FILE FOR PUBLIC INSPECTION.
Comment: This project consists of the replacement of existing 6"
water main with new 8" water main along Newton Road, Valley Avenue
and Lincoln Avenue. It also includes associated removal and
replacement of existing PCC & HMA pavement, removal and
replacement of existing sidewalk and handicap ramps, traffic control,
grading, and seeding. The funding source is Water revenues.

Comment: This project consists of the removal and replacement of
existing PCC, HMA, and Brick pavement in association with the in-
house 2007 Water Main Replacement Program located at Golfview
Avenue (University Heights), Dewey Street, Laurel Street and Carrol
Street. It also includes the removal and replacement of existing
sidewalk and ADA Compliant handicap ramps in these areas. The
funding source is Water revenues.

CONSIDER A RESOLUTION NAMING DEPOSITORIES.
1.
Comment: This resolution includes the following changes:
a. We are recommending that the University of Iowa Credit Union be
added to the list of depositories with a depository limit of
$50,000,000.00. Investments at this institution would be
collateralized by the state sinking fund.
b. We are recommending that Optiva be removed from the list of
depositories.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN
REGARDING AN AGREEMENT FOR THE PROPERTY LOCATED AT
1029 BOWERY STREET, IOWA CITY, IOWA.
Comment: The owner of the property located at 1029 Bowery Street
received assistance with Community Development Block Grant (CDBG)
funds through the City of Iowa City for the start-up of a micro-enterprise
business. The loan has been paid off; thus the lien needs to be
released.

CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE
CAMP CARDINAL ROAD EXTENSION PROJECT - 2005.
Comment: This was a joint project with the City of Coralville that was
awarded and administered by the City of Coralville. Coralville has
accepted the project and Engineering Division recommends acceptance
the work.
9.
CONSIDER A RESOLUTION ACCEPTING USE OF SECTION
453A.22(3) AFFIRMATIVE DEFENSE TO TOBACCO CIVIL PENALTY
BY DELI MART #5, 206 E. BENTON STREET
Comment: Iowa Code Section 453A.22(2) provides that a civil penalty
will be assessed to a retail cigarette permit holder when and if that
permit holder's employee violates Iowa Code Section 453A.2(1) by
selling or providing tobacco to a minor. Iowa Code Section 453A.22(3)
provides an affirmative defense that, if established, prevents the civil
penalty from being assessed, provided the retailer can demonstrate the
employee who violated the law held a valid certificate of completion of
the tobacco compliance employee training program pursuant to Section
453A.5 at the time of the violation. An employee of Deli Mart #5 violated
Iowa Code Section 453A.2(1) by selling tobacco to a minor, but Deli
Mart #5 has provided information sufficient to establish its entitlement to
use of this affirmative defense. This Resolution accepts Deli Mart #5's
use of the affirmative defense to avoid the civil penalty stemming from
its employee's vtolation of Section 453A.2(1). It can use an affirmative
defense to avoid such a civil penalty only once in a four-year period.
10. CONSIDER A RESOLUTION ACCEPTING PAYMENT OF $300.00
CIVIL PENALTY AND WAIVER OF RIGHT TO HEARING FROM
JOHN'S GROCERY, PURSUANT TO IOWA CODE SECTION
453A.22(2) (2005)
Comment: This Resolution accepts payment of a $300 civil penalty,
authorized by Iowa Code section 453A.22(2), John's Grocery, 401 E.
Market Street. Section 453A.22(2) provides that a $300.00 civil penalty
will be assessed to a retail cigarette permit holder when and if that
permit holder's employee violates Iowa Code section 453A.2(1) by
selling or providing tobacco to a minor. By making this payment and
signing the appropriate waiver, John's Grocery waives its statutory right
to have a hearing on whether the civil penalty should be assessed.

11. CONSIDER A RESOLUTION ACCEPTING A WAIVER OF RIGHT TO
HEARING, SERVICE OF A THIRTY (30) DAY PERMIT SUSPENSION
AND PAYMENT OF A $1500 CIVIL PENALTY FROM HARTIG DRUG
COMPANY D/B/A HARTIG DRUG STORE, PURSUANT TO IOWA
CODE SECTION 453A.22(2) (2005)
Comment: This Resolution accepts a waiver of right to hearing, service
of a thirty (30) day retail cigarette permit suspension, beginning March
12,2007, and payment of a $1500 civil penalty, as set out in Iowa Code
section 453A.22(2), by Hartig Drug Company d/b/a Hartig Drug Store,
701 Mormon Trek Blvd. Section 453A.22(2) provides that, after a
hearing, a $300.00 civil penalty will be assessed to a retail cigarette
permit holder when and if that permit holder's employee violates Iowa
Code section 453A.2(1) by selling or providing tobacco to a minor. The
. civil penalty for the second time the permit holder's employee violates
Section 453A.2(1) within a two-year period is either $1500.00 or a thirty
(30) day retail cigarette permit suspension, at the option of the
permittee. The civil penalty for the third time the permit holder's
employee violates Section 453A.2(1) within a three-year period is
$1500.00 and a thirty (30) day retail cigarette permit suspension. This is
the third time within a three-year period that an employee of Hartig Drug
Store has violated Section 453A.2(1). By signing the appropriate
waiver, turning in its retail cigarette permit on the above date and paying
the $1500 civil penalty, Hartig Drug Store waives its statutory right to
have a hearing on whether the civil penalty should be assessed.

Comment: At its January 18 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval, subject to staff approval of legal papers
and construction drawings prior to Council Consideration. Staff recommended
approval in a report, dated December 21. Legal papers and construction
drawings have been approved. Approval will allow development of a 2-lot
commercial subdivision on approximately 3.38 acres of land located at 640
Highway 1 West.

AMENDING TITLE 3, ENTITLED "CITY FINANCES, TAXATION AN FEES,"
CHAPTER 4, ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS,
FINES, AND PENALTIES," SECTION 3-4-5, ENTITLED "SOLID WASTE
DISPOSAL," OF THE CITY CODE TO INCREASE OR CHANGE CERTAIN SOLID
WASTE CHARGES.
Comment: This proposed ordinance would increase solid waste collection fees by
approximately eight percent (8%). Currently the fee is $13.00 per month; the increase
would change the fee to $14.00, effective July 1, 2007. This action is necessary due to
annual increases in operational costs. The last fee increase was effective July 1, 2006.

PROVISIONS," BY AMENDING SECTION 5 TO ALLOW FOR DEPOSITS TO BE
BILLED INSTEAD OF PAID IN ADVANCE WITH PROPER PAYMENT HISTORY.

Comment: This ordinance amendment will allow for utility deposits to be billed instead
of paid in advance with proper payment history. This change is being made to
accommodate enhancements in the City's web capabilities which will soon allow
customers to sign up for utility services via the web. Persons with a poor payment
history with the City will still be required to submit their deposit in advance.

Comment: This agreement between the City of Iowa City and the Iowa Department
of Transportation provides for the financing of the Dubuque Street and Church Street
Intersection Improvements Project with the use of ,;:ammed Surface Transportation
Program (STP) funds in the amount of $500,000. ~

CONSULTANT SERVICES FOR THE FIRST AVENUE I IOWA INTERSTATE
RAILROAD CROSSING IMPROVEMENTS PROJECT.
Comment: This agreement authorizes NNW, Inc. to provide design engineering
services related to the First Avenue I Iowa Interstate Railroad Crossing Improvements
Project. The total cost of the agreement is $297,800. This will be funded by road use
tax funds.

the Senior Center Commission and indicated he would resign from Public Art if
appointed. On February 20th, Felling was appointed to the Senior Center

d) Consider motion acceptina correspondence from Alicia Trimble, and confirmina
her March 5 appointment to the Historic Preservation Commission.
Comment: At their formal meeting on March 5 Council appointed Ms. Trimble
to the Historic Preservation Commission. Staff later received correspondence
from Ms. Trimble changing information on her application. This item is being
placed on the agenda to accept the corrective information and allow
appointment to the Commission in light of the new information.
