Any discussion. steve, I have a question. One of the items that is in here is the letter from Teg Drive Association. Would you be able to bring us up to date on where that is right now. Atkins/ We are in the process of preparing for you a policy position that will initiate new and different traffic control measures. As I am sure you can appreciate, when we write these policies they have to be uniform in a sense that they have to be applicable throughout the city. We have initiated within this policy review a process the use of stop signs as a means of regulating cut through traffic and all the other factors applied to the use of a stop sign. I would hope to give you that memo probably some time next week that outlines the policy. We have taken that particular stop sign policy and applied it to about six neighborhoods to see on just on a piece of paper how it works. It is not finished yet. It is not in a fashion that I am prepared to release it to you because we still have some additional work to do. But I would hope to have it to you by next week. I am making the assumption because the direction that you provided us that we would intend to contact a couple of neighborhoods and actually apply the policy to that neighborhood and inform them what they can expect. Horow/ will we send letters out to everyone in that area. I. ~ (:.;; \ Atkins/ What we did is we took the city and carved it up into sections, for lack of a better word. What we tried to do it take neighborhoods that were bracketed by either an arterial or collector and kind of square it off. In another words if we provided a unique traffic control instrument within the boundaries of those collectors and arterials we would then have some way of demonstrating whether it is going to work or not. We chase traffic out of that neighborhood then we should be experiencing increases along the collectors and the arterials. And so there must be 15-20 of those throughout the city and we have done this work on about six of them. That is kind of the plan right now. KubbYI I guess the thing that I am concerned about is I thought that we had directed that we look at some additional things besides stop signs as strategies- I assume that staff is working on that and that additional tools will be given to us with some options. ,/.'I "-( , I : I. And quite frankly Karen, it is just a matter of testing the thing. The stop sign as an option has been tested on paper, Now whether it is going to work or not we won't know until we go into the field and actually do it. Yes, we will be giving you other options. Kubby/ Okay, so what is the time frame on these additional options besides the stop signs. Atkins/ I couldn't tell you right now. I honestly don't know. I will try to get this one out to you. This one has taken a lot more time than we anticipated and as you know we are up against winter time now for some traffic signals. We will get them done. Horow/ Among the other items we have set a p.h. on 9/27 to discuss amendments to the 1994 Community Development Block Grant Budget and Final statement, Roll call-(Yes) Okay, the Consent Calendar has been adopted. Nov/YoU might also want to mention all the hearings on the 25th of October in the Consent Calendar. Horow/ Well, I considered that but I didn't want to read all of those. We have quite a number of-Okay. The p.h.s on October 25 having to do with parking facility impact fee ordinance. These amendments are the result of the council's discussion regarding redevelopment of the Near South Side and the revitalization amendments. Right. Kubby/ Which translates into abatements. Horow/ Council has spent a lot of time, as you know, working on the development-redevelopment of the area south of Burlington between Burlington and Court and between Court and the railroad area to the south. It has been a long haul but we are working on it and the p.h.s and the resolutions which will follow address how we see structuring that area to encourage economic development. Throg/ Sue, could I say one other very brief thing about that. Through no fault of the reporter of the newspaper article in the local newspaper this morning presented a fairly incomplete description of all the elements involved in the proposed package of components that we put together. You probably all have a letter from me about the proposal that I read about in the paper to discontinue the Seventh Avenue bus route. I am fortunate. I get to use Seventh Avenue, Court Hill and Towncrest bus routes and I am a daily user of the Iowa City Transit System which I think is excellent. The problem I see-one of the problems I see with discontinuing the Seventh Avenue route and I understand there is a lot of complexities with such an issue is that the ridership on Seventh Avenue, although it is light, during the past week averaged about 23 riders in the morning and that would mean that these riders would then have to transfer to the Court Hill and the Towncrest routes in the morning or other peak times and those buses are pretty much full right now. In fact I thought for several years that they needed some extra relief at 5:00 at the Court Hill route and I am just afraid that A-they are going to be packed like sardines and B-this will probably drive people or at least some of the riders into their cars and it is hard to get them out of their cars and back on the buses and I just hope that when this issue does come before you that you look at some of the consequences of discontinuing that service. To us it is maybe a stopping point and I don't know if staff has looked at it or what your feeling is. But we think that this particular issue should be addressed right now before you continue with anymore plans for this site. That is one thing. The other thing is there has been no well interference study done which means you don't know what the affect of putting wells in this site is going to do to the surrounding well owners. Kent Braverman/ I am an adjacent property owner to the same development that you are considering annexing and after going through in 1988 the agreement between the city and the county as to what would happen in our area an agreement was hammered out which was referred to by Aleda including opening up Sycamore and coming from the north if this were to happen and at the same time the agreement was that any development of this parkland would have the approval of the county and the residences around it in reference to where the soccer fields were which at this point in time according to the plan that was advanced in 1988 are much too close to my property without a buffer zone, a fence and some trees, etc. And also in this agreement which I am looking at at the moment there was reference to the amount of traffic that was going to be put on Nursery Land and on Sand Road at the same time which was contingent on opening Sycamore from the north at the same time you develop the property. But most specifically there is a two mile agreement between the county and the city which I am sure you are aware of that allows for those of us in the county and the county government to comment and approve of your development. And it seems to me that because you are'now coming out to annex and I might comment annex in a fashion that is not consistent with prior policy statements involving no jutting of annexation. This is an area that is coming out of the county that you own without annexing around it specifically. That you would consider the fact that those of us who are in the county are being dramatically affected by this plant and by the new proposed parkland should have direct input at any plans of doing it. So what I would ask for is that you, as Aleda did, abide by the agreement that was made between the county and the city at the tome and the specifics of that were to allow those of us in the county, specifically adjacent landowners, to approve or disapprove the plans that you have for the parkland that is going into affect. In that development there is a fairly extensive trail system, a lot of open space planned and a connection was provided to the north into the plain Village Green development. Alison Ames Galsted/ I am chair of the Human Rights Commission and I just would like to make some general comments about the chapter revision currently under consideration. Work on the proposed revision of Chapter 18 now Title 2 that is currently under consideration began back in the fall of 1991. The bulk of the work on this revision has been done in subcommittee. However, the commission, as a whole, has laboriously reviewed several drafts of the revision and discussed all of the significant changes in detail. I am very pleased to see the revision finally formally reaching the council although I know you have had several opportunities to review it in progress. Especially this past summer when the Commission sponsored two public forums on the revisions. Briefly, let me review our objectives. When we began the revision our objectives were to meet HUD's certification requirements regarding substantial equivalency with the Fair Housing Act, to eliminate repetition and inconsistency within the Chapter, to clarify and delineate commission procedures, to include a right to sue option in the complaint process modeled after the state code, and to expand the definition of family. The revision currently under consideration satisfies all the original goals with the exception of meting substantial equivalency with the Fair Housing Act. To the greatest extent we feel possible the Commission has, however, aligned the Housing portion of this Chapter with the Iowa state Code and the Federal Fair Housing Act. During the revision process it became apparent that there were other omissions and inconsistencies within the ordinance that needed to be remedied. Education, for instance, had previously not been addressed in the ordinance although the state code certainly protects that area, the area of education from discrimination, The Commission agreed that education is an area that needs to be addressed consistently across educational structures in Iowa city and should be addressed in the local ordinance and this has been added in this revision. Recognizing the need to expand the definition of family to be more inclusive in our community the Commission has added an article on domestic partnership to the Chapter. This article creates a domestic partnership registry with the city recognizing the importance of getting a mechanism for public acknowledgment of domestic partnerships. Thank you. On the two areas: the educational area and the domestic partner area. First one, education. The question has been raised to me and I have talked to Heather and Anne on it in private but I think it is something that should be discussed in public as well. Some comments have been made that this, since the Iowa city School District already has a very strong sexual harassment policy and program and process for grievance that there seems to be some redundancy there. why is it that you feel the necessity to include education when the school district already has a program. Would you comment on that. Galsted/ This doesn't in any way usurp that process, the internal process that can happen in the school district. This is just another avenue that complaints-discrimination can be addressed. Also we are not talking about just the public schools when we are talking about education. We are talking about private schools as well. And we are looking for consistency and that extra avenue. Baker/ One of the problems you sometimes have, not just with this issue but with all things that have p.h.s is people come back later and say I didn't know. I want to make sure that people do know. Nov/ I think our public school has an excellent plan. Their statements are very well written and their directions to their constituents, the public, students or staff, is if we do not satisfy you in house the next line of appeal is the state commission. Now we have created intermittent line of appeal because they can appeal now to the city and this is important, particularly for a low income parent. They don't have to go all the way to Des Moines pt this point if we adopt it this way. I think you did the right thing. Kubby/ Make sure that it also stated in the school plan, too, that you can go to the city and/or the state. I was asked by a member of the public to respond to a question that they had which I said I would do. And the question was why, related to the timing, why are we doing this or why are we able to do this at this particular point in time and why weren't we able to do it previously. And the answer to the question is that this is a very complex issue. It doesn't seem so when you look at it in this point in time. The regulations which govern these approach slopes are contained in a set of federal regulations. The federal government has taken control of all airspace and has exercised that control to establish certain requirements around airports. The regulation which governs this particular action is not one which is spelled out. It is one in which we arrived at by interpretation. And once we got the idea and our interpretation was made we forwarded that interpretation to the FAA in Kansas city to see if my interpretation of the rules is correct. They weren't sure and they had to forward it in turn to the FAA in Washington D.C. who ultimately responded that in fact that was the correct interpretation and we were able to proceed with this modification. And so I guess what I am saying is that it is the very complexity of this set of regulations which has contributed to perhaps not getting this done the instance that it was available to get done. It is one way traffic because cars are legally parked on both sides of the street. Is there some way. I don't know what the process is. But is there some way to get one side of that street permanently no parking. Kubby / But that eliminates odd even parking which there is a purpose. Last night we talked about a letter we received from a constituent regarding bicycles being confiscated from the meters along some of these streets and I wondered if steve, perhaps you could update us in what we talked about a little bit last, night concerning those issues. Atkins/ It had been sort of an annual event whereby the police would sort of make a sweep and remove bicycles and hopefully the intent was to discourage the strapping of bicycles to virtually every sort of public fixture imaginable in d.t., particularly parking meters. It is a fairly common complaint that we receive. The biggest complaints are that the bike is hooked onto a parking meter, I get out to pay, I have to walk around the bike, or if a park parallel to the curb, I bump into the bike. We have had bikes chained to bikes and it is more of ad. t. nuisance. We get merchant complaints. So what we do and we are going to do now and we won't be doing it for some time yet because we don't have the tags is we are going to tag bikes to sort of encourage better bikepersonship. pigott/ In conjunction with efforts to increase the number of bike racks in town. .~ k", lJr"I ," . They just simply haven't arrived yet and I can assure you when they come in they will get installed properly. pigott/ We talked about perhaps some experimental-some other things to do with meters and perhaps different ways to deal with it. Atkins/ I think there is a variety of ways to deal with it. You just have to get folks to- pigott/ And the city will also be experimenting with other ways to do that. I I" I ~. But I really admit to great frustration to walking on sidewalks d.t. or at the University and being almost run over by conrads on bicycles. There is a problem there. There is no question about that. Charlie Ruppert took part in the tour as did Bruce Glasgow as did some new residents to Iowa city as did some E.A. members as did some older folks who seemed not to be affiliated with E. A. at all. It was a very interesting ride and we had a lot of productive dialogue and conversation back and forth. I mean it was amazing to be on that bus and listen to the chatter and the buzz as we are going along from site to site. We got off at three different sites. One being the Northeast part of the city, another being the water plant and the third being the Near South Side area. Kubby/ We had received a letter from someone about the timing of a stop light at Burlington (can't hear). And I know Jeanette Ockenfels has been here maybe three or four different occasions and we have had other interest in making sure there is enough time on the walk and don't walk blinking time for people to functionally get across safely. I just realized, Mark your letter helped spur this next question, we have never, I don't think, directed our traffic engineer to look at this again and what affects it has on the other lights and how to do that. Atkins/ I did. I read that letter. I should have something for you by your next meeting. It is on its way. Lehman/ May I ask a question. Is the light longer if you push the button than if you do not. Atkins/ To my knowledge, no. It should make no difference. Nov/ Actually, if you don't push the button you don't get a way to cross. Or we-I don't know if is second consideration. I had a few people make comments about the thing wasn't clear about if you adopt an animal you are responsible for the feeding and care taking fees plus the adoption fees and the spay fees and the answer is no. If your animal is at large, like many of us on council-myself included, and your creature has been in the pound for three days, that is when you are responsible for paying the feed and housing costs. Not for when you are adopting it. I wanted to clarify that because a few people made comments. Novl This will be clarified in writing because it was vague the way it was written. Kubby / And lastly, I wanted to let people know about an event coming up this weekend, September 16-17, Friday & Saturday, the '94 Iowa Women's Music Festival. This is the first time the festival has occurred and there will be childcare provided for all the different events which include workshops, things as diverse as massage, country line dancing, as well as music and open mic all day. And some main stage entertainment at night. All women are encouraged to come regardless of ability to pay. It is fully accessible in terms of economics. And again, childcare is provided.
