The Iowa Governor's Traffic Safety Bureau has awarded the Iowa City
Police Department a grant of $5,000 for the purchase of equipment and

to fund 200 hours of overtime traffic enforcement directed at OWl,
occupant restraint, speed and other moving .violation activity.
The first of this overtime enforcement activity will be conducted
during the month of Dec~mber 1994. The focus will be on the apprehen-
sion of intoxicated drivers.

WASTEWATER ORDINANCE
",
I wanted to highlight the changes that were made at the last City Council meeting regarding the
wastewater services ordinance. All references to a rate increase on March 1, 1996, have been
deleted, The delinquent sanitary sewer service account fee proposed at $5.00 is changed back
to the original amount of $3.00. The delinquency deposit fee was changed to read an amount
equal to the average month's billing for the delinquent account. This is a change from twice the
average month's billing. That is my understanding of the changes to the wastewater ordinance.
WATER SERVICE ORDINANCE

All references to a rate increase March 1, 1996, have been taken out. The minimum monthly
usel' charge for water service for the first 200 cubic feet or less of water used based on meter
size was increased by 24%, 6/0 meter. $5,30 to $6.57,

I have received some questions from several Council members on what the City invests their
money in light of the Orange County bankruptcy which was due in part to investing funds in
derivatives. I want to assure you that the City is not investing their funds in any risky investment.
The Iowa Trust scandal which occurred a couple years back prompted new legislation to be
enacted in the state of Iowa concerning governmental entities investing their funds. The new laws
are pretty simple in that in the City of Iowa City's case we can invest in certificates of deposit
within Johnson County or an adjacent county or in government securities, direct obligations of the
federal government or its agencies. The City can also invest in the state investment pool called
IPAIT as well as money market accounts,
All the funds that are invested in certificates of deposit, IPAIT or money market accounts are
collateralized to 10% higher. than the amount invested in the particular institution, which is per
state law. The government security investments are direct obligations of the federal government
and the securities are held in safekeeping at Iowa State Bank,
I have enclosed an investment portfolio report for the City of Iowa City as of December 9, 1994,
and it shows the investments that the City has in order of maturity and the amount invested in
anyone institution, including the type and the interest rate. Below is a summary of the

As previously discussed, John Rummelhart, Jr. filed the attached
Affidavit to Commence Initiative or Referendum proceedings with my
office on December 6.
After review of the attached in relationship to the procedures
outlined in Article VII of the Iowa city Charter please advise me
as to the following questions:
section 7.01. A (3') def ines ordinance. ' Does the resolution
attached to the Affidavit meet the definition?
section 7. 01.B (1) lists limitations. Does the subject matter
contained in the resolution meet the criteria?
section 7.03. E states the timing for filing of referendum
petitions. The resolution was passed on August 2, 1994. Does

WHEREAS, the City of Iowa City has undertaken a project to improve its water treatment and
water collection facilities, hereafter collectively referred to as the "Water Treatment Facilities"
or the "Water Treatment Facility;" and
WHEREAS, the City Council has determined that construction of the Weter Treatment Facility
is a valid public purpose under mte and federal law, and has fur-her determined that
acquisition of certain property rights is necessary to construct, operate, and maintain the

other "multiple shared uses" is hereby repealed.
BE IT FURTHER RESOLVED that we agree with the goal of
improving water treatment in'the City of Iowa City but only
if such improvement is done at a significantly lower cost
than that associated with Resolution No. 94-272. permission
is hereby granted to the Council to enact an alternative
Resolution for the purpose of the Water Treatment project
without regard to the two year limitation set forth in
Section 7.01(B) (3) of the Charter of the City of Iowa City.

Re: Legal Opinion Request: Whether the "affidavit to comtnence referendum
proceedings" signed by John R, Rummelhart, Jr, satisfies the requirements of
the Iowa City Charter
You have asked three questions as to the effectiveness of John Rummelhart, Jr.'s "affidavit"
to commence referendum procedures under the Iowa City Charter. The answer to all of your
questions concludes that the affidavit is not effective to trigger referendum proceedings under
the Iowa City Charter.
Because of the time constraints presented by the short time period needed to answer these
questions, namely that this memorandum must be completed by 9:30 a.m. on Friday,
December 9, 1994, I will answer your questions briefly, with a more detailed legal opinion to
follow.
Briefly, the affidavit in question attempts to submit the City's Resolution No, 94-272,
approved August 2, 1994, by the City Council, which authorized the acquisition of a water
treatment facility site at the location located north of Interstate 80 and west of Dubuque
Street, to Council reconsideration and then to the electorate, For reasons set forth herein, as
well as the more detailed memorandum to follow, I answer your questions briefly as follows,
1,
Does the challenqed resolution to authorize acquisition and/or condemnation
proceedinqs satisfy the definition of "ordinance" under the Charter provisions? .
The answer to your question is "no." While a resolution may, indeed, constitute an
"ordinance" under the charter referendum provisions, this challenged resolution is an executive
action which carries out the Comprehensive Water Facilities Plan approved by the City Council
in November 1993, by way of Resolution No. 93-316, That Comprehensive Water Facilities,
Plan envisioned designing a water treatment and distribution system, together with authorizing
a contract with consultant Horward R, Green to select the appropriate site for such treatment
project. Thus, since the challenged resolution is merely an executive action which "executes"
the prior-approved and existing Comprehensive Water Plan, Resolution No, 94-272 does not
establish a new plan and is thereby not an ordinance within the meaning of the charter,
2. Does the subiect matter of the challenqed resolution meet the criteria of the City
Charter?
The answer to this question is "no," As mentioned above, the subject matter is an executive
action, not a legislative action contemplated under the referendum provisions. Moreover, "any

measure of an executive or administrative nature" is explicitly exempt from referendum
proceedings, as well as "any measure required to be enacted by State or federal law ," ~ 7 ,0 1,
subparagraph B(1), Charter, As will be discussed in greater detail, the resolution was not only
carrying out the City Council's approved Comprehensive Water Plan, but also carried out
acquisition in order to comply with state and federal laws and regulations concerning clean
drinking water,
For both of these reasons, it is my opinion that the subject matter of the challenged resolution
does not meet the ,criteria of the referendum proceedings, as set out in the current City
Charter,
3,
Is the timina of the filina of the' affidavit sufficient to triaoer issuance of the petition
forms and collection of sianatures, for submittal to the Citv Council and possible
election?
The answer to this question is "no." The Charter clearly sets out that any attempt to
challenge City Council action must be submitted to the City Clerk no later than 60 days after
the City Council's action. As you can see from the resolution attached to John Rummelhart,
Jr.'s affidavit, the resolution authorizing acquisition and condemnation was approved August
2, 1994. The affidavit was received in your office December 6, 1994 - which is approxi-
mately two months too late.

As also discussed at the City Council meeting on December 6, 1994, the 60-day limitation
can only be changed by the City Council's amending the Charter, or by way of election after
a petition is submitted, with signatures. Unless and until such amendment occurs, the 60-day
limitation is still in effect.
I trust this will be helpful to you in this brief format, until I can submit a more detailed
memorandum to you next week.

Council member Pigott distributed information on October 21, 1994, regarding outdoor cafes, Assuming
outdoor cafes are establishments selling food or beverage outdoors; OR an establishment selling
alcoholic beverages outdoors; OR an establishment doing both, the City Code does refer to three
categories dealing with outdoor consumption of food and beverage. These three categories are
outlined below.
Plaza Cafes are outdoor cafes in City Plaza immediately adjacent to a restaurant (food service
establishment) and have certain seasonal and time restrictions. These establishments can sell
alcoholic beverages if they apply for outdoor service area status. Section 10-5-9 C. of the City Code
outlines further requirements. To date, no establishment has sought to take advantage of this
category,
Outdoor Service Areas are outdoor cafes on private property immediately adjacent, and accessible
only, from establishments possessing a beer or liquor permit. Currently we have eight within the City:
Gabe's; R.T.'s; Season's Best; Fitzpatrick's; Mumm's; Wig & Pen; Holiday Inn; and Bushnell's Turtle.
Section 4-3-1 C of the City Code outlines restrictions dealing with outdoor service areas.

Sidewalk Cafes are outdoor cafes on public right of way in CB-10 and CB-2 Zones and have certain
seasonal restrictions. No permit is given to any establishment licensed for sale or consumption of any
alcoholic beverages. A reference is made to sidewalk cafes in Section 10-3-1 and 10-3-2. Resolution
84-181 is also attached for your review. To date, no establishment has sought to take advantage of
this category.
A chart of the three categories is included for reference. This information is provided to you as
background, as well as present status, of outdoor cafes within Iowa City. Council needs to determine
if the present permit types are what you envision for the City. If not, direction needs to be given on

ON THE PUBLIC RIGHT-OF-WAY IN THE CITY OF IOWA CITY.
WHEREAS, it is desirable that certain businesses in Iowa City be allowed to
expand food services activities into outdoor service areas, and
WHEREAS', the City Council wishes to establish criteria to serve as a basis'
for its approval of the operation of said outdoor service areas, known and
referred to as sidewalk,cafes. '
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY that the
"REGULATIONS FOR THE' OPERATION OF SIDEWALK CAFES ON THE PUBLIC RIGHT-OF-WAY
IN THE CITY OF IOWA CITY t' attached to and made a part of this resolution,

REGULATIONS FOR OPERATION OF SIOEIIALK CAFES OIl THE PUBLIC RIGHT-
OF-WAY IN IOWA CITY
1. A sidewalk cafe is defined as a temporary, outdoor serv'te area used for v
the serving and consumption of food and beverages which are dispensed from
inside a restaurant to people seated at tables and chairs in the outdoor
area.
2. Permission to operate a sidewalk cafe on the public right-of-way shall not
be given to any business or establishment licensed for the sale, distribu-
tion, or consumption on the premises of any alcoholic beverage under
Chapter 123 of the Code of Iowa.
3. Sidewalk cafes will be permitted in the public right-of-way or on other
publicly-owned property O"~J in the CB-10 and CB-2 zones (the downtown and
the commercial areas d;,":tly north and south of the downtown).
4, The sidewalk cafe area must be adjacent to or directly in front of the
building housing the restaurant and utilization.of that area is subject to
the building owner's approval.
5. A sidewalk cafe area may not extend onto the sidewalk in a manner that will 'II)
not allow a minimtml of eight feet of unobstructed sidewalk remaining for .
pedestrian use: The eight foot unobstructed portion of the sidewalk should
be continuous, and contiguou~ with the adjoining sidewalks in such, a manner
as to provide uninterrupted, smooth passageway for,all pedestrians. If the
existing sidewalk is less than eight feet in width, no encroachment will be
permitted. On the City Plaza ~ a sidewalk cafe may use the area defined as 1/
Zone 1:
6. All tables and chairs in the sidewalk cafe area shall be set back, for
safety purposes; at 1 east ten feet from alleys and shall not be located in
a triangular area at street corners in which two of the triangle's sides
measure 20 feet in length along the curb lines from the point of intersec-
tion of the streets:
7. The area fo" a sidewalk cafe shall be temporarily delineated by rop~s or
sane other suitable meth'od which shall be clearly visible to pedestrms.
Tables, chairs, and other items are to be removed at the end of :a~h day's
operation and the sidewalk cafe area restored to its normal cond,tlon as a
pedestrian way. No materials shall be stored on the public right-of-way.
8. Sidewalk cafes shall not be allowed to operate before April 1 or after
'October 30 of any calendar year.

10. Pmplified sound equipment shall not be permitted. Additional advertising
or identification s ignage beyond that permitted for the ma in restaurant
shall not be permitted. Any amenities (such as chairs; tables: and
umbrellas) shall not have any advertising on their surfaces: Compliance
with the City noise ordinance shall be required:
11. A fee will be charged for the use of the publ ic right-of-way. The fee rate
will be set by resolution of the City Council.
12. The' use of public sidewalk space for sidewalk cafe purposes shall not be
subject to the zoning code. The Zoning Ordinance regulates only the use of
private property and not public property.
13. The sidewalk cafe, as part of a restaurant, must be licensed by the Johnson
County Board of Health.
14. Every sidewalk cafe operator shall be required to post sufficient insurance
as determined by the City and shall enter into an agreement holding the
City harmless against any and all liability arising frOO1 accidents or other
actions arising from its operation: '
15. An application for a sidewalk cafe shall contain: at a minimum; a plot
plan, a picture. or illustration of the amenities to be used', and the
seating capacity. In addition~ the application shall provide the name and
address of the owner of each imnediate abutting property'; App1 ications will 0
be handled by the City staff with the review and approval of any use of the
public right-Of-way, approved by the City Council as prescribed in the City
Code of Ordinances. The City will notify the irrm~diate abutting property
owners by letter of the nature of the application, and the date and time
this item will appear on the agenda for approval by the City CounciL If
the app1 ication is approved by the Council, the City staff will be respon-
sible for the administration of the agreement and collection of fees.
16. The operation of any sidewalk cafe as defined herein shall be in conformity
with all applicable Federal: State: and local laws and regulations: ,
17: A permit to operate a sidewalk cafe shall be granted only for the calendar
year in which application is received: Application shall be made at the
Civic Center on the standard app1 ication f~rm for the use of streets and
public grounds or for the use of City Plaza.
18: The City retains the right to withdraw: at its discretion~ permission for
the use of the public right-of-way for a sidewalk cafe at any time it deems
such withdrawal to be in the publ ic interest. The City may, afte! notice
to the permit holder and a reasonable opportunity for hearing, revoke
authori zat ion for the operation of a s idewa lk cafe for any estab 1 i shment
where excessive noise or other problems: as determined by the.City, result
directly from the operation of the sidewalk cafe. The revocatlon procedure
shall be initiated by the City Attorney fil ing an administrative hearing
C001ll1aint with the City Council. Written notice of hearing, as well as a
copy of said complaint, shall be served upon the permit holder at least 10
days prior to the date set for hearing. The hearing shall be before the
City Council and sha 11 be governed by the procedures as establ ished by
Sections 2-186 and 2-187 of the Code of Ordinances of the City of Iowa
City, Iowa.

Re: Manufactured Housing Fire Safety ~~ogram
As you may recall, $11,250 in 1994 Community Development Block Grant funds were allocated
to a Manufactured Housing Fire Safety program this year. To Implement this program the Iowa
City Fire Department, using these funds, recently purchased 500 smoke detectors and 200 fire
extinguishers to distribute to manufactured housing owners in Iowa City.
A flyer was sent to each manufactured housing owner (nearly 1000) explaining that one smoke
detector per bedroom and one fire extinguisher per home will be available at no charge. The
homeowner simply fills out a short questionnaire and stops by the Fire Department to pick up the
smoke detectors and fire extinguisher. If the homeowner is elderly or disabled they are asked
to contact the Elderly Services Agency which will assist with the distribution and installation of the
smoke detectors and fire extinguishers. To ensure that the equipment is properly installed, a
Community Development Division staff member will be calling and visiting each participating
home.

Iowa Zen Chanoyu extends its deepest appreciation for your efforts and support of
Flowers of an Autumn Harvest, Arts Close to the Earth in Iowa and Yamanashi,
Japan. The four-day event, by all reports, was an exciting one, appreciated widely
and one which engendered the very spirit of cultural exchange and harmony
between the two Sister States, for which we had hoped,

The length and complexity of the event required extensive cooperation among the
co-sponsoring elements and was successfully acheived with admirable sensitivity.
It has'been recognized that both artists and administrators were generous with their
efforts and contributions toward the creatition of a truely beautiful and delicate

is only through the joint and concerted efforts of all who participated that such a
subtle and elusive goal could be so fully attained, The ability and willingness of
the University of Iowa, the Iowa City Community, and nearby Midwest to sum-

Re: Parking in CB-5 Zone
As our diocussion of the CB-5 zone has progressed, the issue of parking requirements and
allowances has become more and more complex. We started with no required parking for
commercial development; however, parking was allowed at the developer's discretion. We are
now requiring that parking be provided and we have almost no allowance for discretion or
negotiation at a particular site. We plan to require that no more than 25% of the parking
requirement be allowed on-site and that 75% be covered with a parking impact fee. This fee will '
cover just a small portion of construction costs, Therefore, our parking fund (user's fees) will be
used to cover a large portion of the parking needs of new development in CB-5,
We also require that n,o more than 50% of the ground floor be devoted to parking and that the
remainder be commercial space. This requirement should encourage most parking to be located I Q,:",
below or above the ground level. This requirement should also encourage a more pedestrian- .
orientl;ld streetscape.

Our motives - to encourage redevelopment in an area that will serve as an extension of our
central business zone, to emphasize commercial development, and to design a pedestrian
streetscape - are all good ones for the future vitality of our city. I believe that our need for and
encouragement of a vital city with a strong downtown does not depend on complex parking
requirements, We can keep the total parking spaces unchanged and allow the site to be
designed with none or some or all of the parking on-site. We should keep the design
requirements: minimum setback, minimum height, minimum commercial space, etc, However,
the parking impact fees can be negotiated and collected on a case-by-case basis for each site
and its ability to meet our other goals for good design in our growing city and our expanding
downtown.
(As an aside, new development in downtown Minneapolis is required to have four levels of
parking underground for each building.)

Holiday Schedule

CITY OF IOWA CITY
City offices at the Civic Center will be closed Friday and Monday, December
23 and 26, 1994, in observance of the Christmas Holidays. A schedule of city
services is as follows:
Iowa City transit buses will operate on an hourly schedule on Friday and
Monday, December 23 and 26. The regular Saturday schedule will be in effect on
December 24.
Parking meters will be enforced and charges will be made for parking in the
ramps on December 23 and on the 24 until 5:00 P.M. After 5:00 P.M. on the 24th
and all day December 25 parking at the meters and in the ramps will be free.
Charges at the meters and in the ramps will again be in effect on December 26.
The Public Library will be open regular hours on December 23 and from
10:00 A.M. to 5:00 P.M. on December 24. The Library will be closed on December
25 and 26.
The Senior Center will be open holiday hours (10:30 A.M. to 3:00 P.M.) on
December 23, 24, and 26. On December 25, the Center will be open from 10:30 A.M.
until 1:30 P.M. Congregate Meals will be served each day.
The offices at the Iowa City Recreation Center will be closed from December

regular schedule. On December 24 the pool will close at 3:00 P.M. and the
remainder of the building at 5:00 P.M. The Cent~r will remain closed through
December 25 with a normal schedule starting on December 26.
Refuse crews will not be making collections on Friday, December 23, or on
Monday, December 26. The makeup schedule is as follows:
Tuesday, December 27 Friday route plus part of the Monday route
Wednesday, December 28 Remainder of the Monday route plus Tuesday route

The pickup of recyclables will follow the same schedule as the refuse crews.
Yardwaste crews will discontinue the collection of yard waste until

CITY OF IOWA CITY
City offices at the Civic Center will be closed Monday, January 2,
1995, in observance of the New Year holiday. A schedule of city services
is as follows:
Iowa City transit buses will not be operating on Monday, January 2.
Parking meters will be enforced and charges will be made for parking
in the ramps on Monday.
The Public Library will close at 5:00 P.M. on Saturday, December 31,
and will remain closed on Sunday, January 1. However, the Library will be
open normal hours on Monday, January 2.
The Senior Center will be open holiday hours (10:30 A.M. to 3:00 P.M.)
on Sunday, January 1. Congregate Meals will be served. However, the Center
will be completely closed on January 2. No Congregate Meals will be served.
The Iowa City Recreation Center will close at 5:00 P.M. on December 31
and will remain closed on January 1. The Center will be open on a normal
schedule on Monday, January 2.
The Iowa City Landfill will close at noon on Saturday, December 31,
and will remain closed on Sunday and Monday, January 1 and 2.
The Refuse crews will not be making collections on Monday, January 2.

In accordance with the State of Iowa regulations, Christmas trees cannot be
landfilled. They must be recycled.
The yard waste crew of the Refuse Division will start collection of Christmas
trees and bundled branches on Thursday January 5,1995 and will continue to
collect only Christmas trees and bundled branches until Tuesday, January 31,
, .
1995. They will not collect any bagged yard waste during this time since the
,chemical make-up of the Christmas trees includes an acid product which cannot
be chipped into the same mulch pile as the bagged yard waste. The yard waste
crew will resume the collection of bagged yard waste the first week of
February 1995.
Your Christmas trees should be placed on the curb by 7:00 A.M. on your
regular refuse collection day during the month of January so they can be
collected by the separate yard waste crew.
You need to remove plastic bags, ornaments, lights and the stand. ,We
aiso encourage you to remove all metal wrappings from wreaths and garlanos.
The chipoed christmas tree mLllch will be available to the public free of
charge at 1200 So. Riverside Drive beginning approximately the second week of
January and will continue to be available until the supply is exhausted.
Persons wishing to obtain some of the mulch should bring their own containers
and tools. There is no limit to the amount that can be taken.

December has been designated as the National Drunk and Drugged Driving
Prevention Month by a coalition of national organizations, including the
National Highway Traffic Administration. A decade of combined efforts by
the National Highway Traffic Administration, media, and many public and
private organizations and volunteers has demonstrated that prevention works
to reduce inlpaired driving. In 1993, 17,461 Americans died in crashes
involving drivers and pedestrians impaired by alcohol and other drugs.
This is the lowest figure in 30 years, but it is still unacceptably high.
The Iowa City Police Department is taking part in this nationwide effort to
emphasize the consequences of impaired driving, and conduct activities
supporting efforts to reduce preventable crashes on our highways. These
efforts are going to include additional officers working approximately 45
hours of overtime during the month of December, who ~lill be focusing their
efforts on the apprehension of impaired drivers. Funding for this project
was obtained from a grant provided by the Iowa Governor's Traffic Safety
Bureau. '
