Mayor of Iowa City

. Iowa City, IA 52240
Dear Mayor Horowitz and City Council Members:
. The Board of Directors of the Iowa City Area Development Group, Inc,' encourage
the Iowa City City Council to support the proposed water rate stnicture. which'
calls for declining rates for large consumption rather than adopting the unifonn
rate structure, We believe that adoption of a unifonn rate' structUre would penalize
existing industries requil'inghigh water usage and discourage new industries from
considering Iowa City, Expansion of existing industries would also be curtailed if
the industrial, rate was extinguished. Limited expansions and loss of' potential
companies would affect the tax base,
~

We realize that the water issue is a controversial subject and that you are trying to
meet federal ma. ndates,. You are faced with a difficult decision, we understand this
and ask that you consider all aspects of the community iricluding our industrial
users,
Sincerely,

THOUGHTS AFTER WATCHING COUNCIL MEETING
The discussion of water rate increases and related issues is very disturbing,
This sounds like such a serious problem that I don't understand why you are spending
time on other issues, Why not put a freeze on all other city expenditures and projects
until this one is resolved? Why talk about money for transit, for "south of Burlington",
for salaray increases, more policemen, etc, etc,
Water is so important, why isn't it being prioitized as the most important issue in Iowa
City, Why aren't we looking at cutting back on other services in order to afford water?
Fewer housing inspection, more infrequent garbage pick-up, No new enrichment
benefits - perhaps cut back on a lot of them, Who can enjoy recreational services if
they don't have safe water?
What are the basic essential city services that we need to buy with our basic taxes,
They should be paid for first.
I know you love us all so much you want us to have the best of everything, no matter
what the cost, and no matter how much suffering or nudging people out of the city,
A concerned citizen (veteran, tax payer, mother, home owner, etc, etc,)

To Jim Throgmorton:
What do you want - mob rule? It seemed to be that 9 speakers covered a lot of
important points and each represented many people, We tried to elect council
persons who are clear thinking, concerned and well intentioned, Ruling by crowds
and noise does not seem to be desireable, It sounds as though you think our opinions
are valuable only if we clutch at your coattails and overwhelming your public meetings,
To Naomi Novick:
Please stop saying there is nothing you can do, You can talk, stamp your teet, te\t%s
who we need to talk to, You can advocate for cooperation and area and s~t~ ~ ii1
meetings, If state and federal regulations are unfair d n't stand stil and b~~~ft~, ;r:

arrangements, One of the most obvious ways is to join with others in shared housing
or shared services, Yet in the past the City has put all kinds of barriers in the way of
independence and creative planning by rules such as limiting the number of
unrelated persons who can live in one household, parking regulations, etc, These
are proproperty, anti people kind of rules,

I have several friends that live in the collection of housing developments north of
Rochester, Everytime I turn onto first Ave, and see the sign NO OUTLET I get a
clutch of panic. One accident on that steep hillside - a big fire, an explosion, a
jackknifed semi or other truck accident could create havoc. AT a minimum it seems
there should be somekind of emerllency exit out First Ave or the end of Hickory Trail.
How can such a situation develo~ Where were safety and common sense heads
when those developments were approved, And now a new big apartment complexllll
After Council Meeting 11.22-94:
Why not get all the mayors in the region (all Iowa, or Eastern IA & Western ILL) affected
by the water plant regs, ( and also, include those in the next level of cities coming up),
Invite the Governors, State Legislatures, Federal officials to meet with you,
1, How to get more reasonable federal regulations?
2. What State and Federal Legislation is needed to intercept contamination at its
source? (agricultural, industrial, urban, sewer, septic tanks, etc,)
3, We tried, and they aren't interested, isn't a good enough answer Mr. Manager.
Try, try, again, If the problem is mutual, perhaps they have a better idea as to how to
meet it. Keep fighting, and keep advocating for strength in numbers.
Karen - Civil Disobedience is not to be ruled out as a last resort .. but be very very
sure that Everything else has been tried. Other plans, other places, cooperative
agreements, political pressure, whatever.

Dear City Council Members,
We are not able to attend the council meeting where the water
and sewer rate increase will be discussed, but we wanted to voice
our feelings about the increase.
We are opposed to the high increase in rates that have been
proposed for our water and sewer usage. You are asking too much.
In our homes when a big expenditure becomes necessary, we have to
cut spending somewhere else in our budget to be able to pay for the
big expenditure. For some reason, government officials do not know
how to do this with the budgets they are given to work with to
provide services for the people that have elected them. They just
want to extract more money out of those that they serve without
cutting spending in other areas to help off set the new financial
requirements,
I think your example shown in the the City News of the water
increase is not showing a true picture of just how much an average
family will have to pay, We have a family of four at our house.
We have been paying about $84.00 every other month for the water
and sewer, The first increase in February would cause our bill to
raise to $117,60. Then one year later we would be required to pay
$205,80 which is approximately a 245% incease, Then we would have
to add the sewer and recycling increase to that total.
Please do not place this burden on the citizens of Iowa City,
I do not believe that our salary is going to increase at a rate to
offset this increase, It is going to be very hard on our family to
make these payments,

November 23, 1994
Councilor Ernie Lehman
c/o City Hall
410 E Washington St
Iowa City IA 52240
Dear Councilor Lehman:
I am writing to you in regard to the water treatment plant and
waste water treatment plant issues now under consideration,
First of all I would, as a resident of Iowa City, like to thank
each of you for doing your best to keep the lines of
communications open with everyone affected by this issue. I did
not attend the Council meeting on Tuesday, November 22, 1994, but
did watch the complete meeting on Channel 4. I did this on
purpose so as not to let the emotions of the moment interfere
with my trying to gain knowledge on this issue. All of you are
to be commended as to your evenhanded reaction to the very
abrasive attitudes displayed by some of the speakers, Many times
I may be on th~ opposite side of some of you on issues, but I
would nevertheless demand of myself the civility of behavior that
each and everyone of you deserve.
I would like to list for your review some points of concern that
I, as a citizen and businessman in this community, see as
affecting me in both roles.
1. Use of the 230 acre site if purchased for the water plant -
I was never confused, as were some, that the water use fees
would not be used for any purposes except debt retirement
and costs of running the plant. However, the issue has been
raised as to the possibility of eventually developing the
area in some fashion, I remember reading a newspaper
article some time ago listing various possibilities
requested by various groups within our community including a
park like area with nature trails, Councilor Kubby
mentioned last evening something to that effect, I would
oppose this for two reasons, The first is that any
community based use would require tax dollars to implement
and to maintain, I feel that those dollars could instead be
used to reduce the monthly water and sewer payments which we
all must pay, If the council wants to consider expanded use
of the site, either in the near future or even years down
the road, I think you should explain that stance publicly
and explain where you intend to get the funding and justify

why you feel that an expanded use of this area would be a
better use of our tax dollars than using those dollars to
offset some of the scheduled rate increases. The second
reason I oppose this is that I feel that if any other type
of development on this land is reasonable and feasible, be
it parking lot or structure, that the present owners of the
land should be allowed, as part of the condemnation
settlement, the exclusive right to pursue this development,
To do otherwise seems to me would be a grossly unfair way of
implementing condemnation proceedings.
2,
The possible use of alternative sites - I have heard through
last night's discussion and from comments within our
community that there may be alternative sites for a possible
location, They include the area south of town where test
drilling has occurred, the Coralville Reservoir, a site just
south of 1-80 which supposedly someone is willing to sell (I
have never heard of it's exact location) and our municipal
airport. If all of these sites and perhaps others which
have already been considered and rejected as not being
feasible either economically or geologically, I think that
each option should be pUblicly explained as to the reason
for its rejection. At my prior place of employment, I was
involved to some extent with water treatment and waste water
treatment plant construction. I have observed that there
were, at times, several alternative solutions which were not
raised due to the parameters given to the engineer by the
municipality. What might have made sense originally may,
due to the current public outcry, not be valid now, Perhaps
it is time to think about "reinventing the wheel" (usually a
process to which I am opposed). An overall review by Howard
R Green & Stanly Consultants, not just of the current
proposed design and it's parameters, but also of the basic
assumptions used to start the current design process might
yield a better more sellable and cost effective solution. I
certainly do not have the expertise to claim that this would
be the case, I am only suggesting that you consider that
premise,
3.
Timing - Mr. Atkins stated that we are under sever time
constraints, a point which I am not disputing, However, a
_clearer explanation as to what the time constraints really
ccare,dI believe, would be helpful to everyone, I would think
~tha~the federal government has issued some specific
~t~~ines as to when the council must act, when a design
'<J;mus~be completed and submitted to whomever in the federal
~gq~[rnment must review and approve it, when construction
~ mJis,'tl be started and when it must be completed, if
~ a~iicable, when and how a protest can be lodged and perhaps

My point is that we, as a community, need to be ~e ~f f~e
rules which you, our elected officials, must play~y. ~hen
all of us will have the knowledge to consider our options as
a community. Questions which might be answered are: Do we
really have time to stop the process and take a hard look at
alternatives? When do specific monetary penalties come in
to play and what exactly are their amounts? Is an appeal
process for implementation possible within our time
constraints? Does it make economic sense to incur some
monetary penalties in the short term to save additional
dollars by a redesign/relocation of the proposed plants? Do
we hav~ time to assess the mood of the newly elected
Congress as to their attitude on rescinding "unfounded
mandates" which may allow us some financial relief? Do ~le,
as a community, have time to launch a hopefully massive
lobbying effort to Congress to perhaps receive some
financial relief? Do we have enough time to monitor the
bond markets so as to issue our bonds at the most
advantageous time in order to reduce interest costs? These
are some of the time related questions which I would
appreciate being clarified and which I believe many of our
citizens would also appreciate being clarified.

4, Total Costs - As was pointed out in last night1s meeting,
the $50 million and $41 million costs are not representative
of the total costs. I believe that the total costs
including interest need to be explained to our community.
Again, if time can be taken to take advantage of fluctuating
bond markets, this should be explained. Maybe the citizens
want to ask the council to wait 6-12 months or more to catch
a favorable bond market even if that puts our community at
risk for fines. Can city staff provide the community with
several ll~lhat if" scenarios? I am also unclear as to the
extent that the pipeline will add to the total costs, Has
Howard R Green studied the various alternatives ie: relocate
the plant, relocate the pipeline, necessary protective
measures needed to be taken on either? If no provisions for
these costs has been made, surely someone at Howard R Green
is knowledgeable enough to make a guess. If an additional
cost has to be added to the current estimate, might it not
be less expensive to change the system and go to another
site? If not, could not council explain that fact with hard
figures? Can someone estimate the cost of litigation with
the present owners even if the city if 100% successful?
What about a "worst case" scenario if the present owners
win? How much will it cost in downtime for our entire water
system if a pipeline disaster (rupture, fire, etc) does
happen? I realize that the city will insure itself against

such disasters, but how large would the deductible be and
\'Ihat are the "human costs" if such a disaster happens? I
would hope that someone can clearly discuss what measures
the city has taken to lessen these problems and what
exposures, if any, still remain.
5, Alternative Financing Methods - While I surely would admit I
can afford any planned increase, I am curious as to how the
"avera~e'l 750 gallon usage was established. I checked the
usage on our last bill and it was 1300 gallons. If the
usage is based on 750 gallons/month, then I am okay as mine
was a two month reading, If not, I do not see how I can
lower my personal usage as there are just the two of us at
home. My wife does approximately two loads of laundry per
week and we rarely water our lawn. It would be nice to have
a clarification on the usage, I have a real problem with
the proposed change in the current based rates to a level
rate no matter what the usage. On the surface it seems to
espouse fairness, However, I as well as many members of the
business community, remain very skeptical of such changes.
I feel that there is a great likelihood of another agenda
being played out behind the scenes. It is the same issue of
"no growth" vlhich the business community opposes, One of
the guiding principles of setting reduced volume rates for
water, sewer (public), gas, electricity, telephone and
telecommunications (private) is to attract and to keep
industry. To reverse that policy would dramatically alter
the cost of producing a product or service for the large
volume users, Common sense will tell you that businesses
have to assess "all costs" when they seek to relocate to or
expand in a community, This l'Iill be a great "dis-incentive"
for our community, Ask Iowa-Illinois if they would ever
consider modifying their rate structure as you are
considering doing. More insidious to me is the very real
possibility that our good corporate community members such
as Proctor & Gamble, United Technologies and General Mills
to name a few, may have to reevaluate their viability to do
business in Iowa City. In my opinion, even the remote
possibility of that happening is disastrous and terribly
short sighted, How can anyone even contemplate adopting a
policy which could create such a jolt to our local economy
in terms of lost property taxes, unemployment and additional
__ pressure on social services resources, Some of you may feel
~ that I am an alarmist or that I am spouting the old Chamber

All of this aside, I must still commend each and everyone of you
for your willingness to be open and take heat about this issue.
If I have held your attention this long, I hope that perhaps I
have either offered a new idea or two or more probably
reemphasized the thoughts of others who have contacted you
previously. I think that I can say, with a minimum of dissent
from my fellow citizens, that we will rally behind any decision
,you finally make if we believe that you have dealt openly and
honestly with us on all the issues and that you have explored and
explained to us all of our community's possible choices.
Very truly yours,
Cl?en.~1 t0~~
Thomas F, Werderitsch
PS. I must also affirm my support that the council provide some
sort of monetary relief for our low income and fixed income
citizens, Those of us who are able should shoulder a little
extra to make sure that happens,

Dear Members of the Iowa City City Council:
I am writing on behalf of the 1,435 Iowa City households that turn to the Crisis Center
for assistance because they have incomes at or below the Federal Poverty Rate.
Crisis Center Volunteers have told me that they are extremely concerned about the
impact of prospective higher rates for sewer and water service, The Volunteers, those
with the most intimate knowledge of how people with low and/or fixed incomes
, manage to survive, question whether the increases can be absorbed by the people
that we assist.
We are painfully familiar with the tragic effects of homelessness, Increased rates will
force additional citizens into crowded shelters.
We hope that you will keep those with no ability to pay for increases foremost in your
minds when you decide about the water and sewer rates.

To the city council:December 1,1994
I was present at the council meeting Nov 22 but chose not to speak
because of the numerous people there who also wanted to speak. I have
chosen instead to put my thoughts down on paper for your consideration.
I am very concerned about the proposed increases in our bills for water
and sewer. We moved into a new home in Iowa City after 17 years in
Coralville and, frankly speaking, I feel like moving back to Coralville,
I had not envisioned buying a new home and then having to worry about
an excessive water and sewer bill, Quite honestly I would find ways to
cut back on usage so as to soften the blow of these increases. I am sure
others would also and it is naive of the council and city manager to
believe otherwise, in spite of your warnings about this to the people
of Iowa City, For the record there are two in our household and I
have calculated that our bill would go from $80 to $110 to $150
with the proposed increases. I can't imagine what a large family or
retired persons on fixed income must face, Now that I have the griping
out of the way I do have some specific proposals for your consideration.
I agree with Ed Barker to a great extent that we should wait till the
new congress is in session and present this problem of federal mandates
without appropriate funding. Our senators and representative must be
involved in this either to the extent of modifying the law or providing
some federal money. I think the same is true of the state in terms of
providing money. I look at all the money we pay in taxes-income, property
sales, etc and I am livid that that we are not able to get some of that
back to help finance this project. The 5% sales tax on our water is
even more irritating in view of the what is happening. I really believe
that if you are unable to accomplish anything in this regard that we as
city should simple say "no" and make a real issue of this with the
press and the whole country.
I also believe that somehow property taxes must come into play here.
There are two aspects of this, First of all, if you were to add some
sort of special assessment or simply increase the taxes, then the actual
amount would be decreased by virtue of the deductibilty on the federal
and state tax forms, In essence we would be getting some our money back
from the government, Our water bill increase is not deductible.
Secondly, in relation to the property tax issue, I think the city must
do detailed review of the city budget and eliminate some programs with
the savings diverted to the water project, As a nurse one of our
standard approaches is a priority system- we do what is more important
first and tasks of lesser importance are done later. This must be a
serious approach to this task.I'm sure a few business people will be
unhappy at losing business but such is life,(Did anyone see the recent

movie "Dave" in which a look alike president of the U.S. did just what I
am suggesting here?),
One other suggestion in regard to this second aspect would be to simply
designate a large portion of the property taxes on newly constructed
homes to the water project-for example of the taxes on all new homes
designate 50% for schools and law enforcement and the rest to the
water plant.
I have also have a few suggestions for other sources of income, Since
the contractors and developers have increased the demand for the water
and sewer you should asses them all a one time fee of $2500-5000 and
designate ALL this to the water/sewer plants, This would include the
subcontractors-painting, electrical, plumbing, and heating, The realtors
also make a lot of money by new people moving here and increasing the
demand. I suggest a 5% tax on real estate commissions, A $100,000 sale
at 6% equals $6000 x 5% equals $300. I'm sure with the housing turnover
here that this would generate a considerable sum, In this case and the
previous suggestion the amount taxed would be deductible as a business
expense and the actual amount paid would be less because of the
deductibilty on the tax forms. The city would again be diverting money
from the state and federal government to itself,
I also believe the local sales tax option should be considered so out "
of town visitors could share the expense. I was recently in Council I'~'"
Bluffs and they have such a tax as does Iowa County, You might speak
with representatives there to assess the impact on business.
I have not heard anything about the possibility of restructuring the
present water plant, If The Russians can retool an armament factory
into making sausage, I would think we could do something with what we
have and build a second smaller cheaper plant as a backup and for
increased demand,

I am also very nervous about the proposed location being so close to the
oil pipeline, This does not seem very prudent,
In closing I do appreciate the time and effort you have spent on this
project. Never lose sight of the fact that your allegiance is to the
people of Iowa City and not to the state or federal beauracracy. If
you take a stand on our behalf, I for one will support you, By the
same token, my anger over this will be reinforced every time I see my
water bill.

November 30, 1994
Iowa City Council:
I attended the November 22, 1994 meeting regarding the new water plant and waste water
facility along with the outrageousl~proposed increases in fees.
I read and hear that the "average" residence uses 750 cf of water each month. It seems
that someone is using most of my "average amount". I am charged the minimum fee of
$45.73 for the two month period. I have been told the minimum fee charged is for the
minimum cf used, which is 300 cf. If I did use 300 cf, which I don't, that would mean
I only used 150 cf each month not 750 cf. Seems I am charged for several cf that I am
not using. Guess in this case it doesn't pay to conserve. Or just maybe if more
residents would conserve we would not need to be building such a large facility. Also,
what ever happened to the thinking that you should only pay for what you use?
How do you think widowed, senior citizens on a fixed income will be able to pay
these enormous bills. Especially when they are paying for a lot that they are not
even using.
I wonder just how many Iowa City residents know that a portion of their water and sewer
I~~re actually used to purchase land for recreational use, i.e., soccer fields.

TOP TEN REASONS NOT TO PROCEED WITH THE CURRENT
IOWA CITY WATER TREATMENT PLANT
10) It's too expensive. Cedar Rapids built a larger plant, serving 5 times as
many people, for a land cost of $195,000. Iowa Citians will pay
$4,390.000 for land (22 times more!) under the current proposal.
9) There is a gasoline and fuel oil pipeline on the proposed site that, if ruptured,
could contaminate the site permanently. No money has been allocated for
moving this mile long pipeline.
8) North Corridor w!;:llls may run dry. No well interference studies have been
completed. It is possible this plant with its eight Silurian wells (pg. VI-11l
and three Jordan wells (pg. VI-8) will damage the wells in the surrounding
area.
7) The City has not received DNR approval for this site. The gasoline pipeline
and well interference issues may result in this site not being approved.
These issues need to be resolved BEFORE spending any money on land and
plant design.
61 We are being intimidated by the City Manager with threats of $10,000 a
day fines and court orders forcing us to comply if we don't proceed with this
project. None of this is true.
51 It is not the best use of this land. Iowa City needs to draw good businesses
to the Iowa City area. This land is zoned for commercial use and could be
the site for the next ACT, NCS or Rockwell. Tax revenues would be
approximately $900,000 per year. As we watch businesses move to
Coralville we will be paying to maintain our newest park.
4) There .ar..e better alternatives. A site south of Interstate 80 would eliminate
the risk of the gasoline pipeline, eliminate more than a mile of water and
sewer lines, eliminate the need for dam repairs and reduce interference with
surrounding wells. This alternate site would save $3,000,000 in land cost,
thousands in litigation and has better park land. In the short term, the
potential exists to tie into the Cedar Rapids water system and purchase
, water while we watch for Federal regulations to ease.
31 The North Dubuque Street site is the dumping ground 'for all the septic
systems in the North Dubuque Street area and North Liberty's sewage plant.
Do we really want our drinking water to come from this source?
21 There is no public support for this project. People do not want to spend
$52.3 million on a water plant; they don't want to pay for more parks or
trails. Our citizens want safe drinking water and know that their water bills

Water and Waste Water Treatment Plants Survey
Iowa Cities Over 20,000 Population
Prepared By Edwin K. Barker
December 4, 1994
The following questions were submitted to the appropriate officials of
each of the cities listed:
1. Are you having any trouble with the Iowa DNR or the EPA in
regard to meeting water and waste water requirements?
2, What is the source of your water?
3. What would a monthly residential bill for water and sewer
service using aoo cuft of water per month?
4, Do you feel that some of the solutions are worse than the
problem? Are you concerned about your employees being exposed
to more and more chemicals that need to be used to treat the
water to meet the ever increasing standards?
5, Are you now doing or planning on doing any major construction
or overhaul to your water and/or waste water plants?
6. Do you think the recent rapid increase in EPA standards and
requirements will slow down significantly in the near future?
7, What is the capacity of your water plant, the average daily
use and the maximum daily use in recent years?
a, Do you have a variable water rate schedule?
The
enclosed
below.
answers received to questions 1, 2, 3, 5, 7, and a are on the
chart. The answers to questions 4 and 6 are in narrative form
The response to question 4 was as follows: (I have paraphrased
and combined the answers from several people some of whom answered
"Yes", some of whom answered "No", and some who had no opinion or
didn't know,)
Question 4: Do you feel that some of the solutions are worse than
the problem? Are you concerned about your employees being exposed to
more and more chemicals that need to be used to treat the water to meet
the ever increasing standards?
"Yes. The technology available now makes it so we can measure and
test not only for so many more things, but also to test the amounts
rather than. for 1 in a million, but for 1 in a billion and it perhaps
will go to 1 in a trillion in the future. Even though it has not been
proven that some of these things are harmful, we still have to treat
the water as though they are. This all costs lots of money and we must
use more and more techniques to treat the water. Who knows the risks
we might take by putting more and more chemicals into the water and
this also exposes our water plant employees to more and more
chemicals, People are becoming to believe in perceived problems, We

all want safe water but there are practical limits to what we should be
doing. There is some movement on the part of EPA that they need to be
more practical and reasonable rather than the attitude that we can test
for all of these added things and can test for more minute amounts. I
believe their intentions are good but they do not know how much water a
person would have to drink each day for how many years to possibly be
exposed to something that might cause cancer. We maintain a continuous
educational program for our employees so that chemicals are always
handled properly. In the past the environmentalists have probably .
wielded too much influence, but they seem to be becoming more realistic
in what they think is in the best interest of the most people. (Six
responses were along these lines.)
No. We have a high water quality to start with so we have very
little difficulty in maintaining our water supply to high standards.
(Three responses were along these lines.)
Officials from the other five cities either had no comment or I
failed to ask the question.
Those who responded to question 6 stated as follows: (I have
paraphrased their answers.)
Question 6: Do you think the recent rapid increase in EPA
standards and requirements will slow down significantly in the near
future?
I@
"will keep on increasing at a slower rate but in the long term
they will be pulling back. The American Water Works Association has
been working with the EPA and detects the EPA moving to a more
reasonable approach."

Explanation
Suggested Iowa City Water/Waste Water
Revenues and Rate Increases

The attached schedules were devised to show the gene~~ c~C~E~ of
what could happen to water and waste water rates if th~~jo~s~~~new
water plant construction is delayed 5 years, and t116;wa~e'water
addition and accompanying sewer lines were delayed ~o ~ears. It
appears that DNR officials would be willing to listen to any reasonable
proposal in order to carry out the desired construction in a manner
that could 'accommodate our concerns as well as providing for the
construction of the waste water treatment plant addition in a timely
manner. Also, from all of the people I have talked with who are
knowledgeable about the water treatment plant, including both Iowa City
officials and DNR . officials, we are under no mandates, current or
pending, that require action now or in the near future. Successful
negotiations with the DNR, particularly in regard to the Waste Water
Treatment Plant addition, are in no way guaranteed. However, I believe
they are willing to listen to a definitive proposal that, if accepted,
could allow for the rate structure and financing to take place along
the guidelines in the attached schedules.
The attached schedules allow for the following assumptions:
1. The construction of the water plant would be delayed five
years. The construction of the waste water plant addition and
associated sewer work would be delayed 2 years.
2. The water rates would be increased beginning in 1995 at the
rate of 11% per year for years 1995-2001. A rate increase of
2.6% would take place in 2002 with no rate increases
associated with the construction to take place after 2002.
3, Waste water rates would be increased by 11% from 1995 through
1998, This rate would increase by 1.6% in 1999 with no
further rate increases anticipated for construction.
4. The funds escrowed would be used to reduce the amount borrowed
for construction and would earn interest at an average rate of
6.00%. Currently, local banks interested in borrowing these
funds would pay interest rates varying from 6.5% to 7,25% on
such funds based on a three year maturity date.
5. These schedules assume a 3% inflation rate per year during the
delayed period of construction.
6.
The escrowed money would be used as a "down payment" on the
two projects,
7 .
Beginning in 1999 in the Waste Water Revenue Account and in
2002 in the Water Revenue Account significant surpluses would
accrue. That, along with additional revenue due to new
construction, could be used to pay for normal increases in
operating costs, to replenish accounts depleted due to
con~truction, and could be placed in escrow to pay for the
eventual phasing out of the North Waste Water Treatment Plant.

Position Statement
of the
Greater Iowa City Apartment Association
on the
Proposed Sewer and Water Projects
December 1, 1994
1. The Greater Iowa City Apartment Association is comprised of persons who
either own or manage residential rental properties in the Greater Iowa City
Area. In Iowa City, our members own or manage in excess of 50% of all
rental units,
2. Our Association is extremely concemed about the consequences of the
abrupt doubling of sewer and water costs. Because these costs will be
passed on through as rent increases, the real impact will be to significantly
raise the costs of living in Iowa City for everyone who rents. Based on
analysis by some of our members, we estimate this increase to be in $10-$12
per month per person range or at least $20-$24 for the average two
bedroom unit.
3. Water and sewer costs are not the only significant cost increases facing
rental properties. Property taxes on residential rental properties for the
1993-94 tax year payable in 1994-95 have increased about 11.5% or
approximately $10 per month per unit. This is another cost that will
indirectly be paid by tenants in the form of rent increases,
4. Significant numbers of these renters are on the lower end of the income
ladder in this community,
If the City Council votes to proceed with the major sewer and water
improvements, we feel that you must find a way to implement these cost
increases gradually, not over a thirteen month period as proposed. The
abrupt and extreme rise in rates will impose a significant financial hardship
on everyone who rents in Iowa City,
We also endorse the comments made by Ed Barker at the November 22nd
Public Hearing.

Dear City Council Member,
I am writing as a citizen and homeowner of Iowa City to voice my,
STRONG opposition to the proposed changes in city water treatment facilities,
While some type of change in facilities may be needed, I cannot support any
plan which requires an increase of 75% in billing in order to fund the plan, A
smaller increase in water and sewer bills (10%) might be acceptable, but 75%
is too large an increase for most people,
My family budget currently meets all of our bills and financial obligations,
If the city council approves the new water treatment plant, my family will still be
able to make ends meet I am very concerned about those families who are not
as financially stable as mine and about students and senior citizens, Many of
these people live on small fixed incomes and their rents are certain to increase
when landlords water bills increase?
I don't believe the proposed water treatment plant is necessary or is in
the best interest of the entire population of Iowa City, For these reasons I
respectfully request that you vote against this proposed change,

The City Council of Iowa city.
December 6, 1994
It was resolved at the December 6, 1994 meeting of AFT
Local 716 to urge the Iowa City Council to take an
appropriate amount of time to explore options of phasing in
the costs of the proposed Water and Sewer Plant Improvement
project over a period of time in order to reduce the adverse
impact on working families and businesses of Iowa City. We
urge the Council. to defer the vote on this matter until
these options have been given a full and proper evaluation.
Sincerely,
lo.~~t

CITY COUNCIL
December 6, 1994
THROGMORTON, KUBBY UNIFORM RATE INCREASE PROPOSAL
All the major cities in Iowa have a declining scale for large
utility usersl~th a uniform rate. The costs are passed onto the
consumers in the form of higher rents and increased prices on
goods and services. The people hurt are the poor people on fixed
incomes, students, and apartment owners. We already live in the
least affordable place in Iowa.
Business and industry would take a big hit. Big companies
provide the best possibility for growth and creating high paying
jobs to keep graduates of the University of Iowa from moving out
of state because they can not find employment here.
Industry helps the middle class make a good salary, and pays for
benefits for our citizens.
Companies do a comparison analysis when choosing where they will
locate. Cedar Rapids, North Liberty and Coralville are pro-
business.
If we pass this proposal, we would show that we are anti-
business, and our competition would have a distinct advantage
over us for something we desperately need: Good jobs and money
to support our taxbase.
Small towns have a uniform rate, but if a big company would come
into their area, with 200-300 jobs, they would be smart enough to
figure out that the company should get a declining scale for
large utility use. The reasoning for this is:
.,
,~(
C----
\
r
1. Support their taxbase.
2. They realize the cost of delivery of water per unit
goes down as the water usage goes up.
3. It is cheaper to send one bill to this company than to
five hundred customers who use the same amount of
water.
~
In closing, business and industry, that we now have, most likely
will not expand their business and many will leave.

The City Council has to use some common-sense when it comes to
this proposal.
I urge Jim Throgmorton and Karen Kubby to drop this proposal.

ook for federal re ulators to lie low for a while.
nforcement will be less aggressive because of the election.
Republican-led congressional conunittees will lean hard on regulators
to take it easy on rulemaking or risk losing a chunk of their budgets.
They'll block nominations for top jobs in agencies that get out of line.
And the mlite House will quietly pass the word to regulators to back off.
But regulators won't roll over and die. Most rules are written
to carry out laws approved by Congress, often several years earlier.
EPA, for example, is still hashing out rules for the 1990 clean air law.
Expect more flexibility. No penalties if firms TRY to comply.
Hore guidelines instead of rigid rules. More time to. meet requirements.
Plus a new focus on the cost of rules in relation to expected benefits.
Is the benefit really worth the price? Just how serious are the risks?
Here are some rules that'll be softened, delayed or eliminated:
Loans by banks. Redlining regulations will be watered down...
standards for measuring a bank's involvement in low-income neighborhoods.
Requirements to report the race and gender of borrowers \~ill be dropped.
Indoor air. Bars & restaurants will be exempt from a prohibition
on smoking in the workplace. Otherwise, no changes,..the ban is popular.
Regulators also will need to show proof of danger from carpets, paint
and poor ventilation before issuing rules. That means YEARS of delays.
Seat belts. Gov' t will drop a plan to hold employers responsible
for making their drivers buckle up. Employees will be personally liable.
Repetitive-motion injuries. OSHA will propose rules next year.
But before they go into effect, Congress will ask that smalls be exempt
and will demand proof that using computers can cause wrist injuries.
Cable TV. Expect less rate-setting by regulators, more reliance
on competition. FCC will allow higher rates if there's more progranuning.
Civil-rights enforcement will case up. There will be less push
for affirmative action and money for Equal Employment Opportunity Comm"
which already has a bIg backlog and more on its plate than it can handle,
tlat'l Labor Relations Board will be eyed warily by Republicans.
They'll insist on moderate appointees when two vacancies open next year.
They also want NLRB to stick to decisionmaking,..not writing HORE rules.
,
,
States will receive broad new powers to do things their own I~ay
in carryIng out federal laws on job safety, pollution and other matters.
Governors arc willIng to take on added responsibilities IF they get money
to do the job right, But they'll raise cain over "unfunded mandates",..
requirements handed down from Washington that must be paid for by states.
( Conggss will repeal unfunded mandates,. .quit passing the buck
to s t\te & local gov' ts for new rules unless it also passes along money.

Hi, my name is Phil Thompson, I live at 428.5 E. Jefferson St. in Iowa
City. I'm a doctoral student in Environmental Engineering and the
President of the UI GSS. I'm here to represent students and other people
on fixed or shall I say low incomes,
Over Thanksgiving, I had the chance to watch an extremely"'~ city

council meeting, the bulk of which was dedicated to public outcry over
large increases in water and sewer rates. The rate increases are of course
needed in order to fund the building of a water treatment plant and tp J ~ IUi1Dv 1TI11v. [.

The $42,880,000 estimated total cost for wastewater treatment upgrades is
for the construction of "Stage I" and is scheduled to be completed by 1998
with "Stage 2" beginning sometime after the year 2010, Stage 2 is loosely
estimated to cost an additional $30 million.

The main problem that I have with the plan is that it proposes a 12 year

solution for meeting ammonia discharge requirements that will cost $,13.5_

So what are our options? Appendix D of the Stanley report contains a
study performe~by The Howard R. Green consulting company to evaluate
-Ih~\,,,,
the ammonia removal problem, In the final analysis, Green, had t\},o
recommendalinm:. One was with regard to something called break2-oin!
.J-. _
chlorinatiQD.. Breakpoint chlorination uses chlorine to convert ammonia to
nitrogen gas instead of nitrate. The company concluded that because of the
projected increases in chlorine costs and the risk of handling additional
chlorine, b~akpoint chlorination was nQLaJl.Qp.tion for being the sole
<
method of ammonia removal. However, the city chose to use this method

Green's second recommendation was that the city should install a diffuser
pipe into the Iowa river for its effluent dischargeo~ would cost
A OM"\\I~rJJ
$515,000, ~ good solution and was strongly recommended by
Green. The IDNR has even suggested several areas where diffusers could
be placed, You have to understand that currently, each of the two facilities
discharges from the shore into the Iowa River, In general, the velocity of
the river is lower along the shore so there is less turbulence and thus less
mixing. A diffuser works by expanding this Zone of Initial Dilution which
permits more ammonia discharge while minimizing the effect on the
~~~ environment. Diffusers have potential bene(its for othe~ wastewater
environmentally and economically ~ound, a,Iternat~e. Based on Green's
data and some very conservative calculations! this alternative solution could
save from $lll million.
My final questions are "Do you the City Council have any questions about
these $43 million dollar plr.~~? D~ ~~feel t~J~~.I9:~Rlake a decision
on this matter tonight andiit$i~rnal~ liaC;b~1pursued?" I
suggest that you have a roundtable discussion, go through the plans and
alternatives and make the best possible decision together,
27.0 million (P&I + contingency)
5.0 million (P&I + Contingecy)
5.0 million (Difference in DIM over 12 years very conservative: includes
tripled chlorine costs and doesn't consider solids handling)
17 million difference overall or 22 million
8 million dollars from the actual plan. or 11 million
