Tom Muller, Senior Center Commission Chair, presented Council with Senior Center
Goals for 1994-1997; and noted the end of the commemoration of the 50th anniversary of
World War II with the planting of tree and dedication of a plaque at Chauncey Swan Park at
1 :00 on September 30th. Teresa Wagner, representing Jim Glasgow presented information
regarding the City's proposed water facility.
Moved by Throgmorton, seconded by Lehman, to set a public hearing on October 11,
1994, on an amendment to City Code Section 14-6J-2, Planned Development Housing
Overlay (OPDH) Zone, and an amendment to City Code Chapter 7, Land Subdivisions, to
require dedication of land or payment of fees in lieu of land for neighborhood open space. The
Mayor Pro tem declared the motion carried unanimously, 5/0, Horowitz, Pigott absent.
Moved by Kubby, seconded by Baker, to set a public hearing for October 11, 1994 on
an amendment to Title 14, Unified Development Code, Chapter 7, "Land Subdivisions," by
amending Article A of the City Code to require review and approval of the division of land
prior to recording. The Mayor Pro tem declared the motion carried unanimously, 5/0, Horow-
itz, Pigott absent.
A public hearing was held on an ordinance amending the Zoning Ordinance to change
the use regulations of a 5.52 acre property located east of Waterfront Drive and the CRANDIC
Railroad right-of-way from CI-1, Intensive Commercial, to CC-2, Community Commercial (Hy-
Vee Food Stores). Mark Brauer, representing Hy-Vee Food Stores, requested the public hearing
be continued to allow the developer's agreement to be fully executed. PCD Director Franklin
present for discussion. After discussion Council directed staff to pursue the possibility of
shared parking for retail use. Moved by Kubby, seconded by Lehman, to continue the public
hearing to October 11, 1994. The Mayor Pro tem declared the motion carried unanimously,

A public hearing was held on a resolution to annex a 1.02 acre parcel located north of
Scott Park Drive (Boyd). PCD Director Franklin present for discussion.
A public hearing on an ordinance amending the Zoning Ordinance by changing the use
regulations of a 1.02 acre parcel located north of Scott Park Drive from County RS, Suburban
Residential, to RS-5, Low Density Single-Family Residential (Boydl. Moved by Kubby, second-
ed by Lehman, to continue the public hearing to October 11, 1994. The Mayor Pro tem
declared the motion carried unanimously, 5/0, Horowitz, Pigott absent.
A public hearing was held on an ordinance amending the Zoning Ordinance to allow
crematoriums as an accessory use to a funeral home. The City Atty. noted the addition of
language regarding Board of Adjustment conditions. No one appeared.

Ordinance to change the use regulations of a 5.11 acre property located east of Wellington
Drive from RS-5 to OPDH-5, be given first vote for consideration IVillage Green Part XIII).

Moved by Throgmorton, seconded by Lehman, to adopt RES. 94-310, Bk. 112, p. 310,
APPROVING THE VOLUNTARY ANNEXATION OF APPROXIMATELY 166 ACRES OF CITY-
OWNED PROPERTY KNOWN AS THE IOWA CITY SOUTH WASTEWATER TREATMENT
PLANT SITE. Council indicated their desire to add a clause to the (intent/commitmentl
resolution allowing the County to review and comment on future proposed use of the park.
Affirmative roll call vote unanimous, 5/0, Horowitz, Pigott absent. The Mayor Pro tem
declared the resolution adopted.
Moved by Kubby, seconded by Lehman, that the ordinance amending the Zoning Ordi-
nance to rezone the City's south wastewater treatment plant site to P, Public, be given first

CO-1, Commercial Office. The Mayor Pro tem declared the motion carried unanimously, 5/0,

Moved by Kubby, seconded by Baker, to accept a recommendation from the Planning
and Zoning Commission that the City impose full city design standards on subdivisions within
the two-mile extraterritorial fringe area, as provided under Iowa State law, because of the
Johnson County Board of Supervisors' disregard of the fringe area agreement, and thus the
City's interest in both rezonings and approvals of subdivisions in the fringe area. Individual
Council Members expressed their views. The Mayor Pro tem stated the matter will be dis-

The Mayor Pro tem noted the previously announced vacancies: Riverfront and Natural .J3.:1.8-
Areas Comm. - three vacancies for three-year terms ending December 1, 1997. These
appointments will be made at the October 11, 1994, meeting of the City Council; Bd. of :2:::J,d, /
Appeals - one vacancy for a building design professional for a five-year term ending December
31, 1999. This appointment will be made at the October 25, 1994, meeting of the City
Council; Sr. Center Comm. - Two vacancies for three-year terms ending December 31, 1997.
These appointments will be made at the October 25, 1994, meeting of the City Council.
The Mayor Pro tem noted the current vacancies: Parks and Recreation Comm. - two
vacancies for four-year terms ending January 1, 1999; Human Rights Comm. - Three vacan-
cies for three-year terms ending January 1, 1998; Bd. of Adjustment - One vacancy for a five-
year term ending January 1, 2000. These appointments will be made at the November 8,
1994, meeting of the City Council.
Moved by Kubby, seconded by Throgmorton, to appoint Ruth Fox, 1988 Elmridge N.E., :;,
North Liberty, to the Design Review Comm. to fill an unexpired term ending July 1, 1995. The
Mayor Pro tem declared the motion carried unanimously, 5/0, Horowitz, Pigott absent.
Council Member Lehman requested staff investigate installing 15-minutes meters in the, //.;'1.35
commercial loading and loading zones downtown, and defining them all loading zones. Parking
& Transit Director Fowler commented on the ticketing policy for the zones. Staff will report
back.

The Mayor Pro tem clarified that Council would not consider the increased fees (items
#9 and # 10) until after the first of the year and therefore would not go into effect unti
February for ramp fees and April for permit fees.
Council Member Kubby noted the letter from County Bd. of Supervisor Duffy regarding
Senior Dining Month and questioned Council participation. Council agreed to discuss the
matter at an upcoming meeting when all Council Members were present. Kubby noted a
recent request for wetlands documentation to be filed in the City Clerks office, rather than
Public Works, and urged filing of documents of interest to the public in the Clerks office
Kubby noted the Energy Use Report outlining City energy savings of $3.4 million since 1980,
and complimented the Senior Center and southeast and westside fire stations for their savings
this past year.
Council Member Novick stated the architect for the Shimek playground came from New
York state, and said the volunteers were terrific.
Council Member Throgmorton reaffirmed that the Council had no intention of reducing
SEATS services. He acknowledged Council Members who helped with the Shimek playground.
Throgmorton noted the Chauncey Swan Park and asked that an opening celebration be sched-
uled. The City Manager noted the park was an investment of the parking fund. Staff will
follow up.
Council Member Baker congratulated all involved with the Shimek playground project.
Baker stated he had received a number of phone calls from teachers and parents at West High
regarding the one way exit onto Melrose, and noting the visual hazards with the bus stop and
telephone pole. The City Manager will follow up with staff regarding moving of the bus stop.
Baker questioned if some sort of recognition had been planned for Boards and Commissions.
The City Manager stated that the task forces would be recognized with a placque late next
month. Baker noted Charter Review Commission consideration of Council compensation.
Mayor Pro tem Novick reminded citizens of the League of Women Voters meeting
September 28; and candidate forums scheduled for 7:00 p.m. in Council Chambers on
October 5 (Iowa Senate), October 13 (Iowa House), October 19 (County Board of Supervi-
sors), and October 26 (US Congress Representatives). Novick also encouraged everyone to
attend the Human Rights Breakfast scheduled for October 12th at the Iowa Memorial Union.
City Mana'ger Atkins announced that the City had been awarded a grant of approxi-
mately $900,000 for the purchase of ten additional existing housing to the City's public
housing inventory.
City Attorney Gentry briefly reported on her attendance at the Government Civil
Practices seminar, noting that additional information would be forthcoming.

AWARDING CONTRACT FOR CONSTRUCTION OF THE 1994 CURB RAMPS PROJECT to All
American Concrete for $91,757.50. Civil Engr. McClure present for discussion. Affirmative
roll call vote unanimous, 5/0, Horowitz, Pigott absent. The Mayor Pro tem declared ,the
