ORDINANCE NO,
(
AN ORDINANCE AMENDING THE ZONING
ORDINANCETO REQUIRE THAT COMMERCIAL
USES BE PROVIDED ON THE SECOND LEVEL
OF BUILDINGS IN THE CB-5 ZONE.
WHEREAS, the Central Business Support
Zone, CB-5, regulations currently only require
commercial uses on the first level of a building;
and
WHEREAS, commercial uses are desired on
the second level of buildings in the CB-5 zone.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
SECTION I. AMENDMENT, Title 14, Chapter
6, Article E, Section 7, "Central Business
Support Zone," of the City Code of the City of
Iowa City, Iowa, be hereby amended by repeal-
ing subsection (c) and adding a new subsection
(c) to read as follows:
(c) Provisional Uses.
(1) Dwellings located above the street
level and the first floor above the
street level (second floor) of a struc-
ture that otherwise complies with the
requirements of this section, A maxi-
mum of three (3) roomers may reside
in each dwelling unit.
(2) Elderly housing, subject to the requ-
irements of Article L of this Chapter,
SECTION II. REPEALER, All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconsti-
tutional.
SECTION IV, EFFECTIVE DATE, This Ordi-
nance shall be in effect after its final passage,
approval and publication, as provided by law,

SPECIAL INFORMATION:
Public utilities:
Municipal water service is available to
the site, Sanitary sewer service will be
connected temporarily to a north-south
alley line east of the site, This force
main will be used until sanitary sewer
capacity is available in the Grant Street
line.
Public services:
Police and fire protection and solid
waste disposal services will be provided
by the City,
Transportation:
The site is accessible to vehicular traf-
fic via Sheridan Avenue. Transit ser-
vice is available on an hourly basis
during the day on the Seventh Avenue
route.
Physical characteristics:
Ralston Creek runs from south to north
along the east portion of the property,
West of the waterway, the remainder
of the property slopes down gently to
the north and the east.
BACKGROUND INFORMATION:
The final plat for Longfellow Manor, as proposed, is a 20-lot residential subdivision with a two
acre outlot labeled "public open space," Lots 1 through 20 are located along an interior cui-
de-sac street, Longfellow Place, The public open space primarily encompasses the floodway
area of Ralston Creek on the east portion of the property, A private horseshoe-shaped drive
runs along the rear of the 20 residential lots, and fronts the west edge of the public open
space,
ANALYSIS:
On April 21, 1994, the Planning and Zoning Commission recommended approval of the
preliminary plat for Longfellow Manor, subject to 1) the rezoning of the former electric
substation site from 1-1 to RS-S, 2) a determination from City Council as to whether an
ancillary agreement regarding the possibility of PCBs on the site will be required as part of the
preliminary plat approval, and 3) prior to the final plat approval, approval of the temporary lift
station and the sanitary sewer main and the accompanying maintenance agreement. The
conditions of preliminary plat approval have been addressed as follows, First, the rezoning
of the former electric substation site to RS.8 was approved on April 26, 1994, by the City
Council. Second, City Attorney Linda Gentry investigated the PCB situation on behalf of the
City Council, and determined there was "no sound reason to require additional testing of the
soils on the Longfellow Manor property." (See Gentry's May 16, 1994, memorandum,
Attachment 2,) Finally, maintenance of the temporary lift station and force main will be

handled through the Longfellow Manor homeowners association, Stipulations in this regard
have been incorporated into the subdivider's agreement accompanying the final plat.
The Longfellow Manor final plat has been reviewed and appears to conform with the general
requirements of the RS-S, Medium Density Single-Family Residential Zone. The final plat also
appears to be in general compliance with the City's subdivision regulations, Construction
plans and a grading plan have been approved for the proposed development by the City Public
Works Department, Legal papers have been submitted, and are being reviewed by the City
Attorney's Office,

The final plat for Longfellow Manor is in substantial compliance with the preliminary plat
approved by the City Council on May 10, 1994, However, the developer has eliminated the
following preliminary plat notation from the final plat: "The private drive easement around the
perimeter of Lots 1 through 20 shall also permit use of the drive for maintenance vehicles,
pedestrians and bicyclists," The preliminary plat showed an asphalt surface for the private
drive, which according to the developer, was intended to encourage use of the private drive
by pedestrians and bicyclists. The loop drive abuts the "public open space." It provides public
access to the open space, and is needed for City vehicle access to maintain the floodway
within this segment of Ralston Creek, Staff continues to recommend limited public access
on the loop drive; the easement note on the preliminary plat concerning maintenance vehicles,
pedestrians and bicyclists should be placed on the final plat and incorporated into the legal
papers for Longfellow Manor,

A. Issue
Several weeks ago neighbors in the Longfellow School area and the Longfellow Neighborhood
Association had questions concerning possible health hazards resulting from se,epage or
leakage from the transformer, which was previously located on property now known as
Longfellow Manor and being developed by Jim O'Brien, These inquiries were specifically
directed to two alleged "seepages" of oil from the transformer in the 1950s and the 1970s
because the oil contained polychlorinated biphenyls or PCBs - which are deemed a hazardous
substance when not contained within the unit for which they were designed, When asked
by you if the City had authority to demand a site assessment or evidence of a "clean site,"
I answered "yes" as a future property owner of the road right-of-way, which included the area
where the oil had been "spilled,"
B, Background and Investigative Procedures
The above questions were first brought to my attention by Melody Rockwell, Iowa City
Planner from the Urban Planning Division, Planning and Community Development Department.
She stated that information was given to Tom Scott, Chair of the Planning and Zoning
Commission, from Sue Scott (no relationl, president of the Longfellow Neighborhood
Association, concerning information from an Iowa-Illinois engineer named Dick Hodson. He
allegedly stated that oil containing PCBs leaked out of a transformer in the 1950s and 1970s
at the Iowa-Illinois substation formerly located on the Longfellow Manor property, When I
inquired of Tom Hoogerwerf, head of the lowa.lllinois office in Iowa City, he directed me to
Jeff Duffy as the engineer who would have the appropriate information. I spoke with Jeff
Duffy on several occasions and requested more specific information which would lead me and
the City Council to reasonably conclude the substation area was "clean" and thus presented
no liability for clean-up under CERCLA and no health hazards to the community at large,
I have now reviewed lowa.lllinois records including inspection reports dated July 5, 1973, and
May 25,' 1959; maintenance records dated 10/4/83 and 4/11/84, which reflect mineral oil
batch record samples of the oil in the transformer, with the samples being taken 10/31/83;
and an internal memo dated October 1983 and April 1984 concerning PCB analysis of the test
from the Sheridan substation for the transformer pot head compartment, tap changer
compartment and the transformer itself.

I have also reviewed correspondence from Jeffrey F, Duffy, Superintendent of Distribution in
the Iowa-Illinois office and dated 12/9/93, together with two letters from Iowa-Illinois attorney
Cathy S, Woollums dated 4/12/94 and 5/5194, I have also reviewed a memo dated March
22, 1994, from Jeff Duffy regarding asbestos removal which concludes:
"Enclosed are copies of all the disposal records from Iowa-Illinois Thermal
Insulation regarding the Transite removal. This portion of the abandonment
project is completed,
..,I'll contact you one last time after we remove the transformer, The site will
be yours after that operation is completed and all the money and paperwork are
finalized, "
More recently, I reviewed a University of Iowa Hygienic Laboratory report dated May 5, 1994,
concerning soil testings for PCBs from the area which the City oflowa City will own as public
right-of-way, together with a letter from David Larabee-Zierath of the Hygienic Lab, also
concerning the PCB soil test in the future City right-of-way area,

I also talked with the following persons regarding the PCB "seepage" from the transform~{i,
Calvin Lundberg, Environmental Specialist for Hazardous Waste Cleanup, Iowa Department'
of Natural Resources (IDNR); and Dave Phippe, Engineer in the Toxic Substance Control Act
, section (TSCAI of the Environmental Protection Agency (EPAl, Kansas City, Kansas office.
Marsha Bormann also spoke with Dave Phippe, and prepared a memo to me dated May 9,
1994, regarding "measurable levels of PCBs" for spillage, I also spoke with Cathy Woollums,
Iowa-Illinois attorney concerning records of spillages, or absence thereof, in order to
demonstrate there were no reportable seepages of PCBs from the transformer, Finally, I spoke
with Jim O'Brien, developer, and his attorney, Dave Poula, on numerous occasions concerning
the City's right to require testing for possible PCB contamination, and forwarded my detailed
memo on the law concerning the Comprehensive Environmental Response, Compensation and
Liability Act of 1980 (CERCLA) to Dave Poula, FYI. As you know, CERCLA gives the City the
right, as future landowner, to demand a "clean site" be demonstrated prior to acceptance of
the public right-of-way. I explained this law to both Poula and O'Brien on several occasions,

C. Findings and Recommendations

Based on the information provided to me, I make the following findings:
1.
The transformer formerly located at the 1300 block of Sheridan Avenue in Iowa City,
Iowa, ("Transformer") was inspected regularly by Iowa-Illinois and contained poly.
chlorinated biphenyls (PCBs) as a coolant because fireproof. PCBs are commonly
referred to by the trade name of "Aroclor,"

EPA has reserved to itself the regulatory authority over PCBs as hazardous wastes
under CERCLA by virtue of the Toxic Substances Control Act or TSCA. As you know,
the EPA generally has referred other regulatory matters for hazardous waste disposal
and cleanup to the states.

Conversely, the state DNR has expressed no interest in regulating PCBs in Iowa City,
deferring to the EPA TSCA/Kansas City, Kansas,

3, PCBs are "safe" if contained within the unit for which they were designed, but are
cause for some concern upon release from the unit or upon disposal.
4. Sample tests taken in September 1983 and November 1983 of the Transformer, as
measured in PCB levels of parts per million ("ppm"l and listed on the "mineral oil batch
record" (attached) were as follows:

5, Jeff Duffy's review of Iowa-Illinois records show two incidents of oil seepage from the
Transformer on 7/5/73 and 8/7/74, see Duffy's memo dated December 9,1993.
6. Cathy Woollums states in her letter dated May 5, 1994, that Iowa-Illinois' record-
keeping practices and procedures, with respect to oil changes in the Transformer, were
as follows:
"Iowa-Illinois' standard practice is to maintain records when a transform-
er or transformer 011 is changed out. We have searched our records and
found no record of transformer or transformer oil change out at this
particular substation. As such, the absence of records would indicate
to a reasonable degree of certainty that the same oil was in the
transformer in 1973 as in 1983."

Based on the Iowa-Illinois practice of record-keeping, it seems reasonable to conclude
that the PCB level in the oil in 1973 was likely the same strength as the reports dated
1983, More importantly, Section 761,124 of the pertinent federal regulations states
as follows:
"The concentration of PCBs spilled is determined by the PCB concentra-
tion in the material spilled as opposed to the concentration of PCBs in
the material onto which the PCBs were spilled, Where a spill of
untested mineral oil occurs, the oil is presumed to contain greater than
50 ppm, but less than 500 ppm PCBs and is subject to the relevant
requirements of this policy." [Emphasis added,]

This means that even though the oil in 1973 was not tested, the federal regulations
presume that the oil contains less than 500 ppm PCBs.
8, Even assuming the oil seeped from the Transformer onto the ground in the 1950s or
1970s, cleanup would only be required of samples dug at ten inches below the surface
tested at ten or more parts per million, see Marsha Bormann's memo dated May 9,
1994, This memo is based on information from Dave Phippe, the EPA engineer from
Kansas City, Kansas, which has regulatory authority over PCBs in this area.

Tests done by the University of Iowa Hygienic Lab show that six (6) out of the seven
I7l samples taken from property which will be City right-of-way measured less than
5 ppm, and one measured 6 ppm, see attached, These samples were taken under the
"supervision" of Dave Eilas, Wastewater Treatment Plant Superintendent.
This means that the soil samples tested "clean" under EPA regulations for PCB parts
per million, for both cleanup and disposal purposes.
10, I confirmed with Dave Phippe that the "milligram per kilogram," as listed on the
Hygienic Lab report is the same as "parts per million."
11, Samples from the Ralston Creek area showed" ..,no PCBs at or above our detection
limit of 5 mg/kg," see Hygienic Lab letter attached,
12, The measurable level of oil with PCBs, once released onto the concrete, should have
been tested for PCBs at a level of under 50 parts per million (see Marsha Bormann's
memo, first paragraph),
13, The EPA then considered whether the 1973 seepage onto the concrete, for disposal
purposes, should be dealt with according to today's regulations, Dave Phippe
acknowledged that the PCB level was no doubt considerably diluted in the concrete,
but his concern was that the concrete should have been tested as to whether it should
go to a landfill, or a hazardous waste site,
14, If the concentration of PCBs in the concrete tested over 50 parts per million, the
concrete should have been disposed in a hazardous waste site. Otherwise, the
concrete should have gone to a landfill, This is no longer possible because the
concrete has been removed by Johnson County and presumably used for ditch and
road fill,

15, In a word, if the "seepage" of the transformer oil onto the concrete had occurred today
or more recently, the EPA would have required disposal of the concrete according to
the rules set forth above, namely testing for 50 parts per million PCBs, and disposal
accordingly,

16, The Iowa-Illinois documentation goes to great length to discuss cleanup requirements
of PCBs and the absence of any records for PCB spills, but says nothing about disposal
of either the concrete or the soil over which the transformer was placed,

17, Nonetheless, with the EPA having reviewed the facts, including the fact that the soils
underneath the transformer concrete tested "clean" under EPA regulations (less than
ten parts per million PCBsl, and the fact that the land owner took extraordinary
measures to test the soil, the EPA found that the likelihood of harm presented a
minimal health risk. especially since the concrete was now dispersed throughout the
county as ditch fill or road fill.

18, Moreover, the EPA also found that the owner (Jim O'Brienl did more testing than what
ordinarily had been required for the soils located under the concrete Transformer pad,
which now tested "clean" under EPA standards, Thus, weighing all these facts, the
EPA has chosen not to pursue the already disposed-of and distributed concrete,

In sum, there is no sound reason to require additional testing of the soils on the Longfellow
Manor property. As potential land owner, the City of Iowa City has now been assured that
the PCB levels in the soil are well below the ten parts per million threshold of concern for
human health and safety,
Also, as seen in the State Hygienic Laboratory report and letter, even the soils near the creek
showed no PCB levels - which is doubly good news for the City of Iowa City. Thus, I
recommend no further testing, and instead find that the City can assume olJYnership of the
public right-of-way with a reasonable degree of certainty that no health hazard is presented
to either the public at large or the neighborhood,

AN ORDINANCE TO AMEND CHAPTER 27, IOWA CITY CODE OF ORDINANCES, 'PLANNING'
BY ADDING ARTICLE VI, DESIGN REVIEW,
WHEREAS, the City of Iowa City continues to carry out an urban renewal project
known as Iowa R-14, and
WHEREAS, the City of Iowa City established a design review process when evaluating
projects within the urban renewal area, and
WHEREAS, the City of Iowa City deems it necessary and appropriate to establish
formal design review procedures and guidelines to use when evaluating projects within the
urban renewal area and to assist the City of Iowa City with other urban design related
projects,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION I. AMENDMENT, That Chapter 27 of the Iowa City Code of Ordinances is
amended by the adoption of the following new article:

ARTICLE VI. DESIGN REVIEW
Sec. 27.91. Purpose and intent
The purpose of this article is to:
(a) Promote the public health, safety and general welfare of the citizens of the City,

(bl Promote orderly community growth, protect and enhance property values, and encour-
age both harmonious and innovative design,
(c) Protect and enhance the social, cultural, economic, environmental, and aesthetic
development of the community.
(dl Recognize environmental and aesthetic design as an integral part of the planning
process,
(e) Recognize that land use regulations aimed at these objectives provide not only for the
health, safety and general welfare of the citizens, but also for their comfort and
prosperity, and for the beauty and balance of the community, These objectives are,
therefore, the proper and necessary concerns of local government.

Sec. 27.92. Applicability
(al The City Council shall designate, by ordinance, areas of the City as areas subject to
design review. Projects located in the following areas and which include any exterior
alterations or new construction visible from a public right-of-way shall be subject to
the design review process:

(1) Urban Renewal Project, Iowa R-14, Exterior alterations or new construction
occurring on all parcels that were acquired and/or disposed of by the City of
Iowa City as part of the urban renewal project known as Iowa R-14. Also,
public right.of.way improvements occurring within and adjacent to the urban
renewal area designated as Urban Renewal Project, Iowa R.14,

(21 City Plaza. Projects designated as requiring design review by Chapter 9.1, City
Plaza Ordinance, Iowa City Code of Ordinances and public improvements to
City Plaza.
Ordinary maintenance or repair that does not involve changes in architecture and
general design, arrangements, texture, material, or color are exempted,
(b) The City Council may request advice and recommendations from the Design Review
Committee on projects located outside of designated areas.
(c) Property owners in the CB-10, CB-5 and CB.2 zones may request advice from the
Design Review Committee, but such advice shall be purely advisory,
Sec. 27-93. Procedures
(a) Initiatinq review, Prior to issuance of a sign permit for an exterior sign or of a building
permit to alter the exterior of an existing structure subject to the design review process
or to construct a new building that is subject to the design review process, the project
shall require the review of the Design Review Committee and the approval of the City
Council.
(bl Desiqn auidelines for review of applications, Design guidelines adopted by the Design
Review Committee and the City Council, and found in Sec. 27-95 of this Article shall

(11 ,Preliminary review, Prior to application for a permit, the applicant may request
preliminary review by the Design Review Committee to discuss basic intentions
and plans before investing time in detailed designs. This step is optional but
recommended for large or complex projects. The applicant is encouraged, but
not required, to submit the application materials listed in Sec, 27-94 of this
Article

Application submission, Prior to or upon submittal of an application for

Committee review, The Committee's findings on each application shall
be set forth in a formal motion either recommending approval, recom-
mending approval with conditions, or recommending disapproval. A
majority of votes cast at any meeting at which a quorum is present shall
be decisive of any recommendation, The Committee shall then forward
its recommendation to the City Council.
c, Citv Council review. The City Council shall, after receipt of the recom-
mendation of the Committee, or after the time of any extension thereof
has passed for the Committee to file their recommendation, make ap-
proval or rejection of the application, City Council approval of the plans
shall require a majority of votes cast at any meeting at which a quorum
is present. The City Council's findings on each application shall be set
forth in a written resolution, to be filed in the office of the City Clerk as
public record.

Revisions to Approved Design Plans.
If the building application deviates from approved design plans, the Department
of Housing and Inspection Services shall inform the Design Review Committee
staff person who shall then determine if the proposed changes are substantive.
Substantive changes to approved design plans require submittal of those
changes to the Design Review Committee and the steps of this section fol-
lowed,
Sec. 27-94. Submittal requirements
(al Preliminarv review submittal reauirements. Preliminary submittals may contain any
elements called for in the final application submittal section, at the option of the
applicant.
(b) Final application and review submittal reauirements. The following are submittal
requirements for all projects subject to design review. Ten copies of all drawings and
written materials must be submitted along with the design review application. These
drawings may be design drawings, though construction (working) drawings may be
substituted for design drawings. All submittal documents should follow accepted
conventions of drawing namely all drawings should be clearly labeled, scales shown,
north arrow on plans, clear and readable linework, and should be as clear as possible.
In addition to the following submittal requirements, each application shall contain the
name and address of the applicant, address of the project, name and address of the
property owner, a project description, and a project time schedule, Proposals shall not
be presented open-ended, and neither staff nor Design Review Committee shall design
the project,

Provide at least one sectional drawing at a suitable scale to show relationship
of buildings to the site, public street and parking area,
(5) Signs
Provide a scaled drawing of each proposed sign with exterior dimensions and
mounting height. Give total area of each sign,
a, Draw or provide sample of letters and logos, and the full message to
appear on the sign.
b, Describe materials and colors of background and letters,
c, Give means and magnitude of illumination,
(6) Lighting Plan
Provide a site lighting plan, which can be combined with other required docu-
ments, indicating location, type, fixture height, power rating and shielding
methods, Show elevation drawing or manufacturer's photo of each fixture,
including its material and color.
(7) Additional Information
Additional information, drawings or other materials necessary to describe the
project may be requested by the Design Review Committee staff person or
Design Review Committee depending on the nature of the project or site. The
applicant may include additional information or materials such as sketches,
videos, models or photos if they help explain the proposal.
The Design Review Committee staff person may, at the staff's discretion,
waive any of the submittal requirements if the nature of the project warrants,
Sec. 27.95. Guidelines
When reviewing a project subject to design review, the Design Review Committee and City
Council shall adhere to the following guidelines, In no case may these guidelines be used to
attempt to replace or override the requirements of the Iowa City Zoning Ordinance.

Any violation of this Chapter shall be considered a simple misdemeanor or Municipal infraction
or environmental infraction as provided for in Chapter 1 of the City Code.
SECTION II. REPEALER, All ordinances and parts of ordinances in conflict with the provisions
of this Ordinance are hereby repealed,
SECTION III, SEVERABILITY, If any section, provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision or part thereof not adjudged invalid or uncon-
stitutional.
SECTION IV. EFFECTIVE DATE. This Ordinance shall be in effect after its,final passage,
approval and publication, as provided by law.

AN ORDINANCE AMENDING CHAPTER 9.1,
IOWA CITY CODE OF ORDINANCES, ENTITLED
"CITY PLAZA," BY AMENDING SECTION 9,1-
8(E)(3)B,
WHEREAS, the City of Iowa adopted Chapter
9,1, "City Plaza," Iowa City Code of Ordinanc-
es, entitled, "City Plaza," to regulate the use of
City Plaza, and
WHEREAS, Section 9,1-8Ie)(31b requires that
plans for construction of any temporary struc-
ture or any building extension to be construct-
ed pursuant to Chapter 9,1 be reviewed by the
design review committee and approved by the
city council, If the city council votes contrary
to the committee's recommendation, it requires
the affirmative vote of five (5) members of the
city council to constitute city council approval,
and
WHEREAS, the City of Iowa City no longer
finds it necessary to require such a vote for
city council approval of said plans,
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. AMENDMENT, That Chapter 9,1,
Iowa City Code of Ordinances, entitled "City
Plaza," is amended by repealing Section 9,1-
8leH31b and adding thereto a new Section 9,1-
81e)(31b to read as follows:
b, No building permit for the construction
of any temporary structure or any
building extension to be constructed
pursuant to this chapter shall be issued
until plans for said construction have
been reviewed by the design review
committee and approvad by the city
council, The design review committee
shall, within thirty (301 days of receipt
of said plans, review the plans and
advise approval, approval with condi-
tions, or disapproval in a written report
forwarded to the city council and the
applicant, City council approval of the
plans shall require 8 majority of votes
cast at any meeting at which a quorum
is present,
SECTION II, REPEALER, All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed,
