a. Consider an ordinance changing the zoning designation from Medium
Density Single Family, RS-8, to Historic Preservation Overlay-Medium
Density Single Family, OHP-RS-8, designating 3 acres of property located
at 747 West Benton Street a Historic Landmark. (REZ02-00005) (First
Consideration) (~
Comment: At its June 20 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the rezoning. At its May 23
meeting, the Historic Preservation Commission recommended approval.
Staff recommended approval in a memo dated May 31. This landmark
designation will allow the Historic Preservation Commission to regulate
exterior changes to structures on this property. Correspondence, and a
letter to staff from applicant requesting expedited consideration, included in
Council packet.

c. Consider an ordinance vacating 32,710 square feet of frontage road right-
of-way along the front of the property at 801 Highway 1 West. (VAC02-
00001) (Second Consideration)
Comment: At its June 20 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of vacating the right-of-way along the
frontage of 801 Highway 1 West, subject to conditions regarding
landscaping and access points and easements. Staff recommended
approval subject to conditions in a report dated May 16. Staff memorandum
included in Council packet. Applicant previously requested expedited
consideration.

14. This rezoning will allow the expansion of Oaknoll Retirement Residence.
Applicant previously requested expedited consideration.

Comment: At its June 20 meeting, by a vote of 7-0, the Planning and ~oning
Commission recommended approval of the rezoning. Staff recommended
approval in a repo~ dated May 16 and in memoranda dated May 31 and
June 14. This sensitive areas overlay is required due the presence of
critical and protected slopes on the properly. Approval will allow the
construction of a 10-unit apa~ment building. Correspondence from a~licant

ARTICLE A, BUILDING CODE, BY ADOPTING THE INTERNATIONAL
BUILDING CODE, 2000 EDITION, AND THE INTERNATIONAL RESIDENTIAL
BUILDING CODE, INCLUDING APPENDIX F RADON CONTROL METHODS,
2000 EDITION, PUBLISHED IN COOPERATION WITH THE INTERNATIONAL
CONFERENCE OF BUILDING OFFICIALS, BUILDING OFFICIALS AND
CODE ADMINISTRATORS INTERNATIONAL, INC., AND THE SOUTHERN
BUILDING CODE CONGRESS INTERNATIONAL, INC., AND PROVIDING
FOR CERTAIN AMENDMENTS THEREOF; TO PROVIDE FOR THE
PROTECTION OF THE HEALTH, WELFARE, AND SAFETY OF THE
CITIZENS OF IOWA CITY, IOWA. (SECOND CONSIDERATION)
Comment: The Board of Appeals held a public meeting on June 3, 2002 to
secure input from contractors. Members of the Iowa City Homebuilders were
present at several Board meetings and provided valuable input to the ordinance
and support for the amendments. Also, the Historic Preservation Commission
has been informed of items discussed by the Board of Appeals and has
provided valuable input to the ordinance as well as support for the
amendments. A description of notable changes was included in Council's June
13, 2002 information packet. Staff recommends action to allow passage and
publication by August 28, 2002.

ITEM 4. CONSIDER AN ORDINANCE AMENDING TITLE 7, CHAPTER 1, FIRE
PREVENTION AND PROTECTION, ADOPTING THE 2000 EDITION OF THE
INTERNATIONAL FIRE CODE, REGULATING AND GOVERNING THE
SAFEGUARDING OF LIFE AND PROPERTY FROM FIRE AND EXPLOSION
HAZARDS ARISING FROM THE STORAGE, HANDLING AND USE OF
HAZARDOUS SUBSTANCES, MATERIALS AND DEVICES, AND FROM
CONDITIONS HAZARDOUS TO LIFE OR PROPERTY IN THE OCCUPANCY
OF BUILDING AND PREMISES IN THE CITY OF IOWA CITY; AND
PROVIDING FOR THE ISSUANCE OF PERMITS FOR HAZARDOUS USES
OR OPERATIONS. (SECOND CONSIDERATION)
Comment: The Board of Appeals held a public meeting on June 3, 2002 and
June 11, 2002 to secure input from contractors. Members of the Iowa City
Homebuilders were present at several Board meetings and provided valuable
input to the ordinance. The Fire Department objects to allowing the use of
portable, outdoor fireplaces as proposed in Section 5. Staff recommends action
to allow passage and publication by August 28, 2002.

ITEM 5. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 5, ARTICLE
B, OF THE IOWA CITY CODE OF ORDINANCES, BY ADOPTING THE 2000
EDITION OF THE UNIFORM PLUMBING CODE, WITH CERTAIN
AMENDMENTS, TO REGULATE THE PRACTICE, MATERIALS AND
FIXTURES USED IN THE INSTALLATION, MAINTENANCE, EXTENSION
AND ALTERATION OF ALL PIPING, FIXTURES, APPLIANCES AND
APPURTENANCES IN CONNECTION WITH VARIOUS PLUMBING
SYSTEMS, TO PROVIDE FOR THE ISSUANCE OF PERMITS AND
INSPECTION OF PLUMBING INSTALLATIONS AND THE COLLECTION OF
FEES, AND TO PROVIDE PENALTIES FOR VIOLATIONS. (SECOND
CONSIDERATION)
Comment: A public hearing is required when adopting a nationally recognized
standard code or podions of such a code. The Board of Appeals held a public
meeting on June 3, 2002 to secure input from contractors. Members of the iowa
City Homebuilders were present at several Board meetings. A description of
notable changes was included in Council's June 13, 2002, information packet.
Staff recommends action to allow passage and publication by August 28, 2002.
ITEM 6. CONSIDER AN ORDINANCE AMENDING SECTION 14, CHAPTER 5,
ARTICLE D, MECHANICAL CODE, BY ADOPTING THE 2000 EDITION OF
THE INTERNATIONAL MECHANICAL CODE PUBLISHED BY THE
INTERNATIONAL CODE COUNCIL, AND PROVIDING FOR CERTAIN
AMENDMENTS THEREOF; TO PROVIDE FOR THE PROTECTION OF THE
HEALTH, WELFARE AND SAFETY OF THE CITIZENS OF IOWA CITY,
IOWA. (SECOND CONSIDERATION)
Comment: The Board of Appeals held a public meeting on June 3, 2002 to
secure input from contractors. Members of the iowa City Homebuilders
Association have been kept informed of all items discussed by the Board of
Appeals during development of the local amendments. Representatives of the
Homebuilders were present at several Board meetings. Staff recommends
action to allow passage and publication by August 28, 2002.

ITEM 7. CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED
DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING AND
HOUSING," BY ADDLING A NEW ARTICLE L ENTITLED "LICENSING" TO
ESTABLISH A CENTRALIZED PROCEDURE FOR EXISTING LICENSING
REQUIREMENTS AND TO ESTABLISH LICENSING REQUIREMENTS FOR
THE DESIGN, INSTALLATION, AND MAINTENANCE OF FIRE SPRINKLERS
AND FOR THE INSTALLATION AND MAINTENANCE OF FIRE ALARMS.
(SECOND CONSIDERATION)
Comment: The Board of Appeals held a public meeting on June 3, 2002 to
secure input from contractors. Members of the Iowa City Homebuilders
Association have been kept informed of all items discussed by the Board of
Appeals during development of the amendment. The amendment will provide a
centralized location in the Code for the procedures to license existing
contractors and a new provision to require licensing of Fire Alarm Installers, Fire
Sprinkler Installers and Fire Sprinkler Maintenance contractors. Contractors
representing all trades involved have been kept informed of the licensing issues
discussed by the Board and provided valuable input to the amendment. Staff
recommends action to allow passage and publication by August 28, 2002.
ITEM 8. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, ENTITLED
"UNIFIED DEVELOPMENT CODE," CHAPTER 5, ENTITLED "BUILDING
AND HOUSING," BY ADDING A NEW ARTICLE M ENTITLED "APPEALS"
TO ESTABLISH A UNIFORM PROCEDURE FOR APPEALS OF THE
BUILDING, PLUMBING, ELECTRICAL, MECHANICAL, AND FIRE CODES.
(SECOND CONSIDERATION)
Comment: The Board of Appeals held a public meeting on June 3, 2002 to
secure input from contractors. Members of the Iowa City Homebuilders
Association have been kept informed of all items discussed by the Board of
Appeals during development of the amendment. The amendment will provide a
uniform procedure for the Board of Appeals to hear appeals of the building,
electrical, plumbing, mechanical and fire codes. Staff recommends action to
a]low passage and publication by August 28, 2002.

ITEM 9. CONSIDER A RESOLUTION APPROVING FUNDING FOR THE ENGLERT
CIVIC THEATRE, INC, FROM IOWA CITY'S COMMUNITY DEVELOPMENT
BLOCK GRANT - ECONOMIC DEVELOPMENT FUND AND AUTHORIZING
THE CITY MANAGER TO SUBMIT ALL NECESSARY DOCUMENTATION TO
THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT.
Comment: The Council Economic Development Committee will be meeting prior
to the formal meeting and will make a recommendation on the Eng[ert Civic
Theatre, Inc. application. This local contribution will serve as a match for a V~s~on
Iowa/Community Attraction and Tourism grant.
