A public hearing on an ordinance amending
the Zoning Ordinance by changing the use
regulations of a 1.02 acre parcel located north
of Scott Park Drive from County RS, Suburban
Residential, to RS-5, Low Density Single-Family
Residential. Moved and seconded to continue
the public hearing to October 11. The Mayor
Pro tem declared the motion carried.
A public hearing was held on an ordinance

Moved and seconded to defer to October
25, an ordinance amending the Zoning Ordi-
nance by changing the use regulations for
property located in the vicinity of the Mormon
Trek Boulevard/Highway 1 intersection from
County A 1 to CI-1, Intensive Commercial, and
land northwest of the intersection from County
R1 A to CO-1, Commercial Office. The Mayor
Pro tem declared the motion carried.
Moved and seconded that the ordinance
amending the Zoning Ordinance by correcting
the legal description of the CB-5, Central Busi-
ness Support, zone, be given first vote for
consideration. The Mayor Pro tem declared the
motion carried.
Moved and seconded to accept a recom-
mendation from the Planning and Zoning Com.
mission that the City impose full city design
standards on subdivisions within the two-mile
extraterritorial fringe area, as provided under
Iowa State law, because of the Johnson Coun-
ty Board of Supervisors' disregard of the fringe
area agreement, and thus the City's interest in
both rezonings and approvals of subdivisions in

a public hearing on an ordinance amending Title
3, "City Finances, Taxation and Fees," Chapter
4, "Schedule of Fees, Rates, Charges, Bonds,
Fines and Penalties" of the City Code, to in-
crease the hourly parking rate in the Dubuque
Street Parking Ramp in Iowa City, Iowa; and
item 1 O. a public hearing on an ordinance
amending Title 3, "City Finances, Taxation and
Fees," Chapter 4, "Schedule of Fees, Rates,
Charges, Bonds, Fines and Penalties" of the
City Code, to increase Monthly Parking Permit
fees in Iowa City, Iowa. The Mayor Pro tern
declared the motion carried. The following

for a five-year term ending December 31,

an amendment to Title 14, Unified Development Code, Chapter 7, "Land Subdivisions," by

Areas Comm. - three vacancies for three-year terms ending December 1, 1997. These
appointments will be made at the October 11, 1994, meeting of the City Council; Bd. of
Appeals - one vacancy for a building design professional for a five-year term ending December
31,1999. This appointment will be made at the October 25, 1994, meeting of the City
Council; Sr. Center Comm. - Two vacancies for three-year terms ending December 31, 1997.
These appointments will be made at the October 25, 1994, meeting of the City Council.
The Mayor Pro tem noted the current vacancies: Parks and Recreation Comm. - two
vacancies for four-year terms ending January 1, 1999; Human Rights Comm. - Three vacan-

Council Member Lehman requested staff investigate installing 15-minutes meters in the
commercial loading and loading zones downtown, and defining them all loading zones. Parking

The Mayor Pro tern clarified that Council would not consider the increased fees (items
#9 and #101 until after the first of the year and therefore would not go into effect until
February for ramp fees and April for permit fees.
Council Member Kubby noted the letter from County Bd. of Supervisor Duffy regarding
Senior Dining Month and questioned Council participation. Council agreed to discuss the
matter at an upcoming meeting when all Council Members were present. Kubby noted a
recent request for wetlands documentation to be filed in the City Clerks office, rather than
Public Works, and urged filing of documents of interest to the public in the Clerks office.
Kubby noted the Energy Use Report outlining City energy savings of $3.4 million since 1980,
and complimented the Senior Center and southeast and westside fire stations for their savings
this past year.
Council Member Novick stated the architect for the Shimek playground came from New
York state, and said the volunteers were terrific.
Council Member Throgmorton reaffirmed that the Council had no intention of reducing
SEATS services. He acknowledged Council Members who helped with the Shimek playground.
Throgmorton noted the Chauncey Swan Park and asked that an opening celebration be sched.
uled. The City Manager noted the park was an investment of the parking fund. Staff will
follow up.
Council Member Baker congratulated all involved with the Shimek playground project.
Baker stated he had received a number of phone calls from teachers and parents at West High
regarding the one way exit onto Melrose, and noting the visual hazards with the bus stop and
telephone pole. The City Manager will follow up with staff regarding moving of the bus stop.
Baker questioned if some sort of recognition had been planned for Boards and Commissions.
The City Manager stated that the task forces would be recognized with a placque late next
month. Baker noted Charter Review Commission consideration of Council compensation.
Mayor Pro tern Novick reminded citizens of the League of Women Voters meeting
September 28; and candidate forums scheduled for 7:00 p.m. in Council Chambers on
October 5 (Iowa Senate), October 13 (Iowa House), October 19 (County Board of Supervi.
sors), and October 26 (US Congress Representativesl. Novick also encouraged everyone to
attend the Human Rights Breakfast scheduled for October 12th at the Iowa Memorial Union.
City Manager Atkins announced that the City had been awarded a grant of approxi-
mately $900,000 for the purchase of ten additional existing housing to the City's public
housing inventory.
City Attorney Gentry briefly reported on her attendance, at the Government Civil
Practices seminar, noting that additional information would be forthcoming.

Harold Engen, Vice Chairman for the Senior Center Commission, distributed copies of
an article from New Choices listing Iowa City as one of the best college towns for retirees,
and updated Council on activities at the Center. Lee Siglin, 618 N. Gilbert, appeared regarding
his garden located in the City right-of-way. The following individuals appeared regarding the
same issue: Clara Oleson, Rick Graf, 628 Second Ave., and Donald Engstrom, 628 Second
Ave. Mike Woodhouse appeared regarding the sewer and water rates and the building of the
proposed water facility. Wayne Drash, 420 E. Jefferson, appeared requesting signage at the

A public hearing was held on an amendment to City Code Section 14-6J-2, Planned

A public hearing was held to consider adoption of a new ordinance entitled Iowa City
Human Rights Ordinance. Alison Ames Galstad, Chair of the Human Rights Commission,
appeared regarding revisions to the ordinance.
Moved by Baker, seconded by Pigott, that the ordinance adopted a new ordinance
entitled Iowa City Human Rights Ordinance, be given first vote for consideration. The Mayor
declared the motion carried, 6/1, with the following division of roll call vote: Ayes: Pigott,
Throgmorton, Baker, Horowitz, Kubby, Novick. Nays: Lehman.
The Mayor noted the previously announced vacancies: Bd. of Appeals - One vacancy

County Board of Supervisors that Nancy English be appointed to the Riverfront and Natural
Areas Commission as a representative of Johnson County for a term ending January 1, 1996.

Moved by Throgmorton, seconded by Pigott, to re-appoint Jim Pugh, 2263 S. Riverside
Dr.; appoint Catherine Pugh, 5 Penn Circle, and Courtney Daniels, 53 Amhurst St. to the
Riverfront and Natural Areas Comm. for three-year terms ending December 1, 1997; appoint
Jessica Neary, 715 N. Linn St. #3, to the Riverfront & Natural Areas Comm. for an unexpired
term ending December 1, 1995. The Mayor declared the motion carried unanimously, 7/0, all
Council Members present.
Council Member Baker noted the joint meeting held earlier in the evening with the
University Student Senate, and stated he would follow-up with the President Lohman regard-
ing some of the issues discussed. Baker also questioned if there was information provided in
Council's packet that could be eliminated in order to make the packets more readable. After
discussion, Council agreed to maintain the packet as is.
Council Member Pigott stated the Hospice Road Race was coming up and volunteers
were needed for the finish line. Interested people should contact Sheri King. Pigott acknowl-
edged City Planner Denney for time spent at an Environmental Advocates meeting discussing
bike paths.
Council Member Novick reported on the public discussion on transportation issues held
earlier in the day with representatives from lOOT. Novick urged participation in the City Steps
public meetings process at the following times and locations: October 19, 12 noon-Housing
Needs-Iowa City Public Library, Meeting Room A; October 20, 7 p.m.-Pheasant Ridge Neigh-
borhood Center; October 27, 12 noon-Homeless Needs-Iowa City Public Library, Meeting
Room A; November 1, 12 noon.Community Development Needs-First National Bank Atrium;
November 3, 7 p.m.-Broadway Neighborhood Center; November 3, 7 p.m.-Housing and
Community Development-Iowa City Public Library, Meeting Room A.
Council Member Kubby acknowledged the efforts of Finance Director Yucuis in restruc-
turing sewer revenue bonds creating a net cash increase of $235,000 in sewer revenue
refunding. Kubby reminded citizens that political signs could not be placed in public right-of-
way.
Council Member Lehman stated he and Mayor Horowitz are part of the Council's
representatives attending meetings on renegotiating of the SEATS contract, and reiterated the
same quality of service is being planned. He stated talks were being held on the formula for
calculating the City's share of the costs.
Mayor Horowitz referenced an article in Time magazine talking about derivatives, and
was glad to learn from Finance Director Yucuis that Iowa City was not investing in such
funds. The Mayor also noted the leaf pick-up schedule for the City, and asked citizens to be
sure the leaves were in the right-of-way and not on the street.
City Atty. Gentry announced she would be a celebrity chef on October 19 as part of
a fund raiser for Alliance for Mentally III of Johnson County, and encouraged individuals to
make reservations.
The Mayor noted a recommendation of the Committee on Community Needs that the
proposed amendments to the 1994 CDBG Program Statement and Budget be approved. The
City Council approved this item at its meeting of September 27, 1994.
Moved by Pigott, seconded by Novick, to adopt RES. 94-324, Bk. 112, p. 324,
ESTABLISHING A PARKS AND RECREATION COMMISSION FOR THE CITY OF IOWA CITY,
IOWA, AND ESTABLISHING THE MEMBERSHIP, TERMS, DUTIES, POWERS AND AUTHORITY
OF SAID COMMISSION. Council agreed a letter be sent to the School Board encouraging them
to recruit an individual. Affirmative roll call vote unanimous, 7/0, all Council Members present.

Dee Vanderhoef presented information and answered questions about the Neighborhood Open
Space plan. Novick recommended adding Flood Plains and Woodlands to 7D-3, Dedication of
Land, B.1. In response to Cook, Council asked that a presentation be made during Tuesday's
formal Council meeting public hearing summarizing the Neighborhood Open Space guiding
principles, graphs and outlines, and why the Neighborhood Open Space Plan is needed.

Director of Parks and Recreation Trueblood commented about the change that all nine members
be appointed by City Council. Council directed Trueblood to ask the Parks and Recreation
Commission to consider the idea of delegating the responsibility to the Iowa City school board
to appoint one member to the Parks and Recreation Commission. Council agreed to proceed with
the resolution as presented.

TRANSIT ROUTE STUDY

City Manager Atkins, Transportation Planner Davidson, Parking and Transit Director Fowler
presented information. Atkins stated that if Council decides to make any substantive changes,
a formal public hearing would be required and if Council wants to pursue specific changes staff
will consider them during the budget process and prepare formal recommendations for Council
consideration.
After discussion, Atkins stated staff will develop a transit policy to be presented to Council
including information about ways to increase ridership.
Davidson and Fowler reviewed alternatives for City Council's consideration within the existing
route structure as outlined in the Davidson/Fowler August 25 memo Iowa City Transit Route
Structure Analvsis.
WATER/SEWER RATES

Finance Director Yucuis and Public Works Director Schmadeke presented information about the
wastewater fund and water fund user fee rate increase.
Kubby requested information about the number of residential and commercial/industrial accounts
that are the minimum usage.
Yucuis stated that if Council wants to implement the proposed rate increases January 1, they
need to set a public hearing at their next Council meeting for November 8.

City Manager Atkins noted that on October 18 there is a 5:30 p.m. reception for Task
Force members, 6:30 Council Executive Session, and 7:00 p.m. discussion regarding
refuse collection and recycling.

Kubby announced that she is trying to schedule a meeting with staff to discuss water
facility questions, and urged combining questions.

3. Kubby reminded Council that Supr. Duffy wants to schedule Council members to attend
Senior Dining at the Senior Center, Council agreed to attend Senior Dining October 13.

In response to Kubby, City Manager Atkins stated that he has drafted a letter to HACAP
regarding their request for placement on the agenda for discussion of housing issues.

In response to Kubby, City Manager Atkins stated he will follow up on the recommen-
dation from the Parks & Recreation Commission to transfer Mesquakie Park to Public
Works.

In response to Throgmorton, City Manager Atkins explained that correspondence to
SEATS regarding negotiating position and cost allocation formulas was prepared as a

him that he now obstructs the view and if he wishes to maintain the garden he would have
to apply for a permit.
8. Throgmorton explained that Steve Vlastos and Mary Ann Rasmussen are concerned about
the pigeon problem on Bloomington Street. Throgmorton requested that City Attorney
Gentry talk to Assistant City Attorney Burnside about the problem.
9. (Agenda Item No. (3)F.(1) - Permit to Sell on Pedestrian Plaza) Novick inquired about the
permit to sell on the pedestrian plaza as an occasional vendor, and whether there was a
fee.,
10. Novick noted that Council has received a whole stack of correspondence from people who
are using SEATS. Novick requested that the Mayor contact those people and explain that
the quality of service will not change. City Clerk Karr noted that Marguerite Knoedel's
correspondence was regarding the Seventh Avenue bus route and not SEATS. The
agenda will be amended.
11. Novick asked if there was some way that the CCN public hearings regarding City Steps
could be posted to allow at least four Council members to attend those meetings. Gentry
n~ted that the legislature requires minutes if there are a majority of Council members
present. Council members discussed attendance to those meetings.
12, ' Lehman noted that letters were received regarding SEATS and that the public should
know that the meeting between the City and county was very harmonious and both the
City and county are very much interested in continuing the kind of service that has been
provided. Kubby suggested that Lehman say something during formal council meeting
council time.
13. Baker noted the recent grant and inquired about the hiring of eight new policemen. City
Manager Atkins stated that a proposal is being prepared.
14, (Agenda Item No. 5A . Neighborhood Open Space Ordinance Public Hearing) Baker
requested that Neighborhood Open Space Committee members be present to assist in
answering questions.

Student Senate joint meeting. The discussion of special topics included proposed water
facility, downtown overnight parking, bike racks, rent control, safety concerns (lighting,
crosswalks, river), community services project (Into the Streets Program), boards and
commissions, snow removal and student voting. City Manager Atkins provided information.

Staff and Council agreed to put city bicycle pamphlets in the student Union, provide
information to United Way campaign regarding University Into the Streets volunteer program,
and send a list of landlords to the University Tenant Landlord Association. Horowitz
announced that one of the City Steps public hearings was scheduled October 19, 12-2 PM
at the Iowa City Public Library and encouraged attendance. City Clerk Karr announced copies
of the Iowa City Charter were available for review and the Charter Review public hearing is
scheduled for November 2, 7:00 PM at the Civic Center Council Chambers. Horowitz
requested that if students have specific safety concerns to forward those concerns to Lohman
and he will give them to Council.
