"~ ,..,,,,,.......-..', 603 Brookland Park Drive 20 Nov 1994 To: Iowa City Council & Manager THOUGHTS AFTER WATCHING COUNCIL MEETING The discussion of water rate increases and related issues is very disturbing, This sounds like such a serious problem that I don't understand why you are spending time on other issues, Why not put a freeze on all other city expenditures and projects until this one is resolved? Why talk about money for transit, for "south of Burlington", for salaray increases, more policemen, etc, etc, Water is so important, why isn't it being prioitized as the most important issue in Iowa City, Why aren't we looking at cutting back on other services in order to afford water? Fewer housing inspection, more infrequent garbage pick-up, No new enrichment benefits - perhaps cut back on a lot of them, Who can enjoy recreational services if they don't have safe water? What are the basic essential city services that we need to buy with our basic taxes, They should be paid for first. I know you love us all so much you want us to have the best of everything, no matter what the cost, and no matter how much suffering or nudging people out of the city, A concerned citizen (veteran, tax payer, mother, home owner, etc, etc,) ~m///J{ Bettyi;Kr~y ~ To Jim Throgmorton: What do you want - mob rule? One accident on that steep hillside - a big fire, an explosion, a jackknifed semi or other truck accident could create havoc. AT a minimum it seems there should be somekind of emerllency exit out First Ave or the end of Hickory Trail. How can such a situation develo~ Where were safety and common sense heads when those developments were approved, And now a new big apartment complexllll After Council Meeting 11.22-94: Why not get all the mayors in the region (all Iowa, or Eastern IA & Western ILL) affected by the water plant regs, ( and also, include those in the next level of cities coming up), Invite the Governors, State Legislatures, Federal officials to meet with you, 1, How to get more reasonable federal regulations? 2. What State and Federal Legislation is needed to intercept contamination at its source? (agricultural, industrial, urban, sewer, septic tanks, etc,) 3, We tried, and they aren't interested, isn't a good enough answer Mr. Manager. Try, try, again, If the problem is mutual, perhaps they have a better idea as to how to meet it. Keep fighting, and keep advocating for strength in numbers. We are opposed to the high increase in rates that have been proposed for our water and sewer usage. You are asking too much. In our homes when a big expenditure becomes necessary, we have to cut spending somewhere else in our budget to be able to pay for the big expenditure. For some reason, government officials do not know how to do this with the budgets they are given to work with to provide services for the people that have elected them. They just want to extract more money out of those that they serve without cutting spending in other areas to help off set the new financial requirements, I think your example shown in the the City News of the water increase is not showing a true picture of just how much an average family will have to pay, We have a family of four at our house. We have been paying about $84.00 every other month for the water and sewer, The first increase in February would cause our bill to raise to $117,60. Then one year later we would be required to pay $205,80 which is approximately a 245% incease, Then we would have to add the sewer and recycling increase to that total. I did not attend the Council meeting on Tuesday, November 22, 1994, but did watch the complete meeting on Channel 4. I did this on purpose so as not to let the emotions of the moment interfere with my trying to gain knowledge on this issue. All of you are to be commended as to your evenhanded reaction to the very abrasive attitudes displayed by some of the speakers, Many times I may be on th~ opposite side of some of you on issues, but I would nevertheless demand of myself the civility of behavior that each and everyone of you deserve. I would like to list for your review some points of concern that I, as a citizen and businessman in this community, see as affecting me in both roles. 1. Use of the 230 acre site if purchased for the water plant - I was never confused, as were some, that the water use fees would not be used for any purposes except debt retirement and costs of running the plant. However, the issue has been raised as to the possibility of eventually developing the area in some fashion, I remember reading a newspaper article some time ago listing various possibilities requested by various groups within our community including a park like area with nature trails, Councilor Kubby mentioned last evening something to that effect, I would oppose this for two reasons, The first is that any community based use would require tax dollars to implement and to maintain, I feel that those dollars could instead be used to reduce the monthly water and sewer payments which we all must pay, If the council wants to consider expanded use of the site, either in the near future or even years down the road, I think you should explain that stance publicly and explain where you intend to get the funding and justify f" - I " ~,\O't -~ ..',- ~'- - ~ "'.0 i.)..".:: 'I .,- " I"'" 10, ,it:. ;", .) ,r.r.T~l ;--:-- (, "\ [ -', ., I \; ~ ;-'-?~ , r ' : I~ I i I ! . The second reason I oppose this is that I feel that if any other type of development on this land is reasonable and feasible, be it parking lot or structure, that the present owners of the land should be allowed, as part of the condemnation settlement, the exclusive right to pursue this development, To do otherwise seems to me would be a grossly unfair way of implementing condemnation proceedings. 2, The possible use of alternative sites - I have heard through last night's discussion and from comments within our community that there may be alternative sites for a possible location, They include the area south of town where test drilling has occurred, the Coralville Reservoir, a site just south of 1-80 which supposedly someone is willing to sell (I have never heard of it's exact location) and our municipal airport. If all of these sites and perhaps others which have already been considered and rejected as not being feasible either economically or geologically, I think that each option should be pUblicly explained as to the reason for its rejection. At my prior place of employment, I was involved to some extent with water treatment and waste water treatment plant construction. I have observed that there were, at times, several alternative solutions which were not raised due to the parameters given to the engineer by the municipality. What might have made sense originally may, due to the current public outcry, not be valid now, Perhaps it is time to think about "reinventing the wheel" (usually a process to which I am opposed). An overall review by Howard R Green & Stanly Consultants, not just of the current proposed design and it's parameters, but also of the basic assumptions used to start the current design process might yield a better more sellable and cost effective solution. I certainly do not have the expertise to claim that this would be the case, I am only suggesting that you consider that premise, 3. Questions which might be answered are: Do we really have time to stop the process and take a hard look at alternatives? When do specific monetary penalties come in to play and what exactly are their amounts? Is an appeal process for implementation possible within our time constraints? Does it make economic sense to incur some monetary penalties in the short term to save additional dollars by a redesign/relocation of the proposed plants? Do we hav~ time to assess the mood of the newly elected Congress as to their attitude on rescinding "unfounded mandates" which may allow us some financial relief? Do ~le, as a community, have time to launch a hopefully massive lobbying effort to Congress to perhaps receive some financial relief? Do we have enough time to monitor the bond markets so as to issue our bonds at the most advantageous time in order to reduce interest costs? I believe that the total costs including interest need to be explained to our community. Again, if time can be taken to take advantage of fluctuating bond markets, this should be explained. Maybe the citizens want to ask the council to wait 6-12 months or more to catch a favorable bond market even if that puts our community at risk for fines. Can city staff provide the community with several ll~lhat if" scenarios? I am also unclear as to the extent that the pipeline will add to the total costs, Has Howard R Green studied the various alternatives ie: relocate the plant, relocate the pipeline, necessary protective measures needed to be taken on either? If no provisions for these costs has been made, surely someone at Howard R Green is knowledgeable enough to make a guess. If an additional cost has to be added to the current estimate, might it not be less expensive to change the system and go to another site? If not, could not council explain that fact with hard figures? Can someone estimate the cost of litigation with the present owners even if the city if 100% successful? What about a "worst case" scenario if the present owners win? How much will it cost in downtime for our entire water system if a pipeline disaster (rupture, fire, etc) does happen? I would hope that someone can clearly discuss what measures the city has taken to lessen these problems and what exposures, if any, still remain. 5, Alternative Financing Methods - While I surely would admit I can afford any planned increase, I am curious as to how the "avera~e'l 750 gallon usage was established. I checked the usage on our last bill and it was 1300 gallons. If the usage is based on 750 gallons/month, then I am okay as mine was a two month reading, If not, I do not see how I can lower my personal usage as there are just the two of us at home. My wife does approximately two loads of laundry per week and we rarely water our lawn. It would be nice to have a clarification on the usage, I have a real problem with the proposed change in the current based rates to a level rate no matter what the usage. On the surface it seems to espouse fairness, However, I as well as many members of the business community, remain very skeptical of such changes. I feel that there is a great likelihood of another agenda being played out behind the scenes. It is the same issue of "no growth" vlhich the business community opposes, One of the guiding principles of setting reduced volume rates for water, sewer (public), gas, electricity, telephone and telecommunications (private) is to attract and to keep industry. To reverse that policy would dramatically alter the cost of producing a product or service for the large volume users, Common sense will tell you that businesses have to assess "all costs" when they seek to relocate to or expand in a community, This l'Iill be a great "dis-incentive" for our community, Ask Iowa-Illinois if they would ever consider modifying their rate structure as you are considering doing. More insidious to me is the very real possibility that our good corporate community members such as Proctor & Gamble, United Technologies and General Mills to name a few, may have to reevaluate their viability to do business in Iowa City. In my opinion, even the remote possibility of that happening is disastrous and terribly short sighted, How can anyone even contemplate adopting a policy which could create such a jolt to our local economy in terms of lost property taxes, unemployment and additional __ pressure on social services resources, Some of you may feel ~ that I am an alarmist or that I am spouting the old Chamber e.:.~ ci:) ~!i,~ommerce party line. I have chosen instead to put my thoughts down on paper for your consideration. I am very concerned about the proposed increases in our bills for water and sewer. We moved into a new home in Iowa City after 17 years in Coralville and, frankly speaking, I feel like moving back to Coralville, I had not envisioned buying a new home and then having to worry about an excessive water and sewer bill, Quite honestly I would find ways to cut back on usage so as to soften the blow of these increases. I am sure others would also and it is naive of the council and city manager to believe otherwise, in spite of your warnings about this to the people of Iowa City, For the record there are two in our household and I have calculated that our bill would go from $80 to $110 to $150 with the proposed increases. I can't imagine what a large family or retired persons on fixed income must face, Now that I have the griping out of the way I do have some specific proposals for your consideration. I agree with Ed Barker to a great extent that we should wait till the new congress is in session and present this problem of federal mandates without appropriate funding. Our senators and representative must be involved in this either to the extent of modifying the law or providing some federal money. I think the same is true of the state in terms of providing money. I look at all the money we pay in taxes-income, property sales, etc and I am livid that that we are not able to get some of that back to help finance this project. The 5% sales tax on our water is even more irritating in view of the what is happening. I really believe that if you are unable to accomplish anything in this regard that we as city should simple say "no" and make a real issue of this with the press and the whole country. I also believe that somehow property taxes must come into play here. There are two aspects of this, First of all, if you were to add some sort of special assessment or simply increase the taxes, then the actual amount would be decreased by virtue of the deductibilty on the federal and state tax forms, In essence we would be getting some our money back from the government, Our water bill increase is not deductible. Secondly, in relation to the property tax issue, I think the city must do detailed review of the city budget and eliminate some programs with the savings diverted to the water project, As a nurse one of our standard approaches is a priority system- we do what is more important first and tasks of lesser importance are done later. I have also have a few suggestions for other sources of income, Since the contractors and developers have increased the demand for the water and sewer you should asses them all a one time fee of $2500-5000 and designate ALL this to the water/sewer plants, This would include the subcontractors-painting, electrical, plumbing, and heating, The realtors also make a lot of money by new people moving here and increasing the demand. I suggest a 5% tax on real estate commissions, A $100,000 sale at 6% equals $6000 x 5% equals $300. I'm sure with the housing turnover here that this would generate a considerable sum, In this case and the previous suggestion the amount taxed would be deductible as a business expense and the actual amount paid would be less because of the deductibilty on the tax forms. The city would again be diverting money from the state and federal government to itself, I also believe the local sales tax option should be considered so out " of town visitors could share the expense. I was recently in Council I'~'" Bluffs and they have such a tax as does Iowa County, You might speak with representatives there to assess the impact on business. I have not heard anything about the possibility of restructuring the present water plant, If The Russians can retool an armament factory into making sausage, I would think we could do something with what we have and build a second smaller cheaper plant as a backup and for increased demand, .". .1 c-,. \ " I am also very nervous about the proposed location being so close to the oil pipeline, This does not seem very prudent, In closing I do appreciate the time and effort you have spent on this project. Never lose sight of the fact that your allegiance is to the people of Iowa City and not to the state or federal beauracracy. I read and hear that the "average" residence uses 750 cf of water each month. It seems that someone is using most of my "average amount". I am charged the minimum fee of $45.73 for the two month period. I have been told the minimum fee charged is for the minimum cf used, which is 300 cf. If I did use 300 cf, which I don't, that would mean I only used 150 cf each month not 750 cf. Seems I am charged for several cf that I am not using. Guess in this case it doesn't pay to conserve. Or just maybe if more residents would conserve we would not need to be building such a large facility. Also, what ever happened to the thinking that you should only pay for what you use? How do you think widowed, senior citizens on a fixed income will be able to pay these enormous bills. Especially when they are paying for a lot that they are not even using. The technology available now makes it so we can measure and test not only for so many more things, but also to test the amounts rather than. for 1 in a million, but for 1 in a billion and it perhaps will go to 1 in a trillion in the future. Even though it has not been proven that some of these things are harmful, we still have to treat the water as though they are. This all costs lots of money and we must use more and more techniques to treat the water. There is some movement on the part of EPA that they need to be more practical and reasonable rather than the attitude that we can test for all of these added things and can test for more minute amounts. I believe their intentions are good but they do not know how much water a person would have to drink each day for how many years to possibly be exposed to something that might cause cancer. We maintain a continuous educational program for our employees so that chemicals are always handled properly. In the past the environmentalists have probably . wielded too much influence, but they seem to be becoming more realistic in what they think is in the best interest of the most people. (Six responses were along these lines.) No. We have a high water quality to start with so we have very little difficulty in maintaining our water supply to high standards. (Three responses were along these lines.) Officials from the other five cities either had no comment or I failed to ask the question. It appears that DNR officials would be willing to listen to any reasonable proposal in order to carry out the desired construction in a manner that could 'accommodate our concerns as well as providing for the construction of the waste water treatment plant addition in a timely manner. Also, from all of the people I have talked with who are knowledgeable about the water treatment plant, including both Iowa City officials and DNR . officials, we are under no mandates, current or pending, that require action now or in the near future. Successful negotiations with the DNR, particularly in regard to the Waste Water Treatment Plant addition, are in no way guaranteed. However, I believe they are willing to listen to a definitive proposal that, if accepted, could allow for the rate structure and financing to take place along the guidelines in the attached schedules. The attached schedules allow for the following assumptions: 1. The construction of the water plant would be delayed five years. The construction of the waste water plant addition and associated sewer work would be delayed 2 years. 2. The water rates would be increased beginning in 1995 at the rate of 11% per year for years 1995-2001. A rate increase of 2.6% would take place in 2002 with no rate increases associated with the construction to take place after 2002. 3, Waste water rates would be increased by 11% from 1995 through 1998, This rate would increase by 1.6% in 1999 with no further rate increases anticipated for construction. 4. The funds escrowed would be used to reduce the amount borrowed for construction and would earn interest at an average rate of 6.00%. Currently, local banks interested in borrowing these funds would pay interest rates varying from 6.5% to 7,25% on such funds based on a three year maturity date. 5. These schedules assume a 3% inflation rate per year during the delayed period of construction. 6. The escrowed money would be used as a "down payment" on the two projects, 7 . Beginning in 1999 in the Waste Water Revenue Account and in 2002 in the Water Revenue Account significant surpluses would accrue. That, along with additional revenue due to new construction, could be used to pay for normal increases in operating costs, to replenish accounts depleted due to con~truction, and could be placed in escrow to pay for the eventual phasing out of the North Waste Water Treatment Plant. Position Statement of the Greater Iowa City Apartment Association on the Proposed Sewer and Water Projects December 1, 1994 1. The Greater Iowa City Apartment Association is comprised of persons who either own or manage residential rental properties in the Greater Iowa City Area. In Iowa City, our members own or manage in excess of 50% of all rental units, 2. Our Association is extremely concemed about the consequences of the abrupt doubling of sewer and water costs. Because these costs will be passed on through as rent increases, the real impact will be to significantly raise the costs of living in Iowa City for everyone who rents. Based on analysis by some of our members, we estimate this increase to be in $10-$12 per month per person range or at least $20-$24 for the average two bedroom unit. 3. Water and sewer costs are not the only significant cost increases facing rental properties. Property taxes on residential rental properties for the 1993-94 tax year payable in 1994-95 have increased about 11.5% or approximately $10 per month per unit. This is another cost that will indirectly be paid by tenants in the form of rent increases, 4. Significant numbers of these renters are on the lower end of the income ladder in this community, If the City Council votes to proceed with the major sewer and water improvements, we feel that you must find a way to implement these cost increases gradually, not over a thirteen month period as proposed. CITY COUNCIL December 6, 1994 THROGMORTON, KUBBY UNIFORM RATE INCREASE PROPOSAL All the major cities in Iowa have a declining scale for large utility usersl~th a uniform rate. The costs are passed onto the consumers in the form of higher rents and increased prices on goods and services. The people hurt are the poor people on fixed incomes, students, and apartment owners. We already live in the least affordable place in Iowa. Business and industry would take a big hit. Big companies provide the best possibility for growth and creating high paying jobs to keep graduates of the University of Iowa from moving out of state because they can not find employment here. Industry helps the middle class make a good salary, and pays for benefits for our citizens. Companies do a comparison analysis when choosing where they will locate. Cedar Rapids, North Liberty and Coralville are pro- business. If we pass this proposal, we would show that we are anti- business, and our competition would have a distinct advantage over us for something we desperately need: Good jobs and money to support our taxbase. Small towns have a uniform rate, but if a big company would come into their area, with 200-300 jobs, they would be smart enough to figure out that the company should get a declining scale for large utility use. The reasoning for this is: ., ,~( C---- \ r 1. Support their taxbase. 2. They realize the cost of delivery of water per unit goes down as the water usage goes up. 3. It is cheaper to send one bill to this company than to five hundred customers who use the same amount of water. ~ In closing, business and industry, that we now have, most likely will not expand their business and many will leave. ! Republican-led congressional conunittees will lean hard on regulators to take it easy on rulemaking or risk losing a chunk of their budgets.
