HEREAS, the property owner h s requested the City to rezone an appropri e 5.11 acre tract f land located east of lIington Drive from -5, Low Density Singl Family Residen- tial, to PDH-5, a Preliminar Planned Develop- ment Ho sing IPDH) Plan; nd WHER S, the reque ted zoning change would per it develop nt of the tract for a planned ho ing deve pment of 20 dwelling units clustere in tw and three unit combina- tions around sto mwater detention facility; and WHEREAS, th subject property is presently in an area sho n n the Comprehensive Plan for the City f 10 City as residential, at a density of toto eig t dwelling units per acre; and WHER S, the de ity of the proposed develop ent is consist nt with the density design ted for this area i the Comprehensive Plan; nd W EREAS, the proposed esign of the PDH pi contains a sufficient mount of open s ace and various features, uch as varied , of lines, staggered facades, etbacks and perimeter landscaping, which Ie sen the ap- pearance of bulk and make the desl n compati- ble with surrounding existing and nticipated single-family development. The following variations from the requirements of the RS-5 zone have been approved as part of this prelim- inary PDH plan: A. Twenty duplex and multi-family dwellings which have been designed in a fashion compatible with the single-family character of surrounding properties, and which will be buffered from adjacent development by building setbacks and perimeter landscap- ing will be allowed. B. Reduction of the pavement width of e private streets within the developme will be allowed. The private streets, S erset Place and Somerset Lane, are int ded for two-way traffic. Instead of t nty-eight foot wide paved surfaces, ba -of-curb to back-of-curb (BC-BCl, the streets shall be a minimum of twenty Ive 125) feet in width, and will have fe-inch deep As- phalt Cement Concr e (ACC) surfaces. Three-inch integral oil curbs will define e edges of the aved surfaces. Side- Iks shall be wived for Somerset Place. Si walks are quired on Somerset Lane adj ent to t e curb. SECTION III, NING MAP. The Building Inspector I h eby authorized and directed to change the oning Map of the city of Iowa City, Iowa, conform to this amendment upon final pass ge, pproval and pUblication of this Ordinan as pr vided by law. SECTI IV. C TIFICATION AND RECORD- ING. he City CI k is hereby authorized and dire ed to certify copy of this Ordinance wh'ch shall be reco ed at the Office of the C unty Recorder of J nson County, Iowa. ECTION V. REPEAL . All ordinances and parts of ordinances in c flict with the provi- sions of this Ordinance ar hereby repealed. SECTION VI. SEVERABILI y, If any section, prOVision or part of the 0 inance shall be adjudged to be invalid or uncon titutional, such adjudication shall not affect the ~alidity of the Ordinance as a whole or any sectl n, provision or part thereof not adjudged invalid unconsti- tutional. SECTION VII. EFFECTIVE DATE.
