Horowl (#2) Special Presentations
Horowl We have some special presentations to be made. Let me come
out here and ask our special people to come forward for our
citizens Award. This evening our awards are for our students
from Lemme School. And the citizenship Award is, as you
remember, are for outstanding qualities of leadership this
evening within Lemme Elementary School and for the sense of
responsibility and helpful to others and we are recognizing
these students as outstanding student citizens. The community
is very proud of them. These are being presented by the city
council and so I appreciate you being here this evening. The
first award is to Brie Nixon, T. J. Meyerholz, Anna Stephen
and Anna isn't here this evening but I am asking Brie to take
this back to school for her and Megan Ansley. congratulations
Megan. I would like to ask our Citizenship Award students to
say something.

principal and all the teachers and the city council.

d. Setting Public hearings.
qf- 3ZS (1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON
NOVEMBER 8,1994, ON THE PROPOSED RATE INCREASE FOR
WATER AND WASTEWATER FEES.
Comment: This resolution sets a public hearing on the proposed
rate increase for water and wastewater fees. The hearing will be
held in the Civic Center Council Chambers at 7:30 p.m., November
8, 1994, to permit public input to be heard for or against the
proposed rate increase for water and wastewater. The first
reading of the ordinance will also take place at the November 8th
meeting. The second and third readings will be scheduled for the ~
following Council meeting. Publication will be done as soon as
legally possible. The new rates are scheduled to go into effect I
February 1, 1995, at the earliest.
Water and wastewater rates were last increased in 1991. The I
proposed increases are needed to comply with existing federal
standards and in planning to construct a new water treatment I
facility at a cost of $ 50 million and make improvements to double
the treatment capacity of the existing south wastewater treatment
plant at a cost of $16.4 million and construct a sewer line to
connect the two wastewater treatment plants at a cost of $25.7
million. The proposed rate increases for water are 40% the first
year and 75% the second year, effective February 1, 1995, and
for wastewater, 40% the first year and 35% the second year.
The rate increases as proposed will be applied as a flat increase
across-the-board to all existing rates and minimum charges.
The impact to the average residential user (750 cubic feet per
month) is an increase from $38 per month to $48 per month in the ~
first year and an increase to $70 per month in the second year.
The minimum bill currently is $23 per month and will increase to
$27 per month and $39 per month in the first and second years,
respectively.

MENT CONCERNING THE STORMWATER MANAGEMENT
EASEMENT FOR WINDSOR RIDGE PARTS 1, 2, & 3 AND THE
PUBLIC WALKWAY/TRAILS SYSTEM FOR WINDSOR RIDGE
PARTS 1 & 4.
Comment: The Subdivider's Agreement and Storm water Manage-
ment Easement Agreement for Windsor Ridge Subdivision obligate
the D'eveloper to construct two storm water management facilities
and a public walkway/trails system through open space in various'
parts of the subdivision. This obligation constitutes a lien and a
cloud on the title to the subdivision lots. The Developer has
substantially completed the storm water facilities but a general
release of the facilities is not yet appropriate. The Developer has
not substantially completed the walkway/trail system, but the
Subdivider's Agreement provides for the escrow of monies to
ensure completion of public improvements when appropriate.
Public Works/Engineering is in agreement that such an escrow is
appropriate in this instance. This Partial Release Agreement
removes the cloud on the title to lots in the Windsor Ridge
Subdivision while protecting the City by establishing escrow funds
which will be retained until the facilities and further development
which may impact the same are completed.

Comment: The Department of Housing and Urban Development
requires a self sufficiency program for families assisted under the
Certificate, Voucher, and Public Housing Programs. This Action
Plan implements the program for our tenants and participants.
The Housing Commission recommends this plan. HUD has ap-
proved the elements of the plan.

Comment: The contract provides for nine new Section 8 Rental

in the Annual Contract Authority to $1,438,196. The award
carries a maximum increased Budget Authority of $360,475 over
the next five years.

a. Consider setting a public hearing for November 8, 1994, on an amend-
ment to City Code Section 14-6E-2, Neighborhood Commercial Zone
(CN-11, to allow restaurants as provisional uses or by special exception
with specific restrictions, and car washes by special exception with
specific restrictions.
Comment: At its October 6, 1994, meeting, the Planning and Zoning
Commission, by a vote of 4-0, recommended that in the CN-1 zone: 11
dwelling units continue to be permitted by special exception, 2)
restaurant uses of 2,500 square feet or less be permitted as provisional
uses, 31 restaurant uses of more than 2,500 square feet be permitted
only by special exception, 41 in no case would restaurant floor area
usage exceed 20 percent of the total commercial floor area within a CN-
1 zone, and 5) car washes be permitted by special exception, provided
the car wash is restricted to one bay and is an accessory use to a filling
station. The Commission's recommendation is consistent with the staff
recommendation.

Renee Paine/ 4347 River Bend Road here in Iowa city. speaking as
the Director of Public Access Television tonight I just wanted
to announce our new staff assisted series program which are
now in production over Public Access Television. They will
be-we have five and I will just quickly say what those are and
give a one line description. We will be doing a show called
Adopt A Pet. It is an update of pets available for adoption at
the Coralville Iowa city Animal Shelter. Another show is
called It Is News To Us which will be a local news and events
show. Tom's Guitar Show, a how to play guitar show, featuring
our own Tom Nothnagle. The other species which will be a
program dealing with stories and articles regarding animals.
And the Sanders Group back in all of its glory which is a free
wheeling discussion of current issues hosted by Gary Sanders.,
Those are the five and look for them on Channel 2 probably
around mid-November. Also our annual meeting is coming up,
November 17. And that will be at 6:30. It will last until
about 9:00. It will be in Meeting Room A at the Iowa city
Public Library. The public is more than welcome to attend.
There will be food there. Also among the other festivities
there will be an election of one the membership of the Public
Access Television Board of Directors. So if you are
interested in being on the Board. Please attend that meeting.
If you won I t be able to attend there is a way to have a
petition filled out and possible get on it that way. Also the
final thing is our programming and other information about
Public Access Television is now available on Panda for all of
those-for those of you who are now on the information super

Horow/ Thank you Renee.
Ron Vogel/ Last Monday I read the report on pesticides and drinking
water written by the environmental working group and
Physicians For Social Responsibility. Then I read the
newspaper articles about it and they completely missed the
point and that is one of the things that I would like to
mention here. But first I would encourage you to read the
report. If you do I think there would be four things that you
would insist on finding out about the local water plant and
the water in the Iowa river. The first one is when is the
water plant sampled. There was discussion in the report on
the periodic variation of these levels of pesticides in the
water and the rivers and you could do this by simply looking
at the dates on the samples for the last two years, for
instance. The implication in this report is that some water
plans intentionally or otherwise miss the peaks of pesticides
in the water. Second one is how much of these pesticides does

the water plant remove. There is a discussion in this report
about different technologies for water treatment and how many
pesticides they remove. The third one is there was an
independent study done last year on several of these same
pesticides by Roger Gopul in the Geography Department and it
such be possible to compare the results of that research with
what is in the report and with the water plant's own samples
to try to sort some of this out. The fourth one is we know
there are other chemicals in the water. We tested for some of
these ourselves. There are other agricultural chemicals.
There are also the inerts in, the pesticide formulations which
can be just as dangerous as the so called active ingredients
and their are lawn pesticides in the river. We know that.
And a more appropriate question and what they addresses is
what would be the total cancer risk if all of these chemicals
were taken into account and not just a five they specifically
measured and were concentrated on. Now these questions
probably wouldn't occur to you if you just read the articles
that were published in the local newspaper. The local
newspaper is not doing an adequate job of covering health
issues. After testing, this is what I mentioned by this
report by the environmental working group is one example.
There are several others in the last year or so. After our
testing of Ralston Creek for pesticides last spring and which
we found a number of them, we submitted an article to the
paper with the results and they refused to publish it. Last
spring a so try on the connection between the pesticides and
breast cancer was in most of the other papers but not the
local paper. Three weeks ago there was a regional conference
here at the University entitles The Media's Role in
Communicating Health Issues. The local newspaper didn't even
send a representative. But the worst example was probably the
one a couple weeks ago, the article on grub worms. This
article was like an advertisement for the lawn chemical
industry in promoting the use of diazanon. Diazanon is one of
the most dangerous of all the lawn pesticides but this article
contained no warnings. It mentioned no health hazards. Over
the last seven years while I have been associated with the
urban Pesticide committee with EA we've received hundreds of
phone calls and letters from people who have suffered various
health problems due to pesticides. I know of several people
who have been permanently disabled because of exposure to
diazanon. The environmental affects are even more severe.
Diazanon is rated by the EPA as very highly toxic to fish and
birds. Its use is not allowed on golf courses or sod farms
because it kills so many birds. It has been found in over 30%
of the water supplies in this country. My point is read the
original material. Last year during the debate on the
pesticide ordinance I asked you to read journal article. No
one did. One council member made the statement that he hadn't

heard from his friends yet. If you want the answer to a
scientific question you can't rely on opinion and the local
newspaper doesn't report it. Please read the original reports
starting with the recent one on drinking water. Thank you.

Douglas Jones/ 816 Park Road and I would also like to comment on
the report that came out last week. I read the report. I was
there at the press conference and I watched the media coverage
of the environmental working group report in the days that
followed and I was also disappointed by the coverage. It is
not just the Press citizen. The D.I.'s coverage was fairly
confused and the local t.v. stations were fairly confused.
The report is available from ICAN. ICAN held the local press
conference as other local representative for the group that
did it and it is a good report. In general I was extremely
impressed with the report. I felt that the one thing that it
didn't do very well was look at economic incentives that would
be available instead of regulatory approached for solving the
problems. Looking at Iowa city' Water Department, both the
response of the Water Department to the report and more
importantly the response of the water Department to the
problems with our water, I am quite impressed. We could do
better. We are planning to do better with a new water plant.
But if I compare the response of our Water department with the
media reports of the response of the Cedar Rapids Water
Department and of the University Water Department what I see
is a tremendous contrast. The representatives quoted in the
media of the Cedar Rapids Water Department gave a major denial
that there was a problem. our water is safe. There is no
problem. The public need not be alarmed. And the same
response is what the university Water Department. Instead
when I look at the response that I have seem from Iowa city's
Water Department I have seen a balance of yes there is a
problem, it is a problem that we have to deal with seriously
and it is a major justification for our proposed water
treatment plant. But also, in general, the water is pretty
safe. That is true. Looking at the statistics in the report

that came out for the safety of the water I conclude that the
health risks posed by regularly drinking Iowa city water are
probably significantly less than the health risks of driving
without a seat belt. If I drove regularly without a seat belt
and acted unconcerned about those risks you would consider me
foolish. If everyone drove that way as we all drink that way
these days we would expect as a society to pay a fairly high
price for the impact of that collectively foolishness. I
suspect as a society today we are paying a fairly high price
for the impact of our failure to take appropriate steps to
treat our water and to preserve its safety by preventing
things from getting into it which ought not be there. But at
the same time each of us individually were are not terribly
threatened. In the 1950's we weren't terribly threatened
individually with our failure to wear seat belts. They
weren't available. I remember that era. with that said
though I think we are facing a significant problem. iowa
city's Water Treatment Plant does indeed take action that does
reduce the concentration of the pesticides in our water. We
use activated charcoal in one of the less cost effective
approaches that we can only afford to do during periods of
peak toxicity. We use dilution with fossil water which we can
pump I don't know for how many years before we no longer have
fossil water available. This is water that got into the
ground before pesticide use was popular. So we dilute the
problem and we filter it some what. The new water treatment
plant that is proposed would do considerably better because it
would have essentially the full technology recommended by the
environment working group report. As the best that a city can
expect to do treating the water on its way out of the river.
There is not much that the city can do as a city to deal with
the root source of the problem and that is what goes into the
water upstream. We can do something responsible for those who
are drinking water downstream all the way to New Orleans and
that is to attempt to reduce the run off of pesticides for our
own territory. But all and all I have to say that I am just
extremely impressed with the quality of the people we have
working in our water plant. I believe that they understand
the problem in as much they are in a position to deal with it
and if we give them the resources as planned I believed we
will do about as well as the city can hope to do.

requested that I research Iowa city's proposed Neighborhood
Open Space Ordinance. Much has been nationally as we all are
aware of on this issue and I contacted the National
Association of Homebuilders for input. I included a copy of
the September 8 and September 9 drafts and they were sent to
the Regulatory Affairs department of the Association. This
morning I received a letter and supporting information
regarding the preliminary research done at National. This
information should be carefully considered before final
ordinances are passed by the council. My detailed report,
including this information, will be provided to the city
council through the city manager's office before the end of
the week. I would be happy to provide any additional copies
to specific city departments if they would request them. As
noted in the agenda I submitted a letter to the council
requesting a two week delay before first consideration would
be given. Mr. Atkins advised me this morning that during your
work session last evening you denied the request.

items. In recent newspaper articles relating to the Crime Bill
enacted by the federal government it was noted that the city
of Iowa city was the likely recipient of significant sums of
money. I guess my question to you would be and a note of
caution. I know you have talked about this but before the
council would rush head long to accept this money I would hope
that you would very carefully consider the ramifications
thereof knowing full well that that money is not going to be
available after the first year I am sure. And I don't know
what the council has directed staff to do at this point but I
certainly hope you would be considering that in that vein
also. Secondly your most recent discussion relative to volume
based garbage rate increases and the likelihood that this is
going to ensue I would hope that you would look at all factors
in this particular arena. I am speaking from a personal point
of view with a what I consider a large family. One that
generates a significant amount of solid waste. I think it
would be patently unfair to single out those families that
unfortunately and not by necessity just by the virtue of our
size would generate a significant amount of solid waste. We do
our best to recycle. We certainly try our hardest in that
endeavor. I would hope that you are looking at all
alternatives because as you well know the residences of Iowa
city only contribute I think less than 15% to the landfill.
Now I think you need to look at the overall area when you are
considering this. I think you are unfairly potentiallY
singling out the residences of the community that quite
frankly we are paying for it now and we shouldn't have to
unduly accept larger increases in the future. I realize you
have regulations and you have timetables to meet but I think

there are other ways to do it than unfairly tag us with more
costs. And that is just for your thought in the future. I
know you will be having a p.h. soon on the water and sewer
rate increase. I guess one question I would have preliminarily
to that is with the wastewater changes and the new regulations
that are coming down after all that was done to improve and
build the new plant I think the people should know what the
government is demanding of us here locally. I think you are
unfairly taking some discussion, some criticism just because
there are new rules and regulations being promulgated from
Washington quite honestly that many of us don't understand and
I think should be explained to the public and really is there
anyway that you as elected policy makers can challenge some of
those regulations that frankly are being written by non
elected individuals in Washington.
Horow/ Well, there are-we belong as you know to the National League
of cities and I sit on the Energy, Environmental and Natural
Resources Policy committee and the aspects of national
application of standards that in some areas of the country are
not applicable. This is being questioned. But as you also
know these standards have been written because Congress has
passed the laws and that has come from people asking them to
pass the laws. So it is a matter of us having to meet
standards of purification for wastewater discharge that other
places they have more problems. We don't. We still have to
pay the tune.
Balmer/ I think what is unfortunate, Madam Mayor, is this community
exacted a large amount of money to what we thought to upgrade
to the standards that were requested. And now coming in again
with another level. I think that is the thing that I think are
most troublesome and that is just for your information.
Before I sit down I do want to compliment the city staff and
specifically the Solid Waste Department. I think they run an
outstanding program and I think it is one of the best around
as far as collection and people that do it. I think those
people should be complimented. I think you run a fabulous
service. That is one area of government that really does work.

Pigott. Sue, could I just mention something. Mr. Balmer, it is
regarding the solid waste issue. We talked in the session
that we had regarding that issue about the process and it is
important to let you know and the rest of the community too
that the process isn't finished and we are in the process of

adjust or change the program based on what we have gotten. And
then in addition to that hold a p.h. to hear more from the
public as to the benefits or drawbacks. SO I appreciate your
input and hope to receive more of it as we get the plan
together in the future.
Balmer/ I appreciate that. I think that is comforting to hear that
there will be further dialogue. I want to make one additional
point. I appreciate the leaf pickup. I think all the
community does. I want to make one suggestion. Maybe that you
do it once or twice in the spring also.
Throg/ Sue, I would like to say something else. John, I would like
to say one other point about the garbage program that we have
tentatively decided to adopt. It is not simply that we would
reduce the amount of garbage that we would pick up. In other
words only have two cans that we would pickup and have a
sticker for the remainder. We are also planning to have
curbside-weekly curbside pickup of recyclables material and
providing a can that would cost $.20 a month for people. So
there is a great opportunity to recycle and reduce waste in
the first place and the other cans could be used to dispose
the other garbage.

unfunded mandates. We would prefer to work with the state and
with the feds doing our best as we can with what we can do.
It could be worse. In other words we took it under
consideration and didn't see that it was that difficult. Now

Glasgow/ I wanted to talk to you tonight about the proposed water
works site plant and so forth which is north of I-80 at the
KXIC towers. If I could save you $30 million on that site
would you give me six minutes to talk about it.

cross rivers and so forth to get it. The city of Galesburg,
Illinois goes 50 miles out to the Mississippi to get their
water. The state of purifying water from whatever source is
unsurpassed at this time. The University of Iowa can give you
all the information you need on that process. The nearest
reservoir to Iowa city is the Coralville Reservoir, three
miles from Iowa city. I am attaching a list of savings the
citizens of Iowa city would gain by moving this water plant
from 1-80 on Dubuque street up to the Coralville reservoir.
And in the minutes I have left I can only give you a few of
them. So first of all the cost of the land and the lease
costs-you have a sand plant out there with leases going back
for nine more years. That is going to be costly. We can save
a lot of money there. We can eliminate the purchase and
repair of the Coralville Power Plant Dam. The city is going
to buy that dam for $1.00 but I predict that it is going to
cost us more than $2 million to replace that dam and it is
required because we have to keep the water level high enough
for the new water plant. We have to take 3 24 inch water
mains underneath four existing Great Lakes Pipeline-Williams
Brothers Pipelines. I tangled with Williamsburg one time about
12 years ago and they wanted $50,000 to lower a pipe across
Tanglewood Lane. Mr. Baker would understand that. Now we
have to go underneath four of them. Four pipelines and take
three pipes, 24 inches in circumference underneath that. That
is going to cost somewhere in the neighborhood of $250,000 if
my $50,000 estimate is correct. We can eliminate about 5,000
feet of this 24 inch water main if we come from the Coralville
Reservoir rather than from this area, the KXIC area. And what
will it cost me by destroying all of the wells north of Iowa
city. I estimate that at about $500,000. If we can eliminate
the cost of one Jordan well and all the unknown other wells
that are suppose to be drilled out at the KXIC Tower site I
think we can save one half million dollars. Jordan Well in
North Liberty cost $275,000. That is just one well. If we
can reduce the purification process to just one source of
water. Now out there at the KXIC Tower site we have two
processes, one for Jordan and one for river water. If we can
go out to the Coraville Dam and eliminate that one water
source that has to have a separate process. $5 million in
savings. And you can eliminate the sanitary sewer from Foster
Road clear out to KXIC Towers. I am not guessing at this
figure because I have got it, $1 million. So, cost savings
there I estimate to be somewhere around $24,000.

Dick Dolezal/ I live at 1111 Marcy, Iowa city. A little rebuttal
for Mr. Glasgow. I noticed in the paper a week ago that Iowa
City was on the lower end of the graph. They were showing
towns that had pesticides and herbicides in their water.
sigourney, Cedar Rapids were all way higher than us but yet we
had the most antiquated water plant and I thought about it
awhile and I think it is the reservoir where it is all sitting
so I don't know if that is such a good idea or not. I am here
tonight because I am concerned about the cost that you people
are incurring for citiZens of Iowa city who aren't in the
weal th category that some of the higher paid doctors and
professors over at the University are. The people that are
blue collar and had to earn their money, maybe people on
retirement. I noticed in my property tax the last several
years historically the schools has always been the biggest
bite out of your property tax. I notice the county and schools
are now under Iowa city. The county hasn't increased for the
last year more than $2-3 for my property tax but the city of
Iowa city just keeps going up and up. You keep going up and up
on the water plant, the sewer plant, the garbage collection
and where is it going to stop. I mean this is a-I seen one of
the councilman had it in the paper last week that he was in
favor of water-using the water rates to conserve water. That
relates to me more increase in the water cost. Is that right
Mr. Throg.
Throg/ Depends on how it works out but what I am trying to get at
with regard to that has to do with the multiplication of water
consumption times the rate that we pay. If the rate goes up
and if you can reduce your own personal consumption then the
bill that you will have to pay will be lower than what it
would otherwise be. But there is another point that you're
tying to make and that is if everyone conserves water than we
still have to pay for the plant and the overall rates will
have to go up so my point has to do with people who somehow
don't have the opportunity to use water more efficiently
because of their fixed income or because they're low income or
because they're renters and what I want to do is find a way to
help them keep their bills from going up as much as they're
going to go up.

Dolezal! I certainly hope that you believe what you're saying but
I don't believe it. I see what you're saying is we'll increase
their water rates. Therefore people who don't have the funds
to pay for it will use less. That's how it relates to me.
Another item that I take issue with is the recycling effort.
I read in the paper if I'm not correct that you're going to
provide everybody in Iowa city with a trash container. The
people who believe in recycling are have already gone out and
purchased a container and they're already recycling.
Horow! That's perfectly all right. If they have them they may use
them again.
Dolezal! If you use the one you have.

Dolezal! Then there's some mention in there of you expect to see a
reduce in the refuse collection with an increase in the
recycle collection. If that is the case then I assume our
recycle fees will go up because our collection fees won't go
down. If there is an increase in the recycling I aspect then
that you are going to be charging more. You definitely going
to charge more for the containers we are going to purchase.
There has to be an end in sight somewhere. I mean that is very
questionable what I am saying. We purchased a $90,000
telephone system for this building. Mr. Atkins told me it was
the state of the art when I questioned him on it. For who does
it help. It doesn't help me when I call down here at 356-5000
the operator can't hook me to the person I ask to talk to. I
have to go through a rigamaroll pressing 1 or pressing 2 or
pressing 3 and when I get that person they are not there I
press 816 to talk to somebody. The other day I called over to
Karin Franklin's place and it rang five minutes and for every
20 seconds it came on we are busy now we will get to as soon
as we could and it went for five minutes and then it rang for
two consecutive minutes and recycled and started ringing
again. When I questioned the purpose who answered the phone
they said they had nobody assigned to answer the phone during
the noon hour. I don't know what that saved me with. It might
have saved the city a lot of money. Why do you constantly or
why does the newspaper and you people have to quote it because
they are quoting you constantly tell us what our rate increase
on our water bills and sewer bills will be in an monthly and
our bill comes out as a to month bill. If you would double
that figure I am sure you would have people down here pounding

increase the cost of it by going to a single monthly billing
because we can't afford to pay two month bill when you get
done with this. I got it figured out my bill will be $190
January 1, 1996. That is what it is going to be if I have

audience estimated his was $189. So we are not too far off. I
figured there is going to be at least $8.00 a month in
recycling because I am going to have to pay $1.00 a month more
for a bag. I mean a $1. 00 per week more for a bag which
relates to $8.00. So I just-I am frustrated at this point. I
don't know where it is going to end. I think you are going to
drive us people out of the city. I see in the paper the Chief
of Police is talking 8 new officers, not you people yet. But
do we need 8 new officers and what criteria did he use to
determine that we needed 8 new officers. Only because the
money was available so he took it. We are paying for it either
way out of either pocket. I would hope that you would consider
a lesser amount of officers because I don't think we have a
crime \~ave in Iowa city that I have seem lately. As in
understand now that police operation would be worth roughly $1
million after four years increase in our taxes. I talked to
the city finance man the other day. He said I was a little off
but he indicated by I was too far off. I figure we have to buy
uniforms. We got to pay workmen I s comp. You got to do all
these other figures, not just the cost of the officers. So you
are talking a lot of money. One other thing that I want to
talk about is the water plant we are talking about building.
After our little fiasco down here where we are paying for it
twice I would certainly hope because it has been mentioned
before that you people would take this pesticide and herbicide
issue into account because as I read the paper correctly that
is not planned to be treatable in this present plant.
Throg/ Wrong. It will be treatable. It is going to be a fine plant.
Dolezal/ Well, I don't think we need bicycle paths. I don't think
we need a castle for a sewage plant that is going to be so
many floors in the air.

Doug Jones/ One small issue brought up by Mr. Glasgow's comment
about the old Coralville Mill Dam. I have been trying to get
somebody to pay attention to that dam for years on a low key
basis. This summer I decided to canoe up there again and poke
around and see how it stood up to the flood and what I
discovered is of some concern. That dam needs someone to pay
attention to it. Somebody has to rehab that dam. It is going
to be either Johnson county who owns it now or the city who I
believe ought to own it. We the taxpayers are going to pay the
, price of repairing it or demolishing it one way or the other
and I would rather see it repaired because I believe it is an
asset to the community as a dam. Right now the east end of the
main dam has a large crack in it that is leaking water at high
pressure around the dam foundation and through the dam and not
over the dam where the water belongs. Right now the emergency
flood spillway of that dam is undercut in some places as much
as half of the width of the concrete by the turbulence of he
flood. That dam needs attention and I urge the city of Iowa
city to take the initiative, get that dam and fix it before it
collapses and becomes such a liability that we have to
demolish it. I think demolishing it would be a disservice to
the community, to history and to the scenery of the river.

city is becoming non-existent entity. Every time the city
increases rates these rates are passed on to the tenants who
are renting. Every tenant that-anyone in Iowa city who rents
from someone ought to be down here complaining because that
goes right back to their rent. A lot of the older buildings
are plumbed in such a fashion that the owners receive the
rate, the water bill, and it is not divided amongst tenants.
So there is no way for us, as any property managers or owners,
to reflect that back on who is and who is not conserving
water. There is just no way to do it. When you talk about and
the one gentleman addressed this a $10.00 or $22.00 increase
in your bill per month. For some of the people in Iowa City
who cannot afford it-By the time it gets to a $22.00 a month
increase, that is $44.00 above what they are paying right now
and that is only for water. That doesn't include the sewer
increase. And that is on a bill that is an average bill of
$23.00. Now that is really not too bad until you start
receiving a bill that is $300-400 and higher. Now when you
start talking about your rate increases of 35%-40%, add that
on to those and then you are going to see some rent increases
along with the property tax increases. The tenants pay for
this. The owners cant afford to pay for that. Along with
that-one other item that has been coming up is the trash
collection at the multi family dwelling unit. And I urge you
to please consider that a lot of the apartment persons are for
this. There are probably some that are not. But a lot of the
ones that I work with are willing to work with the city if
they could just come together on what they are going to do.

As we looked at this use and found that it didn't seem to be

therefore are proposing this amendment so that it can occur.

Throg/ I guess I would like to say something about the ordinances.
I think in principle they are fine ordinances and at this
point I am quite ready to support them with pleasure which is
not to say that I want to shut the door on hearing what Carol
Goddickson or anybody else has to say in public discussion
over the next couple of weeks or there abouts. I guess I
would also like to say that these ordinances have been in the
works for about a year and they derive for the Neighborhood
Open Space Plan that took two years to develop before that. So
the Neighborhood Open Space and the related ordinances were
initiated by previous council and the Neighborhood Open Space
Plan itself was approved by the previous council and we are
just following on some good work that they initiated and we
need good neighborhoods and a good neighborhood isn't just a
matter of housing. It is a matter of having roads. It is a
matter of having water. It is a matter of having sewers. It
is a matter of having good parks for children to play in
without the threat of harm from cars and whatever. So I am

Pigott/ So am I. I think that point that I would like to make,
Jim, is it is a part of the infrastructure. It should be
considered part of the infrastructure and the open spaces in
the neighborhood and I support the hard work that Casey Cooke
and all of he other people that have devoted to it have put
into it. It looks like a good ordinance.
Horow/ Casey Cook. That is okay. Maybe Casey did but Naomi and I
have been on this since '84 or '85. It has been a long time

Lehman/ You know we have been, over the past several years, we have
had a, I think, a fairly successful effort in getting builders
to contribute property for green space. And I think it has
worked fairly well. One argument I haven't heard for this is
perhaps those lots are worth more if they have green space
around them. Now we have heard that they cost more. I think
perhaps I may be able to support this by the time we read this
a second or third time. At this point I am not so sure that
the system is broke and if it isn I t broke maybe we really
don't have to fix it. So I guess I will be voting no for the
first time.
Nov/ I have to understand your argument. Most developers do comply
that do negotiate and they do contribute. But those that
don't need to be addressed on this fashion.

Gentry/ yes. There has been some miscommunication, I think, and
some misunderstanding between the city and the county
regarding the city's intent to comply with the Conditional
zoning Agreement entered into in 1988 between the city and the
county whereby the wastewater treatment plant zoned public so
that the city could use it for its wastewater. We had some
problems with the City Development Board for purposes of
annexation and the city staff and county are getting together
tomorrow morning to solve some of these problems and I think
they are all very resolvable and very doable within a short
period of time. And we have to communicate somehow with the
Development Board as to the November 9 meeting, steve. Don't
let us forget that.
Horow/ November 9. This item is being deferred to November 22.
Gentry/ Yeah, right but the Development Board deferred until their
November 9 meeting so we have to communicate something to them
before that.

Throg/ Well, Sue, I guess I would like to say that sometimes there
are legitimate conflicts between governmental agencies and

Franklin/ Before we have public comment the council had asked that
we put together something to hopefully clarify for people what
was going on here. The first p.h. that you will be hearing
comment on is the parking facility impact fee. The parking
facility impact fee district is shown on the overhead in dark
outline. Any residential or commercial property which expands
or has new construction within this area would be subject to
the parking facility impact fee. The urban revitalization
plans and districts are the subject of your other two p.h.s
and the commercial district that we are discussing ins the
area outlines in yellow which is essentially the CB-5 Zone and
then the area that is outlined in green is the residential
urban revitalization area. The hatched marked properties are
those that we have projected in the Near South Side Plan which
was done two years ago-the potential for redevelopment within
ten years. Now we haven't it shown on here Town Center which
is in Block 103 because that redevelopment is already taken
place. The other possible changes from this include the small
piece of property on Block 19 which is the Dan Bray, Lori
Klochau Law Offices that were rezoned to CB-5 and we so we
don't expect redevelopment there. The possibility of
redevelopment on Block 1 and on the southeast corner of Block
103, whatever happens with st. Pat's, may come into play also.
Understand that all of these projects of possible
redevelopment within the next ten years are speculation on our
part but they are based on the buildings that are there, the
ownership and some discussion with the owners two years ago.

have lots of different voices and I might be a ventriloquist
but I don't have the advantage of having a separate puppet for
everyone of my voices. So just to recap quickly so the
involvements I have with the collection of issues are first of
all I am connected with the Chamber of Commerce in this. I've
worked with the d.t. expansion task force and have attempted
to work on the consensus building aspect of this through the
Chamber formally and we'll pass on that view. I am the owner
of a peculiar kind of enterprise that's associated with this
area and the incentive network in this area that being the
owner of an office variety as opposed to retail variety
business. I'm a business tenant in the projected area
projected commercial area. And my final voice, my Lambchop,
would probably be me. I will through in my asides from time
from time too. First of all from the institutional stand point
the Chamber standpoint and I advise you that the Chamber
executives have approved this position. The board has not yet
and we'll post you on that. First of all on reviewing the
objective that the fundamental purposes pretty much the same
as last time I talked to you. We believe that left alone the
area would develop to residential. Something would happen
absent some kind of incentive program. And that expanding the
basic core of the d.t. with the Iowa city kind of a mix of
residential office and retail into this area south of
Burlington is in the interest of the public. We also believe
after some discussion as you might expect was appropriate
under the circumstances and the comments of last time that tax
abatement is an appropriate kind of incentive to bring about
these public purposes. The carrot is still a worthwhile tool.
Somewhere along the line there's a carrot. Now you've looked

at the plan that divides into two the original area that was
being considered the residential and the commercial
redevelopment areas. The Chamber advises you that that seems
like a reasonable kind of division. It's an elaborate bow to
the inevitable. What's really happened historically and really
what the circumstances the area are. I think that's very
reasonablG, A comment at this point if you look at how far
we've come so far in implementing this policy. If you give us
all a grade ~~ this we might get a gift D on this. That in
reference to looking at commercial incentives there has been
a commercial spot created which is vacant and remains vacant
and also has been vacant. And there has been a project turned
down that had substantial commercial impact. So we haven't
gone very far in the existing policy. Again, Chamber.
Proposed impact fee is not justified. I made some of that
argument and I will continue that in maybe one of my other
voices here in a brief period of time. The Chamber believes
that the closure of Dubuque Street is not justified at this
time in that if you balance the proposed amenities. Posed in
that proposal that would make ingress and egress in the
existing d.t. difficult. It will make it difficult for those
of us who are there and it will make it difficult for anybody
who becomes there without seeing our way clear on that. So we
don't see our way to clear it to endorse that right now. We
also would suggest to you that the proposed employment of a
consultant at this time in light of some of those context
issues may be premature. One thing from the Chamber
standpoint that is important to review and go back. Last time
it was clear that there was unanimity among the business
community in reference to this issue. That that was the
subject matter of much discussion, introspection, discussion
to see if, in light of that. And that argument was basically
why should the government give carrots to people when there
are people who are in the business of selling carrots. And
that, in general, is a good argument. So one has to think
hard about why it should be and the people that raised this
argument are solid citizens, solid business participants in
the community who have substantial investments and whose
interest would not be taken lightly. The two major points
about this, however, seem to us to be: l-that the public at
large does benefit. That we will all benefit from this and
that any kind of temporary dislocation or temporary apparent
competitive disadvantages would be, in fact, that-temporary,
over the long run, that will all grow together to the point we
make out. Voice shift. All right now I want to tell you
something that I think may have been lost in this. I am now
speaking to you as I said a special kind of group of
commercial people. I am a office person which means that I am
a service business. I don't sell particular items. People
come see me basically by appointment. They usually make single

purpose trips and they usually arrive by virtue of their
automobile. In thinking about office type of people I pose
you two different pictures. I found this helpful when thinking
about this issue to think about two different situations.
Think about d.t. Cedar Rapids on one hand and the area of
Ames, Iowa known as Campus Town-dog town to those of us who
spent any time in Ames. Two differeht-very different
compositions of commercial. They could all be called
commercial under our treatment here but there are two
different kinds of commercial. The important thing to think
about there is which do the implementation schemes here lead
us toward and where do we want to be on that. The thing about
office that I need to pass onto you is that when I started in
the community in 1975 it was clear to me as I think back to
the orthodoxy of all of this kind of situation: banks, the
lawyers, the real estate offices, insurance offices,
accounting offices, all the people that fall into this
category. The orthodoxy was you must be d. t. There was
really no discussion about that. Your office had to be d.t.
That where it was. And so we built through that. The retail
has been organized from that. The transportation systems have
been organized for that. until recently and particularly
focused in my own thinking by the comments that came from the
folks who objected to the proposal the last time. There had
been more and more people among this community, for various
reasons, that are saying almost literally I don't have to be
d.t. The office people are saying that. I could tick a bunch
of these off. This bothers me. There is a blind spot in mind
and I think it may be something we need to think about because
that group is an important group for this whole concept
anyway. So test the plan and the implementing elements by
affect on that group. A disincentive to that group is an
incentive to the basic premises of the plan. That we all grow
together that we balance our growth. Voice shift again. Now
I have to shift into my resident of 150 East Court Street,
corner of Court and Dubuque Street. I have been there for
approximately ten years.

In order to construct an improvement by a quasi proprietary
system of the government which could currently finance that
very easily under existing policies by itself, I view that as
extortion. I think that the developers are having the parking
impact fee exhorted from them. It would be a disincentive to
me. If I would do it it is a matter of a principle enough to
me that I would not apply for tax exemption to do that.

Willis/ What I suggest here the problem is this fits into a larger
fiscal dialogue which I do not believe we have had yet. And
we need to. If there is going to be a major change in how we
are going to deal with parking funds and how this relates to
transit and how this relates to the d.t. in general. Let's
have it. Let's do it. I know all the members of the business
community would be anxious to do it. Let's confront it.
Let's not do it in the back door this way. But in any event
the point here is to me the lowest level here that would be a
disincentive. A disincentive to do it. Where we are talking
about carrots it is a non-carrot. It is a negative impact.
Now closing Dubuque street. I certainly have always been on
record favoring open space and hearing the discussions tonight
about the Neighborhood Open Space reminded me of the time that
I was back on the P/Z Commission when all of that was going on
the first time and I remember that very well and I remember
the part of that plan that dealt with the Neighborhood Open
Space assessment assessing for different parts of town what
was lacking about parkland and d.t. is one of them clearly.
Well, so, I am in favor of that in general but when you think
of it in how it applies to me that open space to me the office
is not an amenity. So, if you are constructing-closing
streets, constructing improvements to make amenities to draw
as an incentive businesses my use is indifferent to that.
That doesn't matter to me and the people who come to see me.
A way to put that is-well, a way not to put it in my opinion
is it is not a field of dreams. Build it and they will come.
Well, build what and who will come. In graphic terms I asked
myself if the folks who are at noon between Washington Street
and college Street in the pedestrian mall are there to buy
securities at Dains Bosworth, generally not. Generally not.
So it is not a direct amenity in that kind. To me it will
make my access difficult. Not me, I don't care about me. It
is the people that come to see me that I care about. closing
Dubuque Street makes my access more difficult. I have some
antidotes which I won't share with you about coaching people
who call me on their car phones coming from out of town with
an abstract saying that they want to-they are coming off of
the Dubuque Street exit and they would like to know how to get
to my office. That when was the last time you were in Iowa
city-1950, good luck. You stay where you are and I will come
and meet you. But in any event, because I am a tenant, if my
access is more difficult I suffer some kind of damage on this.
I suffer damage to the point that I will move. So I am moved
out of the area where I think I am a preferred use by this
particular use. In other words right now the way the deal
looks it doesn't look at the amenities that we pick up are
worth the trade of my access. I will go somewhere else. See,
I have a luxury of doing that being a tenant. The owners, ny
landlords who are sitting over there are ready to put on their

boxing gloves here have a different oplnlon but I will just
move. I will go somewhere else. And that has happened. That
has happened to me personally. I use to be in the savings and
Loan Building across from College and Clinton street. Access
problems moved my along. One other point, subpoint, about
being along Dubuque street there. There's a lot more traffic
there than I would have ever thought on Dubuque street. I
noticed the traffic counters came out the first week in
October and I am sure showed that it is probably as busy as
Linn street and maybe not as busy as Clinton street. still it
is a busy street. It is a direct route for our friends down
at Johnson County Ambulance at 808 S. Dubuque street. Since I
have been-we have been talking about this I have been looking
out my window every time a ambulance call comes from the
ambulance garages and the ambulance goes straight north,
through the intersection of Court street, up the stub of this
street and goes straight to Burlington street to respond to a
call to go east or west. So most direct. It is not to say
that they wouldn't do it otherwise but it is the most direct
route. So the usage patterns I think in general indicate that
'. the street is part of the system. The argument has been made
to me and I think I buy this from my own observations is that
also the egress from the Dubuque Street Parking Ramp, for
example at 5:00, becomes more difficult if you close Dubuque
Street. People say that it is a third, a third, a third of
people turning left, right, going straight. If you cut one
off it makes it more difficult. I understand the exit-

Hanickj I want to jump right up. I am here as a owner of a
business in the south side redevelopment area, Lepic Kroeger
Real tors and also representing a group of investors and
partners who seek to develop a hotel at the corner of
Burlington and Dubuque streets. I wanted to jump up very
quickly after Mr. willis finished. It is always a pleasure to
speak after someone so eloquent and you can agree with most of
what they said and get that on the record. I do agree on one
level and I have spoken to a number of councilors on this
issue individually. But i do agree with the general concept
that abate and parking impact should not be linked and I
wouldn I t probably use the words to describe that as Mr.
willis. But I do think it is unfair to link those things. I
thin at least on one level the public benefit, the public good
derived from the kind of redevelopment we are seeing plans for
is in fact justification for the kind of abatement or carrot
as craig described it. That said and for the record I have two
other items I wanted to mention. One-in our particular plan
and given the location we seek to develop early on in our
planning stages we were directed to work with city staff and
specifically Mr. Fowler of the d.t. parking garage and we have
ascertained that at least at this point we would be able to
allocate a certain amount of parking in the Dubuque street
ramp for our use and I wanted to point out and I for whatever
discussion there might be the fact that this is a kind of a
double indemnity that we particular are going to suffer here.
We are going to pay for the ramp. We are going to pay very
directly for out impact across the street as we use that just
like anyone else would. But at the same time we are going to
have to pay for probably something that we aren't going to
use. Now there is going to be some sort of circular argument
saying we are pushing people out of that ramp and they are
going to have to go somewhere. I am told there is adequate
room in the ramp as it is now. So I at least throw that out
as a question. Is there, at least on some level, a kind of
double indemnity here, for our particular use and should that
be considered and should there be some sort of offset or
credits that can be entertained on that issue. And the last
thing I wanted to mention was we have talked in some very
general terms about the closing of Dubuque street and I just
want to reassert that we have never taken a particular
position on that but we are at a fairly crucial corner on that
block. We are not opposed to closing it. We are not
necessarily in favor of it. We want to work with the city
staff in planning our own development and we will do that.
But I certainly have respect for what craig mentioned in terms
of what he perceives to be impact on his business and on his
building. So I wanted to just say that we are not taking a

America in the ownership of the building on Court and Dubuque.
This building was built in 1980 to accommodate our bank and
other commercial tenants. Again, we provide parking for our
customers, tenants, their customers, and also access for a
dri ve up window. Currently our tenants represent an insurance
agency, an abstract title company, law offices and a dentist
office. All are very dependent upon services and very
oriented that way. The access to our build, of course, and
parking lot is off Dubuque street, both north and south. Our
concerns are with the closure of Dubuque Street. The closure
of it would limit the access for our customers and our
tenants. It would further isolate us both visibly and
vehicularly from the central business district that flows off
of Burlington Street. Closure would also limit or lack of the
access to our drive up window which is very key to the success
of our business. Any change in Dubuque Street creates a
drastic change in the traff ic access to our property. We
believe that the closure of Dubuque Street would have a
significant and adverse impact on the usefulness and the value
of our property. Mid-America is supporti ve of the
redevelopment plan of south of Burlington and does hope that
the city is able to go fourth with the plans that facilitate
the redevelopment. However the bank does not believe that
closure of Dubuque Street should be a part of these plans.

John Gross/ I am a co-owner of a business in d.t. Iowa city. I
would like to make just three points about the plan. First
closing Dubuque Street seems to restrict the use of Court
Street as a way to get across that part of town. I use that
myself quite bit. And closing Dubuque Street will certainly
restrict the long term goal of moving traffic to Court Street.
It also restricts my access to clients across Dubuque Street
and I feel that the disadvantages and access problems to those
businesses and to the senior citizen center or the residential
properties there is certainly limited as well. So I would

oppose closing Dubuque street. It is really going to load up
that intersection as craig indicated earlier. You talk also in
the plan about hiring a visual design consultant. In looking
at the transparency that we had it seems to me that there are
very few properties clustered along Dubuque street or really
along any major access that would be redeveloped that could
benefit from the use of a visual design consultant. And
secondly I wonder if it is in the role of the city to tell
private property owners what their perspective buildings are
going to look like. We certainly had design review that
commented on the suitability. But to hire someone and pay them
to design these elevations when they are really only scattered
through the area seemed to be rather improper use of city
funds and not really the role of the city.

design specific buildings but to render a drawing which would
show what the sense of the council was on how this area should
develop in the long run and focusing a lot on types of

element in the draft resolution, right, about bulk and so on.
But the focus of the draft resolution was very much on public
space and how to create publicly useable space in the Near

get down to any detail of design and we will sort through that
if there is any misunderstanding before we would hire anybody.
Throg/ John, just to clarify, we have a draft resolution that we
are not considering tonight but which will come up in another
four weeks or there abouts and that draft resolution-the only
point where it really addresses buildings in the sense that
you mean it says the design plans shall also propose revisions
to city zoning regulations in a way that will prescribe the
design elements which create a unifying sense of place through
architectural design and public improvement projects. So, I
don't understand that to mean that we will be telling people
how to design individual buildings.
Gross/ That is good. The only place where there seems to be any
property massed together is Mrs. Hieronymous's space on
Clinton Street. other than that the parcels as I saw on the
transparencies are pretty much scattered and I am really not
sure how they can be unified when they are sometimes several
blocks apart. One additional point I would like to make and
that is the consideration of the st. Pat's parking lot for a
parking ramp site. I think it is pretty clear that shoppers
who park will park where they can see their destination. A
shopper will walk a quarter of a mile across a mall parking
lot because they can see where they are going. To put a
parking ramp on the st. Pat's lot is around the corner and
down the hill and I don't think we will serve shoppers well at
all. I would suggest maybe that a parking ramp if we are
looking for one to serve that area might well be placed in the
area of Mod Pod, a good size ramp there with an aerial link
across Dubuque Street to the hotel. Another aerial link to the
existing Dubuque Street ramp in providing a way of easy
transit. I am very concerned about people with suitcases
trying to dodge the traffic across Burlington Street. I think
they could be better served by a parking ramp across Dubuque
Street connected aerially. I would like to suggest that be
given consideration rather than the st. Pat's property. Thank

Dell Richard! I like craig share part of the Mid-America Savings
Bank as my office. Craig and I basically have the same office
space. His upstairs and mine downstairs. I have been a
resident of this area since 1972 and chose to stay here in
large part because of Iowa city's commitment to d.t. and my
interest in urban renewal in the d.t. area and those kinds of
issues. In 1981 I was looking for space for my law office and
I chose the Mid-America savings bank because it was a unique
property for the practice of law. It is close to d.t. It is
close to the court house, post office and most of all it is
one of the only properties in the d.t. area that had parking
on site. My initial lease ran out or runs out on December 31
of this year. For the first half of 1994 I was looking around
throughout the community to try to determine whether I wanted
to stay where I was or find a new location. ultimately
determined that there was no better place for doing what I am
doing where I am and I am now committed or have the
opportunity to remain at this location until 2025. That will
give me a total of 40 years in this location and so I feel I
have some interest in what is going on Dubuque Street. I am
willing to pay premium rates because of the unique nature of
my practice and the fact that my clients can get to me. A lot
of the work that I do is for people who want to stop, come in,
drop off documents, see me for a couple of minutes and leave
and so having access to Dubuque Street to get into my parking

Dubuque street. Are you working under the impression that the
'council plans to close Dubuque street from Burlington all the
way to Court.
Richard/ We don't have any operating assumptions other than that
any closure of Dubuque street would limit our access. If the
council is only planning to cut it off so that there is access
from the north and access from the south that would not have
nearly the impact on us as a complete closure of the street
which would effectively shut off our building from vehicular
access. We don't really know what you are planning for sure
because I don't think you have really told us other than you
put a big red line down Dubuque street and said we are going
to close it.

Baker/ That is not entirely true because I think the discussions
have been a substantial closing of Dubuque street with the
south side access still open.

would just like to comment that I like plans that I am seeing.
I like the direction that you are talking about going. The
idea that merchants are now beginning to think that they don't
need to locate d. t. whereas they use to think that is was
appropriate and I shouldn't say merchants-professional
services are now thinking that they don I t need that d. t.
location. That threatens me personally because my job d.t. I
work on campus. If I had to park to get to me office I would
be parking out at Finkbine or out at the commuter parking at
Hancher and I would be walking close to a mile to get to my
office anyway from a parking lot. I would rather walk all the
way to work than to do that. Once I am d.t. I am captive there
because my car would be so far away, because right now I
simply leave my car at home and I really value being able to
walk to my stock broker. I do indeed walk to a stock broker on
the pedestrian mall. If that broker weren't there I might
well be dealing by telephone and if I were dealing by
telephone I would be as likely to deal with Merril Lynch of
Dina, Minnesota or with one of these brokers in Des Moines who

keeps telephoning me trying to get my customer. When I have
needed a lawyer which thankfully hasn't been very frequently
a d.t. location that I can walk to has been preferred. When
I think of the businesses that had representatives here right
now, most of them are businesses that I want d.t. That I want
within walking distance of where I am a captive employee. The
only exception to that is All Pets Vetinary where my dog and
cat happen to go. I have to drive there anyway to move the
animals and I could probably drive to a suburban location just
as well. But the fact is I really appreciate being able to
have even that somewhere close to where I am working because
I can get more bang for the buck and drive d.t. and drop off
some stuff at my office and then deal with the pets and then
pick up something else and take it home that I would otherwise
have to carryon the bus. So please, whatever you do about the
closing of Dubuque street, whatever you do about parking
access fees, make a go of it. We do need to have a growing
healthy business community d.t. to support all of us who work
there and are captive employees of the University and would
otherwise be driving to get something done that we could
instead take ten minutes of walkover and do it.

them up in the afternoon and go home. It is needed.

Senior Center appointments did we-clarify the discussion for
me about guidelines for appointments if there were any

Horow/ We didn't discuss any guidelines in terms of the
appointments for the Commission. As we know we always look at'
the gender balance. We also look for the age. There is
certainly an age balance from time to time. But the
appointments that came in last night we had four people.

Horow/ (#12) city council Information
Lehman/ Last Saturday's Press citizen carried an article about some
traffic difficulties we were having out by West High. The
impression from the article, at least the way I read it, was
that the city was really not too interested in doing nothing
about it. As a matter of fact, on October 12 the School
Safety Committee met here in this building. It was comprised
of three council folks, the folks from the school
administration and some concerned parents. On that day we
asked the city Traffic Engineer to take a look at this
situation and come back to us and tell us exactly what would
be best for this intersection. They understand there is a real
problem. He is looking at it and I understand he is going to
be coming back to us with a recommendation of some sort.

Horow/ We have that this evening. Mr. Atkins would you like to give
us the report from Mr. Brachtel.
Atkins/ Why don't I take a couple of minutes, Susan. If I can just
kind of set the stage for this. Jim Brachtel, our traffic
Engineer, was also receiving the same phone calls that you all
and I was receiving and in the review of that intersection Jim
reminded me that we do have in the works right now about a
$2.1 million project which will involve substantial
reconstruction of Melrose Avenue as well signals as that
intersection. That project is not planned until next year. The
design work has just begun for that and that is in accordance
with our CIP schedule. Be that as it may the issues were such
that several council members called and follow up the meeting
that Ernie was talking about are there some temporary fixes
that we could consider. And Jim I think summarized it rather
well. There is probably four options and I am going to
summarize them in the order of what appears to be the best
solution none of which are particularly good. And that first
solution is the installation of some temporary traffic signals
and that really involves nothing more than putting in some
wooden poles. We would have to have IIGE provide power I
stringing a line. We have-keep an inventory, enough signals,
for five of them that we could use at that intersection. The
second option is a four way stop at that location which I
think is rather straight forward. The third is consider some
sort of traffic cop and fourth is do nothing. As Jim pointed
out to me it is going to be very difficult to make that
intersection safer and the primary concern that he has is the
hill that you see immediately west of their property. When
the reconstruction occurs the hill will go away. There will be
a much clearer line of sight. Jim's concern is that folks
exiting off of 218 or coming up Melrose will approach the hill
and there is some sort of traffic control right over the hill.

Potential for rear end collisions can be dramatically
increased, Quite frankly certain times of the day, probably
not much more than we are experiencing now. Second issue that
Jim pointed out to me is that we have to keep in mind that
this intersection functions satisfactorily 23 1/2 hours a day.
We really have two peaks times that appear to be the problem.
In order to make the traffic signal, which if you chose to do
anything, work it is going to have to be traffic actuated.
That be you don't want those signals on a cycle. If there is
no turning movements it ought to be completely green. Well,
that makes it a much more involved project. Obviously we have
to cut the street to put in traffic actuators in the street.
The through land heading east to west for the turning movement
will likely have a turn lane because you are going to get
cuing of traffic and the same with the other direction. And
Jim, rightfully so, said I don't want to tell you that this is
going to make it dramatically safer. And he doesn't want to
point out a false sense of security about a possibility of
installing traffic signals. That alone is a kind of a summary
of how he feels. If you would choose any of those options:
lights, signals, some sort of an individual directing traffic
or do nothing. But there is another issue and that is just
simply getting the work done. I think I have to be very candid
with you we have four major signal projects underway as we
speak. We just activated Lakeside and Highway 6 just recently.
And we also have the installation of stop signs, lots of them
as you know, in several of our neighborhoods. We are trying
to get all of that work done. We are moving along on those
projects. Even the installation of temporary signals is going
to distract something from some of that work. Not going to
get it done. And I want you to know that. Which one we are
going to have to pick and how it is going to work I just don't
know right now. But I think you havl~ to be aware of that. And
that is sort of Jim's summary which I concur with.

I recall correctly if we put the traffic light into permit
left turning there will be a no right turn on red.
Atkins/ Yes. Jim indicated that that would probably be a likely
consequence and that would probably make some sense. Also
keep in mind traffic signals and or stop signs are not going
to stop the delays. It is just going to control the movement
of traffic. That there are still going to be certain delays
making your turning movements because it only clear so many
cars. So please keep that in mind that it is not going to be
a free flow in and out of that driveway.
Horow/ I think this is important from my perspective that the no
right turn on red will mean that while the cars are turning

left there cannot be cars turning right heading from the west
to the east and they will be cued back up that hill.
Atkins/ That is probably correct, yes. It makes sense.
Horow/ steve, have we had another situation like this in another
part of the city. It seems to me that we have at ACT.
Atkins/ ACT just recently.
Horow/ They were coming off I-80 and the speed coming off I-80 and
the proximity to the other and we turned them down.
Atkins/ We postponed it because there were a lot of other issues
that you had to consider plus you also had to get the approval
of the DOT to get the thing approved. And we moved it up.
They were planning to have it close to their driveway but I
think we all realized that it wasn1t going to work. We needed
to move it further down the street. We did say no we weren't
ready to proceed with that one at this time.
Nov/ Does the DOT get involved on Melrose Avenue.

Horow/ I wonder if we could have the principle of West High School
address us for a couple of minutes.
Baker/ Could I ask a question while Jerry is coming up. Refresh my
memory, what is the pros and cons of having an officer there
directing traffic two or one times a day. Were those

Atkins/ We talked about it, Larry, and frankly as a matter of
operational policy we have discouraged that because I get the
same request from many of the businesses throughout town and
peak hour times are busy times and we just simply don't have
the personnel to tie up directing traffic.
Horow/ It was in cooperation of Mr. Palmer and I working out these
with Mr. Brachtel and Mr. Palmer contacted the University in
terms of seeing if he could get a security officer from the
University and the university did not return his phone call.
So that particular warm body is of unknown quantity right now.

flexibility with kids getting late to school because of that
intersection. I think the primary concern that adults and kids
have is just the safety in using that intersection and as a
daily user myself and I know the parents that are here and
kids that are here, when you use it every day you know the
danger factor is as significant as steve pointed out. I think
there are probably three things that have brought this to
focus in my mind today. This intersection has always been
frankly a hassle. I have been here ten years and we have one
entrance way to our property. It has never been convenient
but in the last five years we have grown from 900 kids to
1300. So we have increased in student population in something
like over 40%. That same growth is going to continue in the
short term. Next year we will have 1400. The subsequent year
will be 1500. Again, just because of that we have more
vehicular traffic entering our property. The other thing that
we have, as you folks know, we have the developments just west
of our school becoming more occupied. We have more people
traveling east

is the opening of the entrance way onto the University
property going the other direction. Again further complicates
the safety factor from about 7: 00, probably 7: 45 to 8: 15.
Steve is right. From the standpoint when is that a crisis, it
is probably about 30-35 minutes a day. The rest of the day we
don't,have lots of problems from the standpoint of the danger
issue. But-and I listen to Steve and I understand what he is
saying as far as an easy solution. I am sure there is not an
easy solution. But from a standpoint as a parent it is a very
very dangerous intersection and I think particularly with the
winter weather coming. We have had a half a dozen fender
benders and I get nervous just from the standpoint of what is
going to happen when the weather gets a little bit more
complicated with winter weather driving. So from my view it is
hard to not think that there isn't something that we ought to
be looking at. I am not advocating anyone of these over the
others from the standpoint of what is the right answer because
frankly I don't know. All I know is for that short period of
time I can't believe that there is a more dangerous
intersection in this city.
Horow/ If the light goes in, do you think that the student body
would be able to live with cuing to make the safe left turn
because having set up on Galway Hills I am ready to put no U-
Turn on Galway Hills.

that there and Walnut Ridge and if they realize that when they
come back from west to east they could possibly get rear

would. The conversations that I have had with kids and
parents and staff on this is that the perception is something
ought to be done and I think people would cooperate with that.

early just to get there earlier. I mean, we can push that and
we can say that as much as we can but I am not really sure if
that would happen. If there is a light there people would
follow the light and people would be glad to follow anything
that is put in there just for safety sake. So I don't think

it. I mean, I assume that with the four way intersection with
as much traffic volume as we have at West High there would be

and I realize that there is a hill and I realize that there

because she is involved in something extracurricular. For the

However we did comment to each other more than one time look

yesterday. I was going west on Melrose and was in the position

woman coming out from this new parking area. She waited there

came up along side of me-I mean she was practically already
cutting my car off and I could see that she was going to
complete her left hand turn. I was waiting to do my left hand
turn and she did just that. She turned left right in front of
my car into the clear lane and that prompted me to go see Dr.
Arganbright and say because if we have snow and people are
doing things like that it is going to be very bad.

vote for the four way stop sign. I think that that is going to
make it-it would be better than nothing but I would like to

Horow/ I guess my question to you is if there are 25 cars cued in
front of you in front of a light are you going to be patient
enough to wait.
Margolin/ I have never made a U-Turn. I have always waited in line.
I always wait in that line and I think people will be more
relaxed about it. Like Jeremy said at least there is something
there to help us. You know that your turn will come. You
don't have to zoom across to try to just squeak in before the
car is coming from the other direction. It is very dangerous.

Baker/ Sue, can I ask a question. I wasn't here last night. So if
this was raised last night I apologize again. It is a
question for Jerry Arganbright if you have a second here. The
question was asked me today and I don't have a good answer but
I did say I would bring it up tonight. There is some talk
about altering behavior, patterns of traffic, people should
come in earlier or later. How feasible is it, I was asked, to
mandate different arrival times for different classes.
Arganbright/ Not very feasible. We have-there is somewhat of a
mis-perception. We have a lot of kids who drive to school. We
also have 28 buses. We deliver kids to our school everyday and
pick kids up everyday. We are not a neighborhood high school.
It is becoming more of a neighborhood school. But we are
basically a driving school because of its proximity to other
residential neighborhoods. But a lot of our kids do ride
buses. You know with north Liberty and Hills and rural areas.
Over half our kids do arrive via some bus transportation. Most
of our juniors and seniors just like we probably were in high
school days do drive cars. The 9th and 10th graders of the
most part do ride buses. I was going to say from the

standpoint of altering arrival times, school starts at 8:10
and we do have some early bird classes and we do encourage
kids to come early as much as we can. Last year R. J.
Winklehake who had a kid at West High-I had him come out and
give us some advice about how to handle that and R. J. wrote
a nice letter that we included in our parent newsletter that
went home encouraging people, back to your point Larry, to
arrive early. If you come 10-15 minutes earlier to work the
transportation is not a problem. However I would say the
success of that is somewhat limited. Most people still arrive
about 10-15 minutes before school starts which again magnifies
the problem.

attitude towards hiring somebody for one year to do something
like that instead of thinking of it as a permanent solution.

problem with the cuing, getting the cars moving forward from
the cue and having them stacked up behind the warm body coming
from the west to the east. There is still that hill that is
going to lend itself to a fender bender. And temporary we are

Nancy Perkins/ I live at Walnut Ridge. I addressed a few weeks ago
about the walkway and I would like to thank you for that. We
are very happy about having that done. One of the questions
that I have is the idea of a temporary doesn't really make
sense to me because you talk about putting something in next
summer but what I hear is that Melrose might not be widened
next summer and that if it is not widened then we will go
ahead and we will put in a light anyway. But you still will
have the problems of the hill with this permanent light and
that is where I have a lot of questions. How I experience
every day this problem. I personally had a car accident there
because I want to point out to you that students are not
making U-Turns in the developments. They are making U-Turns on
Melrose into suing the entrances as part of their U-Turn. This
boy was doing that and he did not yield to the traffic stop
sign at Galway. he did not realize that traffic was stopping.
he banged into someone who banged into someone who banged into
me. These kids don't-in defense of them, yes they are
compulsive and they do things in a hurry but part of it is
they have to because the visibility. So I still am concerned
about this so called temporary light that you are going to put
in.. But you are going to put a permanent light in but you
are going to do that even if Melrose is not widened.

When the project would be and that is the complete project-
that is the street widening, taking out the hill. The
component of that project would be to make that temporary
installation permanent one. Now your question about could it

could occur. But in accordance with our eIP it is planned that
we would be reconstructing that hopefully and have it finished

done to minimize your liability. And of course you have to
keep in mind that Mormon Trek had some extreme circumstances
because you had to annex the land. You had to deal with lOOT.

for me to believe that there are as many more dangerous
intersections than the one that we are facing. We would like

school early but we know it is the nature of an adolescent to
procrastinate until the very last minute. It is also the
nature of 16-18 year olds to be very impulsive and to make
those quick turns and do a lot of darting. So I think when you

letting people know that there is a potential for danger. Most

person that comes off of 380 that still thinks this is a 45 or

at for a couple of years. Some of the newer council members
may not remember we just had a bear of a time getting
easements and there were all kinds of environmental issues.
Throg/ As far as that stop sign is concerned, how serious is the
traffic problem. I mean when I go through there taking my son
to city High I don't encounter a problem there. Is there some
other time of the day when it is more serious then-
Atkins/ No. It is just the matter of the comings and goings of
that. If you were to ask me right now which one is the lowest
priority that is the one I would take because it already has
signing. It is getting cold and it gets dark early. I
certainly don't want these crews working. And the overtime
doesn't accomplish much because it is just too dark. You
can't have them out there late at night.

Saturdays might. If we have to reprioritize probably leaving
Lower Muscatine with a stop sign for another year is not going
to create huge problems.

Lehman/ There may be something that can happen next week though and
I think Jim kind of alluded to it. There are a lot of places
where you have schools or whatever where you have stop sign
that is moved into an intersection or whatever for a period of
time and then removed from the intersection. Is there any
reason why if we provide or could we from 7:00 to 8:30 and the
school has somebody put it out and take it down in the mean
time.
Arganbright/ There is no reason that couldn't happen. I am not
sure, just knowing the traffic flow over that hill, if it
there sometimes and not there sometimes how wise that is. I am
not an expert on traffic flow pattern in general but it makes
me a little nervous thinking about it.
pigott/ I have driven through two towns every day that has that
very same situation. North Liberty and Muscatine.
Atkins/ Keep in mind volumes of traffic. I am not-the idea has a
quick appeal. I am not so sure that young man that volunteered

increasing costs in town is the overall theme that I heard.
Garbage, water and police. We talked about adding police and
how much more it might cost. Increasing rates of the water and
the possibility of increasing garbage rates and I wanted to
say in response at that time and now since it is our time to
speak I would like to say in response that the council is
fully aware of this and is as concerned to each and every
member is concerned about it. And that is why when we do
consider the availability of police under the crime bill we
were going to pay particular attention to the cost over the
long run as to whether or not we do that. In terms of water
bills, you know, part of this concern of the increasing rates
have been discussed in a number of ways by the council from
how we increase our rates and where. In addition to that there
has been talk about conservation methods that would help
reduce the cost and the size of the facility. So I think
throughout our discussions and knowing how difficult the
increasing bills will be for the individuals in the city
council members have all been concerned about the increasing
rates in that area and have been trying creatively to think of
ways to soften the blow for the residents. And finally on
garbage rates. Jim mentioned it in the discussion a bit. But
that we seek to reduce the cost of help mitigate the
increasing costs in these areas through increasing our
recycling program. Secondly that this process because we are
so concerned about the increasing rates across the board we
want to involve the public in the process. And when we do get
a plan cobbled together we are going to bring it out to the
public and the public will have a say in that because it is
important and because we are concerned about the increasing
costs to the city. So I wanted to respond to those concerns
and that to say I think that every council member up here is
very concerned about rising costs and we are all trying to
think creatively of ways to address those issues. That was the
first thing I wanted to say. The second thing I wanted to ask
about was a letter we received from the Iowa Festival
concerning council approval for use of the parking lot across
from the library from June 9-17 of next year. We hadn't talJeed
about it last night. The letter was in our packet and I just
wondered when we might talk about it. What the procedure
would be and-
Atkins/ A couple of ways you can do it, Bruno. I have already asked
Joe to prepare a memo and it just hasn't come up yet and I am
sure you will have it by your next meeting. You are probably
better off considering these kinds of things in conjunction
with the budget. The same with the Jazz Festival. But really

available. Microfilm for permanent retention purposes and then
also available to make copies to xerox. Cassette tapes of the
meetings are also kept and are available through the Clerk's
Office and can be copied and we also keep the video available

have the video and cassette. We have microfilm. We have hard
copy transcriptions and we have internet minutes in addition
to the legal publications.

have a meeting with John Lohman of student government as a
follow up to our public meeting and John and I met this
afternoon and talked for a couple of hours and one of the
reasons we met was to try and do-to figure out some process to
keep whatever initiative or inertia that was developed on most
particular issues that were raised. To follow through on those
and one of the things that John suggested and I thought was a
good idea was the possibility of the council, instead of us
meeting formally as a body with seven people with the group
over there 3 -4 times a year. Why not have some sort of
permanent or standing council subcommittee representative or
representatives deal with city student relations so that the
student government of students could know that there is a
particular person or group of persons that they could go
directly to and wouldn't have to deal with the council and
come down here to meetings and to follow through on individual
issues and if the council, the whole council needs to be
involved then these council reps can come back in that case.
But in other words to appoint somebody to be a liaison with
the student body and that is what John and I talked about and

talking about the whole parking issues that were raised. I
told him I had some problem perceiving it being a major

They meet one Tuesday a month or something like that. Two
Tuesdays a' month. One of those could down on a free Tuesday
night. Not that we don't have other meetings. But I would be
happy to go down and listen to the discussion and report to
them on a Tuesday night that we don't have a meeting and if
they do if we are so lucky.

had a number of issues this evening that were too long. It was

Nov/ I will start if no one else wants to. We asked yesterday for
the contract to be changed to come up with a fixed amount not
to exceed $50,000 and what we received today was an amount for
$50,000 plus expenses and that is far to nebulas for my taste.
If it is not to exceed $50,000 that is the complete package.
So what does the library want to do about this.
Susan craig/ The Library Board anticipated that the expenses would
be somewhat over $50,000 and they have set aside money this
year in the gift money that they have to cover the expenses
that we anticipate will be incurred during this phase.
Nov/ What are they.
Craig/ The expenses are things like trips that the architect would
make to Iowa city and they are spelled out in the contract
that he would make no more than X number of trips during this
part of the project.
Nov/ Do you have a dollar amount in mind.
Craig/ It is spelled out in the appendix of the contract depending
on how many- I mean if he makes three trips not to exceed X
dollars. If we want him there for four then he would come
more.
Horow/ In other words city council would really only be paying
$50,000. The Library Board's gift source would be paying the
extra amount.
craig/ That is correct.
Nov/ So you are saying it is possible to run up another $50,000
before you even have a schematic drawing.
craig/ It may be possible but it is not considered that we would
spend $50,000 on expenses for this phase of design.
Gentry/ Why can't we just change the sentence to say the
reimbursable expenses will be paid by the Library whatever
fill in the blank.
craig/ That would be fine.
Nov/ Is the Foundation at the library prepared. Is the money
sitting there.

with land and you don't have any authority over land. You can
operate it, you can't build it.
craig/ That is a legal question. I understood that when the
current facility was constructed that the architect contract
was with the Library Board and I assumed this would be the
same. But if legal people tell me that is not the case, I will
trust their judgement.

Gentry/ You really should have three signators: Library Board, city
and- That is the way we did the other agreement with the

Comment: The Library Board has adopted a written building program and

Comment: Council requested that language in Section 2.5, relating to
registration fees and certified copy fees for domestic partnership, be revised
to delete the reference to specific fee amounts and to provide instead that
such fees will be determined by resolution of the City Council. Section 2.52

you never heard before. How did you arrive at the $50,000
anticipated figure.
craig/ The $50,000 is based on when the Library Board interviewed
and selected architects they submitted proposals and based on
the only cost figure that we had at the time which came for
the building consultants which was $5-5 1/2 million and based
on the percentages that we were anticipating paying for this
part of the process, that is where we came up with $50,000 and
we said we would ask council for the money for those
professional fees and the Library Board would find the money
for the expenses.
Baker/ Refresh my memory on chronology here. When did you go
through this process.
Craig/ The architect selection process was in November and December
of last year and this was a proposal that was submitted
through our budget process during the last budget phase and we
did spend some time in our budget hearing last January or
February talking about this project.
Baker/ It was part of the budget that we approved back in January
or February.
craig/ No it wasn't. That is why we are here tonight. It was not
actually approved as part of that process. The Library Board
submitted a budget that included this proposal for capital
expenditures.

had to be hired initially to come up with a proposal for
expansion and they couldn't-until they got the expansion costs
you had to back that into the consultants fee which is a
general percentage. So until you got the consultant on board

craig/ Well, it was submitted with our budget proposal last year
and the city Finance Department and steve decided that they
preferred to fund it in a different way.
Atkins/ I believe her. I must have line itemed it out for some
reason. The library hired David smith to do the study. That
study was to give you the various options. The Library Board
then reviewed those options and began to narrow them in the
sense of making certain selections and I don't recall the
specific timing. It is just coming back tome a little bit.
And that at the time they, the library, would choose to
proceed with putting together a project plan they would need
money to assist them in putting together that project plan.
This is part of putting together that project plan knowing
that they have to have something in which to present to the
public-here is what we want to go to referendum for. I don't
remember, Larry, the exact schedule and details but it is
coming back. I remember Susan and Lolly having a conversation
about it.
Baker/ All money questions like where is the money coming from and
why wasn't this accounted for earlier and why we, you know,
you have a $2.4 budget and now you need $50,000 more for this
project because there is not $50,000 in your budget to take
care of this. Did the Library Board at any time consider the
possibility of taking the $50,000 out of the next budget. I
guess the city would have to advance or approve an advance on
the next budget.
Atkins/ In affect that is what this does, it does that. It is just
a matter of when YOll would book the entry. If you are
suggesting that could the library submit a budget proposal
with the budget that Susan and the department directors just
put in, certainly, the budget isn't effective until next July.
Baker/ So when we talk about the budget in the spring we could if
we wanted to, consider this part of. that budget in our
deliberations.
Atkins/ certainly, you can do that. That changes their schedule
then.
Baker/ But they would still spend the money now, get the process
going on the current schedule but it-
Throg/ So we sort of forward them $50,000 now knowing that it would
be incorporated into their budget later and sort of
reimbursed.

process is almost completed. Our budget forms are due to the
city Wednesday and the Library Board signs off Thursday on
them. So, we have already had three budget meetings.
Atkins/ We can amend that by with a memo between Susan and I, if we
can make an amendment. I don't know what you gain by it all.
Baker/ Because I am also looking at our contingency fund and the
possibility that-is it three months into our budget's
contingency fund and taking $50,000 out of it.

okay, fine. And it works out for her that way too.
craig/ Just tell me which form to put it in.
Baker / I guess my concern is I would like to see not just the
Library but any department trying to anticipate as much as
possible which I think you tried to do your cost and have that
part of our budget deliberation and not later in the year come
back and ask for additional money. That is what I would like
to see happen.
Atkins/ I absolutely agree with you. Mid year budget adjustments
are always a pain in the next. I don't think there is any
doubt about that. I think that Susan appears to be saying
that this is the schedule that her Board has laid down for her
with respect to how she wants this project to proceed. In
order for it to proceed there is an expense that she has to
incur. She needs a supplementary appropriation to her budget
which you got in the form of this resolution to cause that to
occur. If you choose not to give her the appropriation she
goes back to her Board and says we have got to reschedule how
we are going to handle it.
Baker/ I am not saying that, They will get the money. That is not
the question. It is a question of how the process works in
the spring on the budgeting and we could talk about all of
that in the spring but I wanted this $50,000 to be part of the
budget consideration for the next FY as well.
Atkins/ And then show that as a reimbursement back to a contingent
account. yeah, I could do that. I think that is a little
extra bookkeeping that is not necessary. I can do that.
Baker/ I will raise that in the spring. I didn't want to slow the
process down here.
Atkins/ If you don't want to slow the process down-
Baker/ It is not directed towards a particular department or
particular request but to try and anticipate as clearly as
possible and not have to go back and make these adjustments.
Horow/ Is there any other discussion. There is a motion on the

Nov/ I would like to say one more thing., I think the plan that
you have approved to build upwards is the right way to go.
