permission to solicit donations from vehicles at intersections on football game days to,

Races on October 30, 1994/ approveq, Regina High School for permission to use
public streets for a homecoming parade on September 29, 1994, approved.

the motion carried.
Harold Engen, Vice Chairman for the Senior Center Commission, distributed copies of
an article from New Choices listing Iowa City as one of the best college towns for retirees,
and updated Council on activities at the Center. Lee Siglin, 618 N. Gilbert, appeared regarding
his garden located in the City right-of-way. The following individuals appeared regarding the
same issue: Clara Oleson, Rick Graf, 628 Second Ave., and Donald Engstrom, 628 Second
Ave. Mike Woodhouse appeared regarding the sewer and water rates and the building of the
proposed water facility. Wayne Drash, 420 E. Jefferson, appeared requesting signage at the
Burlington Street dam warning people of the hazards. Council Member Kubby suggested that
he contact Larry Wilson at the University.
A public hearing was held on an amendment to City Code Section 14-6J-2, Planned f) lj,?yO
Development Housing Overlay (OPDHl Zone, and an amendment to City Code Chapter 7, Land
Subdivisions, to require dedication of land or payment'of fees in Iieu,of land for neighborhood
open space. Dee Vanderhoef, Neighborhood Open Space Committee Member, and Melody
Rockwell, PCD Planner, presented information regarding the Plan and the Ordinance. The
following individuals appeared: Harvey Wehde, 2408 Whispering Prairie; Bruce Glasgow / 834
N. Johnson; Richard Rhodes, 2014 Rochester Ave.; and Jerry Eyman, 91 Heron Circle. PCD
Director Franklin present for discussion. Moved by Kubby, seconded by Throgmorton, to
accept correspondence from Bruce Glasgow and Harvey Wehde. The Mayor declared the
motion carried unanimously, 7/0, all Council Members present.
A public hearing was held on an amendment to Title 14, Unified Development Code, ~L/. '? I

Chapter 7, Land Subdivisions, by amending Article A of the City Code to require review and
approval of the division of land prior to recording. No one appeared.
A public hearing was held on an ordinance amending the Zoning Ordinance to change J(L/3::J.
the use regulations of a 5.52 acre property located east of Waterfront Drive and the CRANDIC
Railroad right-of-way from CI-1, Intensive Commercial, to CC-2, Community Commercial (Hy-
Vee Food Storesl. Mark Brauer, Hy-Vee Food Stores, stated the conditional zoning agreement
had been signed.

Ordinance to change the use regulations of a 5.52 acre property located east of Waterfront

APPROVING THE VOLUNTARY ANNEXATION OF AN APPROXIMATE 1.02 ACRE PARCEL OF
LAND LOCA TED NORTH ON SCOTT PARK DRIVE EXTENDED (Boydl. Kubby stated she would
be voting for the annexation to complete a city block and prevent a septic tank adjacent to
city property. Affirmative roll call vote unanimous, 7/0, all Council Members present. The
Mayor declared the resolution adopted.
A public hearing was held on an ordinance amending the Zoning Ordinance by changing ~ 1./35
the use regulations of a 1.02 acre parcel located north of Scott Park Drive from County RS,
Suburban Residential, to RS-5, Low Density Single-Family ResidentiallBoydl. No one ap-
peared.

CITY, IOWA, ENTITLED "ZONING DEFINITIONS," TO CHANGE THE DEFINITIONS OF "HO-
TEL" AND "MOTEL" TO REFLECT THE COMMERCIAL FUNCTION OF SUCH USES, AND TO
CHANGE THE PARKING REQUIREMENTS FOR HOTELS AND MOTELS TO A COMMERCIAL
CLASSIFICATION. Affirmative roll call vote unanimous, 7/0, all Council Members present. The
Mayor declared the ordinance adopted.
Moved by Kubby, seconded by Novick, to defer indefinitely a resolution approving the
final plat of Longfellow Manor, a 7.64 acre, 20 lot, residential subdivision located on the south
side of the 1300 block of Sheridan Avenue. The Mayor declared the motion carried unani-
mously, 7/0, all Council Members present.
Moved by Throgmorton, seconded by Novick, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be waived,
and that ORD. 94-3641, Bk. 37, p. 38, AMENDING THE ZONING ORDINANCE BY CORRECT-
ING THE LEGAL DESCRIPTION OF PROPERTY REZONED BY ORDINANCE NO. 92-3524 FROM
CC-2, COMMUNITY COMMERCIAL ZONE, TO CB-5, CENTRAL BUSINESS SUPPORT ZONE
IN AN AREA REFERRED TO AS THE NEAR SOUTHSIDE, be voted on for final passage at this
time. Affirmative roll call vote unanimous, 7/0, all Council Members present. The Mayor
declared the motion carried. Moved by Throgmorton, seconded by Novick, that the ordinance
be finally adopted at this time. Affirmative roll call vote unanimous, 7/0, all Council Members
present. The Mayor declared the ordinance adopted.
A public hearing was held to consider adoption of a new ordinance entitled Iowa City
Human Rights Ordinance. Alison Ames Galstad, Chair of the Human Rights Commission,
appeared regarding revisions to the ordinance.
Moved by Baker, seconded by Pigott, that the ordinance adopted a new ordinance
entitled Iowa City Human Rights Ordinance, be given first vote for consideration. The Mayor
declared the motion carried, 6/1, with the following division of roll call vote: Ayes: Pigott,
Throgmorton, Baker, Horowitz, Kubby, Novick. Nays: Lehman.
The Mayor noted the previously announced vacancies: Bd. of Appeals - One vacancy
for a building design professional for a five-year term ending December 31, 1999; Sr. Center
Comm. - Two vacancies for three-year terms ending December 31, 1997. These appointments
will be made at the October 25, 1994, meeting of the City Council. Parks and Recreation
Comm. - Two vacancies for four-year terms ending January 1, 1999; Human Rights Comm. -
Three vacancies for three-year terms ending January 1, 1998; Bd. of Adjustment - One
vacancy for a five-year term ending January 1, 2000. These appointments will be made at the
November 8, 1994, meeting of the City Council.

Moved by Kubby, seconded by Novick, to accept the recommendation of the Johnson tl1s:J.
County Board of Supervisors that Nancy English be appointed to the Riverfront and Natural
Areas Commission as a representative of Johnson County for a term ending January 1, 1996.
The Mayor declared the motion carried unanimously, 7/0, all Council Member present. ~
Moved by Throgmorton, seconded by Pigott, to re-appoint Jim Pugh, 2263 S. Riverside -2l/53 - ,
Dr.; appoint Catherine Pugh, 5 Penn Circle, and Courtney Daniels, 53 Amhurst St. to the,
Riverfront and Natural Areas Comm. for three-year terms ending December 1, 1997; appoint r9. LJ'=; 1./
Jessica Neary, 715 N. Linn St. #3, to the Riverfront & Natural Areas Comm, for an unexpired
term ending December 1, 1995. The Mayor declared the motion carried unanimously, 7/0, all
Council Members present.
Council Member Baker noted the joint meeting held earlier in the evening with the -RL/55
University Student Senate, and stated he would follow-up with the President Lohman regard-
ing some of the issues discussed. Baker also questioned if there was information provided in :II/Sin '
Council's packet that could be eliminated in order to make the packets more readable. After ~
discussion, Council agreed to maintain the packet as is. ~
Council Member Pigott stated the Hospice Road Race was coming up and volunteers Of LJ57
were needed for the finish line. Interested people should contact Sheri King. Pigott acknowl- ~4.t;'6 I
edged City Planner Denney for time spent at an Environmental Advocates meeting discussing t~
bike paths. ~!
Council Member Novick reported on the public discussion on transportation issues held :?~51 .;~~
earlier in the day with representatives from IDOT. Novick urged participation in the City Steps ,-J '/ &;0 !
public meetings process at the following times and locations: October 19, 12 noon-Housing J
Needs-Iowa City Public Library, Meeting Room A; October 20,7 p.m.-Pheasant Ridge Neigh- ~

Council Member Kubby acknowledged the efforts of Finance Director Yucuis in restruc- ;l.4to I
turing sewer revenue bonds creating a net cash increase of $23J3,000 in sewer revenue
refunding. Kubby reminded citizens that political signs could not be placed in public right-of- oNfa::A.
way.
Council Member Lehman stated he and Mayor Horowitz are part of the Council's
representatives attending meetings on renegotiating of the SEATS contract, and reiterated the
same quality of service is being planned. He stated talks were being held on the formula for
calculating the City's share of the costs.
Mayor Horowitz referenced an article in Time magazine talking about derivatives, and.
was glad to learn from Finance Director Yucuis that Iowa City was not investing in such
funds. The Mayor also noted the leaf pick-up schedule for the City, and asked citizens to be
sure the leaves were in the right-of-way and not on the street.
City Atty. Gentry announced she would be a celebrity chef on October 19 as part of
a fund raiser for Alliance for Mentally III of Johnson County, and encouraged individuals to
make reservations.

ESTABLISHING A PARKS AND RECREATION COMMISSION FOR THE CITY OF IOWA CITY,
IOWA, AND ESTABLISHING THE MEMBERSHIP, TERMS, DUTIES, POWERS AND AUTHORITY
OF SAID COMMISSION. Council agreed a letter be sent to the School Board encouraging them
to recruit an individual. Affirmative roll call vote unanimous, 7/0, all Council Members present,

The Mayor declared the resolution adopted. The Mayor noted a vacancy on the Parks and J to
Recreation Comm. for a four-year term ending January 1, 1999. In response to Novick, the
City Clerk stated the appointment would be made at the November 22, 1994 meeting of the
City Council.
Moved by Pigott, seconded by Kubby, that the rule requiring ordinances to be consid-
ered and voted on for final passage at two Council meetings prior to the meeting at which it
is to be finally passed be suspended, the second consideration and vote be waiv,ed, and that
ORD. 94-3642, Bk. 37, p. 39, AMENDING TITLE 14, CHAPTER 8, ENTITLED "AIRPORT
ZONING," CITY CODE BY REVISING ARTICLE A, ENTITLED "GENERAL AIRPORT ZONING
PROVISIONS," AND ARTICLE B, ENTITLED "AIRPORT ZONES," TO CHANGE THE APPROACH
SLOPE ZONES FOR RUNWAY 6 FROM A-34:1 APPROACH OVERLAY (OAl ZONE TO A 20:1
APPROACH OVERLAY (OA) ZONE, be voted on for final passage at this time. Affirmative roll
call vote unanimous, 7/0, all Council Members present. The Mayor declared the motion
carried. Moved by Pigott, seconded by Throgmorton, that the ordinance be finally adopted at
this time. Affirmative roll call vote unanimous, 7/0, all Council Members present. The Mayor
declared the ordinance adopted.
