Comment: The owner of the property located at 613 Ronalds Street, Iowa City, Iowa received assistance through the City of Iowa City's Housing Rehabilitation Program. Comment Ordinance No. 06-4245, was passed and approved by the City Council on December 12, 2006. This ordinance contains thirty-three amendments to certain provisions within Title 14, Zoning Code. However, certain incorrect references within Ordinance No. 06-4245 to specific sections and subsections enumerated within the Zoning Code result in the deletion of certain provisions within the Zoning Code that were not meant to be affected in any way. To amend the Zoning Code as intended, said incorrect references within Ordinance No. 06-4245 to specific enumerated sections and subsections within the Zoning Code should be corrected. It is anticipated that they will make a recommendation to prior to the February 6 City Council meeting. In a report dated January 18, 2007 Staff recommended approval subject to conditions designed to create a buffer between the proposed commercial zoning and adjacent residential development. Approval will allow this properly to be developed with commercial retail and related uses. Staff recommended approval in a report dated December 21. Approval will allow this unused street right-ot-way to be purchased by the adjacent properly owners. 1. CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: e/rJ')l'fDU/~fo;",(L Idc~ laM )/0 e) AMENDING TITLE 14, CHAPTER 5, ARTICLE J, FLOOD PLAIN MANAGEMENT ORDINANCE TO ADOPT THE RE-FORMATTED FLOOD INSURANCE RATE MAP. Comment: In September 2005, the Federal Emergency Management Agency (FEMA) issued an amended Flood Insurance Study (FIS) report and Flood Insurance Rate Map (FIRM) for Johnson County. The amended FIS and FIRM will be distributed in digital files for use in a computer mapping system. Paper copies of the FIRM ("panels") will still be available. The new digital format resulted in new panel numbers and an updated effective date for those panels. There is no change to the underlying boundaries of Special Flood Hazard Areas (SFHAs). (REZ05- 00025/SUB06-00020) (SECOND CONSIDERATION) g) Comment: At its December 21 meeting by a vote of 6-0 (Plahutnik absent), the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated December 21. The amendments include a revised phasing plan, removing McCleary Lane and replacing it with residential lots, revision of locations of shared driveways and revision of the Peninsula Code including the addition of two residential building types and revised building location standards. (SUB06-00009) Comment: At its October 28, 2006, meeting, by a vote of 6-0 (Terry Smith absent), The Planning and Zoning Commission recommended approval subject to staff approval of legal papers and construction drawings prior to Council consideration. Construction drawings and legal papers have been approved. Staff recommended approval in a report dated October 19, 2006. Approval will allow the development of a 4.91-acre, 4-lot commercial subdivision located east of South Gilbert Street on Southgate Avenue. Action: t/,r;~d'-vj,pe.c;/ tf!} '2) fA1.nr/ 8.-;0 h Pt!!.c r~ CONSIDER AN ORDINANCE AMENDING TITLE 4, ENTITLED, "ALCOHOLIC BEVERAGES," CHAPTER 5, ENTITLED, "PROHIBITIONS AND RESTRICTIONS," SECTION 4, ENTITLED, "REGULATION OF PERSONS UNDER LEGAL AGE" TO PROVIDE THAT SECOND AND SUBSEQUENT OFFENSE VIOLATIONS MAY BE BASED ON A PRIOR CONVICTION UNDER AN ORDINANCE FROM ANOTHER CITY OR COUNTY IN IOWA. (SECOND CONSIDERATION) Comment: The City's PAULA ordinance, section 4-5-4, allows for enhanced penalties for second and subsequent convictions. The earlier conviction can be based on violating the City ordinance or the state law. This amendment provides that the earlier conviction can also be based on an ordinance from another city or county in Iowa. Staff recommends expedited action. Comment: At its December 12, 2006 meeting, the Economic Development Committee recommended the Council support an application on behalf of BIOWA, a biobased trade association, for a grant of $48,000 in Community Development Funds through the Iowa Department of Economic Development. The City's only role is to serve as grant administrator, which will be done by the Economic Development Coordinator. Correspondence included in Council packet. (DEFERRED FROM 1/9) Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the Highway 6 & Gilbert Street Intersection Improvement Project. This project includes dual left turn lanes for northbound and southbound Gilbert Street, raised medians to improve traffic operations and access management, and other associated improvements. Comment: A portion of right-of-way partially owned by the City and partially owned by Johnson County is included as part of the City's planned improvements next spring & summer to Lower West Branch Road. Johnson County approves of and consents to the improvements; however, since both the City and the County are public entities, a formalized agreement is necessary pursuant to Chapter 28E.2 of the Code of Iowa (2005). CONSIDER A MOTION GRANTING A 60-DAY EXTENSION TO THE POLICE CITIZENS REVIEW BOARD FOR THE FILING OF THE PUBLIC REPORT WITH THE CITY COUNCIL ON COMPLAINT #06-03. Comment: Ordinance 97-3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance also provides the City Council to grant extensions of the 45-day reporting requirement for good cause. At their meeting of January 9, 2007, the Board requested an additional 50-day extension. Correspondence included in the Council packet. (See draft minutes in information packet).
