Comment: This project involves landscaping improvements along Highway 6 between the Iowa River and Broadway Street. e. Resolutions. oo~ -o~ (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO AFl'EST TO THE RELEASE OF LIEN REGARDING 'I1NO MORTGAGES FOR THE PROPERTY LOCATED AT 3309 TULANE AVENUE, IOWA CITY, IOWA. Comment: The owner of the property located at 3309 Tulane Avenue received assistance through the City's Housing Rehabilitation Program totaling $14,432. The financing was in the form of conditional occupancy loans. The loans have been paid off; thus the lien can now be released. July 16, 2002 City of Iowa City Page 3 -0~¢[ (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A PARTIAL RELEASE OF A PERMANENT SANITARY AND STORM SEWER EASEMENT LOCATED WITHIN THE VACATED WOOLF AVENUE RIGHT-OF- WAY. Comment: The City currently possesses a permanent storm and sanitary sewer easement over the entire easterly one-half of the vacated portion of the Woolf Avenue right-of-way south of McLean Street. This easement was retained over the entire portion of the vacated right-of- way when it was conveyed, as the actual location of the public utilities within the vacated right-of-way had not been determined. The owners of the vacated right-of-way have performed a survey to discern the actual location of the utilities such that those portions of the right-of-way subject to the easement but not necessary for the protection of the utilities may be released. This Resolution authorizes the execution of the Partial Release which releases the City's current easement over those portions of the conveyed right-of-way not necessary for the protection of existing public utilities. f. At its May 23 meeting, the Historic Preservation Commission recommended approval. Staff recommended approval in a memo dated May 31. This landmark designation will allow the Historic Preservation Commission to regulate exterior changes to structures on this property. (REZ02-00002) Comment: At its June 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the amended OPDH plan. Staff recommended approval in a memo dated June 20. This amendment will allow the reconfiguration of dwelling units within the Silvercrest development. Action: f. Public hearing on an ordinance changing the zoning designation from Medium Density Single Family Residential, RS-8, to Planned Development Housing Overlay, OPDH-8, for Windsor Ridge, Part 16, a 31.1-acre, 10-lot subdivision located north of Camden Road and south of Lower West Branch Road. (REZ02-00008) Comment: At its June 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the rezoning. Staff recommended approval in a report dated June 6. Consider an ordinance changing the zoning designation from Neighborhood Conservation, RNC-20, to Sensitive Areas Overlay-Neighborhood Conservation, SAO-RNC-20, for a 0.41-acre property located at 341 N. Riverside Drive. (REZ02-00004) (First Consideration) Comment: At its June 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the rezoning. Staff recommended approval in a report dated May 16 and in memoranda dated May 31 and June 14. This sensitive areas overlay is required due the presence of critical and protected slopes on the property. Approval will allow the construction of a 10-unit apartment building. Correspondence included in Council packet. Action: i.Consider an ordi~nce amending the Sensitive Areas Ordinance to reg~ate isolated wetlands. (First Consideration) Comment: At its May 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the propoSed amendments. Action: July 16, 2002 City of Iowa City Parle 7 ITEM 6. A LEASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND NEXTEL WIP LEASE CORP. FOR USE OF CAPITOL STREET PARKING RAMP SPACE FOR AN EQUIPMENT SHELTER AND SPACE ON THE EXTERIOR OF THE ELEVATOR PENTHOUSE FOR ANTENNA USE. Comment: Nextel WIP Lease Corp. seeks a lease agreement for use of space in the Capitol Street Parking Ramp for an equipment shelter to be located on the ground level of the Capitol Street Parking Ramp and space on the exterior of the elevator penthouse for antenna use for a term of five years with an option to extend the term for four successive five year periods. Rent for the initial five year period has been negotiated at $1,700 a month, with an increase of three percent over the rent payable during the immediately preceding year for each succeeding year. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE VOICE COMMUNICATIONS PHASE 2 OUTSIDE PLANT PACKAGE PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will include the installation of copper and fiber optic cable linking City facilities which is necessary for the voice system upgrade. The estimated construction cost is $395,750 and will be funded by Internal Service Funds, Enterprise Funds, Bond Funds, and Road Use Tax. a. PUBLIC HEARING o~-- ,~ .~D b. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE ANIMAL SHELTER HVAC PROJECT: PHASE II, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will involve resolving the cooling, humidity and temperature control issues in the Animal Shelter. The project will replace the existing 10 ton air conditioning unit with a new 12.5 ton air conditioning system and a new direct digital control (DDC) system. The estimated construction cost is $30,000 and will be funded with by Animal Shelter building Gift fund and General Obligation bond proceeds. a. PUBLIC HEARING /! ,=1%1 ,b. Comment: This project involves the construction of curb ramps in various areas throughout Iowa City. This project will incorporate requests from the public and areas identified as needing curb ramps through the sidewalk survey. AMENDMENTS TO THE FY02 AND FY03~'ANNUAL ACTION PLAN BUDGETS, THAT ARE SUB-PARTS OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS) AS AMENDED, AUTHORIZING THE CITY MANAGER TO SUBMIT SAID AMENDMENTS AND ALL NECESSARY DOCUMENTS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: At their May 16 and May 29 meetings, the Housing and Community Development Commission made recommendations to the Council that would change the allocation of FY02 and FY03 Community Development Block Grant and HOME investment Partnership program funds. A public hearing is required by the U.S. Department of Housing and Urban Development. (FIRST CONSIDERATION) Comment: The Board of Appeals held a public meeting on June 3, 2002 to secure input from. contractors, Members of the Iowa City Homebuilders were present at several Board meetings and provided valuable input to the ordinance and support for the amendments. Also, the Historic Preservation Commission has been informed of items discussed by the Board of Appeals and has provided valuable input to the ordinance as well as support for the amendments. A description of notable changes was included in Council's June 13, 2002 information packet. Staff recommends action to allow passage and publication by August 28, 2002. CONSIDER AN ORDINANCE AMENDING TITLE 7, CHAPTER t, FIRE PREVENTION AND PROTECTION, ADOPTING THE 2000 EDITION OF THE INTERNATIONAL FIRE CODE, REGULATING AND GOVERNING THE SAFEGUARDING OF LIFE AND PROPERTY FROM FIRE AND EXPOSION HAZARDS ARISING FROM THE STORAGE, HANDLING AND USE OF HAZARDOUS SUBSTANCES, MATERIALS AND DEVICES, AND FROM CONDITIONS HAZARDOUS TO LIFE OR PROPERTY IN THE OCCUPANCY OF BUILDING AND PREMISES IN THE CITY OF IOWA CITY; PROVIDING FOR THE ISSUANCE OF PERMITS FOR HAZARDOUS USES OR OPERATIONS; REPEALING ORDINANCE NO. 99-3869 OF THE IOWA CITY CODE AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 5, ARTICLE B, OF THE IOWA CITY CODE OF ORDINANCES, BY ADOPTING THE 2000 EDITION OF THE UNIFORM PLUMBING CODE, WITH CERTAIN AMENDMENTS, TO REGULATE THE PRACTICE, MATERIALS AND FIXTURES USED IN THE INSTALLATION, MAINTENANCE, EXTENSION AND ALTERATION OF ALL PIPING, FIXTURES, APPLIANCES AND APPURTENANCES IN CONNECTION WITH VARIOUS PLUMBING SYSTEMS, TO PROVIDE FOR THE ISSUANCE OF PERMITS AND INSPECTION OF PLUMBING INSTALLATIONS AND THE COLLECTION OF FEES, AND TO PROVIDE PENALTIES FOR VIOLATIONS. (FIRST CONSIDERATION) Comment: A public hearing is required when adopting a nationally recognized standard code or portions of such a code. CONSIDER AN ORDINANCE AMENDING SECTION t4, CHAPTER 5, ARTICLE D, MECHANICAL CODE, BY ADOPTING THE 2000 EDITION OF THE INTERNATIONAL MECHANICAL CODE PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, AND PROVIDING FOR CERTAIN AMENDMENTS THEREOF; TO PROVIDE FOR THE PROTECTION OF THE HEALTH, WELFARE AND SAFETY OF THE CITIZENS OF IOWA CITY, IOWA. (FIRST CONSIDERATION) Comment: The Board of Appeals held a public meeting on June 3, 2002 to secure input from contractors. Members of the Iowa City Homebuilders Association have been kept informed of all items discussed by the Board of Appeals during development of the local amendments. CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING AND HOUSING," BY ADDLING A NEW ARTICLE L ENTITLED "LICENSING" TO ESTABLISH A CENTRALIZED PROCEDURE FOR EXISTING LICENSING REQUIREMENTS AND TO ESTABLISH LICENSING REQUIREMENTS FOR THE DESIGN, INSTALLATION, AND MAINTENANCE OF FIRE SPRINKLERS AND FOR THE INSTALLATION AND MAINTENANCE OF FIRE ALARMS. (FIRST CONSIDERATION) Comment: The Board of Appeals held a public meeting on June 3, 2002 to secure input from contractors. Members of the Iowa City Homebuilders Association have been kept informed of all items discussed by the Board of Appeals during development of the amendment. The amendment will provide a centralized location in the Code for the procedures to license existing contractors and a new provision to require licensing of Fire Alarm Installers, Fire Sprinkler Installers and Fire Sprinkler Maintenance contractors. Contractors representing all trades involved have been kept informed of the licensing issues discussed by the Board and provided valuable input to the amendment. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING AND HOUSING," BY ADDING A NEW ARTICLE M ENTITLED "APPEALS" TO ESTABLISH A UNIFORM PROCEDURE FOR APPEALS OF THE BUILDING, PLUMBING, ELECTRICAL, MECHANICAL, AND FIRE CODES. (FIRST CONSIDERATION) Comment: The Board of Appeals held a public meeting on June 3, 2002 to secure input from contractors. Members of the Iowa City Homebuilders Association have been kept informed of all items discussed by the Board of Appeals during development of the amendment. The amendment will provide a uniform procedure for the Board of Appeals to hear appeals of the building, electrical, plumbing, mechanical and fire codes. Staff recommends action to allow passage and publication by August 28, 2002. ITEM 17. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT FOR THE IMPROVEMENT AND SALE OF LAND FOR PRIVATE REDEVELOPMENT BY AND BETWEEN THE CITY OF IOWA CITY, IOWA, AND THE PLAZA TOWERES, L.L.C. AND MARC MOEN, MONICA MOEN, AND MICHAEL MOEN. Comment: This resolution authorizes the Mayor to sign the Agreement between the Moens and the City for the redevelopment of Parcel 64-1A. The resolution assumes there are no competing proposals submitted which provide greater benefit to the City than the Moen's Plaza Towers proposal. Execution of this Agreement enables the Moens to proceed with design and construction plans for this project and to fulfill all the other requirements necessary precedent to conveyance of the land. Upon completion of all such requirements, the City is then obligated under this Agreement to convey the property and commit $6 million in TIF financing to the project. CONSIDER A RESOLUTION OF INTENT TO CONVEY 32,710 SQUARE FEET OF VACATED FRONTAGE ROAD RIGHT-OF-WAY ALONG THE FRONTAGE OF 801 HIGHWAY 1 WEST, AND SETrlNG A PUBLIC HEARING ON SAID CONVEYANCE FOR AUGUST 20. Comment: The City Council is currently considering passage and adoption of an ordinance vacating 32,710 square feet of vacated frontage road right-of-way along the frontage of 801 Highway 1 West. Staff and the Planning and Zoning Commission recommend that conditions related to combination of the owner's two adjacent properties into one parcel for the purpose of ensuring access to Ruppert Road, relocation of the current access point from Ruppert Road to said parcel, and landscaping of the Highway 1 frontage, be placed on this conveyance. The owner of the adjacent property at 801 Highway I West, has indicated their desire to acquire the property and agreement with these conditions. Because the property was previously dedicated to the City by the owner of 801 Highway 1 West, no additional consideration is being recommended by staff. This resolution declares the City Council's intent to convey the above property to in accordance with said conditions, and sets a public hearing on the proposed conveyance for August 20, 2002. CONSIDER A RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF o~t-~ UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, ~iDEWALK REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the home owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the home owner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the home owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of passage of the resolution. Comment: A revised Chapter 28E Agreement was executed by iowa City in connection with this project on January 12, 1999. Since that time there have been changes in project design, and Coralville, due its need to acquire property from the same property owner in connection with its First Avenue improvements, has taken the lead in property acquisition.
