AN ORDINANCE VACATING A PORTION OF WATERFRONT DRIVE LOCATED SOUTH OF HIGHWAY 6 AND WEST OF THE CRANDIC RAILROAD RIGHT-OF-WAY. WHEREAS, the City of Iowa City has rezoned property located east of the Crandic Railroad right-of-way from Intensive Commercial, CI,l, to Community Commercial, CC-2, to allow the development of a retail center; and WHEREAS, the proposed rezoning and retail development in this area will result in an in- crease in traffic on Gilbert Street and Water- front Drive; and WHEREAS, in order to help ensure efficient and safe traffic circulation in this area it is necessary to reconfigure portions of Waterfront Drive; and WHEREAS, said reconfiguration requires the vacation of a portion of Waterfront Drive. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: SECTION I. VACATION. Location: South of Highway 6 and west of CRANDIC Railroad right-of-way. Size: Approximately 17,000 square feet. Surrounding land use and zoning: North - Vacant; CC,2, South - Commercial; CC,2 and CI-1 , East - Vacant; CC-2. West - Commercial; CC-2, Comprehensive Plan: General Commercial. SPECIAL INFORMATION: " Public utilities: Municipal Water and sanitary sewer lines are located within the right-of. way, Access: Access from the south is via Stevens Drive, Access from the west is via Gilbert Street. BACKGROUND: As the Planning and Zoning Commission will recall, the recent proposal to rezone property east of the intersection of Stevens Drive and Waterfront Drive from CI-1 to CC,2 to allow the construction of a Hy,Vee Food Store, was approved with the understanding that concerns regarding existing traffic conflicts on Waterfront Drive would be addressed. One of those identified conflicts was the existing railroad crossing over Waterfront Drive east of Stevens Street. The Commission reviewed the proposed vacation of a portion of Waterfront Drive in this area and that vacation is now being considered by the City Council. ',.. ,~' \,'.:1 " . ,','.".",;, '". ,.-.--' 2 of Stevens Drive and Waterfront would result in a great increase in traffic in this area, staff recommended that this portion of Waterfront Drive be reconfigured to minimize the amount of additional traffic that would be entering the intersection of Waterfront Drive and Gilbert Street. Staff is now proposing to address this concern by vacating a portion of Waterfront Drive as shown on the attached location map. ANALYSIS: Staff had considered proposing the vacation of Waterfront Drive from its intersection with Gilbert Street eastward to the southern boundary of the area now being proposed for vacation. Staff prepared a concept plan showing how the street could be vacated and the property could be turned over to the adjacent commercial properties for incorporation into their parking lots (the attached Exhibit A illustrates that concept plan), This plan was presented to the three property owners in the area who would be affected. It was the consensus of these property owners that the amount of additional parking that would be achieved was not sufficient enough of an incentive to encourage them to pursue the vacation of Waterfront Drive and the reconfiguration of their parking lots. It was the consensus of the property owners and staff that as an alternative, a vacation of the eastern portion of Waterfront Drive in this area would achieve the City's objective of preventing additional traffic from the proposed Hy-Vee development from entering the Gilbert Street intersection. The area now proposed for vacation is shown on Exhibit B. The east/west portion of Waterfront Drive located south of the Country Kitchen Restaurant and north of the Carlos O'Kelly's Restaurant would remain open, This would also allow for some of the right-of-way to be sold to adjacent property owners for their use. Although this alternative plan does not result in the consolidation of curb cuts on Gilbert Street as the plan illustrated on Exhibit A would have, it will help alleviate existing and potential traffic problems in the area that will result if the Hy-Vee development occurs. The subject right-of-way contains both municipal and private utilities, Therefore, a utility easement will be required over the entire vacated right,of.way, In the future, it is possible that the right-of-way will be sold to the adjacent property owners, including the owners of Carlos O'Kelly's restaurant and the former Robo Car Wash site. These property owners will be able to make use of the property for parking or other uses provided that no structures are built within the vacated right,of-way, All properties which currently have access to this portion of Waterfront Drive will continue to have access. However, access will be limited to one direction. Traffic entering the Country Kitchen property, Carlos O'Kelly's property and former Robo Car Wash property will have to enter and exit the area from Gilbert Street. Access to these properties from Waterfront Drive to the south will no longer be available. The property containing the former Gay's Meat Market and the southwestern entrance to the current Hy,Vee store will be accessible only from the south via Stevens Drive, Although this proposed vacation may result in diminished access for these properties, the general traffic flow in this area should be improved by the proposed vacation, 30'2 .._~-~ 'l" 'W ---, , -, '0.
