proceeds to The Housing Fellowship of approximately $52,535 will
be used for ongoing operational/administrative expenses. The Housing Fellowship has
experienced cash flow shortages over the last two years. The Board of Trustees resolved to sell a
duplex on the private market to generate cash. The sale in March 2006 resulted in the units being

used as market rate rental housing and reduced the number of affordable rental units in our
community.
Included in the project expenses is a developer fee in the amount of $300,000 that will be used to
implement and run the project. The developer fee is ]2.59% of the total project cost and is under
the 17% allowed by the Iowa Finance Authority. ]mplementation and oversight of the project
entails hiring the contractors and construction management of the rehabilitation of the units.
Accounting requirements will also require a significant amount of additional administrative work.
The project includes nine three bedroom and five two bedroom units that The Housing
Fellowship has owned for over ten years that are in need of rehabilitation. The structure of the
project will:
" Lower rents
" Put the units back on the property tax rolls
" Preserve existing affordable rental units
]n an effort to preserve affordable rental housing, the Iowa Finance Authority (IF A) sets aside 20
percent of the annual State L1HTCs for the preservation of qualified properties. Properties
qualiJy if the units have been owned by an entity for over ten years and have not previously
received a L1HTC reservation.
]F A administers the L1HTC program. Under the federal income tax code a credit is a dollar-for
dollar reduction in the tax liability for the property owner (i.e. investor). Low income housing
benefits from the tax credit primarily when the developer of a project, in this case The Housing
Fellowship, "sells" the tax credits to investors who contribute equity to the project in exchange
for an ownership position. These equity contributions, which are substantial, reduce the amount
of other financing needed to develop the project. The reduction of long term debt allows the rents
to be lowered. The transference of the units to a for-profit Limited Partnership will restore the
units to the property tax rolls.
Substantial rehabilitation of over $35,000 per unit will ensure that the units are in good shape for
the required fifteen year affordability period and will contribute to neighborhood improvement.
The tax credit program reQuires all projects to maintain adequate reserves for repairs and
replacement.
The Housing Fellowship has been consulting with the Iowa Equity Fund and Foundations
Development, LLC for technical assistance with the application for L1HTC. The Fannie Mae
Iowa Partnership Office provided a pre-development grant to pay for the technical assistance.
The Iowa Equity Fund will syndicate the credits to the investors and provide ongoing technical
assistance to ensure compliance with all program regulations during the required fifteen year term
of affordability. The Housing Fellowship has elected the option of a fifty year term of
affordability for the units. After the expiration of the required fifteen year affordability period, a
qualified non-profit (i.e. The Housing Fellowship) has the right of first refusal to purchase the
units from the Limited Partnership. As a certified Community Housing Development
Organization, it is the intention of The Housing Fellowship to ensure that these units remain as
affordable housing for the life of the buildings.
The 14 units are assessed at $],506,130. The projected total project cost is $2,383,]25. Proposed
rents for two bedroom units will be $525 or $550 and $763 for three bedroom units, considerably
lower than the net rent received through Section 8 of $560 and $823 respectively. In year one of
the project, the property taxes paid will be $]2,500 and would be expected to increase every year.
In addition to the investment of staff time to prepare the application, the process is an expensive
endeavor for a non-profit. There is a $1,000 application fee and a market study fee of$5,000.
However, the Board of Trustees believes that the benefits outweigh the risk and that this project
has been well planned and that the necessary experts have been consulted. Weare also confident
that we have the capacity to carry out the project.
In conclusion, our request is an opportunity for a local non-profit Community Housing
Organization, in partnership with the City, to preserve 14 affordable rental units through
substantial rehabilitation. The sources of financing for the project are equity from L1HTC, an
IFA loan, equity from the sale of the units to the Limited Partnership and the City ofIowa City.
Through use ofLlHTC equity and the establishment ofa Limited Partnership, the units will be
improved, rents will be lower and the properties will be returned to the tax rolls.

Sealed proposals will be received by the City
Cierk of the City of Iowa City, Iowa, until 10:00
A.M. on the ath day of November, 2006, or at a
later date and/or time as determined by the
Director of Public Works or designee, with notice
of said later date and/or time to be published as
required by law. Sealed proposals will be opened
immediately thereafter by the City Engineer or
designee. Bids submitted by fax machine shall
not be deemed a "sealed bid" for purposes of this
Project. Proposals will be acted upon by the City
Council at a meeting to be held in the Emma J.
Harvat Hall at 7:00 P.M. on the 14'h day of
November, 2006, or at such later time and place
as may be scheduled.
The Project will involve the following:
PCC Paving, HMA Resurfacing, Storm Sewer
Construction, Utility Modifications, Pavement
Markings, Retaining Wall, Traffic Control and
Permanent Signs.
All work is to be done in strict compliance with
the plans and specifications prepared by City of
Iowa City Engineering, of Iowa City, Iowa, which
have heretofore been approved by the City
Council, and are on file for public examination in
the Office of the City Clerk.
Each proposal shall be completed on a form
furnished by the City and must be accompanied
in a sealed envelope, separate from the one
containing the proposal, by a bid bond executed
by a corporation authorized to contract as a
surety in the State of Iowa, in the sum of 10% of
the bid. The bid security shall be made payable to
the TREASURER OF THE CITY OF IOWA CITY,
IOWA, and shall be forfeited to the City of Iowa
City in the event the successful bidder fails to
enter into a contract within ten (10) calendar days
of the City Council's award of the contract and
post bond satisfactory to the City ensuring the
faithfui performance of the contract and mainte-
nance of said Project, if required, pursuant to the
provisions of this notice and the other contract
documents. Bid bonds of the lowest two or more
bidders may be retained for a period of not to
exceed fifteen (15) calendar days following award
of the contract, or until rejection is made. Other
bid bonds will be returned after the canvass and
tabulation of bids is completed and reported to
the City Council.
The successful bidder will be required to furnish
a bond in an amount equal to one hundred
percent (100%) of the contract price, said bond to
be issued by a responsible surety approved by
the City, and shall guarantee the prompt payment
of ail materials and labor, and also protect and
save harmless the City from all claims and
damages of any kind caused directly or indirectly
by the operation of the contract, and shall also

ties, unit prices and extended dollar amounts.
By virtue of statutory authority, preference must
be given to products and provisions grown and
coal produced within the State of Iowa, and to

The Project wili involve the following:
Demolition and remodeling of two offices in
Housing and Inspection Services.
All work is to be done in strict compliance with
the plans and specifications prepared by the
Engineering Division, City of Iowa City, Iowa,
which have heretofore been approved by the City
Council, and are on file for public examination in
the Office of the City Clerk.
Each proposal shall be completed on a form
furnished by the City and must be accompanied in
a sealed envelope, separate from the one
containing the proposal, by a bid bond executed
by a corporation authorized to contract as a surety
in the State of Iowa, in the sum of 10% of the bid.
The bid security shall be made payable to the
TREASURER OF THE CITY OF IOWA CITY,
IOWA, and shall be forfeited to the City of Iowa
City in the event the successful bidder fails to
enter into a contract within ten (10) calendar days
and post bond satisfactory to the City ensuring the
faithful performance of the contract and mainte-
nance of said Project, if required, pursuant to the
provisions of this notice and the other contract
documents. Bid bonds of the lowest two or more
bidders may be retained for a period of not to
exceed fifteen (15) calendar days until a contract
is awarded, or until rejection is made_ Other bid
bonds will be returned after the canvass and
tabulation of bids is completed and reported to the
City Council.
The successful bidder will be required to furnish
a bond. in an amount equal to one hundred
percent (100%) of the contract price, said bond to
be issued by a responsible surety approved by the
City Council, and shall guarantee the prompt
payment of all materials and labor, and also
protect and save harmless the City from all claims
and damages of any kind caused directly or
indirectly by the operation of the contract, and
shall also guarantee the maintenance of the
improvement for a period of one (1) year(s) from
and after its completion and formai acceptance by
the City.
The following limitations shall apply to this

and subcontractors on City projects.
Bidders shall list on the Form of Proposal the
names of persons, firms, companies or other
parties with whom the bidder intends to subcon-
tract. This list shall include the type of work and

The Contractor awarded the contract shall
submit a list on the Form of Agreement of the

unit prices and extended dollar amounts. If no

RESOLUTION NO. 06- 355
RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS
FOR VARIOUS PURCHASES IN ACCORDANCE WITH THE ANNUAL OPERATING
BUDGET, CONTRACTS FOR PUBLIC IMPROVEMENTS WHEN THE ESTIMATED
TOTAL COST TO THE CITY DOES NOT EXCEED $25,000, AND CONTRACTS FOR
PROFESSIONAL SERVICES WHEN THE TOTAL COST OF SUCH SERVICES DOES
NOT EXCEED $25,000.
WHEREAS, pursuant tD Resolution No. 04-169, adopted and approved June 6, 2004 and prior
Resolution No. 96-180, adopted and approved June 11, 1996, the City Council authorized the
City Manager to initiate and execute, without City Council approval, contracts for and purchases
of commodities, operating services and capital outlay authorized by the Council budget, public
improvement contracts for which public bidding was not required by law, and contracts for
professional services (e.g. engineering, architect) where the total estimated amount does not
exceed fifty thousand dollars ($50,000); and
WHEREAS, section 380.4 of the Iowa Code requires that "a resolution must be passed to spend
public funds in excess of $25,000 on anyone project or to accept public improvements and
facilities upon their completion"; and
WHEREAS, because it is not clear whether 380.4 applies only to public improvement projects,
pending legislative clarification the City Manager's authority to authorize professional services
contracts without City Council approval should be reduced to $25,000.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. Resolution No. 04-169 should be and the same is hereby rescinded.
2. The City Manager is hereby authorized to initiate and execute, without City Council
approval, the following contracts in accordance with the annual operating budget as
approved by the City Council:
a. Purchases of commodities, operating services, and capital outlay.
b. Public improvement contracts where the total estimated amount does not exceed
twenty-five thousand dollars ($25,000).
3. In addition to those items approved during the budget process, the City Manager is
hereby authorized to initiate and execute, without City Council approval, contracts for
professional services (e.g. engineering, architect) where the total estimated amount
does not exceed twenty-five thousand dollars ($25,000).
