'-' WASTEWATER ORDINANCE ", I wanted to highlight the changes that were made at the last City Council meeting regarding the wastewater services ordinance. All references to a rate increase on March 1, 1996, have been deleted, The delinquent sanitary sewer service account fee proposed at $5.00 is changed back to the original amount of $3.00. The delinquency deposit fee was changed to read an amount equal to the average month's billing for the delinquent account. This is a change from twice the average month's billing. That is my understanding of the changes to the wastewater ordinance. WATER SERVICE ORDINANCE . All references to a rate increase March 1, 1996, have been taken out. The minimum monthly usel' charge for water service for the first 200 cubic feet or less of water used based on meter size was increased by 24%, 6/0 meter. $5,30 to $6.57, '. r l" ",:, (~ ,~ rr , ~ I The monthly user charge for water in excess of 200 cubic feet per month increased by 40%, Again the delinquent water service account fee proposed at $5.00 was changed to $3,00. I want to assure you that the City is not investing their funds in any risky investment. The Iowa Trust scandal which occurred a couple years back prompted new legislation to be enacted in the state of Iowa concerning governmental entities investing their funds. The new laws are pretty simple in that in the City of Iowa City's case we can invest in certificates of deposit within Johnson County or an adjacent county or in government securities, direct obligations of the federal government or its agencies. The City can also invest in the state investment pool called IPAIT as well as money market accounts, All the funds that are invested in certificates of deposit, IPAIT or money market accounts are collateralized to 10% higher. than the amount invested in the particular institution, which is per state law. The government security investments are direct obligations of the federal government and the securities are held in safekeeping at Iowa State Bank, I have enclosed an investment portfolio report for the City of Iowa City as of December 9, 1994, and it shows the investments that the City has in order of maturity and the amount invested in anyone institution, including the type and the interest rate. Plaza Cafes are outdoor cafes in City Plaza immediately adjacent to a restaurant (food service establishment) and have certain seasonal and time restrictions. These establishments can sell alcoholic beverages if they apply for outdoor service area status. Section 10-5-9 C. of the City Code outlines further requirements. To date, no establishment has sought to take advantage of this category, Outdoor Service Areas are outdoor cafes on private property immediately adjacent, and accessible only, from establishments possessing a beer or liquor permit. Currently we have eight within the City: Gabe's; R.T.'s; Season's Best; Fitzpatrick's; Mumm's; Wig & Pen; Holiday Inn; and Bushnell's Turtle. A fee will be charged for the use of the publ ic right-of-way. The fee rate will be set by resolution of the City Council. 12. The' use of public sidewalk space for sidewalk cafe purposes shall not be subject to the zoning code. The Zoning Ordinance regulates only the use of private property and not public property. 13. The sidewalk cafe, as part of a restaurant, must be licensed by the Johnson County Board of Health. 14. Every sidewalk cafe operator shall be required to post sufficient insurance as determined by the City and shall enter into an agreement holding the City harmless against any and all liability arising frOO1 accidents or other actions arising from its operation: ' 15. An application for a sidewalk cafe shall contain: at a minimum; a plot plan, a picture. or illustration of the amenities to be used', and the seating capacity. In addition~ the application shall provide the name and address of the owner of each imnediate abutting property'; App1 ications will 0 be handled by the City staff with the review and approval of any use of the public right-Of-way, approved by the City Council as prescribed in the City Code of Ordinances. The City will notify the irrm~diate abutting property owners by letter of the nature of the application, and the date and time this item will appear on the agenda for approval by the City CounciL If the app1 ication is approved by the Council, the City staff will be respon- sible for the administration of the agreement and collection of fees. 16. The operation of any sidewalk cafe as defined herein shall be in conformity with all applicable Federal: State: and local laws and regulations: , 17: A permit to operate a sidewalk cafe shall be granted only for the calendar year in which application is received: Application shall be made at the Civic Center on the standard app1 ication f~rm for the use of streets and public grounds or for the use of City Plaza. 18: The City retains the right to withdraw: at its discretion~ permission for the use of the public right-of-way for a sidewalk cafe at any time it deems such withdrawal to be in the publ ic interest. The City may, afte! notice to the permit holder and a reasonable opportunity for hearing, revoke authori zat ion for the operation of a s idewa lk cafe for any estab 1 i shment where excessive noise or other problems: as determined by the.City, result directly from the operation of the sidewalk cafe. The revocatlon procedure shall be initiated by the City Attorney fil ing an administrative hearing C001ll1aint with the City Council. Written notice of hearing, as well as a copy of said complaint, shall be served upon the permit holder at least 10 days prior to the date set for hearing. To Implement this program the Iowa City Fire Department, using these funds, recently purchased 500 smoke detectors and 200 fire extinguishers to distribute to manufactured housing owners in Iowa City. A flyer was sent to each manufactured housing owner (nearly 1000) explaining that one smoke detector per bedroom and one fire extinguisher per home will be available at no charge. The homeowner simply fills out a short questionnaire and stops by the Fire Department to pick up the smoke detectors and fire extinguisher. If the homeowner is elderly or disabled they are asked to contact the Elderly Services Agency which will assist with the distribution and installation of the smoke detectors and fire extinguishers. To ensure that the equipment is properly installed, a Community Development Division staff member will be calling and visiting each participating home. City of Iowa City MEMORANDUM Date: December 9, 1994 To: City Council and City Planners From: Naomi Novick Re: Parking in CB-5 Zone As our diocussion of the CB-5 zone has progressed, the issue of parking requirements and allowances has become more and more complex. We started with no required parking for commercial development; however, parking was allowed at the developer's discretion. We are now requiring that parking be provided and we have almost no allowance for discretion or negotiation at a particular site. We plan to require that no more than 25% of the parking requirement be allowed on-site and that 75% be covered with a parking impact fee. This fee will ' cover just a small portion of construction costs, Therefore, our parking fund (user's fees) will be used to cover a large portion of the parking needs of new development in CB-5, We also require that n,o more than 50% of the ground floor be devoted to parking and that the remainder be commercial space. This requirement should encourage most parking to be located I Q,:", below or above the ground level. This requirement should also encourage a more pedestrian- . orientl;ld streetscape. I d \, " Our motives - to encourage redevelopment in an area that will serve as an extension of our central business zone, to emphasize commercial development, and to design a pedestrian streetscape - are all good ones for the future vitality of our city. I believe that our need for and encouragement of a vital city with a strong downtown does not depend on complex parking requirements, We can keep the total parking spaces unchanged and allow the site to be designed with none or some or all of the parking on-site. We should keep the design requirements: minimum setback, minimum height, minimum commercial space, etc, However, the parking impact fees can be negotiated and collected on a case-by-case basis for each site and its ability to meet our other goals for good design in our growing city and our expanding downtown. The yard waste crew of the Refuse Division will start collection of Christmas trees and bundled branches on Thursday January 5,1995 and will continue to collect only Christmas trees and bundled branches until Tuesday, January 31, , . 1995. They will not collect any bagged yard waste during this time since the ,chemical make-up of the Christmas trees includes an acid product which cannot be chipped into the same mulch pile as the bagged yard waste. The yard waste crew will resume the collection of bagged yard waste the first week of February 1995. Your Christmas trees should be placed on the curb by 7:00 A.M. on your regular refuse collection day during the month of January so they can be collected by the separate yard waste crew. Press Release /' December has been designated as the National Drunk and Drugged Driving Prevention Month by a coalition of national organizations, including the National Highway Traffic Administration. A decade of combined efforts by the National Highway Traffic Administration, media, and many public and private organizations and volunteers has demonstrated that prevention works to reduce inlpaired driving. In 1993, 17,461 Americans died in crashes involving drivers and pedestrians impaired by alcohol and other drugs. This is the lowest figure in 30 years, but it is still unacceptably high. The Iowa City Police Department is taking part in this nationwide effort to emphasize the consequences of impaired driving, and conduct activities supporting efforts to reduce preventable crashes on our highways. These efforts are going to include additional officers working approximately 45 hours of overtime during the month of December, who ~lill be focusing their efforts on the apprehension of impaired drivers. Funding for this project was obtained from a grant provided by the Iowa Governor's Traffic Safety Bureau. ' .....
