Date: August 22, 1994 To: City Council '~~ From: Karin Franklin, Director, Re: Harlocke/Weeber Rezoning Item As you will recall, the last time the Harlocke/Weeber rezon\ng was before the City Council in July, attorneys for the property owners requested deferral of the item to allow time for the property owners and the neighborhood to discuss zoning options. Some discussions have taken place, and resolution on some of the property may be forthcoming. However, total agreement has not been reached at this time. There continues to be disagreement about the Jensen tract, but there may be some settlement on the Ruppert property. Discussions are continuing. Also, there is need for an evaluation of the physical feasibility of the tentative agreement on the Ruppert tract. Jim Houghton, attorney for Mr. Ruppert, has requested that this item be deferred again to the Council's September 13 meeting. Mr. Knabe, "Multiunits are coming, We must go and tell the CO~l1,cil!" 94 JUL 28 PH 3: 1./ Ms. Cubby and a number of then Council members attended a Benton S1. neighborhood picnic some time ago. There was a CnYolfUi~~k of area development. A youngman, as the party was closing IQINIl\GbT~JO\ljAMr. Ruppert and said something like, "You know Charlie, I'm really happy with my place but all this building worries me. What do you intend to do with your property?" At this point you could have heard an ant's step on the tablecloth. Mr. Ruppert replied in his quiet, firm voice, "Well, you do have a beautiful place there...You know, different ones are coming up with plans all the time now. Some aren't going to be happy until every square acre of Iowa City is built on, leaving nothing for the future. You just sit tight, The right thing will come along, something to be proud of ... count on that." ,', The sky is not falling. Perhaps a fellow trespasser commented idly about apartments to Mr. Knabe who, thinking a piece of sky just hit his head, has excited his whole neighborhood. They are good people, but as Council records demonstrate when they: allow their children to play in the streets; to swim in run off filled with toxins washed from fertilized lawns, deadly anti-freeze and other hazardous substances dropped from numerous vehicles onto the roadway; bring children under 6 (whom responsible parents put to bed by 7 p.m.) to Council Meetings known lo last into the night; and become hysterical over traffic from what is now, has always been, and will continue to be without Council action, a closed street; they are using poor judgement. I li) I The real threat is the Council. Only Council action will extend Harlocke and increase traffic. No plans for developement exist, so WHERE IS THE MOTIVE FOR DOING ANYTHING WITH THIS AREA AT THIS TIME? Looking at a map of the area another fable, "The Fox and The Crow," comes to mind. In the Iowa City version, a clever Fox owns a 4 acre place on Weeber Circle possibly subdivided into lots which are not accessable except from an extent ion of Harlocke? He has grown tired of estate lot maintenance and secretly thinks of selling part of his property. Now he needs property nearby to be developed and he is tired of waiting for that to occur naturally. He frightens residents with talk of multifamily units and increased traffic and excourages a neighbor on P & Z to work for rezoning the area. Now the Council considers taking action favorable to the Fox. Action certain to increase traffic on Harlocke and injure those it is purported to help. .j,.! Mr. Knabe has his own and not the neighborhood interest in mind. He asks Council to take what our City Attorney confirmed is illegal action. Why does the Council ignore counsel? Do Council Members understand City liability policies generally don't protect them if they knowingly take illegal action? (six City Attorneys consulted) This wastes City time. We ask that THE CURRENT ZONING DE REQUIRED TO REMAIN IN EFFECT UNTIL A DEVELOPMENT PLAN IS PROPOSED and ANY , DEVELOPMENT PLAN BE JUDGED ON IT'S MERITS. Mr. Knabe should be advised to use his skill at working with people to work openly with his other neighbors. Definition of Hotel and Motel ',\ The current definition of "hotel" as set forth in section 36-4(h)(4) reads: A residential building licensed by the State and occupied and used principally as a place of lodging for guests. Hotels mayor may not provide meals and there are usually no cooking facilities in guest rooms. (see "hotel, apartment") 0" Similarly, the current definition of "motel" as set forth in Section 36-4(m)(5) reads: A residential building licensed by the State, usually located along highways, occupied by and used principally as a place of lodging for guests. The term "motel" includes "motor hotel." A hotel or a motel functions more as a commercial establishment than as a residential use. The Standard Industrial Classification (SIC) Manual published by the federal Office of Management and Budget in 1987 defines hotels/motels as "commercial establishments, known to the public as hotels, motor hotels, motels or tourist courts, primarily engaged in providing lodging, or lodging or meals for the general public." Parking spaces shall be furnished by providing spaces within a publicly- owned parking facility located within 300 feet of the hotel or motel, as specified by a written agreement be- tween the owner of the hotel and the owner of the parking facility; or one and one-quarter (1 )4) parking spaces for each guest unit on the same lot as the use served or within 300 feet. At the April 4, 1994, Planning and Zoning Commission informal meeting, during consideration of parking requirements and parking impact fees in the CB-5 zone, there was a brief discussion about including hotels/motels in the commercial section of the off-street parking regulations. At that time, staff recommended arnending the Zoning Ordinance to categorize hotels/motels as commercial rather than residential. This change would be consistent with the agreement made with the Holiday Inn during urban renewal. The parking requirements for hotels/motels already contain provisions for written agreements between hotels/motels and the City for the hotel/motel to provide payment for parking in public facilities. With hotels/motels currently located in the residential section of the off-street parking regulations, however, this provision is placed in conflict with the parking impact fee requirements for residential parking spaces in the CB-5 zone. Incorporating the hotel/motel parking requirements within the commercial section of the code would clarify City expectations for hotel/motel provision of parking, and would allow current agreements to continue. It would sustain consistency. Reclassify hotels from residential to commercial uses in the zoning ordinance. This text amendment to the zoning ordinance is being processed by the Department of Planning & Community Development. Melody Rockwell is the staff person in charge. The tentative schedule is for the Planning & Zoning Commission to discuss this item at its informal meeting on July 18, and formally consider action at its meeting on July 21. If action is taken, the zoning ordinance text amendment would then proceed to the City Council to have a public hearing set on August 2. Since Council has cancelled their August 16 meeting, the hearing would be set for the August 30 City Council meeting, If you request expedited action and the City Council approves, first consideration of the zoning ordinance text amendment could also be held at the August 30 meeting. Similarly, second and third consideration may be held at the September 13 City Council meeting if Council approves a request from you for expedited action. What I have described is the fastest this item could proceed. If there are any snags along the way, it will take longer, i -l Parking agreement. On the recommendation of the Director of Parking and Transit, the City Council has indicated a willingness to negotiate an agreement for parking with your group, similar to the Holiday Inn agreement. The next step is for your group to draft a proposed agreement indicating what requirements you will have of the City's parking system. Please forward this to me at your earliest convenience, and I will take it through the proper channels at the City. After we have negotiated a satisfactory draft agreement with you, it will be presented to the City Council for consideration. One additional item I would advise you to do, is to have your architect contact us regarding design guidelines for buildings in the CB-5 zone. The intent of the CB-5 zone is to encourage a relatively high intensity of mixed use commercial and residential development near the existing downtown area. It is thought that additional commercial (retail/office) uses adjacent to downtown will help maintain the vitality of the central portion of the city. Both the Central Business Zone ICB-10) and CB-5 zone currently allow dwellings to be located above the ground floor of another principal use permitted in these zones. It is generally good practice to encourage residential uses in and near the downtown to help assure that the area has a 24-hour population. This population helps ensure the vitality and safety of the downtown after business hours and provides customers for downtown businesses. There are currently several buildings in or adjacent to downtown which contain residential uses. Examples include Whiteway building on Clinton Street, buildings at 223 E. Washington Street, 218 E. Washington Street, and Ecumenical Towers, among others. I These examples illustrate that the theory behind the Zoning Ordinance indeed works in practice and these residential uses enhance the downtown area. However, there is the possibility that in the CB-5 zone, as currently structured, only token commercial uses will be included in a project. This may lead to an area that was intended for mixed commercial/residential uses being mostly devoted to residential development. This may thwart the plan of encouraging the expansion of commercial areas south of Burlington Street. The Belle/Breese building at 321 S, Linn Street, for example, contains 4,500 square feet of commercial uses on the ground floor along with approximately 12,000 square feet of parking area. The other three stories of the building are residential. This arrangement is permitted by the current CB-5 regulations. There is some question whether a building with this ratio of residential to commercial uses is desirable in the CB-5 zone. lit should be noted that unlike the other residential uses in the downtown area, Ecumenical Towers contains residences on the first floor. Any amendments to the zone should balance the goal of encouraging commercial/residential mixed uses in the area with the concern that only token commercial uses will be built. Staff prefers a solution that would require that the second floor of a building in the CB-5 zone be required to be devoted to commercial uses. Continuing to allow parking on the ground floor with the front of the building devoted to commercial uses will help assure that buildings have a commercial appearance at the street level. The additional commercial square footage on the second floor will help assure that the commercial uses in the CB-5 zone are not limited to a token amount of square footage. Allowing residential uses above the second floor will promote the vitality of the downtown area, and will contribute to the variety and inventory of the City's housing stock. Exhibit A contains staff proposed amendments. STAFF RECOMMENDATION: Staff recommends that the CB-5 zone be amended to require that the second floor of a building be devoted to commercial uses. The ground floor would continue to be available for commercial uses or a mixture of parking and commercial uses. Residential uses would be permitted on the third floor and any higher floors. The proposal about the CB-5 zone dated July 21, 1994(?) does not impact our building since we use all three floors for our office. With that in mind, I still feel that the proposal is another piecemeal attempt to do something with this area. Over the past several years the City has made piecemeal changes in the regulations for this area in an attempt to induce commercial development. It has not taken place. It is my opinion that the reason for this is that the City does not really have a nuts and bolts comprehensive plan for this area that was developed from solid information. Some years ago, I suggested to the Council and the Commission that a study of the demands for this area should be done so that the City would have the information it needed to evaluate any proposals for the area. The Council felt that it didn't want to spend the money. As a result the area is developing in a haphazard way. NOTICE OF PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATED COST FOR THE CONSTRUCTION OF THE SOUTH SITE SOCCER FIELD AND WASTEWATER PIPELINE GRADING IMPROVEMENT PROJECT IN THE CITY OF IOWA CITY, IOWA "';1 '" TO ALL TAXPAYERS OF THE CITY OF IOWA CITY, IOWA, AND TO OTHER INTERESTED PERSONS: Public notice is hereby given that the City Council of the City of Iowa City, Iowa, will conduct a public hearing on plans, specifications, form of contract and estimated cost for the construction of the South Site Soccer Field and Wastewater Pipeline Grading Improvement Project in said City at 7:30 p.m. on the 30th day of August, 1994, said meeting to be held in the Council Chambers in the Civic Center in said City. Said plans, specifications, form of contract and estimated cost are now on file in the office of the City Clerk in the Civic Center in Iowa City, Iowa, and may be inspected by any interested persons. Any interested persons may appear at said meeting of the City Council for the purpose of making objections to and comments concerning said plans, specifications, contract or the cost of making said improvement. '. ~ '.' RESOLUTION NO. RESOLUTION CERTIFYING UNPAID SANITARY SEWER SERVICE UTILITY CHARGES TO JOHNSON COUNTY FOR COLLECTION IN THE SAME MANNER AS A PROPERTY TAX. WHEREAS, Section 384.84 of the Code of Iowa provides that the City Council may certify unpaid charges for the services of sanitary sewer systems, sewage treatment, solid waste collection, water, and solid waste disposal to Johnson County, for collection in the same manner as a property tax; and WHEREAS, there exist unpaid sanitary sewer service utility charges for the Owners and properties specified in Exhibits A-1 and A-2; and WHEREAS, the Council finds that the property owner has previously received written notice of the date and time for the City Council's consideration of this resolution, at which time the property owner may appear before the Council and be heard concerning the unpaid charges; and WHEREAS, the Council has deferred this matter on several occasions, in an attempt to obtain a settlement of the unpaid bill which would be satisfactory to both parties; and WHEREAS, at its June 14, 1994 City Council meeting, the Council deferred this item for a sixty- day period, to again attempt to negotiate settlement; and WHEREAS, the Owner has rejected the City's settlement and the 60-day period has now expired. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: That the City Clerk is hereby authorized to certify to Johnson County, Iowa, the full amount of the unpaid sanitary sewer service utility charges, for collection in the same manner as a property tax, as stated in Exhibits A-1 and A-2 attached hereto and incorporated by reference herein.
