For better or worse, the city is in the parking business. It is in possession of some extremely valuable real estate in downtown Iowa City. The city ought to run its parking system in a manner that generates a fair return on the city's significant investment in parking facilities. Unlike a private parking operator, you must balance your desire for financial performance with the community's interest in maintaining downtown as a viable retail center. As you've been told time and time again, that means cheap and convenient parking. These two objectives -- maximized revenue and cheap, convenient service -- are usually mutually exclusive. Your chances of making shoppers and taxpayers happy with the same policy are negligible. Complainers have a modest financial stake Should the council heed warnings by the downtown business owners about the alleged dire consequences of rising parking costs? If so, this is a mighty short tail wagging the dog. According to Parking Division figures, Park & Shop program revenues constitute about 10 percent of total parking system revenues, about 18-20 percent of total receipts at the Capitol Street parking ramp and only 3-4 percent of total revenue generated by the Dubuque Street parking ramp. (See charts, next page.) The modest direct financial stake in the city's parking system held by downtown merchants suggests that the city ought not weigh too heavily the shopkeepers' complaints. This is not a back-breaking increase. As I understand the original proposal, Park & Shop rates will not be affected by any rate increase. But there has been some indication by downtown businesspeople that the city has some obligation to help them reduce even this modest financial stake in the city's parking system. I suggest that the council cannot help those who will not help themselves. Merchants need buyers in their stores. The Park & Shop program only pays parking for those who buy from participating merchants. Any increase in this program's budget directly reflects quickened retail activity in downtown stores. Any business owner who complains about the rising costs of his Park and Shop participation is clearly not with the program here and ought to be ignored. , . i I No obligation to protect downtown merchants I ,1 On a related point, it has been suggested in print by the general manager of the Old Capitol Mall that the city has an obligation to protect the downtown retail sector from competition that mayor may not develop in Coralville or elsewhere. This is patently absurd. This manager apparently overestimates your powers. Not only can the city not provide such protection, it is not in the best interests of the city or even of the merchants for you to attempt to do so. It was suggested last week by former mayor Courtney that the current city council may not have a vision for downtown Iowa City, or at the very least, the current council does not share the vision of its predecessors 15 years ago. I" I'm inclined to believe the first point, but think the second is irrelevant to the current discussion. The vision of a redeveloped downtown Iowa City as a regional shopping center clearly did not foresee the burgeoning residential development in Coralville, northern Johnson County and southern Linn County, and the tremendous buying power that residents of these new areas possess. Nor did that plan comprehend the significance of the factory outlet phenomenon, as evidenced by the Tanger Mall in Williamsburg. But to now claim that the city council must stand by promises made nearly two decades ago under a completely different set of assumptions is ridiculous. 1 I I I The alleged threat of new competition Furthermore, why should the council concern itself exclusively with the threat posed to downtown retailers by a potential new mall development in Coralville? Why shouldn't this council be worried about the effect a new regional shopping mall will have on the Sycamore Mall, or any other major retail area inside the corporate limits of Iowa City? In fact, if there is genuine concern among Iowa City business people and city officials about the effect a Coralville mall might have on Iowa City, then a more reasonable approach would be to entice the developer to build this project inside the corporate limits of Iowa City. The KXIC radio park at the northwest quadrant of the Dubuque Street interchange with Interstate 80 might provide an excellent alternate site. This location offers easy access to shoppers from Coralville and northern Johnson County while also reinforcing Dubuque Street as a major entry to Iowa City. t:\, \;::J Suggested Solutions Sell one or more garages to private owners , J (-- Result: Private entities responsible for meeting parking demands , ':, , '; ,( ~ Revenue implication: · One time gain-- $6 million to $12 million . If the downtown merchants persist in their view that parking rates ought to be set as a tool for downtown retail promotion, instead of being set to gain a fair investment on the city's investment, then the city should actively explore the sale of one or more of its parking ramps to private entities whose sole purpose is to provide retail promotion. Potential buyers might include the management company that operates the shopping mall, the downtown association itself or some other entity. During the council's reconsideration of this policy last year, the Parking Division estimated that the policy would cause parking revenues in the Capitol Street ramp to underperform budget estimates by about $44,000. Lifting the morning restriction should result in additional activity during the earlier part of the day in spaces now unavailable for public use. @ Convert Holiday Inn lot to one-hour metered parking Result: Provision of 73 more parking spaces which provide easy access to shoppers to stores fronting the Pedestrian Mall and businesses along Washington Street which are underserved by existing short-term parking. ;,1' Revenue implication: . $50,000 additional annual revenue This lot currently has 17 short-term meters and 73 permit parking spaces. The parking division will renew permits later this month, so action must be taken on this proposal immediately. Permit parkers should be moved to the lower level of the Dubuque Street ramp, with the entrance off Linn Street used exclusively by permit holders. The city council's mistaken refusal to grant certain development incentives in connection with the proposed South Side Redevelopment District has resulted in several vacant storefronts on the southeast corner of Burlington and Clinton Streets. New development will eventually occur on this property. In the meantime, perhaps the landholder could be persuaded to clear these properties and lease the land to the city for use as a temporary lot for two or three years. As evidenced from comments made by Mayor Horowitz regarding Park and Shop at the June 7 City Council Meeting, we are constantly subject to various customer frustrations resulting from using the Downtown ramps. While we feel that the SEATS program is a valuable asset to the community, we would encourage the Council to find alternative funding for this program. We are strongly opposed to raising the rates, as this may be perceived by the public as another barrier to shopping downtown. . ., In light of the potential develop'ment of a Coralville mall, we feel it is time for the City Council to close ranks in support of commerce and the economic integrity of the Downtown Iowa City area. (4) Sideyards may be reduced up to 2 feet, but in no case shall a sideyard be reduced to less than 3 feet in width. (5) Other yards may be reduced up to 15 percent of the required setback. Any requests for modifications which ex- ceed the limitations set forth above and all other requests for modifications of the requirements of this Chapter require the filing of a special exception and/or vari- ance application with the Board of Adjust- ment. (d) Administrative Hearing and Notice Upon receipt a complete minor modifica- tion application, an administrative hearing shall be set. Ten (101 days prior to the administrative hearing, written notice shall be sent to property owners within 200 feet of the exterior boundaries of the property . (el Findings Following an administrative hearing, the building official shall issue a written deci- sion which recites the findings upon which the decision is based. The property owner shall record the decision in the office of the Johnson County Recorder. The building official may approve and/or modify an application, in whole or in part, with or without conditions, only if the building officials makes all of the following findings: (1) Special circumstances apply to the property such as size, shape, topogra- phy, location or surroundings. (21 The minor modification will not be detrimental to the public health, safe- ty, or welfare or be injurious to other property or improvements In the vicino ity and in the zoning district in which the property is located. (3) The minor modification does not ex- ceed the minor modification standards or allow a use or activity not other- wise expressly authorized by the regulations governing the subject property. (gl Burden of Proof The applicant bears the burden of proof and must support each of the required findings by a preponderance of the evi- dence. (hI Minor Modification Expiration A minor modification must be exercised within 180 days from the date of approval or the minor modification shall become null and void. (il Time Extensions For good cause, the building official may grant time extensions not to exceed a total of 12 months from the date of the deci- sion. Prior to granting an extension, the building official shall ensure that the minor modification complies with all current Zoning Code provisions. (jl Revocation The building official may revoke or modify a minor modification if anyone of the following occurs: (11 The' grantee has not' substantially exercised the rights granted by the minor modification. (21 The minor modification was obtained by misrepresentation or fraud. (31 The applicant ceases or suspends work on the improvement authorized pursuant to the minor modification for six or more consecutive calendar months. 141 The improvement authorized pursuant to the minor modificetion violates any applicable statute, ordinance, law or regulation. (61 The improvement permitted by the minor modification is detrimental to the public health, safety or welfare or constitutes a nuis8.1ce. (kl Appeals The applicant may appeal the decision of the building official to the Board of AdJust- ment. SECTION II. REPEALER. WHEREAS, religious institutions required to comply with Section 36.55(mlll1 of the Code of Ordinances must be located with access to arterial streets or on streets with paving wider than 28 feet; and WHEREAS, the additional access regulation for religious institutions is intended to keep local residential streets from being inundated by large amounts of traffic; and WHEREAS, in certain cases, a street classified as a collector street can accommodate the traffic generated by a religious institution; and WHEREAS, in lower density residential zones, religious institutions seeking to establish or expand must submit an application for a special exception to the Board of Adjustment, which considers public health and safety, impacts on the use and enjoyment of property in the immediate vicinity, and traffic congestion; and WHEREAS, the Board of Adjustment's review provides an additional safeguard against the expansion or establishment of a religious institution on a street with Insufficient capacity in the lower density residential zones. This is an Amendment intended for the benefit of First Mennonile Church and, not an Amendment in the general public interest. , 2. The Amendment may make sense for churches In low density residential zones. Jeff Davidson's report uses as examples Church's located on Phoenix Drive, far east Washington Street, and Village Road. None of those churches are located near the University and none, to my knowledge, rent out parking spaces. 3. First Mennonite is located close to the University and rents out parking spaces. The only simitar example which comes readily to mind is St. Andrews Presbyterian Church on Melrose (this may be in University Heights.) 4. With the tree examples that Davidson used, he may be correct when he states 'I do not perceive the churches on these collector streets to be causing inappropriate traffic conditions. That same statement may be inappropriate or Incorrect with respect to First Mennonite. 5. This is not a circumstance like may churches which generate most of their traffic on Sundays, and perhaps Wednesday evenings. 6. No one has mentioned any traffic studies having recently been done on Myrtle or in that area, therefore no one really knows how much traffic flow through that area in a day and whether ('" the 'First Mennonite' Amendment to the Zoning Ordinance Is appropriate. \ ~ I i 1 , I 7. In fact, no one knows how much traffic will be generated because the church has not made clear how it intends to use Its expanded facilities, e.g., it referred to operations of an on premise day care in Its written appeal, but retracted those comments at the hearing before lhe Board of Adjustments. 8. The neighbors to the north of Myrtle avenue have successfully petitioned to have a traffic conlrol island Installed to IImiltrafflc to the very narrow roads north of Myrtle. It would appear inconsistent to increase the traffic flow on Myrtle while trying to decrease traffic directly north of that location. WHEREAS, the sign regulations are intended to enhance and protect the physical appearance and safety of the community and to provide all sign users a responsible opportunity to display signs for identification; and WHEREAS, the current sign regulations permit awning signs in certain zones subject to individual signage allowances; and WHEREAS, permitting awning signs in the industrial, office and research park, and research development park zones would allow flexibility in the location of signage; and WHEREAS, awning signs should be similar in size and character to other permitted signs. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: SECTION I. AMENDMENTS. WHEREAS, the City no longer requires certain street right-of-way in some areas of the City; and WHEREAS, a portion of the Linn Street right- of-way located west of Gilbert Street and north of Benton is no longer needed for public access to properties in the area; and WHEREAS, the City is retaining enough right- of-way to accommodate an eight foot sidewalk along Gilbert Street; and WHEREAS, the City will retain a utility easement over the property.
