Comment: The City of Iowa City has been awarded a second
CDBG Supplemental Flood allocation totaling approximately
$1,300,000 from the U.S. Department of Housing and Urban
Development. The Public Hearing is for the Program Statement
which will outline the objectives and budget for the program.

Comment: On May 24/ 1994/ the Department of Housing and
Urban Development issued a Notification of Funding for the Devel-
opment of Public Housing. This would enable the Iowa City Pub-
lic Housing Authority to apply for acquisition of ten three.bedroom

Kubby I Just to remind people that we have decided to set up a
subcommittee: Larry Baker, Bruno Pigott, and Ernie Lehman will
be from the city council and I hope that we end up having
people from the DTA, people from Old Cap. Mall and maybe
someone who doesn't have any vested interest in this. One or
two people on a subcommittee to explore these issues.

Nov I So far I have gathered a few names of people that have
basically the same interest that Karen has expressed. Some
within the Mall and some out, some on the pedestrian mall,
some not and including a couple that really don't have any
interest in parking. I have had very much the same idea and
so far a number of people have said that if they were asked
they would serve. So we are getting there.

spreadsheet. The spreadsheet numbers were taken from the
figures that the city gave me. They are attached at the end
of the document. Frankly, I don't particularly care whether
you raise parking rates or not. I think the increase is
trivial. I park d.t. most every day. On a weekly basis it is
not really enough to even buy lunch for even one day. You
know, if you raise rates or not, it really doesn't make any
difference to me. But I am very distressed by one of the
claims that some of the d.t. business people made here a week
ago and in print yesterday. Which is that because you intend
to transfer these funds to support another program that
changes the nature of the fee that you are charging from a fee
to a tax. I think they know better than that. I think they
ought to be ashamed of themselves. It is not a tax, it is a
user fee. You don't park in the ramp, you don't pay the fee.
It doesn't make it a tax just because you don't agree with it.
And I am sorry that the DTA isn't here to hear this evening.
Perhaps one of you will pass it along. I do have several
suggestions there and that is why I am here this evening on
ways that you might raise a little bit more money which would
obviate the need to increase rates in the first place. First
thing you might do is just sell one of the ramps. As I
understand that argument by the DTA parking, they view parking
as a retail promotion activity. The city is not in a position
to conduct that sort of activity as far as I am concerned and
it seems to me that if you can all agree that that is what
parking is d.t. then you ought to turn it over to a private
operator. Sale of a parking ramp is going to net you $6
million probably. You could use that to payoff whatever debt
that is outstanding on that and use whatever is left to build
your reserves to fund a new parking garage. That is not a
very good alternative but it is one you might consider. The
second one is that you have a policy now in effect at the
Capital Street Ramp that says three levels of the ramp will
not be used during four hours of the day in order to provide
parking for shoppers at mid day. I suggest that if you repeal
that restriction you can generate another $44,000 in revenue.
That is an estimate that your staff made a year ago and it is
not going to hurt anybody. There may some conflicts again
between shoppers and long term parkers but that is a
management problem and I think the mall is going to have to
figure it out. 3-Might be to convert the Holiday Inn Parking
lot, that lot that is between city library and the parking
ramp at Dubuque and Linn Street. Convert that from permit
parking to short term parking. As I understand it there are
73 permit spaces there. You could easily move those into
Dubuque Street Ramp thereby retaining the permit revenue that
you now generate and provide 73 more spaces of short term
parking that would be very convenient to those businesses that
are located on the pedestrian mall that are not particularly

well served by Capital street and I believe there is one more
suggestion there and I can't remember right off the top of my
head.
Kubby/ The temporary lot at Burlington and Clinton.
Morrissey/ Yes. You had a proposal here a month ago by a developer
to build a building at the corner of Clinton and Burlington.
That project is apparently not going to go forward. Perhaps
you can convince the developer to clear that land and lease
that land to the city for some short period of time, 2-3
years, for a short to medium term parking lot on that lot and
provide some additional service near the Capital street Ramp.

Throg/ Sue, I would like to say something with regard to John's
presentation. I am really taken by your effort to analyze
this situation. I don't know that I agree with each point that
you have made but one of the things that I am struck by is the
passion of the argument that we have been presented with by
friends in the d.t. business community and customers who shop
d. t. The arguments have been very passionate but very lacking
in- Let me put it this way, they have been lacking in reasoned
argument. They have been held passionately but not backed up
by firm data or connecting evidence with the claims that have
been made. The point about how a parking fee increase would
cause a reduction in business. My sense is that there is a
lot of evidence nationwide that indicates that that would not
be the case. That the price elasticity for parking demand is
really quite trivial. A second point is we have heard that
customers think there is not enough parking spaces d.t. but we
also know that 30-35% of the Capital and Dubuque Street ramps

some good analysis and I really like you presenting some of
that material to us. And the only other point that I would
like to make is I do think it is really quite reasonable to
look for-to challenge the connection that we propose to make
between having this fee and SEATS. So we need to work on that
and I am quite happy to do the deferral because of all of
that.

Dean Oakes! I didn't really plan to say anything tonight but I have
a specific thing that I might mention. We ran Jackson's Gift
and China, my wife and I, for five years ending last summer.
six years, maybe seven. But we lost money. The business
couldn I t handle it. We couldn't make a prof it. People did not
want to come d.t. They did not want to park in the parking
ramp. I doubt whether they would want to park in the parking
ramp if you made it 25 cents an hour. They don't like it and
the city council years ago, as was pointed out in the letter
in the PC, guaranteed the d.t. business people parking. And
they have it but they have it in a ramp. A lot of the people
who would park d. t. 20-30 years ago wanted to park on the
streets and they still do. One of the best things that
Jackson's had was the alley behind them because people could
pull in and pick up their stuff in the alley. That was close.
If we'd had a street in front we would have had people dropped
off so they could come in and shop. Older people who didn't
want to walk very far. But the street was closed. I think if
you don't want people to shop d.t. anymore, just keep going
the way you are going and I think they won't. They will go to
the malls. They will go to the easiest to go to get the
products they want. We had a few products that people had to
come to us for. But they were fewer and fewer as the outlet
malls opened up. We had to close. Thanks.

pigott! Just for a second, Sue, I would like to say two things. 1-
You hear a lot about the cause and effect between increased
parking rates and the success or failure of businesses d.t.
And in the meetings that we have with our DTA friends I think
it would be useful to have more statistical information
showing that cause and effect. I am sure the businesses would
be happy to provide that. But just as an element for our
information I think that would be useful. 2-I would like to
say that I think it is also council's job to explain this

fact that it is not just SEATS that we are talking about. It's
our entire transit system. We have got to do a better job of
explaining how parking and our bus system fit together and how
transit is a combination of modes and how both affect

Dave Panther/ I am the owner of Hamburg Inn and if you noticed the
paper this morning. The Handicap Coalition came by the
restaurant yesterday and disappointed that we didn't have
handicap accessible entryway and it has been kind of a
frustrating situation not only for them but for us. During
our construction process our contractor in dealing with the
people we thought would give yea or nay on these things. It
is our understanding that the only way we could do this was by
a change of the law and I talked to Linda Gentry today and
they said that there is another procedure where we filed with
the city council to get an easement or something. I guess the
frustration is is that I see that I just got this memo which
she did which was dated April 21 and our fire was on the 17th.
Yet through this whole process it seems like there is a
different interpretation of the different governmental bodies
here of what is or is not the way to do this because this is
the first-Larry brought this up yesterday and was saying they
said Linda said this. That is not what we are hearing from
over here. I guess the thing is is that we weren't able to
put it in while we were closed and we certainly were willing
to and now we are still willing to but it is going to take
closing again to redo the doorway and we are certainly willing
to go through this process. I guess the frustration is is
there seems like there is not coordination here or there is
misinterpretation of what is or is not. So I guess if
anything can be done to make this easier I would appreciate it

Chamber of Commerce and I sent that to the Chamber. Did you
distribute it at all.
Panther/ Not that I know of. I take my own responsibility in this
too that if they sent it I didn't read it. I wasn't aware of
it. It is like my contractor who I am paying to do-he doesn't
even know this stuff and he is the one who goes down and deals
with getting the building permits and stuff and then they are
saying you can't have a building permit to do this and we
submitted a couple different-maybe we would tear out the
cement and slope it out. Well, they said no you can't have
that go out on the sidewalk. Well, we would like to put the
door flush. But no, you can't open more than a foot out onto
the street. And they said you know they are working on
changing the law to give you a variance on these things which
I thought was the only process we had until today.
Kubby/ We need to make sure that HIS understands this process.
Gentry/ This process could have been initiated months ago and it
would have been moving down the track at the same time as the
UBC amendments so that you could have been, even with the UBC
amendments, you still have to get an easement from the city
council. They are the only ones, as I explained to you, that
can give you use of public r.o.w.
Horow/ When can you initiate it.
Panther/ I just talked to you this morning. I am still kind of
confused about what I have to do other than maybe come up with
a plan.
Gentry/ Have your contractor come in and I will explain it. I will
walk the person through.

builders and I guess they have never done it.

Lehman/ The letter was really rather explicit but like a lot of
mailings that come to businesses sometimes they kind of reach
the circular file. My business-

of miscommunication that is a real problem and I just want to
make that statement that if the building inspector is aware of
it it is not being communicated that this easement procedure

mention. other than that, the letter as Bruno said something
about the letter. There was a promise of a letter being sent
out to all of the businesses. That was probably ten weeks
ago.

Throg/ Sue, Larry's point is that we committed ten weeks ago to
writing a letter and we haven't done it as a council. That is

Kubby/ Although last night we talked about a reason for backing off
on it was to let this consortium of people who are meeting. I
don't know what the name of this group is. That it is the
coalition for people with disabilities and it is some people
from the city and other people to ask-That we were going to
let them decide that that is a route to go and I don't know if
that was an appropriate decision or not but that is at least
the reason for backing off and letting that group have some
autonomy and have some-
Quigley/ Because I am involved in that group and also Dale Helling
is involved in that and other members of the community are
involved it is such a wide spectrum of people. I don't think
it is a realistic idea to try to wait for some consensus from
this group because we are trapped in a lot of decision making
problems to get organized and it is not specifically a city
issue. It is a community issue this task force is dealing
with and this is something that I have been asking the city to
do and so that is the way I see it. I see it separation there
between this task force and the city's obligation.
Horow/ That is your opinion and I think if we had just
dictatorially come out with a letter from council I, for one,
would feel very uncomfortable about that without having had
this task force have some input in that, Larry. I see what
you are saying. And obviously there is no problem of getting
a letter out but things take time to come to that recognition
factor and I would say that is probably where we are.
Quigley/ I am not asking anyone to dictate what needs to be done
and I don't think that is what we discussed.
Lehman/ Last night we brought this up and there was some concern
that the letter hasn't yet been written. I think we felt that
if the letter has any importance, if it has any weight, it
shouldn't come from the city council. It shouldn't come from
the Chamber of Commerce. It should come from anyone group.
It should represent the whole spectrum. Now if we can't do
that, yeah, we will do it. We will send a letter. But I think
it has a lot more weight if it comes from a group of folks who
represent the entire community. And if that doesn't work,
yeah, we can do that. We will send one from the city council
but I don't think folks will pay attention to that.
Quigley/ Well, there is a limit to the number of people that can be
involved in a process for it to get done.

Nov/ I will start discussion. I think that this is basically a non
issue rezoning. I think a voluntary rezoning is a non
controversial kind of thing because nothing is going to happen
to it yet. And I will vote for it. However I will be
reluctant to approve a subdivision development in this
particular area before we have gotten to the point of
approving the extension of the road and extension of the
sewers and all the other things that haven't yet been done. I
think we have done an awful lot of out of sequence development
in that area and I would like to avoid doing more.
KUbby/ When, Naomi, would you be adverse to the idea of increasing
the lift station at the landfill because that is a project
that is going to happen very soon and I think there is going
to be pressure on council to make that lift station bigger to
accommodate the needs of this parcel of land.
Nov/ I wasn't think of the lift station. I was thinking of the
southwest sewer interceptor project down the road a bit and
also we are not going to get to that end of Rohret Road
anytime soon. As far as I know our projections are to do part
of the road this year and part of it next year. But neither
part included that end. So, unless we revise everything,
nothing is happening there. I would prefer not to (can't
hear).

pigott/ First thing I would like to say is in a way it is a bit of
a dilemma. I don't think that necessarily restraining
development in this area is the point of this vote. I think,
however, the point of he vote is whether or not we have to
annex this land now. The southwest, in the staff report of
this staff report, mentioned the southwest area study
indicating that short term development potential is limited
there so that the need to develop that land is-the need to
annex that land I think is not necessary. Additionally, I
think that the annexation doesn't necessarily meet the
criteria listed for annexation of the area. A couple of the
criteria are listed. I have it written down here somewhere as
usual. One of them is that the area falls in the future
service area of the city and sanitary sewer capacity is
available. With a lift station it could in the future be
available. Since it is not now and since it would require
some changes in the lift station I don't think that at this
point and because the city can't provide gravity flow sewers
to the area, I don't think it is necessary to annex this area
now. Further more there are other areas that can be developed

within the city limits before we get to this point.
Encourages the sort of out of sequence development regardless
of whether it happens today or not that I don't want to
encourage. I think you can argue fairly well that an
annexation issue isn't necessary at this time. And I will
vote against it.

my-arguments one way or the other.
Throg/ I guess my general sense is I don't see any evident need
that annexation would be needed and that my sense is that
annexation, if the area was annexed and developed
subsequently, that that would increase cost to the city by
dispersing police and fire protection and transit service if
over any larger distance. Over large area I mean. So I am
inclined not to support the annexation. But does not mean that
I would vote against the rezoning to ID-RS if the majority
approved the annexation. I think ID-RS would make sense so
that extraordinary majority thing would not come into playas
far as I am concerned. And I would agree with what Naomi said
with regard to any subsequent rezoning. It would be very
appropriate to consider that carefully and I think RS-8
probably would be inappropriate given that location. So I am
going to oppose annexation but I would support the rezoning if
we got to that point.

occurs. Whether or not we projected this back in the '70s or
'80s or whatever, where the market dictates development to
occur is where it is going to occur and I think this area is
probably going to be an area where development will occur and
I think it is very very important that the city be able to
retain some control over what develops in that area. So I
will support the annexation.

determining to a great extent. But if we annex the land that
increases the development potential of the land. I don't want
to make a big deal out of than but in fact it would increase

second way the market does not purely determine all of this is

are basically saying this isn't going to develop. And so

Iowa city which is not in the city limits right now. So here
is an unfair question off of the top of my head. How much
land is out there in the projected future growth area that is
not part of the city limits right now. There is a reason for
this question.
Franklin/ I am looking at the map and trying to guess.
Baker/ Because we are dealing with what 18 acres here.
Franklin/ In that section which I am just going to take the
southwest part of Iowa city, from the Iowa River going north
and west to our current corporate limits. There is probably
over 600 acres.
Baker/ And it is currently zoned low density residential for most
of the county.
Franklin/ It is RS or A1. Mostly RS which is their one per acre.
Gentry/ It was my understanding that one of the reasons why the
city staff recommended approval for annexation was that we
wanted to have control over Slothower for secondary access.
I don't remember ever discussing that at this level. Is that
correct.
Franklin/ Well, at some point Southwest Estates is going to need
secondary access and Slothower Road is the likely secondary
access. However, given how things are developing out there,
the Kennedy Hilgenberg development around Weber School will
probably provide a more immediate secondary access. At some
point we will need to look at Slothower Road and the
improvement to it for the street network in this area
generally speaking. The rationale for the annexation had to
do with control of the development there and the fact that it
was within our growth area and it was a voluntary annexation.
Horow/ I remember talking about that in terms of Slothower Road
like in '84 or '85.
Franklin/ It has always been seen as a way to provide secondary
access to that area, sure.

being used in various ways here and one of the things I
started asking myself is how do you want to frame this issue.
Is it a growth issue. And we are talking, first of all,
geographic growth. But geographic growth is not necessarily
development growth and there is a real debate to be made about
growth and annexation policies. I am not sure that this
particular tract of land is the right sort of center to begin
that debate. When I asked Karin about the potential growth
area it suddenly dawned on me that if all of those property
owners of those 600 acres were to voluntarily seek annexation
to the city agreeing that we had no obligation to them to
provide roads, sewers, or anything else out of the sequence
that we have already established and they are willing to
accept the lowest possible density, I would be very tempted to
accept the annexation proposals because it does indeed provide
us control. I mean we could make a great political argument
about this but I think basically this is a very small issue in
which we are simply saying we will take this land and captive-
sit on it, look at it, treat it as an object of art. Whatever
we want to do with it. I am certainly saying that I think Mr.
Oakes understands this. There is no obligation on our part to
do anything out there other than what we are going to do in
our own time anyway. So I am comfortable now with this
annexation because I think it is a control issue and not a
growth issue.
Kubby/ What if he comes in with a plat next week just saying this.
Says I will provide the sewer and I will provide the street.
Baker/ If he is going to pay for everything I am inclined to let
him because we can begin that debate about extending other
city services. Not sewer and road because that has been taken
care of but police and fire and all of this other stuff. That
is an interesting debate and I have some real ideas about
whether or not that kind of growth puts that kind of strain on
those kinds of services. We can have that debate. I would be
glad to do it here or in a campaign somewhere.

our Housing Department and asked them to review this next year
because $30 is an arbitrary number. We just don't know what
this kind of review would actually cost the city. $30 is a
terrific bargain compared to the cost of going to the Board of

up next year, it is just the way life is and we have to
reconsider our feelings and make them realistic.

Avenue here in Iowa city. Let me pass out some photo copies of
materials provided to me by the U.S. Army Corps of Engineers.
There are 8 copies there. One is a fragment of an old plat
map that was provided to the Army Corps of Engineers to do a
jurisdictional wetlands determination on. The other page is
a photo copy of their determination letter. You are being
asked tonight to approve a preliminary plat for Kennedy
Waterfront Addition, for part of the Kennedy Waterfront
Addition. It is my contention that this plat has a serious
deficiency. The plat as you have it before you shows an area,
two small areas of jurisdictional wetlands to the west of
Gilbert Street at the south part of the tract. There is also
on the Corps of Engineers determination a large area of
jurisdictional woodland to the east of Gilbert Street. Last
night councilor Kubby raised the concern about whether the
alignment of Southgate Avenue, which is shown both in the
platted portion and the future development portion of this
plat, as extending east west through the south part of the
plat. She asked if that had any impact on any woodland. From
the preliminary plat in your possession it is impossible to
tell because it omits this eastern jurisdictional woodland.
I feel that for any good planning you need full information.
Both P/Z and the council needs the greatest amount of
information possible that is relevant to the topic. So, my
contention is that the plat has a serious deficiency.

Throg/ Sandy, I am not quite following you. What are you saying
that is omitted on the maps. When I look at the map I see
Gilbert Street right here and I see southgate running north-
east west right here. So what are you saying is omitted.

east of Gilbert Street and south of the future course of
southgate Avenue.

Rhodes/ That woodland is omitted on the plat, the preliminary plat,

submitted by the developer.
Throg/ They are not developing that particular-That particular
piece of property that encompasses the jurisdictional wetlands
that you are referring to is not part of the land being

Rhodes/ It is not part of the land being platted now. However part
of the land being platted includes Southgate Avenue on the
west side of Gilbert Street and that alignment is dependent on
the alignment on the east side of Gilbert Street. Therefore,
the information that councilor Kubby asked for last night is
quite relevant about whether it was going to have an impact or
not.
Horow/ I would like to ask a question, Mr. schnittjer. As I see
this map, which I appreciate Sandy, southgate Avenue is
extending from where southgate is now. In other words, the
potential southgate Avenue just keeps on going from the
existing Southgate Avenue and that doesn't hit the wetlands
that you address. IS that correct.
Larry Schnittjer/ That is right. The map that Sandy has colored is
the same map that I provided as a base map to the Corps of
Engineers so they could have something to show the delineation
of the wetlands. Southgate Avenue is shown on the preliminary
plat and it does not encroach on that particular portion of
the wetlands. If you look closely at the map that has got the
colored woodland areas on it you will notice some various
extraneous lines through that woodland area. That whole
development idea has been taken off until we determine what we
are going to do with that woodland. We are not touching the
woodland with Southgate Avenue and the extension to the east.
We are not doing anything in that area at all until we make
some determination of what is going to happen.
Nov/ I am assuming that when I look at this it is an older map
because it says this area is going to be filled in and you are
no longer planning to fill it.
Schnittjer/ That is right. We are no longer planning that until we
get some idea of whether we can make some mitigation that will
allow us to fill that or whether there is some other thing
that is going to happen. When we talked with the Corps of
Engineers folks they said this is a very low quality portion
of woodland. You can't do anything with it until you come up
with a mitigation plan. They would like to see us put money
into some other wetlands some where else and fill this in and
forget it. But I don't have the authority to do that at this
point.
Horow/ Because you are not dealing with that section.
Schnittjer/ That is right.
Horow/ So, am I correct in assuming that your purpose in bringing
this up is to get this in the record.

Kubbyl I am asking which way does the water flow on lot 10 & 11.
Schnittjerl The water flows on that particular area towards
Southgate Avenue and will go towards the pond and then
eventually seeps through the pond into the river. No-
southgate, then west, onto southgate to the pond, to the
river. Those area that are shown on the west side of Gilbert
street were illustrated because I have shown future
development in that area. We talked to the Corps of
Engineers. They said those areas constitute less than an
acre. All you need to do is get a permit to fill them and then
you can do it.
Novl I think we need to say at some point, for the record, nothing
gets filled here without permission from the Army Corps of
Engineers.
Schnittjerl And nothing has been filled without the permission from
the Corps of Engineers. Mr. Kennedy had a permit to do what
filling was done over the last ten years of the pond and then
the Corps of engineers said, hey stop[, we have got new
regulations. So he stopped and he got a permit to finish it
off.
KubbYI I do agree with Sandy's point, especially when it is the
same property owner. For us to look at the whole tract. I
mean even though that there is a different property owner I
think we should look at the whole tract when we know that
piece by piece it is going to be developed in the future.
Schnittjerl The reason it is not shown is that at the present time
I do not know how we are going to handle that particular piece
of ground. I didn't want to say that I was going to do one
thing and then end up in the future doing something else. So,
that was my logic and I don't-I have a copy in my records.
Chuck Schmadeke has a copy in his records from the Corps of
Engineers and they have their copy. It is well documented as
to what is there and the Corps provides copies to everybody
else.

Larry. It is a matter of-almost a matter of philosophy and
getting that philosophy into our regulations that we look at
whole areas when we do have these sensitive areas. Whether
they are high quality or not. They still serve a function.
Franklin/ Just a reminder, not knowing exactly which direction you
are going. This is a plat and I think this is pertinent to
what you are saying Karen or we are going to say the same
thing. That we don't have local law now regulating wetlands or
requiring them to show things outside the area of the
properties being platted. So it would take additional
regulations to get that as part of our process.
Nov/ Karin, one more question, do you think in this particular
instance that a plat such as this with yellow wetlands drawn
in would have made a difference on whether or not the approval
would have been granted by the P/Z commission.
Franklin/ They were aware of this wetlands issue, sandy brought it
to their attention. If that is your question.
Nov/ I had the impression from something that Sandy said earlier
that they had not seen this whole thing. So, now that I know
that they have seen it that is fine. Thank you.
Throg/ Could I ask sandy a question. Is there a good reason to
thin about wanting to preserve these particular wetlands east
of Gilbert.
Rhodes/ I can I t address that at all, Jim, because I have not
examined them. So, I don't know.
Throg/ I know Larry referred to them as low quality. I am
confident that that is pretty true. I do know I went on a
frog inventory out there about two years ago and I heard a
variety of frogs and that was rather interesting. I don't
know what to make of that. There is a declining frog
population, amphibian population worldwide so it is not
trivial.
Rhodes/ I have also shooed a snapping turtle off of Gilbert Street.
So they do have some biological value but I have never been in
them to look at them.
Throg/ You have no sense of the quality.
Rhoades/ Not at all. And I apologize, Naomi, if I gave you the
wrong impression. P/Z did see the color photocopy.

Comment: This Resolution authorizes the filing of an application for State
Transportation Enhancement grant funds. The funds would be used to
construct the Iowa River Corridor Trail between Sturgis Ferry Park and Napo-
leon Park. The total project cost is estimated at $500,000. This includes a
crossing of the river. Funding is from Transportation Enhancement Funds
($400,000) and Road Use Tax Funds ($100,000).

Horow/ (#6) city council Information.
Kubby/ It was brought to our attention a couple of weeks ago, maybe
a month ago already, that the parking fines are very
discrepant between parking illegal for a bicycle, which is a
$22 fine, and illegally parking a car which is $3 or $5, I
can't remember which. But I haven't heard back. We were going
to try to make that and I don't want to raise the car fee to
$22. I want to lower the bike illegal parking fee down to $3
or $5. We will get something.
Atkins/ We will prepare something.
Kubby/ Well, it is important that those things get fixed. The
other thing was is steve, if you would outline what we are
going to do in terms of the fare policy for SEATS since we are
going to change our policies starting July 1 and it is fast
approaching. I want to make sure people have time to do what
they need to do with some of the new policies will apply to
them.

Kubby/ I will say what the policy is. If you are a SEATS rider
that is ADA eligible you can get a monthly pass at a cost of
$36 per month and the reason that we came up with that is that
it is twice the rate of a fixed route pass which is $18 per
month. You could also get a ten ride punch card. So that will
cost you $10 because the fare is going to be $1.00. So ten
rides will cost you $10 but then you won't have to have money,
you will have a punch card. We will also have a waiver of the
$1. 00 fare for low income individuals. So if you are
receiving SSI, Medicaid, if you receive public assistance for
housing or if you qualify through property tax disbursement
claim program you can get a waiver and that means a waiver
also for the fare. If you qualify for that waiver, where does
someone go to apply for that waiver.

Nov/ I went to a little demonstration today of the University
Summer Rep and I highly recommend it. They are doing a
rotation of four plays by Beth Henley and she is very good.
So I am advising everybody to go to it.
Horow/ That reminds me. I would like everybody to go to Riverside
Theater this summer for the Young People's Edition of
Midsummer Night Dream. My daughter is stage manager.
Throg/ The only thing I would like of mention is I went to the Iowa
Art's Festival on saturday and had a absolutely wonderful
time. And I want to praise Michelle Coleman and Larry Echoldt
for organizing that and for all the other people involved.
Also I would like to praise Terry Trueblood and members of
the P/RE staff because we had a trash problem d.t and they
responded rather quickly to the cries for help from Larry and
others. So thanks to them. Also, I want to say I took part
in the community drum circle about an hour and I was beating
away on the base drums. It was great fun. There were hundreds
of people around. It was great fun.
Nov/ Did everybody bring their own drums.
Throg/ No. The organizers provided probably 50-60 percussion
instruments. It was great fun. So, I want to praise them for
organizing it.
pigott/ I have nothing more to add except that I had a wonderful
time at the Arts Festival. We had a debate Saturday afternoon
which everyone should know about. A debate between which is
better art or science and there was a biased crowd. I was the
moderator and as not a very moderate person sometimes I had a
bias but didn't let it get in the way. And I think the crowd
decided that we could make room for both art and science in
our lives.

Kubby/ As a high school science teacher and an artist I would say
that is a good conclusion.
Baker/ I am always. I just have a few things. I appreciated Jim's
comments about the frogs because where I grew up we were
eating frog legs all of the time. So if there is a source in
Iowa city we need to find out about it. Just kidding. I also
want to congratulate Bruno for his dance performance at Queen
Ida. They are still talking about that. We just got these in
front of us. The Annual Report of the city of 1993 and I
would like to call everybody's attention to the first page.

been blessed in Iowa city with attractive council members. I
think we have been keeping that tradition up. And now
seriously, I want to talk very briefly about this parking ramp
fee subcommittee. I talked to Ernie briefly last night about
a schedule and I just wanted to check with Bruno. We will
start vTith the possibility of a Thursday evening and if
everyone else could work with that would be a good time to
start. As soon as possible. I think Joe is getting stuff
together. I would like to try for next week if possible.

Horow/ I think I would like to someone chair who doesn't ride the
bus nor take a car. I think that would be kind of
interesting.
Nov/ There is also the possibility of operating this kind of thing
as the task force has been and they are getting along fine
with the facilitator and that could work for this group too..
Baker/ The structure is irrelevant. As long as we get together and
talk and one of the things I want to make sure the public
understands is the motor for this is the parking fee
discussion. But I think we all need to talk about if there is
some way to work on the perception problem of parking. If
there is anything else we can do as far as parking d.t. to
encourage people to take advantage of what is there and to
help the retailers out down there. And if a fee is coming it
should not be seen as something done in isolation that the
city is just imposing on people if indeed there are other
things the city can do in conjunction with the merchants. So
it is just not a discussion of how much money do we want to
raise rates if at all. It is what else can we do. Those are
the- I hope the public and the committee members bring ideas
on that as well.
Lehman/ When are we going to set that date because I am leaving
down next Wednesday afternoon.

to have a frantic July and the 15/16 of August if it would
help anybody in terms of setting their vacation time.

any change then perhaps we can schedule differently some
items.
Kubby/ Actually, I had one other item. council received from staff
a severe weather plan and when I first looked at it I thought
it was going to be how the general public should deal with
severe weather and there were some helpful hints in there but
what it really was was how staff can help other staff members
and the general public who are in city facilities at the time
of severe weather. So if you are in a city building when there
is some severe weather, our employees will be very
knowledgeable now after this plan has come out as to where you
should go for safety and what you should do. So go to a staff
member and you will know where of go it there is a tornado or
severe weather. I thought it was a very good plan.

Comment: This agreement stipulates that the Soil Conservation Service will
provide design services, contract administration, quality assurance during
construction, and 80% of the cost of certain repairs to Ralston Creek caused
by the flood of 1993, The repair to Ralston Creek is located north of Iowa
Avenue, east of Lucas Street. The estimated cost of repairs is $43,500, A
statement entitled" Assurances Relating to Real Property Acquisition", which
is part of the Cooperative Agreement, must also be signed by the Mayor.

This agreement divides the cost of repairs equally between the City, Governor
Properties and Psi Beta House Corporation of Chi Omega, The City's share
is estimated to be $2,900, which will be funded by the FY95 General Fund
contingency. This agreement also transfers all responsibilities relative to

Nov/ I think we have to say that this is a wonderful idea and Rick
Fosse is here. You can explain it if you like. I think it
ought to be on the record.
Fosse/ It is just a means of securing some federal money to work
with some private property owners to resolve a problem that
occurred last summer. The reason we are taking the initiative
to work with them is left unchecked, this problem will
eventually get into our r.o.w. and cause some problems for out
bridge on Iowa Avenue where Ralston Creek goes underneath it.
Nov/ I think we can also say that anyone who is having any problems
along Ralston Creek or river or drainage ditches that have
occurred since last year, Rick is the person who wants to hear
about it.

Horow / Rick, I do have a question about this. There are some
projects that we know of that we cannot get to this summer.
Are the funding sources that we are dealing with right now for
this flood-are they still capable of being used next summer.
Fosse/ One of the projects that comes to mind is the Oakland area
sanitary sewer problems and that one we are still pursuing
some funding from FEMA or possibly CDBG and I can't answer the
question for sure one way or the other but we are hoping that
it will still be available next year.
Horow/ I want people to be aware of this. We know that there are
more projects that have to be dealt with so we are looking for
other sources but also the scheduling of these, after the
design design phase is still on your agenda.

Avenue (located in Bryn Mawr Heights - Part Thirteen). Due to the non-
connected nature of Aber Avenue, the emergency services of police, fire and
ambulance have expressed concerns relative to future problems with respect

Comment: This is a two-year agreement providing for a 3 % across-the-board
wage increase at the beginning of each year, overlaying the Blue Cross/Blue
Shield Alliance program on the existing health insurance program, implement-
ing the 1993 job classification study, increasing the reimbursement to em-
ployees for safety shoes, providing rain gear for employees who regularly
work outdoors, and containing a number of other language changes reflecting
contract administration. This agreement is consistent with tentative agree-
ments reached by the parties during recent negotiations and as a result of

find that legal term. That we had knowledge of this in some
way and that it is not Baculis's fault that our city
departments weren't talking to each other and since I don't
think that there was any intent to not pay the bill and to do
anything to try to go around the city in terms of hooking
illegal or anything. There is no evidence of that that I
think that our policy of when there is a misbilling or
mispaying that half of the amount be agreed to.

Gentry/ Thanks to the state legislature the county treasurer will
accept money in any amount every month rather than as it use
to be.
Atkins/ But he has one year to pay it. Payment plan is
between him and the bank. He has to go borrow the money

Comment: In September of 1992, the City awarded contract to Sterling
Codifiers, Inc. of Weiser, Idaho, to reformat the Iowa City Code of
Ordinances. City staff has worked with Sterling on reviewing and updating
the present Code, and recommends adoption of the proposed Code with
minor amendments that are on file in City Clerk's office, A public hearing
was held on the proposed Code on May 10, 1994, and no one appeared,
Effective date of the proposed new Code of Ordinances is September 1,
1994.

COMMENT: This ordinance amends Chapter 32, section 32.1-63,
subsection 23-277. This amendment will increase
hourly parking fees in the captiol Street ramp
(Ramp A) from $.50 to $.55 per hour and in the
Dubuque Street ramp (Ramp B) from $.45 to $.50 per
hour. The intent of this increase is to provide
additional funds to the Tranist Division to fund
paratransit service (SEATS). The effective date is
August 1, 1994. Based on Council discussion at
their June 6, 1994 work session a additional
ordinance was prepared increasing the rates in both
ramps to $.30 per 30 minutes. The original ordinance
($.50 to $.55 and $.45 to $.50) had been deferred
until this time.
