As required by City Ordinance, staff is required to provide City Council with an annual report
accounting for the funds. received as it pertains to the CB-5 Parking Impact Fee, This report
is for the fiscal year ending June 30, 1994. Beginning cash at July 1, 1993 was O. Total
receipts received for the fiscal year were $156,000. Total expenses for the year were $2,500.
Ending cash balance at June 30, 1994 is $153,500.
The initial receipt received in the Parking Impact Fund was dated August 4, 1993, from@ .
Southtown Properties (Breese-Belle Project). The next receipt was received on August 24,
1993 from H & L Apartments, 603 South Dubuque, totaling $8,000. The third receipt was
received on April 18, 1994 from Fitzpatrick's $12,000.
The expense was for appraisal services totaling $2,500 for the property located at the
Southwest comer of Court and Linn Streets .

At last evening's meeting, the City Council deferred to September 13, 1994, the public hearings and
companion ordinances and resolutions on the land use issues adjacent to or nearby Harlocke and
Weeber Streets.

This action was based on Council's sense of support for all parties involved to continue the efforts
taken so far to talk with each other towards reaching a mutually acceptable agreement about zoning
these parcels. It is Council's desire that all parties involved increase the "good faith" conversations
in which you have been engaged to date, and report back to staff prior to the September 13 Council
meeting - say September 7.

This area of the city has had almost a decade of attempts to be developed and subsequent frustrations
on the parts of owners and residents of adjacent neighborhoods when no conclusion has been reached.
Nobody should be placed under this amount of stress. We urge you to get together and submit to
Council an acceptable compromise to end the uncertainty of the future of a most valuable part of our
city.

Re: Traffic Signal Installation
While we are continuing to collect data on many neighborhood traffic control requests, during
the next 90 days our traffic engineering crews are going to be very busy with traffic signal
installation. This may require us to set aside, temporarily, some of our neighborhood traffic
control work in that the same employees are responsible for traffic counts and the issues we
wish to address in our neighborhoods, as well as performing the work to prepare intersections
for traffic signals. This work involves the installation of conduit, setting up poles, the cutting
of loop detectors in the streets, and ultimately signal installation.
We have planned the installation of the following traffic signals:
1. Lakeside Drive and Hi9hway 6.
2. Mall Drive and First Avenue.
3. Mall Drive and Lower Muscatine Road.
4. Mormon Trek and Highway 1.
5. NCS and Highway 1.
We will continue to work as quickly as possible to address all of the traffic control issues our
community finds important, but I felt you should know that the field work necessary for all
of the signals will be underway shortly,

An application submitted to Johnson County by Chris Fountain, on
behalf of property owner Joan Fountain, to rezone 2.01 acres from
AI, Rural, to CH, Highway Commercial, for property located in Fringe
Area 6 in the southwest quadrant of the intersection of Sand Road

An application submitted to Johnson County by William Frees to
rezone 107 acres from AI, Rural, to RS3, Suburban Residential, for

Re: Clarification of Process for Obtaining a Public Right-of.Way Easement for
Encroachment onto a Sidewalk, for Accessibiiity Purposes
In reading your minutes of July 18, 1994, I would like to clarify several things:
1. The process set out in my memo of summer 1994 is fairly simple:
a. The property owner obtains a schematic/construction drawing of the proposed
accessibiiity structure or method to enable better physical accessibility for persons with
disabilities.
b. The property owner or contractor brings the plan to the Public Works Department
Director, Charles Schmadeke, for review.
c. After review and if acceptable to Public Works, the Director presents the plan to
the City Attorney, and a public right.of.way easement is drafted by staff and presented to the
property owner.
d. When the property owner signs the final easement document, the City Attorney and
Public Works Director place the item on the City Council's agenda.
2. If the property owner has well. thought out construction plan and if approved by Public
Works and in compliance with the City's guidelines and state common law obligations of the City
for protecting public right.of.way, the process should take no more than 2.3 weeks to get on the
City Council's agenda.
3. The elaborate "scenario of events," discussed at length at your July 18, 1994, meeting and
in response to certain questions, is altogether too complicated. If a new tenant were to move into
the property, the City does not necessarily require removal of the ramp - and I have no idea
where this notion came from.
4. Rather, if one reads my memo carefully, the City will require removal of the temporary
ramp/structure only when It is determined by the City that the ramp/structure presents an
obstruction, Is dangerous, has not been properly maintained and presents a hazard to the
public, or if the City needs the area for r.o.w purposes. Even so, written notice would be
given to the property owner of this finding, with time to respond.

Re: Near Southside - Issues to be Resolved
After the Council's discussion of the Near Southside on August 29, the following issues
remain to be resolved by the Council:
1 , Should additional criteria be added for development in the commercial tax abatement
district?
Business Criteria: At the August 29 meeting, the suggestion was made to incorporate
additional criteria such as those suggested for CEBA applications, since abatement is
also a financial incentive for development. Possible criteria for CEBA applications is
attached. The question format was drafted after a meeting between Mayor Horowitz,
Councilor Kubby, David Schoon and myself in August, 1993. These criteria have not
yet been adopted by the Council.
CEBA applications are company-specific and therefore lend themselves to the
specificity outlined in the criteria. In the Near Southside, these criteria could be applied
to the developer/owners of property, but it would be very difficult to apply such
detailed business operational criteria to each enterprise that became a tenant of the
redeveloped properties over time. The owners, who benefit from abatement, would
need to evaluate each tenant and presumably the City would need to monitor the
leases to ensure that the criteria were met. The question for the Council is whether
these criteria are critical to !tie success and the goals of the Near Southside and
therefore warrant the scrutiny that would be necessary of each business that locates
there.
Proiect Size Criteria: Another suggestion for additional criteria pertains to the height
of a new project and the number of floors devoted to commercial usage. This criterion
is intended, I believe, to focus on the size of projects that qualify. A minimum of three
floors in height of commercial usage was mentioned. The CB-5 zone has a minimum
hei9ht requirement of 35 feet;' this could equate to approximately two floors of
residential and one floor of commercial use, or two to three floors of commercial use.
If the criterion requires a minimum of three stories, all of which must be devoted to
,commercial development, a three-story building in which 20% or less of the space was
residential would not qualify for abatement. Under the proposal discussed August 29,
this hypothetical building would qualify for abatement.

2. Should the residential tax abatement apply to units for all low to moderate income
persons, or be targeted to units for the elderly and people with disabilities?
There are approximately 469 rental units in the Near Southside, In mid-August, only
16 of those units were in the Section 8 program. Twenty-three people were provided
housing in these units. Twelve of the 16 units were efficiency or one-bedroom units.
It does not appear that the Section 8 assistance in this part of town is focused on
families.
An analysis of the census block group that includes most of the Near Southside south
of Court Street shows that 75.9% of the population are college students. Of the total
households, 92.7% are non-family households (as family is defined by the census).
The median gross rent is hi9her than that for the city as a whole, while 68.1 % of the
people living in the area have an income below poverty level.
The profile of the typical resident, based on the information we were able to find,
reveals a college student who earns less than the median income for Iowa City but
pays rent that exceeds both the HUD "Fair Market Rent" guidelines and the Iowa City
median rent.
3. What is reasonable regarding a parking impact fee?
The variables under discussion are 1) the parking requirement for commercial uses; 2)
the percent of spaces permitted on-site and consequently the percent which must be
paid for through the fee; 3) the requirements for hotels; and 4) how the impact fee is
to be paid - with the building permit, the occupancy permit, or in increments.
Parkinq Requirement: Two ratios for commercial parking have been proposed - one
space/1,800 square feet of use and one space/900 square feet of use. In the CB-1 0
zone, no parking is required; in the CB-2 zone, retail uses provide one space/30D
square feet and office uses provide one space/300 square feet but no more than 27
spaces. The office requirement in the CB-2 zone was a measure devised to encourage
the construction of larger buildings before the Near Southside Plan was developed and
the CB-5 zone adopted. Remember that the CB-2 zone was intended to be an auto-
oriented zone on the edge of downtown. The CB-5 zone is for more intensive land use
and an extension of the downtown. A compromise parking ratio of 1 space/1,20D
square feet may be'feasible, depending upon the conclusions reached regarding the
other variables. '
% On-Site/% Fee: In considering the percent of spaces permitted on-site, the greater
the parking requirement (that is, the lower the square foot number), the higher the
percentage needed of spaces allowed on-site for the fee to be "reasonable" in the eyes
of the developers. The higher percentage allo:.^ls the developers greater flexibility in
90verning their costs. When the fee is paid and how it is paid are also factors in
determining the "reasonableness" of the fee for the private sector.
Some percentage options are 11 allow up to 25% of required parking on-site and
payment of a fee for 75% of the requirement; 2) allow up to 50% on-site and pay for
50%; or 3) allow up to 50% of the required spaces on-site but still require payment
for 75 % of the space. This last option is based on the concept of discouraging parking
on-site and encouraging its placement in centralized ramps. Payment of the fee over

Hotel Reouirements: Hotels are currently required to provide one and one-quarter
parking spaces/room on-site, or agree with the City to lease spaces in a municipal
ramp. Developers of the proposed hotel have requested consideration of the fact that.
they must already finance a long-term lease with the City for parking spaces. The
suggestion was made at the last Council discussion that the parking requirement for
hotels be changed from 1 V-I spaces/room to 1 space/room and the fee per space be
$1,000 rather than the $2,000 for commercial spaces.

Public Proiects and Desion Issues:
It appeared that the Council' was in agreement that as part of the package approach to the
Near Southside, a commitment should be made to public' projects.' The specific projects
included creation of a pedestrian mall in a major part of Dubuque Street between Burlington
and Court Streets, pursuing streetscape improvements, and construction of a parking facility
(please note the memo in your packet from Jeff Davidson regarding the parking ramp site
selection). The Council may wish to adopt a statement of commitment to these projects by
resolution, which will give the staff direction. The Council can also carry out its commitment
annually through the Capital Improvements Program process. Similarly, a commitment to
developing a design plan and design guidelines for the Near Southside can be set out in a
resolution. These resolutions would be adopted at the same time as final passage on the
various ordinances that will be part of the Near Southside package.

The Council asked whether any or all of the votes concerning the Near Southside could be
combined. It appears that you may be able to combine the resolutions adopting the urban '
revitalization plans into a single resolution. This would occur in December, much later in the
process, after you have had the requisite public hearings on each of the plans. Action on the
impact fee and the zoning ordinance amendments must be done separately. The City
Attorney's office is evaluating the combined resolution option further.

Re: Proposed Parking Facility Site in Near Southside Redevelopment Area
At your August 29 work session you asked for additional information regarding how the St. Patrick's
church parking lot site was selected as the favored location for a City parking facility in the Near
Souths ide redevelopment area. Joe Fowler and I investigated several alternative sites, and
summarized our analysis of alternative locations in a memo to the City Manager dated 2/12/94.
The Sl. Patrick's church parking lot site was evaluated along with Block 102 (Hieronymus), and the
Federal Building parking lot. We recommended proceeding with the SI. Patrick's church parking lot
site due to the following factors:
1.
Good location to serve potential short-term redevelopment sites in the Near Souths ide
redevelopment area (refer to page 8 of the Near Souths ide redevelopment plan).
Good accessibility to projects which have already paid into the parking impact fee fund.
Good location for long-term permit use by office development in the CB-10 zone and
surrounding area.
The facility could be constructed incrementally.

The site will allow accessory uses on the ground floor such as a daycare center or recreation
space. It could also provide a location for the parish hall as long as St. Pat's stays at its
present location.

The Hieronymus block was seen as a favorable location, but a major parking facility is not consistent
with the current owner's redevelopment plans. It is a site which already has a high concentration of
parking in the vicinity, and would not be convenient to other locations in the Near Souths ide
redevelopment area further south and east.

The Federal Building parking lot is also a reasonable site, but it is a less favorable location for serving'
potential short-term redevelopment sites In the Near Southside redevelopment area, and is less
convenient to those properties which have already contributed to the parking impact fee fund. Use
of the federal lot might require acquisition of residential properties along Capitol Streel. At one time
it was perceived as difficult to acquire or lease property from the General Services Administration,
although it appears they are now more inclined to work with us.
Our recommendation for construction of a City parking facility on the SI. Pat's site Includes installing
20~ parking meters on Court and Linn Streets. Let Joe or me know if you have any questions
regarding this matter.

As a result of the discussion between the Council and the Commission on August 31, it is the
staff's understanding that the following work items will be completed or continued:
1.
The Capital Improvement Program (CIP) as currently formulated will proceed as
scheduled.
2. An alignment of the "east.west arterial" which begins at the current Dubuque
Road/Highway 1 intersection and proceeds south and east around the Gatens property
and through the Larson property, avoiding the Larson home, will be evaluated by the staff
for physical feasibility. If this alignment is feasible, a capital project including a traffic
signal at the intersection of Dubuque Road and North Dodge Street (Highway 1) and
reconstruction of the south leg of the intersection wil) be included in the CIP for FY96.
Construction of the remaining portions of the arterial to ACT's east property line will not
be programmed in the seven year CIP.

Staff will develop an overlay zone that will provide environmental protection and require
the development of integrated neighborhoods. The neighborhood concept will focus on
pedestrian and transit access, residential and supportive commercial uses, and
neighborhood cohesiveness through variable street standards and setback requirements.
The overlay will be imposed on the Zoning Map according to areas of environmental
sensitivity and will preserve or establish the underlying density, depending upon the
current zoning of the property.
The target adoption date for this ordinance is July 1, 1995. Development of the ordinance
will involve the City staff and/or a consultant, community stakeholders, and representatives
of the Planning & Zoning Commission. Work on this ordinance will begin immediately and
all other items on the Urban Planning Division's work program, other than routine items
and the investigation of barriers to affordable housing, will be deferred to FY96.
Development of a transfer of development rights (TOR) ordinance will commence in FY96.
Please confirm through the Mayor and the Chairperson of the Commission that this is the proper
direction.

Re: Your request for information on the extension of First Avenue to North Dodge Street
During our discussion of northeast Iowa City street issues on August 31, there were several
questions raised regarding the impacts of extending First Avenue to North Dodge Street. You will
recall from the diagrams that were presented that First Avenue is projected to extend north to the
east-west arterial, which will run between Scott Blvd. and North Dodge Street. The extension of
First Avenue from where it currently ends to where it would intersect the east-west arteriai is
approximately 1,600 feel. For comparison, the existing portion of First Avenue from Rochester
Avenue north to where the paving ends is approximatelY 2,400 feel.
The issues with extending First Avenue are the same ones we address whenever we discuss
arterial streets: maintaining an adequate street system for the circulation of traffic in our
developing community vs. the impact on residences along the arterial corridor. The following
information will summarize the related issues.

In this discussion you should bear in mind that arterial streets are more than just facilities for
automobiles and trucks. The construction of new arterial streets includes improvements for the
safer accommodation of pedestrians and bicyclists, such as overwidth sidewalks and extra-wide
curb lanes. Because of their continuity, arterial streets allow more efficient transit routing, and
provide better response times for emergency vehicles. The lack of arterial streets in northeast
Iowa City has created a situation of longer than optimal emergency vehicle response time to this
area.
Why is the extension of First Avenue needed?
The extension of First Avenue to North Dodge Street is reflected in the JCCOG Arterial Street
Plan because it is considered necessary for adequate traffic circulation in northeast Iowa City.
As the First and Rochester Subdivision has developed, incremental extension of First Avenue has
occurred. There is also justification to extend First Avenue because of community travel patterns.
Iowa City has grown north, east, and south while the northeast area has remained relatively
undeveloped. There are now origins and destinations for travel which would logically use a route
along the alignment of First Avenue extended. Because this alignment does not exist, less
convenient streets are used instead.
The princip~1 route for traveling between north and east Iowa City at the present time is North
Dodge Street and the Dodge/Governor one-way pair, combined with one of the following east-
west arterial streets: Kirkwood, Burlington/Muscatine, Court or Rochester. The most seriously
congested of these streets are Dodge between Governor and the North Dodge Hy-Vee, and

of Dodge Street do not currently have serious congestion problems, but short and long-range

neighborhood has expressed its concern about the level of traffic on Dodge Street, which it sees
as bisecting its neighborhood.

The extension of First Avenue would provide relief to these streets by providing a direct route
between north and east Iowa City. Our traffic model projections show First Avenue would almost
immediately become a heavily used street. Staff has stated that the extension of First Avenue
to North Dodge Street should occur only in conjunction with improvements to First Avenue
between 0 Street and Bradford Drive in the Towncrest area. Part of this improvement is currently
programmed for FY96 in conjunction with the Eagle's grocery store development.

The difficult issue for Council is balancing the need for an adequate system of arterial or
"community" streets against the desire by residents living along arterials to preserve the
residential character of their property. In new developments we do this with setbacks, buffering,
and by limiting direct driveway access. In older developed neighborhoods, it is a constant
struggle to balance the negative impacts of arterial street traffic with the need to have an
adequate circulation system in the community.

It has been suggested that extending Scott Boulevard north to Highway 1 in lieu of the First
Avenue extension would provide an alternate north-south route with less disruption to existing
neighborhoods. The Scott Boulevard extension would provide some relief to traffic growth in the
Governor/Dodge Street corridor, but to a lesser extent than the First Avenue extension. This is
because Scott Boulevard is at the far edge of the "desire lines" of travel in east Iowa City. A
desire line of travel is nothing more th'an a line drawn between an origin and a destination. First
Avenue is more centrally located with respect to origins and destinations of travel, and therefore
would be perceived as more convenient than Scott Boulevard. As Iowa City continues to grow
east, Scott Boulevard will become a more convenient route.

If Council is considering First Avenue and Scott Blvd. as either-or options, you should be aware
of the comparative expense of each. The extension of First Avenue, along with the portion of the
east.west arterial required to make the connection to Dodge Street, and the upgrading of First
Avenue between Muscatine and Bradford, is projected to cost a total of $2.2 million. The
construction of Scott Blvd. from Rochester Avenue to Highway 1 is projected at an expense of
$5.7 million. I can provide further breakdown of these numbers if you would like.

NEAR SOUTHSIDE DISCUSSION:
Reel 94-98, Side 2
PCD Director Franklin, City Attorney Gentry, and Economic Development Coordinator Schoon
presented information about the Near Southside plans. Franklin asked Council Members to
send her comments regarding additional criteria for commercial development.
Council asked staff to look at the percentage of parking allowed on-site; the square footage
per space; and hotel parking requirements. Franklin summarized that staff will proceed on
parking ramp as outlined in the May 23 memo, staff is proceeding with streetscape plan, and
staff will proceed with evaluation of the partial closing of Dubuque Street concept. Council
discussed the possibility of making a written commitment to funding the Dubuque Street
public project in the Near Southside; and committing to dedicating some funding towards
public space for public purposes on the south side and to discuss the design plan for the Near
So.uthside, Staff will review for Council the site selection process for the parking ramp and
consider the impact of development on pedestrian crossing Burlington Street.
DOWNTOWN TRANSPORTATION COMMITTEE SUMMARY:

Parking and Transit Director Fowler presented information, Council directed staff to proceed
with scheduling public hearings on September 27 on increasing parking fee by 5 C in the
Dubuque Street parking ramp, and increasing parking permit fees. Staff will research a policy
resolution on promoting downtown parking, and continuing coordination efforts of subcommit-
tees working on maintenance and advertising,
MELROSE WEST STREET IMPROVEMENTS:

City Engineer Fosse, Transportation Planner Davidson, and PCD Director Franklin presented
information. Staff was asked to check on sidewalk assessment to allow for advance notice
to property owners on project plans, and the requirement for right.of-way/walkway,from
Galway Subdivision to West High School,
TRAFFIC CONTROL UPDATE:

city Manager Atkins presented a brief update on traffic control as noted in his August 25
memo, Council requested information about speed control options for neighborhoods that are
not build in traditional grid patterns using humps on Teg Drive; identification, qualification, and
comparison of various other measures of calming traffic; baseline data regarding speeds,
number of cars and origin-destination to evaluate the implementation of jump or stop sign
option,
The City Manager will provide additional information in two weeks,

Throgmorton encouraged Council to invite a Parks and Recreation Commission member
and a Riverfront and Natural Areas Commission member to Wednesday's joint meeting
with Planning and Zoning Commission. Atkins stated neighbors had been notified.
3, Throgmorton raised concerns that traffic is the issue that is driving the northeast Iowa
City development discussion, Throgmorton offered to present an alternative way of
looking at northeast Iowa City development issues at Wednesday's joint meeting with
the Planning and Zoning Commission, Council agreed to the 1 Q-minute slide
presentation.
4, Council agreed with Kubby's request to direct the City Attorney to research creation
of a mobile home tenant protection ordinance similar to the tenant landlord ordinance,
5, Kubby requested an update regarding Cliffs Apartments, Jim Glasgow detailed
construction plans for the cliff repair,

Kubby also raised concerns about the First Avenue/railroad crossing condition' and
asked that the sidewalk area at the crossing be looked at when repairs are made, ,
7, Kubby requested installing a pedestrian crossing sign located at Jefferson Street and
Anne Cleary Walkway, Atkins stated he will take care of it.

(Consent Calendar item #4g(2),) Kubby noted Council should respond to John
Rummelhart's letter requesting specific Council action. Atkins said he will make
comments at Tuesday's formal Council meeting,
9, Baker inquired about scheduling Council discussion about transit routes, Pigott
inquired about scheduling SEATS discussion. Atkins stated he will look at scheduling
SEATS discussion September 12 and transit discussion thereafter,
1 Q. Council advised Atkins to proceed with the student citizenship award program as
scheduled.
11. In response to Baker, Atkins said he would follow'up on correspondence received from
Kirby Tenhulzen regarding retaining wall criteria/embankments.
12, Baker reported that he will not be able to attend Wednesday's joint Planning and
Zoning/Council meeting because he has to teach at Linn-Mar High School, 6-9 p,m,
13. Horowitz stated she would like to get the school.city safety committee together to
address a number of issues. Horowitz noted that Lehman, Kubby and herself represent
Council on that committee,

NORTHEAST IOWA CITY DEVELOPMENT DISCUSSION

PCD Director Franklin and Assistant PCD Director Davidson presented brief comments
summarizing background information about northeast Iowa City development.

Atkins presented maps of the northeast Iowa City development area including proposed east.west
arterial alignment options A and B, Franklin stated that staff would like a decision from City
Council regarding the location of a traffic signal on Dodge Street in the ACT vicinity. Franklin
explained that staff has a request from ACT to signalize Dodge Street and ACT would like to have
that signal located at the drive that exits ACT across from ACT Circle. Franklin asked Council
to address the east.west arterial alignment decision so that the signalized intersection with Dodge
Street can be located,
Franklin reviewed the existing policies for the area as follows:

Comprehensive Plan Land Uses. Franklin explained that the comprehensive plan calls for office
and research development park around the interchange of 1.80 and Highway One and low density
single-family residential in the undeveloped portions of the area just north of Rochester and west
of Seven Sisters Road or Scott Boulevard extended and a medium density residential in the
Foster Road area.
Zoning. Franklin stated that the zoning.in place reflects an RS.12 in the Foster Road area; 10-
ORP; ID.RS. Franklin explained the 10 indicates interim development and the reason for that
designation was due to lack of infrastructure. sewer, roads and/or water,

Adopted Capital Improvements Program 1995.2001. Franklin explained that the adopted CIP
program includes Scott Boulevard Phase I - FY96; Dodge Street - Governor to Dubuque Road.
FY97; East-West Arterial - FY97; Waterline. FY96; Highlander Lift Station and Sanitary Sewer
Line - FY95, Franklin stated that Scott Boulevard phases two and three; East.West Arterial

phases two and three; and Foster Road - North Dubuque Street to Prairie du Chein are adopted
Capital Improvement Program Projects for after 2001, Franklin referred to a map and located all
of the CIP projects,
Franklin reviewed brief history of development issues in the area:
First and Rochester Subdivision Secondary Access Issue. Franklin stated that most of the
area is developed except for 40 acres just east along Hickory Trail, Franklin stated there needs
to be other means of access because First Avenue is the only way to access the area,
ACT Development. Franklin noted that ACT employees have requested signalization and the
Traffic Engineer has done some ,studies and there are warrants for signalization, Franklin
explained the problems with putting the signal at the ACT Drive has to do with what the DOT
would require in terms of improvements to Dodge Street to the ramp off of 1.80, Franklin noted
the vacation of Dubuque Road and ACT commitment to dedicating the right-of-way for a portion
of the East-West Arterial and First Avenue at such time as the City elected to construct First
Avenue to the ACT southerly property line,
Dodge Street Traffic Issues Including Prairie du Chein Road Intersection. Assistant PCD
Director Davidson presented information about the Dodge Street traffic issues, Davidson stated
that the Prairie du Chein intersection is one of the City's major traffic concerns and is starting to
get an accident history, Davidson stated that the City has received a request from Plum Grove
Acres for development, and if that development did occur the City would want a street constructed
between Prairie du Chein and Dubuque,
Davidson stated the Traffic Engineer and City staff have looked at the request for signalization
on Dodge Street in the ACT vicinity. Davidson stated the lOOT would require the entire length
of the corridor to be reconstructed including both interchange ramps if the City signalized ACT
Circle intersection, Davidson presented the East-West Arterial Alignment options A and B,
Council and Planning and Zoning Commission members discussed the East.West Arterial
Alignments as outlined in options A and B, Planning and Zoning Commission member Bovbjerg
raised concerns about the speed on the proposed East.West Arterial Alignment. Davidson
explained that there are design speeds for Arterials and Iowa City does have arterials that range
from 45 miles per hour down to 20 miles per hour in school zones, Bovbjerg commented that the
arterial could be designed for a maximum speed. Kubby suggested designing the alignment
further south and coming up with two curves. Davidson stated there are design standards for
horizontal and vertical curves on arterial streets, Schmadeke noted that as the alignment goes
further south it goes deeper into a valley.
Throgmorton asked for an opportunity topresent an alternate way of framing positions regarding
development in the northeast part of Iowa City, Throgmorton presented a set of slides that
showed the area northeast of Hickory Hill Park, and Hickory Hill Park, Throgmorton stated that
roughly half of the land northeast of Hickory Hill Park should not be developed and built on
because the slopes are too steep, the soils are subject to flooding, and the wooded ravines
provide important habitat. Throgmorton stated that 1) extending First Avenue to the north so that
it intersects with the East.West arterial will divide the wildlife habitat into two smaller and less
viable regions; 2) if First Avenue is extended north so it connects with the East.West arterial, it
will cause the land immediately north of Hickory Hill Park to be converted to housing; and 3) it
will radically alter the character of being in the park, Throgmorton proposed adopting policies that

would ensure that development will sustain the area's unique character and integrity and
encourage development of a new neighborhood which would be beautiful, affordable and
sustainable, while conserving large amounts of wooded ravines and open space. Throgmorton
proposed to leave First Avenue as it is; creating ecological preservation zone; build the East-West
arterial and to extend Scott Boulevard north; rezone the open hills in the northeast area for
redevelopment as a coherent neighborhood; establish a combination of a OPDH and CN.1 zone,
Throgmorton stated the City would need to modify the OPDH and CN-1 zones to incorporate
design guidelines and he would urge the City provide bus service and pedestrian and bH<e trails
leading into and around the ecological preservation zone, Kubby stated that Council should
consider policy decisions that can be made to develop the whole area with the same density but
preserve large tracts of land that are sensitive, Scott noted that there would still be government
intrusion into the development process via zoning, design, and public works, Scott stated that
if Council and Planning and Zoning are going to look at an OPDH imposed overlay zone in the
environmentally sensitive areas, they are going to have to view particular codes with greater
flexibility, Lehman stated that the City will still need to build some streets to move traffic along,
In response to Novick, Throgmorton stated that he does not want to extend First Avenue north
to the East-West arterial because the people of Iowa City love Hickory Hill Park and that park
experience would be changed dramatically as soon as First Avenue was extended and First
Avenue extension would impact on the wildlife in the Hickory Hill Park area, Horowitz suggested
finding out the wildlife migration paths in the area. Scott stated strong arguments against
extension of First Avenue would include political reasons and that First Avenue would become
an arterial as opposed to Scott Boulevard. Franklin stated that the First Avenue extension is not
programmed currently in the CIP. Council and Planning and Zoning Commission members
discussed First Avenue extension and arterial and secondary access issues,
Horowitz asked City Attorney Gentry if the City can legally impose an OPDH on the area, Gentry
stated yes, Gentry explained that there would have to be a designated map similar to the
sensitive areas map and the City would have to go through rezoning of the land as if it were an
overlay, Gentry suggested establishing the OPDH imposed overlay zone in combination with a
transfer development rights ordinance, Gentry explained a transfer development rights was
something that permit that a property owner has certain rights embodied in the land and if those
rights were restricted in terms of imposing the OPDH overlay, that the City would permit that
person who owned the property in lieu of development to set it aside for some environmental
sensitive purpose. But then the City would permit that person to take those development rights
that they would have otherwise have had on that land and move it to other property within the
city, Bovbjerg stated that the OPDH imposed overlay would help preserve sensitive areas,
Gentry stated the City would want to preserve some flexibility as well as some specificity, Council
and Planning and Zoning Commission discussed the OPDH imposed overlay and transfer of
development rights ordinance, Scott stated that currently Iowa City did not get the standard
cookie. cutter subdivision and by and large a lot of the developers would like to do things
differently. In response to Lehman, Franklin stated that First Avenue had been envisioned as an
arterial. Lehman stated that the City should not abandon consideration of First Avenue extended,
Franklin noted that people living along Dodge and Governor Streets want some relief from the
traffic that is coming down through Dodge/Governor couplet to access downtown Iowa City or
southeast Iowa City,

outlined by Throgmorton. Scott stated that the discussion that would take place in consideration
of Throgmorton's development concept would also take place in consideration of an OPDH
imposed overlay zone for sensitive areas, Scott stated that Council and Planning and Zoning
Commission would need to still answer the same questions going through the OPDH overlay zone
for environmentally sensitive areas,

Scott addressed the location of the east-west arterial alignment. Gibson suggested that the City
may be able to cut the economic costs associated with option B by looking at some re-
engineering of the intersection, Franklin summarized that Planning and Zoning Commission and
Council s~em to be interested in lining up with the existing intersection, avoiding houses and
looking at curves in the road, Lehman noted concerns of liabilitY when intersections don't meet.

Kubby asked if Council could direct staft to show Council the possibilities associated with
Throgmorton's development concept. Planning and Zoning Commission and Council discussed
the OPDH imposed overlay and environmentally sensitive areas, Throgmorton stated there
should be a mix of residential and small commercial in the clustered development. Scott
reminded Council and Planning and Zoning Commission that staft would like them to address the
location of alignment of the east-west arterial alignment options A or B, Pigott stated that Council
would like a blend of A1B. Council and Commission concurred. Lehman stated that he would like
to see a list of the pluses and minuses of not connecting First Avenue to the east-west arterial.
Franklin asked the expectation of the timeframe for the planned neighborhood overlay zone.
Scott stated he would like the overlay zone implemented prior to the construction season of 1995.
Throgmorton stated that he would like to see it adopted before Scott Boulevard extended and
east-west arterial are built. Franklin stated a July 1 timetable would mean that other things in the
Urban Planning Division work program would be set aside, Franklin stated that the Urban
Planning Division would probably set aside reviewed development ordinances for barriers to the
provision of affordable housing, review the north side RM.12 zoning area, examine regulations
governing the use of exterior stairwells, review definitions of awnings, and review regulation of
changeable copy signs. Starr stated that he does not want to see the review development
ordinances for barriers to the provision of affordable housing set aside. Franklin stated that the
neighborhood overlay zone could be considered without doing the transfer of development rights
immediately. She felt the July 1 target date could be met.

Council and Planning and Zoning Commission discussed the Woodlands Conservation Ordinance,
Throgmorton raised concerns about allowing for public input. Novick stated that it is not fair to
bring the public in for public input on a Woodlands Ordinance if Council does not expect to adopt
it. Throgmorton raised concerns about what would happen in terms of development if the
Woodlands Ordinance was not adopted, Scott stated that until there is secondary access,
development is not going to go anywhere.
There was no interest to pursue the Woodlands Conservation Ordinance,

Tire Recycling
Effective immediately we have terminated the contract with Rosebar Tire Shredding of Vinton,
Iowa. They have violated a number of provisions of the agreement, specifically even after
frequent contacts, it has been several months since they have picked up and transported the
accumulation of tires at the landfill, as agreed in the contract. Their failure to collect and remove
. the tires constitutes a violation of the City's landfill permit, as issued by the State DNA. Evidently,
the DNR has moved to shut down RosebarTire Shredding, Inc, and they also wi?re having'trouble
with local fire officials.

The DNR is heavily invested in grants to Rosebar, and from all appearances those monies may
now be lost.
Floyde is working on a new contract with BFI of Minnesota, It appears that our per.ton cost will
Increase from $85/ton to $1 05/ton. However, this should result in a more reliable disposal source
and our current charges for tire pickup and disposal provide for adequate revenues to cover this
increase. We will likely initiate a one.year contract.

We needed to move quickly on this issue in that our landfill permit does require the removal of
the tires. Even though the DNR appears to be a prime mover In the shutdown of Rosebar, it does
not relieve us of the permit responsibilities,

This is to inform you that after an evidentiary hearing was held before Judge Thomas in state
court, the judge denied Baculis' request for a temporary injunction, see attached Order entered
September 12, 1994.
As you will recall, this case was filed to challenge the City's authority to certify a lien on the
Baculis Mobile Home, Inc. property, and is referred to as Baculis II. Since Baculis has requested
other remedies from the state court, the law suit is not over - but the City has at least passed
the first hurdle.
Congratulations to Don Yucuis for a job well done! I will keep you informed of further events
involving this dispute, as well as Baculis I (the defamation case), as needed,

Hearing was held on Plaintiff's application for temporary
injunction on September 8, 1994.
Plaintiff appeared by James Martinek and Defendant appeared by
City Attorney Linda Newman Gentry.
The parties have an ongoing dispute concerning sewer charges
to be paid by Plaintiff. The city began providing sewer services
to the Plaintiff's mobile home court in 1972. They apparently did
not begin billing the Plaintiff for over 20 years. Once they
noticed this oversight they began discussions with Plaintiff and
they have not come to an agreement. The city now has demanded over
$100,000 in sewer fees for the time following 1981, the last year
for which they have records for water use. The water use is the
basis for the sewer charge. The city has certified the full amount
to the county for collection as property taxes. The first half of
the bill would be payable in September 1995 and the second half in
March 1996.
Plaintiff seeks a temporary injunction to prevent the city
from doing what it has already done--certify the amounts to the
county. Once that is done the amount constitutes a lien on the
Plaintiff's property. Defendants cite Dobrovolny v, Reinhardt, 173
N. W. 2d 837, 841 for the proposition that injunctive relief is
inappropriate in these circumstances. That case dealt with the
claim that a public body's action was void, because of its failure
to comply with the open meeting law. The Iowa Supreme Court's
discussion of injunction was in the context of enjoining a single
event--a public meeting--after its occurrence. The court concluded
naturally that "Rights already lost and wrongs already committed
are not subject to injunctive relief, especia~ly when there is no
showing the wrong will be repeated. II Here the Plaintiff claims
there will be repetition, i.e" the lien will be a lien each and
every day until it is paid or declared void. The case doesn't

The case of Kleman v, Charles City Police Dept" 373 N.W.2d
90, 96 sets out the standard to follow in the decision concerning
an application for temporary injunction.
The issuance or refusal to issue a temporary injunction
rests largely in the sound discretion of the trial court, and
we will not ordinarily interfere with such ruling unless there
is an abuse of discretion or a violation of some principle of
equity. (citation omitted) To exercises its discretion,
however, the district court must have before it some evidence-
-an affidavit or sworn testimony or their equivalent--on which"
' it may ascertain the circumstances confronting the parties and
balance the harm that a temporary in junction may prevent
against the harm that may result from its issuance.

I conclude that Plaintiff has failed to demonstrate that he
will clearly prevail on the merits, or that he will suffer any
irreparable harm if the temporary injunctive relief is not granted.
It is, therefore, ORDERED that the Plaintiff's application for a
temporary injunction is denied.
